UH, THE ONLY ADMINISTRATIVE SUMMONS THAT CAME BACK AS DELIVERY ATTEMPT AND NOT DELIVERED WAS TO MR. UH, EDDIE GENTRY, WHO WE BELIEVE IS DECEASED.

THIS IS THE NOTICE OF PROCEEDINGS POSTED ON THE FRONT DOOR OF THE PROPERTY.

THIS PICTURE WAS TAKEN JUNE 26TH, 2023.

WHEN WE POSTED THE NOTICE, THE TIMELINE OF ACTIONS FOR 1560 MURRAY 1516 MURRAY BEGAN ON MAY 29TH OF THIS YEAR WHEN THE GARLAND FIRE DEPARTMENT RESPONDED TO A FIRE AT THE PROPERTY ON JUNE 9TH, 2023.

CODE COMPLIANCE STAFF INSPECTED THE PROPERTY TO ASSESS THE EXTENT OF THE FIRE DAMAGE.

THERE WAS A GENERATOR RUNNING ON THE CARPORT.

AN EXTENSION CORD RAN FROM THAT GENERATOR TO THE HOUSE, AND ANOTHER EXTENSION CORD RAN FROM A NEIGHBORING HOUSE.

TO THIS ONE.

STAFF MADE CONTACT WITH DONALD GENTRY, WHO WAS STILL LIVING IN THE HOUSE WHEN TOLD IT WAS NOT SAFE TO STAY, AND THAT THE CITY MAY HAVE RESOURCES TO HELP HIM FIND A SAFE PLACE TO STAY.

HE MADE IT CLEAR HE WAS NOT INTERESTED IN LEAVING.

HE ALSO SHARED THAT THERE WAS A WATER LEAK AND HE HAD BEEN TURNING THE WATER ON AND OFF AT THE METER.

ON JUNE 20, JUNE 13TH, 2023, CODE COMPLIANCE STAFF WENT BACK TO THE HOUSE WITH MELISSA SULLIVAN, A SOCIAL WORKER WITH THE GARLAND HEALTH DEPARTMENT.

SHE HAD ALREADY SPOKEN TO MR. GENTRY SEVERAL TIMES AND AGAIN OFFERED HIM ASSISTANCE, WHICH HE DECLINED.

CODE OF COMPLIANCE STAFF EXPLAINED TO MR. GENTRY THAT IT WAS ILLEGAL TO STAY IN A HOUSE IN ITS CURRENT CONDITION.

IT WAS UNSAFE, AND STAFF CONDEMNED THE HOUSE DURING THAT VISIT JULY 19TH, 2023.

CODE COMPLIANCE STAFF SPOKE TO RUSH GENTRY.

HE TOLD STAFF THAT THERE ARE SEVERAL HEIRS TO THE PROPERTY.

HE ALSO TOLD STAFF THEY INTENDED TO SELL THE PROPERTY.

HE DID NOT KNOW WHO WAS LIVING THERE AT THE TIME OF THE FIRE.

ON JULY 21ST, 2023, CODE COMPLIANCE STAFF SPOKE TO AN INTERESTED BUYER BY PHONE AND HE WAS AWARE OF THE CITY'S ACTIONS AT THE PROPERTY.

ON JULY 28TH, 2023, CODE COMPLIANCE STAFF RECEIVED A VOICEMAIL FROM DONALD GENTRY.

HE ASKED WHAT NEEDED TO BE DONE TO BRING THE HOUSE INTO THE PROPERTY INTO COMPLIANCE.

STAFF ATTEMPTED TO RETURN HIS CALL, BUT WE WEREN'T ABLE TO AT THE PHONE NUMBER HE HAD PROVIDED.

THESE PICTURES WERE TAKEN ON THAT FIRST INSPECTION ON JUNE 9TH, 2023.

YOU SEE THE MOST OF THE FIRE DAMAGE THERE UNDER THE CARPORT.

ON THE LEFT SIDE OF THE PICTURE, THERE'S A PICTURE OF THE GENERATOR AND A CLOSER UP PICTURE OF THE DAMAGE UNDER THE CARPORT.

AND AT THE FRONT FASCIAS AND SOFFITS, THERE'S A PICTURE FROM THE SIDE OF THE HOUSE LOOKING TOWARD THE FIRE DAMAGE UNDER THE CARPORT.

AND WHAT IS THE KITCHEN OF THE HOUSE? UNSECURED DOOR AND WINDOW.

THIS PICTURE OF THE BACK OF THE HOUSE, THIS WAS ALSO TAKEN ON JUNE 9TH.

SO THE DEFICIENCY LIST FOR 1516 MURRAY DRIVE INCLUDES A STRUCTURE DAMAGED BY FIRE, SMOKE, AND WATER, TRASH AND DEBRIS IN THE YARD, IN THE CARPORT, AND AN OCCUPIED STRUCTURE WITHOUT ELECTRIC OR WATER UTILITY SERVICE.

THE REQUIREMENTS TO COMPLY ARE THAT ALL FIRE, SMOKE, AND WATER DAMAGE MUST BE REPAIRED.

THE HOUSE MUST BE REPAIRED TO A HABITABLE CONDITION WITH REQUIRED PERMITS AND PASS FINAL INSPECTIONS BY THE BUILDING INSPECTIONS DEPARTMENT.

THE PROPERTY MUST REMAIN FREE FROM TRASH AND DEBRIS.

AN ELECTRIC AND WATER UTILITY SERVICE MUST BE RESTORED BEFORE THE HOUSE CAN BE OCCUPIED.

IT'S A PICTURE OF UNDER THE CARPORT SHOWING SOME OF THE REPAIRS AND SOME OF THE CLEANING OR PAINTING THAT HAS BEEN DONE, AND SOME OF THE ITEMS REMOVED, AND SOME OF THE FIRE DAMAGE THAT REMAINS.

IT'S A PICTURE OF THE BACK OF THE PROPERTY ALSO TAKEN TUESDAY, AUGUST 8TH, AND ANOTHER PICTURE OF THE REAR OF THE PROPERTY ALSO TAKEN TUESDAY.

IN SUMMARY, THE PROPERTY WAS DAMAGED BY FIRE ON MAY 29TH, 2023.

DONALD GENTRY, WHO OCCUPIED THE HOUSE AT THE TIME OF THE FIRE, STILL LIVES AT THE PROPERTY WITHOUT APPROVED UTILITY SERVICE.

MR. GENTRY WAS OFFERED ASSISTANCE LOCATING A PLACE TO STAY BY THE GARLAND FIRE DEPARTMENT, THE HEALTH DEPARTMENT SOCIAL WORKER, AND GARLAND CODE COMPLIANCE, BUT HAS REFUSED TO LEAVE.

THERE'S A GENERATOR UNDER THE CARPORT WITH EXTENSION CORDS RUNNING INTO THE HOUSE.

THERE'S ALSO SIGNIFICANT FIRE, SMOKE, AND WATER DAMAGE TO THE HOUSE.

DONALD GENTRY HAS TOLD STAFF THAT HE DOES NOT OWN THE HOME AND THAT HE DOES NOT HAVE INSURANCE.

I THINK TO CLARIFY THAT HE IS, HE IS PERHAPS PART OF THE ESTATE THAT OWNS THE HOME.

UH, STAFF HAS BEEN CONTACTED BY POTENTIAL BUYERS OF THE PROPERTY AND CLAIMED HEIRS OF THE PROPERTY WHO WISH TO SELL THE HOUSE.

NO PLAN FOR REPAIR HAS BEEN PRESENTED TO STAFF AND THERE ARE NO ACTIVE PERMITS WITH THE GARLAND BUILDING INSPECTIONS DEPARTMENT.

THEREFORE, STAFF RECOMMENDATION IS THAT THE, THE BUILDING BE VACATED BY AUGUST 13TH, 2013, 2023.

AND SPEAKING WITH ANOTHER, HE RUSH GENTRY, HE PLAN, HIS PLAN SEEMS TO BE TO SELL THE PROPERTY.

IF THE BUILDING IS NOT REPAIRED TO A HABITABLE CONDITION AND A FINAL INSPECTION IS NOT CONDUCTED BY THE CODE COMPLIANCE DEPARTMENT.

BY NOVEMBER 10TH, 2023, CIVIL PENALTIES IN THE AMOUNT OF A HUNDRED DOLLARS PER DAY BE ASSESSED AGAINST THE PROPERTY BEGINNING NOVEMBER 11TH, 2023 AND CONTINUE UNTIL THE BUILDING IS REPAIRED TO A HABITABLE CONDITION.

AND A FINAL INSPECTION IS CONDUCTED BY THE KOCH COMPLIANCE DEPARTMENT.

IF THE BUILDING IS NOT REPAIRED TO A HABITABLE CONDITION, AND PENALTIES HAVE CONTINUED TO ACCRUE BY DECEMBER 11TH, 2023, THE CITY IS AUTHORIZED TO DEMOLISH ALL STRUCTURES ON THE PROPERTY.
