WES, I BELIEVE YOU HAVE THE QUICK UPDATE FOR US ON THIS ONE.

YES, SIR. GOOD EVENING, MAYOR.

COUNCIL, THANKS FOR HAVING ME ON THIS EVENING.

COUNCIL, AS YOU RECALL, WE PRESENTED THE MEMO OF UNDERSTANDING IN THE DRAFT WATER AND WASTEWATER CONTRACTS AT THE NOVEMBER 9TH WORK SESSION.

AND THIS BASICALLY IS JUST TO PROVIDE WATER AND WASTEWATER SERVICES, INCLUDING BUILDING STANDARDS FOR THE FIRESIDE BY THE LAKE, DEVELOPMENT BY D.R.

AND WITH THAT COUNCIL, I'LL TAKE ANY QUESTIONS.

OK, THANK YOU WES.

COUNCIL, WE HAVE DISCUSSED THIS ITEM ON NUMEROUS OCCASIONS.

ARE THERE ANY REMAINING QUESTIONS FOR THIS PARTICULAR ITEM? I SEE NONE. COUNCILMAN NICKERSON, THIS IS IN YOUR DISTRICT.

THANK YOU, MAYOR. I WOULD MOVE TO APPROVE THE MEMORANDUM OF UNDERSTANDING FIRESIDE BY THE LAKE AND RELATED WATER AND WASTEWATER CONTRACTS WITH D.R.

HORTON'S DEVELOPMENT AND ITS DALLAS COUNTY MUNICIPAL DISTRICT NUMBER FOUR.

OK, I HAVE MOTION BY COUNCIL MEMBER NICKERSON AND A SECOND BY MAYOR PRO TEM SMITH TO

[00:10:03]

APPROVE THE ITEM THAT HAS AS PRESENTED TO US.

COUNCIL, IS THERE ANY FURTHER DISCUSSION? IF NOT, PLEASE VOTE.

AND THAT ITEM IS APPROVED, APPROVED UNANIMOUSLY.

GREAT, THANK YOU VERY MUCH.

THANK YOU WES. I KNOW YOU PUT A LOT OF A LOT OF HOURS IN ON THIS ONE.

AND I APPRECIATE ALL THE EFFORT AND ALL THE WORK.

THANK YOU. MY ONLY COMMENT IS YAHOO.

YES. MADE THIS NEVER APPEAR ON OUR AGENDA AGAIN.

THANK YOU MAYOR.

THANK YOU COUNCIL. ALL RIGHT, THE NEXT ITEM, ITEM 12.

[12A. Consider a Zoning request by Josh Adams to re-zone the property at 905 and 911 East Oates Road in District 4 from Single-Family-7 (SF-7) District to Agricultural (AG) District, to allow a small farm for growing fruits and vegetables.]

IS HOLD A PUBLIC HEARING, ITEM 12 A CONSIDER A ZONING REQUEST BY JOSH ADAMS TO REZONE THE PROPERTY AT 905 AND 911 EAST OATES ROAD IN DISTRICT FOUR FROM SINGLE FAMILY SF -7 DISTRICT TO AGRICULTURE DISTRICT TO ALLOW A SMALL FARM FOR GROWING FRUITS AND VEGETABLES.

AND LOOK AT THAT. THE PRESENTATION JUST MAGICALLY APPEARS.

YOU GUYS ARE GETTING GOOD AT THIS.

GOOD EVENING. GO AHEAD.

REQUEST STATED, AND HERE'S THE CASE INFORMATION, THE LOCATION IS AT 905 AND 911 EAST OATES ROAD, THE ACREAGE IS APPROXIMATELY THREE POINT FIVE FOUR ACRES AND THE EXISTING ZONING IS SINGLE FAMILY SEVEN DISTRICT.

AND HERE'S THE LOCATION MAP, THE SUBJECT PROPERTIES OUTLINED IN THIS TEAL BLUE COLOR, AND THIS IS EAST OATES ROAD.

AND THE PROPERTIES TO THE NORTH OR ZONE PLANNED DEVELOPMENT 82-100 FOR MULTIFAMILY USE AND PLAN DEVELOPMENT 85-17 FOR NEIGHBORHOOD OFFICE USES.

AND THESE PROPERTIES ARE CURRENTLY DEVELOPED WITH TOWNHOUSES AND A CHURCH.

THE PROPERTY TO THE EAST IS ZONED SINGLE FAMILY SEVEN DISTRICT, AND IT IS CURRENTLY DEVELOPED WITH A SINGLE FAMILY HOUSE.

THE PROPERTIES TO THE SOUTH ACROSS EAST OATES ROAD ARE ZONED SINGLE FAMILY SEVEN DISTRICT, AND THEY ARE DEVELOPED WITH SINGLE FAMILY HOMES AND THE PROPERTY TO THE WEST IS ZONED AGRICULTURAL DISTRICT AND IT IS DEVELOPED WITH A SINGLE FAMILY HOME.

AND THE APPLICANT ACTUALLY LIVES ON THIS PROPERTY.

AND IF THIS ZONING CHANGE IS APPROVED, THEN HE WILL COMBINE THIS SUBJECT PROPERTY AND THE ADJACENT LOT, WHICH IS ZONED AGRICULTURAL INTO ONE LOT.

AND HERE ARE SOME OF THE PHOTOS, THE TOP LEFT IS LOOKING AT PROPERTY FROM EAST OATES ROAD. UPRIGHT IS LOOKING EAST OF THE SUBJECT PROPERTY FROM EAST OATES ROAD.

BOTTOM LEFT IS LOOKING SOUTH OF THE SUBJECT PROPERTY FROM EAST OATES ROAD AND THE BOTTOM RIGHT IS LOOKING NORTH OF THE SUBJECT PROPERTY FROM ROSE HILL ROAD.

THE APPLICANT REQUEST APPROVAL OF THE ZONING CHANGE FROM SINGLE FAMILY SEVEN DISTRICT TO AGRICULTURAL DISTRICT TO ESTABLISH A SMALL FARM USE, AND THAT'S TO PRIMARILY GROW FRUITS AND VEGETABLES TO SELL OFF SITE TO LOCAL MARKETS.

THE SUBJECT, POVERTY IS CURRENTLY UNDEVELOPED.

I ALSO WANT TO CLARIFY THAT THERE WILL BE NO RETAIL SERVICE ON SITE THAT WOULD BE ACTUALLY BE CLASSIFIED AS A FARMER'S MARKET USE, WHICH REQUIRES APPROVAL OF A SPECIFIC USE PROVISION. AND THE APPLICANT DOESN'T INTEND TO OPEN ANY FARMER'S MARKET AT THIS TIME.

YOUR REQUEST IS A TRADITIONAL REZONING WITHOUT THE FORMATION OF A PLANNED DEVELOPMENT.

FUTURE LAND USE MAP OF THE ENVISION GARLAND PLAN DESIGNATES THE SUBJECT PROPERTY AS COMPACT NEIGHBORHOOD, ALTHOUGH THE AGRICULTURAL DISTRICT IS NOT REPRESENTATIVE OF COMPACT NEIGHBORHOODS. THE PROPOSED SMALL FARM USE WOULD BE COMPATIBLE AND NOT DISRUPTIVE TO COMPACT NEIGHBORHOODS.

IT MAY ALSO PROVIDE LOCAL RESOURCES TO THE COMMUNITY.

STAFF RECOMMENDS APPROVAL OF THIS REQUEST, AND ON NOVEMBER 23, 2020, THE PLANNING COMMISSION, BY A VOTE OF EIGHT TO ONE RECOMMENDED APPROVAL OF THIS REQUEST.

WE ALSO SENT OUT NOTIFICATION LETTERS, TOTAL OF SIXTY TWO LETTERS WERE MAILED OUT, TWO WERE WITHIN A NOTIFICATION AREA AND IN FAVOR OF THE REQUEST.

THREE WERE WITHIN THE NOTIFICATION AREA WE RECEIVED A TOTAL OF FIVE RESPONSES, AND THAT IS THE END OF MY PRESENTATION.

VERY GOOD. THANK YOU.

[00:15:03]

HERE WE GO. WE HAVE TIME FOR QUESTIONS FOR STAFF.

COUNCIL MEMBER WILLIAMS. THANK YOU, MAYOR.

I'VE GOT QUESTIONS, BUT I'LL WAIT UNTIL THE APPLICANT HAS FINISHED AND THEN I'LL COME BACK WITH QUESTIONS.

VERY GOOD. VERY GOOD, SIR.

AND YES, WE DO HAVE WE DO HAVE THE APPLICANT WITH US HERE TONIGHT.

THAT IS JOSH ADAMS. MR. ADAMS, I THINK YOU'RE UNMUTED IF WE COULD JUST GET YOU TO GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND YOU WILL HAVE 10 MINUTES TO MAKE YOUR PRESENTATION.

HI, MY NAME IS JOSH ADAMS. I LIVE AT 829 EAST OATES ROAD, GARLAND, TEXAS, 75043.

AS WAS MENTIONED, I WAS WANTING TO CHANGE THE ZONING ON THE 905 AND 911 LOTS FROM AGRICULTURE, I MEAN TO AGRICULTURAL FROM SINGLE FAMILY SEVEN.

SO I COULD DO A SMALL FARM.

IT'S BASICALLY, YOU KNOW, ORGANIC TYPE FARMING.

I DON'T WANT TO USE ANY TYPE OF PESTICIDES OR FERTILIZERS OR ANYTHING LIKE THAT.

YOU KNOW, I WANT TO TRY TO KEEP IT CLEAN.

AND SINCE IT'S SUCH A SMALL FARM, YOU KNOW, I'VE GOT TO TRY TO BE MORE OF A HIT MORE OF A NICHE MARKET THAN THE BIG GROWERS.

SO I KIND OF HAVE TO GROW THAT WAY TO BE VIABLE.

BUT YEAH, I JUST BASICALLY WANT TO HAVE A SMALL FARM WITH RAISED BEDS AND MAYBE SOME ROW CROPS THAT I DO WITH THE TRACTOR LIKE GRAINS AND THINGS THAT I MAYBE DO ONCE A YEAR AND THEN DO THE VEGETABLE GARDENING MORE FREQUENTLY.

IT'S PRETTY MUCH I THINK EVERYTHING THAT'S EVERYTHING HAS BEEN ADDRESSED.

YEAH, I MEAN, YOU PRETTY MUCH DESCRIBED A FARM, OK, WE DO HAVE SOME QUESTIONS FOR YOU.

COUNCIL MEMBER WILLIAMS. THANK YOU, MR. MAYOR. MY FIRST QUESTION IS FOR STAFF.

OK. PER THE GDC CAN YOU, WHAT ARE THEY IF THIS REQUEST IS APPROVED TONIGHT, WHAT ARE THE USES WOULD BE ALLOWED AT THIS LOCATION BY RIGHT? SURE.

WE DO HAVE SOME SLIDES FROM, THE LAND USE MATRIX WHICH I'LL JUST SHARE MY SCREEN AGAIN.

OK, THIS IS THE FIRST PAGE OF THE LAND USE MATRIX, AND THE FIRST COLUMN IS AGRICULTURAL DISTRICT USE PROVISION. SO THE RANCH ORCHARD USE IS PERMITTED BY RIGHT.

AND THEN THE FEED STORE, WHICH REQUIRED SPECIFIC USE PROVISION.

STABLE, COMMERCIAL AND STABLE AND THEN OVER HERE, DOWN BELOW, WE HAVE THE GUARD MANAGER, CARETAKER, GUEST HOUSE AND RENTAL UNIT, WHICH REQUIRE SPECIFIC USE PROVISION.

AND THE. OK. AND THEN HERE ARE SOME OTHER USES THAT REQUIRE SPECIFIC USE PROVISION.

OK. OK, THANKS VERY MUCH AND MY LAST QUESTION FOR STAFF IS, AGAIN, YOU SAID YOU WE SENT OUT 62 NOTIFICATIONS.

IS THAT CORRECT? YES.

AND YOU SAID WE RECEIVED TWO BACK WITHIN THE NOTIFICATION AREA? WE RECEIVED TWO THAT WERE WITHIN A NOTIFICATION AREA AND IN FAVOR OF THE REQUEST AND THREE WITHIN THE NOTIFICATION AREA AGAINST SO TOTAL WAS FIVE.

[00:20:01]

OK. OK, BECAUSE I DIDN'T I DIDN'T RECEIVE I DIDN'T SEE THOSE FIVE REQUESTS, I ONLY SHOW TWO RESPONSES.

SO I THOUGHT YOU SAID THERE WERE FIVE.

SO AGAIN, THERE WERE THREE AGAINST AND TWO FOR IS THAT WHAT YOU SAID? YES. YES.

AND MAYOR IF I COULD JUMP IN THERE, COUNCIL MEMBER WILLIAMS IS CORRECT.

SOME OF THE COUNCIL MEMBER MEMBERS MAY HAVE NOTICED.

I BELIEVE THE CITY SECRETARY PUT IN A BOX WE DID RECEIVE SOME ADDITIONAL RESPONSES THAT DIDN'T MAKE YOUR WAY INTO THE PACKET.

SO BUT THE COUNT THAT YES. THOSE WERE EMAILED TO US LATE THIS AFTERNOON.

OK, THANK YOU. OK.

OK, AND THE NOTIFICATION, CAN YOU CAN YOU PUT THE MAP, THE AREA MAP BACK UP AGAIN? THAT SHOWS THE NEIGHBORHOOD TO THE SOUTH, THAT SHOWS THE NEIGHBORHOOD TO THE, THE PLATS AND THE ONE OF THE VERY TOP.

YOUR SLIDE AT THE VERY TOP.

YEAH, YEAH.

THIS ONE? YEAH, RIGHT, RIGHT.

OK, DO YOU DO YOU HAVE ANY IDEA HOW MANY HOW MANY NOTIFICATIONS OF THE FIVE WE RECEIVE, HOW MANY NOTIFICATIONS WERE SENT TO THE AREA TO THIS TO THE SOUTH, THAT'S PREDOMINANTLY SF-7, THAT'S ACROSS THE STREET ON THE OTHER SIDE OF OATES? I DON'T HAVE THAT NUMBER WITH ME.

UNFORTUNATELY. WERE THEY WERE THESE, THE NOTIFICATIONS, SIR, YOU'RE ASKING FOR NOTIFICATIONS INSIDE, INSIDE THE NOTIFICATION ZONE? INSIDE YEAH. INSIDE THE NOTIFICATION ZONE.

YES. I BELIEVE SHE'S I BELIEVE THERE WERE TWO INSIDE THE NOTIFICATION ZONE AND BOTH WERE IN FAVOR FROM WHAT I RECALL.

OK, THERE WERE JUST TWO? YES.

TWO WITHIN THE NOTIFICATION AREA AND IN FAVOR.

AND THEN WERE WITHIN THE NOTIFICATION AND AGAINST.

OK, OK.

ALL RIGHT, SO WITHIN THE NOTIFICATION AREA, WE DON'T KNOW.

WE DON'T KNOW WHAT THE WHAT THE TOTAL NUMBER OF NOTIFICATIONS THAT WENT TO FOLKS IN THE NOTIFICATION AREA.

THERE WERE 62 TOTAL SENT OUT AND THE 400 AND SO THE 62 IS THE TOTAL, RIGHT? OK. ALL RIGHT.

I GOT YOU. I GOT YOU.

ALL RIGHT. THANK YOU. THANK YOU VERY MUCH APPLICANT? YES, I DO.

OK, MR. ADAMS. GOOD EVENING MR. ADAMS, HOW ARE YOU DOING? I'M GOOD. I'M GOOD.

I'M GOOD.

LOOKING AT THE NOTIFICATIONS, YOUR ON OATES.

AND THERE'S A MIXTURE.

THE ZONING IS A MIXTURE.

THERE'S SOME AG OUT THERE AND SOME SF SEVEN.

AND WHERE YOU WHERE YOUR HOUSE IS, IT'S A IT'S A IT'S AG.

SO IT'S A MIXTURE THERE ON THE ON THAT SIDE OF OATES ROAD.

THE GDC SAYS IT TALKS ABOUT CERTAIN PERMITTED USES WHICH FORMS, BRANCHES, ORCHARD, FEED STORES AND STABLES BE THEIR PRIVATE STABLES.

OK, WHAT ARE YOUR INTENTIONS? DO YOU HAVE ANY INTENTIONS OF EXPANDING YOUR GARDEN TO ANY OF THESE ITEMS? NO, I DON'T HAVE ANY PLANS FOR THAT.

I MEAN, I ALSO DON'T HAVE THE CAPITAL REALLY REQUIRED TO INVEST IN THAT.

I THINK MAYBE THE FEED STORE AND OTHER THINGS MIGHT REQUIRE THE PROVISIONAL USE THING.

SO, I MEAN I MEAN, ALL I'M PLANNING TO DO RIGHT NOW IS FARMING.

I DON'T HAVE ANY ALTERNATIVE MOTIVES.

OK, OK.

AND I THINK YOU SAID THAT ONE OF ONE OF THE CONCERNS THAT WAS EXPRESSED IN THE RESPONSES WAS ODORS AND CHEMICALS.

WOULD YOU REPEAT AGAIN AND SAY YOU'RE GOING TO YOU'RE GOING TO BE DOING AN ORGANIC GARDEN? AND CAN YOU DESCRIBE TO WHAT EXTENT WILL YOU BE USING PESTICIDES AND SPRAYS AND THINGS LIKE THAT? YEAH, I DON'T PLAN TO REALLY USE ANY TYPE OF PESTICIDES OR ANY TYPE OF SYNTHETIC CHEMICALS.

I MEAN, I'LL MAKE MY OWN COMPOST AND MAYBE USE THINGS LIKE WORM CASTINGS AND JUST MORE NATURAL AMENDMENTS TYPE THINGS THAT ARE NATURALLY MADE.

BUT I MEAN, I'M NOT PLANNING TO USE ANY PESTICIDES.

I PROBABLY USE MORE NETTING AND MORE DIVERSIFIED CROPS SO THAT YOU DON'T GET AS MANY OF

[00:25:02]

PREDATOR SPECIES OR THE PREY THAT EAT VEGETABLES.

AND THEN ALSO.

LET ME THINK FOR A MOMENT.

I'M SORRY I LOST MY TRAIN OF THOUGHT, BUT I WAS JUST TRYING TO SAY, YOU KNOW, THERE'S OTHER WAYS TO CONTROL THE PEST AS OPPOSED TO USING PESTICIDES.

AND I PLAN TO USE MORE NATURAL METHODS.

NETTING AND DIVERSE CROPS AND MAYBE OTHER SPECIES THAT EAT THOSE OTHER TYPES INSECTS THAT EAT THE CROPS LIKE LADYBUGS AND PRAYING MANTIS AND SUCH OTHER INSECTS LIKE THAT.

SO YOU'RE NOT PLANNING TO DO ANY AERIAL SPRAYING? NO. YEAH, I DON'T EVEN KNOW HOW I WOULD REALLY AT THAT SCALE AND WHERE MY PROPERTY IS.

OK, MY NEXT TO LAST QUESTION IS GETTING YOUR VEGETABLES TO AND FROM THE BUSINESSES THAT YOU'RE GOING TO SELL TO.

HOW ARE YOU GOING TO BE DOING THAT? ONE OF THE CONCERNS OF THE CITY THAT TAXPAYERS REALLY HAS MADE AN INVESTMENT IN THAT AREA, PARTICULARLY FOR THE INFRASTRUCTURE, SIDEWALKS AND STREETS.

SO CAN YOU CAN YOU SHARE WITH THE COUNCIL A BIT OF HOW WHAT KIND OF VEHICLES YOU'RE GOING TO BE USING TO, YOU KNOW, TO TRANSPORT YOUR FRUITS AND VEGETABLES TO THE VARIOUS BUSINESSES THAT YOU'RE GOING TO BE DEALING WITH.

ARE YOU GOING TO BE USING HEAVY EQUIPMENT? CAN YOU SHARE WITH US JUST HOW ARE YOU GOING TO BE DOING THAT? YEAH, I MEAN, THIS IS A REALLY SMALL FARM.

I MEAN, I PLAN TO BE THE ONLY ONE WORKING AND I MEAN, STARTING OUT TO FIGURE OUT WHAT'S PROFITABLE. AND IF I NEED TO EXPAND NATURALLY, I WILL.

BUT FOR RIGHT NOW, I MEAN, I'VE JUST GOT A SMALL PICKUP TRUCK THAT S10 THAT YOU KNOW VERY SMALL WEIGHT.

I MEAN, IT'S LIKE AT LEAST CONCERN PROBABLY OF MY FARMING WILL BE ANY TYPE OF WEIGHT OR ANYTHING ON THE ROAD.

I DON'T PLAN TO HAVE ANY BIG TRUCKS COMING OR ANYTHING LIKE THAT.

I MEAN, MOST OF THE STUFF WILL BE DONE ON SITE AND THE VEGETABLE THAT WILL BE TAKEN OFF WILL BE, YOU KNOW, NOT HUGE QUANTITIES.

I ONLY HAVE SIX ACRES OF PROPERTY.

AND I'M ONE PERSON AND ONE PERSON CAN ONLY DO LIKE A QUARTER ACRE OR A HALF ACRE BY HIMSELF. THAT'S WHY THE REST OF IT WILL BE OTHER TYPES OF LIKE ROW CROPS.

THAT YOU CAN HARVEST THAT ONCE A YEAR.

OK. OK, AND YOU AND AGAIN, ABOUT THE THERE'LL BE NO ON PREMISES OR ON SITE SELLING OF YOUR FRUITS AND VEGETABLES THERE, EITHER AT YOUR HOME OR IN THE ADJACENT LOT.

I MEAN, I'M GOING TO BE SELLING AT FARMERS MARKETS AND POSSIBLY OTHER VENUES, BUT I'LL HAVE TO GO THROUGH THE LEGAL ROUTES BEFORE THAT.

I HAVEN'T REALLY LOOKED INTO IT ENOUGH TO SAY FOR SURE WHAT I'M ALLOWED TO DO.

BUT I MEAN, I PLAN TO FOLLOW THE RULES ALLOWED AND.

SO I'M NOT ENTIRELY SURE AT THIS TIME, BUT I'M NOT GOING TO BE SELLING ON MY PROPERTY, NO. SO I DON'T HAVE A FARM STORE.

OK, SO ON YOUR ON YOUR SITE THERE ITSELF, NEXT TO YOUR HOUSE, ARE YOU GOING TO BE ARE YOU SELLING ANY PRODUCT ACTUALLY THERE ON SITE? I BELIEVE SO, BUT I MEAN, I THINK YOU'RE ALLOWED TO HAVE PEOPLE PICK PRODUCE STUFF THAT YOU GREW THAT YOU COMMUNICATE WITH THEM.

I MEAN, I DON'T HAVE ANY PLANS TO DO THAT, I DON'T KNOW, I'M GOING TO HAVE TO LOOK INTO IT. TO SEE IF IT'S ALLOWED, IF IT'S ALLOWED, I MIGHT POSSIBLY DO THAT, BUT I DON'T MOST OF MY BUSINESS PLAN TO COME FROM A FARMERS MARKET OR FROM SALES TO RESTAURANTS.

OK. ALL RIGHT, AND ONE MORE THANK YOU, THANK YOU.

THANK YOU VERY MUCH, MR. ADAMS. BUT ONE MORE QUESTION FOR STAFF.

OK.

UNDER THE EXISTING CURRENT ZONING.

WOULD THE APPLICANT BE ABLE TO GROW A GARDEN AND.

WITHOUT AS IS NOW, IF THEY WANTED TO, IF YOU'RE IF YOU'RE SITTING ON AN SF SEVEN AND YOU DECIDE YOU WANT TO DO A GARDEN.

IS THAT A PERMITTED TO DO THAT, CAN YOU DO THAT? IT CAN BE A SMALL GARDEN, BUT IT CAN'T FIT THE CATEGORY FOR A FARM OR A RANCH

[00:30:01]

THAT IS SPECIFICALLY ALLOWED IN THE AGRICULTURAL DISTRICT, NOT IN THE SINGLE FAMILY SEVEN DISTRICT. OK, ALL RIGHT, ALL RIGHT, THANK YOU.

THOSE ARE ALL QUESTIONS I HAVE.

MR. MAYOR, THANK YOU VERY MUCH.

THANK YOU, SIR. ANY EXCUSE ME COUNCIL, ANY ADDITIONAL QUESTIONS FOR STAFF OR THE APPLICANT? I THINK WE'VE FAIRLY ESTABLISHED WHAT HIS PLAN IN.

COUNCIL LADY MORRIS. JUST A QUICK QUESTION FOR STAFF, CAN YOU DEFINE SMALL? YOU SAID A SMALL GARDEN IS ALLOWED ON AN SF SEVEN ZONING.

WHAT'S WHAT'S SMALL? THE DEFINITION OF FARM COUNCIL MEMBER MORRIS IS AN AREA OF TWO OR MORE ACRES WHICH IS USED FOR GROWING FARM PRODUCTS SUCH AS VEGETABLES, FRUITS, TREES AND GRAIN.

SO HE COULD HAVE A FOR A PROPERTY HIS SIZE.

HE COULD HAVE A GARDEN UP TO TWO ACRES.

ONCE IT EXCEEDS TWO ACRES.

IT WOULD HAVE TO BE A FARM.

HE WOULD HAVE TO HAVE ACTUALLY A CERTIFICATE OF OCCUPANCY TO HAVE A FARM ON THE PROPERTY, WHICH WOULD THEN LIMIT HIM.

AND THAT PROPERTY, THAT DEFINITION OF FARM PROHIBITS RETAIL SALES AS IT CURRENTLY STANDS.

OK, SO MY ZOOM WAS GARBLED WHEN YOU SAID A CERTIFICATE OF OCCUPANCY TO HAVE THE TWO ACRE OR LESS.

NO IF YOU WOULD HAVE LESS THAN TWO ACRES, IT WOULD BE FINE.

TO HAVE MORE THAN TWO ACRES OR MORE.

HE WOULD HAVE TO HAVE A CO AS A FARM.

GOTCHA. ALL RIGHT.

THAT WAS REALLY MY ONLY BURNING QUESTION.

THANK YOU.

MR. NEIGHBOR. I THINK WE, I KNOW YOU POPPED UP A COUPLE OF TIMES AND THAT'S USUALLY THE THE WARNING BELL FOR WE'RE TREADING OUTSIDE THE LINES.

I WANTED TO THROW IN HERE THAT ALTHOUGH WE WENT THROUGH SOME DETAIL AS TO WHETHER IT'S GOING TO BE ORGANIC OR WHAT HE'S GOING TO GROW AND THAT SORT OF THING, THIS IS A STRAIGHT ZONING REQUEST. IT'S SOMEWHAT UNUSUAL BECAUSE IN LAY TERMS, THIS WOULD BE DOWN ZONING.

WE'RE GOING BACKWARDS, IN A SENSE, FROM A MORE INTENSE USE TO A FAR LESS INTENSE USE.

TYPICALLY, WHAT YOU FIND AGRICULTURAL ZONING IN THE CITY LEFT TO BE IS A HOLDING ZONING CATEGORY. WE DO STILL HAVE SOME AGRICULTURAL USES, BUT YOU RARELY SEE ANYBODY.

I CAN'T EVER REMEMBER ANYBODY ASKING FOR AGRICULTURAL ZONING, EXCEPT MAYBE AN UNUSUAL CIRCUMSTANCE WHERE THEY WANTED TO HAVE TO PEACH ORCHID OR SOMETHING BEHIND THEIR HOME.

BUT BEING STRAIGHT ZONING, THE PARTICULARS OF WHAT HE MAY OR MAY NOT DO ARE LEFT ONLY TO THE TERMS OF THE GDC.

THEY'RE NOT GOING TO BE WRITTEN INTO ANY CONDITIONS OR PD CONDITIONS OR ANYTHING OF THAT SORT. SO IN THAT RESPECT, WE NEED TO BEAR IN MIND THAT WE AREN'T GOING TO BE ABLE TO REGULATE HOW HE OPERATES THIS FARM OTHER THAN WHAT'S ALREADY ON THE BOOKS.

THANK YOU, MAYOR. OK, THANK YOU, SIR.

WITH THAT COUNCIL, WE APPEAR TO HAVE CLEARED THE QUEUE.

I THINK WE'VE GONE THROUGH THE OPERATIONS.

COUNCIL MEMBER WILLIAMS. THANK YOU, MAYOR.

I'M READY TO MAKE I'M READY TO MAKE A MOTION.

AND I'M GOING TO MOVE FORWARD TO APPROVE THIS REQUEST.

BECAUSE OF THE EXISTING MIXED ZONING OUT THERE, BOTH AG AND SF SEVEN ON THIS SIDE OF THE OF THE STREET. GIVEN THE RESPONSES FROM STAFF AND FROM THIS APPLICANT AND THE CLARIFICATIONS ON THOSE POINTS.

AND I WANTED TO SEE THE TURNOUT ONCE YOU RAISE THOSE POINTS, BECAUSE I WAS WANTING TO BE RESPONSIVE TO THE POINTS THAT THAT THE OTHER CONSTITUENTS AND NEIGHBORS HAD RAISED OUT THERE. BUT MY MOTION, MR. MAYOR, IS TO APPROVE THE REQUEST.

OK, WE HAVE A MOTION TO APPROVE AND A SECOND, MOTION TO APPROVE BY COUNCIL MEMBER WILLIAMS IS SECONDED BY COUNCIL MEMBER NICKERSON.

ANY FURTHER DISCUSSION? IF NOT, PLEASE VOTE ON THE MOTION TO APPROVE.

[00:35:06]

AND THAT APPEARS TO BE UNANIMOUS IN FAVOR.

MR. ADAMS, THANK YOU.

I APPRECIATE WHAT YOU'RE WHAT YOU'RE TRYING TO DO OVER THERE.

I'VE GOT A SMALL LITTLE GARDEN OUTSIDE THE WINDOW NEXT TO THE DESK WHERE I'M SITTING.

AND ONCE YOU GET UP AND RUNNING, I WOULD LOVE TO TO COME OUT AND VISIT WITH YOU A LITTLE BIT, BECAUSE I HAVE I AM A FRUSTRATED AMATEUR AT BEST.

SO GOOD LUCK TO YOU, SIR.

THANK YOU. I'M JUST GETTING STARTED, TOO, BUT I'LL TRY TO FIGURE IT OUT.

MAYBE WE CAN WE CAN COMMISERATE ABOUT BUGS.

ALL RIGHT. THANK YOU, SIR.

THANKS. AND THAT WILL MOVE US ON TO OUR NEXT ITEM, AND THIS IS COUNCIL THIS IS A ZONING

[Items 12B & 12C]

REQUEST, WHICH IS A TWO PART.

7B CONSIDERED REQUEST OF MASTER PLAN TO AMEND THE ORDINANCE PD 16-35, WHICH WAS APPROVED IN 2017 FOR MULTIFAMILY USE AT 4501 NORTH GARLAND AVENUE IN DISTRICT SEVEN.

DUE TO A PROSPECTIVE REAL ESTATE TRANSACTION.

THAT IS THE END OF MY PRESENTATION.

VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? I KNOW WE DO HAVE THE APPLICANT HERE WITH US AS WELL.

MAYOR PRO TEM SMITH.

THANK YOU, MAYOR. THIS IS MORE OF AN EDUCATION QUESTION FOR ME.

IS IT COMMON? AND I REMEMBER VOTING ON THIS, I BELIEVE BACK IN 2017, IS IT COMMON TO HAVE A FINISHED PRODUCT THAT IS SIGNIFICANTLY DIFFERENT FROM THE DETAILED PLAN THAT WAS APPROVED, LIKE APPARENTLY IS THE CASE HERE? BECAUSE I'M YOU KNOW, AT FIRST LOOK, I'M A LITTLE ANNOYED THAT, HEY, THAT'S NOT WHAT I VOTED ON. BUT I ALSO WANT TO BE REASONABLE IF, YOU KNOW, IF THERE ARE IF THIS IS A COMMON THING OR IS THIS UNIQUE TO THIS PARTICULAR SITUATION AND.

I'LL STOP THERE AND GIVE YOU A CHANCE TO ANSWER.

SURE, THIS IS NOT A VERY TYPICAL REQUEST FOR A ZONING CASE.

THERE ARE SOME CHANGES SOMETIMES WHEN IT COMES TO THE PERMIT THAT ARE VERY MINOR.

BUT IN THIS CASE, THERE WERE SOME EXCEPTIONS, AND THAT'S WHY THE APPLICANT REQUESTED TO COME BACK FOR A PUBLIC HEARING.

OK, SO ONCE WE'VE APPROVED A DETAILED PLAN.

YOU KNOW, THOSE AREN'T PERFECT AND THERE'S SOME WIGGLE ROOM THAT STAFF CAN CAN UNILATERALLY APPROVE, IS THAT KIND OF WHAT I'M.

ANYBODY WANT TO TAKE THAT ONE? I'LL TAKE A STAB AT THIS.

YES SIR, THAT'S GENERALLY TRUE OCCASIONALLY, NOT WITH EVERY CASE, CERTAINLY, BUT OCCASIONALLY DURING PERMITTING AND CONSTRUCTION.

AND ONCE THEY GET REALLY INTO THE WEEDS OF THE ENGINEERING IN THE CIVIL PERMITTING PROCESS AND IN THIS CASE, CONSTRUCTION, I BELIEVE.

OCCASIONALLY SOME ISSUES COME UP.

SOME OF YOU ON COUNCIL MAY HAVE OCCASIONALLY RECEIVED A CALL OR E-MAIL FROM ME WHEN SOMETIMES IT MAY BE KIND OF A GRAY AREA.

HERE'S AN ISSUE THAT CAME UP.

IT'S NOT QUITE MATCHING THE DETAILED PLAN FOR SOMETHING IN YOUR DISTRICT TO KIND OF MAKE YOU AWARE AND SEE IF ANY PARTICULAR CONCERNS ABOUT THAT.

AND THE GDC DOES HAVE THAT PROVISION OF MINOR DETAIL PLAN DEVIATIONS OR MINOR DETAIL PLAN ADJUSTMENTS. SO THERE IS THAT PROVISION AVAILABLE, BUT IT DOES OCCASIONALLY COME UP.

LIKE ESTATE TRANSACTION, THE APPLICANT WISH TO GO THROUGH THIS PROCESS AND WISH FOR THE FULL CITY COUNCIL TO GO AHEAD AND MAKE THAT FORMAL ADJUSTMENT.

OK, AS LONG AS THIS IS A REASONABLE AMOUNT OF VARIATION, I'VE GOT NO PROBLEM WITH IT.

BUT I DID WANT TO ENSURE THAT WE'RE STAYING BETWEEN THE LINES.

THANK YOU. MAYOR PRO TEM SMITH.

PROCESS, WE OFTEN SEE DEVIATIONS THAT COME UP DUE TO THINGS THAT THEY FIND WHERE THEY'VE GOT YOU KNOW A PARKING SPOT ON TOP OF A DRAINAGE SYSTEM THEY CAN'T PUT THERE.

AND SO THEY'LL WANT TO RELOCATE THAT.

WE DO ALLOW THAT AND MAKING SURE THAT IT'S IN THE OVERALL PATTERN AND THAT THEY AT LEAST HAVE THE SAME NUMBER OF PARKING SPACES.

NUMBER OF DWELLING UNITS, AS THEY SAY.

IT'S UNUSUAL. WE DON'T OFTEN SEE A NEW BUYER COMING IN AND ASKING TO DOCUMENT NEEDING MORE PARKING SPACES THAN THEY WERE ORIGINALLY APPROVED.

YOU KNOW, SO I FOUND IT SOMEWHAT UNUSUAL FOR THEM TO COME IN AND SAY, HEY, WE WANT YOU TO DOCUMENT THAT WE NEED MORE PARKING SPACES THAN WHAT WAS ORIGINALLY ON THERE.

ADDITIONALLY, WE THINK THAT THE SQUARE FOOTAGE NUMBERS ARE CHANGED DUE TO HOW WE MEASURE SQUARE FOOTAGE FROM THE OUTSIDE OF THE WALLS WHERE THEY'RE MEASURING KIND OF FROM THE INTERIOR

[00:45:01]

SO THE WALL, THE THICKNESS OF THE WALL MAKES THAT DIFFERENCE IN 16 SQUARE FEET IN A IN A UNIT. BUT OVERALL, OUR BUILDING INSPECTORS GO OUT.

THEY LOOK MAKE SURE EVERYTHING MEETS THE MINIMUM STANDARD, AS IS SET BY THE SUP PLANNED DEVELOPMENT OR THE SITE PLAN.

HOWEVER IT'S PUT OUT THERE.

AND WE DO MAKE SURE ALL OF THAT STUFF IS IN PLACE BEFORE WE ALLOW CO TO BE ISSUED.

YOU KNOW, I SAID THEY HAVE MORE PARKING THAN THEY'RE REQUIRED TO, BUT WE MAKE SURE THAT THEY HAVE THE SAME NUMBER THAT ARE REQUIRED TO BE ON THE ON THE PLAN.

ALRIGHT. WELL, I REMEMBER HOW DIFFICULT THE SITE WAS.

THIS IS THE OLD QUARRY.

AND I KNOW THE BUILDER HAD A HECK OF A TIME WITH IT.

SO I APPRECIATE THE ATTEMPT BY THE NEW POTENTIAL OWNERS TO GET THIS ONE RECORDED CORRECTLY. THANK YOU, SIR.

THANK YOU, MAYOR. THANKS, SIR.

AND WE DO HAVE THE APPLICANT HERE WHO CAN KIND OF GO THROUGH THIS AND BEING THE COUNCIL MEMBER IN THIS DISTRICT DURING THE DEVELOPMENT OF THIS PROPERTY.

I CAN TELL YOU THERE WERE THERE WERE A LOT OF MODIFICATIONS THAT HAD TO BE MADE DUE TO SOME DRAINAGE AND TOPOGRAPHICAL CHALLENGES THAT THIS PROJECT, I THINK WE I THINK WE AMENDED THE TRAIL PLAN AT LEAST THREE TIMES DURING THAT PROCESS, BUT ANYWAY.

WE HAVE DEPUTY MAYOR PRO TEM VERA.

YOU'RE ON MUTE SIR. I HAVE A QUESTION FOR STAFF.

GO AHEAD, SIR. ON THE PICTURES.

CAN YOU GO BACK TO THE PICTURES? ON.

GO TO THE PICTURES.

SITE PLAN? THE PHOTOS LOOKING TOWARDS THE YEAH.

RIGHT THERE, RIGHT THERE.

WHAT ARE THAT RIGHT HERE ON THE BOTTOM LEFT? IS THAT A FOUNDATION? NO, THAT IS THE SIDEWALK RUNNING DOWN THE NORTH GARLAND AVENUE.

OH IT LOOK LIKE A FOUNDATION TO ME.

NO, SIR. OK, OK, THANK YOU.

THAT WAS MY QUESTION. OK, COUNCIL WE DO HAVE THE APPLICANT HERE.

MR. FISHER I'VE UNMUTED THE LINE ON YOUR END, IF YOU GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

CAN YOU HEAR ME? YES, SIR.

GO AHEAD.

MAYOR. COUNCIL MEMBERS.

MAXWELL FISHER WITH MASTERPLAN 2201 MAIN STREET 75201, DALLAS TEXAS 75201 REPRESENTING JPI. I BELIEVE BLAKE TAYLOR WITH JPI IS ALSO ON LINE IN THE EVENT THAT I CAN'T ANSWER QUESTIONS. FIRST OF ALL, I WOULD LIKE TO CONGRATULATE, OH THERE HE IS.

I CAN CONGRATULATE COUNCIL MEMBER MCNEAL FOR HIS APPOINTMENT.

I HAVEN'T MET HIM YET, BUT CONGRATULATIONS, SIR.

IF I COULD SHARE MY SCREEN, I DON'T KNOW IF THAT'S POSSIBLE OR NOT.

YES, SIR. I DON'T THINK I HAVE THAT CAPABILITY.

BECAUSE WE HAD SOME ISSUE WITH ME BEING A PANELIST.

TONIGHT.

LET ME SEE, LISA CAN YOU MOVE MR. FISHER OVER FROM ATTENDEE TO PANELIST, PLEASE? IF THAT IF THAT IMPROVES, THAT IMPROVES OUR SITUATION.

OK, HERE WE GO. THERE WE GO, SEE, IT'S ALL ON THE OK, CAN YOU SEE MY SLIDE? OH, NO, YOU CAN'T YET, BECAUSE I'M NOT HITTING SHARE.

OK, THERE YOU GO.

ALL RIGHT. CAN YOU SEE? THERE WE GO.

OK. OK, THERE WE GO, I JUST WANT TO SHOW A COUPLE OF PICTURES OF WHAT WAS BUILT.

I'M SURE, MOST PEOPLE ARE AWARE IF YOU'VE DRIVEN ON GARLAND AVENUE OFF OF ARAPAHO, THAT YOU'VE SEEN THE DEVELOPMENT.

MORE TO THAT THIS DEVELOPMENT, JEFFERSON WOODLANDS HAS ONE OF THE HIGHER RATE RENTS IN NORTH GARLAND. HERE'S SOME OF OUR INTERIOR SHOTS OF HOW IT CAME OUT.

IN CASE YOU'RE CURIOUS, WE ARE ASKING FOR A FEW AMENDMENTS TO ALIGN THE ZONING TEXT WITH THE PERMITTED AS BUILT CONDITIONS.

THIS IS SORT OF A BUYER DRIVEN REQUEST.

AND SO WE THERE ARE SOME CHANGES.

WE RAN INTO SOME LIFE, LIFE SAFETY, BUILDING AND FIRE CODE ISSUES.

THAT BUILDING

[00:50:01]

GARAGE COUNT FROM ONE FIFTY TWO TO ONE FORTY SEVEN.

AND THEN THERE WERE SOME TANDEM PARKING SPACES, SOME TANDEM SPACES THAT ARE BASICALLY PARKING SPACES BEHIND GARAGE DOORS THAT WERE UNDER THE FOOTPRINT.

SO THEY WERE ACTUALLY SHOWN ON OUR DEVELOPMENT PLAN, BUT THEY WERE COVERED UP BY THE FOOTPRINT. SO WE ACTUALLY DIDN'T CALCULATE THEM, BUT THEY WERE ALWAYS PLANNED AND ALREADY ON THE PLAN, BUT JUST NOT SHOWN.

SO WE'RE JUST BASICALLY CAPTURING THOSE IN THIS AMENDMENT AND THEN OUR OVERALL PARKING IS GOING UP. SO WE'RE JUST CAPTURING WHAT IS ACTUALLY ON THE SITE, WHAT WAS ACTUALLY BUILT.

AND THEN THERE WERE SOME CHANGES TO A DUMPSTER LOCATION THAT HAD AN IMPACT TO A FEW PARKING SPACES. AND THERE WERE AND THERE WERE SOME ADA ACCESS MANEUVERING AND ADJUSTMENTS THAT RESULT SPACES NOT BEING COVERED, BUT OVERALL COVERED PARKING ACTUALLY WENT UP BECAUSE SINCE WE DIDN'T COUNT SOME OF OUR TANDEM SPACES IN THE ORIGINAL REQUEST, THEY WERE ACTUALLY COVERED. SO WE JUST WANTED TO BASICALLY ALIGN WHAT WAS ACTUALLY BUILT WITH THE ZONING OR ZONING FLOOR AREA FOR OUR UNITS, FOR ONE BEDROOM FROM 728 TO 712.

BUT OUR OVERALL AVERAGE FOR ALL OF OUR UNITS COMBINED IS STILL FOUR ABOVE WHAT WAS THE MINIMUM APPROVAL, WHICH WAS NINE TWENTY TWO.

WE'RE AT NINE TWENTY SIX.

WE BELIEVE WE STILL MEET THE SPIRIT AND INTENT OF WHAT THE COUNCIL APPROVED IN OUR ORIGINAL REQUEST.

I JUST WANT TO SHOW AN EXHIBIT THAT SHOWS WHERE OUR TUCKED UNDER A GARAGE PARKING, TANDEM PARKING SPACES ARE IN GREEN, AND THEN SOME OF THE CHANGES THAT I REFERRED TO WITH THE DUMPSTER AND PARKING CONFIGURATION ARE IN THAT SORT OF THAT BLUE CIRCLE AREA THERE.

AND I WILL STOP AND ASK THAT THE COMMISSION OR COUNCIL FOLLOW THE PLANNING COMMISSION RECOMMENDATION. I'LL BE HAPPY TO ANSWER ANY QUESTIONS.

I'LL STOP SHARE. IF YOU CAN UNSHARE FOR ME, PLEASE.

VERY GOOD. ANY QUESTIONS FOR THE APPLICANT? COUNCIL MEMBER WILLIAMS. THANK YOU, MR. MAYOR, THIS QUESTION IS NOT FISHER. THE QUESTION IS NOT FOR THE APPLICANT, QUESTION FOR STAFF.

ARE WE GOING TO? AND I DIDN'T SEE IT.

IN THE IN THE WRITE UP.

TRAFFIC IMPACT, CAN STAFF RESPOND TO THAT, WAS THAT DONE? WELL, I'M GOING TO I'M GOING TO GO OUT ON A LIMB HERE.

AND I'M THINKING WE'RE PROBABLY THAT'S PROBABLY GOING TO TAKE US OUTSIDE THE PARAMETERS OF THIS DEVELOPMENT IS COMPLETE.

OH, IT'S COMPLETED.

YES. THIS PARTICULAR THIS PARTICULAR COMPLEX IS COMPLETELY IS COMPLETELY. THAT'S THE ONE I PASSED.

OK. YES SIR.

WELL, LET ME LET ME LET ME.

BECAUSE I'M NOT USED TO THAT OF ONES THAT ARE THAT ARE COMPLETE.

SO I'LL WITHDRAW THAT TOTALLY COMPLETED. YES SIR.

THANK YOU. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? I BELIEVE WE HAVE CLEARED THE QUEUE.

COUNCILMAN HEDRICK, THIS IS IN YOUR DISTRICT.

THANK YOU, MR. MAYOR. AND I MOVE TO APPROVE THE PROPOSED AMENDMENT TO PD 16-35 AND THE DETAILED PLAN FOR MULTIFAMILY USE AT 4501 NORTH CAROLINA AVENUE.

VERY GOOD. I HAVE THE MOTION BY COUNCIL MEMBER HEDRICK AND A SECOND BY DEPUTY MAYOR PRO TEM VERA TO APPROVE THIS WOULD.

THE MOTION INCLUDES ITEMS 7 B AND 7C.

ANY FURTHER DISCUSSION? I HAVE NOT, COUNCIL, PLEASE VOTE.

AND THAT IS APPROVED UNANIMOUSLY.

THANK YOU, MAYOR AND COUNCIL GOODNIGHT.

AND THAT WAS OUR LAST ZONING CASE FOR THE EVENING.

WE WILL MOVE ON TO ITEM THIRTEEN, CONSIDER APPOINTMENTS TO BOARDS AND COMMISSIONS.

[13. Consider appointments to Boards and Commissions.]

TONIGHT COUNCIL MEMBER NICKERSON HAS AN APPOINTMENT, SIR.

YES, SIR. THANK YOU, MAYOR AND COUNCIL.

TONIGHT, I'D LIKE TO MOVE TO APPROVE, LISA ARAIZA FOR COMMUNITY MULTICULTURAL COMMISSION.

VERY GOOD.

COUNCIL. YOU'VE HEARD YOU'VE HEARD THE APPOINTMENTS TO THE COMMUNITY MULTICULTURAL COMMISSION.

ALL IN FAVOR. AND THAT IS UNANIMOUS APPROVAL.

[00:55:08]

THANK YOU, SIR. THANK YOU.

AND THIS WILL MOVE US TO ITEM 14, CONSIDER THE APPOINTMENT OF A MAYOR PRO TEM AND DEPUTY

[14. Consider the Appointment of a Mayor Pro Tem and Deputy Mayor Pro Tem]

MAYOR PRO TEM.

COUNCILORS REQUESTED TO CONSIDER THE ELECTION OF MAYOR PRO TEM AND IF DESIRED, DEPUTY MAYOR PRO TEM. AND JUST FOR SOME BACKGROUND, NORMALLY WE DO THIS ANNUALLY AFTER OUR MAY ELECTIONS. OBVIOUSLY, OUR MAY ELECTIONS GOT MOVED TO NOVEMBER.

AND THEN WE HAD TO, THEN WE HAD AN EMPTY SEAT THAT WE FILLED FINALLY YESTERDAY.

SO THAT IS KIND OF THROWN OUR SCHEDULE OFF A LITTLE BIT.

I WANT TO THANK MAYOR PRO TEM SMITH FOR HANGING IN THERE THOSE EXTRA COUPLE OF MONTHS AND CERTAINLY SERVING US WELL WITH THAT MAYOR PRO TEM SMITH.

THANK YOU, MAYOR AND COUNCIL, AGAIN, THANK YOU FOR THE FAITH THAT YOU PUT IN ME.

AND IF THERE WAS EVER A YEAR TO BE MAYOR PRO TEM, THIS WAS NOT IT, GUYS.

AND, YOU KNOW, HONOR OF A LIFETIME.

HONESTLY, GUYS, SO I APPRECIATE THE CHANCE TO SERVE IN THAT LEADERSHIP ROLE.

WITH THAT SAID, I WOULD LIKE TO NOMINATE JERRY NICKERSON FOR THE POSITION OF MAYOR PRO TEM. OK.

COUNCIL, YOU'VE HEARD THE NOMINATION FOR COUNCIL MEMBER NICKERSON TO SERVE AS MAYOR PRO TEM. AND WITH THAT, I WILL ASK FOR EVERYONE TO VOTE FOR MAYOR, FOR THE MAYOR PRO TEM SPOT.

AND THAT APPEARS TO BE UNANIMOUS.

COUNCILMAN NICKERSON.

CONGRATULATIONS, AND I GUESS IF YOU LISTEN TO FORMER MAYOR PRO TEM SMITH, MAYBE CONDOLENCES, BUT, YOU KNOW, I DO MY BEST TO BE AS RELIABLE AS POSSIBLE, BUT I CERTAINLY APPRECIATE THE BACKUP ANY TIME IT'S NECESSARY.

WELL I SO, I APPRECIATE THIS AND DID NOT EXPECT THAT NOMINATION AT ALL.

THANK YOU VERY MUCH FOR IT.

VERY GOOD, SIR. AND MAYOR PRO TEM SMITH, YOU'RE IN THE QUEUE.

JUST COUNCILMAN NOW. BUT.

THAT'S TRUE, SEE. YOU KNOW, YOU GUYS KNOW IT TAKES ME WEEKS TO REPROGRAM MY BRAIN FOR THIS STUFF.

OR SOMETIMES NEVER, IF I'M MAY RECALL.

SORRY.

DUE TO DUE TO THE ONGOING PANDEMIC AND OUR NEED FOR DEPTH IN OUR LEADERSHIP ROLES, I WOULD LIKE TO GO AHEAD AND MOVE FORWARD AND NOMINATE A DEPUTY MAYOR PRO TEM AS WELL.

I'D LIKE TO NOMINATE DEBORAH MORRIS.

OK, THANK YOU, SIR.

WE HAVE A NOMINATION FOR DEPUTY MAYOR PRO TEM FOR COUNCIL LADY MORRIS.

I DON'T SEE ANY DISCUSSION.

SO LET'S PLEASE VOTE ON THAT NOMINATION.

AND YES, MA'AM, YOU DO HAVE TO VOTE FOR YOURSELF.

AND THAT IS UNANIMOUS.

THANK YOU. AND I DO AGREE, THESE TIMES, THE BELT AND SUSPENDERS METHOD IS PROBABLY THE SAFEST THING FOR US TO GO TO.

SO HAVING A DEPUTY MAYOR PRO TEM, I THINK IS IS STILL IMPORTANT.

SO, AGAIN, THANK YOU TO MAYOR, FORMER MAYOR PRO TEM SMITH AND FORMER DEPUTY MAYOR PRO TEM VERA FOR YOUR SERVICE THROUGH THE THROUGH A VERY TROUBLING YEAR.

AND CONGRATULATIONS TO OUR NEW MAYOR PRO TEM AND DEPUTY MAYOR PRO TEM.

THANK YOU. AND THAT WILL MOVE US TO, EXCUSE ME, SIR.

AND HE WAS A VERY GREAT LEADERSHIP TO A LOT OF LEADERSHIP ROLES IN THE INTERNATIONAL COMMUNITY IN OUR SCHOOL.

HE ACTUALLY LEFT THIS PAST CLASS OF 2020.

WITH THAT I MISSED TO BE WITH THE GRADUATION HE RECENTLY GOT.

HIS SON RECENTLY GOT MARRIED AND WISH HIM LUCK ON THAT.

I KNOW MR. MCNEAL, HE'S A VERY GREAT YOUNG GUY.

I MEAN HE WORKS REALLY HARD.

AND THE REASON I SAY YOUNG IS BECAUSE HE LOOKS YOUNG.

SO, YOU KNOW, HE DOES BELIEVE IT DOES REALLY APPRECIATE VERY MUCH FOR HIM, FOR HIS WORK.

AND, YOU KNOW, AND.

OK JOSH, I'M GOING TO NEED YOU TO SUM UP PLEASE.

AND I JUST WANT TO WELL, I WANT TO SAY I WANT TO THANK YOU, MAYOR, FOR ALL YOU'VE DONE.
