WE WILL START TO TONIGHT'S MEETING WITH THE CONSENT AGENDA.

[CONSENT AGENDA]

CONSENT AGENDA ARE ITEMS THAT THE COMMISSIONERS HAVE REVIEWED AND WE'LL BE VOTING ON ONE MOTION TO APPROVE.

ANYBODY IN THE AUDIENCE WHO WANTS TO REMOVE AN ITEM FROM THE CONSENT AGENDA OR ANY COMMISSIONER WANTS TO REMOVE AN ITEM FROM THE CONSENT AGENDA, PLEASE LET ME KNOW AFTER I READ IT OUT AND WE WILL TAKE IT FROM THERE.

OF COURSE, WE ONLY HAVE ONE ITEM ON THE CONSENT AGENDA.

NOW, I THINK IT WILL BE TOO TERRIBLY CONTROVERSIAL.

ITEM 1A CONSIDER APPROVAL OF THE PLANNING COMMISSION MINUTES FOR THE JULY 12TH, 2021 MEETING.

I'M GOING TO GUESS THAT THERE ARE NO OBJECTIONS TO HIS VOTING ON THE CONSENT AGENDA.

CHAIRMAN, RETAIN THE MOTION AND JUST HIT YOUR MIC EMOTION AND SPEAK.

>> MR. CHAIR?

>> COMMISSIONER DALTON.

>> MAKE A MOTION THAT WE ACCEPT THE CONSENT AGENDA AS POSTED.

>> A SECOND BY COMMISSIONER JENKINS, LOOKS LIKE YOU CHIMED IN THEIR TOO.

ALREADY, SO WE HAVE A MOTION BY COMMISSIONER DALTON, SECOND BY COMMISSIONER JENKINS TO APPROVE THE CONSENT AGENDA. PLEASE VOTE.

LET ME JUST GO AHEAD AND SHOW IT WHENEVER IT IS.

HERE WE GO. I WAS IN THE WRONG SCREEN HERE.

WE'VE GOT NEW STUFF HERE AND JUST GETTING USED TO THAT PASSES UNANIMOUSLY.

I DON'T SEE THAT STUFF WHEN I'M ON THE HOME PANEL.

ALREADY, NEXT ITEMS ARE ZONING CASES.

[Items 2.a. & 2.b.]

THE FIRST CASE IS A TWO PARTS.

I'LL READ BOTH PARTS AND WE CAN PROBABLY HANDLE WITH ONE MOTION.

CONSIDER THE APPLICATION OF AVALON DEVELOPMENT, KIMLEY HORN.

REQUESTING APPROVAL OF A SPECIFIC USE PROVISION TO LA RESTAURANT DRIVE THROUGH ON PROPERTY ZONE COMMUNITY RETAIL.

THIS PROPERTY IS LOCATED AT 21,28 NORTH JUPITER ROAD.

ITEM 2B CONSIDER THE APPLICATION OF AVALON DEVELOPMENT, KIMLEY HORN.

[00:05:02]

IF THE APPLICANTS HERE WISHES TO SAY ANYTHING, IS ANYBODY SIGNED UP FOR THE APP PLANNER? APPARENTLY THEY HAVE NOTHING TO SAY, BUT IF THERE ARE QUESTIONS OF THE APPLICANT, I THINK WE HAD SOME EARLIER, SO I'LL ASK ONE OF YOU TO COME ON DOWN BECAUSE I THINK YOU'LL HAVE A FEW QUESTIONS AND IF YOU'D STATE YOUR NAME AND ADDRESS ON THE MICROPHONE WE'D APPRECIATE IT.

>> WHICH ONE? EITHER OR? GARY JOHNSON, 69, 01 LOMOND DRIVE, DALLAS, TEXAS.

>> THANK YOU.

>> ANY QUESTIONS FOR THE APPLICANT? COMMISSIONER LUCHT?

>> HOW MANY PATRONS FIT INSIDE TO EAT AND OR GET COFFEE AND OUTSIDE ON THE PATIO.

>> INSIDE IS 2,300 SQUARE FEET.

I DON'T KNOW THE EXACT NUMBER PER SAY, BUT I KNOW IT'S PROBABLY 70 WOULD BE MY GUESS.

THEN OUTSIDE THE PATIOS FORM, 50 FEET, SO LOOKS ABOUT 6-7 TABLES.

>> NICE.

>> THEN THERE'S SOME TABLES ALONG THE SIDE TOO, SO YOU CAN PICK UP A COUPLE MORE PEOPLE OUTSIDE.

>> WHAT KIND OF FOOD ARE THEY PLANNING TO SERVE THERE? IS THAT NOT IN THE WORKS YET OR?

>> NO. I MEAN, IT'S A NATIONAL COFFEE BRAND.

>> OKAY. GOT IT.

>> [LAUGHTER] THEY ARE ACTUALLY RELOCATING FROM ACROSS THE STREET IN RICHARDSON TO GARLAND.

>> OKAY.

>> SOMETIMES THEY'D RATHER NOT GIVE OUT THE ACTUAL TENANT'S NAME.

[LAUGHTER]

>> PARKING IS OF THE AMOUNT OF PEOPLE GOING THROUGH THE DRIVE-THROUGH IS NOT A CONCERN.

YOU'RE CONFIDENT THAT THAT PARKING LOT WE'LL HANDLE THAT.

>> YES. WE TOOK INTO ACCOUNT THE SPILLOVER FROM THE DRIVE-THROUGH AND WE ACTUALLY INCREASED THE NUMBER THAT'S NEEDED.

IT'S GOING TO SPILL BACK INTO ITSELF AS OPPOSED ONTO JUPITER OR BACK INTO HOME DEPOT

>> GREAT. THANK YOU.

>> COMMISSIONER ROSE.

>> THERE APPEARS TO BE A LOT OF FOOD TRUCKS IN THIS AREA ON FRIDAY AND SATURDAY AND SUNDAY NIGHT.

IS THIS FACILITY GOING TO REPLACE THOSE?

>> REPLACE THEM IN LOCATION OR COMPETITION?

>> LOCATION.

>> I MEAN, I WOULD ASSUME THEY JUST GO A LITTLE BIT SOUTH IN THE PARKING LOT OF HOME DEPOT.

BUT I CAN'T REALLY SPEAK THAT I WOULD ASSUME THAT THEY WOULD BE REPLACED, YES.

>> OKAY, HAVE HEARD YOU.

ANY OTHER QUESTIONS FOR THE APPLICANT? ALRIGHT. DO WE HAVE ANY SPEAKERS IN THIS ITEM?

>> WE DO NOT, SIR.

>> I HAVE TO FLIP BACK AND FORTH ON SCREENS TO SEE WHAT I'M LOOKING AT HERE.

THANK YOU VERY MUCH FOR COMING DOWN.

>> THANK YOU COMMISSIONER.

>> CHAIRMAN RETAIN MOTION OR DISCUSSION.

GO AHEAD. GO AHEAD AND SPEAK ONCE YOU [LAUGHTER].

>> IS IT FOR ME?

>> WELL, DID YOU OPPRESS MAKE A MOTION?

>> I TRIED TOO.

>> WELL, YOU'RE LIVE NOW. THAT MEANS YOU'RE IN MAKING MOTION MODE.

JUST AS A REMINDER, WHEN YOU HIT MAKE A MOTION THAT AUTOMATICALLY TURNS ON YOUR MICROPHONE NOW, SHE CAN JUST GO AHEAD AND BLURRED OUT YOUR MOTION.

I BELIEVE IT DOES THE SAME THING FOR THE SECOND.

YOU DON'T HAVE TO BE RECOGNIZED BY ME TO MAKE A MOTION.

>> MR. CHAIRMAN, I MOVE WE APPROVE THE APPLICANT'S REQUEST FOR BOTH DOCUMENTS.

>> OKAY. THE SUP AND THE PLAN.

>> SIR, SECOND FOR ME.

>> OKAY. MOTION BY COMMISSIONER ROSE SECOND BY COMMISSIONER OTT TO APPROVE THE SPECIFIC USE PROVISION AND THE PLAN.

SEEM NO DISCUSSION, PLEASE VOTE. THAT PASSES UNANIMOUSLY.

THANK YOU AND GOOD LUCK WITH YOUR RESTAURANT.

NEXT ITEM ON OUR AGENDA IS ANOTHER TWO PARTER, EXCUSE ME.

[Items 2.c. & 2.d.]

CONSIDERATION OF THE APPLICATION A RANDALL T.

WILSON REQUESTING APPROVAL OF A SPECIFIC USE PROVISION, EXTENSION TO ALLOW A RECYCLING SALVAGE YARD UNLIMITED OUTSIDE STORAGE ON PROPERTY ZONE INDUSTRIAL WITH THE SPECIFIC USE PROVISION, 06-15 FOR RECYCLING, SALVAGE YARD, UNLIMITED STORAGE.

THIS PROPERTY IS LOCATED AT 1340 HEBRON DRIVE.

THEN ITEM 2D IS CONSIDERATION OF THE APPLICATION OF RANDALL T. WILSON REQUESTING APPROVAL OF A PLAN FOR RECYCLING SALVAGE YARD UNLIMITED OUTSIDE STORAGE PROPERTIES, OWN INDUSTRIAL DISTRICT WITH A SPECIFIC USE PROVISION 06-15 FOR RECYCLING, SALVAGE YARD, UNLIMITED OUTDOOR STORAGE, SAME ADDRESS, 1340 HEBRON DRIVE.

[00:10:05]

I BELIEVE THE APPLICANT IS HERE.

IF THERE ARE ANY QUESTIONS.

ANY OF THE COMMISSIONERS HAVE SOME QUESTIONS? OKAY.

SEEING NONE EITHER, DO WE HAVE ANY I DON'T SEE ANY SPEAKERS LISTED.

COMMISSIONER JENKINS.

>> I HAVE A QUESTION.

>> SURE.

>> I KNOW THAT GDC HAS UNDERGONE CHANGES RECENTLY.

DO THE NEW CHANGES, I GUESS, ARE THEY INCORPORATED INTO THE OLD SITE PLAN OR SO THERE ARE NO DEVIATIONS TO THE PLAN ITSELF.

IT'S THE EXACT SAME AS UPN PLAN THAT WAS PRESENTED PREVIOUSLY.

ARE WE STILL IN COMPLIANCE WITH THE GDC?

>> YES.

>> OKAY.

>> I DON'T BELIEVE THERE ANY PHYSICAL CHANGES BEING MADE, SO WOULD NOT TRIGGER ANY CHANGES TO LANDSCAPING THAT MIGHT HAVE OCCURRED BETWEEN THEN AND NOW IN THE GDC THERE ARE TRIGGERING MECHANISMS. IF YOU'RE BUILDING SOMETHING NEW, YOU GOT TO COMPLETELY COMPLY.

IF YOU, I THINK IT'S OVER A THIRD OR 50 PERCENT COST EDITION OR SOMETHING THERE'S SOME TRIGGERS OVER THERE THEN YOU HAVE TO BRING IT UP TO POWER, YOU'RE ADDING SO MUCH CONCRETE, YOU HAVE TO BRING EVERYTHING UP.

I DON'T THINK THIS TRIGGERS ANY OF THAT, ALTHOUGH WE HAVE OPPORTUNITIES ON AS YOU KEEP PROVISIONS TO DO THINGS.

>> THAT'S CORRECT, MR. CHAIRMAN, THERE'S NO PHYSICAL CHANGES BEING PROPOSED, SO IT WOULDN'T TRIGGER THOSE PHYSICAL CHANGES PER SE.

OF COURSE, IT IS A POLICY THAT THE PLANNING COMMISSION AND COUNCIL COULD MAKE CERTAIN CONDITIONS.

AS FAR AS THE GDC GOES, THERE IS A REQUIREMENT THAT THE GDC ADOPTED AS FAR AS OUTDOOR STORAGE BEING SCREENED COMPLETELY BY THE SCREENING DEVICE OR BEHIND A BUILDING, A BUILDING MAY COUNT AS A SCREENING DEVICE.

AS WE NOTED IN OUR REPORT, SOME OF THE MATERIALS AND EQUIPMENT WERE NOT ALL VISIBLE.

BUT THE APPLICANT APPEARS TO BE ADHERING TO THE WAY THE SEP WAS APPROVED IN 2006, WHICH REQUIRED THAT OUTDOOR STORAGE TO BE SCOOTED BACK TOWARDS THE REAR OF THE PROPERTY.

THAT'S WHERE THAT CAME FROM AND THE APPLICANT APPEARS TO BE ON AS FAR AS THE STORAGE PILES, THOSE DO APPEAR TO BE TOWARDS THE REAR OF THE PROPERTY. THANK YOU.

>> COMMISSIONER EDWARDS?

>> I HAD A QUESTION FOR WILL. WILL, THE BACK PART OF THAT PIECE OF PROPERTY IS BELOW GRADE ON THE FRONT.

IT'S A FOOT FENCE IN THE BACK AS WELL AS AT THE FRONT, RIGHT?

>> I BELIEVE THAT'S CORRECT. YES, SIR.

>> OKAY.

>> YES, SIR. CORRECT.

>> ALL RIGHT.

>> IF YOU WILL STATE NAME AND ADDRESS ON THE MICROPHONE.

>> ANDY WILSON, 75 WOOL-FORD WAY, ROCKWELL, TEXAS.

>> OKAY. THERE'S A FENCE ALL THE WAY AROUND IT?

>> THE FENCES ALL-ENCOMPASSING.

I JUST WANT TO CLARIFY, ON THE BACK PART OF OUR YARD, THAT'S D, G, AND O RAILROAD.

WHATEVER THEY'VE PROPOSED, EVEN BEYOND THAT, I THINK IT'S HUNDREDS AND HUNDREDS OF FEET AWAY FROM US.

WE DO KEEP THE PILES TO THE BACK AND PERIODICALLY, THE WAY THE MILLS WORK, SOMETIMES THEY WILL HAVE A SHUTDOWN IN THE SUMMERTIME FOR MAINTENANCE.

MISS HOPKINS HAD BROUGHT IT TO MY ATTENTION THAT SOME OF THEM WERE A LITTLE HIGH AND BE READY TO EXPLAIN THAT, THAT'S WHAT HAPPENS.

WE HAVE BEEN AGGRESSIVELY BRINGING THOSE PILES DOWN THE LAST WEEK AND A HALF.

WE'VE GOT ONE MILLION FOR WORK THAT'S STILL SHUT DOWN SOON AS THEY OPENED THE DOORS NEXT WEEK THE ONE THAT YOU CAN STILL SEE IT'S COMING DOWN.

>> BECAUSE HAVE YOU DRIVEN BY THEIR BEFORE AND SEEING IT TEN FOOT ABOVE YOUR SCREENING LAW?

>> YES. SOMETIMES THAT DOES HAPPEN.

IT HAPPENS WITH LOGISTICS.

WHEN YOU'RE HAVING TROUBLE FINDING TRUCKING AND WHEN THESE MILLS TAKE THEIR BREAKS, WE HAVE TO COLLECT IT AND THEN WE'D GET IT OUT JUST AS SOON AS THEY REOPEN.

WE ARE KEEPING THE PILES BACK BEHIND ON THE BACK PART OF THE PROPERTY.

>> BUT YOU CAN STILL SEE FROM THE STREET?

>> ONCE IN A WHILE.

>> WHEN IT'S OVER THE FENCE, YOU CAN SEE IT?

>> ONCE IN A WHILE YOU CAN, YES.

>> BECAUSE I GO BY THERE ALL THE TIME.

>> AS A MATTER OF FACT, I CAN'T REMEMBER IN 15 YEARS OF DOING BUSINESS OVER THERE EVER HAVING ANYBODY COMPLAIN OR HAVING ANYTHING SENT TO ME.

JUST SO HAPPENS, THE CITY OF GARLAND IS ONE OF MY BIGGEST CUSTOMERS.

SOMETIMES WHEN THE INFLUX IS WHAT IT IS, THEN YES, SOMETIMES YOU WILL SEE THOSE PARTS.

THAT WILL GO FOR EVERY OTHER SCRAP YARD IN THE CITY.

>> WELL, YOU DO REALIZE THAT IT IS TECHNICALLY A VIOLATION?

>> I DO UNDERSTAND, BUT WE DO DUE DILIGENCE.

>> WITH EFFORT TO KEEP.

>> WE DO DUE DILIGENCE TO GET THOSE THINGS DOWN.

IF THEY COME AND TAKE THE PHOTOS AGAIN, THEY'LL SEE THAT THOSE PILES ARE DOWN.

>> OKAY.

>> YEAH.

>> ANY OTHER QUESTIONS FOR THE APPLICANT? THANK YOU FOR COMING.

[00:15:03]

>> THANK YOU VERY MUCH.

>> I DON'T BELIEVE WE HAVE ANY OTHER SPEAKERS, SO COMMISSION MOTION DISCUSSION.

>> CHAIRMAN.

>> COMMISSIONER JENKINS?

>> THANK YOU, ALL. I MAKE A MOTION TO APPROVE BOTH ITEMS AS PRESENTED AND WITH THE RECOMMENDATIONS BY STAFF, HOW MAINTAINING THE SPECIFIC PROVISION IN THE SP THAT REQUIRES SOVEREIGNS TO REMAIN AWAY FROM THE FRONT OF THE PROPERTY.

>> YOU ARE READY? DO I HEAR A SECOND.

>> I'LL SECOND THAT.

>> MOTION BY COMMISSIONER JENKINS AND SECONDED BY COMMISSIONER [INAUDIBLE] TO APPROVE THE SPECIFIC USE PROVISION FOR A PERIOD OF 25 YEARS, I BELIEVE IT IS.

THE PLAN AND POINTING OUT THE PROVISIONS FOR STACKING HEIGHT AND STACKING LOCATION ARE TO BE FULLY ENFORCED.

ANY DISCUSSION? PLEASE VOTE.

[NOISE] COMMISSIONER HARRIS, I MAY HAVE TO PUNCH YOUR BUTTON AGAIN THERE.

IT PASSES UNANIMOUSLY. THANK YOU.

>> THANK YOU, ALL.

>> THAT WAS LAST ITEM ON OUR AGENDA.

BUT BEFORE WE GO, I WOULD LIKE TO MAKE NOTE THAT THIS IS COMMISSIONER EDWARD'S FINAL MEETING WITH US.

YOU MAY NOT KNOW, BUT HE'S BEEN SERVING THE CITY IN SOME CAPACITY OR ANOTHER FOR OVER THREE DECADES THREE YEARS.

IF THIS IS YOUR LAST ONE, AT LEAST YOU'VE GONE OUT AND A HIGH NOTE AND NOT AS A COUNCILMAN, BUT AS A COMMISSIONER.

I WOULD LIKE TO MAKE A PRESENTATION BEFORE HE GOES, I RARELY GET TO DO THIS.

[BACKGROUND] [LAUGHTER] HE SPARED NO EXPENSE.

[LAUGHTER].

>> [INAUDIBLE] THANK YOU VERY MUCH, I APPRECIATE IT.

[APPLAUSE]

>> THANK YOU.

>> WELL, THANK YOU FOR YOUR SERVICE, SIR, NOW AND THROUGHOUT THE YEARS, AND I APPRECIATE YOUR INPUT AND WISDOM. REALLY DO.

>> CAN I SAY SOMETHING?

>> SURE.

>> LIKE YOU SAID, I'VE BEEN DOING THIS FOR MANY YEARS. I'VE ENJOYED IT.

I THINK A LOT OF THIS BOARD, THERE'S SOME GOOD PEOPLE HERE.

WE'VE GOT A GREAT STAFF THAT HAS BEEN WORKING WITH US.

THEY'VE KEPT US IN LINE AND ESPECIALLY OUR CHAIRMAN HAS.

[LAUGHTER] IF WE DO SOMETHING WRONG, HE'LL TELL US.

BUT I JUST LIKE TO APPRECIATE TELL YOU ALL HOW MUCH I APPRECIATE WORKING WITH YOU ALL FOR THE LAST FOUR YEARS.

IT'S TIME FOR ME TO GO TO THE FIELD AND LET SOMEBODY ELSE TAKE MY PLACE.

I'LL BE KEEP WATCHING AND IF ANYBODY NEEDS ANYTHING, GIVE ME A HOLLER.

>> WELL, DON'T BE A STRANGER, SIR.

>> I WON'T BE. [APPLAUSE]

>> WELL, AS I MENTIONED, THERE WAS LAST ITEM ON OUR AGENDA AND A LITTLE BIT NOTE ABOUT OUR MEETINGS NEXT MONTH TYPICALLY MEET ON THE SECOND AND FOURTH MONDAYS OF EACH MONTH BUT BECAUSE OF SOME, NO, FIRST AND THIRD? YEAH. SECOND AND FOURTH, YEAH.

BUT BECAUSE OF SOME STATE LEGALITIES ON WHEN COUNCIL CAN MEET AND WHEN WE CAN MEET, IT'S GOING TO BE ON THE THIRD, FIFTH MONDAY OF THE MONTH.

OUR NEXT MEETING IS NOT UNTIL AUGUST 16TH.

IF YOU WENT AND PUT IT IN YOUR CALENDARS ACCORDING TO WHICH WEEK IT WAS ON A MONTH, YOU'LL BE HERE A WEEK EARLY.

UNTIL OUR NEXT MEETING OF AUGUST 16TH, WE ARE ADJOURNED. THANK YOU.
