YOU CAN USE THE STAR 9 OR RAISE YOUR HAND FEATURE IN THE PLATFORM TO BE RECOGNIZED.

AND IT IS THE CUSTOM AND TRADITION OF THE CITY COUNCIL TO HAVE AN INVOCATION AND RECITAL OF THE PLEDGE OF ALLEGIANCE PRIOR TO OUR MEETINGS.

Consider an ordinance canvassing the results of a General Election for the purpose of electing Council Members to Districts 1, 2, 4 and 5 of the City of Garland, Texas and for the purpose of submitting to the voters a proposition regarding the use of a portion of Hollabaugh Park as a library for an election having been held on November 3, 2020; declaring the results of that election; and providing an effective date. ]

COUNCIL, IS THERE ANY DISCUSSION? PLEASE VOTE. THANK YOU AND LET THE RECORD SHOW THAT THOSE THAT THAT IS PASSED UNANIMOUSLY FOR THOSE FOR THOSE OUT IN THE VIEWING PUBLIC, THIS IS THIS IS BASICALLY OUR PROCESS FOR FOR THE RESULTS OF OUR ELECTIONS, OUR CITY COUNCIL AND PROPOSITION ELECTION THAT WE HAD.

WE NORMALLY OBVIOUSLY LIKE EVERYTHING ELSE WE NORMALLY DO IN OUR LIVES.

WE DO THIS IN PERSON AND WE HAVE A SWEARING IN CEREMONY AND FAMILIES ARE CERTAINLY INVITED THIS YEAR.

OBVIOUSLY, THAT WAS A LITTLE DIFFICULT.

BUT WE DID TAKE THE OPPORTUNITY TO RECORD SOME OF THE SWEARING IN THAT WE DID PRIVATELY AND CARMA, IF YOU COULD RUN THAT VIDEO FOR ME.

I'D APPRECIATE IT.

WE ARE HERE TO WISH FAREWELL TO DAVID GIBBONS FROM DISTRICT ONE, DAVID RESIGNED EARLIER IN THE YEAR TO EXPLORE AND TAKE ANOTHER OPPORTUNITY HERE IN OUR CITY.

YOU KNOW, SEVERAL YEARS AGO, DAVID CALLED ME WHEN HE WAS GETTING READY TO RUN FOR COUNCIL. AND WE SAT DOWN AND TALKED AND AND I CAN'T REMEMBER WHAT I TOLD HIM, BUT I HOPE IT IT HELPED HIM SOMEWHERE ALONG THROUGH THE YEARS.

I CAN TELL YOU THAT I AM GOING TO MISS HAVING DAVID HERE ON THE COUNCIL.

HIS ATTENTION TO DETAIL, ESPECIALLY IN FINANCIAL MATTERS, IS UNMATCHED WITH ANYONE I HAVE SERVED WITH. AND SO THAT HIS LEVEL OF DETAIL AND REALLY HIS NO NONSENSE, THE WAY HE APPROACHES LIFE AND BUSINESS MATTERS AND CITY MATTERS IS REALLY GOING TO BE MISSED.

AND WE CERTAINLY WISH HIM WELL AND WE HOPE TO WORK WITH HIM DOWN THE ROAD.

DAVID, THANK YOU..

IF I MAY, I'LL TAKE THIS OFF.

MR. MAYOR, IT HAS BEEN MY DISTINCT HONOR, SIR, TO SERVE WITH YOU AND THE CURRENT MEMBERS OF THIS COUNCIL. IN ADDITION, I'D LIKE TO ALSO NOTE THAT I HAD THE PLEASURE OF SERVING WITH FORMER MAYOR LORI DODSON, AS WELL AS FORMER COUNCIL MEMBERS.

I WILLIAMS AND I CHERISH THOSE RELATIONSHIPS AS WELL.

I COULDN'T STAND HERE BEFORE YOU AND TALK ABOUT SUCCESSES IN THIS CITY WITHOUT MENTIONING THE CITY MANAGER, BRIAN BRADFORD AND HIS STAFF.

THE CITIZENS OF GARLAND ARE SERVED BY OVER TWO THOUSAND CITY STAFF MEMBERS WHO ARE HARDWORKING, COMMITTED TO DOING AN EXCELLENT JOB, COMMITTED TO DOING THE RIGHT THING FOR OUR CITIZENS AND PROVIDING EXTRAORDINARY CUSTOMER SERVICE.

AND NO, NO DEPARTURE COULD BE COMPLETE WITHOUT SAYING MY THANKS TO BOTH THE STAFF AND MR.

BRADFORD. AS I LOOK BACK OVER THE LAST FOUR PLUS YEARS THAT I'VE HAD THE PLEASURE OF SERVING ON COUNCIL, I THINK OF THE COUNCIL AND THE STAFF WORKING TOGETHER AS A TEAM.

AND DURING THAT PERIOD OF TIME WE'VE MADE SOME MAJOR ACCOMPLISHMENTS THAT I'M VERY PROUD OF. WE SAW A CHARTER ELECTION PASSED WITH NUMEROUS AMENDMENTS, NEEDED AMENDMENTS TO OUR CHARTER. WHEN I CAME INTO COUNCIL FOUR YEARS AGO, OUR STREETS AND ALLEYS AND ROADS AND SIDEWALKS WERE OF UTMOST IMPORTANCE.

EVERYONE WAS CONCERNED ABOUT THEM.

AND WE SAT DOWN AS A GROUP, AS A TEAM, AND WE SAID, WE WANT TO ADDRESS THAT.

AND FOUR YEARS AGO, WE ADOPTED A RESOLUTION THAT SAID WE'RE GOING TO FUND TWO HUNDRED MILLION DOLLARS FOR OUR STREETS, SIDEWALKS AND ALLEYS.

AND WE SET ABOUT A PATH TO DO THAT.

WE INCREASED FUNDING BY 300 PERCENT.

AND FOUR YEARS LATER, I'M VERY HAPPY TO NOTE THAT WHILE WE CERTAINLY STILL HAVE SOME CHALLENGES WITH OUR STREETS AND ALLEYS AND SIDEWALKS, THEY'RE MUCH IMPROVED BY THIS PROGRAM THAT WE WORKED TOGETHER TO COMMIT.

AFTER MANY YEARS OF DISCUSSION, MANY YEARS OF DEBATE, I'M HAPPY TO SAY GARLAND FINALLY HAS A DOG PARK, AND I'M GLAD THAT THAT GOT ACCOMPLISHED DURING MY TERM OF OFFICE.

WE SET FORTH AND ADOPTED A COMPREHENSIVE NEW SIGN ORDINANCE PROGRAM THAT NOT ONLY MEETS CURRENT STATE AND FEDERAL LAW, BUT ALSO ADDRESSED THE ONGOING SIGN POLLUTION THAT WE HAD IN GARLAND AT THAT TIME.

SO I'M VERY PROUD OF THAT AS WELL.

FOR OUR CITIZENS, WE HAVE ADOPTED AND PUT INTO PLACE A HOME IMPROVEMENT GRANT PROGRAM WHERE CITIZENS CAN GET GRANTS TO IMPROVE THEIR HOMES.

SAME THING IS TRUE OF OUR COMMERCIAL PROPERTY OWNERS THAT THEY CAN DO GRANT APPLICATIONS FOR IMPROVING THEIR FACADES OF THEIR BUSINESSES AND VERY TICKLED TO SEE THAT.

MOST IMPORTANTLY, OF RECENT, AND CONGRATULATIONS TO THE MAYOR FOR SIGNING THE AGREEMENT IS AFTER MANY YEARS OF ANGST OVER THE WAY THAT THE NORTH TEXAS MUNICIPAL WATER DISTRICT WAS CHARGING GARLAND FOR THEIR WATER.

THE COUNCIL TO THE LEADERSHIP OF FORMER MAYOR DODSON AND CURRENT MAYOR LEMAY HAS WORKED WITH THE OTHER CITIES, AND I'M GLAD TO REPORT THAT WE FINALLY REACHED AN AGREEMENT, I BELIEVE, THAT WAS JUST SIGNED LAST WEEK THAT WILL SAVE MONEY FOR GENERATIONS TO COME TO THE CITIZENS OF GARLAND.

NO ONE CAN REALLY REALIZE THE IMPACT THAT THIS NEW AGREEMENT WILL HAVE NOT ONLY ON OUR WATER SUPPLY, BUT ALSO THE COST OF THAT WATER.

AND LAST MOST IMPORTANTLY, I THINK THAT WE GOT ACCOMPLISHED IN THE LAST FOUR YEARS WAS THE FOUR HUNDRED AND TWENTY THREE DOLLARS MILLION BOND PROGRAM THAT THE CITIZENS OVERWHELMINGLY APPROVED IN TWENTY EIGHTEEN AND THE COUNCIL NOT ONLY WORKED HARD AND DILIGENTLY WITH THE CITIZENS AND WITH THE STAFF TO GET THAT BOND PROGRAM PRESENTED AND PASSED. THEY'VE ALSO MADE THE COMMITMENT TO IMPLEMENT THAT BOND PROGRAM AS QUICKLY AS POSSIBLE. AND WE'RE ALREADY SEEING THAT IN TERMS OF NEW PROJECTS THAT ARE HAPPENING TODAY. AND I KNOW THIS COUNCIL CONTINUES TO BE DEDICATED TO SEE THAT BOND PROGRAM COMPLETED WITHIN THE NEXT FIVE TO SEVEN YEARS.

I'M VERY EXCITED TO SEE THAT THE CITIZENS WISHES ARE BEING FOLLOWED BY THE COUNCIL.

IN CLOSING, I'D LIKE TO SAY ONCE AGAIN, IT HAS BEEN MY DISTINCT HONOR TO SERVE THE CITIZENS OF GARLAND AND PARTICULARLY THE RESIDENTS OF DISTRICT ONE.

I AM HUMBLED, CONTINUALLY HUMBLED BY THE SUPPORT THAT I RECEIVED DURING MY TERM ON THE COUNCIL. IT IS A PERIOD OF TIME THAT I WILL CHERISH FOREVER.

WE'VE MADE A LOT OF PROGRESS.

I'M VERY PROUD OF THE WORK THAT THIS COUNCIL HAS DONE HARMONIOUSLY, AND I GIVE GREAT CREDIT TO THE OTHER COUNCIL MEMBERS THAT I'VE SERVED WITH INTO MAYOR LEMAY, AND TO MAYOR DODSON. WE HAVE WORKED HARD TO SOLVE THE MOST NETTLESOME PROBLEMS IN THE CITY.

WE'VE WORKED HARD TO IMPLEMENT THE BOND PROGRAM.

WE HAVE MUCH WORK AHEAD OF US.

I WOULD LIKE TO GIVE CREDIT, THOUGH, TO THE RESIDENTS OF THE CITY, THE RESIDENTS OF DISTRICT FIVE, WHO HAVE SO GRACIOUSLY SUPPORTED ME, SOMETIMES LESS GRACIOUSLY THAN OTHERS. BUT I HAVE APPRECIATED THEIR INPUT AND THEIR IDEAS AT EVERY TURN.

YES, IT DOES, BECAUSE THE APPLICANT INCREASED THE LOT SIZES AND THEREFORE THE SIGN SETBACKS THAT--.

BUT IN MOST CASES, WHAT WE'VE DONE SO FAR IS THE TRADE OFF IS THE GDC DEVIATIONS THAT THE APPLICANT IS ASKING FOR.

ESSENTIALLY THE TRADE OFF IS THE CITY GETS THE PROMISED BUILDING MATERIALS WHILE THE APPLICANT GETS THE DEVIATIONS IN THIS CASE FROM THE LOT SIZES AND WHATNOT.

ON THE SITE ITSELF.

THIS WAS AN OLD SINGLE FAMILY LOT THAT WAS DESTROYED BY THE TORNADO FIVE OR SIX YEARS AGO. AND SO IT HAS JUST BEEN A VACANT LOT SINCE THAT POINT.

YOU SAW SOME PICTURES FROM STAFF.

IT'S KIND OF BECOME OVERGROWN.

THERE'S JUST FOUNDATIONS LEFT AT THIS POINT.

AND SO WE ARE PROPOSING TO COME IN THERE AND DEVELOP THAT INTO THE SUBDIVISION YOU SEE NOW.

THE PROPERTY ON ALL THREE SIDES WAS ACTUALLY AN OLD CHURCH THAT WAS ALSO DEMOLISHED BY THAT SAME TORNADO, HAS NOT BEEN REBUILT YET, BUT THAT'S THE UNOCCUPIED STRUCTURE THE STAFF WAS REFERRING TO.

AND SO JUST KIND OF A BRIEF HISTORY ON THAT.

WE STARTED PUTTING THIS PLAN TOGETHER.

OBVIOUSLY, IT'S ONE ACRE SITE, WHICH IS NOT A WHOLE LOT OF ROOM TO WORK WITH, BUT WE THINK WE HAVE COME UP WITH A PLAN THAT REALLY CAN BE SUCCESSFUL AND BE A GOOD ADDITION TO THE CITY. THE COUPLE OF RESTRICTIONS THAT WE'RE WORKING ON IN ADDITION TO THE SMALL LOT SIZE, THOUGH, IS YOU CAN SEE ON THE SITE PLAN THAT WE PROPOSED, THE DETAILED PLAN.

ALONG THE WESTERN BOUNDARY.

THERE IS AN EXISTING CREEK THERE.

AND SO THAT IS PROVIDING A COUPLE OF ISSUES THAT WE'VE HAD TO WORK THROUGH.

WE'RE TRYING TO KEEP THE NATURAL APPEARANCE OF THAT CREEK JUST AS AN ESTHETIC.

WE THINK THAT'S A BENEFIT TO THE COMMUNITY INSTEAD OF JUST PIPING THAT.

SO WE'RE DOING WHAT WE CAN TO TRY TO PRESERVE SOME OF THE NATURAL LOOK OF THAT THAT CREEK. IN ADDITION TO THAT, THOUGH, WE ALSO LOCUST GROVE, YOU CAN SEE, HAS NOT BEEN IMPROVED OR WIDENED IN THE SECTION OF OUR LOT.

AND SO IN ADDITION TO HAVING TO PARTICIPATE IN SOME OF THE IMPROVEMENT OF LOCUST GROVE, SINCE THE SINGLE FAMILY PROPERTY WEST OF US HAS BEEN DEVELOPED, THE CITY HAS MODIFIED THE THOROUGHFARE PLAN. AND SO NOW THERE'S AN ADDITIONAL 10 FEET OF RIGHT AWAY THAT WE HAD TO DEDICATE THAT IS NOT PRESENT ON ANY OF THE PROPERTIES SURROUNDING US.

SO AGAIN, THAT WAS JUST ONE MORE LAND AREA THAT KIND OF GOT TAKEN AWAY FROM US BEING ABLE TO DEVELOP HOMES THERE.

AND SO WE TOOK THE PLAN TO PLANNING COMMISSION.

WE TALKED A LOT ABOUT PARKING.

AND SO AT THE PLANNING COMMISSION MEETING, AS FAR THAT GOES, WE ACTUALLY DID BY THE RECOMMENDATION OF THE PLANNING COMMISSION HAVE A DISCUSSION.

PLANNING DIRECTOR THE PLANNING DIRECTOR, THE CITY MANAGER AND A COUPLE OTHER FOLKS FIRE.

AND WE ACTUALLY TALKED THROUGH SOME OPTIONS ON HOW TO TRY TO ADDRESS THAT AS BEST WE COULD AND SENT A COUPLE SITE PLAN REVISIONS BACK AND FORTH, ULTIMATELY DETERMINED THAT SOME OF THE ALTERNATIVES DIDN'T REALLY FUNCTION WELL.

THEY PRESENTED MORE PROBLEMS THAN THEY DID SOLUTIONS.

AND SO WE HAVE WE HAVE KEPT THE CUL DE SAC LAYOUT THAT YOU SEE HERE.

IT DOES MEET ALL OF THE TECHNICAL STANDARD MANUAL REQUIREMENTS AND THE CITY REGULATIONS FOR PUBLIC RIGHT AWAY AND PUBLIC STREETS.

SO WE'RE NOT REQUESTING ANY DEVIATIONS IN THAT AREA.

AND SO WE THINK THAT, LIKE I SAID, THIS IS KIND OF THE BEST SOLUTION FOR ISD CITY SERVICES, ET CETERA, AS FAR AS THE STREET LAYOUT GOES.

AND THEN, IN RESPONSE TO SOME OF THE OTHER ISSUES THAT WERE BROUGHT UP AT THE PLANNING COMMISSION, AS YOU CAN SEE, WE'VE GONE FROM SEVEN MONTHS DOWN TO FIVE.

WE ARE WORKING CLOSELY WITH COUNCIL MEMBER NICKERSON WHEN WE WORKED WITH HIM BACK AND FORTH AND COORDINATING ON WHAT WOULD BE A SUCCESSFUL PLAN

MORE SUCCESSFUL THAN WHAT WE HAD AT PLANNING COMMISSION.

WE THINK WE'VE GOTTEN THAT AND WAS ABLE TO PROVIDE.

THIS PLAN.

COUNCILMAN NICKERSON AND HE INDICATED HIS SUPPORT OF THE LAYOUT THAT WE'RE SHOWING YOU TONIGHT. AND WE'RE HAPPY TO WORK WITH HIM ON KIND OF GETTING TO THIS POINT.

AND SO I GUESS TO ANSWER A COUPLE OF THE QUESTIONS THAT WERE BROUGHT UP JUST A MINUTE AGO ON THE SIDEWALK ISSUE, WE WILL REQUIRE THAT CONNECTION TO BE MADE AND WE HAVE TO WORK THROUGH THE DETAILS OF GOING AFTER THAT RIGHT AWAY SIDEWALK RIGHT THERE IS A LITTLE BIT OF A GAP IN THERE.

WHETHER THE DEVELOPER BUILDS THAT WITH THE STREET SIDEWALK, WHICH IS PROBABLY WHAT'S GOING TO HAPPEN OR IT'S DONE BY THE HOME BUILDER, WE'LL MAKE SURE THAT SOMEBODY GETS THAT SIDEWALK IN AND THEN THE DEVELOPER WILL BE PUTTING IN THE SIDEWALK, YOU SEE AROUND THE OPEN SPACE LOT. AND SO THAT'LL BE DONE AT THE TIME OF THE CONSTRUCTION OF THE STREET, THE NEW CUL DE SAC STREET.

SO THAT'LL BE DONE.

STAFF, TOUCHED ON THE FENCING ALONG THOSE LOCUST GROVE.

WE HAVE UPGRADED THAT TO MATCH THE SINGLE FAMILY BACK TO THE WEST WITH THE ENHANCED BOARD ON BOARD FENCE.

LIKE I SAID, THAT'LL TIE, I THINK, NICELY WITH THE SUBDIVISION JUST TO THE WEST OF US.

AND THEN, OH, AND AS FAR AS THE BUILDING SETBACKS MR. MAYOR, YOU ARE CORRECT THAT WE'VE ADDRESSED THAT CONCERN.

THAT WAS DUE TO A COUPLE OF THE LOTS.

WE HAD REDUCED THE SET BACK BY ABOUT SIX INCHES, AND THAT HAS NOW SINCE BEEN MOVED BACK OUT. REGARDING THE FACADES, MS. HOPKINS WAS CORRECT. WE ARE PROPOSING TWO ELEVATIONS.

HOWEVER, WE HAVE COMMITTED TO EACH HOUSE, EACH ADJACENT HOUSE, EITHER HAVING TO PICK A DIFFERENT ELEVATION THAN THE ONE BESIDE IT OR MIRRORING THE FACADE TO PROVIDE THAT VARIATION TO MEET THE INTENT OF THE GDC.

AND SO AND I WOULD ALSO BRING UP THAT WE TRIED TO PROVIDE SOME FLEXIBILITY IN THE PLAN, AS WAS ALLUDED TO WITH THE GARAGE AND FRONT DOOR SET BACK TO WHERE WE HAVE WE'VE RESTRICTED THAT THAT GARAGE, THAT BACK TO 20 FEET TO MEET THE CODE.

THE IDEA WAS IF A FEW OF THESE LOTS THAT HAD THE ABILITY TO PUSH THE FRONT DOOR UP IN FRONT OF THAT COULD THEN THEY'D HAVE THE OPTION TO DO THAT.

BUT SOME OF THE LOTS WOULD REQUIRE THE FRONT DOOR TO BE SET BACK AND THEN THE FRONT PORCH WOULD BE ADJACENT WITH THE WITH THE GARAGE.

AND SO WE TRIED.

THAT'S THE REASON YOU SEE SOME OF THOSE SET BACKS BEING DETAILED AS THEY ARE.

WE TRIED TO PROVIDE SOME FLEXIBILITY FOR MORE VARIATION IN THE FACADE, WHICH WE THINK IS AN IMPROVEMENT IF IT'S ABLE TO AS THE LOT'S DEVELOPED.

SO WITH THAT, I THINK LIKE I SAID, I THINK WE'VE COME UP WITH A PLAN.

WE'VE ENJOYED WORKING WITH STAFF AND COUNCILMAN NICKERSON OVER THE LAST COUPLE OF WEEKS.

IT WAS ONE OF THE REASONS WE REQUESTED POSTPONEMENT OF THE LAST MEETING JUST TO MAKE SURE THAT WE HAD EVERYBODY ON BOARD AND UNDERSTANDING WHAT WE WERE TRYING TO DO.

AND SO HE INDICATED TO ME THAT IF WE REQUIRED OF YOU OR IF YOU COMMITTED TO FENCE CONTINUOUSLY THOSE SITES THAT WOULD ADDRESS HIS OPPOSITION AND THAT HE WOULD HE WOULD BE GOOD WITH IT MOVING FORWARD, WHICH ISN'T A LEGAL POSITION ON HIS PART.

BUT AS FAR AS MY COMFORT IN.

BEING SUPPORTIVE OF A PROJECT THAT A MAJOR LANDOWNER NEARBY HAS EXPRESSED OPPOSITION TO.

AND BECAUSE OF THE ODD SHAPES OF THESE LOTS AND I HAVE TO SAY, I'M KIND OF IMPRESSED THAT YOU WERE ABLE TO CARVE OUT LOTS TO FIT WITH SOME OF THE ODD SHAPES THERE THAT YOU'RE DEALING WITH A LOT OF ITERATIONS AND I CAN ONLY IMAGINE SO, SOME OF THEM ARE ARE MORE CHALLENGED AS FAR AS YOUR LOT LINES THAN OTHERS BEING EASEMENTS.

SO, WHAT IS YOUR WORST CASE LOT WHERE YOU HAD THE LEAST EASEMENTS AND YOU WERE CLOSEST TO THE LOT LINES.

WELL, IT'S KIND OF A TRADE OFF, ACTUALLY, FUNNY ENOUGH, LOT FIVE, WHICH IS THE MOST SOUTH EASTERN LINE, IS ACTUALLY THE SKINNIEST, BUT IT'S THE LONGEST.

IT KIND OF PROVIDED THAT TRADE OFF OF THAT'LL BE THE TIGHTEST FROM A WIDTH PERSPECTIVE.
