WELL, GOOD EVENING AND WELCOME TO THE APRIL NINE, 2022 REGULAR MEETING OF THE GARLAND CITY

[Call to Order]

COUNCIL. I AM VERY HAPPY.

I'M GOING TO STOP FOR JUST A SECOND AND SAY IT IS VERY RARE, ALMOST EXCEPTIONALLY RARE THAT WE HAVE THIS MANY PEOPLE IN ATTENDANCE AT A COUNCIL MEETING.

IT IS VERY NICE TO SEE ALL OF YOUR FACES THIS EVENING.

AND IT IS THE CUSTOM AND TRADITION OF THIS COUNCIL TO HAVE AN INVOCATION AND RECITAL OF THE PLEDGE OF ALLEGIANCE PRIOR TO OUR MEETING, LED BY ONE OF OUR COUNCIL MEMBERS.

YOU ARE NOT REQUIRED TO PARTICIPATE AND YOUR CHOICE WILL NOT AFFECT OUR DECISIONS HERE THIS EVENING AND TONIGHT WE WILL BE LED BY MAYOR PRO TEM HEDRICK FROM DISTRICT SEVEN.

THANK YOU, MR. MAYOR. IF YOU JOIN ME IN PRAYER.

GOD OF PEACE AND JUSTICE, WE PRAY FOR THE PEOPLE OF THE WORLD TODAY.

WE PRAY FOR PEACE AND THE LAYING DOWN OF WEAPONS.

WE PRAY FOR ALL THOSE WHO FEAR FOR TOMORROW THAT YOUR SPIRIT OF COMFORT WOULD DRAW NEAR TO THEM. WE PRAY FOR THOSE WITH POWER OVER WAR OR PEACE, FOR WISDOM, DISCERNMENT AND COMPASSION TO GUIDE THEIR DECISIONS.

ABOVE ALL, WE PRAY THAT ALL OF YOUR PRECIOUS CHILDREN AT RISK AND IN FEAR THAT YOU WOULD HOLD AND PROTECT THEM.

WE PRAY THAT YOU PROTECT OUR FIRST RESPONDERS, POLICE, FIRE, MEDICAL PERSONNEL AND OUR MILITARY, AND THAT YOU CONTINUE TO BLESS OUR NATION, STATE AND CITY.

WE PRAY THIS IN THE NAME OF JESUS, THE PRINCE OF PEACE.

AMEN. AMEN.

I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL.

[Mayoral Proclamations, Recognitions And Announcements ]

I'D LIKE TO SAY GOOD EVENING, EVERYONE.

WE HAVE QUITE A FEW AWARDS AND ACKNOWLEDGMENTS AND THINGS TO DO TONIGHT.

BUT IF YOU'RE NOT AWARE, AT OUR FIRST MEETING OF EVERY MONTH, WE HAVE PET OF THE MONTH AND AMY BRINGS A DOG THAT SOMETIMES END UP AT MY HOUSE AND SHE'S GOT ME TWICE ALREADY WITH THESE.

AND I THINK SHE KNOWS THE SIZE OF DOGS THAT I LIKE.

AND I THINK SHE'S WELL ON HER WAY TO ANOTHER ONE.

SO WHAT? WHO IS WITH YOU TONIGHT? SO I BROUGHT [INAUDIBLE] WITH ME TONIGHT.

HE'S A BOY THAT IS THE GOODEST OF ALL BOYS.

HE HAS A SWEATER THAT SAYS VOTED MOST HANDSOME.

CLEARLY. [LAUGHTER] AND HE'S LOOKING FOR HIS FOREVER HOME AT THE ANIMAL SHELTER.

AND HE WANTS TO REMIND EVERYBODY THAT THE BUSIEST SEASON IS COMING SOON.

AND SO WE PROVIDE LOTS OF SPONSORSHIP OPPORTUNITIES TO FIND YOUR FOREVER HOME.

IF YOU'RE A FIREFIGHTER, POLICE OFFICER, VETERAN, CITY OF GARLAND EMPLOYEE, GISD TEACHER, HMM, YOUR BIRTHDAY.

IF YOU'RE A SENIOR CITIZEN, ALL THESE THINGS ARE WAYS YOU CAN SPONSOR A DOG AND TAKE HOME A BOY LIKE VALOR.

ABSOLUTELY. I THINK THAT PRETTY MUCH COVERS EVERYBODY IN THE ROOM.

[LAUGHTER] YEAH. AND IF YOU HAVEN'T HAD THE OPPORTUNITY TO VISIT OUR NEW ANIMAL SHELTER, I WOULD CERTAINLY ENCOURAGE YOU TO DO SO.

IT IS FANTASTIC.

AND OUR ANIMAL SERVICE STAFF IS DOING A TERRIFIC JOB OUT THERE.

ALL RIGHT. ALL RIGHT. THANK YOU, EVERYBODY.

HOPEFULLY YOU WON'T BE THERE LONG.

OH, HE WON'T. [LAUGHTER] ALL RIGHT.

FIRST OR NEXT, YOU KNOW, AND EVERYBODY ALWAYS HAS TO FOLLOW THE PET OF THE MONTH.

IT'S A TOUGH ACT TO FOLLOW.

I UNDERSTAND IT HAPPENS TO ME.

BUT NEXT UP, WE HAVE OUR LIBRARIES.

AND I KNOW THERE'S A LARGE I THINK ALL OF THE LIBRARY STAFF IS HERE.

SO IF YOU'RE TRYING TO CHECK OUT A BOOK RIGHT NOW, WE APOLOGIZE.

WELL, THE TEXAS MUNICIPAL LIBRARY DIRECTORS ASSOCIATION 2021 ACHIEVEMENT OF EXCELLENCE IN LIBRARIES AWARD IS WHY WE ARE HERE.

AND GARLAND LIBRARIES WERE IN THE TOP 105 OF PUBLIC LIBRARIES IN THE STATE.

AND DOROTHY, ALL RIGHT, Y'ALL ARE ALL GOING TO COME ON.

DOROTHY.

DORTHY. COME ON AROUND.

ALL RIGHT. BUT KAREN, IF YOU WOULD LIKE TO COME FORWARD AND WE HAVE THIS FOR YOU, THE

[00:05:06]

2021 ACHIEVEMENT OF EXCELLENCE IN LIBRARIES AWARD.

IF YOU CAN TELL US ABOUT IT? SURE. WELL, ONE I WOULD LIKE TO TO THANK THE MAYOR, COUNCIL, CITY ADMINISTRATION AND OUR LIBRARY BOARD THAT'S HERE THAT WITHOUT YOUR SUPPORT, WE WOULD NEVER BE ABLE TO DO ALL OF THE AMAZING THINGS THAT WE'RE ABLE TO DO AT THE LIBRARY.

BUT MOST ARE, I THINK, FIRST AND FOREMOST, THIS IS A TESTAMENT TO ALL OF THE AMAZING HARD WORK AND CREATIVITY THAT ALL OF OUR LIBRARY STAFF WHO PART ARE HERE TONIGHT, WE'RE ACTUALLY ALL FOUR LIBRARIES ARE OPEN TONIGHT.

[LAUGHTER] THERE ARE PEOPLE MINDING THE STORE, BUT THEY ARE A CREATIVE, ENERGETIC AND AMAZING BUNCH OF PEOPLE WHO ARE ABLE TO BRING SOMETIMES CRITICAL EDUCATIONAL AND ALWAYS FUN SERVICES AND PROGRAMS TO OUR COMMUNITY.

SO WE THANK YOU VERY MUCH.

AND WE THANK YOU. THANK YOU ALL.

THANK YOU. AND I DON'T KNOW, ARE YOU GOOD WITH PICTURES OR I'LL COME UP HERE.

ALL RIGHT. THANK YOU.

THANK YOU. THANK YOU. [APPLAUSE] DOES IT ROTATE? ALL RIGHT. VERY GOOD.

AND NEXT, WE HAVE I'LL LET EVERYBODY CLEAR.

NEXT, WE HAVE THE COMMUNITY DEVELOPMENT DEPARTMENT AWARD, MONA.

MONA AND TEAM CREW.

ON FEBRUARY 4TH, 2022 THE CITY OF GARLAND'S COMMUNITY DEVELOPMENT DEPARTMENT RECEIVED A CERTIFICATE OF DISTINCTION AWARD FROM THE NATIONAL COMMUNITY DEVELOPMENT ASSOCIATION FOR OUR VETERANS DAY HOME DEDICATION PROJECT THAT WAS COMPLETED IN NOVEMBER OF 2021.

THE VETERANS DAY HOME DEDICATION PROJECT UTILIZED HOME INFILL GRANT FUNDING TO PURCHASE, AND RENOVATE A HOME PROVIDED FOR A HOMELESS, LOW INCOME VETERAN WITH NO MORTGAGE, NO MORTGAGE.

IT WAS A FANTASTIC EVENT AND CERTAINLY WORTHY OF AN AWARD.

MONA. IF YOU WANT TO TAKE A PICTURE AND THEN YOU CAN EXPLAIN TO US WHAT IT IS.

THANK YOU, MAYOR. FIRST OFF, I WANT TO JUST ECHO WHAT KAREN SAID AND THANK THE CITY COUNCIL AND CITY ADMINISTRATION AND EVERYONE FOR GIVING OUR DEPARTMENT THE OPPORTUNITY TO SERVE PEOPLE IN OUR COMMUNITY.

WE FEEL HONORED TO HELP EVERYONE AND THESE GRANT FUNDS ALLOW US TO DO THAT.

THE NATIONAL COMMUNITY DEVELOPMENT ASSOCIATION IS OUR NATIONAL ASSOCIATION THAT COVERS, THAT'S AN ADVOCACY FOR FEDERAL GRANT PROGRAMS. AND EVERY YEAR, TWICE A YEAR, THEY HAVE AN OPEN COMPETITION FOR DIFFERENT CITIES ON A NATIONAL LEVEL TO SUBMIT PROJECTS THAT THEY'VE DONE.

AND THEY'RE GRADED BASED ON THE AMOUNT OF GRANT FUNDS THAT ARE SPENT, HOW THE GRANT FUNDS THAT ARE SPENT, AND HOW THE IMPACT ON THE COMMUNITY WAS PERCEIVED.

SO THIS YEAR, GARLAND WON IT FOR THE VETERANS DAY EVENT.

WE PURCHASED A HOME, WE REDID THE HOME, AND THEN WE WERE ABLE TO PROVIDE A VETERAN WHO IS GRADUATED FROM THE POLICE ACADEMY IS GOING TO BE A PUBLIC SERVANT, A HOME MORTGAGE FREE, SO SHE CAN HAVE A HAND UP AND BE A GREAT MEMBER OF GARLAND.

AND SHE IS SO EXCITED AND SO THANKFUL TO EVERYBODY FOR IT.

I WANT TO THANK MY TEAM BECAUSE WITHOUT MY TEAM, NONE OF THIS WOULD BE POSSIBLE.

EVERYONE HERE IS AN IMPORTANT PART TO HELP ALL THESE PROJECTS GO THROUGH, AND THIS IS JUST ONE OF MANY THAT WE HOPE TO DO IN THE FUTURE.

SO THANK YOU, EVERYBODY.

THANK YOU. [APPLAUSE] AND YOU KNOW THAT THAT REALLY WAS A FANTASTIC I MEAN THAT THIS THING WE DID WON AN AWARD IS VERY REWARDING TO US AND REASSURING.

BUT I WILL TELL YOU, WHEN WE HANDED HER THE KEYS TO THAT HOUSE, THE SMILE ON HER FACE WAS BETTER THAN ANY AWARD THAT YOU'LL EVER SEE.

SO IT WAS FANTASTIC.

SO THANK YOU. AND LAST BUT CERTAINLY NOT LEAST.

FIRE DEPARTMENT FIRE SERVICE CHIEF LEE AND ALL.

[00:10:02]

TONIGHT WE HAVE THREE OF OUR FIREFIGHTERS WITH US.

THIS IS IN RECOGNITION OF THEIR EFFORTS AND EXCELLENCE AND BRAVERY SHOWN AT A STRUCTURE FIRE ON FEBRUARY 15, 2021.

NOW, I SHOULD PREFACE THAT WITH, IF YOU ALL REMEMBER, FEBRUARY 15, 2021, THERE WAS A LOT GOING ON. WE WE WERE IN THE MIDDLE OF A MAJOR ICE STORM, POWER OUTAGES.

THERE WAS A LOT HAPPENING.

WHEN THE CREW RISKED THEIR OWN SAFETY TO RESCUE A VICTIM TRAPPED IN A HOUSE THAT WAS ON FIRE. THE MERITORIOUS CONDUCT COMMITTEE OF THE GARLAND FIRE DEPARTMENT HONORED THE AWARDS OF THEIR OUTSTANDING AND HEROIC CONDUCT THIS LAST DECEMBER 2021.

AND I WILL LET CHIEF LEE TAKE IT FROM HERE.

A LITTLE BACKGROUND FOR YOU ON THIS EVENT.

THERE WERE THIS WAS THE SECOND HOUSE FIRE OF THE NIGHT.

CREWS WERE EXTREMELY BUSY, 24TH CALL OF THE SHIFT, SOMETHING LIKE THAT.

THE CREW HAD BEEN GOING ALL DAY LONG, NONSTOP, AS ALL OF OUR CREWS DID.

THEIR FIRST ALARM DISTRICT WHERE THEY WERE, THE FIRST FIRE TRUCKS TO ARRIVE.

THEY ARRIVED TO A HOUSE WITH FIRE BLOWING THROUGH THE ROOF AND THEY WERE NOTIFIED THAT THERE WAS A VICTIM INSIDE.

NORMALLY A HOUSE WITH THE FIRE THROUGH THE ROOF YOU'RE GOING TO GRAB A HOSE LINE AND START FIGHTING FIRE. WITH A KNOWN VICTIM THE CAPTAIN MADE THE DECISION WE'RE GOING ON THE RESCUE MISSION. INSTEAD, THEY ENTERED THE STRUCTURE.

THEY FOUND THEIR VICTIM.

THE VICTIM WAS IN A HOSPITAL BED AND THEY NEEDED ADDITIONAL ASSISTANCE TRYING TO GET THE VICTIM OUT. THE DRIVER TOOK THE ASSIGNMENT, MADE ENTRY WITH THE CAPTAIN AND THIS FIREFIGHTER, AND THEY EXECUTED THAT RESCUE.

NOW, NORMALLY WE WOULD NOW GRAB A HOSE LINE AND START FIGHTING FIRE.

IN THIS EVENT, THE VICTIM SAID, THERE'S SOMEBODY ELSE IN THE HOUSE.

I NEED YOU TO GO GET THEM TOO.

SO THEY BAILED BACK OFF INTO THE HOUSE WITHOUT THE PROTECTION OF A HOSE LINE WITH A WELL INVOLVED ATTIC FIRE BLOWING THROUGH THE ROOF, FIRE DROPPING DOWN IN THE KITCHEN AND THE LIVING ROOM AREA TO COMPLETE THE THE INITIAL SEARCH.

THEY DID NOT FIND ANOTHER VICTIM, BUT THEIR HEROIC ACTIONS RESULTED IN ONE LIVE SAVED AND IT'S WORTHY TO BE RECOGNIZED.

SO IN THE FIRE SERVICE, THERE'S SEVERAL AWARDS.

ONE OF THE HIGHEST IS THE FIRE SERVICE COMMENDATION AWARD.

AND WE'RE HAPPY TONIGHT TO PRESENT TO CAPTAIN MICHAEL ARRIAGA, HIS DRIVER, BRANDON ETHRIDGE, AND HIS FIREFIGHTER KRISTEN BREAUX WITH THAT BAR.

CAPTAIN. THANK YOU, SIR.

BRANDON. THANK YOU. KRISTEN.

THANK YOU. IN HONOR OF THEIR EXTRAORDINARY BRAVERY AND ACTIONS ON THE NIGHT OF FEBRUARY 15TH, 2021.

SO CONGRATULATIONS.

THANK YOU.

[APPLAUSE] GOOD JOB [INAUDIBLE] ONE ADDED TOUCH AND THEY POINTED THIS OUT TO ME A WHILE AGO. KRISTEN WAS CONSIDERED A ROOKIE FIREFIGHTER AT THAT POINT IN TIME.

SO THAT KIND OF ACTION AS A ROOKIE, HER CAREER IS OVER.

SHE'S DONE. CONGRATULATIONS.

THANK YOU. THANK YOU. THANK YOU.

THANK YOU. AND JUST TO I WILL TELL YOU, AT THIS POINT IN MY LIFE IN CITY SERVICE, I HAVE MET A LOT OF FIREFIGHTERS, I'VE MET A LOT OF POLICE OFFICERS.

AND I WILL TELL YOU, YOU KNOW, THEY WILL TELL YOU THEY WERE JUST DOING THEIR JOB.

THEY WERE DOING WHAT THEY WERE TRAINED TO DO, WHICH IS EXACTLY RIGHT.

THEY ARE DOING THEIR JOB.

BUT THE FACT IS THEY STEP UP AND THEY DO THAT JOB.

THERE'S A BIG DIFFERENCE BETWEEN BEING TRAINED FOR SOMETHING AND BEING WILLING TO DO SOMETHING. AND AND YOU HAVE PROVEN THAT.

SO THANK YOU VERY MUCH.

NOW GO BACK TO WORK.

[APPLAUSE] ALL RIGHT. I FEEL LIKE WE'VE ALREADY HAD A MEETING WITH ALL OF THAT GOING ON.

WE WILL AT THIS POINT GET INTO OUR AGENDA.

[00:15:05]

THE FIRST ITEM ON OUR AGENDA THIS EVENING IS THE CONSENT AGENDA.

[Consent Agenda]

AND THE LAST ITEM, ITEM 6, CONSIDER APPROVING THE FRIENDSHIP PARK LEASE AGREEMENT.

THAT IS THE CONSENT AGENDA.

DO WE HAVE ANY ONE WHO WOULD LIKE TO HAVE AN ITEM PULLED AND CONSIDERED SEPARATELY? SEEING NONE.

MAYOR PRO TEM HEDRICK.

THANK YOU, MR. MAYOR. I'D LIKE TO MOVE TO APPROVE THE CONSENT AGENDA.

I HAVE A MOTION BY MAYOR PRO TEM HEDRICK TO APPROVE THE CONSENT AGENDA AS PRESENTED. AND A SECOND BY COUNCILMEMBER MOORE.

ANY FURTHER DISCUSSION? COUNCIL. PLEASE VOTE.

I'M SORRY, MADAM SECRETARY, IF YOU CAN PREPARE THE VOTE FOR US.

[00:20:04]

YOU KNOW, THERE'S SO MANY STEPS IN THERE SOME NIGHTS.

AND COUNCILMEMBER BASS.

YEAH. I'D LOVE TO VOTE.

OKAY. ALL RIGHT.

MADAM SECRETARY, IF YOU COULD DISPLAY THE VOTE FOR US.

AND COUNCILMEMBER BASS.

ALL RIGHT. HE IS SIGNALING IN THE AFFIRMATIVE.

SO THAT ITEM IS APPROVED UNANIMOUSLY.

AND THAT WILL BRING US TO ITEMS FOR INDIVIDUAL CONSIDERATION.

MADAM SECRETARY, IF YOU COULD COVER THE SPEAKER GUIDELINES FOR US.

YES, SIR. THE OPPORTUNITY TO SPEAK IS GIVEN TO PROVIDE TESTIMONY RATHER THAN TO QUESTION THE CITY COUNCIL OR STAFF.

THE CHAIR MAY CALL A SPEAKER OUT OF ORDER IF THE SPEAKER PRESENTS QUESTIONS OR REQUESTS FOR INFORMATION THAT WILL UNDULY DELAY THE TRANSACTION OF BUSINESS AT THE MEETING.

SPEAKERS APPEARING IN THIS CHAMBER WILL SPEAK FIRST.

I'M SORRY. SPEAKERS SHALL BE ALLOWED TO SPEAK ON A FIRST COME FIRST TO SPEAK BASIS AS DETERMINED BY THE ORDER IN WHICH THE CITY SECRETARY RECEIVES THE SPEAKER'S INFORMATION.

APPLICANTS ARE ALLOWED 10 MINUTES FOR PRESENTATIONS, AND ALL OTHER SPEAKERS WILL BE ALLOWED 3 MINUTES TO SPEAK.

WHEN THE PODIUM BUZZER SOUNDS, THE SPEAKER MUST END THEIR COMMENTS AND THE CLERK WILL MAKE THEM AWARE THAT THEIR TIME HAS ELAPSED.

THANK YOU. AND I BELIEVE WE HAVE LOTS OF SPEAKERS THIS EVENING.

AM I CORRECT? WE DO, MAYOR LEMAY, OUR FIRST SPEAKERS IS FOR ITEM 7A, B AND C . OK. AND IT'S MR. HAMEED AND MR. DANN, HIS ATTORNEY.

OKAY. VERY GOOD.

AND JUST A QUICK NOTE TONIGHT, WE WILL, THE APPLICANT FOR ITEM 7K AND 7L HAS REQUESTED A POSTPONEMENT. SO WE WILL NOT BE HEARING THAT ITEM TONIGHT.

SO FIRST UP, UNDER ITEM 7 IS ITEM 7A RECONSIDERATION REQUEST OF A PREVIOUSLY DENIED

[7A. Reconsideration Request of a Previously Denied Zoning Application (File No. Z 21-39, District 6)]

ZONING APPLICATION? THIS WAS FILE NUMBER Z 21-39 IN DISTRICT 6.

MR. GUERIN. YES.

THANK YOU, MAYOR. GOOD EVENING, COUNCIL.

THIS IS A RECONSIDERATION OF CASE Z 21-39 BY MR. ALAN HAMEED.

AS A BRIEF REMINDER, THIS CASE WAS DENIED BY THE COUNCIL WITH A 6 TO 3 VOTE ON MARCH 1ST DURING YOUR REGULAR MEETING ON MARCH 1ST.

SO THE APPLICANT IS REQUESTING RECONSIDERATION OF THE CASE.

THAT IS THE FIRST ITEM AGENDA ON YOUR AGENDA.

THERE IS A LETTER FROM MR. HAMEED IN YOUR AGENDA PACKET FOR CONSIDERATION AND HE AND HIS COUNSEL ARE HERE THIS EVENING AS WELL TO ANSWER ANY QUESTIONS AND TO SPEAK, OF COURSE.

JUST AS A COUPLE OF ITEMS OF NOTE.

A MOTION TO GRANT RECONSIDERATION, THIS IS PER THE GDC MAY ONLY BE MADE BY A MEMBER OF THE COUNCIL WHO VOTED TO DENY THE INITIAL APPLICATION.

HOWEVER, A MOTION TO GRANT RECONSIDERATION MAY BE SECONDED BY ANY MEMBER OF THE COUNCIL, AND A MOTION TO GRANT RECONSIDERATION MUST BE APPROVED BY NO LESS THAN THREE FOURTHS OF THE MEMBERS OF THE COUNCIL PRESENT AND VOTING, BUT NOT LESS THAN FIVE.

AND IF COUNCIL GRANTS THE RECONSIDERATION, OF COURSE, THE ZONING ITEM IS ON THE AGENDA AS WELL AND WE HAVE RE-ADVERTISED FOR THE PUBLIC HEARING ACCORDINGLY.

SO THANK YOU, MAYOR. VERY GOOD.

SO AT THIS POINT, COUNCIL, THERE ARE SEVERAL THERE ARE SOME ITEMS AFTER THIS THAT OBVIOUSLY DEAL WITH THIS PROPERTY OR THIS CASE.

BUT THE FIRST STEP UNDER 7A IS THE RECONSIDERATION REQUEST.

AS MR. GUERIN SAID, THAT WOULD BE SOMEONE ON THE PREVAILING SIDE HAS TO MAKE THAT MOTION FOR WHEN THAT SO THAT WOULD BE ANYONE BUT MYSELF.

COUNCILMEMBER AUBIN AND COUNCIL MEMBER SMITH, I BELIEVE WAS THE HOW THE VOTES AND I HAVE SEVERAL PEOPLE QUEUING UP DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MAYOR. MAYOR I MOVE FOR APPROVAL OF THE REQUEST FOR RECONSIDERATION ON THIS ACTION. OK I'VE GOT SEVERAL FOLKS IN THE QUEUE.

WAS THAT WHERE YOU WERE HEADED? OK.

I HAVE A MOTION BY DEPUTY MAYOR PRO TEM WILLIAMS AND A SECOND BY COUNCILMEMBER AUBIN TO APPROVE THE REQUEST FOR RECONSIDERATION.

ANY FURTHER DISCUSSION? MADAM SECRETARY, IF YOU CAN PREPARE THE VOTE FOR US, PLEASE.

AND COUNCIL. ALL RIGHT.

IT'S NOT WORKING. STEP TWO, THE MOTION IS TO APPROVE.

[00:25:02]

IF I COULD HAVE A SHOW OF HANDS AND LET THE RECORD SHOW THAT IS UNANIMOUS.

THE MOTION CARRIES FOR RECONSIDERATION.

THAT BRINGS US TO ITEM 7B AND 7C.

[Items 7B & 7C]

7B IS CONSIDER A ZONING REQUEST BY ALAN HAMEED TO ALLOW AUTOMOBILE SALES.

THIS PROPERTY IS LOCATED AT 3218 FOREST LANE IN DISTRICT 6.

IT HAS A SECOND PART, WHICH IS TO CONSIDER A DETAILED PLAN, SAME APPLICANT, SAME ADDRESS.

MR. GUERIN.

YES MAYOR, I HAVE THE STAFF PRESENTATION, ESSENTIALLY THE SAME ONE A LITTLE BIT ABBREVIATED, BUT IF YOU'D LIKE ME TO RUN THROUGH THE PRESENTATION AGAIN, I CAN.

IT'S YOU KNOW, I THINK WE'RE ALL PROBABLY PRETTY CLEAR ON THE CASE AT THIS POINT FROM IT WAS RECENT ENOUGH TO WHERE I THINK IT'S PROBABLY HELD IN OUR MEMORIES FOR THIS POINT.

THIS THING ISN'T WORKING WELL, WE'RE ALL YEAH, WE'RE HAVING SOME TECHNICAL DIFFICULTIES.

THAT'S WHAT'S CAUSING EVERYTHING.

THESE HAVE BEEN ON THAT'S WHY THE VOTING HASN'T BEEN WORKING.

ALL RIGHT. HOW MUCH TIME ARE WE TALKING HERE? 30 SECONDS. OKAY.

IT'S KIND OF LIKE A NASCAR PIT CREW.

THEY'VE BEEN ON BACKORDER FOR A YEAR NOW.

SORRY, FOLKS. JUST 1 SECOND.

NOW. PREVIOUSLY, IT WASN'T JUST COUNCILMEMBER BASS THAT DIDN'T HAVE A VOTE.

YEAH BUT THEN THEY ALL LOCKED UP.

IT STARTS OUT MIC].

THERE.

YES. ALL RIGHT.

COUNCILMEMBER VERA.

THANK YOU, MAYOR. NO.

DAN? I WANT TO MAKE [INAUDIBLE].

HANG ON. ALL RIGHT.

GO AHEAD. I THINK YOU'RE MIC'S ON.

HELLO. YEAH. GO AHEAD.

I WANT TO MAKE A MOTION TO APPROVE THIS REQUEST.

AND WOULD THAT BE FOR ITEM 7B AND C, ITEM B AND C WITH A FIVE YEAR SUP? OK.

I HAVE A MOTION BY COUNCIL MEMBER VERA TO APPROVE ITEMS B AND C UNDER A FIVE YEAR SUP.

AND A SECOND BY COUNCIL MEMBER SMITH.

ANY FURTHER DISCUSSION? I'VE GOT.

MAYOR. I'M SORRY.

I RECOMMEND THAT WE GIVE THE APPLICANT A CHANCE TO BE HEARD BEFORE.

OKAY. [INAUDIBLE] VOTE ON THIS.

OKAY. ALL RIGHT.

MADAM SECRETARY, IF YOU COULD CALL THE SPEAKER, PLEASE.

MR. HAMEED AND MR. DAN, HIS ATTORNEY.

AND WHEN YOU COME FORWARD, IF YOU COULD GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE. YES.

I MUST HAVE USED THE DEVICE A LITTLE BIT WRONG.

MY NAME IS TAILIM SONG.

ARE YOU WHY ALL THIS ISN'T WORKING? THAT'S ALL MY FAULT, MAYOR YOUR HONOR.

YES. SORRY.

MY ADDRESS IS 8111 LBJ FREEWAY, SUITE 480, DALLAS, TEXAS, 75251.

AND I'M HERE ON BEHALF OF THE APPLICANT, ALAN HAMEED.

HE'S HERE, TOO, IF THE COUNCIL HAS ANY QUESTIONS.

BUT I'LL TRY TO BE AS ABBREVIATED AS THE SPEAKER BEFORE ME.

WE REALLY WANT TO THANK YOU FOR THE VOTE FOR RECONSIDERATION.

MR. HAMEED WILL BE A GOOD CITIZEN AND A GOOD NEIGHBOR.

WE UNDERSTAND THE USES FOR THIS AREA AND HE REALLY WANTS TO ATTEMPT TO DO THAT WHILE HE

[00:30:06]

IS RECEIVING HIS SUP HOPEFULLY HE IS ALSO WANTING THE COUNCIL TO KNOW THAT HE'S GOING TO SEEK TO ACQUIRE ADDITIONAL LAND SO THAT HE CAN TRY TO REPURPOSE HIS BUSINESS, HOPEFULLY AS A RESTAURANT, TO KIND OF FIT WITH WHAT THE COUNCIL WANTS FOR THE FUTURE USES FOR THIS AREA. HE'S ALREADY REACHED OUT TO DART.

UNFORTUNATELY, HE'S ON THE CORNER AND UNFORTUNATELY HIS LOT IS TOO SMALL TO OPERATE AS A RESTAURANT AT THE PRESENT TIME.

AND WE PROBABLY DIDN'T DO THE BEST JOB AT THE LAST HEARING WITH RESPECT TO THE STATEMENT THAT THIS IS THE HIGHEST AND BEST USE FOR THIS LAND THE LIGHT REPAIR AND USED CAR BUSINESS. HE OPERATED THERE PREVIOUSLY AND PREVIOUSLY HE BUILT A FREESTANDING BUILDING, SO HE EXPENDED QUITE A BIT OF MONEY PRIOR TO FINDING OUT HE NEEDED TO GET HIS SUP AGAIN.

AND WE'D RESPECTFULLY REQUEST IF THE COUNCIL COULD CONSIDER IT TO DOING A TEN YEAR SUP SO THAT HE COULD HELP REPAY THE CONSTRUCTION COSTS FOR BUILDING THIS FREESTANDING BUILDING, AND ALSO IN AN EFFORT TO RAISE CAPITAL SO THAT HE COULD REPURPOSE THE LAND AND BUILD A SECOND BUILDING AND HAVE MORE PARKING SO THAT HE CAN HAVE A RESTAURANT.

AND WITH THAT, IF THE COUNCIL HAS ANY QUESTIONS, I'M HAPPY TO RESPOND.

AND AGAIN, I WANT TO THANK THE ENTIRE CITY COUNCIL, THE CITY MANAGER, THE CITY ATTORNEY, AND THE CITY SECRETARY.

THANK YOU, SIR. ANY QUESTIONS FOR THE APPLICANT? COUNCILMEMBER BASS.

THANK YOU, MAYOR. ACTUALLY, THIS QUESTION IS PROBABLY FOR WILL.

WILL WHAT WAS THE STAFF AND PLANNING COMMISSION RECOMMENDATION ON THE TIME PERIOD ON THE SUP? YES, SIR.

THE STAFF'S RECOMMENDATION WAS DENIAL THAT WAS KIND OF BASED ON THE FUTURE LAND USE MAP, TRANSIT ORIENTED DEVELOPMENT, EXCUSE ME, AND THE PLANNING COMMISSION RECOMMENDED APPROVAL WITH A FIVE YEAR SUP.

OKAY. THANK YOU. SURE.

ANY ADDITIONAL QUESTIONS? I HAVE NO ONE IN THE QUEUE.

SO WE'LL BACKTRACK A SECOND.

COUNCIL. WE HAVE A MOTION ON THE FLOOR FROM COUNCILMAN VERA, SECOND FROM COUNCILMEMBER SMITH TO APPROVE ITEMS B AND C UNDER A FIVE YEAR SUP AS RECOMMENDED BY THE PLANNING COMMISSION. ANY FURTHER DISCUSSION? MADAM SECRETARY, LET'S CROSS OUR FINGERS AND HOPE FOR A VOTE HERE.

COUNCIL. NOT TONIGHT.

TONIGHT IS NOT THAT NIGHT.

ALL RIGHT.

THE MOTION IS TO APPROVE.

ALL IN FAVOR.

LET THE RECORD SHOW THAT THAT IS UNANIMOUS.

THANK YOU, MR. HAMEED. THE NEXT ITEM IS ITEM 7D.

[Items 7D & 7E]

THIS ALSO HAS TWO PARTS.

7D IS CONSIDER A ZONING REQUEST BY OM ESTATES DEVELOPMENT TO ALLOW CONSTRUCTION OF 300 MULTI-FAMILY UNITS, 58 TOWN HOMES AND RETAIL USE.

THIS SITE IS LOCATED AT 240 AND 250 EAST INTERSTATE 30 FREEWAY IN DISTRICT THREE.

IT ALSO HAS A SECOND PART, WHICH IS TO CONSIDER A DETAIL PLAN, SAME APPLICANT, SAME ADDRESS. MR. GUERIN. MAYOR AND COUNCIL.

THANK YOU. THIS IS A PROPOSAL FOR A MIXED USE DEVELOPMENT CONSISTING OF 300 MULTI-FAMILY UNITS, 58 TOWNHOMES AND GROUND FLOOR RETAIL USE.

THE LOCATION IS ALONG I-30 NEAR OAKS TRAIL.

THE APPLICANT AND OWNER IS OM ESTATE DEVELOPMENT.

THE ACREAGE OF THE SITE IS JUST OVER 20 ACRES AND THE CURRENT ZONING DESIGNATION.

THERE'S TWO ZONING DESIGNATIONS ON THE PROPERTY.

ONE IS COMMUNITY OFFICE AND THE OTHER IS AGRICULTURAL DISTRICT.

HERE'S THE GENERAL LOCATION OF THE SUBJECT PROPERTY IN SOUTH GARLAND ALONG I-30.

AND SUBJECT PROPERTY IS OUTLINED HERE IN THIS TEAL COLOR.

AS I MENTIONED EARLIER, THE PROPERTY IS REALLY HAS TWO ZONING DISTRICTS ON IT, COMMUNITY OFFICE AND AGRICULTURAL.

YOU CAN SEE SOME OTHER OFFICE ZONING IN THE AREA WITH THIS KIND OF PINK VIOLET COLOR AND SOME OFFICE USES AS WELL AS A CHURCH TO THE WEST.

THERE'S MULTI-FAMILY TO THE NORTH ACROSS I-30 AND SOME SINGLE FAMILY DEVELOPMENT TO THE SOUTH AND A HORSE RIDING FACILITY TO THE EAST.

THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS BUSINESS CENTERS, WHICH PRIMARILY POINTS TO EMPLOYMENT AND OFFICE TYPE USES.

SO WHILE THIS PARTICULAR PROPOSAL DOESN'T QUITE ALIGN WITH THE BUSINESS DESIGNATION, IT DOES CONTRIBUTE TO THE I-30 CORRIDOR AND IS A SUPPORTIVE USE AS WELL.

[00:35:05]

HERE'S SOME PHOTOS OF THE AREA, INCLUDING THE SUBJECT PROPERTY ON THE TOP LEFT.

IT'S CURRENTLY VACANT.

THIS WOULD BE DEVELOPED IN PHASES, IN FIVE PHASES, TO BE SPECIFIC.

AND THERE'S A MAP. THE SITE PLAN INDICATES THE GEOGRAPHIC AREAS OF THE PHASES.

BUT JUST TO MENTION THE ALLOWANCE AS REQUESTED BY THE APPLICANT.

COMMERCIAL ALLOWANCE IS ON THE GROUND FLOOR RETAIL WHICH WOULD BE ON THE BUILDING CLOSEST TO INTERSTATE 30, THAT WOULD INCLUDE AND WOULD BE LIMITED TO THESE USES, GENERAL OFFICE, MEDICAL OFFICE, RETAIL, RESTAURANT WITH NO DRIVE THRU, FITNESS OR PERFORMING ARTS STUDIO AND PERSONAL SERVICES.

I'M SORRY, WILL. I'M GOING TO STOP YOU FOR A SECOND.

MITCH, CAN YOU PLEASE ASK COUNCILMAN VERA TO COME BACK IN? WE HAVE A CASE THAT WE ARE HEARING.

I WOULD APPRECIATE THAT VERY MUCH.

THANK YOU. I'M SORRY, WILL.

ALL RIGHT, PLEASE CONTINUE.

THANK YOU, MAYOR. I'LL JUMP TO THE NEXT SLIDE, WHICH MAY NOT BE REAL EASY ON THE EYES, BUT I'LL TRY TO HELP OUT HERE.

THERE'S A LOT GOING ON. THERE'S A LOT GOING ON.

IT'S A BUSY VERY BUSY SITE PLAN.

I'LL TRY TO WALK YOU THROUGH IT A LITTLE BIT.

SO PHASE ONE WOULD BE THIS IS I-30 JUST FOR A LITTLE ORIENTATION UP HERE, KIND OF ON THE TOP, KIND OF NORTHERNMOST SIDE OF THE PROPERTY.

THE PROPERTY WOULD BE ACCESSED FROM I-30 THROUGH PUBLIC STREET, WHICH THE APPLICANT WOULD BE BUILDING PUBLIC STREETS THROUGHOUT THE PROPERTY.

THE PROPERTY WOULD ALSO HAVE ACCESS THROUGH THE ADJACENT OFFICE DEVELOPMENT TO THE EAST, WHICH I BELIEVE THE APPLICANT AND OWNER OWNS THAT AS WELL.

BUT THE FIRST PHASE WOULD BE THE MULTIFAMILY BUILDINGS SHOWN HERE TO THE NORTH, CLOSEST TO I-30 THAT INCLUDES THE RESIDENTIAL OVER RETAIL BUILDING, THE GROUND FLOOR RESIDENTIAL OR EXCUSE ME, GROUND FLOOR RETAIL WOULD BE LOCATED HERE IF YOU CAN KIND OF SEE MY CURSOR AND THERE'S AN ADDITIONAL MULTI-FAMILY BUILDING AND A CLUBHOUSE.

SO THAT WOULD BE THE FIRST PHASE.

THE SECOND PHASE WOULD BE AN ADDITIONAL MULTI-FAMILY BUILDING TO THE SOUTH.

PHASE THREE WOULD BE DEVELOPING THE TOWNHOUSES DOWN HERE ALONG WITH AN AMENITY AREA AND THE TOWNHOUSES WOULD BE TRUE SFA SINGLE FAMILY ATTACHED TOWNHOUSES PER THE GDC, THEY'RE NOT MULTI-FAMILY UNITS IN A TOWNHOUSE STYLE.

THEY'RE ACTUAL PLATTED LOTS FOR SALE AND ALL THAT.

FOLLOWING THE GDC REGULATIONS FOR THAT.

PHASE FOUR WOULD BE AN ADDITIONAL MULTI-FAMILY BUILDING, AS WELL AS AN ADDITIONAL CLUBHOUSE AND AMENITY BUILDING OVER HERE.

AND THEN PHASE FIVE WOULD BE FINISHING OUT THE TOWNHOUSE DEVELOPMENT.

AND AGAIN, THE APPLICANT IS PROPOSING PUBLIC STREETS THROUGHOUT.

AND THE STREET STUB OUT HERE.

SO IT LENDS ITSELF TO A POTENTIAL FUTURE THOROUGHFARE CONNECTION TO THE EAST CONTINUING TO LYONS ROAD. SO MR. LUEDTKE AND I MAY BRING BACK A THOROUGHFARE PLAN AMENDMENT AT A FUTURE DATE.

ON THAT NOTE.

HERE'S THE LANDSCAPE PLAN.

IT DOES MEET ALL THE LANDSCAPE REGULATIONS OF THE GDC.

IT INCLUDES TREES ALONG THE PROPOSED PUBLIC STREETS, SIDEWALKS, TREES AND ANGLED PARKING ON STREET PARKING AS WELL.

HERE ARE SOME OF THE BUILDING ELEVATIONS.

THIS IS THE RESIDENTIAL OVER A GROUND FLOOR RETAIL BUILDING THAT I MENTIONED THAT WOULD BE CLOSEST TO INTERSTATE 30.

THIS IS A SAMPLE OF THE MULTIFAMILY BUILDINGS AND SOME OF THE CLUBHOUSE BUILDING ELEVATIONS AND THE TOWNHOUSES.

THIS IS THE FRONT ENTRY PRODUCT WHERE THE GARAGES WOULD BE FACING THE FRONT AND THEN THE APPLICANT WILL PROVIDE SOME REAR ENTRY TOWNHOUSES AS WELL, WHEREAS THE GARAGES WOULD BE SERVED FROM AN ALLEYWAY.

THE APPLICANT REQUEST A FEW DEVIATIONS FROM THE GDC IN ORDER TO MAKE THIS DEVELOPMENT FIT ON THE SITE. STAFF DID ENCOURAGE EARLY ON IN THIS PROCESS FOR THE APPLICANT TO EXPLORE OTHER MIXED USES.

IT ORIGINALLY WAS KIND OF COMING IN PRIMARILY AS MULTI-FAMILY.

WE ENCOURAGE THEM TO EXPLORE TALENT, INCORPORATING SOME TOWNHOUSES AS WELL, PUBLIC STREETS GET IT TO A LITTLE BIT MORE OF AN URBAN TYPE FASHION AND LAYOUT AND A TRUE MIXED

[00:40:03]

USE FASHION.

OF COURSE, THERE'S SIDEWALKS CONNECTING THROUGHOUT THE SITE PLAN, BUT THAT'S KIND OF THE IMPETUS FOR THESE DEVIATIONS.

BUT I'LL JUST KIND OF START FROM THE TOP.

THE APPLICANT IS MEETING THE COVERED PARKING REQUIREMENT OF THE GDC, BUT SOME OF THE CARPORTS, PARTICULARLY ON THE WEST SIDE OF THE DEVELOPMENT, WILL ENCROACH INTO THE SETBACK, BUT THAT IS TO ENSURE THAT THEY WOULD MEET THE COVERED PARKING REQUIREMENT OF THE GDC.

ANGLED PARKING THE RIGHT OF WAY THE APPLICANT DOES MEET THE ACTUALLY EXCEEDS THE PARKING NUMBERS PER THE GDC FOR THIS OVERALL DEVELOPMENT.

HOWEVER, THAT DOES INCLUDE COUNTING PARKING SPACES THAT THEY WOULD BE PROVIDING ON THE PROPOSED PUBLIC STREET.

SO ANGLED PARKING IN ORDER TO WHICH IS NOT UNCOMMON FOR KIND OF URBAN MORE URBAN STYLE MIXED USE DEVELOPMENTS TO HAVE KIND OF THAT ON STREET PARKING.

DENSITY FOR MULTI-FAMILY THE MAXIMUM PER THE GDC FOR JUST STRAIGHT MULTI-FAMILY DISTRICT IS 18 UNITS PER ACRE.

THE APPLICANT PROPOSES 26 UNITS PER ACRE AND AGAIN THEY WOULD BE INCORPORATING SOME PUBLIC STREETS AND ACHIEVING A MORE URBAN, WALKABLE STYLE OF DEVELOPMENT.

AND IT SHOULD BE NOTED THAT, OF COURSE, THE LESS DENSE TOWNHOUSE DEVELOPMENT IS LOCATED ON THE SOUTHERN SIDE OF THE PROPERTY, WHEREAS THE MORE DENSE MULTI-FAMILY IS CLOSER TO THE NORTHERN SIDE OF THE PROPERTY, AWAY FROM THE ADJACENT SINGLE FAMILY HOMES.

BUILDING HEIGHT, THE MAXIMUM BUILDING HEIGHT FOR JUST STRAIGHT MULTI-FAMILY IS 40 FEET, WHICH TYPICALLY ALIGNS WITH THREE STORY'S, 2 TO 3 STORY'S.

THE APPLICANT'S PROPOSAL IS 53 FEET, AND THAT PROPOSED HEIGHT WOULD ACCOMMODATE FOUR STORY'S.

LOT DEPTH FOR THE SINGLE FAMILY ATTACHED THAT'S THE TOWNHOMES.

THE GDC REQUIREMENT IS 90 FEET.

THE APPLICANT PROPOSES 75.

THE DEVIATION IS NEEDED TO INCLUDE THE PUBLIC STREET TO ACCESS EACH TOWNHOME AND ALSO TO INCORPORATE AN ALLEY AS WELL.

SO THERE'S OBVIOUSLY SOME INFRASTRUCTURE THAT THE APPLICANT NEEDED TO MAKE FIT.

GARAGE SETBACK FOR SINGLE FAMILY ATTACHED.

THE GDC REQUIRES A FIVE FOOT OFFSET THAT THE GARAGE DOOR HAS TO BE BEHIND THE FRONT DOOR.

THE APPLICANT WOULD MEET ALL THE OTHER SETBACKS AND HAVE THE MINIMUM DRIVEWAY THAT WOULD EXCEED 20 FEET PER THE GDC, BUT THEY JUST WOULDN'T HAVE THAT DOOR TO GARAGE DOOR OFFSET ON THE FRONT ELEVATIONS.

AND THEN FINALLY, I BELIEVE THIS IS THE LAST ONE ATTACHED UNIT FOR TOWNHOMES THE GDC PRESCRIBES FOR TOWNHOUSE BUILDINGS BETWEEN THREE AND SIX UNITS.

IS THE THREE IS THE MINIMUM, SIX IS THE MAXIMUM.

THE APPLICANT PROPOSES SOME OF THE BUILDINGS TO BE SEVEN UNITS.

SO AND THE APPLICANT CONTENDS THIS DEVIATION IS NECESSARY TO ALLOW THE HIGHEST NUMBER OF FOR SALE RESIDENTIAL PRODUCTS.

AGAIN, THOSE WOULD BE INDIVIDUALLY PLATTED LOTS.

THE TOWNHOUSES WOULD BE.

STAFFS RECOMMENDATION IS APPROVAL OF THE REQUESTS, BOTH THE ZONING CHANGE AND THE DETAIL PLAN AS PART OF THE PD REQUEST AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL WITH A UNANIMOUS VOTE AND COUNCIL WE RECEIVED QUITE A FEW RESPONSES ON THIS.

LET'S SEE, WE, IF I CAN FIND IT.

SO WE MAILED OUT 97 LETTERS ON THIS CASE.

WE RECEIVED 32 IN FAVOR WITHIN THE NOTIFICATION AREA, THREE IN OPPOSITION WITHIN THE NOTIFICATION AREA, AND 23 IN FAVOR OUTSIDE OF THE NOTIFICATION AREA.

AND WITH THAT, I'LL BE GLAD TO ANSWER ANY QUESTIONS.

IT'S A PRETTY IMPRESSIVE RETURN.

[LAUGHTER] RECORD YEAH.

QUESTIONS FOR STAFF? COUNCILMEMBER BASS.

THANK YOU, MAYOR. THANK YOU WILL.

WILL, CAN YOU GO BACK TO THE SLIDE WHERE IT SHOWED THE DENSITY OF THE UNITS AND WHERE THEY BORDERED THE RESIDENTIAL? OKAY. PERFECT. AND I JUST WANT TO CONFIRM ON THE NORTH, THE EASTERN PART OF THAT WHERE IT BORDERS, THAT'S COMMERCIAL, CORRECT? YES, SIR. THESE ARE OFFICE BUILDINGS.

OKAY. AND THE RESIDENTIAL IS ON THE SOUTHERN BORDER THERE? THAT'S CORRECT. THAT'S THE ONLY PART. OK.

AND WHAT IS THE WHAT'S THE BUILDING HEIGHT ALONG THE SOUTHERN BORDER? OF THE TOWNHOUSES? YES. MAY NEED THE APPLICANT TO CONFIRM, I WANT TO SAY 30 TO 35 FEET BUT I CAN LET THE APPLICANT CONFIRM THAT THEIR TEAM IS HERE.

OKAY. SO THE DEVIATION FOR THE 53 FEET ISN'T ALONG THAT PART, RIGHT THERE AT ALL? THAT'S CORRECT. THAT'S JUST FOR THE MULTI-FAMILY BUILDINGS.

YES, SIR. OKAY. OKAY.

I JUST WANTED TO CONFIRM THAT.

THANK YOU, MAYOR. THANK YOU SIR.

MAYOR PRO TEM HEDRICK.

THANK YOU, MR. MAYOR. WILL, HAS TRANSPORTATION REVIEWED THE ANGLED PARKING ON THE PUBLIC RIGHT OF WAY? I KNOW THAT'S A STANDARD THING WE DON'T USUALLY HAVE IN TOWN.

THEY HAVE. WE HAD A KIND OF A BIG GROUP MEETING WITH THE APPLICANT AND THEIR ENGINEERS VERY EARLY ON IN THIS PROCESS, PRIOR TO FORMAL SUBMITTAL KIND OF IN THE PRE-SUBMITTAL DISCUSSIONS. AND THERE WAS QUITE A BIT OF BACK AND FORTH AS I'M SURE THE APPLICANT'S TEAM

[00:45:03]

CAN ATTEST, ON MAKING SURE THIS ALL WORKS AND MEETS ENGINEERING AND TRANSPORTATION STANDARDS. BUT YES, SIR, MR. LUEDTKE AND HIS TEAM DID A REVIEW OF THIS AND ULTIMATELY, AGAIN, THIS HAS GONE THROUGH MULTIPLE REVISIONS AND BACK AND FORTH, BUT ULTIMATELY IT HAS BEEN GIVEN THE THUMBS UP.

YES, SIR. NO. WELL, DID THEY DISCUSS PUBLIC SAFETY CONCERNS OF BACKING UP INTO A PUBLIC RIGHT OF WAY, LIKE YOU'D HAVE TO DO IN THAT MANEUVER TO GET OUT OF A PARKING SPACE? YEAH, THE SPEEDS ARE ANTICIPATED TO BE FAIRLY LOW.

AND THAT WAS ONE THING THAT I KNOW, MR. LUEDTKE. I DON'T WANT TO CERTAINLY SPEAK FOR HIM AND HE MAY ABLE TO SPEAK MORE TO THIS WHEN THIS COMES BACK AS A THOROUGHFARE PLAN AMENDMENT.

BUT THE THOUGHT WAS THAT THIS WOULDN'T WHILE WE SAY THE WORD THOROUGHFARE, THAT MAY BE A LITTLE MISLEADING. IT'S REALLY MEANT TO BE MORE OF A KIND OF A RESIDENTIAL LOCAL STREET FUNCTION, MORE LIKE THAT AND LOW SPEEDS AND MORE OF KIND OF A NEIGHBORHOOD STREET VERSUS A KIND OF A MAJOR COLLECTOR.

SO THAT WAS PART OF THE THOUGHT BEHIND THAT.

OKAY. THANK YOU. THANK YOU, MR. MAYOR. VERY GOOD.

ANY ADDITIONAL QUESTIONS FOR STAFF? I SEE NONE. MR. GUERIN. THANK YOU, MADAM SPEAKER IF YOU COULD CALL OUR FIRST I BELIEVE WE HAVE SPEAKER CARDS FOR THE APPLICANT.

AND JUST A REMINDER, APPLICANTS, YOU'LL HAVE 10 MINUTES TO MAKE YOUR PRESENTATION, THEN WE'LL ALLOW YOU SOME TIME AT THE END IF THERE IS A NEED TO ANSWER ANY QUESTIONS THAT COME UP. MADAM SECRETARY.

AND IF YOU COULD GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

WE HAVE TWO SPEAKERS FOR THE APPLICANT, JULIE GALE AND FRANCIS NOLAN.

OKAY. DON'T TAKE THIS THE WRONG WAY, BUT I'M GOING TO ASK YOU TO PULL THAT MICROPHONE DOWN A LITTLE BIT. SORRY.

ALL RIGHT. OKAY.

GOOD EVENING, EVERYONE.

THANK YOU SO MUCH, MR. MAYOR AND OTHER COUNCIL MEMBERS AND CITY ATTORNEY TO AND THE STAFF MEMBERS TO COME AND GIVE US THE OPPORTUNITY TO PRESENT OUR NEW PROJECT, URBAN VILLAGE AT ROSEHILL.

REALLY APPRECIATE FOR YOUR TIME TONIGHT.

NAME AND ADDRESS AND YOU'RE OFF TO THE RACES.

MY NAME IS ANJUM VARSHNEY AND MY ADDRESS IS 4017 BORDEAUX CIRCLE FLOWER MOUND, TEXAS.

SO I'M GOING OVER THE SLIDE.

SO I THINK I'M MISSING ONE SLIDE HERE.

THIS IS THE OLD ONE.

CAN WE. MADAM SECRETARY, IF YOU COULD HOLD THE TIMER FOR JUST A SECOND, IF THAT'S POSSIBLE, THAT'S FINE.

I'LL GO WITH THIS ONE.

THAT'S FINE. NEVER MIND.

RESTART IT. OKAY.

SO MY NAME IS ANJUM VARSHNEY.

AND WE ARE IN THE REAL ESTATE BUSINESS FOR THE LAST 20 YEARS.

WE HAVE OUR [INAUDIBLE] IN THE DIFFERENT PART OF THE DFW AREA.

WE OWN A LOT OF COMMERCIAL AND COMMERCIAL MIXED DEVELOPMENT AND ALSO MULTI-FAMILY OF OFFICE BUILDING IN DIFFERENT PARTS OF THE DFW LIKE IRVING, DALLAS, PROSPER, FLOWER MOUND GARLAND, RIGHT ON THE GARLAND WE OWN TWO OFFICE BUILDINGS.

AND SO, SO WE ARE IN THIS REAL ESTATE FOR LAST 20 YEARS AND WE HAVE TWO BUILDINGS IN GARLAND AND WE ARE VERY HAPPY TO BE PART OF THE CITY OF THE GARLAND.

SO TODAY I'M JUST TRYING TO SHOW THIS SLIDE.

THERE WAS THE ONE SLIDE BEFORE, BUT I THINK IT'S NOT THERE.

SO THIS IS THE ROSEHILL CONCEPTUAL PLAN.

SO IT WAS, I THINK, DONE THE THREE FOUR YEAR STUDY AND THIS WAS APPROVED.

IT IS, I THINK ON THE GARLAND WEBSITE AND THE PICTURE OF THE TOP THIS IS THE GARLAND ROSEHILL IS CONCEPTUAL PLAN AND THIS PLAN IS INCLUDE LIKE A PARK AREA RETAIL, RESTAURANTS AND HOTEL AND OUR LAND LOCATION IS HERE ON THE BOTTOM HERE, WHICH IS LIKE A RED OUTLINE SHOWING THERE AND WHICH IS THE EAST SIDE OF THE I-30.

AND WE ARE TRYING TO ALIGN WITH OUR MASTER PLAN WITH THE CITY OF THE GARLAND CONCEPTUAL PLAN. SO OUR PLAN WILL INCLUDE LIKE WALKING TRAIL, PARK AREA, POND AREA, MULTI-FAMILY AND SINGLE TOWNHOMES AND ALSO A LOT OF RESTAURANTS AND THE RETAIL IN THE FRONT.

SO THIS IS THE BUILDING THAT WE OWN CURRENTLY IS 310 OFFICE PLAZA.

WHILE YOU ARE DRIVING, YOU HAVE SEEN THIS BUILDING AND THIS LAND IS LOCATED NEXT TO OUR BUILDING. SO, LIKE CURRENTLY THIS LAND IS USED IS LIKE AS MR. WILL MENTIONED THAT IT IS CURRENTLY FOR THE OFFICE USE AND THE AGRICULTURE, BUT WE ARE PROPOSING TO CHANGE THE USES FOR THIS LAND, FOR THE MIXED DEVELOPMENT.

AND WHY WE ARE DOING IT BECAUSE YOU HAVE SEEN WITH THE COVID AND THE NEW NORMAL OFFICE USES HAS BEEN DECLINED.

A LOT OF PEOPLE ARE WORKING FROM THE HOME PEOPLE, A LOT OF EMPLOYED, ALLOWING THE PEOPLE WORKING FROM THE HOME WITH THE TELECOMMUNICATION AND ZOOM CALL AND THIS AND THAT.

SO THERE ARE A LOT OF THE BUILDINGS AROUND THE BACKSIDE IS EMPTY.

AND SO WE ARE LOOKING TO BETTER USE OF THIS LAND FOR THE PROVIDING THE MIXED DEVELOPMENT.

[00:50:02]

SO THIS IS OUR MIXED DEVELOPMENT PROPOSAL.

SO THIS IS THE BIG MASTER PLAN.

SO IF YOU CAN SEE IN THE BACK, LET ME START FROM THE BACK.

THIS IS THE POND AREA IS A NATURAL POND.

RIGHT, NOW THERE.

SO IT IS A POND AREA.

AND WE WILL BE DEVELOPING HERE A NICE WALKING TRAIL HERE AND ALSO GAZEBO AND SITTING AREA. SO PEOPLE OF THIS COMMUNITY AND THE OTHER CITY OF THE GARLAND CAN SPEND NICE QUALITY TIME WITH THEIR FAMILY AND FRIEND.

AND THEN THIS SIDE OVER HERE, THERE WILL BE A DOG PARK HERE SO PEOPLE CAN BRING THEIR PETS AND AND WALK AROUND THERE.

AND ON THE FRONT SIDE, IF YOU LOOK HERE, THERE WILL BE A RETAIL AND RESTAURANTS HERE BECAUSE WE HAVE HEARD THAT THERE IS NOT A GOOD RESTAURANT HERE IN THIS PART OF THE GARLAND. SO WE ARE TRYING TO BRING NICE CLASS A RESTAURANTS HERE.

AND THIS WILL BE OUR OTHER BUILDING, WHICH HAS A CLUBHOUSE AND THE FITNESS CENTER.

AND THERE WILL BE A POOL HERE, RIGHT HERE.

SO THIS IS AND IN THE BACK, THERE WILL BE A 58 INDIVIDUAL PLATED TOWNHOME FOR THE SALE PRODUCT. SO THIS THAT THE CITY STAFF REQUESTED THAT WE ARE [INAUDIBLE] OF THE MIDSIZE HOME IN GARLAND. THAT'S WHY WE ARE TRYING TO BRING THE FOR SALE PRODUCT.

SO NOW I WILL ASK MR. [INAUDIBLE], HE IS COMING AND TALK A LITTLE BIT ABOUT MORE ABOUT THIS PLAN.

THANK YOU. MY NAME IS STEVEN [INAUDIBLE], I'M WITH LEVEL GROUP SOUTHWEST.

WE'RE THE GENERAL CONTRACTOR FOR THE PROJECT.

OUR ADDRESS IS 2099 VALLEY VIEW LANE IN FARMERS BRANCH, TEXAS.

AND I'M GOING TO ASK YOU TO PULL THE MIC UP A LITTLE BIT.

THERE WE GO. I WASN'T GOING TO THAT.

THAT'S ALL ON YOU.

[LAUGHTER] YES.

THANK YOU. SO LIKE ANJUM POINTED OUT, YOU KNOW, I THINK THE THE URBAN VILLAGE PROJECT IS INTENDING TO FOLLOW THE CONCEPTUAL PLAN THAT YOU HAVE FOR THE ROSEHILL DEVELOPMENT ACROSS THE STREET WITH THE SAME MIXED USE PROPOSALS.

YOU KNOW, ANJUM COVERED A LOT OF IT, BUT WHAT I DID WANT TO SAY IS.

ANJUM, WHICH ONE DID YOU USE? THANK YOU. LOOKING AT THE SITE PLAN, I THINK INTENTIONALLY WE WORKED WITH STAFF AND TRIED TO INCORPORATE A LOT OF THEIR COMMENTS THAT THEY SAW AS MORE BENEFICIAL TO THE CITY THAN OUR ORIGINAL APPROACH.

THIS DID PUSH A LOT OF THE MULTI-FAMILY UP TO THE NORTHERN PORTION OF THE SITE.

BUT THAT'S AN INTENTIONAL IT KEEPS IT CLOSER TO I-30 AND FURTHER FROM THE SINGLE FAMILY HOMES ON THE SOUTHERN PORTION SOUTHERN AREA FROM THE SITE.

AND WE THEN DECIDED OR PROPOSED TO PUT THE TOWNHOMES ON THE SOUTH SIDE OF THE SITE TO HAVE THE SAME USES NEXT TO EACH OTHER.

AND ALSO WANTED TO POINT OUT THAT THERE IS A 30 FOOT EASEMENT TO THE SOUTH AND WITH A TEN FOOT BUFFER BEHIND THE TOWNHOMES.

SO THERE'S A 40 FOOT BUFFER IN BETWEEN THE EXISTING SINGLE FAMILY HOMES TO THE SOUTH AND THE BACK SIDE OF OUR TOWNHOMES.

AND TO YOUR POINT, THERE ARE ONLY TWO STORY TOWNHOMES.

SO THE VIEW LINE FROM THE EXISTING SINGLE FAMILY TO THE NEW SINGLE FAMILY WILL BE EXTREMELY LIMITED BECAUSE OF THE TREES AND BECAUSE OF THE HEIGHT OF THE TOWNHOMES.

AND AS WILL HAD POINTED OUT, A LOT OF THIS WAS DRIVEN BY OUR DESIRE TO MEET THE CITY'S CONCERN OR DESIRE TO HAVE THE FOR SALE PRODUCT TO THE SINGLE FAMILY HOMES, WHICH ALSO BROUGHT IN THE USE OF THE PUBLIC STREETS.

AND INCORPORATING A LOT OF THE OTHER ITEMS WAS WE'RE REALLY WAS LOOKING AT THE AMENITIES THAT IT BRINGS FROM THE THERE'S A 12 FOOT TRAIL THAT WE'LL BE BUILDING ACROSS THE FRONT TO CONTINUE ACROSS I-30, THE CONNECTIVITY, ALL THE TRAILS WITHIN THE SITE, TRYING TO MAKE THIS A PLACE WITH A LOT OF RECREATION AND WALKING TRAFFIC FOR NOT ONLY THE RESIDENTS, BUT THE COMMUNITY AS A WHOLE, WHICH WOULD ALSO INCLUDE THE USE AND RENTAL OF THE CLUBHOUSES.

ON THE DESIGN BASIS, I THINK WILL COVERED A LOT OF THIS, BUT WE, YOU KNOW, WE TRY TO TAKE A LOOK AT MEETING, ALL THE ARCHITECTURAL ELEMENTS AND THE ARTICULATION REQUIREMENTS FOR THE PROJECT, BOTH ON THE HORIZONTAL PLANE AND VERTICALLY.

YOU SEE YOU'RE TALKING A LITTLE BIT OF HEIGHT, BUT ISSUES.

BUT THAT'S REALLY IN OUR EFFORT ALSO TO TRY TO MEET THE ARTICULATION REQUIREMENTS AND PUT

[00:55:02]

THE SHED ROOFS AND THOSE THINGS ON THE MULTI-FAMILY BUILDINGS.

ONE OF THE OTHER ELEMENTS WAS ON THE TOWNHOMES MAKING SURE THAT THE FACADE WASN'T JUST A FLAT REGULAR TOWNHOME.

WE WERE PROVIDING SOME ARTICULATION TO THOSE.

SO EACH HOME HAD ITS OWN INDIVIDUAL APPEARANCE.

AND I THINK YOU'VE SEEN THESE ELEVATIONS ON THE MULTI-FAMILY OR THESE ARE THE TOWNHOMES WITH THE REAR ENTRY AND THE FRONT ENTRY.

THE IN BOTH INSTANCES WE EXCEED THE MINIMUM GDC REQUIREMENTS FOR THOSE TOWNHOME USES.

THERE'S THIS IS AN ELEVATION OF THE, TOWNHOMES AND THE OFFICES.

HERE I THINK YOU'VE SEEN THESE PREVIOUSLY FROM WILL.

YOU KNOW THE EFFORT WAS TO MAKE THESE A TRANSITIONAL MODERN FINISH.

THIS IS A VERY SIMILAR PROJECT.

AND LOOKED THAT WE'RE WE'VE DONE, YOU KNOW, IN OTHER CITIES LIKE FRISCO, RICHARDSON AND SO FORTH. SO WITH THAT, I'LL HAND IT BACK TO ANJUM AND LET HER FINISH.

OKAY, SO LET ME GO BACK.

SO I JUST WANT TO GO OVER WHAT ARE SOME KEY POINTS FOR THIS PROJECT.

SO WE ARE PROVIDING SERVICE ROAD WILL BE CONNECTING FROM THE I-30 SERVICE ROAD TO THE LYONS ROAD. SO IT WILL PROVIDE IT WILL REDUCE THE TRAFFIC ON THE RED LIGHT, WHICH IS I THINK CALLED WHICH IS CALLED BOBTOWN.

ALSO, WE ARE DEVELOPING PROVIDING A LOT OF GREEN SPACE AROUND THE PARK AND THE POND AREA.

AND WE ARE ALSO I HAVE HEARD THAT IN THE PREVIOUS MEETING, THE FOOD DESERT.

RIGHT. YOU HAVE I ATTENDED THE VIRTUAL MEETING AND THERE I HEARD THE WORD FROM YOU GUYS FOOD DESERT BECAUSE THERE ARE NOT GOOD RESTAURANTS AROUND THIS AREA.

AND WE ARE TRYING TO BRING CLASS A RESTAURANT HERE.

A LOT OF MY TENANT I HAVE TWO BUILDINGS RIGHT THERE THEY GO IN THE OTHER CITY, CITY OF MESQUITE AND THE ROCKWALL TO GET THE FOOD IF THEY HAVE TO TAKE THE TEAM DINNER OR LUNCH OR EITHER THEY HAVE TO TAKE THEIR CLIENT.

SO WE ARE TRYING TO BRING THE RESTAURANT HERE SO WE CAN KEEP THE TAXES, SALES TAX HERE WITHIN THE CITY OF THE GARLAND.

AND OTHER THING IS THIS LAND IS VACANT FOR [INAUDIBLE] YEAR.

I DON'T KNOW HOW MANY YEARS, BUT WE ARE TRYING TO BRING THIS DEVELOPMENT AND IT WILL BRING AT LEAST 1.5 MILLION OR MORE TAX VALUE EACH YEAR TO THE CITY AND THE COUNTY.

SO AND OUR PROPOSED DESIGN IS MEETING THE [INAUDIBLE] GUIDELINE, AND IT WAS APPROVED BY MANY OF YOUR CITY STAFF WITH MULTIPLE REVIEWS THERE.

AND WE HAVE CAREFULLY SELECTED THE LIKE A TONE COLOR PALETTE TO ENHANCE THE VISUAL AESTHETICS FOR THE I-30 SO IT LOOKED NICE FROM THE I-30 THAT'S WHAT MR. MOORE WANTED WHEN WE APPROACHED HIM THAT MAKE SURE THAT IT LOOKED NICE FROM I-30.

WHEN PEOPLE DRIVE HERE LIKE A FRISCO, THEY HAVE A DEVELOPMENT LIKE THAT.

FRISCO ON THE 121 AND WE ARE TRYING TO MEET THE SAME GUIDELINE HERE, SAME COLORS AND EVERYTHING. SO IN THAT BECAUSE I HAVE ONLY NO MORE TIME LEFT? BUT GIVE ME ONE MINUTE, I'LL FINISH VERY QUICKLY.

[LAUGHTER] SO I'M GOING TO HAVE TO TELL YOU.

YEAH, YOU GET ME ONLY TEN MINUTE.

[LAUGHTER] OKAY.

SO HERE IS THE PICTURE OF THE POND AREA, WHICH IS CURRENTLY THE POND ON THE LEFT AND THE TOP SIDE. AND THEN AFTER WE DEVELOPING, THERE WILL BE A NICE POND WITH THE WATER FEATURE AND WILL BE A PLAYGROUND EQUIPMENT SO THE PEOPLE CAN ENJOY AND HAVE A NICE FAMILY TIME.

AND ALSO I WANT TO BRING MY, INTRODUCE MY GROUP HERE.

MR. [INAUDIBLE]. HE WILL BE AT GDC HE'S THE CIVIL ENGINEER.

MR. ROTH [INAUDIBLE] HE'S THE ARCHITECT.

HE HAS DONE THAT A LOT OF PROJECTS LIKE THAT IN ALL OF THE PART OF THE COUNTRY.

HE'S DOING TWO PROJECTS IN THE CITY OF GARLAND.

ONE IS THE WOODLAND PROJECT, AND HE'S DOING THE OTHER ONE.

WHAT IS THE NAME [INAUDIBLE] RIDGE HOME RIGHT NOW HE HAS DONE IT.

AND THEN OUR ENGINEER, BRENDAN, HE HAVE DONE WORK WITH THE CITY OF GARLAND.

SO I HAVE CHOSE THE TEAM WHICH IS RECOMMENDED BY THE STAFF.

I ASKED THEM, ARE THEY OKAY? BECAUSE BEFORE I EVEN BRING THE PROJECT TO THE CITY SO THEY MAKE SURE THEY'RE FOLLOWING THE GUIDELINES HERE.

SO THANK YOU SO MUCH, EVERYONE.

AND I'M REALLY APPRECIATE FOR YOUR SUPPORT FROM THE BOTTOM OF MY HEART TO HELP THIS PROJECT. I AM IN THE BUSINESS WITH THE CITY OF GARLAND FOR THE LAST TEN YEARS AND I WANT TO CONTINUE UNTIL I LIVE HERE.

THANK YOU SO MUCH. [LAUGHTER] THANK YOU.

I THINK WE MAY HAVE, DON'T RUN OFF.

I THINK WE MAY HAVE SOME QUESTIONS FOR YOU, COUNCIL LADY MORRIS.

THANK YOU, MAYOR, AND THANK YOU FOR YOUR PRESENTATION.

AND I WILL HAVE TO ECHO THE MAYOR IN SAYING I DON'T THINK I'VE EVER SEEN A ZONING CASE FOR ANYTHING INVOLVING MULTI-FAMILY THAT HAD SO MANY LETTERS OF SUPPORT.

[01:00:01]

SO WHATEVER YOU'RE DOING, I'LL JUST HAVE TO SAY I'M IMPRESSED.

I'M IMPRESSED. I'M IMPRESSED WITH THE TRAIL SYSTEM.

A LOT OF THIS IS NICE.

I JUST HAD ONE QUESTION.

I WAS LOOKING AT THIS, BUT I COULDN'T TELL BECAUSE IT'S LITTLE THE YOU HAVE 40 FEET, BASICALLY A 40 FOOT BUFFER ON THE SOUTH END BETWEEN THE TOWNHOMES AND THE RESIDENTIAL NEIGHBORHOOD TO THE SOUTH.

CORRECT. AND I LOVE THAT YOU'RE TRANSITIONING LIKE THAT.

I THINK THAT WAS A WISE DECISION.

SO IN THAT 40 FOOT BUFFER, IS THERE GOING TO BE ANY KIND OF ADDITIONAL SCREENING WALL OR IS THAT JUST GOING TO BE OPEN WITH TREES? A LOT OF TREES YOU CAN SEE ALREADY LIKE I THINK VERY LONG TREE.

I CANNOT EVEN SEE FROM THE HOUSE FROM THERE WHEN I WALKED THERE.

OK. SO THE 40 FEET INCLUDES MATURE TREES.

YES. THAT PROVIDE A VISUAL SCREEN AND A DIVIDER.

THAT'S CORRECT. AND THE SINGLE FAMILY HOMES TO THE SOUTH ALSO HAVE A FENCE ALONG THE BACK OF THEIR HOMES. OKAY.

ALL RIGHT. WELL, THAT WAS REALLY THE ONLY QUESTION I HAD WITH THAT.

AND I APPRECIATE IT.

THANK YOU. THANK YOU, MAYOR.

THANK YOU.

DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU VERY MUCH.

THANK YOU VERY MUCH, MAYOR.

YOU DON'T NEED WATER, DO YOU? I JUST [INAUDIBLE] ONE. [LAUGHTER] AND IN YOUR REPORT AND PERHAPS I MISSED IT ON THE SITE PLAN YOU SAID PUBLIC YOU SAY PUBLIC STREET FROM I-30 FOR FUTURE TO CONNECT TO LYONS ROAD PROJECT CAN MAYBE I MISSED IT.

CAN YOU WALK ME THROUGH THAT AND WHAT ARE WE TALKING ABOUT THERE? WHEN I LOOK AT YOUR EGRESS AND YOUR INGRESS POINTS THERE, I ONLY SEE HERE. SO THIS IS SO THIS IS THE ROAD THAT WILL BE STARTING FROM THE I-30 SERVICE ROAD AND IT WILL BE CONNECTING TO HERE, WE ARE ALSO IN THE PROCESS TO BUYING THE ADDITIONAL LAND AND I THINK THE LANDOWNER IS HERE.

I DON'T WANT TO SAY THE NAME, BUT WE ARE IN PROCESS AND WE WILL BE THIS ROAD WILL BE CONNECTING WITH THE LYONS ROAD THERE.

RIGHT HERE. OKAY.

SO THAT'S WHY I DIDN'T SEE IT ON HERE BECAUSE IT'S STILL IN [INAUDIBLE] RIGHT? YEAH. YOU CAN SEE HERE AND THE LYONS ROAD RIGHT HERE IF YOU CAN SEE MY CURSOR.

WELL, I THINK ALSO, AS WILL POINTED OUT, I THINK THEY'RE GOING TO BRING IN PART OF THE NEW THOROUGHFARE PLAN TO OBVIOUSLY WORK THAT IN IN THE FUTURE.

AND LIKE SHE SAID, SHE'S IN DISCUSSIONS WITH THAT PROPERTY OWNER TO BUY THE LAND SO SHE CAN FACILITATE THAT WITH THE CITY.

IN ADDITION, I'D LIKE TO POINT OUT THAT THERE IS CURRENTLY A SECOND POINT OF ACCESS THAT WILL BE AS SHE OWNS THE BUILDINGS, THE OFFICE BUILDINGS ADJACENT.

SHE'LL WE WILL PROVIDE CROSS ACCESS EASEMENTS TO PROVIDE ADDITIONAL FORM OF ACCESS TO THE STREET OVER HERE.

OKAY. THERE IS TWO ACCESS OF ONE RIGHT HERE IS CONNECT WITH THE OAKS TRAIL AND ONE WILL BE RIGHT HERE. SO. OKAY.

ALL RIGHT. THANK YOU VERY MUCH.

THANK YOU, MAYOR. THANK YOU. CERTAINLY.

COUNCIL MEMBER AUBIN. THANK YOU, MAYOR.

THANK YOU FOR BRINGING US THIS PROJECT.

IT'S A DIFFICULT SITE TO DEVELOP.

IT LOOKS LIKE WITH EVERYTHING THAT'S ALL GOING AROUND IT.

AND SO IT LOOKS LIKE YOU GUYS HAVE BROUGHT SOME REAL VALUE TO THE SITE.

SO I APPRECIATE IT AND SOME CREATIVITY TO MAKING IT HAPPEN.

SO I APPRECIATE YOU GUYS WORKING WITH STAFF AND COMING UP WITH THIS PLAN.

LOOKS GOOD. THANK YOU.

VERY GOOD. DEPUTY MAYOR PRO TEM HEDRICK.

MAYOR PRO TEM HEDRICK. EXCUSE ME.

THANK YOU, MR. MAYOR. CAN YOU ELABORATE A LITTLE BIT ON THE CONVERSATIONS YOU'VE HAD WITH STAFF ABOUT THE ANGLED PARKING ALONG THE RIGHT OF WAY ALONG THE MAIN ENTRANCE DRIVE? WELL, I MEAN, WE THE DISCUSSIONS THAT WE'VE HAD WITH STAFF WERE REALLY I WOULD OUTLINE IN, AS WILL SAID, YOU KNOW, WE ARE TRYING TO MEET THE GDC REQUIREMENTS AND THE INTENTION OF THE RIGHT OF WAY THERE IS TO BE A MORE RESIDENTIAL TYPE STREET WITH REDUCED SPEEDS.

SO IF YOU'RE BACKING OUT OF YOUR DRIVEWAY, SOMEWHAT A SIMILAR SITUATION, BACKING OUT OF A PARKING SPACE SO THAT IT WOULDN'T BE AN INTENTION, CERTAINLY BE LIKE A LYONS ROAD AND BACKING ONTO SOMETHING THAT IS THE SPEEDS THAT WOULD PROHIBIT THAT KIND OF USE.

OKAY. THANK YOU.

THANK YOU, MR. MAYOR. ALL RIGHT.

ANY ADDITIONAL QUESTIONS FOR THE APPLICANT?

[01:05:01]

I SEE NONE. MADAM SECRETARY, I BELIEVE WE HAVE, IF YOU CAN HAVE A SEAT FOR A MOMENT, WE'RE GOING TO HAVE SOME SPEAKERS.

AND IF WE HAVE ANY QUESTIONS, WE'LL ASK YOU, WE'LL GIVE YOU SOME TIME AFTER.

CAN I MAKE ONE COMMENT.

YOU'RE JUST GOING TO PUSH ME ALL NIGHT, AREN'T YOU? I REALLY WANT TO APPRECIATE THIS.

MR. WILL AND MR. [INAUDIBLE] STAFF. THEY ARE VERY HELPFUL TO GUIDE THROUGH THE WHOLE PROCESS.

IT TOOK SIX, SEVEN MONTHS, BUT I REALLY I HAVE WORKED WITH THE DIFFERENT CITY WITH THE IRVING, DALLAS, EULESS.

BUT I REALLY, REALLY THANKFUL TO THE CITY STAFF.

YOUR STAFF IS EXCELLENT AND VERY HELPFUL AND FRIENDLY.

WELL, AS LONG AS YOU'RE GOING TO COMPLIMENT OUR STAFF, THEN FINE.

[LAUGHTER] MADAM SECRETARY.

MADAM SECRETARY, IF YOU COULD PLEASE GET ME OUT OF THIS AND CALL OUR FIRST SPEAKER.

MAYOR LEMAY, WE HAVE 25 PLUS SPEAKERS REGISTERED FOR PASSAGE OF THE ITEM, BUT NONE OF THEM HAVE INDICATED THE DESIRE TO SPEAK.

WELL, ALL RIGHT 25 PEOPLE ARE HERE TONIGHT IN FAVOR OF THIS PROJECT, CORRECT? YES, SIR. THAT IS PRACTICALLY UNHEARD OF FOLKS, I'M JUST GOING TO TELL YOU AND I APPRECIATE YOU COMING DOWN.

I APPRECIATE YOU TAKING THE TIME TO GET INVOLVED AND UNDERSTAND WHAT'S GOING ON AROUND YOU. THAT IS. PLEASE DO ME A FAVOR AND TALK TO ALL OF YOUR NEIGHBORS AND FRIENDS ACROSS THE CITY AND ENCOURAGE THEM TO DO THE SAME THING WHEN THEY SEE THOSE ZONING SIGNS POP UP.

ALL RIGHT. ALL RIGHT.

I GUESS REBUTTAL IS OUT OF THE QUESTION AT THIS POINT.

COUNCILMEMBER MOORE, THAT'S IN YOUR DISTRICT, SIR.

GO AHEAD. THANK YOU, MR. MAYOR. ANJUM, WONDERFUL.

WE TALKED ABOUT THIS OF COURSE, YOUR EXCITEMENT, YOUR ENTHUSIASM.

IT'S CONTAGIOUS.

JUST SITTING HERE IN THIS ROOM TONIGHT, YOU CAN LOOK AROUND AND SEE THE PEOPLE WHO'VE COME TO SUPPORT YOU.

AND WE'RE JUST WE'RE JUST EXCITED ABOUT THE PROJECT.

WE TALKED ABOUT THIS AND, YOU KNOW, THAT ONE OF MY VERY ONE OF MY CONCERNS IS INDEED THAT I-30 CORRIDOR AND THE TYPES OF BUSINESSES THAT WE NEED TO PUT THERE NOW, WE NEED TO BE PURPOSEFUL ABOUT UPSCALE RESTAURANTS AND RETAIL AND MORE MIXED USE PURPOSES, SUCH AS WHAT YOU ATTEMPTED TO PUT THERE PRESENTLY.

AND YOU CAME INTO THE CITY.

AND ALL I'VE HEARD FROM STAFF IS, OH, SHE'S JUST SO EASY TO WORK WITH.

AND THEY GAVE YOU DIFFERENT SUGGESTIONS AND IDEAS THAT WERE NOT EVEN IN YOUR PLAN INITIALLY, AND YOU INCORPORATE THEM INTO YOUR PLAN.

AND I KNOW THAT YOU KEPT SAYING TO ME, MR. ED ARE YOU GOING TO BE THERE. ARE YOU GOING TO? WELL, AS YOU'VE SEEN I DON'T NEED TO SAY ANYTHING TONIGHT.

THIS IS NOT MY NIGHT.

THIS IS YOUR NIGHT. [LAUGHTER] YOU HAVE DONE A WONDERFUL AND A MARVELOUS JOB.

SO WITH THAT, MR. MAYOR, I'D LIKE TO MAKE A MOTION TO APPROVE THE DETAIL PLAN AND ZONING REQUEST, AS RECOMMENDED BY THE PLANNING COMMISSION FROM COMMUNITY OFFICE AND AGRICULTURAL DISTRICT TO PLANNED DEVELOPMENT DISTRICT FOR MIXED USES.

AND THAT ALSO INCLUDES THE DETAIL PLAN.

I'M SORRY, I WAS MAKING NOTES.

YES. THAT'S FOR BOTH ITEMS. YES. OKAY. I HAVE A MOTION BY COUNCILMEMBER MOORE TO APPROVE ITEMS 7D AND 7E AS PRESENTED WITH THE SECOND BY COUNCILMEMBER BASS.

ANY FURTHER DISCUSSION? SEEING NONE. MADAM SECRETARY AND COUNCIL, IF YOU CAN PLEASE VOTE EVERYBODY CROSS YOUR FINGERS AND DISPLAY THE VOTE, PLEASE.

AND THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU VERY MUCH. [APPLAUSE] I FEEL LIKE WE SHOULD ALMOST TAKE A RECESS BECAUSE I'M JUST REALLY NOT SURE WHAT'S GOING ON HERE TONIGHT BETWEEN THE ELECTRONICS AND PEOPLE BEING SO IN FAVOR OF A PROJECT.

ALL RIGHT. WELL, WE'LL PLOW AHEAD.

ITEM 7F IS CONSIDERED A ZONING REQUEST BY HANIF NENSEY FROM AGRICULTURE DISTRICT TO SINGLE

[Items 7F - 7H]

FAMILY SF 7 DISTRICT.

THIS PROPERTY IS LOCATED AT 705 EAST OATES ROAD IN DISTRICT 4.

IT ALSO HAS A SECOND PART TO CONSIDER A SPECIFIC USE PROVISION.

SAME APPLICANT.

SAME ADDRESS.

MR. MAYOR THERE ARE THREE PARTS OF THIS.

I'D LIKE TO TAKE THEM ALL TOGETHER.

OH, EXCUSE ME.

I'M SORRY. THREE PARTS.

YES, AND PART SEVEN.

THANK YOU, SIR. 7H IS TO CONSIDER A REQUEST FOR TO ALLOW A GUEST HOUSE

[01:10:10]

AGAIN SAME PROPERTY, SAME APPLICANT.

THANK YOU. SURE. SORRY I MISSED THAT.

ALL RIGHT, MAYOR AND COUNCIL. THANK YOU.

THIS IS A PROPOSAL TO REZONE THE PROPERTY TO ALLOW TWO SINGLE FAMILY HOMES AND A GUEST HOUSE. SPECIFICALLY, THE REQUEST HAS THREE PARTS.

A CHANGE IN ZONING FROM AG TO SF 7 AND AN SUP FOR A GUEST HOUSE AND OF COURSE, A PLAN FOR A GUEST HOUSE. THE LOCATION IS 705 EAST OATES ROAD.

THE APPLICANT AND OWNER IS MR. HANIF NENSEY. THE ACREAGE OF THE SITE IS 1.45 ACRES AND AGAIN THE CURRENT ZONING IS AGRICULTURAL DISTRICT.

HERE'S THE GENERAL LOCATION OF THE SUBJECT PROPERTY NEAR BROADWAY AND OATES.

AND HERE'S THE SUBJECT PROPERTY OUTLINED HERE IN TEAL AS FRONTAGE ON OATES ROAD.

AGAIN, IT'S CURRENTLY ZONED AG.

THERE IS A MOBILE HOME COMMUNITY TO THE EAST, ALSO ZONED AG THERE IS A CHURCH TO THE WEST, NORTH AND WEST OF THE PROPERTY AND THERE ARE SINGLE FAMILY RESIDENCE ON THE OTHER SIDE OF OATES ROAD. THOSE ARE ZONED SF 7 AND IF YOU JUST ACTUALLY ZOOM OUT IN THE ZONING MAP, YOU'LL SEE ADDITIONAL SF 7 ZONING.

SO THE REQUEST FOR SF 7 IS FAIRLY CONSISTENT WITH THE AREA.

THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS COMPACT NEIGHBORHOODS AND THE REQUEST ADHERES TO THAT GENERAL DESIGNATION.

HERE ARE SOME PHOTOS OF THE AREA, INCLUDING THE SUBJECT PROPERTY ON THE TOP LEFT.

THE REQUEST IS A TRADITIONAL REZONING WITHOUT THE FORMATION OF A PLANNED DEVELOPMENT OR PD. THE INTENT OF THE REQUEST FROM AG TO SF 7 AGAIN IS FOR TWO SINGLE FAMILY HOMES ON SEPARATE LOTS AS WELL AS A GUEST HOUSE ON WHAT THE APPLICANT IS LABELING AS LOT B AND THE GUEST HOUSE WOULD REQUIRE AN SUP IN SF 7 ZONING.

THE PROPOSED GUEST HOUSE IS 1,970 SQUARE FEET.

THE PRIMARY STRUCTURE WILL BE JUST OVER 6500 SQUARE FEET.

SO IT WOULD ADHERE TO THE 30% MAX SIZE OF A GUEST HOUSE BASED ON THE PRIMARY HOUSE ON THE SAME LOT. IT MEETS THE GDC REQUIREMENTS FOR GUEST HOUSES, INCLUDING BUILDING DESIGN.

AND THE APPLICANT IS REQUESTING THE SUP TO BE VALID FOR AN INDEFINITE TIME PERIOD WHICH ALIGNS WITH THE TIME FRAME PER THE SUP TIME PERIOD GUIDE, WHICH GOES UP TO AN INDEFINITE TIME PERIOD BASED ON SOME PREVIOUS SUP APPROVALS FOR GUEST HOUSES.

HERE'S THE SITE PLAN SHOWING THE PROPOSED GUEST HOUSE.

AND WHILE THE DETAILS OF THE SINGLE FAMILY HOMES ARE NOT UNDER CONSIDERATION THIS EVENING BECAUSE IT IS A STRAIGHT ZONING, THE APPLICANT'S INTENT IS TO PLAT TWO SEPARATE LOTS AND HAVE THE GUEST HOUSE ON ONE PARTICULAR LOT IN THE REAR SIDE OF IT.

HERE ARE THE BUILDING ELEVATIONS OF THE PROPOSED GUEST HOUSE.

STAFF RECOMMENDATION IS APPROVAL OF THE REQUESTS, BOTH THE ZONING CHANGE AND THE SUP AND PLAN FOR THE GUEST HOUSE.

AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL WITH A UNANIMOUS VOTE [INAUDIBLE] AND THE ZONING SUP AND AS WELL AS THE PLAN ITEM.

MAYOR, WE MAILED OUT 74 LETTERS ON THIS CASE.

WE RECEIVED ONE IN FAVOR WITHIN THE NOTIFICATION AREA AND FIVE IN OPPOSITION WITHIN THE NOTIFICATION AREA AND ONE OPPOSED OUTSIDE OF THE NOTIFICATION AREA.

I'LL BE ABLE TO ANSWER ANY QUESTIONS. VERY GOOD ANSWER. ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE.

THANK YOU, MR. GUERIN. MADAM SECRETARY.

THE APPLICANT, THE APPLICANT.

MR. HANIF NENSEY WAS REGISTERED TO SPEAK.

OK. AND JENNA NENSEY.

SIR, IF YOU COULD COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, AND WE'LL ALLOW 10 MINUTES FOR YOU TO MAKE A PRESENTATION, OR YOU CAN JUST ANSWER QUESTIONS UP TO YOU. THANK YOU, EVERYONE.

MY FIRST NAME IS HANIF MY LAST NAME IS NENSEY, THIS IS MY DAUGHTER, JENNA.

WE PLAN TO BE OWNER OCCUPANTS IN THESE HOMES.

WE ARE BUILDING THESE HOMES FOR OURSELVES.

THE FIRST HOUSE WILL BE FOR MY SON.

THE SECOND HOUSE, I WILL LIVE THERE.

AND MY DAUGHTER WILL BE IN THE GUEST HOUSE TILL SHE COMES OF AGE.

WHEN I'M OLD, I WANT TO GO IN THE GUEST HOUSE SO I DON'T HAVE TO GO TO A NURSING HOME.

MY SON IS A NURSE.

I WOULD LIKE TO BE CLOSE TO HIM.

WE WILL BUILD BEAUTIFUL HOMES NEXT TO A CHURCH.

WE WILL BLEND WITH THE CHURCH.

AND WE WILL BE ABSOLUTELY HAPPY TO BE PERMANENT RESIDENTS OF GARLAND AND 705 EAST OATES

[01:15:06]

WILL BE A PERMANENT RESIDENTIAL ADDRESS.

IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER THEM.

VERY GOOD, SIR. ANY QUESTIONS FOR THE APPLICANT? DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MR. MAYOR. GOOD EVENING, MR. NENSEY. MAYOR, I DON'T HAVE ANY QUESTIONS, BUT I JUST WANT TO EXPRESS MY APPRECIATION.

IT'S BEEN WHAT [INAUDIBLE] BEEN TWO YEARS AGO, ALMOST THREE YEARS AGO, WHEN YOU FIRST I THINK I WAS EITHER OFF COUNCIL OR JUST A CITIZEN WHEN YOU BROUGHT THIS IDEA AND WHEN I CAME BACK ON COUNCIL, YOU WERE VERY DILIGENT IN REACHING OUT TO ME AND TO STAFF AND WALKING US THROUGH THIS PROCESS AND SHARING YOUR VISION WITH US AND ASKING THE KINDS OF QUESTIONS THAT I WISH.

I MEAN, IT WAS REFRESHING TO HAVE THE EXPERIENCE.

IT WAS NEVER ADVERSARIAL.

YOU ALWAYS ASKED THE QUESTIONS.

YOU ALWAYS WANTED HELP.

YOU ALWAYS LET YOUR VISION OUT WHEN WE SIT AND TALKED WITH YOU.

AND WE APPRECIATE THAT.

AND I'M GLAD TO SEE THIS COME TO FRUITION.

IN ADDITION AND IT HAS NOTHING TO DO MR. CITY ATTORNEY IT HAS NOTHING TO DO WITH THIS CASE TONIGHT.

BUT YOUR OUTREACH OF BEING A GOOD CITIZEN, YOU DID SOME THINGS.

I'M NOT GOING TO MENTION THOSE THINGS HERE.

BUT YOUR OFFER TO SUPPORT THIS CITY THROUGH COVID AND SOME OTHER THINGS WAS JUST UNHEARD OF. SO YOU SHOWED ME AS YOUR COUNCILMAN THAT YOU WERE NOT ONLY IN IT JUST TO BUILD A BIG HOUSE AND STAY WITH YOU AND YOUR FAMILY, BUT THAT YOU WERE CONCERNED ABOUT THE COMMUNITY AND PARTICULARLY THE SOUTHERN SECTOR AND THE PRODUCT THAT YOU OR THE PLAN THAT YOU HAVE THERE. WE THE CITY HAS INVESTED IN RECENT INFRASTRUCTURE IMPROVEMENTS IN THAT AREA.

SO THIS COMPLEMENTS THE INFRASTRUCTURE IMPROVEMENTS AND INVESTMENTS THAT WE'VE MADE AS A CITY. SO I WANT YOU TO KNOW IN ADVANCE, I TOTALLY SUPPORT THIS PROPOSAL AND I COMMEND YOU ON HOW YOU APPROACHED THIS AND WORKED WITH US.

THANK YOU, SIR. THANK YOU.

IT GOES BOTH WAYS. MY GRACIOUS THANKS TO YOU AND THE PLANNING DEPARTMENT THAT GUIDED ME THROUGH THIS. VERY GOOD.

ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? I SEE NONE. THANK YOU, SIR.

I MAY HAVE TO ACTUALLY ASK YOU TO MEET WITH MY CHILDREN AND DISCUSS HOW THEY'RE GOING TO TAKE CARE OF ME AS YOUR CHILDREN ARE GOING TO TAKE CARE OF YOU.

SO I APPRECIATE THAT.

ITEM. DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MAYOR.

MAYOR I MOVE FOR A MOTION FOR APPROVAL OF A CHANGE IN ZONING FROM AG TO SINGLE FAMILY, SEVEN APPROVAL OF THE SUP FOR THE GUEST HOUSE AND APPROVAL OF THE PLAN FOR THE GUEST HOUSE. VERY GOOD.

I HAVE A MOTION BY DEPUTY MAYOR PRO TEM WILLIAMS TO APPROVE ITEMS 7F, G AND H AS PRESENTED WITH THE SECOND BY MAYOR PRO TEM HEDRICK.

ANY FURTHER DISCUSSION? MADAM SECRETARY, IF YOU PREPARE THE VOTE FOR US, PLEASE.

AND COUNCIL.

AND DISPLAY THE VOTE, THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU, SIR. [APPLAUSE] [LAUGHTER] NEXT.

NEXT, WE HAVE 7I CONSIDER A SPECIFIC USE PROVISION, A RENEWAL REQUEST BY SEAN KIM FOR AN

[Items 7I & 7J]

EXISTING RECEPTION FACILITY ON SUBJECT PROPERTY THAT IS LOCATED AT 2800 WEST KINGSLEY ROAD IN DISTRICT 5.

AND THIS ALSO, I BELIEVE, HAS A SECOND PART 7J CONSIDER A PLAN REQUEST BY SEAN KIM FOR AN EXISTING RECEPTION FACILITY SAME ADDRESS, SAME APPLICANT.

THANK YOU MAYOR AND COUNCIL.

THIS IS A PROPOSAL TO RENEW A SUP FOR AN EXISTING RECEPTION FACILITY ON THE SUBJECT PROPERTY. THE LOCATION IS 2800 WEST KINGSLEY ROAD, SUITE 100 AND THE ACREAGE OF THE OVERALL SITE IS ABOUT 6.8 ACRES AND IT IS ZONED INDUSTRIAL DISTRICT WHICH ALLOWS RECEPTION FACILITIES BY SUP ONLY.

HERE IS A GENERAL LOCATION OF THE SUBJECT PROPERTY IN GARLAND INDICATED BY THE RED STAR.

AND HERE IS THE OVERALL SUBJECT PROPERTY OUTLINED IN TEAL.

THERE'S A BUILDING ON THE PROPERTY, BUT MORE SPECIFICALLY IN THIS KIND OF BLUE RECTANGLE THAT WE SHADED IN IS WHERE THE GENERAL LOCATION OF THE RECEPTION FACILITY IS AND WILL

[01:20:07]

CONTINUE TO BE IF APPROVED FOR THE RENEWAL.

IT IS MOSTLY SURROUNDED BY INDUSTRIAL DEVELOPMENT WITH SOME MIXTURE OF AUTO AND RETAIL USES. THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS INDUSTRY AS WELL.

AND HERE'S SOME PHOTOS. THE SUBJECT PROPERTY OR THE FRONT OF THE SUBJECT PROPERTY IS THERE ON THE LEFT, EXISTING BUILDING, AND THERE'S A NEARBY BUSINESS SHOWN ON THE RIGHT HAND PHOTO. AND HERE'S SOME ADDITIONAL PHOTOS OF OTHER USES IN THE GENERAL AREA AND JUST SOME PHOTOGRAPHS OF THE BUILDING ELEVATIONS, THE EXISTING BUILDING.

AND HERE'S THE SITE PLAN WITH THE EXISTING BUILDING HERE.

SUITE 100 IS SHOWN HERE IN THIS KIND OF GREEN BUBBLE ON THE EASTERN SIDE OF THE SITE.

SHOULD BE NOTED THAT THE PREVIOUS SUP ACTUALLY WAS FOR SUITES 100 AND 101, WHICH TOOK UP MORE SQUARE FOOTAGE, OF COURSE.

BUT THIS REQUEST IS TO LIMIT IT TO SUITE 100 ONLY.

AND THE APPLICANT AGREES WITH THE SPECIAL STANDARDS OUTLINED FOR RECEPTION FACILITIES IN THE GDC, AND THAT INCLUDES A GARLAND POLICE OFFICER ACTUALLY WORKING WITH SECURITY.

THE GDC DOES HAVE SOME SECURITY REQUIREMENTS FOR RECEPTION FACILITIES.

THE APPLICANT REQUESTS THE SUP TO BE IN EFFECT FOR 15 YEARS, WHICH ALIGNS WITH THE SUP TIME PERIOD GUIDE AND NO NO DEVIATIONS HAVE BEEN REQUESTED BY THE APPLICANT.

STAFFS RECOMMENDATION IS APPROVAL OF THE REQUEST FOR THE SUP RENEWAL AND THE PLAN AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL WITH A UNANIMOUS VOTE.

AND MAYOR, WE MAILED OUT 39 LETTERS ON THIS CASE AND WE DID NOT RECEIVE ANY RESPONSES.

CAN'T WIN THEM ALL. ALL RIGHT.

ANY QUESTIONS FOR STAFF ON THIS ITEM.

COUNCILMEMBER AUBIN.

JUST ONE QUESTION. AS I'M LOOKING AT I AND J.

WHAT'S THE DISTINCTION BETWEEN ONE'S A RENEWAL, BUT ONE'S A.

WHAT'S THE DISTINCTION BETWEEN THE TWO ITEMS? THE AGENDA ITEMS, I'M SORRY? YES, YES, YES.

I WOULD THINK IF WE JUST APPROVED I, WE WOULD BE DONE, BUT.

OH, YES, I AND J.

YES. REALLY THE REQUEST IS THE RENEWAL, THE PLAN.

IT'S REALLY JUST THE EXISTING.

THEY'RE NOT MAKING ANY CHANGES, ANY EXPANSIONS, ANYTHING LIKE THAT.

IT'S JUST PER THE STATE LAW.

AND WHEN WE HAVE SUPS AND PDS AND THE LIKE, WHICH INCLUDE PLANS.

WE ALSO HAVE TO APPROVE. RIGHT. SO THE J IS A PLAN FOR THE RECEPTION FACILITY USE? THAT'S CORRECT. JUST KIND OF SHOWING THE SITE PLAN.

IT DOESN'T QUITE READ THAT WAY. SO I WAS A LITTLE CONFUSED.

OKAY. THAT'S THE ONLY QUESTION I HAD. OTHER THAN THAT.

YEAH, IT ALL LOOKS GOOD.

THIS IS AN EXISTING RENEWAL OF IT, I THINK IS FINE.

IT'S IN AN INDUSTRIAL AREA, SO WE'RE NOT GOING TO REALLY HAVE ANY ISSUES THERE SO.

OK. I HAVE NO ONE ELSE IN THE QUEUE FOR QUESTIONS FOR STAFF.

DO WE HAVE, MADAM SECRETARY, DO WE HAVE ANY ADDITIONAL SPEAKER CARDS ON THIS ITEM.

THE APPLICANT? ILEANA ROJAS HAS REGISTERED.

OKAY, MA'AM, IF YOU CAN COME DOWN, IF YOU CAN GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, YOU CAN HAVE 10 MINUTES TO MAKE YOUR PRESENTATION OR ANSWER QUESTIONS.

IT'S UP TO YOU. MY NAME IS ILEANA ROJAS 2421 JESTER PLACE CARROLLTON.

I'M THE BUSINESS OWNER.

MR. SEAN KIM HE'S ACTUALLY THE OWNER'S SON.

SO HE'S IN THE APPLICATIONS.

HE'S THE BUILDING OWNER, BUT I'M THE BUSINESS OWNER, SO I'M HERE REPRESENTING THE BUSINESS JUST TO ANSWER ANY QUESTIONS THAT YOU GUYS MAY HAVE.

LIKE THEY MENTIONED BEFORE, THIS IS A RENEWAL.

WE'VE BEEN IN THE PROPERTY FOR SLIGHTLY OVER TEN YEARS.

SO ANY QUESTIONS THAT YOU NEED ANSWERED? I'M HERE TO ANSWER.

VERY GOOD. ANY QUESTIONS FOR THE APPLICANT? I'VE GOT NONE. THANK YOU.

THANK YOU. AND I HAVE NO ONE ELSE IN THE QUEUE.

NO OTHER SPEAKERS.

COUNCILMEMBER AUBIN. THANK YOU, MAYOR.

I MOVE THAT WE APPROVE THE SUP FOR A TERM OF 15 YEARS AND APPROVE THE DETAIL PLAN.

I HAVE A MOTION BY COUNCIL MEMBER AUBIN AND SECOND BY COUNCILMEMBER VERA TO APPROVE ITEM 7I AND J AS PRESENTED.

ANY ADDITIONAL DISCUSSION? MADAM SECRETARY, IF YOU PREPARE THE VOTE FOR US, PLEASE.

AND COUNCIL. AND DISPLAY THE VOTE.

AND THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU. AS I MENTIONED EARLIER, WE'VE HAD A REQUEST FROM THE APPLICANT ON THE NEXT TWO

[Items 7K & 7L]

[01:25:01]

ITEMS, ITEMS 7K AND 7L FOR REQUESTING A POSTPONEMENT TO OUR APRIL 19TH MEETING.

COUNCILMEMBER BASS.

I THINK OUR ATTORNEY WOULD PROBABLY APPRECIATE IT IF WE TOOK ACTION ON THE REQUEST FOR THE POSTPONEMENT.

COUNCILMEMBER BASS.

THANK YOU MAYOR. I'LL MAKE A MOTION TO APPROVE THE POSTPONEMENT.

ON ITEM 7K AND 7L? YES, ON ITEM 7K AND 7L.

THE ZONING REQUEST AND DETAIL.

ALL RIGHT. I HAVE A MOTION BY COUNCILMEMBER BASS AND A SECOND BY COUNCIL LADY MORRIS TO POSTPONE ITEM 7K AND 7L TO OUR APRIL 19TH MEETING.

MADAM SECRETARY, PREPARE THE VOTE FOR US, PLEASE.

COUNCILMEMBER VERA. AND DISPLAY THE VOTE AND THOSE POSTPONEMENT REQUESTS ARE APPROVED. AND NOW WE ARE AT 7 M CONSIDER A ZONING REQUEST BY DON

[Items 7M and 7N]

GORDON TO ALLOW A MAJOR AUTOMOTIVE REPAIR SHOP ON THE SUBJECT PROPERTY THAT IS LOCATED AT 2025 OLD MILL RUN IN DISTRICT 8.

THIS ALSO HAS A SECOND PART 7N IT IS A DETAIL PLAN REQUEST SAME APPLICANT SAME ADDRESS.

MAYOR AND COUNCIL THIS IS A PROPOSAL FOR A MAJOR AUTOMOBILE REPAIR SHOP USE ON THE SUBJECT PROPERTY. IT WOULD REQUIRE AN AMENDMENT TO THE PD, WHICH REFERS TO COMMUNITY RETAIL BASED ZONING, WHICH ALLOWS MINOR AUTOMOBILE REPAIR BY RIGHT BUT DOES NOT ALLOW MAJOR AUTOMOBILE REPAIR.

SO THAT IS THE REASON FOR THIS REQUEST COMING FORWARD.

THE LOCATION IS 2025 OLD MILL RUN.

THE APPLICANT AND OWNER IS MR. DON GORDON. ACREAGE OF THE SITE IS APPROXIMATELY 0.373 ACRES AND IS CURRENTLY ZONED IN PD 82-42, WHICH AGAIN REFERENCES THE BASE COMMUNITY RETAIL ZONING.

HERE'S A GENERAL LOCATION INDICATION OF THE SUBJECT PROPERTY.

AND MORE SPECIFICALLY, IT IS SHOWN HERE THIS IS THE EXISTING PROPERTY BUILDING.

THERE'S A BUILDING ON THE PROPERTY OF COURSE, OLD MILL RUN IS SHOWN HERE AND BUCKINGHAM ROAD IS JUST TO THE SOUTH.

SO SOME OF THE SURROUNDING LAND USES, THERE'S AT LEAST ONE OTHER AUTO REPAIR USE IN THE AREA, AS WELL AS A COMMUNITY CENTER TO THE SOUTH, RETAIL SHOPPING CENTER TO THE EAST, ACROSS OLD MILL RUN AND SOME SINGLE FAMILY RESIDENCES TO THE WEST.

THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS NEIGHBORHOOD CENTERS, WHICH GENERALLY ALIGNS WITH SERVICES, RETAIL AMENITIES AND THE LIKE.

THE FRONT OF THE SUBJECT PROPERTY IS SHOWN HERE ON THE LEFT AND THERE'S JUST SOME ADDITIONAL PHOTOS OF THE AREA AND WE HAVE SOME ADDITIONAL PHOTO.

HERE'S THE SITE PLAN BUT SIMILAR TO THE PREVIOUS CASE, NOT REALLY MUCH IN THE WAY OF CHANGES, CERTAINLY NO BUILDING EXPANSIONS BEING PROPOSED.

IT'S MOSTLY THE EXISTING IMPROVEMENTS WHERE THE APPLICANT IS PROPOSING TO MOVE THE USE INTO. HERE'S SOME ADDITIONAL PHOTOGRAPHS OF THE SUBJECT PROPERTY.

HERE'S THE NORTH ELEVATION, THE FRONT OF THE BUILDING HERE AND GOING BACK TO THE REAR OF THE BUILDING THROUGH THIS DRIVEWAY THERE.

AND THE WEST ELEVATION THAT IS IN THE BACK OF THE PROPERTY.

SCREENING, THERE'S AN ALLEYWAY.

THIS IS BEHIND THE PROPERTY JUST TO THE WEST OF THE SUBJECT PROPERTY THERE'S AN ALLEYWAY THERE. THERE'S A BRICK WALL AS YOU CAN SEE, THERE LOOKS TO BE ABOUT SIX FEET IN HEIGHT.

AND THEN THERE'S A WOODEN FENCE, EXISTING EIGHT FOOT WOODEN FENCE SURROUNDING THE SUBJECT PROPERTY. THE APPLICANT REQUESTS THE MAJOR AUTO REPAIR USE TO BE ALLOWED BY RIGHT THROUGH PD 82-42.

NO DEVIATIONS HAVE BEEN REQUESTED BY THE APPLICANT.

THE APPLICANT HAS MENTIONED THAT THE INTENT OF THE BUSINESS IS FOR BODYWORK AND PAINTING.

SO ONE OF STAFF'S RECOMMENDATIONS, STAFF RECOMMENDATION IS APPROVAL OF THE REQUEST.

BUT WE HAVE DRAFTED A PD CONDITION PROHIBITING MECHANICAL REPAIRS ORDINARILY ALLOWED IN MAJOR AUTO REPAIRS, SUCH AS ENGINE AND TRANSMISSION REPAIRS.

AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL.

AND THEY HAD AN ADDITIONAL RECOMMENDATION THAT ALL REPAIR VEHICLES SHOULD BE STORED IN THE REAR OF THE PROPERTY AND ALL REPAIR WORK SHALL REMAIN IN THE EXISTING BUILDING.

AND A PD CONDITION HAS ALSO BEEN DRAFTED ACCORDINGLY IN YOUR AGENDA PACKETS.

[01:30:03]

AND MAYOR, WE MAILED OUT 46 LETTERS ON THIS CASE.

WE RECEIVED FIVE IN FAVOR AND FOUR IN OPPOSITION.

THOSE WERE ALL WITHIN THE NOTIFICATION AREA.

VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? I HAVE NONE. THANK YOU, SIR.

MADAM SECRETARY. THE APPLICANT, DON GORDON, HAS REGISTERED TO SPEAK.

MR. GORDON, IF YOU COME FORWARD AND GIVE US YOUR NAME AND ADDRESS.

AND YOU HAVE 10 MINUTES TO MAKE A PRESENTATION OR JUST ANSWER QUESTIONS UP TO YOU.

DON GORDON, 6 DUNROBIN GARLAND, TEXAS 75044.

I'LL JUST ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE.

ANY QUESTIONS FOR THE APPLICANT? NOTHING. THANK YOU. ALL RIGHT.

THANK YOU. AND I BELIEVE THAT WAS OUR ONLY SPEAKER ON THIS ITEM.

CORRECT? HE WAS THE ONLY SPEAKER.

OKAY. VERY GOOD.

COUNCIL MEMBER SMITH.

THANK YOU, MAYOR. MOVE TO APPROVE ITEMS M AND N PER THE PLANNING COMMISSION'S RECOMMENDATIONS. VERY GOOD.

SECOND. I HAVE A MOTION BY COUNCIL MEMBER SMITH AND A SECOND BY MAYOR PRO TEM HEDRICK TO APPROVE ITEM 7M AND N AS RECOMMENDED.

ANY DISCUSSION? SORRY. MADAM SECRETARY, IF YOU CAN PREPARE THE VOTE FOR US, PLEASE.

AND COUNCIL.

AND DISPLAY THE VOTE.

AND THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU, SIR. THAT BRINGS US TO ITEM 7 O.

[7O. Consideration for final approval of the determination not to update Land Use Assumptions, Capital ImprovementsPlan, or Impact Fees.]

CONSIDERATION FOR FINAL APPROVAL OF THE DETERMINATION NOT TO UPDATE LAND USE ASSUMPTIONS, CAPITAL IMPROVEMENTS, PLAN OR IMPACT FEES.

MAYOR COUNCIL A LOT OF ITEMS. THAT'S AN INTERESTING, INTERESTING SENTENCE.

YOU HAVE SOME EXPLANATION FOR US, I'M SURE.

WELL, I DON'T HAVE A FORMAL PRESENTATION ON THIS ONE.

I'LL JUST HOPEFULLY KEEP IT FAIRLY SIMPLE AND TO THE POINT.

BUT JUST AS A BRIEF BACKGROUND, THE STAFF BROUGHT A BRIEFING TO THE COUNCIL FOR THIS ITEM ON DECEMBER 6TH, 2021, AT YOUR WORK SESSION THEN AND BRIEFED THE PLANNING COMMISSION AS WELL BEFORE THAT ON NOVEMBER 11TH.

THE PLANNING COMMISSION, AS A REMINDER, SERVES AS THE CAPITAL IMPROVEMENTS ADVISORY COMMITTEE, OR CIC, IS AN ACRONYM WHICH REVIEWS IMPACT IMPACT STUDIES AND REPORTS AND THE LIKE. THAT'S PER FOR THE CITY ORDINANCE.

THE STATE MANDATES THAT CITIES WHO COLLECT IMPACT FEES TO REVIEW THE IMPACT FEES AND THE STUDIES ON WHICH THOSE ARE BASED EVERY FIVE YEARS.

SO IT'S BEEN ACTUALLY FIVE YEARS SINCE THE COUNCIL, SOME OF YOU MAY REMEMBER ADOPTING THE IMPACT FEE STUDY THAT WE BROUGHT FORWARD WITH KIMLEY-HORN .

SO IT'S ALREADY BEEN FIVE YEARS, SO TIME TO REVIEW IT.

BUT STAFF AND CONSULTING WITH THE ENGINEERING DEPARTMENT, WATER DEPARTMENT AND OUR CONSULTANT FROM KIMLEY-HORN WHO IS STILL THERE AND DID OUR STUDY THEN IT WAS DETERMINED AND RECOMMENDED THAT A NEW STUDY IS NOT NECESSARY AT THIS TIME AS WE CONTINUE PROJECTS AND THE LIKE, ESPECIALLY FROM THE BOND PROGRAM.

BUT IT WILL BE LIKELY THAT FIVE YEARS FROM NOW WE'LL NEED A NEW STUDY AT THAT TIME.

AND AS A BRIEF REMINDER, WE DO COLLECT WATER AND ROADWAY IMPACT FEES WITH NEW DEVELOPMENT.

SO STAFF'S RECOMMENDATION IS NO CHANGES TO THE STUDY AND THE IMPACT FEES AND WE RECOMMEND APPROVAL OF THE ORDINANCE.

VERY GOOD. ANY QUESTIONS ON THIS ITEM? I HAVE NONE. AND DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MAYOR.

MAYOR. I'LL MOVE FORWARD FOR APPROVAL ON THIS ITEM AS RECOMMENDED BY STAFF.

OKAY. AND I HAVE A COUPLE OF FOLKS PUNCH IN AT THE SAME TIME.

DEPUTY MAYOR PRO TEM WILLIAMS HAS MADE A MOTION TO APPROVE MAYOR PRO TEM HEDRICK.

SECOND, ANY FURTHER DISCUSSION? MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE.

OH AND COUNCIL.

AND DISPLAY THE VOTE.

THAT ITEM IS APPROVED UNANIMOUSLY.

THANK YOU. THAT WAS OUR LAST ITEM FOR INDIVIDUAL CONSIDERATION THAT MOVES US TO ITEM 8.

[8. Consider appointments to Boards and Commissions.]

CONSIDER APPOINTMENTS TO BOARDS AND COMMISSIONS.

COUNCIL MEMBER AUBIN.

I BELIEVE YOU HAVE A NOMINATION THIS EVENING.

[01:35:03]

GO AHEAD. IT'S ON. THANK YOU, MAYOR YES, I DO.

TONIGHT FOR BOARD OF ADJUSTMENT, I HAVE MARGARET BICE, WHO ALL KNOW AS [INAUDIBLE] BICE.

SHE'S OVER HERE.

THIS IS ONE OF OUR NEIGHBOR OF THE YEAR.

WHAT WERE YOU THIS YEAR? WHO'S WHO IN GARLAND NEIGHBORS NOW ALSO WANTING TO BE ONE OF OUR WHO'S WHO ON THE BOARDS AND COMMISSION. SO.

SO I NOMINATE MARGIE FOR BOARD OF ADJUSTMENT.

VERY GOOD APPOINTMENTS DO NOT NEED A SECOND.

SO WE HAVE THE NOMINATION FOR MARGARET BICE TO THE BOARD OF ADJUSTMENT.

MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE AND COUNCIL AND DISPLAY THE VOTE AND THAT NOMINATION IS APPROVED UNANIMOUSLY.

WE EXPECT GREAT THINGS FROM YOU.

THANK YOU. THE NEXT ITEM ON OUR AGENDA IS ITEM 9.

[9. Citizen comments.]

CITIZEN COMMENTS.

PERSONS WISHING TO ADDRESS ISSUES NOT ON THE AGENDA MAY HAVE 3 MINUTES TO ADDRESS COUNCIL. AT THIS TIME, COUNCIL IS PROHIBITED FROM DISCUSSING ANY ITEM NOT POSTED, ACCORDING TO THE TEXAS OPEN MEETINGS ACT.

MADAM SECRETARY, DO WE HAVE ANY SPEAKERS REGISTERED? WE HAVE NO SPEAKERS REGISTERED MAYOR LEMAY.

OKAY. DO WE HAVE ANYONE WHO WOULD LIKE TO SPEAK THIS EVENING? I'M GOING TO ASK YOU TO DO TWO THINGS.

YOU CAN COME FORWARD, GIVE YOUR NAME AND ADDRESS FOR THE RECORD.

AND I'M GOING TO ASK YOU TO FILL OUT A SPEAKER CARD BEFORE YOU LEAVE.

IS THERE ANYONE WHO WOULD LIKE TO SPEAK TO THE COUNCIL? PLEASE COME FORWARD.

GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, AND YOU WILL HAVE 3 MINUTES.

MY NAME IS CHASTITY LLEWELLYN.

MY ADDRESS IS 1110 BAR DRIVE GARLAND, TEXAS.

IS THAT GOOD ENOUGH? OKAY, GREAT.

SO I'VE ALREADY HAD SOME DISCUSSIONS, SO SOME OF THIS MIGHT SEEM REDUNDANT, BUT NOT TO SOUND REDUNDANT. I AM A BUSINESS OWNER.

I OWN THE BUSINESS AT 414 WEST AVENUE D.

MY REPRESENTATIVE IS DISTRICT TWO DEBORAH MORRIS, AND THERE ARE SOME ISSUES WITH SEVERAL OF THE FOOD TRUCKS AND THINGS LIKE THAT.

AND I AM ONE OF THE BUSINESSES THAT IS A PROPRIETOR FOR IT.

I AM, FOR ALL INTENTS AND PURPOSES, A HUSTLER, AND I'M HUSTLING THE TRUCKS TO BE ABLE TO PAY FOR AND OFFSET MY BUSINESS COSTS AS A SMALL BUSINESS.

AND I MEAN SMALL.

AND MY PROBLEM WITH IT IS, IS I DON'T KNOW WHY THERE IS AN ORDINANCE, PERIOD, END OF STORY. WHY DO WE NEED REGULATIONS AND WHY DO WE NEED YOUR HOLY HUDDLE TO TELL US HOW TO DO IT? I DON'T UNDERSTAND THAT, AND I DON'T THINK A LOT OF PEOPLE DO.

AND THERE'S A LOT OF QUESTIONS THAT ARE BEING ANSWERED, BUT THEN THERE ARE SOME THAT AREN'T, AND THERE'S TOO MUCH CONFUSION AND CHAOS.

AND I AM TRYING TO BRING OUR COMMUNITY TOGETHER, NOT SEPARATE IT.

I DON'T SEE THE TRUCKS AS MY COMPETITORS.

I SEE THEM AS OUR COMMUNITY.

AND LORD KNOWS THAT THE GARLAND COMMUNITY NEEDS MORE TOGETHERNESS.

SO THAT'S WHAT I HAVE TO SAY.

TAKE IT OR LEAVE IT.

YOU MAY NOT LIKE IT, BUT THAT'S THE WAY I RUN MY BUSINESS.

I RUN COMMUNITY.

I DON'T RUN BUSINESS, I RUN COMMUNITY.

SO I FEEL LIKE IF MORE OF US DID THAT, A LOT OF THINGS WOULD GO BETTER INSTEAD OF US MAKING DECISIONS THAT REALLY AFFECT A LOT OF PEOPLE.

MAYBE IMMEDIATELY SOUNDS GOOD, BUT ON DOWN THE ROAD THERE ARE REPERCUSSIONS, JUST LIKE THROWING A PEBBLE IN THE WATER.

THE RIPPLES, THE RIPPLE EFFECT.

I JUST NEED YOU TO LISTEN TO THAT.

THANK YOU. THANK YOU.

AND IF SOMEBODY COULD FOLLOW HER UP WITH A SPEAKER CARD, I'D APPRECIATE THAT.

IS THERE ANYONE ELSE WHO WOULD LIKE TO ADDRESS THE COUNCIL? I SEE NONE.

AND WITH THAT, AT 8:39, WE ARE ADJOURNED.

THANK YOU ALL VERY MUCH.
