The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

NOTICE: Due to the COVID-19 emergency and, pursuant to Section 551.125 of the Texas Government Code and the executive orders of Governor Greg Abbott suspending provisions of the Texas Government Code and other applicable laws of the State regarding normal open meetings, the City Council will hold this meeting by internet/telephonic remote means.

For participants (online and by phone) who wish to speak on an item on the agenda, you must use the "raise hand" feature in order to be recognized.  Similarly, if you wish to provide a comment at the end of the agenda during the open public comments portion of the meeting, you must use the "raise hand" feature.

You are invited to offer a comment or make a statement on any item on the agenda as that item is called.  Your comments must relate to an item on this agenda - non-germane comments are not in order.  Time limits will be imposed by the Mayor as appropriate to the nature of the agenda item.  Generally, public speakers are given three minutes.  Due to legal restrictions, the City Council is not able to answer questions during the public comments portion of the agenda. 

If the City Council adjourns into Executive Session during this meeting, the Executive Session will be conducted by teleconference between and among the members of the City Council and relevant City staff.  Public access to that call is prohibited by State law.

LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the May 18, 2021 Regular Meeting.
 
2. Consider approval of the following bids:

This request is to approve a Change Order for the Patricia Drive Water Main Replacement.

This request is to provide Underground Line Locating Services for GP&L on an as-needed basis.  This approval is for a Term Agreement with four optional renewals.

This request is to purchase a scheduled replacement Articulating Telescopic Aerial Device (Aerial Bucket Truck) for Garland Power & Light.

This request is to provide a stand-alone ticket booth with restroom for Windsurf Bay Park to help with traffic control on weekends.

This request is to obtain engineering services to support flood mitigation efforts at the TMPA Ben Davis Substation.

Brown & Brown, Inc. $3,823,000.00  

The City is seeking an insurance broker to place property, terrorism, inland marine and boiler and machinery insurance coverage (collectively, “Property Insurance”) for our various City property.  City property includes, but is not limited to, City buildings, administrative offices, maintenance buildings, theaters, power plants and associated equipment, recreational facilities and other properties located throughout the Dallas area.  This approval is for a Term Agreement with four optional renewals.

Major Medians and Thoroughfare Maintenance   Bid No. 0682-20
     
Carruthers Landscape Management, Inc.  $44,000.00  

This request is to approve a Change Order to increase the contract capacity for grounds maintenance of 126.21 acres of medians along major thoroughfares throughout the city.
 
3.   Consider approving the Cultural Arts Master Plan as presented.

At the May 17, 2021 Work Session, Council considered a draft of the Garland Cultural Arts Master Plan as presented by Ben Martin and Lynn Osgood with Civic Arts. 
 
4.   Consider a resolution agreeing to the sale of certain property located within the City of Garland and owned by taxing authorities including the City of Garland as the result of a Tax Sale; authorizing the Mayor to execute a Deed without Warranty; and providing an effective date.

At the May 17, 2021 Work Session, Council was briefed on the potential sale of property located at 1130 Meandering Way.
 
5.   Consider a resolution agreeing to the sale of certain property located within the City of Garland and owned by taxing authorities including the City of Garland as a result of a tax sale; authorizing the Mayor to execute a Deed without Warranty; and providing an effective date.

At the May 17, 2021 Work Session, Council was briefed on the potential sale of property located at 504 Clark Street.
 
6.   Consider authorizing the City Manager to execute the contract with the City of Rowlett for wastewater treatment services.

At the May 17, 2021 Work Session, Council considered a contract with the City of Rowlett to provide wastewater treatment services for 20 years from the effective date. 
 
7.   Consider an ordinance authorizing the issuance of "City of Garland, Texas, General Obligation Refunding Bonds, Series 2021;" specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; providing for the redemption of certain outstanding obligations of the City; and resolving other matters incident and related to the issuance, sale, payment and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement and an Escrow Agreement and the approval and distribution of a Preliminary Official Statement and an Official Statement; and providing an effective date. 

At the April 5, 2021 Work Session, Council considered a refunding of Commercial Paper Notes and Certificates of Obligation with General Obligation Refunding Bonds.
 
8.   Consider an ordinance authorizing the issuance of "City of Garland, Texas, Combination Tax and Revenue Certificates of Obligation, Series 2021;" providing for the payment of said certificates of obligation by the levy of an ad valorem tax upon all taxable property within the City and a limited pledge of the net revenues derived from the operation of the City's Water and Sewer System; providing the terms and conditions of such certificates of obligation and resolving other matters incident and relating to the issuance, payment, security, sale and delivery of said certificates of obligation, including the approval and execution of a Paying Agent/Registrar Agreement and the approval and distribution of a Preliminary Official Statement and an Official Statement pertaining thereto; and providing an effective date. 

At the April 5, 2021 Work Session, Council authorized the sale of Certificates of Obligation in the approximate amount of $24 million to fund a portion of the 2021 CIP. 
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
9.   Consider by minute action the appointment of a City of Garland representative to the North Texas Municipal Water District Board.

At the June 7, 2021 Work Session, Council considered appointing a representative to the North Texas Municipal Water District Board for a two-year term beginning June 8, 2021.
 
10.   Reconsideration Request of a Previously Denied Zoning Application (File No. Z 20-32, District 6)

The applicant, Ocean Star Metals, Inc., has submitted a written request for the City Council to reconsider the previously denied Zoning Case Z 20-32.  This property is located at 521, 523, and 525 Shepherd Drive. The City Council previously considered and in effect denied this application on January 12, 2021 by a lack of a super majority vote. Approval of the reconsideration request would allow the applicant to submit a new zoning application in less than the Garland Development Code’s required one-year waiting period for denied cases.
 
             
11. Hold public hearings on:
 
a.   Consider a Specific Use Provision (SUP) request by Spiars Engineering to extend the SUP time period of an existing convenience store and gas station [RaceTrac].  This property is located at 2602 Lavon Drive in District 1.

Consideration of the application of Spiars Engineering, requesting approval of a Specific Use Provision extension for Fuel Pumps, Retail on a property zoned Community Retail (CR) District. This property is located at 2602 Lavon Drive. (File No. Z 21-10, District 1)
 
b.   Consider a Site Plan request by Spiars Engineering for an existing convenience store and gas station [RaceTrac]. This property is located at 2602 Lavon Drive in District 1.

12. Citizen comments.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
