UH, PLEASE STATE THE DRIVER RATIONALE FOR THE CONTRACT EXTENSION AMOUNT REQUESTED, AND LAURA IS GONNA ANSWER THAT ONE. SO I THINK COUNCILS HEARD ME SAY A ECOM IS THE HORSEPOWER BEHIND THE BOND PROGRAM. IT TAKES TALENTED TECHNICAL PEOPLE FOR US TO DELIVER THE PROJECTS. UM AS WITH MOST TECHNICAL POSITIONS, UH, SUCH AS PROJECT MANAGERS, ENGINEERS, ARCHITECTS, UM WE HAVE BEEN FACED WITH SOME STIFF COMPETITION BETWEEN OTHER CITIES AND THE PRIVATE SECTOR, UM, TO FILL OUR VACANT POSITIONS, AND WE HAVE SEVERAL POSITIONS THAT WE'VE BEEN UNABLE TO FILL, UH, FOR THE PAST COUPLE OF YEARS AND FOR US TO CONTINUE DELIVERING THESE PROJECTS IT IS NECESSARY FOR US TO, UM, CONTINUE AUGMENTING STAFF. WE HAVE DEVELOPED A TRANSITION PLAN THAT TAKES INTO ACCOUNT THE PROJECTS. THEY SCHEDULE THE RESOURCES THAT IT TAKES TO DELIVER. UM WE HAVE SIX POSITIONS THAT WE ARE LOOKING AT EXTENDING IN VARIOUS CAPACITIES RANGING FROM ONE MONTH TO 15 MONTHS, AND THIS REPRESENTS OVERALL A 64% REDUCTION FROM WHERE WE WERE AT THE PEAK OF THE BOND PROGRAM. UM NUMBER TWO BRIEFLY DESCRIBE THE IMPACT OR LINK BETWEEN THE STATED RATIONALE FOR THIS REQUESTED EXTENSION AND VENDOR.

PERFORMANCE SLASH PROJECTS DELIVERY. SO TO THAT, I WOULD SAY MOMENTUM IS KEY. UM A E COM HAS BEEN INSTRUMENTAL IN HELPING US TO DELIVER 70% OF THE PROJECTS WITHIN THE BOND PROGRAM . WE STILL HAVE A LITTLE WAYS TO GO. UM CONTINUITY IS KEY. SO RETAINING THE TALENT THAT WE HAVE, UM, WITH THE SPECIFIC PROJECT KNOWLEDGE IS REALLY KEY TO MINIMIZING THE DISRUPTION IN GETTING THESE PROJECTS ACROSS THE FINISH LINE. SO I'M ACTUALLY GONNA COMBINE THREE AND FOUR AND IT'S PLEASE SHARE SOME OF THE KEY PERFORMANCE ASSESSMENT TOOLS IN PLACE FOR THIS CONTRACT AND SHARE THE PROTOCOL FOR AND FREQUENCY OF VENDOR PERFORMANCE UPDATES AND REPORTING. SO WE CALL THAT A ECOM IS CONSIDERED STAFF AUGMENTATION FOR THE PROJECT MANAGEMENT OFFICE FOR THE REASONS THAT LAURA STATED, UM ASSOCIATED WITH QUESTION ONE, AND THEN YOU ASKED FOR KIND OF PROTOCOL OR FREQUENCY OF REPORTING. PRONE PROPERTY. BUY OUT PROGRAM UPDATE. THOSE ARE POSSIBLY SOME OF THE MOST DIFFICULT WORDS FOR ME TO SAY, ESPECIALLY IN A SENTENCE. IT IS IT IS. FLOOD PRONE PROPERTY. BY A PROGRAM.

UPDATE. ALL RIGHT. GOOD EVENING, HONORABLE MAYOR AND COUNCIL MEMBERS. I AM HERE TO PRESENT THE FLOOD PRONE PROPERTY. BUY OUT PROGRAM UPDATE. IT IS A MOUTHFUL. YES, IT IS. UM I WOULD BEFORE WE GET REALLY INTO WHERE WE'RE AT IN THE UPDATE ITSELF. I WANTED TO GIVE A BRIEF HISTORY.

THERE'S A FEW COUNCIL MEMBERS ON THAT ARE HERE THIS EVENING THAT WE'RE NOT PART OF THE ORIGINAL ADOPTION OF THE ORDINANCE IN THAT TYPE OF THING, SO I WANTED TO KIND OF GIVE A BRIEF HISTORY IN THE 19 BOND PROGRAM. THERE WAS FUNDING THAT WAS ESTABLISHED, UH, FOR A FLOOD PRONE PROPERTY, BUY OUT PROGRAM IN THE IN THE AMOUNT OF $4 MILLION AS SET FORTH BY THE VOTERS IN 2021 CITY STAFF BEGAN OUR RESEARCH WITH OTHER UM, FLOOD PRONE PROPERTY, BUY OUT PROGRAMS THAT WE WERE AWARE OF, UH, YOU SEE THE CITIES IN THE COUNTY LISTED HERE, ARLINGTON, AUSTIN, FORT WORTH, HOUSTON, SAN ANTONIO AND HARRIS COUNTY. IN OUR DISCUSSIONS WITH THESE UM, CITIES. MOST OF THE CITIES WERE IN A RESPONSE TO A DISASTER TYPE OF SITUATION WHERE WHETHER IT WAS A HURRICANE OR WHETHER IT WAS A LOCAL FLOODING AREA, AND THEY CONCENTRATED ON SPECIFIC AREAS. IT WASN'T JUST AN ONGOING PROGRAM LIKE WE WERE TRYING TO ESTABLISH AT THE TIME. SO UM HARRIS COUNTY WAS THE ONLY ONE THAT HASEALLY AN ONGOING, UM, PROGRAM WITH THEIR BUY OUT PROGRAM, AND WE TALKED EXTENSIVELY WITH THEM. AND THEN WE QUICKLY FOUND OUT THAT THEY SAID WELL, TO GET EVERYTHING ESTABLISHED. YOU PROBABLY SHOULD, UM, HIRE SOMEBODY THAT KNOW WHAT'S WHAT THEY'RE DOING WITH THIS AND GET A LITTLE BIT OF ASSISTANCE. BECAUSE IT AS YOU GO THINGS ARE NOT AS WHAT YOU WHAT THEY SEEM TO BE, AND THAT'S KIND OF WHAT WE FACED GOING THROUGH THIS, SO WE CONTRACT WITH PACHECO COKE TO ASSIST US WITH DRAFTING THE ORDINANCE AND THE PROGRAM GUIDELINES. UM AFTER A FEW MONTHS OF GOING THROUGH THOSE WE VETTED THOSE A DRAFT ORDINANCE AND THE GUIDELINES WITH THE TRANSPORTATION INFRASTRUCTURE AND MOBILITY COMMITTEE BACK IN AUGUST IN SEPTEMBER OF 2022. AFTER THE SEPTEMBER MEETING. WE ESTABLISHED IT AND I, UH, IN THE COMMITTEE SAID, LET'S LET'S PRESENT THIS TO COUNCIL. SO ON OCTOBER 17TH OF 22. I GAVE A PRESENTATION OVER THE BUY OUT PROGRAM AND THE ORDINANCE AS WELL AS THE GUIDELINES TO THE COUNCIL AT THAT TIME, AND THEN ONE MONTH LATER, ORDINANCE NUMBER 7382 WAS ADOPTED ESTABLISHING THE FLOOD PRONE, BUY OUT PROGRAM. UM. THE NEXT COUPLE OF SLIDES ARE ARE VERY SIMILAR. WE'VE UPDATED THOSE WITH THE MORE RECENT INFORMATION OF THE PROCESS. ORIGINALLY WOULD NOT PRESENTED THIS TO COUNCIL. WE FIGURED IT WAS LIKE ABOUT A TWO YEAR PROCESS. WELL IN REALITY. WHEN YOU'RE DEALING WITH FEDERAL FUNDS IT IT HAS BEEN STRETCHED OUT, UM, TO A THREE YEAR PROCESS, SO IT WAS A LITTLE BIT LONGER THAN WHAT WE HAD ANTICIPATED. SO EARLY ON THE STEPS OF THE PROCESS, THE CITY OUTREACH AND APPLICATION PRO PROGRAM ARE THE PROCESS WAS, UH, JANUARY OF MARCH THROUGH MARCH OF 2023. THERE WERE MAILINGS.

THERE WERE PUBLICATIONS. WE ADVERTISE THIS ALSO IN THE GARLAND CITY PRESS, THERE WERE

AND THEN WE RECEIVED APPLICATIONS BETWEEN MARCH AND MAY OF THAT OF 23. THEN IT WENT TO THE CITY EVALUATION AND THE TEXAS UM, WATER DEVELOPMENT BOARD APPLICATION PROCESS, UH, OF JUNE OF LAST YEAR THROUGH JULY, 31ST. WE EVALUATED IT INTERNALLY, AND THEN WE MADE OUR SUBMITTAL TO, UH, THE TEXAS WATER DEVELOPMENT BOARD. FOR THE END OF SEPTEMBER AND THEN MOVING INTO THE NEXT PROCESS. THE TEXAS WATER DEVELOPMENT BOARD ACTUALLY REVIEWED THE THAT INFORMATION FROM SEPTEMBER OF LAST YEAR. UH OR EXCUSE ME, REALLY, FROM DECEMBER TO JANUARY OF THIS YEAR , BUT THEY'RE THEY'RE OPENING FOR APPLICATIONS WITH SEPTEMBER TO DECEMBER, 2ND. AND THEN WE ARE CURRENTLY I HAVE IT IN RED AND HERE, THE SUBMITTAL TO FEMA IS SET TO BE SUBMITTED ON FEBRUARY 26, WHICH IS JUST NEXT MONDAY OF THIS YEAR, SO WE ARE TO THAT POINT IN THE PROCESS. SO AFTER THIS FEMA WILL PROCESS THEIR PROCESS INCLUDES INFORMATION REQUEST. IF THERE'S ANY ADDITIONAL INFORMATION, WE HAVE TO PROVIDE THEM, THEN WE WILL GET THAT TO THEM IN THE NEXT FEW MONTHS MARCH TO JUNE, AND THEN THEY SHOULD HAVE THEIR DEDESION AND SELECTIONS MADE BY JULY TO SEPTEMBER AND NOTIFY THE TEXAS WATER DEVELOPMENT BOARD OF THE SELECTIONS, THEN TEXAS WATER OF A BOARD COMES BACK TO THE CITY OF GARLAND, WHICH WE'RE ASSUMING THAT WE WILL BE SUCCESSFUL AND THEY'LL BE DISCUSSING THE CONTRACTS WITH US FOR THE FUNDING AND GET EVERYTHING KICKED OFF AND MOVING TO WHERE WE CAN. HOPEFULLY OUR EXPECTATION IS HIT THE GROUND RUNNING IN JANUARY THROUGH DECEMBER OF NEXT YEAR, ACTUALL PURCHASING THE PROPERTIES CLOSING ON THEM, UM, DEED TRANSFERS, DEMOING OF THE STRUCTURES AND THEN DEDICATION OF THE PROPERTIES TO OPEN SPACE. AND THAT'S ONE THING I TO CLARIFY ANY TIME YOU USE FEDERAL FUNDING FOR PURCHASE OF PROPERTIES LIKE THIS. THEY HAVE TO FOREVER BE OPEN SPACE AFTERWARDS AND DEDICATED AND WE DID TALK ABOUT THAT AT THE COUNCIL MEETING. UM, SO WHERE ARE WE AT AT THIS TIME? AND GIVEN YOU A QUICK, QUICK UPDATE CITY MAILED OUT APPROXIMATELY 900 LETTERS BACK IN JANUARY OF LAST YEAR. UH, WE COVERED EVERY PROPERTY THAT HAD ANY PORTION OF THE FLOODPLAIN TOUCHING THAT PROPERTY SO THAT WE WERE ALL INCLUSIVE AND FROM THAT THE CITY DID RECEIVE 25 APPLICATIONS FROM INTERESTED PROPERTY OWNERS. THESE WERE ALL RESIDENTIAL AT THE TIME. IF COUNCIL MAY REMEMBER THAT THAT WE MADE A DECISION NOT TO INCLUDE COMMERCIAL PROPERTIES AT THIS TIME, IT WAS JUST RESIDENTIAL COMMERCIAL PROPERTIES GETS A LITTLE BIT TRICKIER AND MORE DIFFICULT WHEN YOU HAVE TENANTS IN THE BUILDING, SO WE COUNCIL HAD CHOSEN TO GO WITH PARTICULARLY THE RESIDENTIAL AT THIS TIME. SO ALL 25 APPLICATIONS ARE RESIDENTIAL PROPERTIES AND ORIGINALLY WHEN WE START FIRST STARTED VETTING THIS, UM, WITH THE TEXAS WATER DEVELOPMENT BOARD IN OUR IN OUR CONSULTANT, FIVE PROPERTIES QUALIFIED FOR THE PROGRAM. AND THEN ABOUT 3 TO 4 WEEKS AGO, J IN JANUARY, FEMA ANNOUNCED THEY NOW USE AN AMOUNT OF $360,000 PER STRUCTURE THAT IS LOCATED IN A SPECIAL FLOOD HAZARD AREA, AS OPPOSED TO THEIR PREVIOUS AMOUNT OF 323,000. SO WHAT THIS MEANS IN FOR GARLAND IS THAT A TOTAL OF 19 PROPERTIES OUT OF THE 25 NOW QUALIFY. FOR THE BUY OUT PROGRAM, WHICH PUT US INTO A LITTLE BIT OF A ALL HANDS ON DECK TO GO GET ALL THE INFORMATION THAT WE NEEDED.

FIRST WE HAVE TO CONTACT THE PROPERTY OWNERS MAKE SURE THEY'RE STILL INTERESTED, AND THEN THEY HAVE TO PROVIDE ADDITIONAL INFORMATION FOR THE FEMA SUBMITTAL ON THE 26TH OF THIS MONTH, AND SO THE LAST FEW WEEKS WE'VE BEEN WE'VE BEEN SCRAMBLING TO GET A HOLD OF THE PROPERTY OWNERS. UM GOING VISITING WITH THEM. SOME PEOPLE DON'T HAVE ACCESS TO COMPUTERS AS AS WE EXPECT THEM TO, AND, UM SO WE WERE. WE WERE OUT THERE FILLING OUT FORM WORK WITH THEM ONE ON ONE TRYING TO GET THE PAPERWORK COMPLETE. AND THEN, UH, WE'RE ALSO TAKING PHOTOS OF THE HOUSE OF THE HOMES ON ALL FOUR SIDES THAT'S REQUIRED BY FEMA IN TRYING TO PUT ALL THIS INFORMATION TOGETHER. UM AT THE TIME 19. THESE 19 PROPERTIES ARE QUALIFIED. 17 PROPERTIES QUALIFY FOR A 9010 PARTICIPATION SPLIT 90% BEING FEDERAL FUNDED IN 10% BEING LOCAL GARLAND FUNDS AND THEN TWO PROPERTIES QUALIFY FOR 7525 OUR DEADLINE TO GET ALL THIS INFORMATION BACK TO THE TEXAS WATER DEVELOPMENT BOARD BOARD TO PREPARE FOR OUR APPLICATION FOR FEMA WAS LAST

FRIDAY. WE DID GET ALL THIS INFORMATION BACK TO THEM. WE FOUND OUT WAS THAT THERE OF THE 19 PROPERTIES FOUR OF THEM ONE PROPERTY HAD SOLD ALREADY. AND THEY WERE NO LONGER INTERESTED.

UM, TWO OTHER PROPERTIES HAD PRIVATE. FLOOD INSURANCE BUT NOT NF IP, A NATIONAL FLOOD INSURANCE PROGRAM INSURANCE. THEY DIDN'T HAVE ACTUALLY A POLICY. THEY HAD PRIVATE INSURANCE, SO THEY DID NOT ACTUALLY QUALIFY. AND THEN, UM, ONE OTHER PROPERTY THAT, UH, DID NOT CONTINUE THEIR NF IP COVERAGE OF THEIR HOME, SO THEY WERE EXCLUDED. SO ALL IN ALL WE GOING TO BE PART OF GARLAND'SE APPLICATION TO FEMA NEXT WEEK. UM. FROM THERE. THE TEXAS WATER DEVELOPMENT BOARD WILL FINISH REVIEWING OUR INFORMATION THAT WE PROVIDED THEM THIS WEEK, AND WE THINK WE HAVE IT ALL IN PLACE THERE. THERE MAY BE A FEW THINGS THEY ASK FOR. AND THEN THE CITY WILL SUBMIT THE APPLICATION NEXT WEEK TO FEMA. UM FEMA WILL THEN REVIEW IT AS WE SAW IN THE PREVIOUS SLIDES THAT VIEW BETWEEN MARCH AND JUNE AND JUNE OF THIS YEAR, THE END OF JUNE AND THEN IN JULY TO SEPTEMBER. HOPEFULLY THEY WILL HAVE THEIR DECISION MADE. WE WILL BE PART OF THAT. AND THEN, UH, AGAIN IN JANUARY OF 25, WE SHOULD HOPEFULLY BE ABLE TO MOVE FORWARD AND START UM, APPRAISAL PROCESS IS CLOSING AND PURCHASING PROCESS PROPERTIES DEMO IN THE STRUCTURES AND RESTORING THE PROPERTY TO NATURAL STATE. UM CITY WILL HAVE . TO EXTEND ITS RESOURCES UP FRONT. AND. WE WILL BE. THERE'S A THERE'S A REIMBURSEMENT PROCESS FROM THE TEXAS WATER DEVELOPMENT BOARD. THEY THEY RECEIVED THE FUNDS FROM FEMA, AND THEN THEY WORK WITH THE CITIES, ONE ON ONE OR MORE IN A LOCAL ON A LOCAL BASIS, AND, UH, BUT WE WILL HAVE TO APPLY FOR REIMBURSEMENT. LAST FEBRUARY, THE COUNCIL PASSED A NEW SHORT TERM RENTAL ORDINANCE. AND UM, WE DID IT IN LIGHT OF SEVERAL LAWSUITS THAT WERE ONGOING WITHIN THE STATE AT THE TIME, AND THOSE LAWSUITS ARE STILL ONGOING. IN FACT, WHEN Y'ALL PASS THE ORDINANCE LAST FEBRUARY, WHICH WAS ALMOST A YEAR AGO, UM UM.

FOUR MONTHS LATER PASSED THEIR STR ORDINANCE BANNING SHORT TERM RENTALS IN RESIDENTIAL AREAS.

SINGLE FAMILY AREAS AND I GOT A I GOT SEVERAL CALLS FROM MEMBERS OF COUNCIL ASKING ABOUT WHY WE COULDN'T HAVE DONE THAT. AND UM, MY, MY RESPONSE WAS WELL, THEY'RE GOING TO BE SUED OVER THIS. AND SURE ENOUGH, ABOUT TWO MONTHS LATER, THEY GOT SUED. UM IN OCTOBER. IN DECEMBER, A COURT HEARD THE PRELIMINARY HEARING TO ENJOIN THEM FROM EN THEIR ORDINANCE AND THE COURT ACTUALLY DID, IN FACT, JOIN THE CITY FROM ENFORCING THEIR SHORT TERM RENTAL ORDINANCE, AND IT'S AN ONGOING LAWSUIT. NOW UM, UM THAT'S KIND OF THE UPDATE OF THE LITIGATION THAT'S GOING ON AT THE MOMENT. UH IN THOSE COURT CODE OF ORDINANCES THAT WE THAT WE REGULATE OUR SHORT TERM RENTALS. UH, IS IT IS LOCATED IN CHAPTER 32 SECTION 09 AND ALSO IN CHAPTER 2660 THROUGH 2666.
