[CONSENT AGENDA ]

>>

>> THANKS MAYOR.

>> ALL RIGHT. WE GOT A FEW THINGS BEFORE WE GET TO OUR AGENDA.

AS MANY OF YOU KNOW, LESS MONTHS, WE STARTED BRINGING BACK A FAVORITE AND THAT IS PET OF THE MONTH.

AMY, SO WHAT'S GOING ON TONIGHT?

>> THERE WE GO. WE UNMUTED SO I HAVE A VERY FUN WITH ME TONIGHT, AND SHE JUST NOW OPENED UP.

SHE'S BEEN REAL REAL SHY AND CUDDLY BUT NOW SHE'S GOT A GOOD SMILE THIS IS ESTELLE.

SHE IS A ONE-YEAR-OLD CHIHUAHUA THAT WAS A STRAY, AND SHE FOUND HER WAY TO GARLAND ANIMAL SERVICES AND SHE IS NOW AVAILABLE FOR ADOPTION, AND I WILL WARN YOU, CUTE LITTLE DOGS LIKE ESTELLE, THEY GET ADOPTED SO FAST.

IF YOU'RE GOING TO LOOKING FOR A SMALL DOG, I HIGHLY RECOMMEND CALLING THE SHELTER, MAKING AN APPOINTMENT, COMING ON UP AND MEETING HER QUICK CAUSE SHE WILL BE ADOPTED VERY VERY QUICKLY THAT WE ARE DOING ADOPTION SPECIAL THIS MONTH.

THINGS GOT A LITTLE CRAZY DURING THE ICE STORM LIKE IT DID FOR EVERYBODY,

[3.a. Introduction of Judson Rex, Assistant City Manager for Development. ]

BUT OUR DOGS ARE LOOKING FOR THERE FOREVER HOMES.

NOW'S A GOOD TIME IF YOU ARE LOOKING, AND WE'RE DOING A 25 DOLLAR ADOPTION SPECIAL FOR DOGS, 15 FOR CATS, WHICH IS A HECK OF A DEAL THAT COVERS THE MICROCHIP FEE, THE RABIES VACCINE AND THEN GETTING SPAYED AND NEUTERED.

HIGHLY RECOMMEND CHECKING THIS OUT, AT LEAST TO SEE ESTELLE TODAY

>> VERY GOOD. WELL, THANK YOU FOR JOINING US ONCE AGAIN.

I'M GUESSING, AS ALWAYS, WE HAVE PLENTY OF CATS AND DOGS ON HAND FOR ADOPTION.

>> THAT'S RIGHT I KNOW OFTEN SAID SHE LOOKED LIKE A BABY YODA.

I THINK SHE'S CUTER THAN BABY YODA.

BUT SHE AND I HAVE HAD SEVERAL CONVERSATIONS VIA EMAIL AND WE WILL CERTAINLY GET THE PROCLAMATION OUT TO HER.

WITH THAT, WE WILL MOVE ON TO OUR AGENDA.

THE FIRST ITEM ON OUR AGENDA AND I HAVE A QUICK QUESTION.

THE FIRST ITEM ON OUR AGENDA IS OUR CONSENT AGENDA, AND I NEED TO CHECK WITH ONE OF OUR SPEAKERS TO SEE.

OKAY. I THOUGHT I HAD SOMEONE WHO HAD REGISTERED TO SPEAK. I DO.

WE HAVE SOMEONE SIGNED UP TO SPEAK TONIGHT, HOLLY SANBORN.

I'M TO INTERPRET FROM THE COMMENTS.

WITH THAT. THE FIRST ITEM IS OUR CONSENT AGENDA.

>> I HAVE A MOTION BY COUNCIL ROBIN, AND A SECOND BY COUNCILMAN RIVERA TO APPROVE THE CONSENT AGENDA AS PROVEN, PRESENTED.

THAT IS UNANIMOUS. THANK YOU.

NOW, WE WILL MOVE ON TO ITEMS FOR INDIVIDUAL CONSIDERATION.

[00:15:01]

ANYONE WISHING TO SPEAK FOR OR AGAINST OR ON AGENDA ITEMS HOPEFULLY HAS REGISTERED TO SPEAK IN OUR SYSTEM.

ONCE WE GET TO THE VARIOUS ITEMS I WILL TRY TO MAKE SURE THAT WE HAVE EVERYBODY QUEUED UP.

>>I HAVE A MOTION BY COUNCILMAN BY MAYOR I SEE NO ONE ELSE. COUNCIL, PLEASE VOTE.

THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU, SIR.

NEXT, WE WILL MOVE ON TO ITEM 8, HOLD PUBLIC HEARINGS.

IN JUST REAL QUICK BEFORE WE START HERE, OUR FIRST ITEM COUNCILMAN HEDRICK IT IS IN YOUR DISTRICT, AND IT IS ACTUALLY IN THREE PARTS.

WOULD YOU BE OPPOSED TO US CONSIDERING ALL THREE OF THE ITEMS AT ONE TIME?

>>NO, I WOULD NOT, I'M HAPPY TO DO THEM ALL.

THE FIRST ITEM IS ITEM 8A, CONSIDER A ZONING REQUEST BY JM CIVIL ENGINEERING TO ALLOW A GAS STATION CONVENIENCE STORE USE AT 4680 NORTH SHILOH ROAD.

THIS ALSO INCLUDES ITEM 8B, CONSIDER A SPECIFIC USE PROVISION REQUEST BY JM CIVIL ENGINEERING TO A GAS STATION CONVENIENCE STORE USE FOR A PERIOD OF 25 YEARS.

THEN, PART C IS CONSIDERED A DETAILED PLAN REQUEST BY JM CIVIL ENGINEERING FOR A GAS STATION CONVENIENCE STORE USE IN ALL THREE OF THESE ARE AT 4680 NORTH SHILOH ROAD IN DISTRICT 7 THE PRESENTATION IS HERE.

>> SORRY ABOUT THAT, MAYOR, I WAS MUTED.

GOOD EVENING, EVERYONE. YOU SEE THAT OKAY, MAYOR?

>> YES, SIR.

>> OKAY. THANK YOU. THIS IS THE REQUEST, AS STATED, THE APPLICANT REQUEST TO CONSTRUCT A GAS STATION AND CONVENIENCE STORE.

THIS IS AT THE SOUTHEAST CORNER OF ARAPAHO AND SHILOH.

THIS IS THE CASE INFORMATION.

THIS IS A CITYWIDE APPLICATION MAP, THE RED STAR INDICATING WHERE THE GENERAL LOCATION IS OF THE SUBJECT SITE.

HERE IS A MORE SPECIFIC LOCATION MAP SHOWING THE ZONING DISTRICTS AS WELL IN THE AREA.

THE SUBJECT PROPERTY IS OUTLINED IN THIS TEAL COLOR HERE, AGAIN, ON THE SOUTHEAST CORNER OF SHILOH AND ARAPAHO.

TO THE EAST IS A VACANT PROPERTY, TO THE NORTH ACROSS ARAPAHO ROAD IS A CREDIT UNION BUILDING AND A SELF-STORAGE FACILITY.

CUT A CORNER TO THE SITE ACROSS ARAPAHO AND SHILOH IS A TOM THUMB AND A SHOPPING CENTER WITH RETAIL SHOPS.

AT HARD NORTHWEST CORNER OF ARAPAHO AND SHILOH ACTUALLY IS THE FUEL PUMPS FOR TOM THUMB.

TO THE WEST ACROSS SHILOH ROAD, WE'VE GOT A CAR WASH UNDER CONSTRUCTION.

FURTHER TO THE WEST OF THAT IS A STARBUCKS, AND THEN THE INTERNATIONAL LEADERSHIP OF TEXAS CHARTER SCHOOL IS DIRECTLY WEST ACROSS SHILOH ROAD.

TO THE SOUTH ARE SINGLE-FAMILY HOMES.

AND THAT MOSTLY CONTEMPLATES RESIDENTIAL DEVELOPMENT, BUT CONTEMPLATES SOME NON-RESIDENTIAL AS WELL.

THESE AREAS, AS THE COM PLAN STATES, ALSO ACCOMMODATE USES SUCH AS CONVENIENCE, RETAIL, GOODS AND SERVICES, OFFICE SPACE, AND PUBLIC SERVICES.

THIS PROPOSED DEVELOPMENT OF FUEL PUMPS WITH CONVENIENT STORE WOULD PROVIDE ADDITIONAL SERVICES WITH CONVENIENCE SHOPPING TO THE COMMUNITY.

[00:20:04]

HERE'S SOME PHOTOS OF THE AREA.

THE TOP-LEFT IS THE SUBJECT PROPERTY, LOOKING AT THE SUBJECT PROPERTY FROM ARAPAHO ROAD.

THE TOP-RIGHT IS THE CREDIT UNION BUSINESS NORTH OF ARAPAHO ROAD.

DOWN HERE, THAT'S THE TOM THUMB FUEL PUMPS, AND OVER HERE IS LOOKING AT THE SUBJECT PROPERTY BUT FROM THE SOUTH EDGE ALONG SHILOH ROAD.

HERE'S THE SITE PLAN.

THE APPLICANT PROPOSES THREE DRIVE CUTS.

ONE, INGRESS/EGRESS OFF OF ARAPAHO ROAD, ONE RIGHT HERE OFF SHILOH ROAD, AND THEN ONE FURTHER TO THE SOUTH.

A DRIVEWAY WOULD EXTEND FURTHER SOUTH.

THIS IS PER THE TRANSPORTATION DEPARTMENT AND WOULD ALIGN WITH AN EXISTING DRIVEWAY AND INTERSECTION THERE.

IF YOU CAN SEE MY CURSOR, AND IT WOULD ORIENT TO THE NORTH.

IT WOULD FACE NORTH TOWARDS ARAPAHO ROAD.

THIS IS THE CANOPY WITH THE EIGHT FUELING PUMPS.

OVER HERE IS WHERE THE DUMPSTER WOULD BE LOCATED.

OVER HERE IS ACTUALLY THE UNDERGROUND WHERE THE UNDERGROUND TANKS WOULD BE LOCATED.

THIS IS THE LANDSCAPE PLAN.

THE PROPOSAL CONFORMS WITH THE GDC LANDSCAPING REQUIREMENTS.

SHOULD NOTE THAT THE APPLICANT DOES NOT PROPOSE LANDSCAPING AT THIS TIME ON THE SOUTHSIDE OF THE SOUTHERNMOST DRIVEWAY THAT I SHOWED, BUT THAT WOULD REQUIRE TO BE PROVIDED ONCE THE SOUTHERN PORTION OF THE TRACK DEVELOPS.

BUT AT THIS TIME, THAT WOULD REMAIN UNDEVELOPED.

ONLY THE MURPHY OIL, WHICH IS PROPOSED THIS EVENING, THE COMMUNITY STORE AND GAS PUMPS WOULD BE DEVELOPED AT, ESSENTIALLY, THE HARD CORNER OF THE SITE, ALONG WITH THE DRIVEWAY.

A RENDERING SHOWING WHAT IT WILL LOOK LIKE.

HERE ARE THE ELEVATIONS AS WELL, COLOR ELEVATIONS OF THE BUILDING AND THE CANOPY.

THE APPLICANT DOES PROPOSE, REQUEST THREE DEVIATIONS RELATED TO BUILDING DESIGN, ONE OF WHICH IS THE HEIGHT OF THE CANOPY.

THE EXISTING PD HAS A MAXIMUM HEIGHT OF 16 FEET.

THE APPLICANT PROPOSES A TOTAL CANOPY HEIGHT OF APPROXIMATELY 20 FEET, SO ADDITIONAL FOUR FEET.

GOING BACK TO THE BUILDING HERE, THE TWO OTHER DEVIATIONS, ONE IS REGARDING THE NORTH ELEVATION.

THE APPLICANT REQUESTS A DEVIATION FOR VERTICAL ARTICULATION.

YOU CAN SEE THE ROOF LINE IS MOSTLY FLAT.

THERE MIGHT BE ARTICULATION THERE WITH THIS FEATURE, BUT THE GDC REQUIRES A BIT MORE TO THAT, SO IT FALLS JUST A BIT SHORT.

THE WEST ELEVATION, THERE'S JUST ONE ARCHITECTURAL ELEMENT.

THE GDC REQUIRES A MINIMUM OF SIX ARCHITECTURAL ELEMENTS.

THAT WAS JUST MISSING ONE ON THE DETAILED ELEVATION SHEETS.

BUT IT WOULDN'T BE DIFFICULT IF THE APPLICANT WERE ABLE TO PROVIDE A PLANT OR A BENCH, THOSE ACTUALLY COUNT AS AN ARCHITECTURAL ELEMENT.

AGAIN, THIS IS A SUMMARY OF THE DEVIATIONS I JUST WENT OVER REGARDING VERTICAL ARTICULATION ON THE NORTH ELEVATION, THE ARCHITECTURAL ELEMENTS ON THE WEST ELEVATION, AND THE CANOPY HEIGHT.

THE APPLICANT PROPOSES THE SUP TO BE IN EFFECT FOR A PERIOD OF 25 YEARS.

STAFF'S RECOMMENDATION IS APPROVAL OF ALL THREE REQUESTS, THE PD AMENDMENT, THE SUP, AND THE DETAIL PLAN.

THE PLAN COMMISSION RECOMMENDED APPROVAL OF ALL THREE REQUESTS AS WELL.

THE PLAN COMMISSION FURTHER RECOMMENDED TO ALLOW THE CANOPY HEIGHT OR ALLOWING THE SUP CONDITIONS FOR THE CANOPY HEIGHT TO BE ALLOWED UP TO 22 FEET IN HEIGHT JUST TO ALLOW A LITTLE BIT OF BREATHING ROOM, SO TO SPEAK, FOR THE CANOPY JUST IN CASE THEY RUN INTO ANY ISSUES.

STAFF MAILED OUT 67 NOTIFICATION LETTERS ON THIS CASE.

WE RECEIVED TWO AND OPPOSITION WITHIN THE NOTIFICATION AREA.

THERE WERE TWO LETTERS SUBMITTED BY THE SAME INDIVIDUAL AND THERE WAS ONE RESPONSE AND OPPOSITION OUTSIDE OF THE NOTIFICATION AREA.

I SENT THE COUNCIL EARLIER, IN YOUR BOX WERE A COUPLE OF ADDITIONAL NOTIFICATION LETTERS, AND SOME OF THEM WERE ACTUALLY SPECIFIC TO THE BEER AND WINE CASE, WHICH WE'LL GET TO YOU.

THAT'S THE NEXT ITEM ON THE AGENDA.

WITH THAT, MAYOR, I'LL BE GLAD TO ANSWER ANY QUESTIONS.

>> THANK YOU, SIR. COUNCIL MEMBER HENDRICK.

[00:25:02]

>> THANK YOU, MR. MAYOR. MR. GUERIN, WILL YOU LET ME KNOW THE DISTANCE BETWEEN THE SOUTHERN SIDE OF THE PROPERTY, AND THEN TO THE NEIGHBORHOOD, AS WELL AS THE DISTANCE BETWEEN THE PROPERTY AND THE CHURCH TO THE EAST.

>> SURE.

>> I KNOW THERE WERE SOME CONCERNS IN THE RESPONSES FROM RESIDENTS THAT THEY DON'T WANT IT SO CLOSE TO THEIR HOUSES.

SO I JUST WANT TO GET THAT DISTANCE ESTABLISHED.

>> FOR CLARIFICATION, THE DISTANCE FROM THE PROPOSED BUILDING?

>> PROPOSED BUILDING OR THE DRIVING, JUST AN ESTIMATE OF WHAT IT IS.

I KNOW THERE'S THAT

>> SURE. ABSOLUTELY. THIS MAY BE A VERY ROUGH MEASUREMENT, IF THAT'S OKAY.

BUT I WOULD SAY APPROXIMATELY MORE THAN 500 FEET FROM THE PROPOSED CONVENIENCE STORE TO THE RESIDENTIAL HOMES.

IT APPEARS ROUGHLY 500 FEET.

WHAT WAS THE SECOND MEASUREMENT, I'M SORRY, COUNCIL MEMBER?

>> THE DISTANCE TO THE CHURCH TO THE EAST.

>> CHURCH, OKAY.

FROM BUILDING TO PROPERTY LINE, THAT'S GOING TO BE CLOSE TO 500 FEET AS WELL.

I'M COMING UP WITH ABOUT 490.

AGAIN, THESE ARE ROUGH MEASUREMENTS.

>> OKAY. THANK YOU. THAT'S ALL THE QUESTIONS I HAD, MR. MAYOR. THANK YOU.

>> THANK YOU, SIR. COUNCIL MEMBER SMITH.

>> THANK YOU, MAYOR. WELL, QUICK QUESTION, AND I'LL TRY NOT TO STRAY OFF TOPIC.

BUT I REMEMBER THAT THERE WAS A CONCEPT PLAN PRESENTED FOR THIS PARCEL, IT HAD TO HAVE BEEN A COUPLE OF YEARS AGO.

I'M WONDERING HOW THIS FITS INTO THAT PLAN; IF THIS IS CONSISTENT WITH THAT PLAN OR NOT.

I APOLOGIZE, I WOULD HAVE ENGAGED YOU EARLIER IN THE DATA TO LOOK THIS UP, BUT GOT SIDETRACKED.

>> SURE. NO PROBLEM.

I'M PULLING IT UP HERE.

IT REALLY DOESN'T VARY TOO MUCH OTHER THAN THEY IDENTIFIED THREE LOTS, WHICH THIS WOULD BE REALLY LOT 1, AT THE HARD CORNER THAT THEY'RE DEVELOPING, AND, OF COURSE, THE DRIVEWAY, WHICH WAS A TECHNICAL REQUIREMENT ANYWAY FROM TRANSPORTATION.

ACTUALLY, I'LL JUST GO AHEAD AND SHARE IT HERE.

I'M ABLE TO DO THAT. HERE WE GO.

IF YOU CAN SEE THAT, IT WASN'T SHOWING PROPOSED DEVELOPMENT, NOT EVEN REALLY A BUBBLE PLAN.

THEY'RE JUST PROPOSING, CONTEMPLATING THREE LOTS.

THE MAIN ITEM, AS I RECALL, IS THEY AMENDED THE PD IN ORDER TO ALLOW A NUMBER OF USES.

THE PREVIOUS PD BEFORE THAT WAS VERY OFFICE USE-CENTRIC.

IN FACT, I THINK THAT 16-FOOT HEIGHT MAY HAVE BEEN A CARRYOVER FOR THAT ORIGINAL PD, WHICH, ONE-STORY OFFICE BUILDINGS, NOT A LOT OF HEIGHT AND THAT SORT OF THING.

WITH THIS PD IN 2018 THAT WENT THROUGH, THEY ADDED A NUMBER OF RETAIL USES TO BE ABLE TO MARK IT FOR THE SITE.

SO FUEL PUMPS, RETAIL WAS ACTUALLY A LISTED USE BY SUP.

SO THEY'RE SIMPLY FOLLOWING THAT SUP PROCESS THAT WAS LAID OUT IN THAT PD AT THIS TIME.

>> OKAY. MAYOR, WE'RE TAKING 8D AS A SEPARATE ITEM, CORRECT?

>> YES.

>> VERY GOOD. THAT'S ALL THE QUESTIONS I HAD.

THANK YOU, SIR. THANK YOU, MAYOR.

>> YES, JUST FROM LIVING IN THAT AREA FOR A LONG TIME, I'VE SEEN A LOT OF THOSE OLD PDS THAT RUN DOWN SHILOH AND AROUND CAMPBELL.

AT ONE TIME, IN THE EARLY MID-'80S, THAT WAS PROJECTED TO BE LIKE A TELECOM CORRIDOR STYLE OF DEVELOPMENT ALL THE WAY DOWN THROUGH THERE.

AS WE ALL KNOW, THAT ISN'T WHAT OCCURRED.

BUT WE DO HAVE THE APPLICANT HERE WITH US.

MR. WESTMORELAND, I HAVE OPENED THE LINE ON OUR END.

>> YES, SIR. COUNSEL, I APPRECIATE YOU LETTING ME ADDRESS COUNCIL.

BASICALLY HERE JUST TO ANSWER ANY QUESTIONS I CAN FOR ANYONE, WITH STAFF, OR ANYBODY WITHIN THE PUBLIC THAT HAS ANY ADDITIONAL QUESTIONS REGARDING OUR PROPOSED USE.

WE'LL SPEAK TO THE ALCOHOL VARIANTS AS A NEXT TOPIC.

BUT TO ANSWER ANY QUESTIONS, I CAN FOR ANYONE AT THIS TIME.

>> YEAH. WE'LL DEAL WITH THE ZONING-TYPE ISSUES BEFORE WE GET TO THAT USE ISSUE.

[00:30:05]

ANY QUESTIONS, COUNSEL, FOR THE APPLICANT? COUNSEL

>> THANK YOU, MR. MAYOR. I JUST HAD ONE QUESTION AND THIS IS ALSO IN SOME OF THE CITIZEN COMMENTS.

THERE WAS A CONCERN ABOUT INCREASE IN CRIME, I WAS HOPING THE APPLICANT COULD SPEAK TO THAT AND TALK ABOUT ANY CRIME PREVENTION MEASURES THEY TAKE FOR THEIR SITES.

>> BEING A FORTUNE 300 COMPANY, ONE THING THAT WE CERTAINLY DO IS OUR LIGHTING BASED ON CITY RECOMMENDATION, WE HAVE LIGHTING AROUND THAT CANOPY THROUGHOUT ALL OF THE HOURS OF OPERATION.

THAT'S ONE THING. ALSO, WE HAVE APPROXIMATELY 10 CAMERAS THAT ARE INSTALLED IN THE BUILDING AND LOOKING OUT ON THE SURROUNDING AREAS, THE PUMPS IN THAT AREA AS WELL.

>> VERY GOOD. THANK YOU, MR. MAYOR.

>> ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? I DO HAVE SOMEONE WHO'S ASKED TO SPEAK.

MR. MORELAND, IF WE NEED TO, WE WILL COME BACK TO YOU, SIR.

>> GREAT. THANK YOU.

>> I HAVE SOMEONE. JENNIFER IF YOU COULD GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

>> JENNIFER I RAISED MY HAND AND I MIGHT BE PREMATURE IN THIS.

BUT DOES THE CHURCH NEXT TO THE PROPERTY HOUSE A DAYCARE AND A PRESCHOOL? IS MY QUESTION TO STAFF OR TO THE DEVELOPER.

>> I CAN TELL YOU THE ANSWER IS YES.

THE CHURCH DOES HAVE A DAYCARE CENTER.

>> OKAY. THANK YOU.

>> WAS THAT IT? ALL RIGHT.

>> YES.

>> OKAY. THANK YOU.

>> ALL RIGHT.

>> MY NEXT SPEAKER IS JOSH GARCIA.

YOU GIVE US THE NAME AND ADDRESS FOR THE RECORD, PLEASE.

>> THANK YOU, MAYOR. JOSH GARCIA OF 4029 TEXAS THANK YOU THE APPLICANT AND THANK YOU MR. JARED FOR YOUR PRESENTATION.

I'M ONE OF THE VERY EXCITED TO SEE A GAS STATION ON THAT AREA.

I AM ONE OF THE GRADUATES OF 2019, THE INTERNATIONAL LEADERSHIP OF TEXAS RIGHT ACROSS WHERE THE APPLICANT IS PROPOSING A GAS STATION.

ACTUALLY, ONE THING I'M VERY CONCERNED ABOUT IS THE TRAFFIC.

BUT FIRST I WANT TO TALK ABOUT THOSE GOATS BEHIND THERE.

THOSE 16 GOATS THAT ARE RIGHT BEHIND WHERE THEY'RE GOING TO PROPOSE THE GAS STATION, THEY NORMALLY MOVE AROUND.

>> HAVE NOT BEEN ON THAT PROPERTY FOR PROBABLY MORE THAN A YEAR NOW.

>> WELL, THEY HAVE BEEN THERE SINCE SEVENTH GRADE, I BELIEVE.

>> THEY HAVE BEEN GONE FOR MORE THAN A YEAR NOW, MAYBE AT LEAST TWO YEARS.

>> BECAUSE THEY MOVE AROUND THAT'S WHAT I WAS TRYING TO SAY.

>> THEY'RE NOT LIVING THERE NOW.

>> GOT YOU. I HAVEN'T SEEN IN A LONG TIME.

THEN NUMBER 2, AS FAR AS CRIME, I HAVE NOT SEEN ANY CRIME AS FAR AS I KNOW.

I'VE BEEN ATTENDING THAT SCHOOL SINCE SEVENTH GRADE.

AS FAR AS CRIME, IT SEEMS TO BE OKAY.

NORMALLY THOSE STUDENTS WALK TO AND FROM HOME MOST OF THE TIME.

THE ONLY THING THAT I REMEMBER, THERE WAS AN INCIDENT WHERE ONE AFTERNOON SOME CAR STRANGER ASKED SOME STUDENTS SAYING, "HEY, I'M TAKE YOU FOR A RIDE." THEY REPORTED TO THEIR OWN PD, ETC.

BUT THAT WAS SOMETHING THAT WASN'T RELATED TO CRIME THING BUT I DON'T SEE ANY CRIME AT ALL.

MY CONCERN IS THE TRAFFIC FROM NORTH SHADOW ROAD TO ARAPAHO ROAD.

THERE IS A LOT OF TRAFFIC RIGHT NOW WITH THIS COVID, WHERE THE INTERNATIONAL LEADERSHIP IN TEXAS IS.

THERE'S NOT SO MANY STUDENTS ARE GOING THERE RIGHT NOW.

I KNOW THERE ARE SOME THAT ARE GOING BUT IT'S LESS TRAFFIC.

BUT THERE WAS AN INCIDENT I REMEMBER WHEN I WAS A JUNIOR WHERE SOME TYPE OF SINGER WAS WALKING ACROSS, I GUESS IT DIDN'T PAY ATTENTION TO THE STREETS AND A CAR HIT HER AND SHE GOT RUN OVER BUT THANKFULLY IT WASN'T THAT BAD.

IT SEEMED BAD BUT IT WASN'T THAT BAD.

THAT WAS THE ONLY THING.

MY CONCERN IS THE SAFETY AND PRIORITY OF OUR STUDENTS THERE BECAUSE THEY NORMALLY WALK AROUND TO STARBUCKS OR ANYWHERE THOSE SHOPPING CENTERS AROUND THERE.

[00:35:03]

JUST TAKE THE PRECAUTION MEASURES IN THAT CASE.

>> JOSH, I NEED YOU TO SUM UP.

>> THAT'S ALL I HAD TO SAY, MR. MAYOR.

>> THANKS, SIR. MY NEXT SPEAKER IS PAULINE SIAS.

I HAVE OPENED THE LINE ON OUR END.

IF YOU CAN UNMUTE ON YOURS.

IF YOU CAN GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE.

>> HI MR. MAYOR. MY NAME IS PAULINE SIAS.

I'M AT 1109 VICKSBURG DR, SCOTLAND TEXAS 75041.

I JUST HAD A QUESTION FOR THE VENDOR HIMSELF.

CONSIDERING THAT IT IS ACROSS THE STREET FROM THE INSTRUCTIONAL FACILITY, THE INTERNATIONAL LEADERSHIP SCHOOL WILL THERE BE ANY COMMUNITY INVOLVEMENT WITH HIM AS FAR AS WITH THAT SCHOOL OR ANY OTHER GISD SCHOOLS AROUND THAT AREA?

>> I WILL BRING THIS TO WESTMORELAND BACK HERE IN A SECOND AND HAVE HIM ADDRESS THAT.

DO YOU HAVE ANY OTHER CONCERNS?

>> OH, NO, THAT WAS IT.

>> OKAY.

>> THANK YOU.

>> VERY GOOD. THANK YOU, MA'AM. IS THERE ANYONE ELSE WHO WOULD LIKE TO SPEAK ON THIS SIDE? MR. WESTMORELAND, I'VE UNMUTED THE LINE ON OUR END.

IF YOU CAN UNMUTE.

I DON'T KNOW IF YOU CAN ADDRESS THE COMMUNITY INVOLVEMENT QUESTION.

>> SURE. I GUESS THIS WILL ALSO SOMEWHAT RELATE TO THE NEXT TOPIC.

BUT I GUESS TO START ANSWERING THE QUESTION NOW.

BUT EARLY ON IN THIS PROCESS, WE KNEW ALCOHOL WAS AN ISSUE AND THE DISTANCE BETWEEN THE INTERNATIONAL LEADERSHIP SCHOOL ACROSS THE STREET SO WE REACHED OUT AS A GOOD POTENTIAL NEIGHBOR AND ADDRESSED THOSE CONCERNS AND REQUESTS WITH THE PRINCIPAL OF RECORD AT THE SCHOOL BASICALLY TO GET THEIR APPROVAL AND RECOMMENDATION OR SUPPORT FOR ALCOHOL AND THROW OUT THOSE DISCUSSIONS.

ALSO OFFERED ANY TYPE OF SERVICES WE CAN OFFER.

NOTHING BARELY WAS PROPOSED AT THAT TIME, BUT WE DID WELCOME HERSELF OUT THERE AS A FUTURE POTENTIAL NEIGHBOR AND ALL COMMUNICATIONS THAT WE'VE HAD WITH THEM IN THE LAST TWO PLUS YEARS, MAYBE EVEN THREE THAT WE'VE BEEN WORKING ON THIS PROJECT.

EVERYTHING HAS BEEN AMICABLE BETWEEN THE TWO OF US.

WE'RE CERTAINLY WILLING TO WORK WITH THEM AS THEY HAVE WITH US ON THE VARIANCE.

>> WE'RE GOOD. THANK YOU, SIR.

COUNSEL, I DON'T HAVE ANYBODY ELSE IN THE QUEUE ON THIS ITEM.

I THINK WE'VE HEARD FROM THE APPLICANT ON THESE AS WELL AS STAFF SO

>> THANK YOU, MR. MAYOR. IF THERE'S NO ONE ELSE WHO WISH TO SPEAK THEN I MOVE FOR APPROVAL OF THE AMENDMENT TO PLAN DEVELOPMENT 1847.

I ALSO MOVE FOR APPROVAL OF SPECIFIC USE PROVISIONS, SUP TO ALLOW FOR FUEL PUMPS ON A PROPERTY ZONE PD 1847, AND ALSO INCLUDE THE CANOPY HEIGHT ALLOWABLE UP TO 22 FEET AND FINALLY, I MOVE FOR APPROVAL OF A DETAILED PLAN FOR FUEL PUMPS ON OUR PROPERTIES ON OUR PROPERTY ZONE PD 1847.

>> COUNCILMAN WILLIAMS.

>> MAYOR, I SECOND.

>> THANK YOU, SIR.

>> SURE. THANK YOU, SIR.

>> I HAVE A MOTION BY COUNCILMAN HENDRICK, SECOND BY COUNCILMAN WILLIAMS TO APPROVE ITEMS 8A, WHICH IS THE ZONING REQUEST, 8B, THE SPECIFIC USE OF PROVISION, AND 8C, THE DETAILED PLAN, AND I BELIEVE YOU MENTIONED THAT THAT DOES INCLUDE THE ADDITIONAL AMENDMENTS FROM THE PLANNING COMMISSION ON THE CANOPY HEIGHTS.

>> YES, SIR.

>> OKAY. ANY FURTHER DISCUSSION ON THIS ITEM? IF NOT, COUNCIL, PLEASE VOTE.

THIS ITEM IS APPROVED UNANIMOUSLY.

NOW WE WILL MOVE ON.

THERE'S SORT OF A SEMI RELATED TOPIC.

WE WANT TO DEAL WITH THE ZONING ISSUES FIRST.

THAT MOVES US TO ITEM 8D.

CONSIDER A VARIANCE REQUEST BY MURPHY OIL USA TO ALLOW AN ESTABLISHMENT

[00:40:03]

THAT SELLS ALCOHOLIC BEVERAGES TO BE LOCATED LESS THAN THE MINIMUM REQUIRED DISTANCE FROM A SCHOOL, AND AGAIN, THIS IS SAME PROPERTY AT 4680 NORTH SHILOH ROAD. MR GARLAND.

>> YES, MAYOR. AS YOU STATED, THIS IS A VARIANCE, RIGHT IN THE DISTANCE TO, IN THIS CASE, A SCHOOL FROM AN ESTABLISHMENT THAT WOULD SELL ALCOHOLIC BEVERAGES, AND IT IS REALLY THE SAME SITE THE APPLICANT IS MURPHY OIL USA, INC.

BUT AGAIN, THIS MAP IS A LITTLE BIT DIFFERENT THAN THAT IT HIGHLIGHTS THIS OVERALL SUBJECT PROPERTY.

OF COURSE, THE ACTUAL CONVENIENT STORE WOULD BE LOCATED IN THE NORTHERN PORTION OF THE SITE UP HERE, BUT THE SCHOOL IT'S A CHARTER SCHOOL, BUT IN A CONSULTATION WITH THE ATTORNEY'S OFFICE FOR ALL INTENSIVE PURPOSES, IT'S TREATED AS A PUBLIC SCHOOL.

IT'S HERE, THE LEADERSHIP ACADEMY OF TEXAS, PROBABLY LINED A PROPERTY LINE, WHICH IS THE APPROPRIATE GDC MEASUREMENT BETWEEN SCHOOLS AND SCHEMING BETWEEN SCHOOLS AND ALCOHOL SELLING ESTABLISHMENTS.

THE PROPERTY LINE TO PROPERTY LINE MEASUREMENT IS APPROXIMATELY 100 FEET ACROSS THE SHILOH ROAD RIGHT-OF-WAY.

THE MINIMUM DISTANCE PRESCRIBED IN THE GDC IS 300 FEET.

SO THAT IS WHAT NECESSITATES THE VARIANCE.

MAYOR, WE, AGAIN, ON THIS CASE, MAYOR, 67 LETTERS.

THERE WAS ONE LETTER OF SUPPORT FROM THE ILT, FROM THE SCHOOL THAT SHOULD BE IN YOUR PACKETS, AND THAT WAS PROVIDED WITH THE APPLICATION BY THE APPLICANT.

THERE WERE THREE RESPONSES RECEIVED IN OPPOSITION.

TWO OF THOSE WERE WITHIN THE NOTIFICATION AREA AND ONE WAS OUTSIDE THE NOTIFICATION AREA.

WITH THAT, I'LL BE GLAD TO ANSWER ANY QUESTIONS AND THERE IS AN APPLICANT WITH US TONIGHT SPECIFIC TO THIS REQUEST.

>> VERY GOOD.

COUNCIL MEMBER SMITH.

>> THANK YOU, MAYOR. ONE QUESTION, WILL.

THE TOM THUMB THAT'S ACROSS THE INTERSECTION, DO WE KNOW IF THEY HAVE A SIMILAR LICENSE THAT ENABLES THEM TO SELL BEER AND WINE?

>> THEY DO. I BELIEVE IT'S IN THE MAIN STORE, BUT I COULD BE WRONG ABOUT THAT IN THE MAIN GROCERY STORE.

I DON'T RECALL IF THERE'S ONE UNDERNEATH THE CANOPY.

I'M SEEING A HEAD SHAKE SIDE.

>> I'M CONFIDENT THAT THERE'S ONE IN THE GROCERY STORE.

>> JUST IN THE GROCERY STORE. THAT'S FINE.

I JUST WANTED TO MAKE SURE WE WEREN'T INTRODUCING IT INTO AN AREA THAT IT WASN'T ALREADY IN.

THANK YOU, SIR. THANK YOU, MAYOR.

>> THANKS, SIR. COUNCILMAN HENDRICK.

>> THANK YOU, MR. MAYOR, AND JUST TO CONFIRM THE TOM THUMB TO MEASURE THAT DISTANCE IS ALSO LESS THAN A 300 FOOT DISTANCE REQUIREMENT PROPERTY TO PROPER LINE, CORRECT?

>> YES, SIR.

>> I JUST WANTED TO JUST MAKE SURE WE HAD THAT AS WELL, THAT IT'S ESTABLISHED 100 FEET TO THE SCHOOL AND THEN PROBABLY 150 FEET OR SO CROSS THE INTERSECTION DIAGONALLY.

>> YES, SIR.

>> THANK YOU. THANK YOU, MR. MAYOR. THAT'S ALL I HAD.

>> ALL GOOD. COUNCILMAN HENDRICK, YOU KEEP COMING BACK INTO THE QUEUE

>> I'M HITTING ON RAISE HAND AND ITS A MESS. WHAT CAN I SAY?

>> ANY ADDITIONAL QUESTIONS FOR STAFF? I DO BELIEVE WE HAVE THE APPLICANT HERE WITH US, MR. HILL.

IF WE HAVE ANY QUESTIONS FOR THE APPLICANT.

HERE WE GO. GO AHEAD, COUNCILMAN WILLIAMS.

>> THANK YOU, MR. MAYOR.

I HAVE ONE QUESTION FOR THE APPLICANT.

GIVEN THE PROXIMITY TO THE SCHOOL AND GIVEN YOUR CUSTOMER MIX, PARTICULARLY AS WE MOVE BACK TOWARDS FULL TIME IN-PERSON SCHOOLING, CAN YOU TALK A LITTLE BIT ABOUT YOUR SECURITY MEASURES? MOST OF YOUR STORES HAVE A PRETTY ATTRACTIVE FOOD MENU ALSO, THAT PROBABLY WOULD BE ATTRACTIVE TO STUDENTS.

AS STUDENTS COME AND GO ON YOUR PROPERTY, AND YOU HAD MENTIONED EARLIER ABOUT CAMERAS AND THOSE KIND OF THINGS.

WHEN WE NARROW IT DOWN, YOU DON'T HAVE AN ACTUAL PHYSICAL SECURITY PERSON OR DO YOU? CAN YOU SHARE OUT? I DON'T REMEMBER EVER SEEING A "SECURITY PERSONNEL".

CAN YOU TALK A BIT ABOUT YOUR SAFETY AND SECURITY MEASURES AT THIS SPECIFIC LOCATION BECAUSE YOU'RE GOING TO HAVE SOME UNIQUENESS, YOU ARE GOING TO HAVE AN AUDIENCE OF STUDENTS THAT I'M PRETTY SURE ARE GOING TO BE GOING BACK AND FORTH TO YOUR PROPERTY AND MIXING WITH CUSTOMERS.

[00:45:05]

>> SURE. THANK YOU, COUNCILMAN WILLIAMS

>> MR. HILL, IF YOU GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

>> YEAH. OF COURSE.

>> MY NAME IS KYLE HILL WITH MARTIN FROST HILL IN AUSTIN, TEXAS, AND I'M A LIQUOR LAWYER, IF THERE IS SUCH A THING SO I WENT TO LAW SCHOOL AND DID A LOT OF PRACTICE IN UNDERGRAD AND IT JUST ALL WORKED OUT THAT WAY.

I HAVE BEEN WORKING WITH MURPHY FOR A NUMBER OF YEARS NOW, AND I'VE BEEN BEFORE MANY CITY COUNCILS AS WELL.

THIS ISN'T OUR ONLY STORE THAT'S WITHIN 300 FEET, OR 301 FEET, OR 400 FEET OF A PUBLIC SCHOOL.

MURPHY REALLY PRIDES THEMSELVES.

THEY HAVE, I THINK, CLOSE TO 200 RETAIL PERMITS AND I'LL GET TO THIS SPECIFIC STORE FOR SURE.

BUT JUST BY WAY OF BACKGROUND, THEY WERE THE LARGER RETAIL PERMITS WHICH THE TABC AND TEXAS FOR CONVENIENCE STORES.

AS MR. WESTMORELAND MENTIONED, IT'S A FORTUNE 300 COMPANY.

THIS ISN'T A FLY-BY-NIGHT OPERATION.

THEY TAKE EXTREME CARE AND ARE VERY DILIGENT ABOUT BEING COMPLIED OPERATOR AND UNDERSTANDING THE CORPORATE RESPONSIBILITY THEY HAVE WITH REGARDS TO ALCOHOLIC BEVERAGE SALES AND MINORS AND INTOXICATED INDIVIDUALS.

TEXAS DOES NOT REQUIRE ALCOHOLIC AND BEVERAGE TRAINING FOR ITS RETAIL PERMITEES, BUT IT DOES HIGHLY RECOMMEND IT.

THERE ARE BENEFITS FOR THOSE WHO DO LIKE MURPHY.

THEY ENSURE THAT ALL OF THEIR EMPLOYEES ARE TRAINED, AUTHORIZED HOURS TO LOOK FOR SALES TO MINORS, CHECK FOR IDS.

AS SUCH, THEY ENJOY STELLAR COMPLIANCE RECORD WHEN YOU CONSIDER THE MULTITUDE OF ALCOHOL BEVERAGE TRANSACTIONS THEY HAVE.

OF COURSE, MINORS ARE GOING TO BE ATTRACTED TO CONVENIENCE STORE.

EVERY TIME I DRIVE HOME WITH MY KIDS, THEY WANT TO STOP IN FOR CANDY OR ICE CREAM, FOR SODAS, BUT THEY'RE NOT GETTING ALCOHOL.

WE'VE GOT SIGNAGE.

WE'VE GOT TRAINED STAFF, AND THE CLERKS ARE TRAINED.

THAT WORKS FOR US. THAT WORKS FOR THE COMMUNITY, AND THE CLERKS ARE GOING TO BE ON HEIGHTENED AWARENESS FOR THIS PARTICULAR LOCATION.

BETWEEN TRAINING AND STAFF AND FOLLOWING THE STATES RECOMMENDED AND TMC APPROVED COURSES, THAT'S HOW WE HOPE CONTROLLING AND KEEP ALCOHOL OUT OF THE HANDS OF MINORS.

>> THANK YOU, SIR. THANK YOU, MR. MAYOR.

>> VERY GOOD. THANK YOU, SIR. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT?

>> COUNCILMAN HENDRICK. HANG ON.

LET ME BACKUP. JENNIFER ERNST.

JENNIFER, BY NOW YOU KNOW THE DRILL.

>> I DO AND I'M SORRY.

I'M LIKE THE NAP THAT DOESN'T GO AWAY.

JENNIFER ERNST, 705 MALIBU DRIVE.

I HAVE A QUESTION FOR THE APPLICANT AND THAT IS, IF YOU HAVE IT IN FRONT OF YOU, HOW MANY UNDERAGE MINORS WERE SERVED IN YOUR FACILITIES OVER THE LAST THREE YEARS IN THE STATE OF TEXAS?

>> HOW MANY CITATIONS RECEIVED? OR HOW MANY INCIDENT?

>> YES. HOW MANY I GUESS HOW MANY CITATIONS WERE RECEIVED BECAUSE YOU CAN'T KNOW THEM ALL UNLESS YOU'VE GOT A CITATION RIGHT?

>> NO. THEY DO ISSUE WARNINGS EVEN THOUGH, BECAUSE OF TRAINING, EVEN IF A CLERK STILL MESSES UP AND SELLS TO A MINOR SAY A MINOR STILL, YOU WILL STILL GET A WARNING EVEN THOUGH THERE MAY BE AN ADMINISTRATIVE PENALTY, AND WHAT THAT IS IS EVIDENCE THAT THE RETAILER DID EVERYTHING TO STAY TO ASK A BIT AND TRAINING OF STAFF.

SOMETIMES STAFFS STILL SCREWS UP AND THAT'S WHEN YOU GET A CITATION.

OVER THREE YEARS, WITH ALMOST 200 RETAIL PERMITS, AND LET'S CALL IT THOUSANDS OF DAILY ALCOHOLIC BEVERAGE TRANSACTIONS.

I'M GOING TO GUESS AND THIS IS AN EDUCATED GUESS, MAYBE 15 OCCURRENCES OVER THE PAST FIVE YEARS THAT'S ACROSS THE STABLE.

>> THAT'S RELATIVELY LOW.

THANK YOU. I APPRECIATE YOUR ANSWER.

>> THANK YOU. LET ME GET BACK OVER HERE.

[00:50:02]

I BELIEVE WE'VE CLEARED THE QUEUE ON THE SIDE, AND COUNCILMAN HENDRICK.

>> THANK YOU, MR. MAYOR. IF THERE'S NO OTHER SPEAKERS, THEN I MOVE TO APPROVE THE VARIANCE REQUESTS BY MURPHY OIL TO ALLOW ALCOHOLIC BEVERAGES SALES AT LESS THAN THE MINIMUM DISTANCE REQUIRED FROM A SCHOOL.

>> VERY GOOD. I HAVE A MOTION BY COUNCIL MEMBER HENDRICK AND A SECOND BY COUNCIL MEMBER SMITH TO APPROVE THIS VARIANCE AS REQUESTED.

COUNCIL, PLEASE VOTE.

THAT ITEM IS APPROVED UNANIMOUSLY. THANK YOU, MR. HILL.

>> THANK YOU. CHEERS, EVERYONE.

>> ALL RIGHT, AND CONTINUING ON IT WITH ITEM 8E, AND COUNCILMAN HEDRICK, THIS ITEM IS IN YOUR DISTRICT AS WELL, AND IT HAS TWO PARTS.

ARE YOU WILLING TO CONSIDER THEM BOTH AT THE SAME TIME?

>> YES, SIR. I DON'T WANT TO SEPARATE THEM, AND

>> I JUST WANTED TO CHECK BEFORE I START READING.

WE'RE AT ITEM 8E, CONSIDER A SPECIFIC USE PROVISION REQUEST BY BALDWIN ASSOCIATES.

APPARENTLY, MY TIME IS UP, BALDWIN ASSOCIATES TO CONTINUE OPERATING A CHARTER SCHOOL FOR A PERIOD OF 10 YEARS.

THIS PROPERTY IS LOCATED AT 2266 ARAPAHO ROAD IN DISTRICT 7.

ALSO, THE SECOND PART OF THIS ONE IS CONSIDERED A SITE PLAN REQUEST BY BALDWIN ASSOCIATES FOR A CHARTER SCHOOL AT THE SAME LOCATION.

>> ALL RIGHT, MAYOR AND COUNCIL, AS STATED THE APPLICANT REQUEST TO CONTINUE OPERATING A CHARTER SCHOOL ON THE SUBJECT PROPERTY.

THIS IS ESSENTIALLY AN SUP RENEWAL.

THEY PREVIOUSLY HAD AN SUP ISSUED FOR FIVE YEARS, AND THAT IS SET TO EXPIRE THIS YEAR.

SO THEY ARE WISHING TO STAY IN AN EXISTING BUILDING, AND WISHING TO STAY.

THEY ARE REQUESTING TO RENEW THEIR SUP.

THIS IS THE CASE INFORMATION, 2266 ARAPAHO ROAD, AND THIS IS ALMOST IDENTICAL TO THE PREVIOUS REQUEST, VERY CLOSE TO THE PREVIOUS REQUEST WE JUST SAW NEAR THE SOUTHEAST SIDE OF ARAPAHO AND SHILOH ROAD.

THIS IS A MORE ZOOMED IN LOCATION MAP.

THE TEAL AREA OUTLINES THE ACTUAL SUBJECT PROPERTY WHERE THE CHARTER SCHOOL CURRENTLY OPERATES, AND WHERE THEY REQUEST TO CONTINUE TO OPERATE.

IT IS PART OF AN OVERALL SITE OF ARAPAHO ROAD BAPTIST CHURCH.

THE MAIN CHURCH BUILDING IS OVER HERE TO THE SOUTHEAST OF THE CHARTER SCHOOL BUILDING, AND WHAT WE CALL THE CHARTER SCHOOL BUILDING, I BELIEVE THE CHURCH USES ALSO AS THEIR FELLOWSHIP HALL.

THEN TO THE SOUTH IS A PRESCHOOL DAYCARE CENTER, ALL PART OF THE OVERALL SITE.

TO THE SOUTH-SOUTH-WEST IS AN EXISTING SINGLE-FAMILY NEIGHBORHOOD.

TO THE WEST IS A VACANT PROPERTY, ALSO TO THE NORTH, ACROSS HOLFORD IN ARAPAHO IS A VACANT PROPERTY, AND TO THE NORTHEAST ACROSS ARAPAHO IS ALSO VACANT, ALTHOUGH FURTHER TO THE EAST IS A MULTIFAMILY DEVELOPMENT UNDER CONSTRUCTION.

THE COMPREHENSIVE PLAN IDENTIFIES COMPACT NEIGHBORHOODS FOR THIS SITE AS WELL.

THE PROPOSED USE IS COMPATIBLE WITH COMPACT NEIGHBORHOODS AS SCHOOLS ARE OFTEN FOUND IN BOTH RESIDENTIAL AND NON-RESIDENTIAL AREAS.

IN ADDITION, THE SCHOOL SUPPORTS THE OVERALL COMMUNITY BY CONTINUING TO PROVIDE EDUCATIONAL OPPORTUNITIES, RESULTING IN INCREASED EDUCATIONAL ATTAINMENT SKILLS, AND A BETTER EQUIPPED WORKFORCE FOR THE EMPLOYMENT SECTOR OF THE LOCAL ECONOMY.

HERE'S SOME PHOTOS.

THIS PHOTO TO THE LEFT IS THE SUBJECT PROPERTY, AN EXISTING BUILDING WHERE THE SCHOOL OPERATES.

THE PHOTO TO THE RIGHT IS THE MAIN ARAPAHO ROAD BAPTIST CHURCH BUILDING.

THIS IS ON THE LEFT, THIS IS LOOKING GENERALLY FROM THE SITE, CADDY-CORNERED TO THE NORTHWEST ACROSS HOLFORD AND ARAPAHO ROAD.

THEN TO THE RIGHT IS LOOKING ACROSS ARAPAHO ROAD TO THE NORTHEAST.

THIS IS AN OVERALL SITE PLAN.

AGAIN, THIS BUILDING HERE IS CALLED THE FELLOWSHIP HALL, THAT'S SHARED WITH THE CHARTER SCHOOL BUILDING, AS THE CORE SUBJECT SITE.

BUT AGAIN, THIS SHOWS THE OVERALL SITE THAT I'VE MENTIONED, AND THIS IS A MORE ZOOMED IN SITE PLAN.

THE SITE IS IN CONFORMANCE WITH THE GDC PARKING REQUIREMENTS.

THERE IS SUFFICIENT PARKING IN ACCORDANCE WITH THE GDC AND THE APPLICANT IS NOT PROPOSING ANY BUILDING EXPANSIONS OR ANYTHING LIKE THAT,

[00:55:04]

SO NEW SCREENING AND LANDSCAPE STANDARDS ARE NOT TRIGGERED BY THIS REQUEST.

AS PART OF THE REVIEW, THE APPLICANT PRESENTED A TRAFFIC CIRCULATION PLAN TO STAFF.

THIS WAS REVIEWED AND APPROVED BY THE TRANSPORTATION DEPARTMENT.

THIS JUST SHOWS TRAFFIC CIRCULATION FOR A DROP OFF AND PICK UP TIMES, COMING IN OFF ARAPAHO ROAD AND JUST SHOWS THAT CIRCULATION PLAN HERE.

AGAIN FOR PICK UP AND DROP OFF.

THE APPLICANT IS NOT PROPOSING AN INCREASE IN STUDENT ENROLLMENT AS FAR AS NUMBER OF STUDENTS BEING IN THE CAMPUS, FOR BILLING AT ONE TIME, THEREFORE THERE IS NO INCREASE IN TRAFFIC IMPACT ANTICIPATED WITH THIS REQUEST.

THE APPLICANT REQUEST THE SUP RENEWAL BE IN EFFECT FOR A PERIOD OF 10 YEARS.

THEY INITIALLY REQUESTED ANOTHER FIVE YEAR RENEWAL, BUT THE PLANNING COMMISSION SUGGESTED 10 YEARS, AND THE APPLICANT WAS FINE WITH THAT.

SO THE REQUEST IS 10 NOW, AND THE REQUEST IS FOR AN SUP ONLY.

THERE ARE NO DEVIATIONS FROM THE GDC BEING REQUESTED.

STAFF'S RECOMMENDATION HAS APPROVAL OF THE REQUEST AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL.

IN ADDITION, AS I MENTIONED, THEY RECOMMENDED A 10 YEAR TIME PERIOD TO WHICH THE APPLICANT CONCURS.

LET'S SEE, WE MAILED OUT 23 LETTERS WITH THIS CASE AND WE RECEIVED THREE RESPONSES.

LET'S SEE, TWO WERE IN FAVOR, ONE WITHIN THE NOTIFICATION AREA, AND ONE OUTSIDE, ONE OF THE PROPERTY OWNERS OWNS TWO PROPERTIES.

THEN THERE WAS ONE OPPOSED TO THE REQUEST WITHIN THE NOTIFICATION AREA.

WITH THAT, MAYOR, I'LL BE GLAD TO ANSWER YOUR QUESTIONS.

>> GOOD. EXCUSE ME.

ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE, I DO BELIEVE WE HAVE AN APPLICANT WITH US?

>> YES, YOUR HONOR.

>> THERE YOU ARE. I COULDN'T SEE YOU IN THERE.

>> MY NAME IS ROB BALDWIN, OF ZIP 3904, ELM STREET, SUITE B, IN DALLAS.

I'M HERE REPRESENTING TEXAS, THAT'S KHAN ACADEMY IN THIS SUP RENEWAL.

I HOPE YOU CAN SUPPORT IT, STAFF SUPPORTED IT, THE PLANNING ZONING COMMISSION SUPPORT IT.

THEY DO REALLY GOOD WORK THERE FOR STUDENTS THAT AREN'T TRADITIONAL HIGH SCHOOL STUDENTS.

WE'VE BEEN THERE FOR FIVE YEARS AND HAVEN'T HAD ANY PROBLEMS, AND WE WOULD LIKE TO STAY THERE FOR AS LONG AS WE CAN.

I'M HERE TO ANSWER ANY QUESTIONS YOU MAY HAVE.

WILL DID A GREAT JOB BRIEFING YOU, BUT I CAN ANSWER ANY QUESTIONS BEFORE I SIGN OFF.

I MUST SAY THAT I REALLY LIKE YOUR YES AND NO PLAQUE.

HATS OF TO YOU FOR THAT.

AGAIN, ROB BALDWIN, I'M HERE TO ANSWER ANY QUESTIONS YOU MAY HAVE.

THANK YOU VERY MUCH.

>> VERY GOOD. COUNCILMAN HEDRICK?

>> THANK YOU, MR. MAYOR, JUST ONE QUICK QUESTION FOR THE APPLICANT.

I'M CERTAINLY SUPPORTIVE OF THIS ITEM, CONSIDERING THAT YOU'VE BEEN THERE ALREADY FOR FIVE YEARS AND EXTENDING IT TO THAT.

WE DID GET ONE COMMENT REGARDING STUDENTS CUTTING THROUGH THE ALLEY AND THROWING TRASH AND LITTER IN THE BACK ALLEY BEHIND THE SCHOOL AS THEY WALK FROM THE SCHOOL.

CAN YOU ADDRESS ANY MEASURES YOU MAY TAKE TO PUT A TRASH CAN OUT IN THE BACK, OR HELP PREVENT THAT?

>> YES, SIR. THIS WAS BROUGHT UP AT THE P&Z HEARING AS WELL, AND SCOTT BURROW WITH THEY HAVE A NEW CUSTODIAL STAFF THAT IS AWARE OF THIS AND WILL MAKE SURE THAT'S TAKEN CARE OF.

ALSO, SCHOOL SECURITY WILL BE PATROLLING THE AREAS BEFORE AND AFTER SCHOOL TO MAKE SURE THAT STUDENTS DON'T LINGER AND ARE GOOD CITIZENS.

>> PERFECT. THANK YOU. THANK YOU, MR. MAYOR.

>> THANK YOU. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? ALL RIGHT. THANK YOU, MR. BALDWIN.

IS THERE ANYONE ELSE WHO WOULD LIKE TO SPEAK ON THIS ITEM? I SEE NONE.

I CAN TELL YOU, COUNCIL, I WAS REPRESENTING DISTRICT 7 WHEN THE CHARTER SCHOOL WAS FIRST APPROVED.

THERE WERE A LOT OF CONCERNS EXPRESSED IN THOSE DAYS OF TRAFFIC CONGESTION AND CONGREGATION OF STUDENTS, ETC., AND I CAN TELL YOU, NONE OF THOSE NEGATIVE THINGS HAVE MATERIALIZED.

I SAW THE COMMENT ABOUT THE LITTER, BUT THE OVERALL CONCERNS AT THIS SITE, HONESTLY, IT HAS OPERATED.

I WOULD BE WILLING TO BET THAT MOST PEOPLE WHO DRIVE BY DON'T EVEN KNOW IT'S

[01:00:01]

THERE AS FAR AS THE ACTIVITY.

I WILL CERTAINLY BE IN SUPPORT OF IT.

COUNCILMAN HEDRICK, GO AHEAD.

>> THANK YOU, MR. MAYOR. I MOVE FOR APPROVAL OF SUP TO ALLOW A CHARTER SCHOOL ON THE 16-20 SUP FOR TEN YEARS.

I ALSO MOVE FOR APPROVAL OF A PLAN FOR A CHARTER SCHOOL ON THE SAME PROPERTY.

>> I HAVE A MOTION BY COUNCILMAN HEDRICK, AND A SECOND BY COUNCILMAN AUBIN TO APPROVE THE SPECIFIC USE PROVISION FOR 10 YEARS, AND THE SITE PLAN AS PRESENTED.

ANY FURTHER DISCUSSION? LET'S SHOW MR. BALDWIN OUR SIGNS AGAIN.

THAT ITEM IS APPROVED UNANIMOUSLY. THANK YOU, SIR.

MOVING ON. THAT WILL THAT WILL END THE DISTRICT 7 PORTION OF OUR SHOW FOR THIS EVENING.

I WOULD TELL YOU I REPRESENT A DISTRICT 7 FOR 12 YEARS BETWEEN THE PLANNING COMMISSION AND THE CITY COUNCIL, AND I DON'T THINK IN THAT TIME I EVER HAD THIS MANY ZONING CASES EVER.

IT'S A BIG NIGHT FOR DISTRICT 7.

THAT WILL MOVE US TO ITEM 8G.

CONSIDER A SPECIFIC USE PROVISION REQUEST BY R-DELTA ENGINEERS INCORPORATE TO ALLOW AN ELECTRIC SUBSTATION USE FOR AN UNLIMITED TIME PERIOD.

THIS PROPERTY IS LOCATED AT 2900 ELM GROVE ROAD IN DISTRICT 1.

I'M SORRY, COUNCIL NEIL, THIS IS ALSO A TWO-PART.

WOULD YOU LIKE TO CONSIDER THEM BOTH AT THE SAME TIME? 8H, CONSIDER A SITE PLAN REQUESTS BY R-DELTA ENGINEERS INCORPORATED FOR THE ELECTRIC SUBSTATION AT THAT SAME ADDRESS AT 2900 ELM GROVE ROAD. MR. GUERIN?

>> SIR MAYOR, COUNCIL, THIS IS A REQUEST TO CONSTRUCT AN ELECTRIC SUBSTATION ADJACENT TO AN EXISTING ELECTRIC SUBSTATION.

HERE'S THE CASE INFORMATION.

THE LOCATION IS 2900 ELM GROVE ROAD, AND THE PROPERTY OWNER IS THE CITY OF GARLAND.

APPLICANT IS R-DELTA ENGINEERS, INC, AND THE SPECIFIC ACREAGE FOR THE SUBSTATION SITE IN QUESTION IS THREE ACRES.

THE ZONE, AGRICULTURE.

THIS RED STAR INDICATES THE LOCATION OF THE SITE.

THIS IS OBVIOUSLY, THEY'RE ON THE OUTSIDE PORTION OF GARLAND BEYOND THE LANDFILL, AND THIS IS A MORE SPECIFIC LOCATION MAP.

THIS IS THE SUBJECT SITE WHERE THE SUBSTATION WOULD BE CONSTRUCTED.

THERE ARE ACTUALLY TWO EXISTING SUBSTATIONS NEARBY.

THE IMMEDIATELY ADJACENT ONE I BELIEVE THIS IS ENCORE SUBSTATION, AND THEN THIS ONE OVER HERE IS A GP&L'S EXISTING SUBSTATION.

THE PURPOSE OF THIS SUBSTATION WOULD BE TO INTERCONNECT TO THE GP&L SUBSTATION AND TRANSFORM AND DISTRIBUTE ELECTRICITY TO THE FARMERS ELECTRIC COOPERATIVE CUSTOMERS, AS THE FEC DEMAND IS NECESSITATING IT.

THE COMPREHENSIVE PLAN CONTEMPLATES THE LANDFILL AND THE GENERAL PUBLIC FACILITY OUT HERE, SO IT ACTUALLY HAS ITS OWN DESIGNATION AS OPERATING LANDFILL AND PUBLIC FACILITY.

IT RECOGNIZES THE IMPORTANCE OF THIS AND UTILITIES IN GENERAL FOR FUTURE DEVELOPMENT INFILL OR REDEVELOPMENT CASES THAT THESE SERVICES ARE NEEDED, AND THIS PARTICULAR UTILITY SERVICE THAT WOULD BE PROVIDED BY THIS PROPOSAL IS VALUABLE FOR NOT JUST THE SERVICE AREA AND ITS CUSTOMERS, BUT FOR FUTURE DEVELOPMENT.

HERE ARE PHOTOS OF THE AREA.

THE TOP TWO SHOW THE SUBJECT SITE AND LOOKING ACROSS VINSON ROAD HERE, AND THAT SHOWS A LITTLE SNAPSHOT OF THE EXISTING SUBSTATION AREAS.

AGAIN, THIS IS THE SITE PLAN.

THE RED SHOWS THE PROPOSED SUBSTATION.

AGAIN, THIS IS THE EXISTING ENCORE SUBSTATION OVER HERE, GP&L SUBSTATION OVER HERE.

IT IS MY UNDERSTANDING THAT IF THIS SUP IS APPROVED, THAT IT IS GP&L'S INTENT TO THEN EXPAND THEIR SUBSTATIONS, SO THIS GRAYED-OUT AREA YOU SEE HERE ON THE SITE PLAN WOULD BE A FUTURE GP&L EXPANSION.

IT CONFORMS WITH THE GDC LANDSCAPING AND SCREENING REQUIREMENTS.

THEY'D BE PROPOSING SOME TREES ALONG VINSON ROAD,

[01:05:05]

AND THERE WOULD BE AN EIGHT-FOOT CHAIN LINK FENCE AS WELL, CONSISTENT WITH THE EXISTING FENCING IN THAT AREA SCREENING THE SUBSTATIONS.

THIS IS THE SIMULATION THAT THE APPLICANT PUT TOGETHER JUST SHOWING THE POLE.

THERE WOULD BE A 120-FOOT TALL POLE, A SHIELD STRUCTURE THAT WOULD SUPPORT SOME COMMUNICATION ANTENNA THAT IS NECESSARY FOR COMMUNICATION AMONG THE UTILITY PROVIDERS, SO I JUST WANTED TO SHOW A SCALE THERE.

THE APPLICANT CAN EXPAND ON THIS IF THERE ARE MORE QUESTIONS, BUT IT'S MY UNDERSTANDING THERE'S SOME FALL PROTECTION PROVISIONS IN PLACE FOR THIS POLL IN CASE OF SOME TYPE OF DISASTER OR TORNADO OR SOMETHING LIKE THAT.

THIS WOULD BE WITHIN THE SITE, AND THE PHOTO JUST SHOWS WHAT THAT WOULD MOST LIKELY LOOK LIKE.

THERE'S THE FENCE DETAIL I MENTIONED EARLIER, IT WOULD BE AN EIGHT-FOOT CHAIN LINK FENCE.

AGAIN, CONSISTENT WITH THE FENCING IN THAT AREA.

THE APPLICANT PROPOSES THE SUP TO BE AN EFFECT IN PERPETUITY.

IN OTHER WORDS, AN UNLIMITED TIME PERIOD.

THE EXISTING SUBSTATIONS NEAR THE SUBJECT SITE, BOTH THE GP&L AND ENCORE SUBSTATIONS BOTH HAVE UNLIMITED TIME PERIODS AS WELL ALREADY, AND THOSE HAVE SUP'S BY THE WAY, THERE WERE APPROVED I BELIEVE IN 2007 AND 2008.

NO DEVIATIONS FROM THE GDC ARE BEING REQUESTED WITH THIS APPLICATION.

STAFF'S RECOMMENDATION IS APPROVAL OF THE REQUEST, AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL OF BOTH THE SUP AND THE PLAN, AND WE MAILED OUT FOUR LETTERS ON THIS CASE, AND WE RECEIVED ONE RESPONSE IN FAVOR, AND THAT WAS OUTSIDE THE NOTIFICATION AREA.

I'LL STOP SHARING THERE, AND I CAN ANSWER THE QUESTIONS.

>> ANY QUESTIONS FOR STAFF ON THIS ITEM? I DON'T SEE ANY.

I BELIEVE WE HAVE THE APPLICANT HERE.

I THINK I SAW HE'S BEEN HERE SOMEWHERE. THERE YOU ARE.

IF YOU GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE.

SO IT TAKES ME A MINUTE SOMETIMES.

>> YEAH. SORRY. GOOD EVENING. I'M FRANK PALMER, THE R-DELTA ENGINEERS.

OUR ADDRESS IS 618 MAIN STREET IN DOWNTOWN GARLAND.

WILL HAS DONE A GOOD JOB OF OUTLINING THIS AS COUNCIL'S AWARE THERE'S A CONTRACT BETWEEN RAYBURN ELECTRIC COOPERATIVE AND THE CITY OF GARLAND, TWO PARTS AS THE THREE ACRES, BASICALLY AT MARKET VALUE.

IT'S CLOSING IS CONTINGENT ON APPROVAL THIS SUP FOR THE SUBSTATION USE.

GLO MENTION THE 120-FOOT SHIELD POLE WITH A COUPLE OF COMMUNICATION DERIVATIONS ON IT.

IT'S NECESSARY FOR COMMUNICATION BACK TO THEIR CONTROL CENTER, FOR PROTECTIONS, THE POLL ITSELF, GOOD DESIGN FOR A 110 MILE AN HOUR WIND SPEED, SO WE GET SOMETHING THAT SAYS A BAD TYPICALLY A FAILURE BE THE 1/3 OR 2/3 POINT, SO I'D LAY DOWN BASICALLY IN THE YARD.

IT'S LOCATED 67 FEET FROM THE RIGHT-OF-WAY LINE OF THE ABIDING ROAD THERE.

BEYOND THAT, IT'S BASICALLY TO SERVE ADDITIONAL LOT OF GROWTH FOR FEC AND PROVIDE INCREASED RELIABILITY OF THEIR DISTRIBUTION SYSTEM.

THERE WILL BE AN INTERCONNECT TO THE GP&L 138 KV FACILITIES, WHICH WOULD THEN GO THROUGH EQUIPMENT AND FACILITIES OF RAYBURN, AND THEN THE DEMARC POINT WOULD THEN GO TO FARMERS ELECTRIC COOPERATIVE TRANSFORMERS THEN ON OUT IN THE DISTRIBUTION SYSTEM.

SEE IF THERE'S ANYTHING ELSE HERE.

THOSE ARE BASICALLY MY COMMENTS.

GREAT. IF YOU'VE GOT ANY QUESTIONS, I'D SURE BE HAPPY TO ANSWER.

>> ANY QUESTIONS FOR THE APPLICANT? I DO HAVE A CITIZEN WHO HAS SIGNED UP TO SPEAK ON THIS ITEM.

COUNCIL, ANY QUESTIONS FOR THE APPLICANT BEFORE I MOVE OVER TO THE OTHER? I DO HAVE ONE PERSON SIGNED UP TO SPEAK ON THIS ITEM, CARLIE ZACHARY.

CARLIE, I'VE OPENED THE LINE ON OUR END, IF YOU CAN UNMUTE YOURSELF AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE.

>> GOOD EVENING, EVERYONE.

MY NAME IS CARLIE ZACHARY.

I'M AT 3530 VINSON ROAD.

MY MAIN THING OF COMING ON HERE IS JUST WE HAVE OUR FAMILY THAT LIVES HERE,

[01:10:05]

I HAVE A THREE-YEAR-OLD, AND THIS IS LITERALLY OUR FRONT YARD THAT WE'RE LOOKING AT.

FOR ONE, I KNOW THAT THEY HAD STATED A LETTER HAS GONE OUT TO EVERYONE IN THE 400 FEET OF THIS THAT IT'S TO BE BUILT.

WE NEVER RECEIVED A LETTER, WE ALSO HAVE NEIGHBORS THAT DID NOT RECEIVE A LETTER THAT WE ASKED, ALSO EXTENDED FAMILY ON VINSON NEAR US THAT DID NOT RECEIVE A LETTER THAT WAS A CONCERN WHERE I COULD HAVE BROUGHT SOMETHING UP A LITTLE SOONER THAN NOW, BUT WE DIDN'T RECEIVE SOMETHING.

LIKE I SAID, ANOTHER THING IS JUST THIS IS OUR FRONT YARD AND I KNOW THAT THERE'S ANOTHER AGRICULTURE PIECE OF LAND THAT THE CITY OWNS RIGHT NEXT TO IT.

WHY DOES THIS HAVE TO BE AN EYESORE FOR THE NEW HOMES THAT ARE SITTING HERE ON VINSON THAT WILL BE LOOKING AT IT EVERY DAY.

WHY CAN'T IT BE THE HIDDEN LANDFILLS EYESORE? AND I DON'T KNOW IF THAT'S AN OPTION, BUT I WANTED TO BRING IT IN YOUR ATTENTION.

>> THANK YOU, MA'AM. DO YOU HAVE ANY OTHER QUESTIONS? I'LL POP BACK OVER TO STAFF AND ASK SOME QUESTIONS FOR YOU.

>> I THINK THAT WAS REALLY IT.

JUST SEEING IF THAT WAS ANOTHER OPTION OF HAVING IT OFF OF ACTUALLY ELM GROVE INSTEAD OF OFF OF VINSON.

>> AS FAR AS YOUR HOME AND THE NEIGHBORS YOU SPOKE OF, ARE THOSE WITHIN THE CITY OF GARLAND OR OUTSIDE THE CITY OF GARLAND?

>> OUTSIDE THE CITY OF GARLAND.

>> THANK YOU. MR. GARY CAN YOU ADDRESS THE NOTIFICATION LETTERS PLEASE?

>> YES MAYOR. FOR ANY PROPERTIES THAT FALL OUTSIDE THE CITY OF GARLAND INTO ANOTHER JURISDICTION, WHAT WE DO IS WE MAIL ONE LETTER TO THAT CITY GOVERNMENT, TO THEIR CITY HALL, AND WE DEFER IT TO THEM ON HOW THEY WISH TO DISTRIBUTE THAT IF THEY DO.

SOME OF OUR NEIGHBORS DO THE SAME WITH US, WE OCCASIONALLY GET ZONING LETTERS FROM THE CITY OF RICHARDSON AND THE CITY OF ROWLETT, I BELIEVE.

THAT'S HOW WE HANDLE THAT VERSUS NOTIFYING OTHER COMMUNITY CITIZENS.

>> WE NOTIFIED THE CITY OF ROWLETT.

>> THAT'S CORRECT, YES SIR.

>> THANK YOU, SIR. COUNCIL MEMBER SMITH?

>> JUST A QUICK FOLLOW ON QUESTION WITH THAT.

WELL, DID WE HAVE THE SIGNS PRINTED UP AND PUT OUT THERE OR WE'RE STILL ON THE OLD ONES?

>>

>> OKAY, THANK YOU, SIR.

>> YES, SIR. I THINK THIS CASES TONIGHT FELT RIGHT.

THEY HAD GONE TO PLANNING COMMISSION WHERE WERE NOTIFIED WITH THE OLD LETTERS, AND THEN WE STARTED WITH THE NEW MIDWAY BETWEEN.

I THINK WE WENT OUT AND PUT OUT SOME NEW SIGNS, BUT THEY MAY HAVE HAD THE OLD ONES AS WELL, SO YES AND YES.

>> UNDERSTOOD. I APPRECIATE IT.

>> COUNCILMAN MCNEAL, I BELIEVE WE HAVE CLEARED THE QUEUE HERE. GO AHEAD, SIR.

>> THANK YOU, MR. MAYOR, AND ONE QUESTION BEFORE I MOVE FOR APPROVAL.

MR. GARY, ON THE EIGHT-FOOT SCREENING, THAT'S OUR STANDARD SCREENING OBVIOUSLY WITH THE TOWER ABOVE THAT.

BUT THAT'S JUST, AGAIN, I THINK YOU INDICATED THAT THAT SCREENING IS JUST AN EXTENSION OF THE EXISTING SCREENING.

AM I UNDERSTANDING YOU CORRECTLY?

>> ESSENTIALLY, SIR, YES.

IN OTHER WORDS, IT'LL MATCH THE CHAIN LINK FENCING THAT'S ALREADY OUT THERE.

IT'LL BE VERY, VERY SIMILAR. YES, SIR.

>> THANK YOU, SIR. MR. MAYOR WITH THAT, I MOVE FOR APPROVAL OF THE SITE PLAN, AS WELL AS THE SUP.

>> I HAVE A MOTION BY COUNCILMAN MCNEAL, AND A SECOND BY MAYOR PRO TEM NICKERSON TO APPROVE THE SPECIFIC USE PROVISION AS WELL AS THE SITE PLAN ON THIS ITEM.

ANY FURTHER DISCUSSION? IF NOT, COUNCIL PLEASE VOTE.

THAT ITEM IS APPROVED UNANIMOUSLY. THANK YOU, COUNCIL.

THAT WAS OUR LAST OUR LAST ZONING CASE FOR THE EVENING.

WE'RE NOW ON PERSONS WISHING TO ADDRESS ISSUES NOT ON THE AGENDA MAY HAVE THREE MINUTES TO ADDRESS COUNCIL AT THIS TIME.

COUNCIL IS PROHIBITED FROM DISCUSSING ANY ITEM NOT

[01:15:02]

POSTED ACCORDING TO THE TEXAS OPEN MEETINGS ACT.

I HAVE SEVERAL FOLKS SIGNED UP TO SPEAK, I'LL JUST TAKE THEM IN THE ORDER THAT I HAVE THEM ON MY SHEET.

THE FIRST IS HOW MANY HOLLY SANBORN? I'VE OPENED THE LINE ON OUR END, IF YOU CAN UNMUTE YOURSELF, AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

>> HOLLY SANBORN, 2402 RIDGECREST, GARLAND.

I JUST WANTED TO THANK YOU ALL FOR THE ADU DISCUSSION LAST NIGHT.

I APPRECIATE THE FACT THAT JOEL HAS DECIDED TO LEAVE THINGS AS IS, AND THAT WAS ALL I HAD TO SAY. THANK YOU.

>> THANK YOU MA'AM. MY NEXT SPEAKER IS JENNIFER ERNST.

>> JENNIFER ERNST, 705 MELBA DRIVE.

IN THE LAST 12 MONTHS, IT HAS BECOME MORE APPARENT JUST HOW IMPORTANT THE COUNCIL'S JOB IS FROM COVID TO SNOVID AND ALL THE WAY DOWN TO LIVING CONDITIONS SUCH AS ADUS, AND WE THANK YOU FOR YOUR WORK ON THESE ISSUES DURING THIS TIME.

WE THE PEOPLE ARE ENTITLED TO REPRESENTATION WHO WILL DO THE RESEARCH, RUN THE STATISTICS, AND WHO WILL FIND THE SCHOLARLY ARTICLES.

AS SUCH, WE ARE ALSO ENTITLED TO REPRESENTATION WHO CAN DO THESE THINGS OR KNOW HOW TO ASK FOR HELP TO GET IT DONE.

THIS IS PARTICULARLY TRUE WITH ANY COUNCIL DECISION WHICH MAY IMPACT POLICE OR FIRE.

WE NEED HERE TO LOOK HOW ANY DECISION AFFECTS CRIME RATES, QUALITY OF LIFE, AND/OR PUBLIC SAFETY.

OUR POLICE HAVE ENOUGH ON THEIR PLATES AND DESERVE THE RESPECT OF THIS COUNCIL BY TAKING CRIME RATES INTO CONSIDERATION, AND/OR THE IMPACT OF DECISIONS THIS COUNCIL MAKES ON THE POLICE OFFICER'S JOBS.

LASTLY, I'M A LITTLE DISAPPOINTED IN HOW THE ADU POLICY DISCUSSION PLAYED OUT LAST NIGHT.

I WATCHED ALL THREE OF THE DSD VIDEOS.

AFTER VIEWING THEM, IT IS APPARENT THE RESIDENTS OF GARLAND DESERVE MORE RIGOR IN THE PROCESS.

YOU CONDUCT IN THE WHOLE COMMUNITY, NOT JUST CERTAIN DISTRICTS AND NO, 'WELL, I TALKED TO SOME CITIZEN GROUPS IN MY AREA'.

COMMUNITY OUTREACH REQUIRES OUTREACH TO THE COMMUNITY, ALL OF THE COMMUNITY.

IN THESE VIDEOS, THERE WAS NO SUGGESTION OR VIBE THE RECOMMENDATION WAS GOING TO BE NO CHANGE.

IN FACT, IT APPEARED TO BE QUITE THE OPPOSITE UP UNTIL THE COUNCIL MEETING LAST NIGHT.

IF THE RECOMMENDATION COMING OUT OF COMMITTEE WAS GOING TO BE NO CHANGE, WHY MAKE THE WHOLE PRESENTATION AND GIVE ALL THE INFORMATION? IT IS APPARENT SOMEWHERE BETWEEN THE LAST COMMITTEE MEETING AND THE COUNCIL MEETING, YOU WENT FROM A POSITIVE RECOMMENDATION TO NO CHANGE, WHICH IS THE RIGHT THING, BUT CANDIDLY SHOULD HAVE NEVER MADE IT OUT OF COMMITTEE IF NO CHANGE WAS THE RECOMMENDATION RESULT FROM THE LAST COMMITTEE MEETING, WHICH WATCHING THE VIDEO IT WAS NOT.

PLEASE ALSO NOTE, I WILL BE ASKING AND CONTINUING TO PUSH FOR ANSWERS ON PROGRESS IN REGARDS TO GP&L AND WHAT OUR CITY ALONG WITH GP&L CAN DO BETTER TO HELP WITH WHAT HAPPENED DURING THE FEBRUARY 2021 STORM.

I WOULD ASK AT THIS TIME THAT THE COUNCIL INVITE GP&L BACK TO THE NEXT COUNCIL MEETING OR THE ONE AFTER FOR AN UPDATE FROM THEM.

THANK YOU, MR. MAYOR AND COUNCIL FOR ALL OF YOUR HARD WORK, AS WELL AS YOUR THEATER PROCLAMATION FROM A THEATER AND CHOIR NERD.

THEATER IS IMPORTANT TO OUR COMMUNITY AND TO OUR CHILDREN.

COUNCILMAN VERA, I WANT YOU TO KNOW THAT I SEE YOUR SECONDS.

THAT MAYOR MAY NOT, BUT I JUST WANTED YOU TO KNOW THAT I WAS SEEING YOUR PEACE SIGNS IN THE VIDEO.

>> THANK YOU MA'AM.

I DO HAVE ONE PERSON WHO HAD SIGNED UP TO SPEAK, BUT I DON'T SEE THEM ONLINE WITH US.

LET ME JUST CLICK AROUND HERE JUST TO BE SURE, BUT I DON'T SEE THEM IN THE QUEUE.

MY LAST, I DO HAVE JOSH GARCIA.

BEFORE I START MY COMMENTS, I WOULD LIKE TO WISH YOU A VERY HAPPY BIRTHDAY TO MR. BRADFORD, GOD BLESS YOU MANY MORE YEARS OF LIFE AND CONTINUE TO BE A GREAT SERVANT LEADERSHIP TO OUR CITY OF GARLAND.

I REALLY APPRECIATE ALL YOU DO FOR OUR CITY AND CONTINUE TO STRIVE IN OUR CITY OF GARLAND, AND I MUST SAY THAT THE WHITE HAIR DOES NOT MAKE YOU OLD.

NUMBER TWO, I WOULD LIKE TO SAY DURING I FORGOT TO SAY FOR THE AIR-CON ON THE WINTER STORM, SEEING THAT ON THE GARLAND NEXTDOOR UPDATES, THAT I REALLY SAW ON THE STAR WARS.

THAT WAS REALLY AN AMAZING UPDATE THAT YOU GUYS PUT, THAT COUNCIL MEMBER IRWIN DID, THAT WAS REALLY GREAT.

[01:20:01]

ALSO THE FALSE COAST AND THE RUSSIAN DOES WHEN HE SAID ABOUT THOSE, THAT WAS REALLY GREAT.

I REALLY APPRECIATE VERY MUCH MR. MAYOR FOR WHAT YOU DO AND I DON'T KNOW WHAT ELSE TO SAY.

YEAH AND THEN ALSO I WANT TO RECOGNIZE TWO CITIZENS.

I APPRECIATE MR. JEFF BASS, THE OWNER, I THINK HIS BARBECUE PAYED A 1413 WESTBROOK GARLAND, TEXAS FOR HELPING THOSE PEOPLE IN NEED, THE GRILL STATION AND EVERYTHING, AND ALSO MR. JULIAN OLALDE FOR ALWAYS SUPPORTING THE RESTAURANTS FOR GARLAND FOODIES, I WILL ALWAYS SUPPORT THEM.

MR. BASS ALWAYS HAS TO STEP UP TO HIS LEADERSHIP AND ALWAYS HAS A CERTAIN HEART TO HELP OUR CITIZENS OF GARLAND, TEXAS AND I REALLY APPRECIATE VERY MUCH.

THAT'S ALL I HAVE TO SAY, MR. MAYOR, THANK YOU AGAIN AND KEEP LOOKING VERY PROFESSIONAL.
