MR. CHAIRMAN, I'D LIKE TO READ THIS SLIDE INTO THE RECORD A BIT DIFFERENTLY THAN WE HAVE IN THE PAST.

UH, WE'VE HAD SOME, WE'VE NOTICED SOME ISSUES WITH THE POSTAL SERVICE INDICATING, UH, THAT SOME ITEMS WERE STILL IN TRANSIT, WHEN IN FACT THEY HAD BEEN RETURNED TO SENDER.

AND SO I'D, I'D LIKE TO READ INTO THE RECORD HOW THEY WERE ACTUALLY RECEIVED.

YES, SIR.

UH, ON AUGUST 31ST, 2022, STAFF DID POST THE NOTICE OF PROCEEDINGS FOR TONIGHT'S HEARING AT THE PROPERTY ON SEPTEMBER 15TH.

UH, STAFF SPOKE TO MONICA ORTIZ, WHO IS THE WIFE OF THE OWNER, AS INDICATED BY DECA.

AND WE DID DISCUSS THIS HEARING WITH HER, AND YOU'LL SEE THAT THE ADMINISTRATIVE SUMMON DOES STILL SHOW TO BE IN TRANSIT.

THIS IS A PICTURE OF THE POSTING, THE NOTICE OF PROCEEDING ON THE FRONT OF THE PROPERTY AT 1005 WEST AVENUE G.

THESE PHOTOS WERE BOTH TAKEN, UH, AT THE TIME OF THE POSTING ON AUGUST 31ST, 2022.

THE TIMELINE OF ACTIONS AT THIS PROPERTY BEGAN IN SEPTEMBER OF 2019.

IN MAY OF 2022, CODE COMPLIANCE BEGAN RECEIVING COMPLAINTS THAT HOMELESS PEOPLE WERE LIVING ON THE PROPERTY IN AUGUST OF 2022.

CODE COMPLIANCE STAFF CONDEMNED THE PROPERTY IN SEPTEMBER OF 2022.

STAFF SPOKE TO MONICA ORTIZ, THE OWNER OF THE PROPERTY AFTER SHE HAD RECEIVED THE CONDEMNATION NOTICE.

THIS IS A PICTURE OF THE CONDEMNATION NOTICE.

BOTH PICTURES ARE OF THE SAME NOTICE POSTED ON THE FRONT OF 1005 WEST AVENUE G.

THIS IS A PICTURE TAKEN OCTOBER 5TH, 2022.

UH, YOU'LL NOTICE A MARKED DIFFERENCE IN THE PROPERTY.

THERE HAS BEEN QUITE A BIT OF REPAIR DONE SINCE THE CONVERSATION WITH MS. ORTIZ.

UH, FROM WHAT WE COULD TELL, THE WINDOWS HAVE BEEN REPLACED, THE DOOR HAS BEEN REPLACED.

THE, UH, ENTIRE ROOF SEEMS TO HAVE BEEN SHINGLED.

THIS IS ANOTHER PICTURE OF THE PROPERTY TAKEN YESTERDAY, OCTOBER 5TH, 2022.

ANOTHER FRONT VIEW OF THE PROPERTY SHOWING SOME OF THE REPAIRS THAT HAVE BEEN MADE.

SO, IN SUMMARY, THIS PROPERTY HAS BEEN THE SOURCE OF NINE COMPLAINTS AND CASES SINCE 2017.

THERE ARE CURRENTLY NO OUTSTANDING ABATEMENT LIEN FILED.

THE PROPERTY WAS DAMAGED BY A FIRE IN SEPTEMBER OF 2019.

SINCE THAT TIME, STAFF HAS RECEIVED ADDITIONAL COMPLAINTS ABOUT HOMELESS PEOPLE OCCUPYING THE BACKYARD AND FRONT PORCH.

AFTER SPEAKING WITH STAFF ABOUT THIS HEARING, THE OWNER DID APPLY FOR A PERMIT WITH THE BUILDING INSPECTIONS DEPARTMENT, AND THERE'S ALSO BEEN QUITE A BIT OF PROGRESS ON REPAIRS TO THE HOUSE.

MS. ORTIZ EXPRESSED INTEREST IN ATTENDING THIS HEARING TO SHARE THE DETAILS OF HER PLAN FOR THE PROPERTY STAFF'S RECOMMENDATION FOR 1001 WEST AVENUE G IS THAT THE BUILDING BE REPAIRED TO A HABITABLE CONDITION BY DECEMBER 6TH, I BELIEVE.

MR. WEINSTEIN, AS WE PROCEED QUESTIONING OF YOU, YOU INDICATED THAT SOME OF THE NOTICES WERE IN TRANSIT, BUT IN REGARDS TO THE CITY AND THE STAFF, UH, COMMUNICATING WITH THE OWNERS OF THE PROPERTY, COULD YOU ELABORATE, UH, THE, THE NOTICE, THE THEM, THE NOTIFICATION AND THE URGENCY OF THE RECOMMENDATIONS THAT'S BEING BROUGHT BEFORE US? CAN YOU, CAN YOU COMMUNICATE YOUR VERBAL COMMUNICATION OR, OR IN WRITING, UH, SINCE THE NOTICES WERE IN TRANSIT WITH THE, THE OWNERS THEMSELVES? YES.

WELL, UH, I DON'T KNOW THAT MS. ORTIZ RECEIVED THE ADMINISTRATIVE SUMMONS IN THE MAIL.

IT DOES SHOW TO STILL BE IN TRANSIT BY THE U S P TRACKING SERVICE.

HOWEVER, I DID PERSONALLY HAVE CONVERSATIONS WITH HER ON THE PHONE, SEVERAL CONVERSATIONS ABOUT THIS HEARING AND ABOUT THE REPAIRS REQUIRED AND ALSO ABOUT THE CONDEMNATION, CONDEMNATION NOTICE THAT SHE HAD RECEIVED.

COULD YOU ELABORATE ON AFTER YOUR VERBAL COMMUNICATION ON THE PHONE? WHAT WAS HER FEEDBACK AFTER YOU VERBALIZED? UH, THE, UH, THE VIOLATIONS? UH, SHE WAS, SHE WAS AWARE OF SOME OF THE VIOLATIONS SHE HAD.

SHE WAS AWARE THAT THERE WERE HOMELESS PEOPLE, UH, COMPLAINTS OF HOMELESS PEOPLE IN THE YARD.

AND, UH, SHE HAD PLANS TO REPAIR THE STRUCTURE, BUT HAD RUN INTO SOME DIFFICULTIES DUE TO COVID 19.

UH, AND I CAN SAY THAT IMMEDIATELY AFTER OUR, OUR CONVERSATIONS, A PERMIT WAS OBTAINED AND CONSTRUCTION BEGAN SHORTLY THEREAFTER.

THANK YOU.

MR. WEINSTEIN.

I HAVE NO FURTHER QUESTION FOR MR. WEINSTEIN.

IS THERE ANY, ANYONE FROM THE BOARD HAVE QUESTIONS, FURTHER QUESTIONS FROM MR. WEINSTEIN? MR. MALACO, YOU MENTIONED THAT SOME OF THE VIOLATIONS HAVE ALREADY BEEN TAKEN CARE OF.

WHAT ARE THE REMAINING VIOLATIONS ON THIS PROPERTY? WE HAVEN'T INSPECTED THE INSIDE OF THE STRUCTURE, AND SO I'M NOT ENTIRELY SURE OF WHAT THE, HOW, HOW THE STANDARDS HAVE COME ALONG.

THERE IS A BUILDING INSPECTIONS PERMIT, BUT NO INSPECTIONS HAVE BEEN CONDUCTED ASSOCIATED WITH THAT PERMIT.

AS FAR AS I CAN TELL, THE WINDOWS HAVE BEEN REPLACED.

THE FRONT DOOR IS, HAS EITHER BEEN REPAIRED OR REPLACED, AND ALL OF THE ROOF STRUCTURE SEEMS TO HAVE BEEN REPAIRED, BUT NOT, UH, NO INSPECTION HAS BEEN DONE OF, OF ANY OF THOSE ITEMS. OKAY.

JUST BEFORE THE CONVERSATION WITH MR. MICHAEL DREWRY, THE TIMELINE OF ACTIONS BEGIN AT THIS PROPERTY.

ON AUGUST 17TH, 2022, THE TASK FORCE ARRANGED FOR MR. JURY TO MEET WITH A SOCIAL WORKER THROUGH THE VETERANS ADMINISTRATION ON AUGUST 22ND, 2022, DUE TO CONTINUING UNSAFE UNSANITARY CONDITIONS OF THE HOME, COCO COMPLIANCE STAFF PRESENTED MR. MICHAEL DRURY WITH AN ORDER TO VACATE IN PERSON AT THE RESIDENCE.

THESE ARE THE COMMENTS FROM THE COURTESY INSPECTION CONDUCTED BY THE BUILDING INSPECTIONS DEPARTMENT.

UH, THE ITEMS HIGHLIGHTED AND READ ARE THE MAJOR CONCERNS.

IT, IT SAYS THE HOME DID NOT APPEAR TO BE IN TERRIBLE SHAPE, BUT FIRST WALK AROUND AS VINYL SIDING HAS BEEN ADDED TO SOME PO AT SOME POINT IN THE PAST.

THE HOUSE HAS A CONCRETE PERIMETER FOUNDATION, AND THE INTERIOR PORTION IS PURE AND BEAM.

THE CONCRETE FOUNDATION DID NOT SHOW NOTICEABLE SIGNS OF DAMAGE.

THE ROOFING MATERIAL IS WOODEN SHAKE WITH NOTICEABLE SIGNS OF DETERIORATION AND ROT.

A LAYER OF COMPOSITE SHINGLES HAS BEEN ADDED, BUT THESE ARE NOT IN GOOD CONDITION AND MANY PLACES APPEAR TO HAVE BEEN PATCHED UPON ENTERING THE HOME.

THE RESIDENT POINTED OUT MANY LOCATIONS WHERE THE FLOOR JOISTS WERE UNSTABLE OR MISSING.

AND ON THE FOLLOWING SLIDES, I'LL SHOW YOU THE LOCATIONS OF THOSE, UH, DAMAGED SECTIONS.

THE BATHROOM FLOOR NEAR THE EXTERIOR WALL HAD DETERIORATED TO THE POINT THE GROUND COULD BE SEEN THROUGH A HOLE APPROXIMATELY TWO FEET BY TWO FEET.

THE CONCRETE FRONT PORCH WAS NOT ATTACHED TO THE HOUSE AND HAS TILTED BACK TOWARD THE HOME, ALLOWING WATER TO ENTER THROUGH THE FRONT DOOR.

THIS HAS CAUSED ROTTEN DECAY.

WOOD FRAME WINDOWS HAVE SEVERE DECAY.

HE ALSO SAYS THAT THE RESIDENT STATES THE TOILET DOUBLE FLUSHES.

THIS LEADS THE, TO THE POTENTIAL AND IMPROPER SLOPE HAS FORMED IN THE SEWER LINE.

ADDITIONALLY, THE RESIDENT STATES THAT SEWER, I BELIEVE THAT'S SEWAGE SPEWS FROM BROKEN PIPES UNDER THE HOUSE.

HE DOES SAY THAT THE ELECTRICAL SYSTEM SEEMS TO BE IN GOOD SHAPE AND IS SERVICEABLE.

WALKING UP THE STAIRS TO THE LOFT AREA AND ACCESS WAS OPEN, ALLOWING HIM TO VIEW THE UNDERSIDE OF THE ROOF.

THE PORTION HE COULD SEE HAD STANDARD ROOF CHOICE WITH SLATS INSTALLED AND A THIN DECKING MATERIAL UNDER THE SHAKE SHAKE SHINGLES.

THAT PORTION APPEARED TO BE IN GOOD SHAPE AND SHOWED NO SIGNS OF ISSUES AT THAT POINT.

HE SAID, AT THIS POINT, I WOULD SAY THE HOUSE IS SALVAGEABLE AND NOT RECOMMEND DEMOLITION.

BUT HAZARDS DO EXIST.

MANY FLOOR JOISTS WOULD NEED REPLACEMENT ALONG WITH DECKING AND INSULATION, SEWER PIPING UNDER THE HOUSE WOULD NEED REPLACING WITH A, WITH A POSSIBILITY OF

[00:45:01]

REPLACEMENT FROM THE HOUSE TO THE CITY MAIN AND THE REAR ALLEY.

THIS IS A DRAWING PROVIDED BY THE BUILDING INSPECTOR SHOWING THE AREAS WITH DAMAGED OR MISSING FLOOR JOISTS.

THE FRONT DOOR IS AT THE BOTTOM OF THIS PICTURE.

THIS IS THE ORDER TO VACATE.

I'LL HAVE TO READ IT TO YOU BECAUSE IT'S A BIT SMALL TO SEE HERE.

THIS WAS DATED AUGUST 22ND, 2022, ADDRESSED TO JAMES MICHAEL DREWRY OF 1001 WEST AVENUE F GARLAND, TEXAS 75,043 REGARDING 1001 WEST AVENUE F.

DEAR MR. DREY, THE FOLLOWING HEALTH AND SAFETY CONDITIONS EXIST AT THIS PROPERTY AND CONSIDER THIS NOTIFICATION FROM THE CITY OF GARLAND CODE COMPLIANCE DEPARTMENT TO HAVE THIS PROPERTY VACATED FROM YOUR CURRENT OCCUPANCY, INCLUDING ANYONE ELSE OCCUPYING THE PROPERTY OR PREMISES.

AND IT GOES ON TO LIST THE VIOLATIONS.

LACK OF WATER AND ELECTRIC ELECTRICITY SERVICE SERVICES WERE TERMINATED ON NOVEMBER 21ST, 2019.

THE ROOF CONTAINS NOTICE, NOTICEABLE SIGNS OF DETERIORATION AND ROT.

A LAYER OF COMPOSITE SHINGLES HAS BEEN ADDED, BUT THESE ARE NOT IN GOOD CONDITION, AND MANY PLACES APPEAR TO HAVE BEEN PATCHED.

MANY LOCATIONS WHERE THE FLOOR JOISTS WERE UNSTABLE OR MISSING, THESE INCLUDE THE AREAS BETWEEN THE DINING ROOM AND LIVING ROOM, FRONT DOOR, BATHROOM AND ANOTHER SITTING AREA.

THE BATHROOM FLOOR NEAR THE EXTERIOR WALL HAD DETERIORATED TO THE POINT THE GROUND COULD BE SEEN THROUGH A HOLE APPROXIMATELY TWO FEET BY TWO FEET.

THE CONCRETE FRONT PORCH NOT ATTACHED TO THE HOUSE, HAS TILTED BACK TOWARD THE HOME, ALLOWING WATER TO ENTER THROUGH THE FRONT DOOR THAT HAS CAUSED ROTTEN DECAY.

WOOD FRAME WINDOWS HAVE SEVERE DECAY.

RESIDENT STATES THE TOILET DOUBLE FLUSHES.

THIS LEADS TO THE POTENTIAL AND IMPROPER SLOPE HAS FORMED IN THE SEWER LINE.

ADDITIONALLY, RESIDENT STATES SEWER SPEWS FROM BROKEN PIPES UNDER THE HOUSE, UNSANITARY LIVING CONDITIONS.

THESE SPECIFIED CONDITIONS, ALONG WITH OTHERS ARE EVIDENCE THAT THIS STRUCTURE IS UNSAFE TO OCCUPY.

THIS PROPERTY MUST BE VACATED UPON POSTING AUGUST 22ND, 2022.

FAILURE TO DO SO WILL RESULT IN FURTHER ENFORCEMENT ACTIONS.

THIS BUILDING MAY NOT BE OCCUPIED UNTIL WRITTEN APPROVAL FROM THE GARLAND BUILDING.

OFFICIAL OFFICIAL IT ASSIGNS SINCERELY, RICK BARKER, DIRECTOR OF CODE COMPLIANCE 1001 WEST AVENUE.

F DEFICIENCY LIST INCLUDES THE ITEMS LISTED ON THAT VACATE ORDER, SUBSTANDARD AND UNSANITARY CONDITIONS OCCUPIED HOUSE WITHOUT ACTIVE UTILITY SERVICE, AND WITH A VACATE ORDER, TRASH AND IMPROPER STORAGE AT THE EXTERIOR, MISSING AND BROKEN SECTIONS OF SEWER LINE UNDER THE HOUSE AND POSSIBLY FROM THE HOUSE TO THE CITY.

SEWER DAMAGED ROOF DECKING, MISSING AN UNSTABLE FLOOR JOISTS HOLES IN THE FLOOR DAMAGED CONCRETE FRONT PORCH AND DECAYED WOOD WINDOW FRAMES.

1001 WEST AVENUE F REQUIREMENTS TO COMPLY INCLUDE ALL VIOLATIONS ON THAT DEFICIENCY LIST.

THE PROPERTY MUST REMAIN VACANT UNTIL REPAIRED TO A HABITABLE CONDITION.

UTILITY SERVICE IS RESTORED AND THE VACATE ORDER IS REMOVED.

ALL REPAIRS AND OR CONSTRUCTION MUST BE DONE WITH REQUIRED PERMITS FROM THE BUILDING INSPECTION DEPARTMENT.

ON SEPTEMBER 21ST, 2022, THE UH, CITY OF GARLAND HOMELESS TASK FORCE UPDATED US.

IT SAYS MR. JURY HAS RETAINED A VA ATTORNEY WHO INFORMED HIM THAT IT LOOKS HOPEFUL THAT HE IS IN, THAT HE IS NAMED IN THE WILL AND DEED OF THIS RESIDENCE.

SHE INFORMED HIM THAT SHE WOULD BE CONDUCTING A TITLE SEARCH ON THE PROPERTY.

MR. DREWRY HAS MADE CONTACT WITH A PLUMBER REGARDING REPAIRS TO THE PLUMBING OF HIS RESIDENCE.

MR. DREWRY NOW HAS A BIRTH CERTIFICATE, VOTER'S REGISTRATION CARD, STATE IDENTIFICATION CARD, AND HIS SOCIAL SECURITY CARD HAS BEEN ORDERED.

THIS IS A PICTURE OF THE FRONT OF THE PROPERTY AT 1001 WEST AVENUE F.

THIS IS ANOTHER PICTURE OF THE FRONT AND RIGHT SIDE OF 1001 WEST AVENUE F.

THIS PICTURE WAS TAKEN OCTOBER 5TH, 2022.

AND THIS IS A PICTURE OF THE BACK AND RIGHT SIDE, AND ALSO THE DE, EXCUSE ME, DETACHED GARAGE FOR 1001 WEST AVENUE F.

THIS PICTURE WAS ALSO TAKEN OCTOBER 5TH, 2022.

AND THIS IS THE PICTURE OF THE BACK OF THE PROPERTY AT 1001 WEST AVENUE F.

THIS PICTURE WAS TAKEN OCTOBER 5TH, 2022.

SO IN SUMMARY, PER THE, UH, DALLAS COUNTY APPRAISAL

[00:50:01]

DISTRICT, THE OWNER OF THIS PROPERTY IS THE ESTATE OF VELMA EL DREY.

VELMA EL DREY IS DECEASED AND THE OWNERSHIP OF THIS PROPERTY HAS BEEN IN QUESTION SINCE HER DAUGHTER, THE EXECUTOR OF THE STATE ALSO PASSED AWAY.

STAFF HAS SPOKEN TO SEVERAL SURVIVING FAMILY MEMBERS BY PHONE AND COMMUNICATED WITH OTHERS BY EMAIL TO ENSURE THEY ARE AWARE OF THIS PROCEEDINGS BEFORE THIS BOARD.

THIS PROPERTY HAS BEEN WITHOUT UTILITY SERVICE AND OCCUPIED BY MR. MICHAEL DREARY.

SINCE NOVEMBER OF 2019, THE CITY OF GARLAND HOMELESS TASK FORCE HAS BEEN WORKING WITH MR. DREWRY, THE OCCUPANT AND SON OF VELMA JURY IN AN ATTEMPT TO SECURE THE DOCUMENTS REQUIRED TO GET HIM ASSISTANCE TO MAKE THE REQUIRED REPAIRS.

MR. DRURY PLANS TO OBTAIN THE DOCUMENTS NECESSARY TO PROVE HIS RIGHT TO OCCUPY THE HOUSE, MAKE THE NECESSARY REPAIRS, AND HAVE UTILITY SERVICE REESTABLISHED.

HOWEVER, THE TIMELINE FOR THESE STEPS IS NOT CLEAR.

WHILE PREPARING FOR THIS HEARING, STAFF LEARNED THAT THERE IS ALSO A PENDING TAX FORECLOSURE SALE WITH THE TRIAL SET FOR EARLY NEXT YEAR.

THEREFORE, STAFF'S RECOMMENDATIONS FOR 1001 WEST AVENUE F IS THAT UTILITY SERVICE BE RESTORED BY OCTOBER 10TH, 2022.

IF UTILITY SERVICE IS NOT RESTORED BY OCTOBER 10TH, 2022, THE CHAIRMAN OF THE PROPERTY STANDARDS BOARD IS AUTHORIZED TO ISSUE ORDERS OR DIRECTIVES TO ANY PEACE OFFICER OF THE STATE, INCLUDING A SHERIFF OR CONSTABLE OR CHIEF OF POLICE OF THE MUNICIPALITY, TO ENFORCE AND CARRY OUT THE LAWFUL ORDERS OR DIRECTIVES OF THE PROPERTY STANDARDS BOARD TO VACATE THE PREMISES.

ADDITIONALLY, THAT THE BUILDING BE REPAIRED TO A HABITABLE CONDITION BY DECEMBER 10TH, 2022.

IF THE BUILDING IS NOT REPAIRED TO A HABITABLE CONDITION BY DECEMBER 10TH, 2022, CIVIL PENALTIES IN THE AMOUNT OF $100 PER DAY BE ASSESSED AGAINST THE PROPERTY BEGINNING DECEMBER 10TH, 2022, AND CONTINUE UNTIL THE BUILDING IS REPAIRED.

IF THE BUILDING IS NOT REPAIRED TO A HABITABLE CONDITION, AND PENALTIES HAVE CONTINUED TO ACCRUE BY JANUARY 10TH, 2023, THE CITY IS AUTHORIZED TO DEMOLISH THE BUILDINGS.

THANK YOU MR. WEINSTEIN.

UH, ANYWAY, I HAVE ONE QUESTION BEFORE WE GO AROUND THE, THE, THE TABLE FOR ANY MORE POSSIBLE QUESTIONS.

POINT OF REMEDY, WHEN YOU HAVE COMMUNICATED, YOU HAVE COMMUNICATED WITH THE OWNER IN PERSON, CORRECT? I HAVE, UH, THE OWNER IS IN QUESTION.

I HAVE COMMUNICATED WITH MR. DREW, YES.

MR. DREW OR MICHAEL DREW, WHEN HAVE YOU COMMUNICATED THE VIOLATIONS OR A POSSIBLE REMEDY TO RESOLVE THESE VIOLATIONS TO HIM? YES.

WHAT WAS HIS, WHAT WAS, I KNOW THEY'RE COMING BEFORE US.

WHAT WAS HIS RESPONSE IN REMEDY THIS, THE PROPERTY OF, UH, COMPLETING THESE VIOLATIONS? I, I NEVER DID REALLY HEAR A, A TIMEFRAME FOR THE REPAIRS.

HE DID UNDERSTAND AND HAD ALREADY, UH, REMOVED SOME OF THE SEWER PIPE FROM UNDER THE HOUSE.

UH, I BELIEVE IN AN ATTEMPT TO REPAIR OR LOCATE THE, THE LOCATION OF THE PROBLEM TO BE REPAIRED.

BUT HE WAS CONCERNED ABOUT, UH, SEVERAL THINGS, THE, THE FUNDS TO MAKE THE REPAIRS, AND THAT'S ONE OF THE THINGS THAT THE HOMELESS TASK FORCE WAS TRYING TO ASSIST WITH, BUT ALSO MAKING REPAIRS TO A HOUSE, UH, WITHOUT THE, UH, WITHOUT BEING ABSOLUTELY CERTAIN OF HIS LEGAL OWNERSHIP OF THE HOUSE.

THANK YOU, MR. WEINSTEIN.

I HAVE NO FURTHER QUESTIONS FOR MR. WEINSTEIN.

DO WE HAVE ANY ADDITIONAL QUESTIONS FOR MR. WEINSTEIN AT THIS TIME? ANY ADDITIONAL QUESTIONS? SEEING NONE, MR. WEINSTEIN, THANK YOU VERY MUCH.

YOU MAY BE EXCUSED AT THIS TIME.

WE HAVE SPEAKER CARDS.

IT'S BR BEEN, IT'S BEEN BROUGHT TO MY ATTENTION THAT WE LIKE TO HAVE TWO SPEAKERS BEING BROUGHT UP SPONTANEOUSLY.

SO I'M GONNA ASK THESE TWO INDIVIDUALS TO COME FORTH.

YOU CAN PICK AND CHOOSE WHO'S GONNA GO FIRST.

UM, I'LL START OFF WITH THIS FIRST INDIVIDUAL.

JAMES DREWRY.

PLEASE COME FORTH PL WHEN YOU COME FORTH.

PLEASE STATE YOUR NAME AND ADDRESS AND ALSO THE INDIVIDUAL BY THE NAME OF CLAUDIA, CLAUDIA CANNO GANO.

WHEN YOU COME FORTH, MAKE SURE YOU SPEAK IN FRONT OF THE THE MICROPHONE.

PLEASE STATE YOUR NAME AND FULL ADDRESS FOR THE RECORD, PLEASE.

CLAUDIA CONO.

I'M AN ATTORNEY WITH LEGAL AID OF NORTHWEST TEXAS.

ADDRESS 1515 MAIN STREET, DALLAS, TEXAS 75,201.

THANK YOU, MR. JURY.

YOU'RE NEXT.

JAMES MICHAEL, I'M THE OCCUPANT AND I BELIEVE THE OWNER.

YOUR, YOUR, YOUR ADDRESS.

IT'S 1001 WEST AVENUE F GARLAND, CITY AND STATE AND ZIP CODE GARLAND, TEXAS 75 40.

THANK YOU VERY MUCH.

PLEASE PROCEED.

[00:55:02]

UH, WHAT YOU WOULD LIKE FOR US TO HEAR, UH, THIS EVENING.

MS. GANNA? YES.

THANK YOU FOR ALLOWING ME TO SPEAK ON BEHALF OF, UH, MR. DREWRY.

MR. DREWRY AND I, UH, COMMUNICATED FIRST IN THE MIDDLE TOWARDS THE END OF SEPTEMBER, AND, UM, I HAVE IN FACT MADE A DETERMINATION BASED ON THE PUBLIC RECORDS THAT ARE AVAILABLE ON DALLAS COUNTY ONLINE, WHETHER THAT BE THE DALLAS, UH, RECORDS THAT ARE AVAILABLE THROUGH THE PROBATE COURT, BUT ALSO OF COURSE THE RECORDS THEMSELVES OF THE DEEDS.

UH, IT IS CLEAR THAT HIS SISTER AND THE PURPOSE OF THIS DISCUSSION IS TO LET YOU KNOW THAT HE IS IN FACT, UH, I WOULD DETERMINE TO BE AN HEIR OF THE PROPERTY AT THIS POINT.

UM, WHEN HIS MOTHER PASSED AWAY IN 2007, SHE DID LEAVE THE WILL, THE PROBATE RECORDS WOULD INDICATE, AND I DID BRING SOME TO LEAVE WITH Y'ALL, SOME OF THE RECORDS IF YOU WANTED TO SEE THEM.

YES.

UM, SEAN, WE'LL ENTER IN THE, THE WILL IN AS EXHIBIT A.

THE WILL WILL BE ENTERED IN AS EXHIBIT A.

WELL, I PUT THEM ALL TOGETHER ARE ALL THE DOCUMENTS THAT I COULD DETERMINE I COULD FIND.

I HAVE THE AFFIDAVIT OF AIRSHIP THAT DATES BACK.

MM-HMM.

, UH, FOR MR. BRYAN H DREWRY JR.

WHO IS THE FATHER OF MR. DREWRY AND ALL THE SIBLINGS, BOTH OF COURSE DECEASED AND THE ONES THAT ARE STILL ALIVE.

UH, I COPIED FOR YOU THE CASE INFORMATION, WHICH IS ON THE WEBSITE THAT INCLUDES ALL OF THE DOCUMENTS THAT ARE AVAILABLE, AS WELL AS THE PROCEEDINGS, THE DATES THEY WERE HELD, AND WHO THE PARTIES WERE.

IT INCLUDES THE LAST WILL AND TESTAMENT OF VELVA OF VELMA, LOU WELSH DR THE APPLICATION FOR PROBATE OF THE WILL MADE BY HIS SISTER KATHY.

THERE IS ALSO AN ORDER AUTHORIZING, ADMITTING THE WILL TO PROBATE SIGNED BY, UH, THE JUDGE ON THE 22ND OF JANUARY, 2007.

THERE'S A WAIVER AND DECLINATION OF RIGHT TO BE APPOINTED INDEPENDENT EXECUTOR BY HIS BROTHER, WHO CURRENTLY LIVES IN COLORADO.

AND, UH, BY ALL, BY ALL MEANS, HE HAS NOT SHOWN ANY INTEREST IN THE PROPERTY IN SINCE HIS MOTHER PASSED AWAY.

ALSO, PROOF OF DEATH AND OTHER FACTS SIGNED BY, UH, KATHY SAUNDERS, NOW DECEASED, HIS SISTER, SIGNED THE SAME DAY, UH, THE OATH OF THE EXECUTOR.

AND THEN IN ORDER TO SHOW CAUSE BY THE COURT, WHICH WAS LATER TURNED INTO RE THE REMOVAL OF THE INDEPENDENT EXECUTOR, UH, AND I I STATES HERE FOR FAILURE TO FILE AN INVENTORY, APPRAISEMENT AND LIST OF CLAIMS IS REQUIRED BY LAW.

IN ESSENCE, SHE REMAINS ANIS.

NOT, NOT, UM, THE WILL WAS NEVER PROBATED AND WHEN IT WAS PROBATED BECAUSE NONE OF THE REQUIRED ELEMENTS WERE SATISFIED, SUBJECT TO RECEIVING THE LETTER'S TESTAMENTARY, THERE WAS AN ORDER ISSUED THAT WITHDREW THEM FROM MS. KATHY SAUNDERS.

NOW, THIS WAS ALL IN 2007.

THE RECORDS WOULD REFLECT AGAIN THEIR PUBLIC RECORDS ONLINE THAT SHE PASSED AWAY IN DECEMBER OF 2018.

MS. SAUNDERS, TO MY UNDERSTANDING, AND HE WILL CORRECT ME IF MY NOTES ARE INCORRECT, UM, WAS THE ONE THAT LOOKED AT THE PROPERTY WHILE HIS SISTER AND HE, UM, WE'RE UNAWARE NECESSARILY OF THAT THE PROBATE HAD LAPSED IN FACT, AND THAT NOTHING HAD TRANSFERRED.

SO IT IS ONLY RECENTLY THAT IT, TO MY UNDERSTANDING, HE HAS BECOME EVEN AWARE THAT HE DOES HAVE A SHARE IN THIS PROPERTY.

UH, DIVISIBLE, THERE WERE FOUR CHILDREN ALL LIVING AT THE TIME OF THE DEATH.

SO IN QUARTERS, AND THEN OF COURSE GOING FROM THERE, THE DIVISION FOR THOSE THAT HAVE BEEN DISEASED, UH, WHICH I UNDERSTAND JUSTIN AND MR. GREGORY PERHAPS ARE CHILDREN OF MS. KATHY, UH, THEY HAVE SHOWN NO INTEREST.

GREGORY'S CHILD IS MY BROTHER, SORRY, UH, OF, UM, JOHNNY YES.

WHO HAVE SHOWN NO INTEREST IN, UH, EITHER THE HOME OR, UM, WHO HAVE NO SHOW, NO INTEREST WHATSOEVER.

SO HERE WE ARE.

AND SO MR. MR. DREWRY REMEMBERS THIS HOME.

HE HAS EVERY INTENTION OF BRINGING IT TO A HABITABLE, HABITABLE CONDITION IN

[01:00:01]

ORDER THAT HE CAN CONTINUE LIVING THERE.

IT IS A FAMILY HOME, AND IT HAS BEEN IN THE FAMILY.

HIS SISTER PEGGY PASSED AWAY IN 2018.

HE WAS CLOSE WITH PEGGY.

AND ALL OF THESE CIRCUMSTANCES, THE DEATHS OF THE, OF THE WOMEN IN THE HOUSEHOLD WHOM HE DID DEPEND ON, UH, BRING US TO WHERE WE ARE HERE TODAY.

NONETHELESS, HE UNDERSTANDS.

AND, AND NOW THAT HE DOES, CAN VERIFY THAT HE WOULD HOLD OWNERSHIP IN THE PROPERTY, THEN HE HAS THE ABILITY.

AND I DON'T THINK THAT YOU KNEW THAT IT WAS UP FOR FORECLOSURE.

UM, NOW OF ALL THE RESEARCH I DID, THAT WAS ONE THAT I DID NOT DO , BUT SO IT SET UP FOR FORECLOSURE IN JANUARY.

BETWEEN THEN AND TODAY, THERE IS SUFFICIENT TIME FOR DOCUMENTATION TO BE PRESENTED TO THE COURT, EVEN IF NOT IN ITS FINAL OR AN ORDER FOR HIM TO BE ABLE TO DEMONSTRATE THAT HE HAS THE ABILITY BECAUSE HE HAS PART OWNERSHIP AT THAT POINT.

UM, THERE ARE OTHER METHODOLOGIES BY WHICH FORECLOSURE COULD BE POTENTIALLY AVOIDED GIVEN THAT THIS IS HIS FAMILY HOME, THAT HE WAS NOT INFORMED, THAT HE WASN'T HEIR, THAT THERE WAS A PROBATE THAT WAS NEVER EVEN COMPLETED.

THAT UNTIL THIS INFORMATION CAME TO LIGHT, BECAUSE I LOOKED IT UP, HE NOW KNOWS THIS, HERE WAS HIS INTENT ANYWAY, TO WANT TO LIVE THERE AND REPAIR IT, EVEN, EVEN WITHOUT BELIEVING HE MIGHT NOT HAVE ANY OWNERSHIP.

SO GIVEN THE SITUATION, THE TIMELINE BY DECEMBER 10TH AND I UNDERSTAND SEEMS PREMATURE IN THE ONLY, FROM THE PERSPECTIVE THAT IT WON'T BE UNTIL JANUARY, THAT THE COURT WILL MAKE A DETERMINATION AS TO ITS FORECLOSURE.

AND THE, AND THE COURT WOULD HAVE THE PRIMARY DUTY OF DETERMINING THAT WHOEVER IS IN THERE AND WHO IS ENTITLED TO MAKE CLAIM, BE AWARE OF THE POTENTIAL FOR THE LOSS OF PROPERTY AND OR ITS VALUE, WHICH UP UNTIL NOW, HE DID NOT KNOW, AND HE DID, DIDN'T KNOW THAT IT WAS UP FOR FORECLOSURE EITHER.

SO AT THE VERY LEAST, NOT THAT THIS IS WHAT HE WANTS AS AN, AS AN ATTORNEY, I WOULD SAY HE WOULD AT LEAST HAVE THE AUTHORITY OR THE, IN THE, THE OPPORTUNITY TO REHABILITATE THE HOME SO THAT HE CAN LIVE THERE.

HE WANTS TO LIVE THERE.

HE'S DOING ALL HE CAN AT THIS POINT TO TRY TO MAKE A PLAN IN LIGHT.

HOWEVER OF THE PLAN IS THIS SITUATION.

AND UNTIL THE COURT CAN MAKE A DETERMINATION AS TO WHETHER IT BE FORECLOSED OR NOT, OR WHETHER THERE IS EVEN A NECESSITY GIVEN THE CIRCUMSTANCES AT LAW, THEN WE REQUEST THAT IT BE CONTINUED OR THAT THE ACCRUAL DATE FOR THE 23RD FOR THE AUTHORIZATION TO DEMOLISH THE BUILDING BE HELD OFF AND POSTPONED FOR A DATE AFTER WHICH THE COURT CAN MAKE A DETERMINATION IN THE INTERIM, EVEN THOUGH HE HAS NOT YET HAD THE DOCUMENTS.

I KNOW THAT IS MR. DREW'S INTENT TO MAKE ALL EFFORT DURING THIS YEAR TO TAKE CARE OF THE ELECTRICAL SERVICE RESTORED.

NOW, THERE'S A DATE OF OCTOBER 10TH, 2022.

MR. DURRY HAD APPROACHED BEFORE THE UTILITY COMPANIES, AND YES, AS OF NOW HE HAS HIS IDENTIFICATION, WHICH PROVES HIS IDENTITY.

HE HAS HIS VA CARD, WHICH PROVES THAT HE IS ALSO ENTITLED TO GOVERNMENT BENEFITS, WHICH HE IS RECEIVING.

HE IS A VIETNAM VETERAN.

HE CAME BACK TO US AFTER THE WAR AND, AND ALSO HE WOULD BE ABLE TO RECEIVE SOCIAL SECURITY BENEFITS.

AND FOR A PERIOD OF TIME, I THINK THEY CEASED.

BUT, AND YOU MAY CORRECT ME IF I'M WRONG, BUT HE, BUT, BUT, UM, SO HE WOULD HAVE THE FUNDS AVAILABLE TO DO THAT.

ADDITIONALLY, GIVEN THE CIRCUMSTANCES AND AS PART OWNER,

[01:05:01]

AND GIVEN THE FACT THAT HE IS A VIETNAM VETERAN, THERE ARE PROGRAMS THAT ARE BECOMING OPEN THAT MIGHT BE SOLIDIFIED THIS VERY YEAR.

AND I KNOW WE'RE TALKING ABOUT MAZE, BUT THERE'S NO QUESTION, AND THERE IS NO DOUBT THAT GIVEN THE PANDEMIC AND GIVEN THE HOUSING SITUATION THAT IS, THAT IS OCCURRING AROUND DALLAS COUNTY RIGHT NOW WITH THE RISE IN, UM, RENTS AND THE POPULATION AND THE PROBLEMS WITH EVICTIONS.

WE RECEIVED ON ONE DAY, 2000 TELEPHONE CALLS TO OUR OFFICE REQUESTING ASSISTANCE.

THIS WAS ALL, AND THAT'S THE ONE DAY, THAT WAS THE LARGEST DAY.

IT WAS A LITTLE OVER 2000.

BUT THAT IS THE TYPE OF SITUATION THAT WE ARE DEALING WITH.

SO THE DECEMBER 10TH DATE, WE, WE REQUESTED PERHAPS CODE COMPLIANCE.

WE CAN WORK TOGETHER TO MAKE A DETERMINATION OF WHAT, WHAT CAN BE DONE IN ORDER TO BRING THIS, THIS LOCALE TO HAVE A HABITABLE DEGREE.

AND THAT MR. DREWRY COULD TAKE ADVANTAGE OF THE PROGRAMS THAT ARE OFFERED IN ORDER TO REHABILITATE HIS HOUSE SO THAT HE CAN LIVE THERE AND NOT, AND NOT, UM, BE HOMELESS FOR AT LEAST A WHILE OR BE ASKED TO GO OUT INTO THE WORLD AND PAY RENT FOR, UH, LOCATIONS THAT, THAT ARE VERY EXPENSIVE FOR MINIMAL RETURN OTHER THAN A PLACE TO LAY DOWN.

OKAY, MS. MS. CANO APPRECIATE YOU COMING OUT DOING YOUR EXTENSIVE RESEARCH.

UM, I JUST HAVE TWO BASIC QUESTIONS AND THEN WE'LL PROCEED FORWARD WITH OTHER QUESTIONING FROM THE OTHER BOARD MEMBERS.

NUMBER ONE, NUMBER ONE, AS LEGAL REPRESENTATION.

AS LEGAL COUNSEL.

WE'LL, WE'RE GONNA ENTER IN ALL OF YOUR RESEARCH IN AS, AS EXHIBIT A.

WE'LL GIVE THE BOARD MEMBERS A CHANCE TO REVIEW THAT NUMBER, NUMBER ONE.

NUMBER TWO, YOU'RE FAMILIAR WITH WHAT THE, WHAT THE STAFF OR THE CITY IS RECOMMENDING TONIGHT? YES, I WILL.

I MEAN, YOUR TESTIMONY WAS CLEAR ABOUT SOME OF THE OBSTACLES AND CHALLENGES, BUT WE NEED TO BE MORE SPECIFIC.

WE NOT DEALING WITH INDEFINITE AMOUNT OF TIME AS, AS FAR AS MAKING A DECISION.

THE, THE CITY HAS BROUGHT FORTH SOME TIMELINES AND SOME DATE.

SO AS LEGAL REPRESENTATION OF, OF THE, OF THE AIR AIRSHIP, CAN YOU BE MORE SPECIFIC OF WHAT TIME WILL BE PRACTICAL OF, AS FAR AS GETTING, UH, ADDRESSING ALL THE VIOLATIONS THIS'S BEING BROUGHT BEFORE US TONIGHT? IF THERE IS A COURT DATE SET OF JANUARY AND 2023, UH, REGARDING FORECLOSURE, THEN UH, IT WOULD BE, IT WOULD BEHOOVE US AND IT WOULD HAVE TO BE REQUIRED THAT PRIOR TO THAT DATE, THERE WOULD HAVE TO BE THE EVIDENCE PUT FORTH TO THE COURT AND THE DOCUMENTS FILED THAT WOULD BE NECESSARY TO ESTABLISH HIS AIRSHIP LINE IN ORDER TO BE UNDER ACKNOWLEDGED.

OKAY.

CONSIDERING ALL THOSE FACTORS AND TIMELINES, GIVE US, GIVE US A DATE.

A DATE CONSIDERING ALL THOSE COMPONENTS THAT YOU JUST COMMUNICATED.

I THINK THAT, UM, DID YOU INDICATE, MAY I ASK A QUESTION ABOUT THE DATE THAT THE COURT IS SET FOR, PLEASE? I MIGHT BE OF SOME HELP WITH THE, THE PROBATE MATTER IS CURRENTLY SET FOR TRIAL ON FEBRUARY 13TH, 2023.

FEBRUARY 13TH.

OKAY.

30 DAYS BEFORE THAT.

30 DAYS BEFORE THAT.

SO WE'RE MS. GANO, ARE WE TALKING ABOUT THAT'S REASONABLE TO HAVE THE DOCUMENTATION? YES.

FOR AIRSHIP, WELL, WE HAVE DOCUMENTATION.

THAT'S ONE COMPONENT.

THE SECOND COMPONENT IS BRINGING THE PROPERTY UP TO CODE.

WE GOT DOCUMENTATION, BUT WE GOT, WE HAVE VIOLATIONS HERE THAT IS SPECIFIED DATES OF COMPLIANCE.

MY QUESTION TO YOU.

WE GOT DOCUMENTATION DATE AND WE HAVE COMPLIANCE DATES.

MY QUESTION TO YOU IS LEGAL REPRESENTATION.

WHAT IS A PRACTICAL TIMEFRAME GIVEN ALL THE COMPONENTS TO BRING THIS PROPERTY BACK INTO VIOLATION? WHAT IS PRACTICAL? UH, I DON'T, I I DON'T HAVE THAT ANSWER FOR YOU.

WE UNDERSTAND WHAT THE STAFF RECOMMENDATION IS.

NUMBER ONE, IT WAS MR. DREW'S ANSWER FROM

[01:10:01]

THE UTILITY COMPANIES WHEN HE, WHEN HE WENT TO, TO PUT IT BACK ON, BECAUSE THERE IS NOTHING WRONG WITH, WITH THE UTILITIES AND IN THE, IN AND OF ITSELF THAT THEY CAN BE TURNED ON.

THERE'S NOT A FAILURE IN BEING ABLE TO DELIVER ELECTRICITY.

HOWEVER, I, THEY TOLD HIM THAT THERE WAS A HOLD PUT ON BY, BY THE CODE DEPARTMENT.

WE DON'T KNOW OF ANY HOLD PUT ON BY THE CODE DEPARTMENT.

SO IN ORDER FOR HIM TO ESTABLISH IT BY OCTOBER 10TH, COULD YOU ESTABLISH IT BY OCTOBER THE 10TH, YOU TOLD ME THAT I HAD HAVE MY NAME.

YOU HAVE THAT YOU HAVE ALL THE IDENTIFICATION, CORRECT? YES, MA'AM. <
