HERE WE GO. WELL, GOOD EVENING.

EXCUSE ME, LADIES AND GENTLEMEN.

ALL RIGHT, NOW EVERYBODY'S IN THEIR PLACES.

YOU ARE NOT REQUIRED TO PARTICIPATE, AND IT IS YOUR DECISION, AND YOUR DECISION WILL NOT IMPACT OUR DECISIONS HERE TONIGHT, AND TONIGHT WE WILL BE LED BY COUNCILMEMBER VERA FROM DISTRICT SIX. THANK YOU, MAYOR.

I WANT TO THANK EVERYBODY FOR COMING TO THIS MEETING TONIGHT.

LET'S BOW OUR HEAD.

DEAR HEAVENLY FATHER, FIRST, WE GIVE YOU THANKS FOR ALL YOUR BLESSINGS YOU GAVE US EACH DAY. WE THANK YOU FOR ALL YOU'VE DONE FOR THE COMMUNITY OF GARLAND, AND WE PRAY THAT YOU TAKE CARE OF MILITARY AND ARMOR SERVICEMEN LOCALLY AND AROUND THE WORLD AND PROTECT OUR POLICEMEN, FIREMEN AND FIRST RESPONDERS, AND PLEASE TAKE CARE OF YOUR PEOPLE IN UKRAINE FOR THEIR LOSS OF INNOCENT PEOPLE THERE, AND I HOPE YOU TAKE CARE OF THEM.

ALLEGIANCE]

[Mayoral Proclamations, Recognitions and Announcements]

WELL, WE DO HAVE ONE RECOGNITION TONIGHT.

IT IS PUBLIC PROCUREMENT MONTH.

GARY AND YOUR TEAM, CERTAINLY WELCOME TO COME FORWARD, AND I'VE BEEN PRACTICING SAYING PROCUREMENT FOR THE LAST HALF HOUR, SO I CAN SAY PURCHASING, IT'S EASIER. NOW, WHERE WAS HE A HALF AN HOUR AGO WHEN I WAS STRUGGLING WITH PROCUREMENT? BUT YES.

OH, AND ANOTHER AWARD FOR THE TROPHY CASE.

WELL, VERY GOOD. THIS IS IN HONOR OF PUBLIC PROCUREMENT MONTH, AND THE PUBLIC PROCUREMENT PROFESSION PLAYS A SIGNIFICANT ROLE IN THE EFFICIENCY AND EFFECTIVENESS OF THE CITY.

PROCUREMENT PROFESSIONALS DEDICATE THEMSELVES TO PROVIDING THE BEST VALUE FOR EACH TAXPAYER DOLLAR.

THEY PROVIDE STRATEGIC, LOGISTICAL AND OPERATIONAL SUPPORT FOR THE CITY, AND THEY DEDICATE THEMSELVES TO EXPANDING THEIR KNOWLEDGE, SKILLS AND ABILITIES FOR THE PUBLIC GOOD. IN ADDITION TO THE PURCHASE OF GOODS AND SERVICES, PROCUREMENT ADDS VALUE BY PERFORMING SUCH FUNCTIONS AS EXECUTING, IMPLEMENTING AND ADMINISTERING CONTRACTS, DEVELOPING STRATEGIC PROCUREMENT STRATEGIES, AND CULTIVATING WORKING RELATIONSHIPS WITH SUPPLIERS AND OTHER DEPARTMENTS WITHIN THE ORGANIZATION.

IN 2021, THE PROCUREMENT TEAM MANAGED $303 MILLION IN PURCHASES WITH EFFICIENCY, TRANSPARENCY AND EFFECTIVENESS, RESULTING IN A COST SAVINGS OF MORE THAN 8 MILLION. THANK YOU FOR THAT.

THE ACHIEVEMENT OF EXCELLENCE IN PROCUREMENT AWARD RECOGNIZES ORGANIZATIONAL EXCELLENCE BY MEASURING INNOVATION, PROFESSIONALISM, E-PROCUREMENT, PRODUCTIVITY AND LEADERSHIP ATTRIBUTES OF THE PROCUREMENT PROFESSION, AND IN 2021, THE PROCUREMENT DEPARTMENT OF THE CITY OF GARLAND RECEIVED THE ACHIEVEMENT OF EXCELLENCE IN PROCUREMENT AWARD FOR THE 23RD CONSECUTIVE TIME.

MOREOVER, THE CITY OF GARLAND WAS ONE OF ONLY 64 CITIES IN THE UNITED STATES AND CANADA TO RECEIVE THE AWARD.

THE NATIONAL INSTITUTE OF GOVERNMENTAL PURCHASING HAS DESIGNATED THE MONTH OF MARCH AS PROCUREMENT MONTH TO FURTHER EXPAND THE AWARENESS OF THE PROCUREMENT PROFESSIONALS ROLE AND ROLE TO GOVERNMENTAL OFFICIALS AND THE GENERAL PUBLIC.

[00:05:02]

SO NOW THEREFORE I SCOTT LEMAY WITH THE CITY COUNCIL DO HEREBY PROCLAIM MARCH 2022 IN GARLAND, TEXAS, PROCUREMENT MONTH.

GARY, AND IF YOU COULD SHARE A LITTLE BIT ABOUT WHAT YOU DO.

WELL, I'D BE HAPPY TO, MAYOR. THANK YOU VERY MUCH.

MAYOR AND CITY COUNCIL WE'RE HONORED THIS EVENING TO BE RECOGNIZED FOR THE 23RD CONSECUTIVE EXCELLENCE OF ACHIEVEMENT IN PROCUREMENT AWARD, AND AS MY TEAM HERE CAN ATTEST, IT'S NOT VERY EASY TO ACHIEVE EXCELLENCE IN PROCUREMENT, ESPECIALLY IN THIS CURRENT MARKET, BECAUSE WE'VE GOT UNPRECEDENTED DISRUPTIONS THROUGHOUT THE SUPPLY CHAIN, BUT THEY STEP UP TO THE PLATE EVERY TIME AND MAKE IT HAPPEN FOR US, AND WE'RE ALSO VERY FORTUNATE TO HAVE THE PARTICIPATION FROM THE VENDOR COMMUNITY, THE COOPERATION OF OUR DEPARTMENTS, AND, OF COURSE, THE SUPPORT OF THE ADMINISTRATION AND THE CITY COUNCIL, AND I'D LIKE TO TAKE A MOMENT TO INTRODUCE THE PEOPLE BEHIND ME.

THEY REALLY WORKED HARD TO MAKE THIS AWARD POSSIBLE.

HAVE ARMANDO GALLARDO, ALEX ARELLANO, THERESA SMITH, DANNY G., C.

SANDERS AND LIZ SEGURA.

SO IT'S JUST THE HARD WORK OF THESE AND THE REST OF THE PROCUREMENT TEAM TO MAKE THIS POSSIBLE, AND WE LOOK FORWARD TO BRINGING THIS HOME AGAIN TO GARLAND NEXT YEAR.

THANK YOU ALL VERY MUCH.

THANK YOU. [APPLAUSE] I WAS NOT EXPECTING THAT TO WEIGH THAT MUCH.

I ALMOST, ALMOST FELL OVER JUST TRYING TO CARRY IT AROUND THE DESK.

YOU WENT AND DOUBLE DECKED, THE TROPHY CASE.

I THINK WE MIGHT NEED TO "PROCURE" A HEAVIER SHELF.

YEAH, WE GOT A LOW BID LAST TIME, SO YOU KNOW HOW THAT GOES.

[CHUCKLING] VERY GOOD. THANK YOU. THANK YOU ALL.

THANK YOU ALL VERY MUCH. THANK YOU.

THANK. THANK YOU VERY MUCH.

IS THERE ANYONE WHO WOULD LIKE TO HAVE ANY OF THE ITEMS PULLED AND CONSIDERED SEPARATELY? I SEE NONE. I ALMOST DID IT AGAIN.

DO WE HAVE A MOTION? I MAKE THE MOTION THAT WE APPROVE.

I HAVE A MOTION BY COUNCILMEMBER VERA AND A SECOND BY COUNCILMEMBER AUBIN TO APPROVE THE CONSENT AGENDA AS PRESENTED.

MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE, AND DISPLAY THE VOTE AND THAT IS APPROVED UNANIMOUSLY, AND YES, I ALMOST SKIPPED THE MOTION AND THE SECOND PART AGAIN. IT'S GETTING TO BE KIND OF A HABIT.

I DON'T KNOW. ALL RIGHT, WE WILL MOVE ON NOW TO ITEMS FOR INDIVIDUAL CONSIDERATION.

MADAM SECRETARY, IF YOU COULD REVIEW THE SPEAKER REGULATIONS FOR US, PLEASE.

YES, SIR, THE OPPORTUNITY TO SPEAK IS GIVEN TO PROVIDE TESTIMONY RATHER THAN TO QUESTION THE CITY COUNCIL OR STAFF.

THE CHAIR MAY CALL A SPEAKER OUT OF ORDER IF THE SPEAKER PRESENTS QUESTIONS OR REQUESTS FOR INFORMATION THAT WILL UNDULY DELAY THE TRANSACTION OF BUSINESS AT THE MEETING.

SPEAKERS APPEARING IN THE CHAMBER WILL SPEAK FIRST.

APPLICANTS ARE ALLOWED 10 MINUTES FOR PRESENTATIONS, AND ALL OTHER SPEAKERS WILL BE ALLOWED 3 MINUTES TO SPEAK.

WHEN THE PODIUM BUZZER SOUNDS, THE SPEAKER MUST IN THEIR COMMENTS.

THANK YOU, MA'AM, AND DO WE HAVE SPEAKERS IN THE IN THE QUEUE? WE HAVE SPEAKERS REGISTERED FOR THE CASES 13C AND D AND 13E AND F.

VERY GOOD, THANK YOU.

ALL RIGHT, WE'LL START OUT WITH ITEM 13A HOLD A PUBLIC HEARING AND CONSIDER RE ADOPTION

[Items 13A & 13B]

OF THE JUVENILE CURFEW ORDINANCE.

AT THIS TIME, I'D LIKE TO OPEN THE PUBLIC HEARING IF THERE IS ANYONE WHO WOULD LIKE TO ADDRESS THE COUNCIL ON THIS ITEM.

COUNCIL, SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AND THAT WILL MOVE US TO ITEM 13B CONSIDER AN ORDINANCE APPROVING THE RE-ADOPTION OF CHAPTER 26 POLICE MISCELLANEOUS PROVISIONS AND OFFENSES OF THE CODE OF ORDINANCES OF THE CITY OF GARLAND SUBSECTION 26.10 RELATED TO CURFEW HOURS FOR MINORS, AND I AM OPEN FOR A MOTION.

COUNCIL LADY MORRIS.

BOY.

[CHUCKLING] IT WORKS. YEAH, I'LL BACK AWAY.

MAYOR, I DID HAVE A COUPLE.

[00:15:01]

OH, SORRY.

CITIZENS. I'M NOT MAKING A MOTION.

I DID HAVE A COUPLE CITIZENS WHO HAD QUESTIONS, WHO HAVE NOT FOLLOWED THAT THIS IS SOMETHING WE PRETTY MUCH DO OVER AND OVER AGAIN, AND THEY WERE WONDERING AND I WONDERED IF CHIEF BRYAN MIGHT BE ABLE JUST TO QUICKLY EXPLAIN THE PURPOSE AND BACKGROUND OF THIS WITHOUT MUCH DETAIL.

I BET HE CAN DO THAT.

HE CAN. THANK YOU, SIR.

I CAN GIVE YOU SOME INFORMATION.

SO THE ORDINANCE, AS YOU'RE PROBABLY AWARE, SETS A CURFEW FOR JUVENILES AT 11:00 DURING THE WEEK AND MIDNIGHT ON THE WEEKENDS.

I'LL TELL YOU HOW WE ENFORCE THIS ORDINANCE IS WE DO NOT GO OUT LOOKING FOR JUVENILES THAT ARE BREAKING THE ORDINANCE.

WE ENFORCE THIS ORDINANCE WHEN WE COME ACROSS JUVENILES WHO ARE ENGAGED IN ACTIVITIES AND WE NEED TO GET THEM HOME, AND LAST YEAR, WE ISSUED SEVEN CITATIONS.

TO GIVE YOU AN IDEA OF HOW RARELY WE TAKE ENFORCEMENT ACTION.

HOWEVER, WHAT WE DO MORE OFTEN IS, IS WE'LL COME ACROSS JUVENILES THAT ARE ENGAGED IN IT COULD BE HANGING OUT AT A CAR WASH, PLAYING LOUD MUSIC.

IT COULD BE HANGING OUT IN THE WOODED AREA, AND WE SIMPLY SEND THEM HOME, TALK TO THEIR PARENTS, AND THIS ORDINANCE GIVES US THE TOOL TO DO THAT.

SO ENFORCEMENT IS VERY RARE, IN EXTREME CASES, AND THE OTHER THING I'VE SAID BEFORE IS THIS IS AN ORDINANCE THAT WE USE TO KEEP THEM OUT OF TROUBLE, NOT TO GET THEM INTO TROUBLE, AND SO WE'RE ASKING TO RENEW THAT ORDINANCE TONIGHT.

VERY GOOD. THANK YOU, CHIEF.

THANKS. ANY FURTHER QUESTIONS OR DISCUSSIONS ON THIS ITEM? I'M OPEN TO A MOTION.

COUNCILMEMBER AUBIN. THANK YOU, MAYOR, I MOVE APPROVAL.

SECOND. I HAVE A MOTION BY COUNCILMEMBER AUBIN AND A SECOND BY COUNCILMEMBER VERA TO APPROVE THIS ITEM AS PRESENTED.

MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE, AND COUNCIL, AND DISPLAY THE VOTE, PLEASE, AND THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU, CHIEF. NEXT, WE WILL MOVE ON TO THE FIRST OF OUR TWO ZONING CASES FOR THE

[Items 13C & 13D]

EVENING. THIS ITEM, AS WELL AS THE OTHER ZONING CASE, ARE TWO PART.

THE FIRST ONE IS 13C.

CONSIDER A ZONING REQUEST BY ADVANTAGE SELF STORAGE ADVISORS LLC TO ALLOW SELF STORAGE MINI WAREHOUSE USE.

THE PROPERTY IS LOCATED AT 3599 NORTH GARLAND AVENUE IN DISTRICT SEVEN.

IT ALSO CONTAINS 13D, WHICH IS TO CONSIDER A DETAILED PLAN, SAME APPLICANT, SAME ADDRESS.

GOOD EVENING. GOOD EVENING.

MY NAME IS N. AHMED.

I'M PRESENTING ON BEHALF OF MR. [INAUDIBLE] TONIGHT. THIS IS FOR K Z 21-59.

THE APPLICANT PROPOSES A SELF STORAGE FACILITY MINI WAREHOUSE USE ON THE SUBJECT PROPERTY. HERE IS THE CASE INFORMATION.

THE ACREAGE IS APPROXIMATELY 6.051 ACRES, AND THIS IS THE CITYWIDE LOCATION MAP.

THE RED STAR IDENTIFIES THE APPROXIMATE LOCATION OF THE SUBJECT PROPERTY, AND THIS IS THE LOCATION MAP.

THE SUBJECT PROPERTIES OUTLINED IN THIS TEAL BLUE COLOR.

IT IS ZONED PD 85-49, WHICH IS A MIXED USE PD AND THE SUBJECT PROPERTY IS CURRENTLY IN TRACT THREE, WHICH ALLOWS SOME INDUSTRIAL USES AND THE APPLICANT IS PROPOSING TO AMEND THIS PD WITH THE BASE ZONING OF COMMUNITY RETAIL.

SO IT IS MORE COMPATIBLE WITH THE ADJACENT PROPERTIES AND THE PROPERTY TO THE NORTH IS ZONED NEIGHBORHOOD OFFICE THERE IS A SCHOOL ON SITE AND THEN THE PROPERTY TO THE EAST IS ZONED AGRICULTURAL AND THERE IS A RELIGIOUS FACILITY.

THE PROPERTIES TO THE SOUTHWEST ARE ZONED PD 11-24 AND THERE'S SINGLE FAMILY PROPERTIES THERE. THE FUTURE LAND USE MAP, THE ENVISION GARLAND PLAN DESIGNATES THE SUBJECT PROPERTY AS COMPACT NEIGHBORHOODS, AND THESE AREAS ACCOMMODATE USES SUCH AS CONVENIENCE, RETAIL GOODS AND SERVICES, OFFICE SPACE AND PUBLIC SERVICES.

THE ARCHITECTURAL CHARACTER AND SCALE OF THESE AREAS ARE COMPATIBLE WITH THE ADJACENT RESIDENTIAL DEVELOPMENT.

HERE ARE SOME OF THE SITE PHOTOS.

THE LEFT IS THE SUBJECT PROPERTY, AND THEN TO THE RIGHT IS NORTH OF THE SUBJECT PROPERTY

[00:20:06]

WHERE THE RELIGIOUS FACILITY IS, AND THIS LEFT PICTURE IS WEST OF THE SUBJECT PROPERTY, AND TO THE RIGHT IS EAST OF THE SUBJECT PROPERTY, AND HERE IS THE PROPOSED SITE PLAN, WHICH SHOWS A TOTAL OF FIVE BUILDINGS AND A TOTAL OF 644 SELF STORAGE UNITS.

THE ACCESS WILL BE FROM NORTH GARLAND AVENUE AND BUILDING A WILL BE APPROXIMATELY 70,600 SQUARE FEET. BUILDING B WILL BE 7280 SQUARE FEET.

BUILDING C WILL BE 4400 SQUARE FEET.

BUILDING D WILL BE 4200 SQUARE FEET, AND BUILDING E WILL BE 10,650 SQUARE FEET, AND IT DOES COMPLY WITH THE PARKING REQUIREMENT PER THE GARLAND DEVELOPMENT CODE, AND THERE IS A MINIMUM OF EIGHT FOOT MASONRY SCREENING WALL THAT IS REQUIRED TO BE ALONG THE SOUTHERN PERIMETER OF THE PROPERTY WHERE IT IS ADJACENT TO RESIDENTIAL, AND THE APPLICANT PROPOSES TO USE THE EXTERIOR SOLID WALL OF THE BUILDING, BUILDING C AND BUILDING D TO SERVE AS THE SCREENING FOR THE ADJACENT RESIDENTIAL PROPERTIES, AND THE GDC DOES ALLOW TO USE EXTERIOR SOLID WALLS AS THE SCREENING WALL, BUT IT CANNOT BE ADJACENT TO A RESIDENTIAL DISTRICT. SO THE APPLICANT PROPOSES THAT AS A DEVIATION, AND HERE IS THE LANDSCAPE PLAN.

IT DOES COMPLY WITH THE LANDSCAPING STANDARDS PER THE GARLAND DEVELOPMENT CODE AND AS YOU CAN SEE ALONG THESE SOUTHERN PERIMETER LINE, THERE IS A 40 FOOT BUFFER BETWEEN THE RESIDENTIAL PROPERTIES FOR BUILDINGS C AND D AND THEN THERE'S LARGE CANOPY TREES AND THE REQUIRED IS ACTUALLY 20 FEET.

SO THE APPLICANT PROPOSES 40 FEET TO HELP WITH THE SCREENING.

THE ELEVATION FOR BUILDING A AND IT DOES COMPLY WITH THE BUILDING DESIGN STANDARDS PER THE GARLAND DEVELOPMENT CODE.

BUILDING B. BUILDING C . RENDERING.

HERE IS THE SUMMARY OF THE DEVIATIONS AND THE ONLY DEVIATION IS FOR THE SELF STORAGE SCREENING, AND THE GDC REQUIRES ALL SELF STORAGE FACILITIES TO PROVIDE A MINIMUM OF EIGHT FOOT TALL PERIMETER SCREENING, SECURITY FENCING WITH AUTOMATIC GATES.

AS PER THE GDC, A SELF STORAGE BUILDING WALL MAY SERVE AS THE PERIMETER SCREENING WALL, BUT NOT WHEN ADJACENT TO A RESIDENTIAL ZONING DISTRICT, AND THE APPLICANT PROPOSES THE EXTERIOR SOLID WALL OF THE STORAGE UNIT AS A SCREENING WALL FOR THE ADJACENT RESIDENTIAL ZONING DISTRICT TO THE SOUTH, AND THE APPLICANT PROPOSES A 40 FOOT BUILDING SETBACK FROM THE RESIDENTIAL PROPERTIES EXCEEDING THE REQUIRED 20 FOOT SETBACK WITH A ROW OF LARGE CANOPY TREES WITHIN THE BUFFER.

IN ADDITION, NO WINDOWS WOULD FACE TO THE SOUTH AND AN EXISTING SIX FOOT WOOD FENCE IS LOCATED ALONG THE SOUTHERN PROPERTY LINE.

THE APPLICANT REQUESTS THE SUP FOR A PERIOD OF 40 YEARS, WHICH ALIGNS WITH THE SUP TIME PERIOD GUIDE. STAFF RECOMMENDS APPROVAL OF THE AMENDMENT TO PD 85-49 APPROVAL OF THE SUP FOR SELF STORAGE FACILITY AND APPROVAL OF THE DETAILED PLAN ON A PROPERTY ZONED PD 85-49.

ON FEBRUARY 21ST, 2022.

THE PLANNING COMMISSION BY A VOTE OF 8 TO 0, RECOMMENDED APPROVAL OF THE AMENDMENT TO PD 85-49, THE SUP FOR SELF STORAGE FACILITY AND ALSO RECOMMENDED APPROVAL OF THE DETAILED PLAN, AND WE DID MAIL OUT NOTIFICATION.

WE MAILED OUT 65 LETTERS AND WE RECEIVED TWO WITHIN A NOTIFICATION AREA AGAINST THE REQUEST. ONE WAS OUTSIDE OF THE NOTIFICATION AREA AND AGAINST THE REQUEST, AND WE RECEIVED A TOTAL OF THREE RESPONSES.

I'D BE HAPPY TO ANSWER ANY QUESTIONS.

THANK YOU VERY MUCH. ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE. THANK YOU.

MADAM SECRETARY, IF YOU'D CALL OUR SPEAKER.

BRIAN BACA. MR. BACA, WILL YOU COME FORWARD?

[00:25:01]

IF YOU COULD GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, AND WE'LL HAVE 10 MINUTES FOR YOU FOR PRESENTATION.

ANY QUESTIONS? YEAH, GOOD EVENING, MAYOR AND COUNCIL CITY MANAGER.

I AM BRIAN BACA.

I'M A PRINCIPAL OWNER OF ADVANTAGE STORAGE.

OUR ADDRESS IS 2221 LAKESIDE BOULEVARD IN RICHARDSON.

YEAH, JUST WANT TO TAKE A FEW MINUTES TO KIND OF INTRODUCE YOU GUYS TO US AS WELL AS THE PRODUCT THAT WE'RE PROPOSING HERE.

ADVANTAGE STORAGE HAS BEEN IN BUSINESS SINCE 1996, AND IN THAT TIME WE'VE DEVELOPED 50 NEW STORES, DEVELOPMENTS ALL ACROSS DFW AND CURRENTLY OWN AND OPERATE OVER 4 MILLION NET RENTABLE SQUARE FEET.

A LOT OF TIMES WHEN WE THINK OF MINI WAREHOUSE OR MINI STORAGE, THIS IS KIND OF THE IDEA THAT YOU HAVE IN MIND.

THAT'S KIND OF THE EARLY GENERATION, THE OLDER MODELS, WHICH ISN'T REALLY THAT CONDUCIVE TO COMMERCIAL PROPERTIES OR RESIDENTIAL, BUT THIS IS THE CURRENT MODEL NOT ONLY FOR US, BUT FOR MOST SELF-STORAGE DEVELOPERS.

BUILDINGS THAT ARE FITTING IN THIS PARTICULAR CASE, IN A RETAIL ENVIRONMENT BACKED UP DIRECTLY TO A NEIGHBORHOOD.

THIS PARTICULAR PROJECT IS 78,400 RENTABLE SQUARE FEET, AND AS WAS MENTIONED EARLIER, WE HAVE EXCEEDED THE REQUIREMENTS FOR LANDSCAPING AND SETBACK PRIMARILY TO JUST SOFTEN THAT DIFFERENTIATION BETWEEN THE USES.

SO YOU MIGHT ASK A SELF STORAGE APPROPRIATE FOR NEIGHBORHOOD, YOU KNOW, APPROPRIATE NEIGHBOR FOR A RESIDENTIAL NEIGHBORHOOD, AND WE BELIEVE IT IS; WE BELIEVE IT'S AN EXCELLENT NEIGHBOR PRIMARILY BECAUSE THE WAY THAT IT'S BUILT AND THE USE OUR RETAIL DEVELOPMENT ALMOST ALWAYS HAS DRIVES ALL THE WAY AROUND.

A LOT OF BACK OF OFFICE TYPE STUFF GOES ON BACK THERE, DUMPSTERS AND IN THIS PARTICULAR CASE, WE PROVIDE SINGLE STORY BUILDINGS TO PROVIDE THAT INITIAL BUFFER AND THEN LANDSCAPING THAT SOFTENS THAT APPEAL.

IN ADDITION, SELF STORAGE PROVIDES VERY LOW TRAFFIC IMPACT, SO MUCH SO THAT IT'S REALLY NOT THAT MUCH MORE NOTICEABLE THAN THE OTHER USES THAT ARE IN THE NEIGHBORHOOD.

THIS IS A FOUR ACRE SITE BACKED RIGHT UP TO WAGON WHEEL CROSSING, AND YOU CAN SEE SOME OF THOSE HOUSES HAVE VERY SMALL YARDS GOING TO THE BACK, THOSE GARDEN STYLE HOMES, BUT WE PROVIDED IN THE CENTER OF THIS A TWO STORY BUILDING, WHICH YOU'VE SEEN THE RENDERING ALREADY, AND THAT IS APPROXIMATELY 90 FEET FROM THE BACK FENCES OF THOSE NEIGHBORS. WE'VE PROVIDED SINGLE STORY BUILDINGS FLANKING THE PERIMETER, AND THEN IN ADDITION TO THAT, WE'VE GOT A 40 FOOT LANDSCAPE SETBACK, WHICH DOES HAVE CANOPIES AND SHRUBBERY. THE INTERNAL DRIVES ARE COMPLETELY HOODED.

THEY'RE SHIELDED BY THOSE 12 FOOT TALL PERIMETER BUILDINGS.

THEY'RE SOLID MASONRY, SO THE NEIGHBORS AREN'T GOING TO SEE ANY TRAFFIC COMING AND GOING IN THAT FACILITY.

IN FACT, EXCEPT FOR THE FEW THAT ARE PARKING OUT IN THE PARKING LOT, THE PEOPLE ALONG NORTH GARLAND DRIVE WON'T SEE THE GOINGS ON INSIDE THE BUSINESS AS WELL.

THE ARCHITECTURE: TOP NOTCH, I THINK THAT'S CLASS A ARCHITECTURE.

WE'VE GOT STEEL AND GLASS AS THE FOCAL POINT, FLANKED BY NATURAL STONE AND BRICK.

SO I WANT TO TAKE A FEW MINUTES TO TAKE YOU ON A VIRTUAL TOUR OF ONE OF OUR STORAGE FACILITIES. THIS ONE HAPPENS TO BE IN PLANO.

IT'S OUR MCDERMOTT SQUARE FACILITY.

THIS IS THE ONE THAT'S IN A RETAIL AND IS ALSO BACKED UP TO RESIDENTIAL.

WHEN YOU GO INTO OUR OFFICES, THIS IS WHAT YOU SEE.

YOU SEE KIND OF A HIGH CLASS, VERY MODERN, CLEAN DESIGN.

THIS IS A TYPICAL GATE.

IN FACT, IN THIS PARTICULAR CASE, WE WOULD HAVE SOMETHING VERY SIMILAR, A TWO STORY BUILDING THERE ON THE LEFT, SINGLE STORY BUILDING ON THE RIGHT, ALL MASONRY, NICE WIDE, WELL-LIT DRIVES AND THEN THIS IS THE LOADING AREA THAT WE HAVE FOR THE TWO STORY BUILDING.

NOW, THIS IS IN THE BACK, FLANKED BY THE PERIMETER OF SINGLE STORY BUILDINGS.

THIS WILL NEVER BE SEEN BY ANYONE ON THE OUTSIDE, BUT EVEN IF IT WERE, YOU CAN SEE IT'S A VERY NICE INSET.

SO THIS IS THE BACKYARD.

AS YOU CAN SEE ON THE RIGHT, THAT IS A RESIDENTIAL NEIGHBORHOOD, AND THEN WE'VE GOT IN THIS PARTICULAR CASE, A LITTLE BIT LESS LANDSCAPING UP TO OUR BUILDINGS, BUT IF YOU LOOK AT THE BACK OF THOSE BUILDINGS, THAT'S MASONRY, 12 TO 14 FOOT TALL.

THIS PARTICULAR ONE HAS AN ACCENT OF [INAUDIBLE] THERE ON THE TOP FOR THE COPING.

THIS IS A TYPICAL INTERIOR HALLWAY.

THE ZONING ALLOWS FOR OFFICE, SHOWROOM, OFFICE, TECHNICAL AND LIGHT INDUSTRIAL USES, AND WHAT WE'RE PROPOSING IS STORAGE.

WE BELIEVE THAT IS A NEEDED NEIGHBORHOOD SERVICE TO SUPPORT THE RESIDENTS IN THAT COMMUNITY, AS WELL AS THOSE WITHIN A COUPLE OF MILES.

80% OF OUR CUSTOMERS LIVE WITHIN A THREE MILE RADIUS OF OUR FACILITIES AND ALONG WITH THE HIGH QUALITY ARCHITECTURE.

THE ADDITIONAL BENEFIT IS THAT STORAGE PRODUCES VERY LOW TRAFFIC IMPACT.

[00:30:04]

SO YOU MIGHT ASK YOURSELF, DOES GARLAND REALLY NEED ANOTHER STORAGE FACILITY? YOU CAN SEE THIS MAP IN A THREE MILE RADIUS, A LOT OF SELF STORAGE AND THERE'S QUITE A BIT OUT THERE. IN FACT, THERE'S ABOUT 800,000 SQUARE FEET OF SUPPLY, BUT ACCORDING TO HOW GARLANDIANS USE SELF STORAGE ALONG WITH OTHER PEOPLE IN THE METROPLEX, IT REALLY DICTATES THAT THERE SHOULD BE ABOUT 1.1 MILLION SQUARE FEET OF RENTABLE STORAGE.

SO WE ARE IN EFFECT UNDERSUPPLIED BY ABOUT 300,000 SQUARE FEET.

EVEN WITH THIS FACILITY, IT WILL STILL BE UNDERSERVED BY OVER 200,000 SQUARE FEET.

TAX BENEFITS, A PROJECT LIKE THIS WILL VALUE FOR SOMEWHERE IN THE NEIGHBORHOOD OF ABOUT 10 MILLION, WHICH WILL EQUATE TO ABOUT $250,000 IN PROPERTY TAXES.

THE VAST MAJORITY OF THAT STAYING RIGHT HERE IN GARLAND.

DOESN'T DO YOU ANY GOOD UNLESS WE CAN DELIVER ON WHAT WE PROMISED, AND SO I WANT TO SHOW YOU A FEW PICTURES, SOME RENDERINGS AND KIND OF THE FINAL PICTURES OF WHAT WE'VE PROVIDED FOR OTHER AREAS.

THIS ONE HERE IS IN FRISCO, BACKS UP TO A RESIDENTIAL NEIGHBORHOOD.

THAT'S WHAT WE PROMISED TO BUILD THEM.

THAT'S WHAT THEY GOT.

VERY MUCH THE SAME.

THIS IS HIGHWAY 121.

CRAIG RANCH IN MCKINNEY PROVIDED THIS BUILDING AS THE RENDERING, AND THAT'S EXACTLY WHAT THEY GOT. THIS PARTICULAR BUILDING HERE IS ON NORTHWEST HIGHWAY IN DALLAS, AND WE ACTUALLY WORK DIRECTLY WITH THE HOMEOWNERS IN THAT AREA BECAUSE THEY WANTED TO PRESERVE THAT MID-CENTURY MODERN FEEL ON NORTHWEST HIGHWAY.

THIS IS NOT ONE OF OUR ORIGINAL DESIGNS.

WE ACTUALLY SCRAPPED THAT AND CAME UP WITH THIS DESIGN, AND THAT'S EXACTLY WHAT WE BUILT FOR THEM.

HERE IN YOUR OWN BACKYARD, WEST CAMPBELL ROAD, JUST NORTH OF US HERE, THIS FACILITY IS RIGHT NEXT TO AN ELEMENTARY SCHOOL ON THE RIGHT RETAIL CENTER ON THE LEFT, DOG DAYCARE IN THE BACK, AND THEN JUST ACROSS THE STREET IS A RESIDENTIAL NEIGHBORHOOD AND VERY NICE INFILL PRODUCT.

THAT WAS THE NEWEST BUILDING TO BE BUILT THERE IN QUITE A WHILE, AND THAT'S EXACTLY WHAT WE DELIVERED, AND SO I DO WANT TO THANK YOU FOR THE TIME TO ALLOW ME TO INTRODUCE MYSELF TO YOU AND KIND OF OUR PRODUCT, AND SO I'M AVAILABLE FOR ANY QUESTIONS YOU MAY HAVE ON THIS PARTICULAR PROJECT OR FOR ANYONE ELSE.

VERY GOOD. ANY QUESTIONS FOR THE APPLICANT? DEPUTY MAYOR PRO-TEM WILLIAMS. THANK YOU, MAYOR. GOOD EVENING, SIR.

THANK YOU FOR COMING DOWN.

YOU'RE WELCOME. I THINK THREE AND A HALF QUICK QUESTIONS FOR YOU AND I'LL ASK THEM AND YOU CAN ADDRESS ALL OF THEM IN ONE RESPONSE.

ELEVATIONS, I WAS IMPRESSED WITH ALL THAT YOU'VE JUST SHOWN US.

WHICH OF THESE ELEVATIONS ARE GOING TO BE THIS PROPERTY.

OH, I'M SORRY, THAT'S IT RIGHT THERE.

THAT'S WHAT YOU'RE GOING TO SEE FROM NORTH GARLAND.

ALL RIGHT, AND THE SIDE OF THIS PROPERTY THAT BACKS UP TO THE RESIDENTIAL PROPERTIES, YOU SAID THIS IS TWO STORIES, RIGHT? TWO STORIES, CORRECT? NO, SIR. THE PART THAT BACKS UP TO THE RESIDENTIAL PROPERTIES, THEY ARE SINGLE STORY.

THEY'LL BE ABOUT 12 TO 13 FEET TALL.

OKAY, ALL RIGHT.

SO THERE WILL BE NO TWO STORY UNITS BACKING UP TO THE RESIDENTIAL AREA? NO, SIR. THE TWO STORY BUILDING, WHICH IS THE ONE IN THE IN THE FRONT HERE, KIND OF THE FOREGROUND, THE BACK WALL OF THAT BUILDING IS 90 FEET FROM THE PROPERTY LINE.

ACCESS, IS IT 24 HOURS? IT IS NOT 24 HOURS.

WHAT ARE THE HOURS? THE HOURS OF ACCESS ARE SIX IN THE MORNING UNTIL TEN AT NIGHT.

OKAY, ALL RIGHT.

THE OFFICE HOURS I THINK ARE JUST ARE THE MORE NORMAL 9 TO 6, I THINK.

ALL RIGHT, AND MY LAST QUESTION FOR YOU, LOOKING THROUGH THIS, THE FILE HERE, THERE WERE SOME COMMENTS FROM SOME OF THE RESPONDENTS.

THEY WERE CONCERNED ABOUT THE NUMBER OF STORAGE FACILITIES IN THAT AREA.

HOW DO YOU RAISE THE COMFORT LEVELS EXPRESSED BY SOME OF THE FOLKS WHO RESPONDED TO THIS CASE? I THINK YOU TOUCHED ON IT A LITTLE BIT, BUT CAN YOU TALK A BIT MORE ABOUT THAT? THEY'RE CONCERNED ABOUT THE NUMBERS.

I HEAR YOUR DATA, BUT, YOU KNOW, THE FOLKS WHO I'M SURE RESPONDED, YOU KNOW, DIDN'T GO IN AND LOOK AT THAT DATA AND, YOU KNOW, THEY DON'T KNOW WHAT THE SOURCE WAS.

SO HOW WOULD YOU ADDRESS THE ANY CONCERN THAT RESIDENTS HAVE IN THIS AREA ABOUT THE NUMBER OF SELF STORAGES IN THE AREA? I WOULD SUSPECT THAT THEIR CONCERN WOULD BE THAT WE WOULD BUILD A STORAGE FACILITY THAT DOESN'T GET FILLED UP AND I MEAN, THAT'S JUST MY GUESS.

I MEAN, IF THE IF THE FACILITIES ARE BEING USED, THEN IT WOULD BE A NECESSARY FACILITY, AND OUR NUMBERS ARE TELLING US THAT THIS IS AN UNDERSERVED MARKET.

THIS PARTICULAR AREA IS UNDERSERVED.

[00:35:01]

THERE ARE A LOT OF SELF STORAGE FACILITIES AROUND.

THAT IS A FAIRLY RECENT LAST TWO DECADE PHENOMENA THAT STORAGE FACILITIES ARE POPPING UP EVERYWHERE, BUT CURRENTLY AT THE MOMENT, PORTFOLIO-WIDE, WE ARE ABOUT 96% OCCUPIED, WHICH MEANS THAT WE ARE FILLING UP ALL THE UNITS THAT WE HAVE, AND SO WE HAVE YET TO BUILD ONE THAT DOESN'T FILL UP. NOW THAT SAYS MORE ABOUT, I THINK, OUR COMMUNITY STANDARDS AND HOW PEOPLE ARE USING THOSE THINGS THAN IT DOES THIS INDIVIDUAL PROJECT, BUT WE HAVE NO DOUBT THAT THIS IS A VERY GOOD USE FOR THIS PIECE OF LAND WILL PROVIDE THE SERVICES THAT IT NEEDS FOR WHAT WE BELIEVE TO BE AN UNDERSERVED MARKET.

MY LAST QUESTION IS SUSTAINABILITY.

WHAT WOULD YOU SAY IS YOUR SUSTAINABILITY, YOU CORPORATE TURNOVER RATES FOR FACILITIES IN THE CITIES THAT YOU'VE SHOWN US HERE? WELL, CAN YOU CLARIFY WHAT YOU ARE [INAUDIBLE]? YOU'RE BUILDING THIS, SO WHAT'S THE LIKELIHOOD FIVE YEARS DOWN THE ROAD, THREE YEARS DOWN THE ROAD, ANOTHER SIGN GOES UP ON THE PLACE, IT'S SOLD, TURNOVER.

I'VE SEEN THAT HAPPEN IN A NUMBER OF STORAGE FACILITIES.

SO CAN YOU TALK ABOUT ONCE YOU BUILD HERE, ARE WE LOOKING AT YOUR SUSTAINED PRESENCE, SUSTAINED UPKEEP OF YOUR COMPANY? TALK TO US ABOUT WHAT'S YOUR TRACK RECORD? OUR TRACK RECORD. MR. MAYOR. HANG ON ONE SECOND.

CITY ATTORNEY. YES, I WOULD RECOMMEND THAT YOU DIRECT THE WITNESS NOT TO ANSWER THAT PARTICULAR QUESTION. IT'S REALLY NOT GERMANE TO WHAT Y'ALL'S TASK IS HERE TONIGHT.

OKAY, I'LL RESPECT THAT AND I WITHDRAW THAT QUESTION.

ALL RIGHT. THANK YOU, MAYOR. VERY GOOD.

ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? ONE THING, COULD YOU ADDRESS SORT OF THE ELEVATION OF THIS PROPERTY IN RELATION TO THE NEIGHBORHOOD BEHIND IT AND NORTH GARLAND AVENUE? THERE'S QUITE A RISE ON THIS PIECE OF PROPERTY.

YEAH, THERE IS, AND YOU'RE CALLING IT A RISE--WELL, IT'S SIGNIFICANTLY ABOVE THE STREET LEVEL ON THE NORTH GARLAND SIDE, AND SO JUST CURIOUS HOW YOU'RE GOING TO BE ADDRESSING THAT. YEAH, IT IS ABOVE THE STREET LEVEL ON THE NORTH GARLAND SIDE, AND THEN WE ARE ACTUALLY DOWN BELOW THE RESIDENTIAL NEIGHBORHOOD A LITTLE BIT BACK BEHIND US, AND AS FAR AS ADDRESSING IT, I'M NOT REALLY SURE EXACTLY, WHAT YOU'RE GETTING AT.

WHERE WILL THE BUILDINGS BE, THE BUILDING'S FOUNDATION VERSUS THE STREET LEVEL? IT IS GOING TO BE ABOVE THE STREET LEVEL AND WITHOUT THE GRADING PLAN IN FRONT OF ME, I MEAN, AND WE'VE NOT DONE ONE YET, IT WOULD BE DIFFICULT FOR ME TO TELL YOU EXACTLY HOW MUCH. THE ONE FACILITY THAT WE SHOWED YOU WHICH WAS LET'S SEE THIS ONE HERE IN PLANO, THAT ONE IS SIGNIFICANTLY ABOVE, BUT THEN THE WHOLE RETAIL AREA IS SIGNIFICANTLY ABOVE THE STREET LEVEL. SO WE DO HAVE ON THIS PARTICULAR ONE FAIRLY STEEP DRIVES, BUT THEY'RE WITHIN THE 6% GUIDELINES FROM THE FIRE MARSHAL, BUT TYPICALLY, WE'LL HAVE DRIVES THAT GO UP IN THERE, AND WE'RE GOING TO BE SETTING UP A LITTLE BIT ABOVE THE STREET LEVEL AT THIS POINT. I DON'T KNOW HOW MUCH.

OKAY. ALL RIGHT.

THANK YOU. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? MAYOR PRO-TEM HEDRICK.

IF THERE'S NO OTHER QUESTION, THEN I'D LIKE TO MAKE A MOTION.

I HAVE NO ONE ELSE IN THE QUEUE, SIR.

THANK YOU, SIR. I'VE BEEN VERY IMPRESSED WITH THIS APPLICANT AND HOW THEY'VE REACHED OUT TO THE WAGON WHEEL CROSSING COMMUNITY TO THE SOUTH.

HOLD A ZOOM MEETING WITH THEM, ACTUALLY CHANGED THEIR DESIGN BASED UPON THE RECOMMENDATIONS, REMOVING A DRIVEWAY FROM WAGON WHEEL AND PUTTING ONE ON NORTH GARLAND TO EVEN FURTHER RESTRICT THE TRAFFIC THAT WOULD BE HEADING TOWARDS THAT NEIGHBORHOOD.

SO THEY'VE BEEN VERY, VERY GOOD TO WORK WITH THROUGHOUT THIS WHOLE PROCESS.

SO SAYING THAT, I'D LIKE TO MAKE A MOTION TO APPROVE THE ZONING, THE SUP AND THE DETAILED PLAN FOR THIS CASE.

I HAVE A MOTION BY MAYOR PRO TEM HEDRICK AND A SECOND BY COUNCILOR MOORE TO APPROVE APPROVE THESE ITEMS 13C AND D AS PRESENTED.

ANY FURTHER DISCUSSION.

I WILL SAY I WAS ON THIS COUNCIL WHEN THE PROPERTY ON CAMPBELL WAS PRESENTED AND DEVELOPED AND IT HAS CERTAINLY YOU GUYS PRODUCED WHAT YOU SAID YOU WERE GOING TO PRODUCE , AND I THINK IT HAS WORKED INTO THE AREA NICELY.

[00:40:01]

SO THANK YOU FOR THAT.

WITH THAT, MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE, AND COUNCIL.

COUNCILMEMBER VERA, AND DISPLAY THE VOTE, PLEASE.

THAT ITEM IS APPROVED 8 TO 1 WITH COUNCILMEMBER SMITH IN OPPOSITION.

THANK YOU, SIR, AND THAT MOVES US TO ITEM 13E CONSIDER A

[Items 13E & 13F]

PLANNED DEVELOPMENT AMENDMENT REQUEST BY KRG CIVIL ENGINEERS, INC.

TO ALLOW THE CONSTRUCTION OF A CHURCH.

THIS PROPERTY IS LOCATED AT 2313 NAAMAN SCHOOL ROAD IN DISTRICT ONE.

IT ALSO HAS A SECOND PART, 13F FOR A DETAILED PLAN, SAME APPLICANT, SAME ADDRESS.

HELLO, AGAIN. HELLO AGAIN.

THE APPLICANT REQUESTS TO CONSTRUCT A 15,883 SQUARE FOOT CHURCH.

HERE'S THE CASE INFORMATION.

THE ACREAGE IS APPROXIMATELY 2.27 ACRES.

THIS IS THE CITYWIDE LOCATION MAP.

THE RED STAR SHOWS THE APPROXIMATE LOCATION OF THE SUBJECT PROPERTY, AND THIS IS THE LOCATION MAP, THE SUBJECT PROPERTY'S OUTLINED IN THIS TEAL BLUE COLOR AND IT IS PART OF PD 06-78 AND IT HAS TWO DIFFERENT LOTS, AND THE DETAILED PLAN WAS APPROVED FOR THIS NURSING FACILITY, WHICH IS ZONED FOR MULTIFAMILY AND OVER HERE, THE SUBJECT PROPERTY IS FOR COMMUNITY RETAIL AND CHURCHES ARE ALLOWED IN THE GARLAND DEVELOPMENT CODE, BUT THIS PARTICULAR PD REQUIRES A DETAILED PLAN APPROVAL.

SO THE APPLICANT HAS BROUGHT FORWARD A DETAILED PLAN FOR THIS CHURCH.

THE PROPERTY TO THE EAST IS ZONE P FOR RESIDENTIAL AND IT'S CURRENTLY VACANT.

PROPERTIES TO THE SOUTH ARE DEVELOPED WITH SINGLE FAMILY, RESIDENTIAL PROPERTY AND PROPERTY TO THE WEST, THERE IS A NURSING FACILITY WHICH IS PART OF THIS PD.

THE FUTURE LAND USE MAP OF THE ENVISION GARLAND PLAN DESIGNATES THE SUBJECT PROPERTY AS COMPACT NEIGHBORHOODS, AND THIS USE IS SUPPORTIVE TO THE SURROUNDING AREA.

HERE ARE SOME OF THE SITE PHOTOS.

THE TOP LEFT IS VIEW OF THE SUBJECT PROPERTY FROM NAME AND SCHOOL NORTH OF THE SUBJECT PROPERTY. THE BOTTOM LEFT IS SOUTH OF THE SUBJECT PROPERTY, AND BOTTOM RIGHT IS WEST OF THE SUBJECT PROPERTY, AND HERE IS THE PROPOSED SITE PLAN WHICH SHOWS THE CHURCH AND THIS WILL BE DEVELOPED IN TWO PHASES.

PHASE ONE WILL BE FOR THE CHURCH, FOR THE PARKING, SCREENING AND LANDSCAPING, AND PHASE TWO, WHICH IS THIS BROWN SHADED AREA.

THE INTENT FOR THOSE FOR THIS SITE IS UNKNOWN AT THIS TIME, BUT IT IS SUBJECT TO DETAILED PLAN APPROVAL PRIOR TO DEVELOPMENT, AND THIS IS THE PROPOSED LOCATION OF THE CHURCH, AND IT DOES MEET WHAT THE PARKING REQUIREMENTS AND THE ACCESS WILL BE FROM NAME AND SCHOOL AND PLEASANT VALLEY AND OVER HERE YOU CAN SEE WHERE MY CURSOR IS, THERE IS A LOADING AREA WHICH IS REQUIRED PER THE GARLAND DEVELOPMENT CODE FOR DELIVERIES AND IT IS WITHIN THE SETBACK, AND IT'S A DEVIATION THAT I'LL GO OVER IN JUST A MOMENT AND THEN TO THE OVER HERE NEAR THE BUILDING WHERE IT'S LABELED AS LOADING AREA, THAT'S ACTUALLY A DROP OFF AREA FOR THE CHURCH MEMBERS. SO IT'S NOT EXACTLY A LOADING AREA FOR DELIVERIES.

THIS IS THE PROPOSED LANDSCAPE PLAN AND IT DOES COMPLY WITH THE SCREENING AND LANDSCAPING STANDARDS PER THE GDC, AND THEY ARE PROVIDING A MASONRY SCREENING WALL THAT'S ADJACENT TO THE RESIDENTIAL PROPERTIES.

THIS IS THE BUILDING ELEVATIONS AND IT COMPLIES WITH THE BUILDING DESIGN STANDARDS PER THE GDC. THIS IS THE DEVIATION TABLE AND THE ONLY DEVIATION IS FOR THE LOADING SPACE.

THE GDC REQUIRES THAT LOADING SPACES CANNOT BE LOCATED WITHIN A BUILDING SETBACK, AND THE LOADING SPACE IS LOCATED WITHIN THE BUILDING SETBACK, AND THIS DEVIATION IS NEEDED IN ORDER TO AVOID THE PLACEMENT OF THE LOADING AREA NEAR THE STREET SIDE OF THE BUILDING,

[00:45:05]

AND THE APPLICANT CONTENDS THE DELIVERIES TO THE CHURCH BY THE VENDORS WILL BE AT MOST ONCE A MONTH BECAUSE MOST SUPPLIES OR FOOD ITEMS WILL BE PROVIDED BY THE CHURCH MEMBERS.

IN ADDITION, THE LOADING AREAS WILL BE APPROXIMATELY 40 FEET FROM THE NEAREST BUILDING EDGE OF THE NURSING HOME.

STAFF RECOMMENDS APPROVAL OF THE AMENDMENT TO PD 06-78 AND APPROVAL OF THE DETAILED PLAN AND ON FEBRUARY 21ST, THE PLANNING COMMISSION, BY A VOTE OF 8 TO 0, RECOMMENDED APPROVAL OF AN AMENDMENT TO PD 06-78, AND APPROVAL OF THE DETAILED PLAN.

MAILED OUT NOTIFICATION LETTERS.

88 LETTERS WERE MAILED OUT.

ONE WAS WITHIN A NOTIFICATION AREA, AND FOR THE REQUEST, SEVEN WERE WITHIN A NOTIFICATION AREA AND AGAINST THE REQUEST, AND WE RECEIVED A TOTAL OF EIGHT RESPONSES.

VERY GOOD. ANSWER ANY QUESTIONS.

ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE, THANK YOU. MADAM SECRETARY, IF YOU COULD CALL OUR KELLY GOMEZ, PLEASE.

SIR IF YOU COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, YOU'LL HAVE 10 MINUTES TO MAKE A PRESENTATION AND OR JUST ANSWER QUESTIONS.

MY NAME IS KELLY GOMEZ.

I'M WITH KRG CIVIL ENGINEERS.

WE'RE LOCATED AT 2150 SOUTH CENTRAL EXPRESSWAY; THAT'S IN MCKINNEY, 75072.

THANK YOU, SIR. IF YOU HAVE ANY QUESTIONS, I'LL BE HAPPY TO TRY TO ANSWER THEM.

VERY GOOD. ANY QUESTIONS FOR THE APPLICANT? I SEE NONE. DID A GREAT JOB.

[CHUCKLING] OH, SORRY. DEPUTY MAYOR PRO TEM WILLIAMS. SORRY, SIR, MR. JONES, IF YOU COULD STEP BACK, WE HAVE A QUESTION FOR YOU.

THANK YOU, MAYOR. JUST THIS ONE QUESTION.

ONE OF THE RESPONDENTS RAISED AN ISSUE ABOUT EXTENSION OF THE BRICK WALL AND THE FENCING EXTENDED TO THE SIDEWALK BACK TO THE FRONT FENCE OF THE PROPERTY.

YOU KNOW WHAT THEY WERE TALKING ABOUT? I DON'T, BUT I DO KNOW TO CONFIRM, YOU KNOW, WHAT'S ALREADY BEEN SAID, WE'RE REQUIRED TO PROVIDE A SCREENING WALL ON THE RESIDENTIAL SIDE, AND THAT NORMALLY TERMINATES AT THE RIGHT OF WAY LINE.

I DON'T KNOW IF THEY'RE ASKING IT TO GO FURTHER OR SOMETHING LIKE THAT, BUT IT SOUNDS LIKE THEY ARE. THEY ARE. SOUNDS LIKE THE WAY IT READS IT IS THAT THEY'RE ASKING IT TO BE EXTENDED FURTHER. THAT'S FROM THE WAY IT READS.

I DON'T THINK THE CITY WOULD ALLOW THAT.

WE'D BE ENCROACHING INTO THE--I DIDN'T THINK SO, BUT I JUST WANTED THAT ADDRESS SINCE THEY'RE ASKING FOR IT. SEEMS LIKE TO ME.

OKAY. ALL RIGHT.

THANKS, SIR. THANK YOU.

ANY ADDITIONAL QUESTIONS? COUNCILMEMBER BASS. THANK YOU, MAYOR, I WAS JUST GONNA MAKE A MOTION.

I HAVE NO ONE ELSE IN THE QUEUE, GO AHEAD.

THANK YOU, I MAKE A MOTION TO APPROVE THE AMENDMENT AND THE DETAILED PLAN AS PRESENTED.

I HAVE A MOTION BY COUNCILMEMBER BASS AND A SECOND BY COUNCILMEMBER MOORE TO APPROVE ITEMS 13E AND F AS PRESENTED.

ANY FURTHER DISCUSSION? MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE AND COUNCIL, AND DISPLAY THE VOTE.

THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU, SIR. APPRECIATE IT.

THAT WAS OUR LAST ZONING CASE FOR THE EVENING.

THE NEXT ITEM ON OUR AGENDA IS ITEM 14 CITIZEN COMMENTS.

I DON'T BELIEVE THERE ARE ANY CITIZENS PRESENT.

I BELIEVE IT'S ONLY STAFF MEMBERS.

SO I WILL TAKE IT THAT THERE IS NO ONE HERE TO ADDRESS THE COUNCIL OF THIS EVENING, AND WITH THAT, AT 7:49, WE ARE ADJOURNED.

THANK YOU.
