UH, WE GOT MICHAEL POLLAK HERE. HE HAS, UH, SOME INFORMATION ALSO, BUT WE HAD LENGTHY COMMITTEE DISCUSSION ABOUT OUR, ONE OF OUR BOND PROGRAMS, AND THIS IS THE FLOOD PRONE PROPERTIES BUYOUT PROGRAM. AND, UH, HE'LL RUN THROUGH ALL THE DETAILS, BUT, UH, THERE IS SOME OPPORTUNITY TO USE SOME OF THE FEDERAL FUNDING THAT IS AVAILABLE. AND, UM, WE THINK THAT WOULD BE A GOOD POLICY MOVING FORWARD TO MAXIMIZE USE FOR OTHER PEOPLE'S DOLLARS IN THIS PROGRAM. SO TAKE IT AWAY, . GOOD EVENING, HONORABLE MAYOR, MEMBERS OF THE COUNCIL. UM, AS, AS, UH, COUNCILMAN HEDRICK WAS SAYING THIS WAS A LENGTHY PROCESS, UH, IF IT, TO SAY THE LEAST. UM, BUT WE DID COME TO A CONCLUSION AND I BELIEVE IT'S, IT'S GONNA HAVE WORKED THE BEST FOR THE CITY AND FOR, UH, FUTURE YEARS TO COME WITH THIS, WITH THIS FLOOD PRONE PROPERTY BUYOUT PROGRAM. UM, HERE TO PRE TONIGHT TO PRESENT THE ACTUAL ORDINANCE AND THE GUIDELINES AS RECOMMENDED BY THE TIM COMMITTEE. UH, A LITTLE BRIEF HISTORY ON THIS, ON THIS, UH, PROGRAM IN THE 2019 BOND PROGRAM, THERE WAS $4 MILLION ESTABLISHED FOR THIS PROGRAM, UM, FOR BUYOUT. UH, IN JANUARY, FEBRUARY OF THIS YEAR, THE TIM COMMITTEE MET, AND WE REPORTED THAT THERE, THERE IS NOT AN ORDINANCE AND THERE'S NOT ANY GUIDELINES, UM, PERTAINING TO THIS PROGRAM AT THIS TIME. SO AT THAT TIME, THEY GAVE US CHARGE TO, TO PUT SOMETHING TOGETHER. UM, IN MARCH OF 22 THIS YEAR, WE, WE HAD A KICKOFF MEETING BETWEEN THE CITY STAFF AS WELL AS, UH, PACHECO KOCH, WHO WE, WHOM WE HIRED TO ASSIST US WITH THE DRAFTING OF OUR ORDINANCE, AS WELL AS THE GUIDELINES. THEY'VE HAD SOME EXPERIENCE IN THIS, UH, AREA, AND, AND WE DIDN'T, AND WE WERE KIND OF RELYING ON THEM TO HELP US WALK US THROUGH THIS, THIS PROGRAM. UM, IN MAY, WE RECEIVED THE FIRST DRAFT IN, IN JUNE, THE SECOND DRAFT. AND OF COURSE, BOTH TIMES THEY WERE REVIEWED BY STAFF AND COMMENTS MADE AND SENT BACK, WHITTLED IT ALL DOWN. IN AUGUST, WE RECEIVED THE THIRD DRAFT THAT WE ACTUALLY PRESENTED TO THE TIM COMMITTEE. AND, UM, WITH A FEW QUESTIONS ANSWERS, WE WENT BACK AND DRAFTED ONE MORE TIME AND, AND POLISHED IT UP. AND IN SEPTEMBER, WE PRESENTED THE FINAL DRAFT OF TIM COMMITTEE FOR CONSIDERATION. THEY SAID, YES, WE LIKE THIS. LET'S, LET'S REPORT THIS BACK TO THE, TO THE COUNCIL. AND THAT'S WHERE WE AT, WE ARE AT IN OCTOBER OF THIS YEAR. AND TONIGHT IS, UH, FROM THE TIM COMMITTEE REPORT. WE'RE GONNA GO THROUGH WHAT WE VETTED THROUGH THE COMMITTEE. AND IN, UH, NOVEMBER, WE ANTICIPATE THE ADOPTION OF THE ORDINANCE AND THE GUIDELINES, UH, BY CITY COUNCIL, CITY DEPARTMENT INVOLVEMENT. UH, NOT THAT THE ENGINEERING DEPARTMENT WAS OPERATING IN A VACUUM. I WANTED EVERYBODY TO KNOW THAT THERE'S, THERE'S A NUMBER OF, OF DIFFERENT DEPARTMENTS IN THE CITY THAT ARE ACTUALLY GOING TO BE IMPACTED WITH THIS BUYOUT PROGRAM. AND THEY'LL, THEY'LL PLAY A ROLE SOMEWHERE ALONG THE WAY THAT INCLUDES NOT ONLY ENGINEERING, BUT NEIGHBORHOOD VITALITY, BUILDING INSPECTION, COMMUNITY DEVELOPMENT, [00:05:01] AS WELL AS PARKS AND RECREATION. UM, I DO, I DO WANNA HAVE A LITTLE SIMPLE, SIMPLE PLUG. ALL OF THESE, UM, DEPARTMENTS PUT IN A LOT OF TIME AND EFFORT FROM THE KICKOFF MEETING ALL THE WAY THROUGH ALL THE SUBSEQUENT REVIEWS, BUT I HAVE TO CALL OUT, UM, MR. RAMON KARE AND JAKE FISHER AND OUR DEPARTMENT, THEY STAYED ON TOP OF THIS THE WHOLE TIME. THEY KEPT EVERYTHING MOVING SO THAT IT KEPT A GOOD EVEN FLOW PROCESS AND DIDN'T LET IT SET. AND I, AND I DO APPRECIATE ALL THE HARD WORK THAT THEY PUT INTO THIS ON THE, ON THE CITY'S BEHALF, BEGINNING WITH THE ORDINANCE. THIS WAS PROBABLY THE SIMPLEST PART OF THE WHOLE PROCESS. UM, THE, THE HARDER PART WAS PUTTING THE GUIDELINES TOGETHER, BUT, UM, WHAT WE'RE DOING IS WE'RE GOING TO MODIFY THE EXISTING ORDINANCE IN THE ARTICLE SEVEN OF THE FLOOD DAMAGE PREVENTION ORDINANCE IN SECTION 31.1 HUNDRED. IN THE PREAMBLE, WE'RE ADDING AN ITEM NUMBER SIX, WHICH IS THE PURCHASING OF FLOOD PRONE RESIDENTIAL PROPERTIES THROUGH A VOLUNTARY ACQUISITION PROCESS INITIATED BY THE PROPERTY OWNER. AND IT GOES ON FROM THERE. ONE THING THAT YOU MIGHT HAVE CAUGHT ONTO WAS RESIDENTIAL PROPERTIES. AT THIS TIME, UM, WE HAD CONTACTED OTHER ENTITIES THAT ALREADY HAVE A FLOOD PRONE PROPERTY BUYOUT PROGRAM, AND THEY HAD RECOMMENDED TO BEGIN WITH RESIDENTIAL. THEY SAID COMMERCIAL GETS VERY CONFUSING WITH, WITH ACQUISITION, NOT ONLY WITH THE ACQUISITION, BUT UM, TENANTS THAT ARE IN THE BUILDING, ANY TENANTS THAT HAVE SPECIAL EQUIPMENT IN BUILDINGS, IT BECOMES A VERY LONG DRAWN OUT PROCESS TO TRY TO ACQUIRE COMMERCIAL LOTS. AND THEY SAID, START WITH YOUR RESIDENTIAL FIRST. GET THAT UNDER CONTROL, THEN YOU CAN ADD COMMERCIAL LATER. SO THAT'S WHAT WE REPORTED BACK TO THE TIM COMMITTEE. THEY AGREED WITH OUR RECOMMENDATION. THEY SAID, YEP, LET'S START WITH THE, WITH THE RESIDENTIAL PROPERTIES FIRST AND START FROM THERE. SO THAT'S THE REASON THAT THE, THE ORDINANCE IS WORDED THE WAY IT IS. UM, THE NEW PART OF THE ORDINANCE WILL BE ACTUALLY BE SECTION 31.108, UH, VOLUNTARY FLOOD PRONE PROPERTY BUYOUT, AGAIN, A THROUGH D. UH, THE FIRST PART OF THIS ACTUALLY DEFINES, UH, THE RESIDENTIAL PROPERTY AS A SINGLE FAMILY, SINGLE FAMILY ATTACHED OR DUPLEX, UM, GOES ON ABOUT DEDICATING OF THE PROPERTY. AND, AND WE'LL GET TO THAT HERE IN A LITTLE BIT TOWARDS THE END OF THE PRESENTATION. UM, ALSO ITEM D, THE BUYOUT SHALL BE IN ACCORDANCE WITH THE CURRENT ENGINEERING DEPARTMENT'S FLOOD-PRONE PROPERTY BUYOUT PROGRAM GUIDELINES. THE REASON THAT WE DON'T INCLUDE ALL THE GUIDELINES IN HERE, UM, YOU'VE BEEN GIVEN A COPY OF THIS EVENING OF THE ORDINANCE, UM, AT YOUR STATIONS. AND, UH, IN THE BACK OF THAT, UH, THE FRONT IS THE ORDINANCE. THE REST OF THE 13 PAGES IS ACTUALLY THE, THE GUIDELINES. AND TO GO THROUGH ALL THOSE GUIDELINES AND ACTUALLY HAVE THEM PRINTED IN THE ORDINANCES, LENGTHY. PLUS, ANYTIME FEMA WANTS TO CHANGE THEIR PROCESSES AND PROCEDURES OR THE TEXAS WATER DEVELOPMENT BOARD, WE WOULD'VE TO GO BACK AND CHANGE THE ORDINANCE EVERY TIME. AND SO WE FELT LIKE THE GUIDELINES BEING ADOPTED BY THE COUNCIL, THAT THAT WAS A LIVING DOCUMENT, THAT WHENEVER THEY MAKE A CHANGE TO THEIR PROCESSES AND PROCEDURES, WE CAN ADJUST OURS ACCORDINGLY, CUZ WE'RE FOLLOWING THEIR GUIDE, THEIR PROCEDURES. AND OURS IS BASICALLY ACCOMPANYING THEIR PROCESSES AND PROCEDURES. SO WITH THAT, THE PROGRAM ELIGIBILITY, UM, I'LL GO THROUGH THESE REALLY QUICKLY FOR THE BUYOUT PROGRAM. THE, THIS PROGRAM, AGAIN, RESIDENTIAL PROPERTY DEFINED WHAT WE HAD STATED BEFORE. SINGLE FAMILY PROPERTY MUST BE LOCATED WITHIN THE FEMA 100 YEAR FLOOD PLAIN OR FLOOD WAY. AND, UH, ACCORDING TO THE CURRENT RATE MAPS, THE PROPERTY MUST BE CURRENT ON THEIR CITY AND COUNTY TAXES. AND THE PROPERTY MUST HAVE A CLEAR TITLE WITHOUT LIENS, WITH THE EXCEPTION OF A MORTGAGE LIEN. THAT'S THE ONLY LIEN THAT, THAT THIS PRO PROGRAM WOULD ACCEPT. AGAIN, THE GUIDELINES ARE PRINTED IN WORD FORM. I'M GONNA TAKE YOU THROUGH BASICALLY A COUPLE OF SLIDES WITH, WITH A FLOW CHART, UM, OF HOW WE INTEND TO OPERATE THIS PROCESS AND PROCEDURE. UH, CITY TRE AND APPLICATION PERIOD, JANUARY THROUGH MARCH. AND THIS IS OUR INTENTION IS TO BEGIN THIS NEXT JANUARY OF 2023. IT WOULD BE THE MAILINGS, UH, TO ALL THE PROPERTY OWNERS, RESIDENTIAL PROPERTY OWNERS IN THE FLOOD PLAIN PUBLICATIONS IN THE GARLAND CITY PRESS. UH, FLYERS IN PUBLIC BUILDINGS SUCH AS THE CITY HALL WHERE YOU HAVE A LOT OF FOOT TRAFFIC AND PEOPLE WANNA PICK UP A FLYER ABOUT THE PROGRAM, UM, IN OTHER MUNICIPAL BUILDINGS AS WELL. AND THEN THERE, THERE'LL ALSO BE A WEBPAGE THAT WE'VE STARTED CREATING AT THIS TIME THAT WILL ACTUALLY HAVE THE INFORMATION AND IN THE MAILINGS TO THE PROPERTY OWNERS, IT WILL ACTUALLY HAVE ALL THIS INFORMATION AND, AND DIRECT THEM TO THE WEBSITE FOR MORE INFORMATION, CONTACT INFORMATION TO CALL US SO THAT WE CAN EDUCATE THE PROPERTY OWNERS ON, ON THE PROGRAM ITSELF. UM, FROM THEN, FROM MARCH, FROM JANUARY TO MARCH, WE'LL BE SOLICITING APPLICATIONS FROM THE [00:10:01] PROPERTY OWNERS. UH, BY SENDING THIS OUT TO ALL THE PROPERTY OWNERS IN THE FLOOD PLAIN, WE WILL BE TARGETING WHAT THEY CALL SEVERE REPETITIVE LOSS AND REPETITIVE LOSS PROPERTIES. I WILL COVER THE DEFINITIONS OF THOSE TOWARDS THE END OF THIS PRESENTATION. BUT, UM, THOSE ARE KEY. THERE ARE 49 REPETITIVE LOSS AND SEVERE REPETITIVE LOSS PROPERTIES IN GARLAND. AND THESE ARE THE ONES WE REALLY WANT TO TARGET. UM, BETWEEN MARCH AND MAY, MARCH 1ST AND MAY 31ST, UM, THE CITY WILL RECEIVE THE APPLICATIONS FROM THE PROPERTY OWNERS THAT ARE INTERESTED, AND THEN WE WILL BEGIN OUR PROCESS AFTER MAY, BETWEEN JUNE AND JULY. THE NEXT TWO MONTHS WE'LL PROCESS, EVALUATE, MAKE SURE THEY MEET ALL THE REQUIREMENTS, UH, CURRENT ON THEIR TAXES, ET CETERA. AND THEN, UM, WE'LL START PUTTING TOGETHER OUR APPLICATION THAT WE WILL SUBMIT TO THE TEXAS WATER DEVELOPMENT BOARD. UM, WHAT THIS ENTAILS IS THAT IF WE RECEIVE, LET'S PICK A NUMBER SEVEN. LET'S SAY WE HAVE SEVEN PROPERTY OWNERS INTERESTED THIS YEAR. UM, WE COMBINE ALL THOSE AS ONE APPLICATION TO THE TEXAS WATER DEVELOPMENT BOARD, AND ULTIMATELY IT'S ONE APPLICATION TO FEMA. THEY DON'T DIVIDE THE PROPERTIES OUT ONE BY ONE. THEY'RE ALL ONE APPLICATION FROM THE CITY. SO IT'S AN ALL OR NOTHING TYPE OF SITUATION. SO DURING OUR PROCESS, WE WILL EVALUATE A BENEFIT TO COST RATIO FOR ALL THESE PROPERTIES. AND THE AVERAGE OF THE NUMBER OF PROPERTIES YOU HAVE OF THE SEVEN, UH, IF THAT'S THE NUMBER THIS YEAR, HAS TO EQUAL 1.0 OR BETTER FOR THE AVERAGE OF THE BENEFIT TO COST RATIOS BEFORE TEXAS WATER DEVELOPMENT BOARD WILL EVEN CONSIDER THE APPLICATION. SO WITH THAT, WE SUBMIT TO FEMA, OR EXCUSE ME, TEXAS WATER DEVELOPMENT BOARD, AND THEY'LL BEGIN THEIR REVIEW. AND THEN THEIR REVIEW ON THIS NEXT SLIDE IS, UH, THEIR, THEIR SUBMITTAL DATE IS SEPTEMBER 30TH THROUGH DECEMBER 2ND FOR OUR APPLICATION. DURING THAT TIME, THEY'LL BE ASKING FOR ADDITIONAL INFORMATION, AND WHAT THEY DO IS THEY HELP US REFINE OUR APPLICATION TO MAKE IT STRONGER TO SUBMIT TO FEMA. SO IF WE DO HAVE A BENEFIT TO COST RATIO THAT BARELY EQUALS ONE, THEY MAY RECOMMEND, UM, MAYBE REMOVING ONE LOWER BENEFIT TO COST RATIO PROPERTY TO MAKE OUR APPLICATION STRONGER SO THAT WE'LL HAVE A BETTER CHANCE OF RECEIVING THE GRANT FUNDING FOR THE OTHER SIX PROPERTIES. SO THERE IS A CHANCE THAT THEY MAY RECOMMEND CALLING ONE IF IT, IF IT, IT WEAKENS OUR APPLICATION. SO THEY'LL, THEY'LL ADVISE US ON THAT. AND THEN AS WE GET THROUGH THE END OF DECEMBER AND INTO JANUARY, THEIR, THEIR PERIOD ENDS IN, ON JANUARY 25TH, IT GETS SUBMITTED TO FEMA. OUR APPLICATION WILL FINALLY MAKE IT TO FEMA. SO WE'VE BEEN FROM JANUARY OF 23 ALL THE WAY THROUGH THE BEGINNING OF 24 BEFORE IT EVER EVEN GETS TO FEMA. I WANT TO, I WANT TO HAVE EVERYBODY UNDERSTAND THIS IS A VERY LENGTHY PROCESS, UM, WITH THE FEMA PROCESS. THEY WILL BEGIN THEIR REVIEW IN FEBRUARY AND ASK US FOR ADDITIONAL INFORMATION IF THEY NEED INFORMATION, AND THEN BETWEEN MARCH AND JUNE, THEY WILL START THEIR EVALUATION PROCESS AND THEIR RANKING SYSTEM WITH ALL THE APPLICATIONS THAT THEY RECEIVE STATEWIDE. UM, WELL AND COUNTRYWIDE, BUT MOSTLY STATE BECAUSE THE TEXAS WATER DEVELOPMENT BOARD IS, THEY, THEY HAVE REGIONS. AND THEN, UM, IN JUNE, WE FINALLY FIND OUT BASICALLY A YEAR AND A HALF AFTER WE START THIS, IF, IF WE'RE SUCCESSFUL AND, AND IF WE'RE ONE OF THE SELECTED APPLICATIONS OR WE WE'RE SUCCESSFUL ON THAT, THE FUNDS GET TRANSFERRED TO THE TEXAS WATER DEVELOPMENT BOARD IN AUGUST AND THEN BEGINS OUR CONTRACT WITH TEXAS WATER DEVELOPMENT BOARD IN SEPTEMBER AND OCTOBER. AND FINALLY THERE'S THE ACQUISITION PROP PROCESS OF THE PROPERTIES BEGINNING FROM OCTOBER THROUGH HOWEVER LONG IT TAKES TO ACQUIRE THE PROPERTIES. SO YOU'RE LOOKING AT AT LEAST A YEAR AND A HALF PLUS OR MORE OR LONGER TWO YEARS. AND IN THIS WHOLE TIME, THE FOLLOWING JANUARY, WE'RE GOING TO START OUR SECOND CYCLE. AND THERE'S, THERE'S A POSSIBILITY YOU COULD HAVE THREE CYCLES GOING ALL AT THE SAME TIME BEFORE IT'S ALL SAID AND DONE. BUT, UM, LO AND BEHOLD, EVEN AFTER YOU ACQUIRE THE PROPERTIES, THERE'S STILL THE DEMO OF THE STRUCTURES, REGRADING OF THE LOT, ESTABLISHING LOW, LOW MAINTENANCE VEGETATION. FEMA REQUIRES A CITY TO DEDICATE THE PROPERTIES THAT WE PURCHASE USING THEIR FUNDS AS OPEN SPACE, UM, IN PERPETUITY. AND THEN A CITY WILL ALSO BE RESPONSIBLE FOR LONG TERM MAINTENANCE OF THE PROPERTIES OVER TIME. NOW, FUNDING SUSTAINABILITY, I MENTIONED SEVERE REPETITIVE LOSS AND REPETITIVE LOSS PROPERTIES A LITTLE BIT EARLIER. THESE ARE THE TWO DEFINITIONS AS DEFINED BY FEMA OF WHAT SEVERE REPETITIVE LOSS AND REPETITIVE LOSS ARE. AND IN BOTH CASES, THEY HAVE TO BE NATIONAL FLOOD INSURANCE PROGRAM INSURED [00:15:02] STRUCTURES. AND FOR SEVERE REPETITIVE LOSS, LOSS IS IDENTIFIED AS FOUR OR MORE CLAIMS OF MORE THAN $5,000 EACH TWO OR MORE CLAIMS WHERE THE TOTAL EXCEEDS THE CURRENT VALUE OF THE PROPERTY. THAT'S A SEVERE REPETITIVE LOSS. REPETITIVE LOSS ARE TWO MORE SEPARATE PAYMENTS OF MORE THAN A THOUSAND DOLLARS PAID BY THE N F I P WITHIN THE ROLLING 10 YEAR PERIOD SINCE 1978. AND TWO OR MORE OR TWO MORE CLAIMS WITH THE BUILDING PAYMENTS ONLY THAT AVERAGE OR EQUAL 25% OF THE MARKET VALUE OF THE PROPERTY. THE REASON I BRING THESE UP IS IN THE NEXT, UM, ITEM BELOW THAT, THE MITIGATION ASSISTANCE FUNDS THAT WE'RE TRYING TO ACQUIRE FOR THESE PROPERTIES FOR SEVERE REPETITIVE LOSS PROPERTIES, THEY WILL PAY UP TO A HUNDRED PERCENT FOR SEVERE REPETITIVE LOSS PROPERTIES.
