WE INVITED ABOUT NINETY SIX HUNDRED, ALMOST TEN THOUSAND, AND WE HAD A LITTLE OVER FOURTEEN HUNDRED THAT ACTUALLY SHOWED UP FOR FIRST DOSES. NOW KEEP IN MIND, WERE STILL DOING SECOND DOSES AS WELL. I KNOW, WE HAVE ALL BEEN VERY CAUTIOUS AND WE'VE HAD OUR SENIOR CENTERS CLOSED FROM THE GET GO, I WILL TELL YOU OUR STAFF AND THEIR DISCUSSIONS WITH THE SENIORS, THE I'LL PUT IT POLITELY, BUT THE SENIORS ARE HOUNDING THEM TO REOPEN. AND I TELL YOU, WE STRUGGLE WITH THAT. OUR ORIGINAL THOUGHT WAS TO WAIT ON THE SENIOR CENTERS UNTIL THIS SUMMER, UNTIL THAT MAY THIRTY FIRST DATE, AND THAT IS OUR CURRENT PLAN. IT'S ONE WAY TO REACH OUT TO MORE OF THE SENIORS WHO MIGHT HAVE BEEN HOMEBOUND AND UNABLE TO GET TO THAT VACCINE. THAT'S JUST A THOUGHT. YOU KNOW, I DO SEE THE LOGISTICAL ISSUES AND POTENTIAL LEGAL ISSUES AS FAR AS REQUIRING PROOF OF VACCINE OR RAPID COVID TESTS TO GET INTO THE SENIOR CENTER. BUT I WANT TO MAKE SURE, ESPECIALLY WITH THAT PARTICULAR POPULATION, THAT EVERY OPPORTUNITY HAS BEEN GIVEN FOR THEM TO GET THE VACCINE. AND SO THAT AT THAT POINT, IT'S VERY MUCH A CHOICE. SO THE CITY DID A GREAT JOB KEEPING UP WITH THE COUNTY AND USING THE RESOURCES THAT WERE AVAILABLE WHEN WHEN THEY COULD. SO IT WAS A GREAT AUDIT. THERE WAS UNMODIFIED OPINIONS ON THOSE MAJOR SINGLE AUDIT PROGRAMS. CORONAVIRUS RELIEF FUND WAS ONE. THE OTHER WAS THE DRINKING WATER LOAN PROGRAM. AND THEN YOU ALSO HAVE A STATE SINGLE AUDIT BECAUSE YOU EXPEND MORE THAN 700--WELL, I'M SORRY FOR SINGLE AUDIT, IT'S THREE HUNDRED THOUSAND AS THE THRESHOLD. SO BECAUSE THAT WAS EXCEEDED, THE PLEASANT VALLEY CONSTRUCTION PROJECT WAS SELECTED. SO THOSE RECEIVED UNMODIFIED OPINIONS. YOU HAD NO SIGNIFICANT DEFICIENCIES TO REPORT. AS MANY OF YOU ARE AWARE, THE CITY OF GARLAND PROVIDES ECONOMIC DEVELOPMENT INCENTIVES TO PROMOTE NEW DEVELOPMENT AND REDEVELOPMENT IN GARLAND. BASICALLY, THIS IS A TOOL THAT WE USE TO ATTRACT NEW INDUSTRIES AND TO ENCOURAGE RETENTION AND REDEVELOPMENT TO PROPERTY TAX EXEMPTIONS OR REDUCTIONS. SALES AND USE TAX REBATES OR [INAUDIBLE] TAX REBATES AND OTHER CHAPTER 380 INCENTIVES. WE HAD TWO OBJECTIVES FOR THIS AUDIT. THE FIRST ONE WAS TO DETERMINE IF THE CITY HAS ESTABLISHED A STANDARDIZED PROCESS TO RECEIVE, EVALUATE AND APPROVE ED INCENTIVE REQUESTS. FOR THIS OBJECTIVE, [INAUDIBLE] COVER JANUARY 2018 - MAY 2020. THE NEXT OBJECTIVE WAS TO VERIFY THAT THE CITY MONITORS AND VERIFY COMPLIANCE OF ED AGREEMENTS. AND FOR THAT WE COVERED ALL ACTIVITY AGREEMENTS WHICH WERE MANAGED BY THE ECONOMIC DEVELOPMENT DEPARTMENT. THERE WERE A TOTAL OF TWENTY FOUR AND THERE WERE ANOTHER EIGHT WHICH WERE HANDLED BY OTHER DEPARTMENTS. OVERALL, I BELIEVE THIS AUDIT WAS VERY FRUITFUL. THERE WERE WE'VE IDENTIFIED A FEW OPPORTUNITIES WHERE WE CAN ENHANCE OUR CITY'S FOOTPRINT, ESPECIALLY WHEN IT COMES TO PROVIDING CERTAIN SERVICES TO OUR CUSTOMERS OR IN THIS CASE, THE ENTITIES. PART OF THE AGREEMENT. SOME OF THESE ENTITIES WERE REQUIRED TO USE OUR CITY'S SOLID WASTE SERVICES, WHICH THEY WERE NOT. AND SO THIS GIVES US AN OPPORTUNITY TO ENCOURAGE AND TO ATTRACT THESE ENTITIES TO THE CITY SOLID WASTE SERVICES. SO STAFF I KNOW TALKING WITH THE ED DEPARTMENT AS WELL AS THE ENVIRONMENTAL WASTE SERVICES THEY'RE ON TOP OF THIS RIGHT NOW, THEY ARE IN THE PROCESS OF REACHING OUT TO MANY OF THESE ENTITIES TO ATTRACT THEM, TO USE OUR SERVICES. SOME OF THE OTHER THINGS THAT WE [INAUDIBLE] DEPARTMENT OPPORTUNITIES FOR IMPROVEMENT AND OUR CONTRACTS CAN BE CLARIFIED A LITTLE FURTHER. FOR ONE EXAMPLE, IN SOME INSTANCES WHEN THE DEVELOPER SELLS OR LEASE US OUT TO ANOTHER ENTITY IN THE AREA, WE DO NOT HAVE CLARITY IN OUR AGREEMENTS WHERE THE DEVELOPER IS STILL RECEIVING THE INCENTIVES. HOWEVER, THEN THE NEW PERSON WHO IS LEASING THE PROPERTY MAY NOT HAVE TO ABIDE BY SOME OF THESE AGREEMENTS SO ONCE WE CLARIFY THAT IN THE CONTRACT, WE'LL HAVE A CLEAR DIRECTION ON WHETHER THE NEW ENTITY THE LEASEE WILL HAVE TO COMPLY OR NOT. THE OTHER THING THAT WE FOUND ON SOME OF THE ABATEMENT CALCULATIONS, SINCE THE METHODOLOGY WAS NOT DEFINED, WE HAD A FEW INACCURACIES IN HOW WE CALCULATED THE ABATEMENTS. AND FOR THAT REASON, WITH ONE ENTITY WE USED THREE DIFFERENT METHODOLOGY IN CALCULATING, WHICH RESULTED IN PROVIDING A REFUND, THEN TURNING BACK AND SENDING THEM A TAX BILL. AGAIN, ONCE NOTIFIED, THE DEPARTMENT IMMEDIATELY TOOK CHARGE AND CONTACTED THE ENTITY TO FIX THIS ERROR. IN ANOTHER INSTANCE, AGAIN, ABATEMENT CALCULATION MISUNDERSTANDING, WHICH COST AN ENTITY TO OVERPAY THE TAXPAYER MONEY TO THE CITY. ONCE WE REALIZED THAT WE DID CONTACT THE ENTITY AND WERE ABLE TO MITIGATE THIS, WERE ABLE TO PROVIDE THE ACCURATE INFORMATION TO THEM AND WE ACTUALLY CUT A CHECK TO THEM. IN OTHER INSTANCES, SOME OF THE ENTITIES WERE PAID INCENTIVES WHILE THEY WERE IN A PROTEST, TAX PROTEST OR A TAXES LAWSUIT WERE HAPPENING. PER OUR AGREEMENT, WE ARE NOT REQUIRED TO PAY THE INCENTIVES IF THERE IS AN ACTIVE LAWSUIT OR THERE'S AN ACTIVE TAX PROTEST. BUT IN THIS INSTANCE, WE MADE THE PAYMENT. GOING FORWARD, THE DEPARTMENT WILL HAVE A BETTER CHECKLIST. AND THEY ALSO HAVE FIGURED OUT A WAY TO VERIFY THE STATUS OF POTENTIAL LAWSUITS ON DALLAS COUNTY APPRAISAL DISTRICT WEBSITE AND SOME OF THE OTHER ONES WERE MINOR ISSUES, [01:20:06] SOME OF THE SUPPORTING EVIDENCE THAT WE RECEIVED FROM THESE ENTITIES WERE NOT SIGNIFICANT OR WERE NOT SUFFICIENT ENOUGH FOR US TO VERIFY THEIR COMPLIANCE. SO WE HAVE MADE RECOMMENDATIONS FOR THEM TO OBTAIN MORE DETAILED INFORMATION. AND ALSO, WHEN CHANGES ARE MADE TO OWNERSHIP, OR NAMES THEY ARE REQUIRED TO NOTIFY THE CITY. AND SOME OF THESE INSTANCES, THEY DO NOT DO THAT. OVERALL, A NUMBER OF RECOMMENDATIONS TO ENHANCE OUR INTERNAL CONTROLS AND COMPLIANCE VERIFICATIONS WITH THE DEPARTMENT. I DO WANT TO APPRECIATE MR. ON WHEN THOSE CONTROLS HAVE BEEN ESTABLISHED, I GUESS, IS MY FIRST QUESTION. AND CHAIRMAN, I MEAN, COUNCIL MEMBER SMITH, ACCORDING TO THE REPORT, BY THIS SUMMER, THEY HAVE AGREED TO IMPLEMENT A LOT OF THESE CONTROLS. I WILL SAY WE MAY HAVE TO WAIT ANOTHER CYCLE FOR COMPLIANCE BECAUSE THE DEPARTMENT USUALLY SENT OUT THEIR COMPLIANCE VERIFICATION DOCUMENTS TO THESE ENTITIES, USUALLY IN JANUARY EVERY YEAR. SO IF YOU WAIT FOR NEXT CYCLE, I WOULD SAY THAT WILL BE IN 2022, SUMMER TIME. WE CAN GO BACK AND VERIFY THESE INTERNAL CONTROLS THAT HAVE BEEN PUT IN PLACE AND MITIGATED. SOMETHING IS STICKING IN MY BRAIN THAT THAT'S NO LONGER ALLOWABLE IN OUR CONTRACTS. AND ARE WE CHANGING OUR APPROACH TO THAT GOING FORWARD? I THINK THERE WAS SOME LEGISLATIVE ISSUE THAT TOOK THAT AWAY FROM US. CAN ANYBODY SPEAK TO THAT? BRYAN, I BELIEVE YOU'RE MUTED. JED, I'LL TRY TO ADDRESS THAT. THERE WAS SOME LEGAL CONCERN AS TO WHETHER OR NOT WE COULD REQUIRE THAT. THERE WAS ALSO SOME PRACTICAL ISSUES THAT WE RAN INTO. FOR EXAMPLE, THE PERSON BUILDING THE FACILITY MAY NOT BE THE ONE USING THE FACILITY, WHICH IS THE CASE IN A LOT OF OUR SITUATIONS AND A LOT OF OUR AGREEMENTS WHERE WE'RE BUILDING A MANUFACTURING SHELL THAT MAY END UP HOSTING A LOT OF DIFFERENT USES. A LOT OF OUR USERS ARRIVED WITH NATIONAL CONTRACTS THAT WOULD HAVE PUT THEM IN LEGAL JEOPARDY TO BREAK. AND SO WE STARTED RUNNING INTO A NUMBER OF PRACTICAL ISSUES. WHERE WE CAN CERTAINLY DO BETTER IS THERE WAS THERE WAS NOT THE LEVEL OF COMMUNICATION THAT WAS HAPPENING BETWEEN THE DEPARTMENT AND THE REST OF THE ORGANIZATION. AND FOR EXAMPLE, WHERE WE'RE TRYING TO MOVE IS WHEN ECONOMIC DEVELOPMENT CEMENTS A DEAL, THEN THEY IMMEDIATELY LET US KNOW SO THAT EWS THEN CAN APPROACH THE ULTIMATE USER AND AN ATTEMPT TO ACQUIRE THE ACCOUNT BECAUSE THEY'RE REALLY THE ONES THAT NEED TO BE INVOLVED. AND MATTER OF FACT, I THINK JED WILL AGREE. IF YOU LOOK THROUGH THIS AUDIT BEHIND SO MANY OF THE ISSUES, WERE THE FACT THAT THE DEPARTMENT ITSELF WAS NOT COMMUNICATING WITH THE REST OF THE ORGANIZATION IN A CLEAR AND PRODUCTIVE WAY AND A LOT OF THE ISSUES THAT ARRIVED WHEN YOU GOT TO THE ROOT OF THEM, THAT WAS WHAT WAS BEHIND. AND SO WE'RE WORKING VERY, VERY HARD TO RESOLVE THAT. AND JUST TO LET YOU KNOW, I'VE GOT CITY ATTORNEY HAS RAISED HIS HAND, SO I'M GOING TO CALL [01:25:03] ON HIM AT THIS POINT. MR. NEIGHBOR. AND WHEN WE CRAFTED SOME LANGUAGE TO ADDRESS THAT CONCERN, AND IT'S UNFORTUNATELY BEEN, IN MY VIEW, BEEN CARRIED ALONG IN BOILERPLATE OVER AND OVER THE YEARS, I DIDN'T KNOW IT WAS GOING TO GAIN THE PREEMINENCE THAT IT DID IN THIS AUDIT REPORT. GO AHEAD SO WHAT THIS BASICALLY IS, IS IN THE 2019 LEGISLATIVE SESSION, A LAW WAS PASSED TO PROVIDE PROPERTY TAX RELIEF IN THE FORM OF A TEMPORARY PROPERTY TAX EXEMPTION FOR ELIGIBLE PROPERTIES WHEN A COUNTY IS DECLARED A DISASTER AREA BY THE GOVERNOR. SO WITH THE WINTER STORM, THIS IS KIND OF THE FIRST OPPORTUNITY, THE FIRST TIME THE PUBLIC HAS SEEN THIS EXEMPTION IN ACTION WITH THE GOVERNOR DECLARING ALL TWO HUNDRED AND FIFTY FOUR COUNTIES A DISASTER AREA ON FEBRUARY 12TH. [01:35:01] SO WHAT I THOUGHT I'D DO IS JUST KIND OF GO OVER WHAT ARE THE QUALIFYING FACTORS FOR THIS EXEMPTION, HOW THE EXEMPTION IS CALCULATED, AND THEN FINALLY, HOW A RESIDENT OR A BUSINESS OWNER COULD APPLY FOR THIS EXEMPTION. VERY GOOD. SO HOW TO QUALIFY? SO THERE'S REALLY THREE TYPES OF QUALIFYING FACTORS. ONE IS A TANGIBLE PERSONAL PROPERTY USED FOR INCOME PRODUCTION OR WHAT WE CALL BUSINESS PERSONAL PROPERTY. THE OTHER IS IMPROVEMENTS TO REAL PROPERTY. SO A HOME, A BUSINESS AND THEN ALSO CERTAIN MANUFACTURING HOMES. I BELIEVE WHAT THEY'RE MEANING BY THAT IS IF THE MANUFACTURING HOME IS USED AS A DWELLING UNIT. THE ONE THING THAT ISN'T LISTED AND ONE THING THAT IS NOT INCLUDED IN THE CALCULATION IS LAND. SO IT'S BASICALLY THE STRUCTURES AND THE PIECES OF THE PROPERTY AND THE IMPROVEMENTS ON THE LAND. SO OBVIOUSLY NEED TO BE LOCATED IN AN AREA DECLARED A DISASTER. WELL, IN THIS SITUATION, NOT JUST DALLAS COUNTY OR THE CITY OF GARLAND, THIS IS THE FIRST TIME WE'VE SEEN THE ENTIRE STATE OF TEXAS COULD TAKE ADVANTAGE OF THIS. AND THE THIRD QUALIFYING FACTOR IS YOU NEED TO AT LEAST HAVE 15 PERCENT OF YOUR PROPERTY DAMAGE DUE TO THE DISASTER. THIS IS DETERMINED BY THE CHIEF APPRAISER, WHICH FOR MOST OF US WOULD BE THE DALLAS COUNTY CENTRAL APPRAISAL DISTRICT. SOME OTHER NOTES IS THIS IS A TEMPORARY DISASTER AREA EXEMPTION, SO THIS WOULD BE ONLY AVAILABLE FOR THE CURRENT TAX YEAR OF 2021, ALL TWO HUNDRED FIFTY FOUR COUNTIES, AS I'VE MENTIONED, HAVE BEEN DECLARED A DISASTER. THIS EXEMPTION DOES NOT CHANGE YOUR MARKET VALUE AND IS EXEMPTION FOR YOUR TAXABLE VALUE. AND THEN THE FINAL PIECE THAT I'LL MENTIONED MULTIPLE TIMES IS THE DEADLINE FOR APPLYING FOR THIS DCAD. YOU DON'T APPLY WITH THE COMPTROLLER'S OFFICE OR THE CITY OF GARLAND IT'S WITH DCAD, MAY 28TH, 2021. SO NOW GETTING INTO HOW THIS EXEMPTION IS CALCULATED FOR EACH PROPERTY THAT IS DAMAGED BY A DISASTER, THERE'S THIS PROPERTY DAMAGE ASSESSMENT RANKING THAT IS IN THIS LAW AND BASICALLY THE WAY IT IS, IS IT HAS FOUR DIFFERENT LEVELS. SO IF YOUR DAMAGES ARE BETWEEN 15 PERCENT AND LESS THAN 30 PERCENT, THE EXEMPTION IS 15 PERCENT AND 30 PERCENT LESS THAN 60, YOUR EXEMPTION IS 30 PERCENT OF THE PROPERTY AND SO ON, ALL THE WAY UP TO ONE HUNDRED PERCENT. AND DCAD HAS PROVIDED SOME KIND OF DAMAGE DESCRIPTIONS OF WHAT EACH ONE OF THESE MAY BE. AND THEN ONCE YOU HAVE THESE EXEMPTION PERCENTAGES, IT IS PRORATED BASED ON THE TIME OF YEAR, THE TAX YEAR. SO JANUARY 1ST TO DECEMBER 31ST THAT THE DISASTER OCCURRED. AND AS I MENTIONED, THIS WAS FEBRUARY 12TH. SO THEY WILL PRORATE THAT THREE HUNDRED 22 DAYS OF THE THREE SIXTY FIVE OR EIGHTY EIGHT PERCENT. SO I'LL WALK THROUGH A QUICK EXAMPLE. IN THIS EXAMPLE, SAY A ONE HUNDRED THOUSAND DOLLAR HOUSE RECEIVED TWENTY THOUSAND DOLLARS IN DAMAGE DUE TO A BURST PIPE. AND REMEMBER, THE LAND VALUE IS NOT CALCULATED. SO THIS IS THE VALUE OF THE HOME ALONE. THE TWENTY THOUSAND DIVIDED BY THE 'HUNDRED THOUSAND DOLLAR HOME IS 20 PERCENT, SO THIS PARTICULAR PROPERTY WOULD FALL INTO THAT LEVEL ONE, 15 PERCENT TO 30 PERCENT. SO THE EXEMPTION OF 15 PERCENT ON ONE HUNDRED THOUSAND DOLLAR HOME IS FIFTEEN THOUSAND, AND THEN YOU PRO-RATE IT AT THAT EIGHTY EIGHT PERCENT FOR THIS WINTER STORM EVENT. SO THE EXEMPTION WOULD BE THIRTEEN THOUSAND TWO HUNDRED. SO HOW DO YOU APPLY. AGAIN, THE APPLICATION NEEDS TO BE COMPLETED BY MAY 28TH, 2021. YOU CAN FIND THE FORM THAT, ACTUALLY THE TEXAS COMPTROLLER IT'S THEIR FORM, BUT YOU CAN FIND THIS ON DALLASCAD.ORG/FORMS. AND THE FORM INSIDE OF THERE IS CALLED EXEMPTION APPLICATION FOR TEMPORARY DISASTER. IT SAYS ELEVEN POINT THIRTY FIVE AND THAT'S THE PART OF THE TAX CODE. AND THE NEXT MOST IMPORTANT PIECE IS DCAD IS REQUIRING YOU TO INCLUDE ALL DOCUMENTATION FOR BACK UP ON HOW YOU APPROVED OF YOUR NUMBER AND HOW YOU CAME UP WITH YOUR DAMAGE ASSESSMENT.
