UH, SO WELCOME BACK.

HOPE WE EVERYBODY HAD A GREAT NEW YEAR'S.

UH, JUST ONE POINT REAL QUICK, UH, COUNSEL, YOU MAY HAVE NOTICED, AND TO THE PUBLIC, WE HAVE A LITTLE BIT DIFFERENT FORMAT THAT OUR AGENDAS ARE BEING, UH, PRESENTED IN.

AND ONE THING ON OUR, OUR WORK SESSION AGENDA, UH, THERE ARE TWO ITEMS THAT PREVIOUSLY WERE NUMBERED AGENDA ITEMS THAT WILL JUST NOW BE, THEY WILL JUST BE ON THE AGENDA.

THERE IS ALSO, UH, SOME HANDOUTS THAT HAVE MADE THEIR WAY AROUND, AND WE WILL INVITE REPRESENTATIVES FROM THE CHARTER REVIEW TO COME FORWARD AND COUNSEL, YOU KNOW, KIND OF THE, THE IDEA FOR WHILE THEY GET SETTLED, UH, THE IDEA, THE, FOR TONIGHT, UH, IS FOR THE REVIEW PROCESS AND RECOMMENDATIONS.

UM, YES, THERE'S CERTAINLY, YOU KNOW, CERTAINLY WE CAN HAVE QUESTIONS AND THINGS, BUT WE WILL BRING THIS BACK AT THE JANUARY 22ND, I BELIEVE, WORK SESSION FOR DISCUSSION, FURTHER DISCUSSION AND ACTION TO, UH, IF FOR ITEMS WE'RE MOVING FORWARD ON.

ALL TOO MUCH , VAGUELY .

WELL, UH, IF I MAY, BEFORE YOU GET GOING, I THINK I'VE TOLD SOME OF YOU, I DON'T KNOW IF IT'S BY ACCIDENT OR BY DESIGN.

Y'ALL PUT TOGETHER ALMOST THE PERFECT GROUP FOR THIS JOB BECAUSE WE GOT VIEWPOINTS FROM ALL ASPECTS OF THE CITY.

AND LEMME GO THROUGH AND, AND ESPECIALLY FOR THE PUBLIC WHO LET 'EM KNOW WHO WAS ON THIS COMMITTEE.

WE HAD TWO FAR FORMER GARLAND CITY STAFF MEMBERS, DOROTHY WHITE, PUBLIC RELATIONS AND MEDIA DIRECTOR.

AND MARTIN GLENN, HE WAS A DEPUTY CITY MANAGER.

SO WE GOT TO SEE THE VIEWPOINTS FROM WITHIN THE ADMINISTRATION, AND THAT'S SOMETHING WE HAVEN'T, HAVEN'T DONE BEFORE.

AND WE HAVE TWO FORMER COUNCIL MEMBERS AND A MAYOR.

LORI DOTSON WAS A MAYOR AND A COUNCIL MEMBER.

AND THIS GENTLEMAN HERE, ROBERT SMITH, FORMER COUNCIL MEMBER.

SO WE GOT TO SEE THE POLITICAL ASPECTS OF ALL THESE ISSUES.

AND THEN PEOPLE KNEW HER TO PUBLIC SERVICE.

UH, GAIL OWENS, SHE'S ON THE PROPERTY STANDARDS BOARD.

I DON'T THINK SHE'S BEEN IN ANYTHING ELSE.

BILL OAKS OVER THERE.

AND THIS IS HIS FIRST, UH, FORAY INTO THIS.

SO YOU JUST THROW HIM INTO THE DEEP END OF THE WATER.

BUT HE WAS ALL VERY GOOD.

AND STEVE SILAS, IF YOU'RE A MEMBER AT YOUR LAST MEETING, YOU FOLKS HONOR THEM FOR THE WORK HE'S DONE IN THE NEIGHBORHOODS.

AND THEN YOU HAD TWO LONG-TERM VOLUNTEER SERVANTS, UH, MIKE ROSE AND MYSELF.

AND I FIGURED BETWEEN THE TWO OF US, WE HAVE 50 TO 70 YEARS OF GIVING BACK TO THE CITY.

SO I WOULD KEEP THESE FOLKS ON YOUR SHORT LIST OF APPOINTEES IN THE FUTURE.

THEY WERE ALL VERY GOOD.

AND WE DISCUSSED ALL THE ITEMS FROM EVERY ANGLE.

IT WAS FREEWHEELING DISCUSSIONS, BUT IT ALL CON GELLED TOGETHER.

AND ALMOST ALL ITEMS, EVERYTHING WAS UNANIMOUS VOTE.

IF THERE WAS DISSENTING VOTE, IT WAS USUALLY ON A, JUST A TECHNICAL ITEM OR TWO, YOU KNOW, MAYBE A NUMBER HERE AND A NUMBER THERE.

AND I'D ALSO LIKE TO THANK THE STAFF MEMBERS AND TRACY ALMOND DINGER.

SHE'S NOT HERE TONIGHT, BUT THESE FOLKS HAD THE ANSWERS WHEN WE NEEDED THEM.

UM, Y'ALL CHARGED THE, UH, CHARTER REVIEW COMMITTEE BACK IN SEPTEMBER WITH 15 SPECIFIC ITEMS YOU WANTED THEM TO REVIEW, BUT THEN YOU WERE ALSO SPECIFIC THAT YOU WANTED THEM TO BE ABLE TO CONSIDER THEIR OWN ITEMS IF THEY HAD THOSE FOR CONSIDERATION AS WELL.

AND THEY HAPPILY DID THOSE OVER SEVEN MEETINGS BETWEEN SEPTEMBER AND DECEMBER.

UM, SO WHAT WE HAVE TONIGHT IS THE PRESENTATION OF THOSE RECOMMENDATIONS.

UH, WE'LL GO THROUGH HOW WE'VE SET THE PRESENTATION UP IS JUST THROUGH YOUR CHARGE ORDER.

UH, THE ITEMS WENT THROUGH 15, AND THEN AFTER THAT, THE RECOMMENDATIONS THAT THE COMMITTEE HAS TO MAKE THAT WERE NOT PART OF YOUR CHARGE, BUT THAT THEY CONSIDERED AND THEY WOULD RECOMMEND YOU, UH, TAKING UNDER ADVISEMENT FOR, TO PUT TO A VOTE.

UM, SO WE WILL, AS THE MAYOR SAID, WE WILL GO THROUGH THESE TONIGHT AND THEN WE WILL PLACE ANOTHER WORK SESSION AT THE SECOND WORK SESSION HERE IN JANUARY SO THAT Y'ALL CAN DISCUSS IN MORE DETAIL AMONGST YOURSELF AT THAT TIME.

AND THEN GIVE PHIL AND I DIRECTION AS TO WHAT YOU WOULD LIKE SENT, UM, AS PART OF THE ELECTION SO THAT WE CAN START DRAFTING THAT ORDINANCE TO CALL THE ELECTION IF COUNCIL DECIDES YOU WANT ONE IN MAY.

SO, ANY QUESTIONS JUST ABOUT PROCESS NOW BEFORE WE GET INTO THE RECOMMENDATIONS OF THE COMMITTEE AND FOR THE DISCUSSION AND THE BACKGROUND AND, AND WHY THEY DID WHAT THEY DID? THAT'S WHY WE HAVE THESE TWO FINE GENTLEMEN SITTING HERE, BUT, UM, START WITH CHARGE ITEM ONE.

UH, THEY WERE ASKED TO CONSIDER, UH, COUNCIL MEMBER TERM LINKS AND LIMITS, UH, SPECIFICALLY, UH, LENGTHENING THE CURRENT TERM FROM TWO TO THREE YEARS, AND THEN REDUCING THE TERM LIMITS FROM THREE TO TWO AFTER EXTENSIVE DETAILED DISCUSSION BY THE, BY THE COMMITTEE, UM, THAT I AM A WITNESS TO.

UH, THEIR ULTIMATE RECOMMENDATION ON THIS ONE WAS NO CHANGE.

SO IF THERE ARE ANY SPECIFIC QUESTIONS OR COMMENTS THAT Y'ALL WOULD LIKE TO THROW IN THERE, YOU TWO, NO, SOME OF THIS WAS DUE TO STATE LAW TOO AND THE DIFFERENT ASPECTS IT HAS IN THE CITY AND ITS ELECTIONS, WHETHER YOU'RE AT TWO YEAR OR THREE YEAR TERMS, AND THEY CAN GET INTO MORE DETAIL ON THAT IF YOU WANT LATER.

UM, LET'S GO THROUGH ALL OF THEM AND THEN WE'LL COME BACK TO QUESTIONS THAT WAY WE JUST KIND OF KEEP A FLOW GOING HERE.

UH, CHARGE ITEM TWO WAS THE, UH, CONSIDER THE ELIGIBILITY WAIT TIME FOR ALTERNATIVE COUNCIL POSITIONS.

UM, THE, UH, COMMITTEE RECOMMENDS NO CHANGE BASED ON THAT.

NOW, I DID DROP A FOOTNOTE ON THIS SLIDE THAT THERE IS A CHANGE RECOMMENDED TO THIS SPECIFIC SECTION OF THE CHARTER, BUT IT'S BECAUSE OF A DIFFERENT REASON.

IT IS NOT FOR THE WAIT TIME.

SO THAT WAS ARTICLE THREE, SECTION 1D AND THEN ITEM THREE WAS RELATED TO THE SAME SECTION ABOUT A WAIT TIME FOR, UH, A POSITION ON A BOARD COMMITTEE OR COMMISSION.

AGAIN, THE COMMITTEE RECOMMENDS NO CHANGE BASED ON THAT CRITERIA, BUT THIS IS THAT SAME SECTION THAT WE DO HAVE A CHANGE THAT WE'LL BRING UP LATER IN CHARGE.

ITEM FOUR, UH, WAS THE MAYOR AND COUNCIL MEMBER COMPENSATION.

UM, THE COMMITTEE DID DECIDE THAT, UH, THEY WOULD RECOMMEND RAISING THE COMPENSATION TO THE MAYOR AND THE, UH, COUNCIL MEMBERS.

UH, WE HAVE IN HERE, AND YOU'LL SEE THIS AS WE GO THROUGH, UH, A RED LINE OF THE CHANGES THAT THEY WOULD RECOMMEND, UH, COUNSEL TO CONSIDER.

UH, BASED ON THEIR DISCUSSION.

UH, THEY CAN PROBABLY GIVE YOU MORE, UH, DETAILS AS TO WHY THEY CHOSE THE AMOUNTS THEY DID.

UH, GENERALLY THOUGH, IT WAS MY UNDERSTANDING THAT IT WAS, UH, IN LINE WITH THE INFLATION RATE, AND THAT'S, THAT'S EXACTLY WHAT WE DID.

UM, WE, WE DIDN'T WANT TO CHANGE THE, UH, THE METHOD OR THE REASONING BEHIND THE COMPENSATION, BUT WE DID WANNA KEEP UP WITH INFLATION.

ADDITIONALLY, WE'RE PROPOSING, UH, FOUR ADDITIONAL PAID MEETINGS PER YEAR, UH, COVERING HELPING Y'ALL COVER, UH, FUEL DRY CLEANING, CHILDCARE COSTS FOR, UH, THE SUMMER AND WINTER, UH, RETREATS AND THE, UH, OPERATING AND THE CIP BUDGET WORK SESSIONS.

UH, BUT WE DO LIMIT THE NUMBER OF PAID MEETINGS TO 52 PER YEAR.

SO SOMEBODY CAN'T GO AND CALL A BUNCH OF EXTRA MEETINGS FOR PAY.

UH, WE JUST RECOGNIZE THAT THESE, THESE MEETINGS HAVE BEEN HAPPENING EVERY YEAR FOR A VERY LONG TIME, UH, AND THAT WE SHOULD, UH, HELP DEFRAY COSTS FOR COUNCIL MEMBERS.

AND MAYOR, IF I MAY AS WELL, WE, UH, WE'RE ABLE TO PULL ALL OF THE COMPENSATION FROM OUR SISTER CITIES THAT WE TYPICALLY COMPARE FROM.

AND IF THE COUNCIL WISHES, WE CAN SHARE THAT AS WELL.

WE DID NOT PUT THAT IN THIS, IN THIS PACKET, BUT WE CAN SHARE THAT WITH THE COUNCIL IF THEY WISH.

I, I WAS GONNA MENTION THAT WE DID LOOK INTO THAT AND CITIES OF COMPARABLE SIZE WERE RIGHT WELL WITHIN THE RANGE.

AND IT WAS A THOUGHTS WE DIDN'T WANNA MAKE IT TO WHERE IT WAS A JOB FOR SOMEBODY.

Y'ALL ARE SERVANTS AND EVERYBODY ON THE COMMITTEE REALIZED THE AMOUNT OF EFFORT, MANY, MOST ALL OF YOU, EVERYBODY PUTS IN AND WE KNOW THIS DOESN'T

REALLY COMPENSATE FOR IT, BUT IT SHOULDN'T BE A JOB THAT YOU'RE STRIVING FOR AN INCOME FOR.

SO IT WAS A TRICKY BALANCE THERE.

ALL RIGHT.

CHARGE ITEM FIVE WAS, UH, RELATED TO ADDING IN THE DEPUTY MAYOR PRO TIM, NOW THAT WE HAVE THAT POSITION, UM, THIS WAS A PRETTY TEXTUAL CHANGE, BUT IT ADDS IT IN THERE, UM, IN THE SECOND PARAGRAPH.

AND THEN, BECAUSE WE WERE CHANGING THE SECTION ANYWAY, UM, THEY ADDED, UH, RECOMMEND ADDING THE GENDER NEUTRAL LANGUAGE TO THE, UH, FIRST PARAGRAPH OF THAT SECTION SINCE WE'RE CHANGING THE SECTION ANYWAY.

SO MOST OF THE GENDER NEUTRAL CHANGES WERE MADE THE LAST TIME.

YEAH, I THOUGHT WE, YEAH, ONE SLIPPED THROUGH.

MOST OF MOST OF THEM WERE MADE.

ONE OF THEM SLIPPED THROUGH AND IT JUST HAPPENED TO BE A SECTION WE WERE CHANGING ANYWAY.

AND IT DOES KIND OF BRING UP AN KIND OF ANOTHER TOPIC.

WE DIDN'T MAKE A BUNCH OF CHANGES HERE AND THERE JUST FOR VERBIAGE AND STUFF, BECAUSE WHEN THE STATE PASSED THEIR NEW LAWS, THEY REQUIRED A NEW NOTIFICATION, WHICH GETS INTO A LARGE EXPENSE IN PUBLISHING AN ITEM FOR VOTING ON.

SO IF IT REALLY WASN'T, YOU KNOW, THAT IMPORTANT, JUST CHANGING WORD HERE AND THERE, WE OPT NOT TO DO IT TO BUDGET-WISE.

ALRIGHT, JUST BRIEFLY, PART OF THE CHANGE THAT, UH, CHAIRMAN ROBERTS IS REFERRING TO IS THAT LAST TIME, UH, WHEN Y'ALL WENT THROUGH THIS IN 2018, YOU COULD KIND OF CONSOLIDATE WHAT YOUR CHANGES WERE WHEN YOU WERE EXPLAINING WHAT THOSE WERE IN YOUR PUBLICATIONS AND, UH, ITEMS LIKE THAT THAT WE HAVE WOULD'VE TO PAY FOR SPECIFICALLY.

NOW WHEN WE PUBLISH IT, WE'VE GOTTA PUT IT ALL OUT IN VERY SPECIFIC DETAILS.

SO THE PUBLICATION CHARGE FOR THESE CHANGES IS GOING TO GO UP BECAUSE OF EVERYTHING THAT WE NOW HAVE TO, ARE REQUIRED TO PUT OUT THERE, MULTIPLE COLUMN INCHES IN USED IN THE BUSINESS.

CHARGE ITEM SIX WAS, UM, ELIGIBILITY.

OH WAIT, TIME FOR THE INTERIM MAYOR, COUNCIL MEMBER, UH, THE KITTY COMMITTEE CONSIDERED THIS AND RECOMMENDS NO CHANGE RELATED TO THAT ONE.

UH, SEVEN WAS RESTRICTION ON RESIGNATION FOR CANDIDACY.

I WANNA SAY THE DISCUSSION FOR THIS ONE ACTUALLY SPANNED TWO EVENINGS, BUT AT THE END OF IT, THE COMMITTEE CAME DOWN WITH A RECOMMENDATION OF NO CHANGE, UH, CHARGE ITEM EIGHT WAS THE ESTABLISHMENT OF ROADS.

THIS WAS ONE OF THOSE THAT WAS A TEXTUAL CHANGE.

UM, BECAUSE OUR CHARTER SPECIFICALLY USES THE WORD STRAIGHTEN WHILE STRAIGHTEN IS IN THERE, WE'RE NOT LIMITED BY THAT.

AND THE COMMITTEE DECIDED THAT THEY THINK THE OTHER CHANGES ARE MORE IMPORTANT AND THAT THE, FOR THE CITY TO FOCUS ON.

AND SO THEY RECOMMENDED NO CHANGE HERE.

UM, JUST FOR THAT REASON, THAT WAS ONE TO SAVE A BUCK ON.

SO CHARGE ITEM NINE WAS THE REMOVAL OF OFFICIALS.

UH, THIS ONE, THEY DO HAVE A RECOMMENDATION ON THE CHANGE.

UM, THEY DID NOT WANT TO MAKE IT A UNILATERAL DECISION OF A SINGLE COUNCIL MEMBER BECAUSE, UH, APPOINTEES ARE, UH, CONFIRMED BY FULL COUNSEL.

THEY WANT 'EM TO STILL BE REMOVED BY FULL COUNSEL, BUT THEY WANTED IT TO BE A LITTLE MORE BROAD AS TO WHAT IT COVERED IN THE SECTION.

SO THAT'S THE CHANGE YOU SEE ABOVE YOU THIS EVENING.

I DIDN'T KNOW IF Y'ALL HAD SOMETHING YOU WANTED TO ADD ON THAT ONE.

NO.

JUST KIND OF FIGURED IT TAKES FIVE TO PUT US ON SOMETHING.

AND JUST A SIMPLE CALL AND NO NOTIFICATION IS NOTED OR ANYTHING.

SO CHARGE ITEM 10 WAS COUNCIL MEMBER INTERACTIONS WITH APPOINTMENTS.

UH, THE COMMITTEE DISCUSSED THIS AND DECIDED THAT THE COUNCIL THERE, THERE IS THE COUNCIL POLICIES AND PROCEDURES THAT YOU ADOPT AS A BODY THAT ARE OUTSIDE THE CHARTER THAT HAS A FULL SECTION RELATED TO THE INTERACTIONS THAT COUNCIL MEMBERS ARE SUPPOSED TO HAVE WITH STAFF.

SO THE COMMITTEE DECIDED THAT, UH, THEY DID NOT WANNA RECOMMEND A CHANGE RELATED TO CHANGING WHAT THAT POLICY WOULD BE BECAUSE THAT COMES BEFORE Y'ALL ANYWAY.

BUT THEY THINK THAT A BETTER WAY TO DEAL WITH IT WOULD BE UNDER THE CITY'S CODE OF ETHICS, UM, FOR DISCIPLINARY PURPOSES.

YEAH, THE WITHHOLDING OF FUNDS BECAME KIND OF TRICKY LEGAL LEGALLY.

AND GOING BACK TO EACH OF THE PREVIOUS CHARTER CHANGES, WE ARE ALWAYS CHASING STATE LAW ON THIS.

UM, AND SO IT SEEMS, UH, IT SEEMED TO US AT THE TIME IT MIGHT BE MORE WISE TO, UH, JUST REFERENCE A DOCUMENT THAT WE CAN CHANGE A LITTLE BIT MORE QUICKLY, UH, TO KEEP, KEEP UP WITH STATE LAW.

AND THE ETHICS ORDINANCE SEEMED TO BE THE CORRECT, UH, PLACE TO GO TO FOR THAT CHARGE.

ITEM 11 WAS THE CITY MANAGER'S CONTRACT LENGTH.

UM, CONSIDER REVISING IT TO ALLOW FOR A LONGER TIME THAT THE CONTRACT COULD BE FOR, UH, THE COMMITTEE DISCUSS, DISCUSSED IT AND DECIDED THAT THEY WOULD RECOMMEND A FIVE YEAR, UM, ALLOWANCE UNDER THE CONTRACT.

UM, WE'LL GET TO IT LATER, BUT THEY THEN EXPANDED THAT AND DECIDED THAT THEY WOULD RECOMMEND THAT THE OTHER COUNCIL APPOINTED CONTRACTS, UH, BE SIMILAR.

SO YOU'LL SEE THAT COMING UP FOR THE CITY ATTORNEY AND THE CITY AUDITOR.

ONE OF THE IMPORTANT THINGS HERE TO REMEMBER WITH THE CITY MANAGER IS THAT HE IS, OR SHE, UH, WOULD, IS REQUIRED TO LIVE INSIDE THE CITY

LIMITS.

AND SO THAT WAS ONE OF THE REASONS WE WE DID VOTE TO EXTEND THE MAXIMUM ALLOWABLE IS BECAUSE WE KNOW THAT THERE'S A COMMITMENT TO MOVING.

SO, UH, CHARGE ITEM 12 WAS, UM, ELIGIBILITY OF MEMBERS WHO PREVIOUSLY SERVED ON COUNCIL, UM, POTENTIALLY TO ADD A WAIT PERIOD, UH, FOR PERSONS WHO HAD BEEN SERVING ON THE MAYOR COUNCIL BEFORE THEY COULD SERVE ON A, ON THE PLAN COMMISSION.

UH, THE COMMITTEE DISCUSSED IT AND DECIDED THEY WOULD RECOMMEND NO CHANGE AT THIS SECTION AS WELL.

UH, CHARGE ITEM 13 IS AN INCREASED VOTE TO OVERRIDE THE PLAN COMMISSION RECOMMENDATION.

UH, THE COMMITTEE DISCUSSED IT.

THERE WERE LOTS OF DETAILED DISCUSSION OVER THE PROCEDURE FOR THINGS TO BE REVIEWED BY PLAN COMMISSION.

AND THEN WHEN THEY COME TO COUNCIL AND THE POTENTIAL THAT THEY'RE, WITH THE SHOCK CLOCK BEING ROLLED OFF FOR A LOT OF THINGS, THERE'S POTENTIAL FOR LOTS OF ITEMS TO CHANGE BETWEEN PLAN, COMMISSION AND COUNSEL IN THE DETAILS.

AND SO THEY WANT COUNCIL TO BE ABLE TO HAVE ITS AUTHORITY TO APPROVE OR DENY SOMETHING WHEN IT COMES TO COUNSEL.

THAT'S PRETTY MUCH IT.

WELL, I APPRECIATE THE THOUGHTS BEHIND IT AND EVERYTHING.

WHAT YOU SEE MAY BE SUBSTANTIALLY DIFFERENT THAN FROM WHAT WE SEE WITH THAT.

WITH THE SHOT CLOCK, IT MIGHT HAVE MADE MORE SENSE, BUT WITH THE SHOT CLOCK IN YEARS PASSED, SOME APPLICANTS TAKE TWO TO THREE MONTHS TO GET BACK TO YOU.

'CAUSE WE'LL HAVE READ 'EM THE RIOT ACT.

THE CITIZENS WILL HAVE JUMPED ON 'EM AND THEY COME BACK AND REDESIGN AND NO POINT HOLDING THEM TO A STANDARD THAT'S NO LONGER THERE.

UH, CHARGE ITEM 14 WAS, UM, CLEANING UP THE LANGUAGE RELATED TO THE, UH, CITY'S PLANNING AND ZONING POWERS.

UM, IT WAS AGREED THAT THIS COULD BE SIMPLIFIED AND NOT MADE TO SEEM SO EXCLUSIVE, EVEN THOUGH IT'S NOT EXCLUSIVE, IT WAS NEVER INTENDED TO BE EXCLUSIVE.

IT KIND OF READ THAT WAY TO SOME PEOPLE.

SO IT WAS DECIDED THIS SHOULD JUST BE AN INCLUSIVE, SIMPLIFIED GRANT OF AUTHORITY TO THE CITY.

SO THAT'S THE LANGUAGE THAT IS HERE.

SO IT TAKES OUT A LOT OF THE SPECIFIC STUFF AND MAKES IT AS BROAD AS WE CAN MAKE IT.

AND THEN CHARGE ITEM, UH, 15 WERE, UH, RECOMMENDATIONS BY LEGAL AND STAFF, UM, A LOT OF TIMES RELATED TO EITHER VERY PRACTICAL ISSUES OR, UH, ISSUES THAT HAVE BEEN RAISED BECAUSE OF CHANGES IN STATE LAW.

UH, SO THE FIRST ONE WAS A, UH, CHANGING THE DEFINITION OF TERM AND ARTICLE THREE, UH, BECAUSE TERM WAS DEFINED AS, UM, A PERIOD OF ONE YEAR.

AND WHEN YOU HAVE ELECTIONS IN MAY, SOMETIMES IT'S A LITTLE LESS THAN A YEAR, SOMETIMES A LITTLE MORE THAN A YEAR.

AND SO THAT COULD RAISE PROBLEMS BECAUSE OF THAT.

SO THE RECOMMENDED, RECOMMENDED CHANGE FOR THAT IS JUST THE TIME BETWEEN THE ANNUAL STATUTORY ELECTION DATES IN MAY.

UH, THE SECOND STAFF CHANGE IS, UH, RELATED TO, UH, DELEGATION OF CERTAIN PLATT APPROVALS.

THIS IS A RECOMMENDED ADDITION TO THIS SECTION, SPECIFICALLY BECAUSE THEY CHANGED DURING THIS LAST LEGISLATIVE SESSION, UH, THAT ALLOWS FOR THIS DELEGATION THAT WAS NOT PREVIOUSLY THERE.

AND IN ESSENCE, WHAT THIS ONE DOES IS ALLOWS THE PLANNING DIRECTOR TO SIGN ALL PLATTS.

AND IF THEY TURN DOWN A PLATT, THE PLAN COMMISSION BECOMES IN ESSENCE THE APPEALS BOARD FOR TURN DOWN OR EVEN APPROVED PLANS.

YEAH.

AND, AND THIS SECTION IN AND OF ITSELF DOES NOT GRANT THAT APPROVAL.

THAT WOULD, THAT DELEGATION OF APPROVAL WOULD STILL HAVE TO COME FROM COUNSEL INDEPENDENTLY.

THIS SECTION WOULD JUST ALLOW YOU TO THEN MAKE THAT DELEGATION UNDER STATE LAW.

UH, THE THIRD ONE IS, UH, FLEXIBILITY IN THE ELECTION DATE ITSELF.

UH, THE RE BECAUSE OF ISSUES WE'VE HAD WITH COVID AND OTHER ISSUES, SOMETIMES WE CANNOT MAKE THAT ELECTION DATE IN MAY, OR THERE'S BEEN DISCUSSION OF TAKING OUT THE ELECTION DATE IN MAY AT THE, UH, HIGHER LEVELS THAN US.

SO IF THAT WERE TO HAPPEN, UH, WE WOULD TECHNICALLY NEED TO CHANGE THE CHARTER TO MOVE TO A NOVEMBER ELECTION DATE.

SO THE RECOMMENDED CHANGE HERE IS TO JUST MAKE IT EACH YEAR ON A STATE DECLARED UNIFORM ELECTION DAY, SO THAT WAY WE CAN PROCEED AS WE HAVE BEEN DOING IN MAY, UNLESS THERE IS SOMETHING OUT OF OUR CONTROL OR THE STATE DECIDES TO CHANGE IT ON US, WE WOULD NOT THEN HAVE TO COME BACK AND CHANGE THE CHARTER.

AND THOSE WERE YOUR CHARGE ITEMS. SO NEXT WE HAVE ARE THE COMMITTEE RECOMMENDATIONS BASED ON OTHER TOPICS THAT THEY RAISE THEMSELVES.

AND THE FIRST IS RELATED TO REDISTRICTING AND MA UH, GERRYMANDERING.

AND THAT ALSO TAKES OUT A FIVE YEAR CHANCE OF HAVING TO CALL ELECTIONS ALL OVER AGAIN.

AND THEN, UH, THE GERRYMANDERING LANGUAGE IS PRETTY BOILERPLATE.

UM, YOU KNOW, LOOKING BACK AT THE, THE PREVIOUS UH, CYCLE THAT WE DID WITH THE REAPPORTIONMENT, WE DID FINE.

EVERYTHING LOOKED GOOD.

AND, AND WE'D LIKE TO, TO KEEP THAT PATTERN OF SUCCESS AND TRANSPARENCY AND HONESTY WITH OUR CITIZENS THAT WE'RE, WE'RE NOT TRYING TO DRAW ANYBODY INTO ANYTHING.

YOU KNOW, WE'RE JUST, UH, WE'RE KEEPING IT SIMPLE.

SO THAT'S WHAT THE LANGUAGE HOPEFULLY ACHIEVES AND A NU NU NUMBER OF OTHER CITIES USE VERY SIMILAR TO IDENTICAL LANGUAGE.

UH, WE HAD IN THERE ALREADY THAT A COUNCIL MEMBER COULD BE REMOVED IF CONVICTED OF A FELONY ERROR CLASS, A MISDEMEANOR, AND THEY WANTED THAT TO BE ADDED TO A QUALIFICATION TO RUN THAT YOU COULD NOT BE PREVIOUSLY CONVICTED OF A FELONY OR A CLASS A MISDEMEANOR.

AND THEN WE RECOMMEND THE REMOVAL OF THE LANGUAGE OF BEING IN ARREARS FOR PAYMENT BECAUSE OF, UM, PROBLEMS ON THE LEGAL SIDE OF ENFORCING THAT.

UM, ITEM THREE WAS THE LENGTH OF THE CITY AUDITOR CONTRACT.

WE WANT TO FINISH WHAT WE'VE STARTED.

UH, WE WANT TO TAKE CARE OF WHAT WE HAVE.

SO, SO THAT LOOKS LIKE, UH, REPLACING THE EQUIPMENT AND INFRASTRUCTURE THAT WE HAVE IN PLACE ALREADY THAT HELP US DELIVER THE ESSENTIAL SERVICES TO THE RESIDENTS OF GARLAND.

UH, AND THEN WE WANNA PLAN FOR THE FUTURE.

SO WE WANNA MAKE SURE THAT WE HAVE THE DEBT SERVICE CAPACITY, UH, UH, RESERVED FOR UPCOMING INITIATIVES, WHETHER THAT'S A FUTURE BOND PROGRAM, UH, WHETHER THAT'S TAKING CARE OF OUR STREETS AND DRAINAGE OR OUR FACILITIES.

UH, SO ON, ON THOSE THREE ITEMS, I'LL, I'LL MENTION IN PARTICULAR THAT OUR, UH, WE ARE FINISHING UP A MASTER PLAN FOR OUR FACILITIES.

ESSENTIALLY, WE HAVE TAKEN ALL THE HUNDREDS OF BUILDINGS THAT THE CITY OWNS AND OPERATES AND DONE A TOP TO BOTTOM ASSESSMENT OF THOSE FACILITIES SO THAT WE HAVE SOME SENSE FOR WHAT, UH, WHAT EXPENSES WE HAVE FOR THE UPCOMING FUTURE CIPS.

AND SO THAT'S GONNA OBVIOUSLY HELP SHAPE, UH, WHAT HAPPENS IN FUTURE CIPS.

WE WANTED TO HAVE A GOOD SENSE FOR THAT.

UM, ON STREETS AND DRAINAGE, UM, WE'RE DOING A, A CITYWIDE CITY, A CITYWIDE STREET AND ALLEY ASSESSMENT THAT WILL, UH, THIS SUMMER GIVE US RESULTS THROUGH A PCI FOR EVERY STREET AND ALLEY SEGMENT IN THE CITY.

AND THAT'S GONNA HELP, UH, HELP COUNCIL MAKE POLICY DECISIONS AND FUNDING DECISIONS ABOUT, UH, OUR STREET PROGRAM MOVING FORWARD.

WE NEED TO HAVE CAPACITY FOR THAT.

AND WE'RE DOING THE SAME ON THE DRAINAGE SIDE.

WE HAVE, UM, AN EROSION, UH, STUDY UNDERWAY FOR EVERY STREAM SEGMENT IN GARLAND.

UH, LOOKING AT HOW WE CAN SHORE THOSE UP AND, AND, UH, ADEQUATELY HANDLE THE STORM DRAINAGE, UH, THAT COMES THROUGH OUR COMMUNITY.

AND THERE'S GONNA BE OTHER LONG-TERM FUNDING NEEDS THAT, THAT ARISE AS WELL.

SO, UM, AGAIN, FINISH WHAT WE'VE STARTED, TAKE CARE OF WHAT WE HAVE AND PLAN FOR THE FUTURE, REALLY WHAT THE GOALS ARE FOR THE 2024 CIP UH, GETTING INTO THE NUMBERS A LITTLE BIT.

UH, YOU'LL RECALL THE LAST TWO YEARS WE'VE HAD, UH, SORT OF RECORD CIP, UH, DOCUMENTS, UM, AND PLANS WE'RE, WE'RE NOT AT A RECORD THIS YEAR.

WE'RE OFF BY 8.9 8.9 MILLION.

UM, AGAIN, THAT'S PROBABLY AN INDICATION THAT WE'RE ON THE BACKSIDE OF IMPLEMENTING THE 2019 BOND PROGRAM AND, AND COMPLETING PROJECTS, UH, THAT WE HAVE PLANNED.

SO AGAIN, IT'S ABOUT 559.3 MILLION FOR THE FIVE YEAR CIP.

UM, THAT BREAKS DOWN TO, UM, ONE OF THE WAYS THAT WE LOOK AT THIS IS HOW MUCH OF THAT 560 MILLION IS SUPPORTED BY OUR TAX BASE, UH, SUPPORTED BY THE GENERAL FUND.

UH, AND THAT NUMBER IS 245.6 MILLION.

SO, UM, AGAIN, MOST OF THAT OVER 70%, ALMOST 80% IS, UH, COMPLETING THE, THE 2004 AND 2019 BOND PROGRAMS AND PROJECTS.
