IT IS THE CUSTOMER TRADITION OF THIS COUNCIL TO HAVE AN INVOCATION AND RECITAL OF THE PLEDGE OF ALLEGIANCE PRIOR TO OUR MEETINGS, UH, LED BY ONE OF OUR COUNCIL MEMBERS.

UH, YOUR DECISION IS STRICTLY A MATTER OF YOUR OWN CHOICE.

SHOULD YOU WANT TO PARTICIPATE? UH, IF YOU DO NOT, UH, THAT IT WILL NOT HAVE ANY IMPACT ON THE DECISIONS WE MAKE HERE THIS EVENING.

AND TONIGHT WE WILL BE LED BY COUNCILMEMBER BASS FROM DISTRICT ONE, SIR.

THANK YOU, MAYOR.

UM, FIRST OF ALL, I'D LIKE TO START OFF BY SAYING, UH, COUNCILMAN ROBERT VERUS FAMILY HAS SUFFERED A TRAGEDY RECENTLY.

UH, PLEASE KEEP HIS FAMILY IN YOUR PRAYERS.

AS HE HAS LOST HIS GRANDSON TO A TERRIBLE ACCIDENT.

CADEN, ROBERT VERA LIVED LIFE TO THE FULLEST EVERY DAY AND BROUGHT A SMILE AND LAUGHTER TO ALL WHO MET HIM.

HE WAS AN HONOR ROLL AND STRAIGHT A STUDENT RECENTLY PLACING SECOND IN STATE IN DIVING FOR HIS FIVE 80 SCHOOL.

AS A FRESHMEN, KAYDEN WILL ETERNALLY BE 14 YEARS OLD, BUT MAY HE BE IN OUR PRAYERS FOREVER? IF YOU'D LIKE TO JOIN IN AND BOW YOUR HEADS.

THANK YOU LORD, FOR BLESSING US AND ALLOWING US TO BE IN THIS COUNTRY.

IN THIS STATE, IN THIS CITY, WE ARE TRULY BLESSED TO BE HERE WITH THE ABILITY TO HAVE OUR VOICES HEARD AND WHERE OUR OPINIONS MATTER.

WE ARE BLESSED TO HAVE A CITY COUNCIL PACKED WITH SERVANT LEADERS.

WE ARE BLESSED TO HAVE SUCH HIGH CALIBER CITY STAFF WHO TRULY HAVE THE FUTURE OF GARLAND IN THEIR FOREMOST THOUGHTS.

I THANK YOU LORD, FOR THESE BLESSINGS THAT YOU BESTOW ON US DAILY AND PRAY THAT WE DO NOT TAKE YOUR BOUNTY FOR GRANTED.

WELL, IT IS A LITTLE CLOSER.

HOW ARE YOU? IT IS THE FIRST MEETING OF THE MONTH.

UM, AND WE DESIGNATE THAT AS OUR PET OF THE MONTH MEETING.

AND AMY BRINGS US SOMEONE FROM OUR SHELTER WHO WAS WITH US TONIGHT.

WELL, I HAVE MANY SHE'S A SIX MONTH OLD PUPPY LOOKING FOR HER FOREVER HOME IN, LET ME TELL YOU, SHE DEFINITELY GOT STAGE FRIGHT.

THIS THAT'S WHEN WE WALKED IN OUTSIDE, SHE WAS PLAYING IN AND RUN IN.

AND THEN SHE CAME IN.

SHE WAS LIKE, PEOPLE I'M JUST GOING TO BE A BIG BABY IN HER ARMS. SO SHE CAME TO US AS A STRAY AND SHE IS HERE TO REMIND EVERYBODY THAT YOU SHOULD ADOPT AND NOT SHOP.

AND THAT THERE'S MANY MORE VERY FRIENDS, JUST LIKE HER AT OUR SHELTER, LOOKING FOR THEIR FOREVER HOMES.

AND THERE'S LOTS OF WAYS THAT WE SPONSOR OPTIONS.

WHETHER YOU'RE A CITY OF GARLAND EMPLOYEE, YOU'RE A FIREFIGHTER, A VETERAN, A POLICE OFFICER, A GIS D TEACHER.

UH, IF IT'S YOUR BIRTHDAY, IF YOU'RE A CITY SENIOR CITIZEN, THERE'S LOTS OF WAYS THAT WILL HELP YOU FIND YOUR FOREVER HOME.

SO ALL YOU HAVE TO DO IS STOP BY WHAT IF YOU'RE A BOY SCOUT? I THINK YOU CAN MAKE A SPECIAL EXCEPTION FOR THE BOY SCOUTS.

THANK YOU, MAYOR AND COUNCIL, UM, FOR THE OPPORTUNITY TO COME BEFORE YOU TONIGHT TO DO A SPECIAL RECOGNITION FOR OUR GARLAND YOUTH COUNCIL MEMBERS WHO WILL BE GRADUATING THIS YEAR AND LEAVING OUR AMAZING PROGRAM AND, UH, LEAVING A LEGACY, UH, THESE YOUNG LADIES AND GENTLEMEN THAT ARE UP HERE TRULY PUT A LOT OF WORK THIS YEAR INTO OUR PROGRAM.

UM, MY NAME FOR THOSE OF YOU THAT DON'T KNOW, UM, THE GARLAND YOUTH COUNCIL IS A PROGRAM

THAT IS A CITY SPONSORED AND THAT TEACHES STUDENTS ABOUT CITY FUNCTIONS.

AND WE GO OUT, WE MEET TWICE A MONTH.

WE DO A SERVICE VOLUNTEER OPPORTUNITIES WHILE WE TALK WITH DEPARTMENTS AND LOOK FOR WAYS ON HOW WE CAN PARTNER, UH, THROUGHOUT THE YEAR.

AND SO I JUST WANT TO TAKE THIS TIME TO THANK YOU ALL FOR YOUR DEDICATION TO THE PROGRAM AND FOR MAKING THIS AN AMAZING YEAR.

UM, I'LL START HERE TO MY RIGHT WITH, WITH MS. LEE UP THERE AGAIN, MR. JONATHAN SIMON, MS. SERENE HAROUN AND MS. VICTORIA PENNICK.

AND I WILL SAY, UH, THIS YEAR WE HAD 18 YOUTH COUNCIL MEMBERS AND UNFORTUNATELY THE OTHER GRADUATING SENIORS WERE UNABLE TO COME THIS EVENING, BUT I STILL WOULD LIKE TO RECOGNIZE THEM.

WE ARE LOSING HALF OF OUR MEMBERS FOR THE THIS YEAR.

AND SO I WOULD JUST LIKE TO RECOGNIZE THOSE THAT WERE UNABLE TO ATTEND MR. JULIAN BROWN GRIFFIN, MR. , MS. HEATHER MOODY, MS. MARYANNE OD BOY AND MR. CHRISTIAN WILLIAMS. THANK YOU VERY MUCH AGAIN, MAYOR FOR THE OPPORTUNITY.

AND WE LOOK FORWARD TO, UH, AS WAS STATED YESTERDAY AT THE WORK SESSION TO MAYBE SEEING SOME OF THESE LEADERS ON THE OPPOSITE SIDE HERE, UM, THERE'S A GREAT FUTURE IN THEIR HANDS.

UM, THEY'RE GREAT LEADERS.

THEY'RE THEY HAVE A SERVANT HEART AND THEY LOVE THEIR GARLAND COMMUNITY.

UH, YOU KNOW, THIS GROUP, UH, YOU KNOW, WE, WE ARE LOSING HALF OF OUR YOUTH COUNCIL, UH, SO THAT, WHAT THAT REALLY, I MEAN, THAT'S WHAT THAT REALLY MEANS IS WE HAVE NINE OPENINGS, UH, AND WE ARE TAKING APPLICATIONS AS WE SPEAK.

SO, UH, BUT THIS GROUP HAS DONE A LOT OF WORK THIS YEAR.

YOU KNOW, WE WENT THROUGH A COUPLE OF YEARS, OBVIOUSLY WITH COVID RESTRICTIONS WHERE THE YOUTH COUNCIL COULDN'T DO A WHOLE LOT OF ANYTHING.

UM, BUT THIS YEAR THEY CAME BACK FULL ON, UH, THEY HAD LOTS OF SERVICE OPPORTUNITIES, LOTS OF ACTIVITIES THAT THEY DID, UH, ALL YEAR LONG.

SO THANK YOU.

CONGRATULATIONS, COME BACK AND SEE US.

AND YES, SOMEDAY, I HOPE TO SEE ONE OF YOUR NAMES UP HERE ON THIS BOARD.

WELL, WHAT WE HAVE HERE IS PUBLIC SERVICE RECOGNITION WEEK.

UH, WE ARE, UH, WE ARE OBSERVING THAT THIS WEEK, UH, AMERICANS ARE SERVED EVERY SINGLE DAY BY PUBLIC SERVANTS AT THE FEDERAL STATE COUNTY AND CITY LEVEL.

THESE UNSUNG HEROES DO THE WORK THAT KEEPS OUR NATION AND COMMUNITIES WORKING IN THE FACE OF UNPRECEDENTED CHALLENGES.

DURING THE PAST TWO YEARS, LIKE MANY OTHER PUBLIC SERVANTS, OUR DEDICATED EMPLOYEES HAVE RISEN TO THE MOMENT, UH, BRINGING STRENGTH, HEALING, AND HOPE THAT EXTENDS TO THOUSANDS OF FAMILIES AND BUSINESSES AND VISITORS HERE IN GARLAND.

UH, WORKING WITH THE CITY OF GARLAND IS MUCH MORE THAN A JOB.

UH, PUBLIC SERVANTS, UH, TAKE AN UNSPOKEN OATH, UH, TO SERVE OUR COMMUNITY.

AND WE ASK, WE ASK A LOT OF THEM, MANY PUBLIC SERVANTS, INCLUDING MILITARY PERSONNEL, POLICE OFFICERS, FIREFIGHTERS, PARAMEDICS, MARSHALL'S HEALTH CARE PROFESSIONALS, AND OTHERS RISK THEIR LIVES EACH DAY IN SERVICE TO OUR COMMUNITY.

WITHOUT THESE PUBLIC SERVANTS AT EVERY LEVEL CONTINUITY OF SERVICES AND SUSTAINABILITY OF LIFE WOULD NOT BE POSSIBLE.

WHEREAS WE CELEBRATE, UH, THE FIRST FULL WEEK OF MAY.

THIS HAS BEEN THE CELEBRATES SINCE 1985 PUBLIC SERVICE RECOGNITION WEEK IS A TIME SET ASIDE TO HONOR THE MEN AND WOMEN WHO SERVE OUR NATION AT FEDERAL STATE COUNTY AND LOCAL GOVERNMENT LEVELS.

UH, PUBLIC SERVICE RECOGNITION WEEK CONNECTS AND EDUCATE CITIZENS NATIONWIDE TO THE WORK THAT OUR GOVERNMENT, UH, CELEBRATES AND CELEBRATES THE DEDICATION AND EFFORTS OF THE PUBLIC SECTOR, EMPLOYEES WHO HELP AND HELP INSPIRE NEW GENERATION OF PUBLIC SERVANTS.

UH, AND SO, WHEREAS ALL CITIZENS ARE ENCOURAGED TO RECOGNIZE THE ACCOMPLISHMENTS AND CONTRIBUTIONS OF GOVERNMENT EMPLOYEES AND VOLUNTEERS AT ALL LEVELS.

UM, IT, UH, IT TRULY HAS BEEN, UH, SHALL WE SAY A CHALLENGING AND EXCITING COUPLE OF YEARS FOR PUBLIC SERVICE AND I COULD NOT BE MORE PROUD OF THE EMPLOYEES WE HAVE AT GARLAND AND FOR THE WAY THEY HAVE STEPPED UP AND, AND MET THOSE CHALLENGES.

THE, UM, PUBLIC SERVICE IS REALLY MORE OF A CALLING THAN IT IS A CAREER.

AND I THINK THAT EXEMPLIFIES OUR 2200 EMPLOYEES, UH, VERY, VERY WELL.

UH, THE CITY OF GARLANDS VALUES WERE FOUNDED AND BUILT UPON A STEADFAST AND ABIDING BELIEF IN GOD AS REFLECTED BY THE EXISTENCE OF VIBRANT CHURCHES.

SOME OF WHOM HAVE EXISTED FOR OVER 150 YEARS IN OUR CITY, UH, THROUGHOUT OUR HISTORY.

UH, THE CITY OF GARLAND HAS UNITED IN PRAYER TO HUMBLY ASK GOD FOR STRENGTH AND PROVISION.

DURING TIMES OF DIFFICULTY, UH, PRAYER HAS SUSTAINED THE CITY, UH, THROUGHOUT MANY YEARS, PROVIDING PEACE AND GUIDANCE IN TIMES OF CRISIS CAUSED BY TORNADOES FLOODS, UH, COVID-19 PANDEMIC AND OTHER DISASTERS, UH, PRESENTLY THE IMPACTS OF THE UNPRECEDENTED CORONAVIRUS PANDEMIC HAVE LESSENED, BUT CONTINUE TO CREATE CHALLENGING TIMES OF UNREST AND STRESS.

WE ACKNOWLEDGED THE IMPACT OF THIS, UH, INTERNATIONAL PANDEMIC ON OUR LOCAL AND NATIONAL GOVERNMENT SUPPLY CHAIN, FAMILIES AND INDIVIDUALS, BUSINESSES, EDUCATIONAL INSTITUTIONS, STUDENTS, NONPROFITS, AND FIRST RESPONDERS, INCLUDING FIRE AND POLICE DEPARTMENTS.

IT SEEMS FITTING THAT NOW MORE THAN EVER, WE NEED TO RALLY TOGETHER TO UNITED PRAYER FOR THE CITY OF GARLAND, THE STATE OF TEXAS, THE NATION AND OUR LEADERS, UH, THAT WE WOULD BE ROOTED AND GROUNDED IN HIM.

SO, WHEREAS CITIZENS OF GARLAND ARE REQUESTED TO PAUSE FOR ONE MINUTE, BEGINNING AT 12 NOON ON THURSDAY, MAY 5TH, 2022 TO PRAY SPECIFICALLY FOR QUIETLY REFLECT ON THE WELLBEING OF OUR FELLOW CITIZENS, THE SUSTAINABILITY OF OUR LOCAL BUSINESSES, THE MENTAL, SPIRITUAL, AND PHYSICAL HEALTH OF OUR CITIZENS AND STRENGTH OF OUR INSTITUTIONS.

SO NOW THEREFORE I, SCOTLAND MAY MAYOR THE CITY OF GARLAND LOW WITH THE CITY COUNCIL DO HEREBY PROCLAIM THURSDAY, MAY 5TH, 2022 GARLAND NATIONAL DAY OF PRAYER.

AND I WILL PRESENT THIS TO YOU.

MY NAME IS KIRBY RICHMOND ON THE ASSOCIATE PASTOR LAVONNE DRIVE BAPTIST CHURCH IN, UH, JUST SO HONORED TO BE A PART OF THE NATIONAL DAY OF PRAYER IN OUR ORGANIZERS, MRS. DOROTHY BROOKS IN, UH, WE WERE SO THANKFUL FOR DOROTHY AND ALL THAT SHE DOES THROUGHOUT OUR COMMUNITY THROUGHOUT THE YEAR IN, UH, WE WANT TO INVITE YOU TO COME AND BE A PART OF THE NATIONAL DAY OF PRAYER IN OUR FAMILY, MOVED HERE ABOUT SEVEN YEARS AGO TO TAKE THIS POSITION AT LAVON DRIVE.

AND IN THOSE SEVEN YEARS, IT'S AMAZING WHAT WE HAVE GONE THROUGH.

AND AS THE MAYOR HAS ALREADY MENTIONED TO THINK IN JUST SEVEN YEARS, WE'VE GONE THROUGH MULTIPLE TORNADOES, SOME SEVERE HEALTH STORMS, FLOODING AND IN COVID.

AND, UM, AND THEN, UH, THE, THE FAMOUS SNOWMAGEDDON.

AND, UH, SO WE'VE ALL ENDURED THAT.

AND, UH, WE EXPERIENCED THAT.

AND SO I THOUGHT ABOUT HOW AMAZING IT WAS.

IT'S TRUE.

ALL OF THAT, THE CITIZENS OF GARLAND STEPPED UP TO HELP ONE ANOTHER AND, UH, WHETHER IT WAS THE TORNADOES OR WHATEVER, IT MAY BE.

PEOPLE CAME TOGETHER.

AND I ABOUT THE FACT THAT HOW STRANGERS FOR MANY CULTURES JUST LOOK AROUND THE ROOM HERE, EVEN AMONGST OUR VOLUNTEERS HERE, HOW MANY CULTURES ARE REPRESENTED

HERE FROM ALL AROUND THE WORLD, HOW THAT WE CAN COME TOGETHER THROUGH AND OVERCOME THESE CHALLENGES, HOW IS THAT POSSIBLE? AND IN HONOR OF THE NATIONAL DAY OF PRAYER, IT'S ONLY BY THE GRACE OF GOD THAT WE CAN DO THAT AND PRAYER.

AND SO THAT'S WHY WE WANT TO GET TOGETHER.

THE NATIONAL DAY OF PRAYER IS ANOTHER OPPORTUNITY FOR ALL OF US TO COME TOGETHER AND AS CHRIST FOLLOWERS ACROSS OUR CITY, THE SET ASIDE PREFERENCES AND OUR GOVERNMENT OFFICIALS MAY BE THE SET ASIDE, SOME PARTY LINES AND CONVICTIONS THAT THEY MAY HAVE, BUT TO TRULY UNITE IN PRAYER FOR OUR COMMUNITY.

AND SO ON THURSDAY, WE'LL MEET TOGETHER.

I LIVE ON DRY BAPTIST CHURCH ON LAVON DRIVE, CLOSE TO BUCKINGHAM.

THERE WE'D LOVE FOR YOU TO JOIN US.

OUR THEME THIS YEAR, AS THE MAYOR HAS ALREADY MENTIONED IS FROM COLOSSIANS CHAPTER TWO, VERSES SIX AND SEVEN, AND OUR THEME IS ROOTED AND BUILT UP IN CHRIST.

AND SO WE'RE INVITING EACH OF YOU TO JOIN US IN PERSON, AS WE BOMBARD GOD'S THRONE AND ASKING HIM FOR HIS BLESSING AND HIS WISDOM, WE'LL BE PRAYING FOR ALL OF YOU AS CITIZENS OF OUR COMMUNITY.

WE'LL BE PRAYING FOR OUR GOVERNMENT LEADERS AND, UH, ON OUR NATIONAL LEVEL AND OUR STATE LEVEL, BUT DEFINITELY EVEN ON OUR CITY LEVEL.

ON MARCH 31ST, 2022, JONATHAN RINGO TEMPLE FREE BORN ACHIEVED THE RANK OF EAGLE SCOUT AND HAS EARNED AND HAS EARNED THE ON MY HONOR AWARD IN HIS FAITH, BOTH AS CUB SCOUT AND AS A BOY SCOUT, THE EAGLE SCOUT AWARD IS THE HIGHEST FORM OF RECOGNITION IN THE BOY SCOUTS OF AMERICA.

AND ITS ATTAINMENT REPRESENTS A SIGNIFICANT ACCOMPLISHMENT.

JONATHAN BEGAN HIS SCOUTING CAREER AS A CUB SCOUT WITH PAC 10 44 IN JUNE OF 2014.

HE EARNED HIS ARROW OF LIGHT IN DECEMBER OF 2016 AND CROSSED OVER TO BOY SCOUT TROOP 100, WHO ARE ALL HERE WITH US THIS EVENING.

UH, LET'S SEE, TRIPLE 100 IN JANUARY OF 2017, HE WAS ALSO A MEMBER OF TROOP 10 44 FROM MAY, 2017 THROUGH DECEMBER, 2019.

HE IS A MEMBER OF SEA SCOUT SHIP, 49 50 AND VENTURING CREW ONE.

IN THIS CASE, IT WAS ABOUT 1.3 MILLION OF A CERTIFICATES OF OBLIGATION SERIES 2012, IN ORDER TO GET COST SAVINGS.

WE WERE ANTICIPATING ABOUT 66,000 OF SAVINGS WITH THIS BOND REFUNDING.

HOWEVER, AS MOST OF Y'ALL HAVE PROBABLY HEARD WITHIN THE INFLATIONARY CRISIS, THAT'S GOING ON IN THE UNITED STATES WITH THE FEDERAL RESERVE, RAISING INTEREST RATES, INTEREST RATES HAVE GONE UP AND TODAY WHEN WE PRICED IT DIDN'T MAKE SENSE FOR US TO REFINANCE THE SMALL PIECE.

SO I'M THE MAYOR PRO TEM HENDRICK DID A GREAT JOB OF REPORTING THE DEVELOPMENT SERVICES COMMITTEE RECOMMENDATIONS BACK ON YOUR WORK SESSION ON APRIL 4TH.

SO, UM, A LOT OF WHAT I'M GOING TO PRESENT AS KIND OF A REPETITION OF THAT, BUT I'LL JUST KIND OF RUN THROUGH IT HERE.

UH, THERE ARE SOME AMENDMENTS PROPOSED, UH, HERE RECOMMENDED BY THE COMMITTEE, UM, RELATED PRIMARILY TO CELLULAR TOWERS AS WELL AS ONE, UM, CLEANUP AND THE GDC RELATED TO MULTI-FAMILY PARKING, BUT I'LL JUST, UM, JUMP RIGHT INTO THE, UH, RED LINES HERE.

OF COURSE THE CHANGES ARE INDICATED IN RED HERE.

SO I'LL JUST KIND OF START FROM THE TOP.

UH, AS A REMINDER, AS THE COMMITTEE REPORTED, UM, CELLULAR TOWERS, AS WELL AS, AS BRIEF BACKUP AND REMINDER, UM, THE COMMITTEE, UH, WANTED TO OBSERVE OUR CURRENT GDC REGULATIONS RELATED TO CELLULAR CELLULAR TOWERS TO SEE HOW THEY MATCH UP WITH OTHER CITIES.

UH, WE ALSO BROUGHT AN EXPERT WHO HAPPENED TO BE AN APPLICANT FOR A COUPLE OF CELL TOWERS WHO CAME THROUGH THE PUBLIC HEARING PROCESS.

SO, UH, HIS INPUT WAS VERY VALUABLE AND, UM, ULTIMATELY THIS WAS, UM, UH, REALLY WHAT THE COMMITTEE, UH, ENDED UP WITH RECOMMENDATION WISE.

SO THAT INCLUDES, UM, ALLOWING, UH, CELL TOWERS BY SUP ONLY IN RESIDENTIAL ZONING DISTRICTS.

CURRENTLY, THEY'RE NOT ALLOWED AT ALL WITH A COUPLE OF, UM, VERY SPECIFIC EXCEPTIONS, BUT THIS WOULD ALLOW AT LEAST THE POSSIBILITY TO REVIEW IT ON A CASE BY CASE BASIS, UH, BY SUP IF A FREESTANDING CELLULAR TOWER IS PROPOSED IN A RESIDENTIAL ZONING DISTRICT, AS OPPOSED TO EITHER BANNING IT ALTOGETHER OR REQUIRING AN ENTIRE, UM, UH, PLANT DEVELOPMENT PD.

UM, AND THEN AS FAR AS NON RESIDENTIAL AND MIXED USE DISTRICTS, UM, CURRENTLY, UH, FREESTANDING TOWERS NOT ALLOWED, UM, UH, OR IT'S ALLOWED UP TO THE BUILDING HEIGHT WITHIN THAT ZONING DISTRICT, UH, WHICH IS FAIRLY RESTRICTIVE.

SO FOR EXAMPLE, A COMMUNITY RETAIL ZONING HAS A MAXIMUM BUILDING HEIGHT OF 35 FEET.

SO ANYTHING ABOVE THAT WOULD REQUIRE AN SUP CURRENTLY, UH, THE COMMITTEE HAS RECOMMENDED ALLOWING, UM, COMMERCIAL CELL TOWERS BY RIGHT UP TO 85 FEET IN HEIGHT IN COMMERCIAL ZONES.

AND ANYTHING ABOVE 85 FEET WOULD TRIGGER AN SUP REVIEW.

UM, IN ADDITION TO THAT, THERE'S SOME LANGUAGE THAT, UH, WAS INTERESTING, REVIEWED IT WITH MR. ENGLAND, AND WE FIGURED IT NEEDED A LITTLE CLEANUP JUST TO MAKE THE INTENT SUPER CLEAR.

UM, BUT THIS, UH, SENTENCE HERE, UH, THAT CURRENTLY READS A SITE WITH A PREVIOUSLY ISSUED AND CURRENTLY ACTIVE COMMERCIAL, EXCUSE ME, ACTIVE SUP SHALL NOT REQUIRE A NEW SUP AND LESS THE HEIGHT OR FOOTPRINT OF THE ANTENNA SUPPORT STRUCTURE HAS CHANGED.

IT SEEMS TO INDICATE THAT A, AN EXISTING SUP THOSE ISSUED, UM, IN A COMMERCIAL DISTRICT FOR A CELL TOWER DOES NOT NEED TO COME BACK FOR RENEWAL AS LONG AS THEY'RE NOT ADDING HEIGHT OR EXPANDING THE BASE STRUCTURE.

UM, A LITTLE CLEANUP WAS NEEDED JUST TO MAKE CLEAR ON WHAT THAT MEANT BY ACTIVE SUP REALLY THE ACTIVE USE, UM, AND IN OUR OPINION, BUT WE, WE SHARED IT WITH THE COMMITTEE AND THEY, UH, CONCURRED WITH, UH, KIND OF CLEANING UP THAT LANGUAGE AND, AND GOING FORWARD WITH THE INTENT OF NOT REQUIRING SUP RENEWALS IN COMMERCIAL ZONES PROVIDED THAT A TOWER DOES NOT, UH, CHANGE IN HIGHER

FOOTPRINT.

UH, SO IN EFFECT THAT ESSENTIALLY MAKES THE SUP TIME PERIOD, UH, INDEFINITE, UH, FOR THOSE, THOSE, UM, PARTICULAR TOWERS, AGAIN FOR COMMERCIAL AND MIXED USE ZONING DISTRICTS.

SO THAT WAS IT FOR CELL TOWERS.

UM, AS FAR AS MULTIFAMILY COVERED PARKING, THIS WAS A CLEANUP THAT, UH, STAFF HAD NOTICED AND BROUGHT TO THE COMMITTEE'S ATTENTION.

UM, THE, THE CURRENT REQUIREMENT AND, AND THE PROPOSAL TO CONTINUE REQUIRING IS A 50% OF MULTI-FAMILY PARKING HAS TO BE COVERED VIA CARPORTS OR GARAGES, WHATEVER THE CASE MAY BE.

UH, THERE WAS SOME LANGUAGE THAT WAS IN A DIFFERENT SECTION OF THE GDC THAT INDICATED THAT EACH UNIT MUST HAVE AT LEAST ONE COVERED SPACE.

IN ADDITION TO THAT REQUIREMENT, UM, BACK A FEW G GDC AMENDMENTS BACK STAFF, UH, HAD PROPOSED TO ELIMINATE THAT, AND RATHER IS SOMEHOW GOT DOUBLED AND DUPLICATED INTO, UH, AN ADDITIONAL SECTION.

SO IT WAS A MISTAKE WE MEANT TO, UM, ELIMINATE THAT.

SO THAT, THAT IS WHAT, UM, IS PROPOSED THIS EVENING AND WHAT THE COMMITTEE HAS RECOMMENDED AS WELL.

UH, WE DID, UH, PRESENT THIS TO THE PLAN COMMISSION, UH, DURING THEIR APRIL 11TH MEETING, AND THEY RECOMMENDED APPROVAL OF THE CHANGES, UM, AS PRESENTED, THEY HAD SOME PRE-MEETING DISCUSSION AND SOME, UH, QUESTIONS AND, AND, UH, CONSIDERATIONS THAT THE COMMISSION DID ASK THAT STAFF INCLUDE THAT IN THE REPORT.

SO THAT IS INCLUDED IN THE STAFF REPORT.

UH, BUT AGAIN, THOSE WERE PRE-MEETING DISCUSSIONS AND WERE NOT PART OF THEIR FORMAL, UH, RECOMMENDATION.

THE RECOMMENDATION WAS, UM, APPROVAL AND TO PASS ALONG TO THE COUNCIL.

SO WITH THAT MAYOR ALL BE GLAD TO ANSWER YOUR QUESTIONS.

UM, IT WAS A VERY INTERESTING, UM, THOUGHT, I THINK THE THOUGHT BEHIND THAT WAS, YOU KNOW, WHAT IF IN THE FUTURE, THE TECHNOLOGY CHANGES AND, UM, CELL TOWERS BECOME SOMETHING ELSE OR, UH, SOMETHING LIKE THAT.

SO DO WE START SEEING ABANDONMENTS OF THESE, THAT, THAT HASN'T BEEN AN ISSUE, UH, TO DATE? UH, CERTAINLY TO MY KNOWLEDGE, BUT, UM, IT WAS KIND OF A, WHAT IF SCENARIO? SO, BECAUSE WE HAD, WE DO HAVE SOME SIMILAR LANGUAGE FOR ABANDONED USES AND, UH, STRUCTURES AND THE LIKE, AND THE GDC.

SO, UM, I DID SHARE IT WITH THE CITY ATTORNEY'S OFFICE.

I'M NOT SURE IF THEY HAD ANY PARTICULAR THOUGHTS ON THE MATTER, BUT, UM, I DID KIND OF PASS THAT ALONG TO MR. ENGLAND'S OFFICE, UM, AS WELL.

SO LOOKS LIKE IT'S ABOUT TO SAY SOMETHING.

I WAS TRYING TO FIGURE OUT MY, MY, UM, SCREEN CHANGED A LITTLE BIT.

ONE OF THE, ONE OF THE ISSUES OF IT THAT, UM, UH, WITH THE ABANDONED TOWERS THAT WE NEED TO LOOK AT IN THE FUTURE IS, UM, FEDERAL LAW WAS CHANGED IN 2012, BUT THE SPECTRUM ACT AND THAT LAW BASICALLY SAID FOR EXISTING TOWERS FOR TELECOMMUNICATIONS SITES, UM, THERE'S ONLY SO MUCH THAT REGULATION THAT WE CAN DO AS A LOCAL GOVERNMENT.

AND AS LONG AS THEY'RE NOT CHANGING THEIR FOOTPRINT OR THEIR HEIGHT, THEN WE CAN'T DO A LOT.

IN FACT, IT SAYS, UM, IT GIVES THEM A CRITERIA THAT WE HAVE TO, FOR WHICH WE WOULD HAVE TO APPROVE.

AND WE CAN ONLY ASK QUESTIONS RELATED TO THE CRITERIA IN FEDERAL LAW.

AND SO IT'S NOT CLEAR UNDER FEDERAL LAW, WHETHER WE COULD REQUIRE THEM TO TAKE DOWN A ABANDONED CELL TOWER OR NOT.

UM, I'D HAVE TO LOOK AT THAT WITH THE SPECTRUM ACT.
