GOOD EVENING. WELCOME TO THE MARCH 11TH MEETING OF THE GARLAND PLAN COMMISSION. THIS IS OUR WORK SESSION PORTION OF OUR COMMISSION, WHERE WE GET STAFF BRIEFINGS AND ASK QUESTIONS BACK AND FORTH. AFTER THAT IS OVER. WE WILL TAKE A RECESS UNTIL SEVEN O'CLOCK WHERE WE HAVE OUR PUBLIC HEARING PORTION OF THE MEETING. GOOD EVENING EVENING. FIRST I'D LIKE TO GO OVER THE CONSENT AND IF THERE'S ANY QUESTIONS NOPE. OK NEXT ITEM ON THE AGENDA IS THE 24-09. THE APPLICANT IS REQUESTING TO RENEW THESE SPECIFIC USE PROVISION FOR AN EXISTING RESTAURANT WITH A DRIVE THROUGH WHICH IS A TACO CABANA. HERE'S THE CASE INFORMATION. THE ACREAGE IS APPROXIMATELY 1.27 ACRES. AND THE EXISTING ZONING IS COMMUNITY RETAIL DISTRICT WITH A SPECIFIC USE PROVISION. 02-36. HERE'S THE CITYWIDE LOCATION MAP AND THE RED STAR SHOWS THE APPROXIMATE LOCATION OF THE CEDRIC PROPERTY. AND HERE'S THE LOCATION MAP. THE SUBJECT PROPERTY IS OUTLINED IN THE TEAL BLUE COLOR AND SURROUNDING PROPERTIES ARE MAINLY COMMUNITY RETAIL WITH SHOPPING CENTER. UM OTHER RETAIL AND RESTAURANT USES. THE FEATURE LANDY'S MAP OF THE ENVISION GARLAND PLANT DESIGNATES THIS PROPERTY AS TRANSIT ORIENTED CENTERS. THIS USE IS AN EXISTING RESTAURANT THAT SERVES AND ADDS BUSINESS ACTIVITY TO THE AREA PROVIDES PEDESTRIAN CONNECTION SIDEWALK CONNECTIONS TO THE ADJACENT PROPERTIES AND IS COMPATIBLE WITH THE COMPREHENSIVE PLAN. OR THE ECONOMIC DEVELOPMENT STRATEGIC PLAN. THE PROPOSAL IS CONSIDERED STAND-ALONE COMMERCIAL, AND WE'LL CONTINUE TO GENERATE SALES TAX FOR THE CITY. SEP THE SEP TIME PERIOD GUIDE RECOMMENDS BETWEEN 20 TO 25 YEARS FOR A RESTAURANT WITH A DRIVE THROUGH STAFF RECOMMENDS APPROVAL OF THE SDP RENEWAL FOR A DRIVE THROUGH RESTAURANT USE AND A PLAN ON A PROPERTY OWN COMMUNITY RETAIL DISTRICT WITH A SPECIFIC USE PROVISION, 02-36 AND WE MAILED OUT. 76 LETTERS. AND WE RECEIVED, UM TWO RESPONSES, WHICH ARE WITHIN A NOTIFICATION AREA AND IN FAVOR OF THE REQUEST. WE HAVE TO ANSWER ANY QUESTIONS. ANY QUESTIONS ON THIS CASE? COMMISSIONER CORNELIUS.

THIS IS A, UM MAJOR WAIVER REQUEST TO THE DOWNTOWN SCIENCE STANDARDS TO INSTALL A NEW AWNING SIGN. UH, LOCATION IS 823 MAIN STREET AND THE ACREAGE OF THE, UH, SITE IS ABOUT 0.63 ACRES IN SIZE. IT IS ZONED IN THE DOWNTOWN DISTRICT AND MORE SPECIFICALLY WITHIN THE UPTOWN SUBDISTRICT. UM THIS PARTICULAR TENANT SPACE. UM UH, IS THE FORMER SPACE OF PAPA'S CAFE AND THEY DO HAVE A NEW RESTAURANT TENANT, UM, LINED UP SO THE SIGNAGE WOULD BE FOR THIS NEW RESTAURANT TENANT. HERE'S A GENERAL LOCATION OF THE SUBJECT PROPERTY, OF COURSE IN THE DOWNTOWN AREA, MAIN STREET AND MORE SPECIFICALLY SHOWN HERE IF YOU CAN SEE THIS, UH, SORT OF TURQUOISE OR OUR TEAL BLUE COLOR THERE UM, IT IS AT THE INTERSECTION OR OR BOUNDED BY THREE STREETS. MAIN STREET, WHICH IS ITS PRIMARY FRONTAGE, UH, SOUTH NINTH STREET TO THE WEST AND STATE STREET. UH TO THE NORTH. UM, THE REQUEST AT HAND IS EXCLUSIVELY REGARDING SIGNAGE THE RESTAURANT USE WOULD WOULD BE ALLOWED BY RIGHT AND THIS

AREA, UH, DOWNTOWN AREA INCLUDES AN ARRAY OF LANE USES, INCLUDING OFFICES, PERSONAL SERVICES, RETAIL AND SOME RESTAURANTS AS WELL. UM OTHER SIGNS IN THE AREA INCLUDE, UM OTHER AWNING AND ATTACH SIGNS AND AS WELL AS SOME FREESTANDING SIGNS AS WELL. THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS NEIGHBORHOOD CENTERS, UH, WHICH IS GENERALLY LINES WITH, UH, COMMERCIAL LIGHT RETAIL TYPE, UH, USES. UM I MENTIONED THE OTHER SIGNAGE IN THE AREA. IN ADDITION, UH, GARLAND DOES HAVE AN ADOPTED CULTURAL ARTS MASTER PLAN, WHICH TOUCHES ON DOWNTOWN SIGNS. UH, IT SAYS QUOTE, FOLLOWING THE EXCEPTION MADE FOR DOWNTOWN GARLAND DEVELOP A SIGN VARIANT SIGNAGE ANCE THAT ALLOWS FOR CREATIVE SIGNAGE THAT PROVIDES AN OPPORTUNITY FOR PRIVATE BUSINESSES TO CONTRIBUTE TO THE VISUAL. UH, VIBRANCY OF THE CITY. AND HERE'S SOME PHOTOS OF THE AREA, INCLUDING THE ACTUAL SUBJECT, PROPERTY THERE, UM, ON THE TOP LEFT AGAIN. THIS IS THE FORMER SPACE OF PAPA'S CAFE. THEY'VE REPAINTED, UH, THE BRICK A BIT, BUT THEY, UH, WILL RETAIN THE EXISTING AWNING THERE. AND THERE'S SOME OUTDOOR SEATING AS WELL. THEN THE OTHER PHOTOS ARE JUST SOME SURROUNDING, UH, VIEWS OF SOME OF THE SURROUNDING PROPERTIES. AND HERE'S SOME ADDITIONAL, UM PHOTOS OF THE AREA, INCLUDING NORTH OF THE SUBJECT PROPERTY. THAT'S A CHURCH BACK THERE, BUT THERE'S UH ON THE LEFT AND RIGHT ARE SOME ADDITIONAL PHOTOS OF THE, UM SUBJECT PROPERTY, INCLUDING SOME ADDITIONAL OUTDOOR SEATING ON THE WEST SIDE OF THE PROPERTY THERE. AND THIS IS THE PROPOSED SIGN. UM, SO THE SIGN UH UM WOULD GO RIGHT ON TOP OF THE AWNING SO WITH THE MAJOR WAIVER REQUEST IS FOR IS THE G. DC HAS LANGUAGE I'LL READ HERE SHORTLY.

BUT THE, UH G DC SUGGESTS THAT AWNING SIGNAGE SHALL BE RELIGIOUS ON THIS EDGE OF THE AWNING AND HAS AN EIGHT INCH HIGH. UH, VERTICAL MAXIMUM, UM, THE HEIGHT FOR SIGNAGE RESTRICTIONS. SO IN IN THIS PROPOSAL, THE, UM SIGNAGE WOULD BE PLACED ON THE AWNING AND IT WOULD ESSENTIALLY SERVE AS AS MALL SIGN. UH, AS A WALL SIGN, THEY WOULDN'T HAVE AN ADDITIONAL WALL. SIGN IN ON ON TOP OF THIS. SO UH, THIS KIND OF SERVES TWO PURPOSES AS AN AWNING SIGN, TECHNICALLY SPEAKING, BUT WOULD SERVE AS THEIR PRIMARY. UM PRIMARY SIGNAGE AS WELL BUILDING SIGN AS THAT IS THE SIGN IS APPROXIMATELY 32 ALMOST 33 SQUARE FEET IN SIZE. UM AND AGAIN, THE MAJOR WAIVER IS REGARDING JUST THE REALLY THE PLACEMENT OF THE SIGN AS A AS AN AWNING SIGN TECHNICALLY. SO PER THE G DC SIGNS ON AWNING SHALL BE, UH, PRINTED, PAINTED OR APPLIED DIRECTLY ON THE SURFACE OF THE AWNING AND INCLUDED OR EXCUSE ME, INCLUDE ONLY THE NAME LOGO AND TYPE OF SERVICE OF THE BUSINESS LETTERS SHALL BE A MAXIMUM OF EIGHT INCHES HIGH.

THE UH, PROPOSED SIGN WILL BE MOUNTED ON TOP OF THE EXISTING METAL AWNING AND THE LETTERING WILL BE MORE THAN EIGHT INCHES IN VERTICAL HEIGHT. THE SIGN WILL BE APPROXIMATELY 33 SQUARE FEET IN SIZE AND WILL BE ILLUMINATED. THE SIGN IS INTENDED TO SERVE AS THE PRIMARY BUILDING SIGNAGE. A WALL SIGN WOULD BE LIMITED IN VISIBILITY BECAUSE OF THE AWNING, UM, BEING PRESENT AND THE, UH, APPLICANT WISHES TO KEEP THE AWNING IN PLACE. AND AGAIN, IT SHOULD BE NOTED THAT THE PAPAW SIGN WAS LOCATED ON THE AWNING AS WELL AND THAT HAS SINCE BEEN REMOVED AND WILL BE REPLACED WITH THIS. UM, UH, BARBECUE RESTAURANT SIGN. UM THE STAFF'S RECOMMENDATION IS APPROVAL OF THE REQUEST, AND I'LL NOTE THE, UH, LANGUAGE FROM THE G DC AS FAR AS MAJOR WAIVERS GO FOR THE G DC IN CHAPTER SEVEN, WHICH THIS IS SPECIFIC TO THE DOWNTOWN AREA. MAJOR WAIVERS MAY BE APPROVED BY THE CITY COUNCIL, FOLLOWING A RECOMMENDATION BY THE PLANNING DIRECTOR AND THE PLAN COMMISSION IN ORDER TO APPROVE A MAJOR WAIVER. THE CITY COUNCILINDINGS ARE ARE LISTED AS FOLLOWS, UH, MEETS THE GENERAL AND MEETS THE GENERAL INTENT OF THIS DISTRICT AND WILL RESULT IN AN IMPROVED PROJECT, WHICH WILL BE AN ATTRACTIVE CONTRIBUTION TO THE DOWNTOWN DISTRICT. SO THAT'S KIND OF THE GENERAL, UM, CRITERIA FOR DOWNTOWN MAJOR WAIVERS. AND WITH THAT, UH, COMMISSIONERS. THE PLANNING DEPARTMENT MAILED OUT 70 NOTIFICATION LETTERS ON THIS CASE, AND AS OF YET, WE HAVE NOT RECEIVED ANY RESPONSES. SO THANK YOU. ANY ANY QUESTIONS? YES.
