The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving a Specific Use Provision (SUP) renewal for Fuel Pumps, Retail on a 0.9366-acre tract of land zoned Community Retail (CR) District and located at 1810 West Kingsley Road; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Notice of Conditions of Compliance Clause; providing a Savings Clause and a Severability Clause; and providing an effective date.

4.   Employment Agreements for the City Manager, City Auditor, Municipal Judges & City Attorney (including the appointment thereof)

Council is requested to pass and approve: (1) an ordinance appointing John Sholden as Municipal Judge and approving the employment contract related thereto; (2) an ordinance appointing Natalie Banuelos as Municipal Judge and approving the employment contract related thereto; (3) amendments to existing employment agreements, with Bryan Bradford (City Manager), Jedson Johnson (City Auditor), and (4) a resolution appointing Brian England as City Attorney and approving the employment contract related thereto.

5.   Conveyance of City Property - 1700 Block Spencer Road Denton, Texas (Spencer Electric Generation Facility)

Council is requested to approve the Easement and Right-of-Way agreement conveying the 0.271-acre variable width surface use easement and the 0.101-acre 30-foot access easement at 1700 block of Spencer Road in Denton, Texas at the City of Garland Spencer Electric Generation Facility to Atmos Energy Corporation for a total monetary compensation of $10,000.00.

6.   Consider a resolution providing for the redemption of the outstanding City of Garland, Texas, Tax Notes, Series 2021; and resolving other matters incident and related to the redemption of such obligations. 

When Council approved the issuance of $29,355,000 Tax Notes, Series 2021 on September 14, 2021, it was contemplated that the City would exercise the call provision to redeem the notes prior to the scheduled maturity date of November 15, 2022. Staff requests Council consider approving a resolution to redeem the Tax Notes, Series 2021 as contemplated.

7.   Consider amending the current development agreement with the Draper Garland, LLC to allow them until March 31, 2022 to obtain a building permit and construction loan.

The City and The Draper Garland, LLC entered into an Economic Development Agreement on April 7, 2021.  Due to COVID-19 related challenges with obtaining a building permit, and consequently the company’s construction loan, the company requests that the City extend the deadline to obtain the permit from December 31, 2021 to March 31, 2022.

8.   Consider by minute action the approval of one purchase agreement negotiated to date with the property owner in the amount of $168,694.00

Council has been briefed on previous occasions of the plans for Naaman School Road (from Brand to S.H. 78 / Lavon Drive). This project will alleviate road congestion by providing twice the number of travel lanes in each direction and alleviate flooding issues during significant rainfall. This requires additional land/right-of-way and staff has been working with consultants to acquire the necessary property. One additional purchase agreement has been successfully negotiated with a property owner for the acquisition of land needed to move forward with the project.

ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
9.   Consider a resolution of the City of Garland, Texas finding and determining that the public necessity and convenience require the acquisition of variour property rights located along Naaman School Road, east of Brand Road, and west of State Highway 78, in the City of Garland, County of Dallas, Texas, said property interests being more particularly described below; providing authorizations to acquire such property rights by purchase or condemnation and making certain findings pertaining thereto; providing further authorizations as may be necessary to carry out the purposes of this resolution; and providing an effective date.

Council is requested to approve a resolution authorizing the acquisition of the property rights described in the proposed resolution. The City has been able to negotiate with property owners of whole-takes in the project area to acquire the necessary property interests. The City has also been able to negotiate with some strips and clips owners in the area to acquire the necessary property interests. However, the City has been unable to acquire certain property rights from four strips and clips property owners due to liens. The owners are named in the proposed resolution. State law requires particular wording to be used in a motion to adopt a resolution authorizing the initiation of condemnation proceedings. The City Attorney will provide in written form the appropriate wording of the motion.  Council was briefed on requirements for land acquisition on the Naaman School Road project on February 1, 2021 and April 5, 2021 in Executive Session.

10.   Presentation of 2022 Proposed CIP

The City Manager will formally present the 2022 Proposed Capital Improvement Program (CIP) for the City Council's review and deliberation.

11.   2021-22 Budget Amendment No. 1

Council is requested to consider approval of the ordinance amending the FY 2021-22 Adopted Budget as outlined by 2021-22 Budget Amendment No. 1 which proposes to increase the General Fund's FY 2021-22 appropriation by $489,343 to meet the needs of the Police Department, including a Flock Safety and Gunshot Detection System, two new additional Police Officers (Gang Unit), one new civilian Crime Analyst, and one additional Mental Health Clinician.

12.   Consider an ordinance of the City of Garland, Texas, establishing Civil Service classifications within the Police and Fire Departments; prescribing the number of positions in each classification; prescribing the base salary and types of pay for those classifications; and providing an effective date.

Pursuant to Chapter 143 of the Local Government Code of Texas, the City Council must establish the civil service classifications in the Police and Fire Departments, the number of positions in each classification, the base salary and the types of incentive pays for each classification.  The attached ordinance reflects the positions and compensation approved in the 2021-22 Operating Budget and as amended by 2021-22 Budget Amendment No. 1.

14.   Consider appointments to Boards and Commissions.

Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.

15.   Citizen comments.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
