[Plan Commission Pre Meeting]

[00:00:02]

THIS IS A PORTION WHERE WE HEAR ALL ABOUT THE CASES FROM STAFF AND WE ASK QUESTIONS BACK AND FORTH. AND AFTER THIS IS OVER, WE WILL TAKE A RECESS UNTIL THE 7:00 PUBLIC MEETING.

ALL RIGHTY. GO AHEAD.

THANK YOU. [INAUDIBLE].

PODIUM MIC.

ON. TRY THAT NOW.

OKAY. HELLO? GOT IT. PERFECT.

GOOD EVENING.

I WOULD LIKE TO OPEN UP THE MEETING BY ASKING IF ANYONE HAVE ANY QUESTIONS IN REGARDS TO THE CONSENT AGENDA? ANYTHING ON THE MINUTES OR THE PLATS? NO. OKAY.

OKAY. THIS IS CASE NUMBER Z 21-50.

THE APPLICANT PROPOSES A MINOR AUTOMOBILE REPAIR SHOP ON THE SUBJECT PROPERTY.

THIS IS THE CASE INFORMATION.

THE PROJECT IS LOCATED AT 2999 NORTH PRESIDENT GEORGE BUSH TURNPIKE AND THE ACREAGE IS 1.3504 ACRES.

THIS IS THE CITYWIDE LOCATION MAP.

THE STAR REPRESENTS THE GENERAL AREA OF THE PROJECT.

THIS IS THE LOCATION MAP.

THIS IS NORTH GEORGE BUSH TURNPIKE AND THIS IS FIREWHEEL PARKWAY.

THE PROPERTY IS OUTLINED IN TEAL AND THE SURROUNDING USES ARE PRIMARILY PLANNED DEVELOPMENTS, WHICH CONSISTS OF A VARIETY OF RETAIL USES.

THESE ARE THE PHOTOS OF THE AREA.

THIS IS THE SUBJECT SITE.

THIS IS THE PROPERTY TO THE WEST, WHICH IS VACANT, AND THEN FURTHER TO THE WEST IS A AT HOME BUSINESS RETAIL CENTER.

THE PROPERTY TO THE EAST IS A VARIETY OF MIXED USES, AND ACROSS THE GEORGE BUSH TURNPIKE IS THE FIREWHEEL TOWN CENTER.

THIS IS THE SITE PLAN THAT THE APPLICANT HAS PROVIDED.

THEY ARE PROPOSING A AUTOMOBILE MINOR REPAIR USE ON THIS SITE AND THEY WILL HAVE--.

THEIR OPERATIONS WOULD BE MONDAY THROUGH FRIDAY FROM 7 AM TO 6 PM AND SATURDAY FROM 8 AM TO 5 PM.

AS PER THE GARLAND DEVELOPMENT CODE SPECIAL STANDARDS, THE APPLICANT IS PROHIBITING A RECORD AND THEN ALSO STORED VEHICLES ON THIS SITE, AND THOSE CONDITIONS WILL BE PROVIDED IN THE PD.

THE APPLICANT IS MEETING THE PARKING REQUIREMENTS AS PER THE GARLAND DEVELOPMENT CODE AND THE LANDSCAPE PLAN IS MEETING THE GDC REQUIREMENTS.

THESE ARE THE ELEVATIONS THAT THE APPLICANT IS PROPOSING.

THIS IS THE NORTH AND SOUTH ELEVATION.

AND THIS IS THE WEST AND EAST ELEVATIONS AND THE APPLICANT HAS ORIENTED THE GARAGE BAYS TO FACE WEST AND EAST INSTEAD OF FACING TOWARDS THE HIGHWAY.

SO THE USE IS ALLOWED BY RIGHT.

HOWEVER, A DETAILED PLAN IS REQUIRED FOR THIS PLAN DEVELOPMENT AND THE APPLICANT IS NOT REQUESTING FOR NO DEVIATIONS.

AND THIS REVIEW MEETS ALL TECHNICAL REQUIREMENTS.

STAFF RECOMMENDS APPROVAL OF A DETAILED PLAN ON A PROPERTY ZONE PLAN DEVELOPMENT DISTRICT 06-28 FOR COMMUNITY RETAIL USES.

WE MAILED OUT 11 NOTIFICATION LETTERS AND WE RECEIVED ONE IN FAVOR WITHIN THE NOTIFICATION AREA, AND THE TOTAL RESPONSE WAS ONE.

AND THAT CONCLUDES STAFF PRESENTATION.

ANY QUESTIONS? OKAY. THANK YOU.

THIS IS PRETTY MUCH KIND OF LIKE A PLAT THEN? [INAUDIBLE] TECHNICALLY CORRECT, SO WE'RE NOT GIVEN MUCH OF A CHOICE.

YEAH. [LAUGHTER] COMMISSIONER PARIS.

IT WAS JUST ONE QUICK QUESTION ON TRAFFIC FLOW, INCREASE OR CONGESTION.

[00:05:02]

MY UNDERSTANDING PROBABLY IT'S WITHIN LIMITS OR YOU'VE ALREADY REVIEWED THAT TRAFFIC ANALYSIS. THIS MAY BE TOO EARLY, I'M NOT SURE, BUT JUST VERY FAMILIAR WITH THAT AREA.

I JUST WANTED TO BE SURE THE INCREASE OR THE CONGESTION THAT COULD HAPPEN OR IS THERE A CONCERN THAT THAT MIGHT HAPPEN? SO THE TRANSPORTATION DEPARTMENT, THEY DID REVIEW THIS, AND THEY DID NOT REQUIRE [INAUDIBLE]--.

ANALYSIS, IMPACT ANALYSIS? ALL RIGHT. THANK YOU. THANK YOU.

I DON'T KNOW HOW TO TURN THE MIC OFF.

THIS NEXT CASE IS Z 21-54.

THE APPLICANT PROPOSES TO RENEW A SPECIFIC USE PROVISION FOR AN EXISTING AUTO SALES NEW OR USED, AND THIS IS APPROVAL OF A SPECIFIC USE PROVISION RENEWAL FOR AUTO SALES, NEW OR USED, AND APPROVAL OF A PLAN ON A PROPERTY ZONED INDUSTRIAL DISTRICT.

HERE'S THE CASE INFORMATION.

THE ACREAGE IS APPROXIMATELY 18.23 ACRES.

[INAUDIBLE] CITY WIDE LOCATION MAP AND THE RED STAR SHOWS THE APPROXIMATE LOCATION OF THE SUBJECT PROPERTY.

THIS IS THE LOCATION MAP AND THE SUBJECT PROPERTIES OUTLINED IN THIS TEAL BLUE COLOR, AND IT DOES HAVE AN EXISTING SUP THAT HAS EXPIRED, IT'S FROM 95.

AND THE PROPERTIES TO THE NORTH ARE ZONED FOR HEAVY COMMERCIAL, AND THERE IS A AUTO REPAIR SERVICE.

PROPERTIES TO THE EAST, THERE ARE SEVERAL PLANNED DEVELOPMENTS WITH COMMUNITY RETAIL BASED ZONING. THERE IS A TEMPORARY OFF SITE CONSTRUCTION CAMPUS, A CAR WASH AND AUTO SALES.

AND THE PROPERTIES TO THE WEST ZONE INDUSTRIAL, AND THERE IS A TRUCK REPAIR SERVICE.

THE FUTURE LAND USE MAP OF THE ENVISIONED GARLAND PLAN DESIGNATES THIS PROPERTY AS INDUSTRY CENTER.

AND THE USE IS COMPATIBLE WITH THE SURROUNDING AREA AND THE COMPREHENSIVE PLAN.

HERE ARE SOME OF THE PHOTOS.

THE TOP LEFT IS VIEW OF THE SUBJECT PROPERTY FROM SOUTH SHILOH ROAD AND THAT'S THE EXISTING AUTO SALES FACILITY.

TOP RIGHT IS NORTH OF THE SUBJECT PROPERTY.

BOTTOM LEFT IS EAST OF THE SUBJECT PROPERTY.

AND BOTTOM RIGHT IS SOUTH OF THE SUBJECT PROPERTY.

AND HERE IS THE SITE PLAN, THIS IS THE EXISTING LAYOUT.

THE APPLICANT IS NOT PROPOSING ANY CHANGES AT THIS TIME.

THERE ARE FOUR BUILDINGS ON SITE AND THIS IS FOR AN SUP RENEWAL.

THE APPLICANT REQUESTS THE SUP EXTENSION TO BE IN EFFECT FOR A PERIOD OF 25 YEARS, AND NO GDC DEVIATIONS ARE BEING REQUESTED WITH THIS APPLICATION.

STAFF RECOMMENDS APPROVAL OF THE SUP RENEWAL FOR AUTOMOBILE SALES NEAR USED ON A PROPERTY ZONED INDUSTRIAL DISTRICT AND APPROVAL OF A PLAN FOR AN AUTOMOBILE SALES NEW OR USED ON A PROPERTY ZONED INDUSTRIAL DISTRICT.

I'D BE HAPPY TO ANSWER ANY QUESTIONS.

SURE, COMMISSIONER OTT THEN ROSE.

VERY MINOR QUESTION.

RANDALL REED, THEIR FACILITY HAS BEEN A REALLY GOOD STEWARD OF THEIR SPACE DOWN THERE.

I DON'T KNOW OF THEM HAVING ANY PROBLEMS IN THAT AREA, BUT THEIR SUP DID IT EXPIRE TWO YEARS AGO? IS THAT CORRECT? FROM THE MATH ON IT? HOW DID THAT GET CAUGHT? DID THEY COME TO US OR DID WE APPROACH THEM? HOW DID WE KNOW? WE APPROACHED THEM. WE SENT OUT LETTERS THAT WE'VE BEEN KEEPING TRACK OF THE SUPS THAT HAVE EXPIRED RECENTLY, AND WE SENT OUT LETTERS TO THEM.

OKAY. THANK YOU.

I DON'T THINK IT'S SOMETHING ON THE TOP OF THEIR MIND.

YEAH. COMMISSIONER ROSE? HOW MANY YEARS? 25 YEARS.

OKAY, THANKS.

THANK YOU.

[00:10:03]

THIS NEXT CASE IS Z 22-10.

THE APPLICANT PROPOSES TO RENEW A SPECIFIC USE PROVISION FOR AN EXISTING RECEPTION FACILITY ON THE SUBJECT PROPERTY.

AND THIS IS A SPECIFIC USE PROVISION AND A PLAN FOR A RECEPTION FACILITY ON A PROPERTY ZONE PD 06-46 FOR COMMUNITY RETAIL USES.

HERE IS THE CASE INFORMATION.

THE ACREAGE IS APPROXIMATELY 3.14 ACRES.

THIS IS THE CITY WIDE LOCATION MAP AND THE RED STAR SHOWS THE APPROXIMATE LOCATION OF THE SUBJECT PROPERTY. AND THIS IS THE LOCATION MAP, THE SUBJECT PROPERTY IS OUTLINED IN THIS TEAL BLUE COLOR.

AND THE PROPERTIES TO THE NORTH ARE DEVELOPED WITH SINGLE FAMILY RESIDENTIAL.

PROPERTY TO THE EAST IS A SHOPPING CENTER.

AND THEN THE PROPERTIES TO THE SOUTH ACROSS EAST CENTREVILLE ARE SINGLE FAMILY PROPERTIES . AND THE PROPERTY TO THE WEST IS ZONED SINGLE FAMILY TEN DISTRICT BUT IS CURRENTLY VACANT. AND THE GDC STATES THAT A RECEPTION FACILITY MAY NOT BE WITHIN 500 FEET OF A RESIDENTIAL DWELLING, AND THIS REGULATION CAME IN--.

WHEN THE GDC WAS ADOPTED, AS WAS--.

THEN THIS SUP WAS APPROVED PRIOR TO THE GDC, SO IT'S REGULATION DIDN'T EXIST AT THE TIME, BUT THE DISTANCE FROM THE NORTH OF THE RECEPTION FACILITY TO THE RESIDENTIAL UNITS, IT'S ABOUT 244 FEET.

AND THEN DISTANCE FROM THE SOUTH IS ABOUT 173 FEET.

THE FUTURE LAND USE MAP OF THE ENVISIONED GARLAND PLAN DESIGNATES THIS PROPERTY AS NEIGHBORHOOD CENTERS.

AND THE LAND USE IS COMPATIBLE WITH THE AREA AND THE COMPREHENSIVE PLAN.

HERE ARE SOME OF THE PHOTOS.

TOP LEFT IS VIEW OF THE SUBJECT PROPERTY AND THE TOP RIGHT IS EAST OF THE SUBJECT PROPERTY WHERE THAT SHOPPING CENTER IS.

AND THEN BOTTOM LEFT IS SOUTH OF THE SUBJECT PROPERTY AND BOTTOM RIGHT IS WEST OF THE SUBJECT PROPERTY.

THIS IS THE EXISTING SITE PLAN.

THE APPLICANT DOES NOT INTEND TO MAKE ANY IMPROVEMENTS ON THIS SITE.

THIS IS BEING USED AS A RECEPTION FACILITY AND IT'S APPROXIMATELY 19,600 SQUARE FEET.

AND HERE ARE THE BUILDING ELEVATIONS.

THE APPLICANT REQUEST THE SUP TO BE IN EFFECT FOR 15 YEARS, WHICH ALIGNS WITH THE SUP TIME PERIOD GUIDE.

AND STAFF RECOMMENDS APPROVAL OF THE SUP RENEWAL FOR RECEPTION FACILITY ON A PROPERTY ZONED PD 06-46 FOR COMMUNITY RETAIL USE AND APPROVAL OF A PLAN FOR A RECEPTION FACILITY USE. I'D BE HAPPY TO ANSWER YOUR QUESTIONS.

COMMISSIONER DALTON, THEN COMMISSIONER ROSE.

THANK YOU. SO THIS IS RIGHT NOW LEGAL NON-COMPLYING AT THE MOMENT SINCE--? SINCE THE SUP HAS EXPIRED.

RIGHT. THERE IS ONE CITIZEN RESPONSE SAYING THERE'S BEEN A LOT OF THINGS HAPPEN THERE THAT HAVE REQUIRED POLICE INTERVENTION.

HAVE YOU TALKED TO THE POLICE DEPARTMENT TO FIND OUT WHAT POSSIBLE THINGS HAVE TAKEN PLACE IN THAT VICINITY? YES, WE HAVE CONTACTED THE POLICE DEPARTMENT.

AND IN THE PAST THREE YEARS, THERE HAVE BEEN FOUR INCIDENTS REPORTED ON THAT PROPERTY.

DO YOU KNOW WHAT THOSE REPORTS WERE? YES. BECAUSE ONE OF THEM REFERENCES EXTREMELY LOUD MUSIC.

SO THE POLICE DEPARTMENT STATED THERE ARE FOUR INCIDENTS, ONE OF THEM IS LOST PROPERTY, SECOND ONE IS AGGRAVATED ASSAULT, THIRD ONE IS A HIT AND RUN, AND THE FOURTH ONE IS PROTECTIVE CUSTODY, MENTAL HEALTH.

OKAY. THANK YOU.

COMMISSIONER ROSE? IN THIS WRITE UP AND SAYS THEY WON'T BE OPEN AFTER 3 AM.

HOW'S THAT GOING TO GET ENFORCED? ARE THEY SELF ENFORCING IT? IN WHICH CASE IT'LL BE 3:30, 4:00, WHO KNOWS.

I'M JUST CURIOUS.

I BELIEVE THERE'S SECURITY ON SITE, AND I'M SURE THE APPLICANT CAN PROVIDE MORE INFORMATION ON THAT.

ALL RIGHTY, COMMISSIONER WILLIAMS? THANK YOU, MR. CHAIRMAN.

[00:15:02]

DID THEY WANT MORE THAN 15 YEARS, OR IS THAT JUST WHAT WE'RE GIVING THEM? THEY ASKED FOR 15 YEARS.

THEY ASKED FOR 15 YEARS.

OKAY. THANK YOU.

IS THAT IN LINE WITH THE GUIDELINES THEN? SEEMS--. ALSO THE OTHER COMMENTS, A CITIZEN COMMENT WAS AROUND TRAFFIC ISSUES.

HAS THAT BEEN ADDRESSED OR WAS AN ANALYSIS DONE? GO AHEAD. THIS IS AN EXISTING BUILDING, BUT IT HAS BEEN REVIEWED BY THE TRANSPORTATION DEPARTMENT, AND SINCE THEY'RE NOT PROPOSING ANY IMPROVEMENTS AT THIS TIME, THEY DIDN'T HAVE ANY FEEDBACK.

THANK YOU. OKAY.

SO THIS IS WHEN YOU PROBABLY SENT A LETTER OUT AND THEY'RE COMING BACK.

[INAUDIBLE] WITH THE NOISE AND THE OTHER ISSUES, THAT WHOLE BUILDING IS THE RECEPTION CENTER THEN, CORRECT? YES.

AND WITH THAT, A FLOOR PLAN, WE DON'T KNOW WHETHER THEY'RE DOORS OPENING UP OUT TO THE BACK TO THE NEIGHBORS.

WE WENT THROUGH THIS ONCE A NUMBER OF YEARS AGO WHERE DOORS ARE OPENING OUT TO THE BACK TO THE NEIGHBORS, AND WE LOOKED AT WAYS TO MITIGATE SOME OF THAT, BUT WITHOUT THE FLOOR PLAN, REALLY CAN'T TELL THAT.

MAYBE THE APPLICANT CAN HELP US OUT ON THAT.

BECAUSE I KNOW THIS IS JUST ONE REPORT, BUT I IMAGINE IF YOU WENT TO THE NEIGHBORHOOD, WE MIGHT FIND SOME OTHER PEOPLE CURIOUS.

THANK YOU. OH, AND COMMISSIONER JENKINS? IT LOOKS LIKE ONE OF THE COMMENTS INDICATES THAT THE SUP AT SOME POINT CONTEMPLATED A CONDITION THAT THE MUSIC MUST STOP AT A SPECIFIC TIME.

DO YOU HAVE ANY HISTORICAL RECORD INDICATING THAT IT MAY HAVE, IN FACT, SAID THAT OR ANYTHING OF THE SORT? I'M NOT AWARE OF THAT.

I WOULD HAVE TO CHECK THE PAST REPORTS THAT WAS APPROVED BACK IN '95.

BUT I DIDN'T COME ACROSS ANYTHING [INAUDIBLE].

THANK YOU. THANK YOU.

ANY OTHER QUESTIONS? ALL RIGHTY. THAT WAS THE LAST OF OUR ITEMS FOR WORK SESSION.

SO UNTIL OUR PUBLIC HEARING PORTION, WE ARE IN RECESS.

PLEASE VOTE. AND THAT PASSES UNANIMOUSLY.

THANK YOU. ALL RIGHTY.

FIRST, ZONING CASE, ZONING ITEM 3.A, CONSIDERATION OF THE APPLICATION OF KIMLEY-HORN REQUESTING APPROVAL OF A DETAILED PLAN FOR AUTOMOBILE REPAIR, MINOR USE ON PROPERTY ZONED PLANNED DEVELOPMENT DISTRICT, PD 06-28 DISTRICT FOR COMMUNITY RETAIL USES.

THIS ITEM MAY INCLUDE AMENDMENTS TO PLAN DEVELOPMENT PD DISTRICT 06-28.

THIS PROPERTY IS LOCATED AT 2999 NORTH PRESIDENT GEORGE BUSH TURNPIKE.

DO WE HAVE ANY SPEAKERS ON THIS ITEM? IS THE APPLICANT HERE? I DIDN'T FILL OUT THE KIOSK, BUT I CAN GO UP AND DO THAT.

YEAH. YEAH, YOU CAN DO THAT.

JUST NAME AND ADDRESS IN THE MICROPHONE, PLEASE.

MICHAEL DOGGETT WITH KIMLEY-HORN, 260 EAST DAVIS, SUITE 100, MCKINNEY, TEXAS.

WE'VE REVIEWED THE STAFF REPORT AND AGREE WITH EVERYTHING IN IT.

APPRECIATE YOUR APPROVAL TONIGHT AND I'D BE HAPPY TO ANSWER ANY QUESTIONS YOU GUYS HAVE.

ANY QUESTIONS OF THE APPLICANT? THANK YOU VERY MUCH FOR COMING DOWN, AND--.

THANK YOU. COMMISSIONER DALTON? THANK YOU. ARE YOU AT LIBERTY TO SAY WHAT FACILITY, WHAT COMPANY THIS IS? YES, IT'S SUN AUTO SERVICES.

THEY'RE BASED OUT OF SCOTTSDALE, ARIZONA.

THEY'LL BE DEVELOPING IN NORTH TEXAS.

WHAT DO THEY DO? BASIC OIL CHANGE AND TIRE ROTATIONS AND--? MINOR AUTOMOBILE REPAIR.

THEY DO A LITTLE BIT OF EVERYTHING, YEP.

AND THEY'VE GOT NO PROBLEM WITH THE FACT THERE CANNOT BE A RECORD THERE NOR ANY VEHICLE STORED OVERNIGHT? THAT'S CORRECT.

OKAY. THANK YOU. THANK YOU.

AND YOU'RE OUT OF THE MCKINNEY OFFICE? YES, SIR. TELL JOE HELMBERGER I SAID HELLO.

OKAY. ALL RIGHTY.

IS THERE ANYBODY ELSE IN THE AUDIENCE AS WE SPEAK ON THIS CASE? SEEING NONE. COMMISSIONERS MOTION? MR. CHAIR? COMMISSIONER DALTON. MAKE A MOTION THAT WE CLOSED THE PUBLIC HEARING AND APPROVE AS POSTED . SECOND. MOTION BY COMMISSIONER DALTON, A SECOND BY COMMISSIONER WILLIAMS TO APPROVE THE DETAILED PLAN.

SEEING NO DISCUSSION.

PLEASE VOTE. IT'S BUILT IN.

AND THAT PASSES 7 TO 1.

LET'S SEE IF I CAN SEE THE--.

AND VOTE AGAINST BY COMMISSIONER JENKINS.

ALL RIGHTY. NEXT ITEM IS A TWO PARTER.

[Items 3B & 3C]

CONSIDERATION OF THE APPLICATION OF RANDALL REED'S PLANET FORD 635 REQUESTING APPROVAL OF A SPECIFIC USE PROVISION RENEWAL TO ALLOW AUTOMOBILE SALES NEW OR USED ON A PROPERTY ZONED INDUSTRIAL DISTRICT.

THIS PROPERTY IS LOCATED AT 3601 SOUTH SHILOH ROAD.

ITEM 3.C, CONSIDERATION OF THE APPLICATION OF RANDALL REED'S PLANET FORD 635 REQUESTING APPROVAL OF A PLAN FOR AUTOMOBILE SALES NEW OR USED ON PROPERTY ZONED INDUSTRIAL DISTRICT. AGAIN 3601 SOUTH SHILOH.

HAVE NO SPEAKERS LISTED, IS--.

YOU CAN GO AND FILL THAT OUT LATER OR THEY MAY EVEN HAVE A CARD UP THERE FOR YOU.

SUZANNE BAKER WITH PLANET FORD 635 AT 3601 SOUTH SHILOH ROAD.

YEAH, WE'RE JUST DOING A RENEWAL FOR THE SPECIAL USE PERMIT THAT WAS ACTUALLY EXPIRED FOR THE 25 YEARS ORIGINAL.

SO DO YOU HAVE ANY QUESTIONS? ANY QUESTIONS? I SEE NONE.

THANK YOU VERY MUCH-- THANK YOU. COMING DOWN.

ANYBODY ELSE IN THE AUDIENCE WAS SPEAKING THIS ITEM? ALL RIGHTY. COMMISSIONER WILLIAMS? MAKE A MOTION. ALL RIGHTY.

DOES NO ONE ELSE WANT TO SPEAK? NO? NO. I MAKE THE MOTION.

[00:25:02]

WE CLOSE THE PUBLIC HEARING AND APPROVE THE REQUEST AND WITH A COMMENT, THESE PEOPLE HAVE BEEN NOTHING BUT TROOPERS DOWN THERE ON SHILOH WITH ALL THAT CONSTRUCTION GOING ON.

[LAUGHTER] IT'S BEEN A GOD AWFUL MESS DOWN THERE FOR YEARS, AND I'M VERY PLEASED THAT THEY'RE STILL THERE.

THEY HAVE PUT UP WITH A WHOLE LOT OF STUFF AND WITH THAT CONSTRUCTION GOING ON.

SO THEY'VE BEEN 100% TROOPERS THE WHOLE TIME [LAUGHTER].

AND, OKAY, SO WE HAVE MOTION BY COMMISSIONER WILLIAMS, AND I SAW A FINGER GO UP BY COMMISSIONER ROSE TO SECOND AND THAT WOULD BE THE APPROVAL OF THE SPECIAL USE PROVISION AND THE PLAN.

ANY DISCUSSION? OK.

THAT'S OK.

OK. LET THE RECORD SHOW THAT COMMISSIONER PARIS IS THE SECOND ON THIS MOTION.

ALL RIGHTY. LET'S GO AHEAD AND VOTE.

HEARING NO DISCUSSION.

AND THAT PASSES UNANIMOUSLY.

THANK YOU FOR PUTTING UP WITH ALL THE CONSTRUCTION.

IT'LL GET BETTER SOMEDAY.

THANK YOU, GUYS. ALL RIGHTY.

[Items 3D & 3E]

NEXT ITEM IS ALSO A TWO PARTER, AND EVEN THOUGH I'VE BEEN TOLD HOW TO PRONOUNCE THE LAST NAME, I AM GOING TO MESS IT UP, AND I APOLOGIZE.

CONSIDERATION OF THE APPLICATION OF JUDE NWACHUKWU REQUESTING APPROVAL OF A SPECIAL USE PROVISION RENEWAL TO ALLOW RECEPTION FACILITY ON PROPERTY ZONED PLAN DEVELOPMENT DISTRICT 06-46 FOR COMMUNITY RETAIL USES.

THIS PROPERTY IS LOCATED AT 1906 EAST MILLER ROAD, AND ITEM 3.E CONSIDERATION OF THE APPLICATION OF JUDE NWACHUKWU REQUESTING APPROVAL OF A PLAN FOR RECEPTION FACILITIES, AGAIN 1906 EAST MILL ROAD.

GOOD EVENING. GOOD EVENING.

MY NAME IS JUDE NWACHUKWU.

1423 COLBORNE DRIVE, MESQUITE, TEXAS.

I'M THE ONE. IF YOU HAVE ANY QUESTIONS, I'D BE MORE THAN WILLING TO ANSWER.

ALL RIGHTY. I THINK THERE MAY BE A FEW.

COMMISSIONER DALTON.

YOU'RE BUILDING--. ONE OF THE COMMENTS MADE BY NEIGHBORS IS THE AMOUNT OF NOISE OR SOUND COMING OUT OF YOUR FACILITY.

WHAT SIDE OF THE BUILDING IS THE MAIN DOOR TO ENTER AND EXIT? IS IT ON THE MILLER SIDE OR IS IT ON THE GARLAND ROADSIDE OR--? ACTUALLY IT'S ON THE--.

WE DO HAVE INTEREST ON MILLER AND WE HAVE THE MAIN ENTRANCE IS ACTUALLY ON THE SIDE, WHICH IS MORE LIKE IT'S GOING TO BE FACING IF YOU KNOW THE AREA, IT'S GOING TO BE FACING THE DAYCARE. FACING THE DAYCARE? YES. I MEAN, THERE'S A DAYCARE.

I'M GOING TO SAY IT'S FACING MORE EAST.

IT'S NOT ON THE MILLER.

IT'S NOT ON CENTERVILLE.

IT'S ON THE EAST SIDE OF THE BUILDING.

RIGHT.

IT'S ON THE CENTERVILLE SIDE.

NO, IT'S NOT CENTERVILLE SIDE.

WE DON'T USE IT [INAUDIBLE]. I'M SORRY.

I'M SORRY. MY MISTAKE.

IT'S FACING THE DAYCARE WHICH IS WE'RE GOING TO PULL UP THE MAP SO [INAUDIBLE] PUT A MOUSE POINTER ON IT FOR US.

THAT'LL WORK. WELL, I'M NOT GOING TO, BUT.

[LAUGHTER] OKAY.

CAN YOU ZOOM IN ON THAT? THERE WE GO. YOU SAY THERE IS A DOOR FACING MILLER? YES, BUT THAT'S REALLY NOT THE--.

THAT'S THE MAIN DOOR FOR THE ADDRESS, BUT WE DO HAVE THE DOOR WE USE IS THE ONE ON THE SIDE.

THE ONE THAT'S ON BASICALLY THE EAST SIDE OF THE BUILDING FACING THE PARKING LOT TO THE

[00:30:03]

RIGHT, AS I'M LOOKING AT THIS MAP IS WHERE PEOPLE COME IN AND OUT.

IS THAT A PORTE-COCHèRE THAT I SEE ON THEIR? COVERED ENTRY.

OUR [INAUDIBLE] VESTIBULE THERE, JUST TO KEEP THE NOISE INSIDE.

SO YOU HAVE BASICALLY A MAN TRAP OR A DEAD AIR SPACE IN THAT AREA RIGHT THERE? OK.

HAS THERE BEEN ANY TESTING DONE JUST TO SEE WHAT THE SOUND IS OUTSIDE YOUR BUILDING? IT'S BEEN DONE OVER AND OVER.

IN THE BEGINNING, 15 YEARS AGO, THE POLICE CHIEF DID SEND AN OFFICER THAT DID A NOISE CHECK AND THEY COULDN'T NOTICE ANY NOISE.

THE NOISE COMING OFF THE FREEWAY OR THE STREET, YOU HEAR THE CARS, THE NOISE OF THE CARS.

YOU CAN'T HEAR THE NOISE COMING FROM OUR BUILDING, AND FOR EVERY EVENT WE HAVE, WE USE GARLAND POLICE.

AND IF ANYBODY HAD ANY ISSUE TO CALL AND THERE'S ALWAYS AN OFFICER THERE TO TAKE CARE OF WHATEVER THE PROBLEM IS, WHICH, YOU KNOW, THE OFFICERS CAN TESTIFY TO.

OKAY. WHAT TIME DO YOU CLOSE? WHAT TIME DO YOU SHUT DOWN? MOST EVENTS END THAT 1:00, WE STOP THE MUSIC AT 1:00, AND OF COURSE, THE PEOPLE HAVE TO 2:00 TO LEAVE.

EVERY NOW AND THEN, YOU KNOW, YOU MAY HAVE PEOPLE STAY BEYOND THAT TIME, BUT MOST OF OUR EVENT IS 2:00, EVERYBODY SHOULD BE OUT OF THE PLACE.

SO ONE OF THE THINGS MENTIONED IN ONE OF THE RESPONSES WAS AS LATE AS 5 AM, HAVE YOU-- ? UNLESS SOMEBODY JUST HANGING AROUND THE PARKING LOT, WHICH WE DON'T ALLOW.

SO THE OFFICERS THEN WILL ASK PEOPLE TO LEAVE THE LOT IF IT'S PAST THE 2:00 TIME? OKAY. THANK YOU.

THANK YOU. ANY OTHER QUESTIONS THAT THE APPLICANT.

THANK YOU VERY MUCH FOR COMING DOWN.

I APPRECIATE IT. OKAY.

I LOOKED TOO QUICK. I'M SORRY.

COMMISSIONER JENKINS? EAGER TO LET US GO.

I UNDERSTAND. [LAUGHTER] GOOD EVENING, SIR.

MY QUESTION IS, ARE YOU THE--.

HAVE YOU BEEN THE PERSON IN CHARGE OF THE BUSINESS OPERATIONS OF THIS LOCATION FOR A VERY LONG TIME? FOR 15 YEARS NOW.

SO, 15.

MY MATH IS PRETTY BAD.

2020. 2005 OR SO.

SO YOU WOULD HAVE NO KNOWLEDGE OF THE PREVIOUS SUP THAT USED TO GOVERN THIS PARTICULAR LOCATION? THE SUP WAS ACTUALLY GIVEN TO US.

THE BUILDING HAS BEEN THERE FOR OVER 50 YEARS AND WE'RE STILL DOING THE SAME THING THAT THE PEOPLE WHO WERE THERE BEFORE US WERE DOING.

SO REALLY ALL WE HAVE DONE IS IMPROVE THE PLACE.

AND OF COURSE, WE HAVE BROUGHT THE GARLAND POLICE THERE ALSO TO DO THE SECURITY WHEN WE HAVE THOSE EVENTS.

HE HAS ONE OF THE OLDER SPECIAL USE PROVISIONS AND BEFORE 2015, THEY WERE TIED TO THE INDIVIDUAL. YES.

NOW IT'S A RANGE WHERE THEY'RE TIED TO THE ADDRESS AND THE PROPERTY.

SO YOU'VE HAD IT SINCE 2006? YES. YEAH. JUST A LITTLE HISTORY THERE.

ALL RIGHT. ANY OTHER QUESTIONS? AND YOU KNOW, EVERY EVENT THAT I HAVE, I'M THERE EVERY NIGHT.

I DON'T--. IT'S NOT LIKE I GO HOME AND SLEEP.

I DON'T GO HOME TO SLEEP.

SO YOU JUST PARTY ALL THE TIME? I'M THERE ALL THE TIME. [LAUGHTER] SO, JUST TO MAKE SURE THAT, YOU KNOW--.

GOT ONE MORE SPEAKER.

COMMISSIONER OTT? ONE QUESTION. I HAVE, YOU HAD MENTIONED THAT YOU HAVE GARLAND POLICE OFFICERS AT YOUR EVENTS. IS THAT AT EVERY EVENT, MOSTLY EVERY EVENT, UNLESS ALCOHOL IS NOT BEING SERVED? OKAY. THAT'S WHAT I THOUGHT.

THE LAW SAYS WE MUST HAVE SECURITY AND WE USE GARLAND POLICE FOR THAT.

OKAY. AND WHAT PERCENTAGE DO YOU THINK? HOW OFTEN DO YOU HAVE OFFICERS AT YOUR EVENTS? HONESTLY, EVERY SATURDAY NIGHT.

OKAY. SO--.

EVERY NOW AND THEN, FRIDAYS, BUT EVERY SATURDAY NIGHT.

SO THE SATURDAY NIGHT EVENTS, YOU HAVE OFFICERS THERE.

AND THEN IF YOU HAD SOMETHING THAT WAS ON A SUNDAY, THAT'S PROBABLY A FAMILY TYPE OF EVENT THEN YOU PROBABLY WOULDN'T FOR SOMETHING LIKE THAT? YOU KNOW, WE HAVE TO LOOK AT EVERY EVENT AND WHERE THE, YOU KNOW, THE EVENT, IF IT REQUIRES POLICE.

YEAH, WE MAKE SURE THE POLICE OFFICERS ARE THERE.

OKAY. THANK YOU.

THANK YOU. THANK YOU.

[00:35:04]

ANYBODY ELSE IN THE AUDIENCE WHO WISHES TO SPEAK ON THIS ITEM? SEEING NONE.

CHAIR WILL ENTERTAIN A MOTION.

DISCUSSION? COMMISSIONER JENKINS? MAKE A MOTION TO CLOSE THE PUBLIC HEARING.

OKAY. WE HAVE A MOTION BY COMMISSIONER JENKINS AND A SECOND BY COMMISSIONER WILLIAMS TO CLOSE THE PUBLIC HEARING.

IT'S JUST CLOSING THE PUBLIC HEARING.

PLEASE VOTE. [INAUDIBLE].

AND THAT PASSED UNANIMOUSLY.

WE ARE IN DISCUSSION.

ANY DISCUSSION? CHAIRMAN? COMMISSIONER JENKINS? [INAUDIBLE] VERY GENERALLY IN FAVOR OF THIS PROPOSITION, BUT I DO HAVE SOME HESITATION REGARDING THE NOISE VIOLATIONS, OR AT LEAST THE ALLEGATIONS FOR THE NOISE VIOLATIONS, AND I WOULD ENCOURAGE THE APPLICANT TO REVIEW THE COMMENTS THAT WERE PROVIDED FOR THIS DISCUSSION, BECAUSE ONE OF THE INDIVIDUALS THAT WEIGHED IN MAY DETERMINE THE APPLICANT'S RIGHTS AT A LATER DATE AND TIME.

SO AGAIN, I'M GOING TO SPEAK VERY GENERALLY IN FAVOR OF THIS PROPOSITION, BUT I'M HESITANT REGARDING THE NOISE VIOLATIONS.

THANK YOU. THANK YOU.

COMMISSIONER DALTON? ONE OF THE THINGS THAT WAS ALSO BROUGHT UP WAS CHECKING WITH THE POLICE, WHICH WE DID GET THAT REPORT, AND IN THE PAST, I DON'T RECALL THE TIME WINDOW, THREE YEARS? THERE WAS A TOTAL OF FOUR POLICE EVENTS, ONE BEING A TRAFFIC ACCIDENT, ONE BEING A MENTAL ISSUE, I BELIEVE.

I DON'T SEE EITHER ONE OF THOSE NECESSARILY BEING RELATED TO THIS BUSINESS IN ITSELF.

THE POLICE ALWAYS USE THE ADDRESS THEY'RE IN FRONT OF WHEN THEY'RE WRITING A TICKET OR DOING ANY KIND OF INTERACTION, THEY USE THE ADDRESS IN FRONT OF THE BUSINESS OR HOME THAT THEY'RE IN FRONT OF.

SO I AGREE IN GENERAL TO THE APPROVAL OF THIS.

I DO ENCOURAGE ALSO THAT YOU TAKE A LOOK AT THE NOISE ISSUES VERY CLOSELY MOVING FORWARD WITH THIS PARTICULAR SITUATION.

THANK YOU. THANK YOU.

AND COMMISSIONER OTT? I TOO AM, GENERALLY, IN SUPPORT OF THIS.

IT'S NOT OFTEN THAT WE--.

THE RECEPTION FACILITIES HAVING THIS TIED TO THE BUSINESS NOW AND ALSO WE HAVE A REALLY GOOD CODE COMPLIANCE DEPARTMENT THAT IF THERE IS SOMETHING THAT IS AN ISSUE THERE IS A REMEDY AND THEY CAN ALSO LOSE THIS SUP IF THEY ARE VIOLATING THE TERMS. SO THAT'S SOMETHING THAT I WOULD BE IN FAVOR OF PASSING THIS.

ANY OTHER COMMENTS? ALL RIGHT. DO I HEAR A MOTION? MR. CHAIRMAN? COMMISSIONER JENKINS.

MAKE A MOTION TO APPROVE AS PRESENTED.

SECOND. OK, A MOTION BY COMMISSIONER JENKINS.

THE FIRST SECOND WAS BY COMMISSIONER PARIS [LAUGHTER].

THIS EAR IS WORKING A LITTLE BETTER THEN.

[LAUGHTER] I WAS ACTUALLY CENTERED, SO I COULD HEAR BOTH SIDES.

ALL RIGHT. AND THAT WOULD INCLUDE THE RENEWAL OF THE SUP AND THE PLAN, SO.

ALL RIGHT, WE HAVE A MOTION TO APPROVE.

PLEASE VOTE.

AND THAT IS UNANIMOUS.

WELL, GOOD LUCK WITH THE NEXT 15 YEARS, SIR.

THAT WAS THE LAST ITEM ON OUR AGENDA.

SO UNTIL OUR MEETING OF APRIL 11TH, WE ARE ADJOURNED.

THANK YOU.
