[7.a. Consider amendments to the Garland Development Code]

SEVEN HOLD HOLD PUBLIC HEARINGS ON THE FOLLOWING ZONING CASES. FIRST ITEM IS ITEM SEVEN. A CONSIDER AMENDMENTS TO THE GARLAND DEVELOPMENT CODE. UH, THIS WAS PRESENTED, UH, BY COMMITTEE DEVELOPMENT SERVICES COMMITTEE TO THE COUNCIL BACK IN DECEMBER, AND, UH, MR GARIN, GIVE US A REFRESHER. YES, SIR. MAYOR UM, THANK YOU. UM SO, YEAH. EXCITED TO BRING THIS SITE IN BEFORE YOU ALL THIS IS THE FORMAL ORDINANCE, BRINGING IT FORWARD TO AMEND THE GARLAND DEVELOPMENT CODE. AND UH, ESSENTIALLY, UM, DE FRONT LOAD THE ZONING PROCESS. ESSENTIALLY WHEN IT COMES TO P, DS AND SUPS AND THE LIKE, I'LL GIVE KIND OF ABBREVIATED PRESENTATION SIMILAR TO WHAT I GAVE THEHE COUNCIL A W MONTHS AGO. BUT JUST AS A REFRESHER AS YOU SAID, MAYOR, I'LL KIND OF RUN, UH, RUN THROUGH THIS. SO UM, JUST AS A REMINDER AS A BACKGROUND THIS, UM, ORIGINATED REALLY ABOUT A YEAR AGO, A LITTLE OVER A YEAR. IN THE SPRING OF 2023. THERE'S A CONVERSATION WITH THE DEVELOPMENT SERVICES COMMITTEE ABOUT, UH, JUST OUR, UM, APPLICATION REQUIREMENTS UP FRONT WHEN IT COMES TO DETAIL PLANS AS WE KNOW IT AND SIMILAR, UH, ZONING CASES AND THE AMOUNT OF ENGINEERING LEVEL UM, UH, DETAIL THAT'S REQUIRED WITH THOSE AND, OF COURSE, THE COST THAT'S INCURRED BY DEVELOPERS AND THEIR DESIGN TEAM ON THOSE.

SO, UM HAD SOME PRODUCTIVE CONVERSATIONS WITH THAT, AND THEN WE KIND OF HIT PAUSE AND HAD SOME, UH, REALLY NUMEROUS WORKSHOPS AMONG STAFF, UM, WITH THE HELP AND FACILITATION BY DYLAN MORGAN, UH, CONSULTING INC AND BY STAFF. THIS IS REALLY NUMEROUS DEPARTMENTS PLANNING ENGINEERING, BUILDING INSPECTION . FIRE TRANSPORTATION GP NL. THE LIST GOES ON, UH, THE CITY MANAGER'S OFFICE, OF COURSE, AND, UM, REALLY APPRECIATED THE TASK. THAT WAS, UH REALLY, UH, A QUESTION THAT WAS ASKED OF US BY MR REX, WHICH WAS, UM, YOU KNOW, WHAT WOULD IT LOOK LIKE? IF GARLAND HAD THE BEST DEVELOPMENT PROCESS IN THE REGION? SO UM, REALLY, THAT SPURRED SOME SOME VERY POSITIVE AND PRODUCTIVE WORKSHOPS AMONG STAFF AND THE, UH FACILITATORS AND, UM DEVELOPERS WERE INTERVIEWED. WE INTERVIEWED MULTIPLE DEVELOPERS WHO HAVE KIND OF RUN THROUGH THE PROCESS, BOTH VETERAN ONES AND BRAND NEW ONES AND LARGE SCALE SMALL SCALE AND, UM, GOT SOME GREAT FEEDBACK FROM THEM. UM AND THEN, UH, WENT BACK TO DEVELOPMENT SERVICES COMMITTEE WITH SOME OPTIONS AND RECOMMENDATIONS, AND, UH, ULTIMATELY IT UH, AS YOU STATED MAYOR WAS REPORTED TO THE COUNCIL IN DECEMBER AND WAS DIRECTED BY THE CITY COUNCIL TO PROCEED FORWARD. SO THE PLANNING COMMISSION WAS BRIEFED IN JANUARY 8TH JUST TO KIND OF GIVE THEM A HEADS UP ON WHAT'S COMING AND WHAT WAS DIRECTED BY COUNSEL AND THEN IT OFFICIALLY WENT TOO TH. UH UH, AS A HEARING ON MARCH 25TH, AND THEY HAVE PASSED IT ALONG. UM JUST AS A CAN A BRIEF REMINDER A CURRENT THE CURRENT ZONING PROCESS OUTSIDE OF STRAIGHT ZONING CASES, OF COURSE, REQUIRE DETAIL, DETAILED PLANNING DOCUMENTS, INCLUDING ENGINEERING SCHEMATICS, DETAILED SITE PLANS, LANDSCAPE PLANS, ELEVATIONS, ET CETERA. SO FROM A DEVELOPER'S PERSPECTIVE, UM HE OR SHE CANNOT CLOSE ON THE PURCHASE OF A PROPERTY UNTIL A ZONING ENTITLEMENT IS SECURED.

UM WE WENT OVER THIS A LITTLE BIT. AND WHILE CERTAINLY ONE TASK IS TO MAKE THE PROCESS, ESPECIALLY STARTING ZONING, A LITTLE BIT MORE DEVELOPER FRIENDLY AND COMPETITIVE WITH

[00:25:02]

OTHER CITIES, UH, IN OUR REGION. UM IT ALSO HAS A GREAT BENEFIT OF REALLY KIND OF PUTTING THE CITY A LITTLE BIT MORE IN THE DRIVER'S SEAT. AND UH, AS AS IT COMES TO P DS AND, UM, LEVERAGING, UH, BETTER DEVELOPMENT IN TERMS OF REALLY NEGOTIATING BACK AND FORTH AND TRADE OFFS AND THINGS OF THAT NATURE AND REALLY ESTABLISHING PD STANDARDS UP FRONT VERSUS KIND OF TRADITIONALLY REVIEWING DEVELOPMENT AS IT COMES IN AND KIND OF MEASURING IT UP AGAINST JUST THE G DC AND DEVIATING FROM THERE. SO A LITTLE BIT OF A PARADIGM SHIFT, BUT ABSOLUTELY A HUGE, UM, POSITIVE AS WE SEE IT. UM SO REALLY, THIS IS SHIFTING, UH, GETTING RID OF THE DETAILED PLAN REQUIREMENT AS A REMINDER AND GOING TO CONCEPT PLANS WHEN IT COMES TO PLAN DEVELOPMENTS AND SUPS AND SO, UM, I'M JUST GONNA READ THIS REAL QUICKLY. THIS IS THE, UM THE DESCRIPTION OF A CONCEPT PLAN IS, UH, DRAFTED IN THE G DC AND, UM, THE ACTUAL THIS USED TO EXIST IN THE G DC. ONE CONCEPT PLANS WERE AN OPTION PRIOR TO 2019 PRIOR TO THE SHOT CLOCK LAW. BUT UM, THE PURPOSE OF A CONCEPT PLAN IS TO PROVIDE A GENERAL LAYOUT OF THE PROPOSED DEVELOPMENT. THE CITY'S APPROVAL OF A CONCEPT PLAN WILL ALLOW THE APPLICANT TO DETERMINE WHETHER THE CITY IS GENERALLY IN AGREEMENT WITH THE LAND USAGE AND DEVELOPMENT PROPOSED AND WILL PROVIDE THE CITY WITH AN OVERALL IMPRESSION OF THE DEVELOPMENT PROPOSED A CONCEPT PLAN SHALL BE CONSTRUED TO BE AN ILLUSTRATION OF THE LAYOUT AND DEVELOPMENT CONCEPTS ONLY, AND NOT AN EXACT ENGINEERED REPRESENTATION OF THESE SPECIFIC DEVELOPMENT PROPOSED. AND JUST, UH, BELIEVE I SHOWED THESE IN THE WORK SESSION, BUT THESE ARE JUST SOME EXAMPLES THAT HAD BEEN CONTEMPLATED IN THE PAST. UM THIS IS YOU MAY RECOMMEND, UH, RECOGNIZE AS THE UH UH, MY POSSIBILITIES CONCEPT PLAN THAT CAME FORWARD BACK IN 2018. IT DOES SHOW A GENERAL LAYOUT OF THE STREET NETWORK AND KIND OF GENERALLY WHERE THE LOTS WILL BE OPEN SPACES. UM HOWEVER, WHAT YOU DON'T SEE ARE ACTUAL DIMENSIONS. MEASUREMENTS OF THE RIGHTS OF WAY AND, UH, INDIVIDUAL LOT SIZES, UM AND EASEMENT AND THINGS OF THAT NATURE AND UTILITIES. UM, THAT ALL THAT LEVEL OF ENGINEERING DETAIL IS LEFT OFF. UM SIMILAR CONCEPT PLAN HERE. THIS IS ACTUALLY DONE. UM UH BY A CONSULTANT OF OURS, UH, DURING THE I 30 CATALYST AREA PLAN. THIS IS FOCUSED ON THE ROSE HILL AREA. BUT UH, THE CONSULTANT DRAFTED A CONCEPT PLAN HERE BUT SIMILAR, UM, SIMILAR LAYOUT IN THAT IT SHOWS, UM THE GENERAL BILL BUILDING FOOTPRINT, STREET NETWORKS, OPEN SPACES, BUT, UM, UH, FALLS SHORT OF PROVIDING EXACT DIMENSION. OF AGAIN LOT SIZES, UM, EXACT BUILDING FOR OR MEASUREMENTS OF BUILDING FOOTPRINT, SHOWING EASEMENTS AND THINGS OF THAT NATURE. SO AGAIN, JUST AS A REMINDER, UM, THE CITY COUNCIL DIRECTION WAS TO REPLACE ZONING DETAIL PLANS WITH CONCEPT PLANS AND UM, ALSO NO LONGER REQUIRING SUCH PLANS THROUGH THE PUBLIC HEARING PROCESS, UH PER A PD WHEN ALL ZONING AND TECHNICAL REQUIREMENTS ARE MET. I KNOW YOU'VE OCCASIONALLY IN THE PAST.

SEEMS SOME DETAIL PLANS TO COME FORWARD WHERE IT'S THE ZONING IS ALLOWED. THEY'RE NOT DEVIATING OR MENDING ANYTHING WHATSOEVER. SO, UH, THE COUNCIL IS PRETTY CLEAR ON NO LONGER SEEING THOSE TYPES OF, UM, ITEMS COME FORWARD AND, UM AND OF COURSE, AS IT NOTED, AND REMINDER, UM, DETAILED REVIEW OF CLIENTS WITH G DC TECHNICAL STANDARDS AND ANY APPROVED, UM PD REQUIREMENTS WILL CONTINUE TO BE REVIEWED IN THE PERMITTING STAGE OF DEVELOPMENT BY CITY STAFF. SO THIS IS REALLY JUST SHIFTING. UM THE FRONT LOADED NATURE OF THOSE TYPES OF DETAILED PLANS TO, UM PERMITTING RATHER RATHER THAN THE ZONING PROCESS. UM JUST A COU A COUPLE OF OTHER QUICK NOTES. MAYOR UM, PART OF THIS ORDINANCE CHANGED JUST, UH, TWEAKS CHAPTER ONE OF THE G DC, WHICH IS WHERE THE PLANNING AND ZONING FEES ARE LISTED. JUST REPLACING DETAIL PLAN WITH CONCEPT PLAN FOR THAT APPLICATION TYPE, UM AND DISCUSSING WITH, UM, WITH ALISON AND BUDGET. UM, THESE CHANGES ARE ANTICIPATED TO BE MINIMAL IN TERMS OF REVENUE IMPACT. SO UM, AND THEN, UM, AS FAR AS THE IMPACT OF FOR THE DEVELOPMENT COMMUNITY, WE DID START MESSAGING THIS AND PRE DEVELOPMENT MEETINGS REALLY STARTING BACK IN DECEMBER THAT HEY, THIS IS, UM CHANGE THAT MAY BE COMING FORWARD. AND UM, SO WE'VE KIND OF BEEN ALREADY BEEN PREPPING, UH, DEVELOPERS THAT COME FORWARD WITH MEETINGS, UM, IN MEETINGS WITH STAFF THAT THESE ARE COMING AND WILL BE AN OPTION. UM AND THEN, UH, FINALLY , OF COURSE, THERE ARE SOME ZONING APPLICATIONS IN OUR PENDING CHART. YOU'LL PROBABLY SEE IN YOUR FUTURE FUTURE CASES MEMO THAT ARE ALREADY WELL INTO THE PROCESS THAT HAVE SUBMITTED DETAILED PLANS. YOU MAY STILL SEE SOME COME FORWARD THAT ARE ALREADY WELL INTO THE PROCESS. THOSE ARE THE REQUIREMENTS THAT THEY HAD AND WERE WERE PROVIDED. UM SO YOU'LL STILL PROBABLY SEE THOSE A FEW COME FORWARD, BUT THEY'LL FIZZLE OUT OVER TIME. AND THEN IN THE NEAR FUTURE, YOU'LL START SEEING SOME CONCEPTUAL PLANS AS WELL. SO I'LL STOP THERE, MAYOR IF THERE ARE ANY QUESTIONS VERY GOOD. I SAID WE HAD, UH PRESENTATION OF THIS BACK IN DECEMBER. I DON'T HAVE ANYONE IN THE QUEUE, UH, COUNCIL RIVER HEDRICK. UH, THIS WAS FROM YOUR COMMITTEE. SO I WILL LOOK TO YOU FOR A MOTION, SIR. UM YES, SIR. THANK YOU, MAYOR. I MOVE. WE APPROVE THE AMENDMENTS TO THE G DC BASED UPON THE PRESENTATION AND THE RECOMMENDATION OF THE DEVELOPMENT SERVICE COMMITTEE

[00:30:01]

AND WHAT WE DISCUSSED IN WORK SESSION. VERY GOOD. I HAVE A MOTION, UH, TO APPROVE ITEM SEVEN. A UH FROM COUNCIL MEMBER HEDRICK AND A SECOND FROM COUNCILOR RULLO. MA'AM, IF YOU PREPARE THE VOTE FOR US, PLEASE. THAT IS MR MAYOR. SORRY. SORRY I MAY HAVE MISSED IT BEGINNING.

DID YOU OPEN THIS UP FOR PUBLIC COMMENT? I'M SORRY. I PROBABLY DID NOT PROBABLY DID NOT LET ME BACK UP A HALF A STEP. IS THERE ANYONE HERE WHO WOULD LIKE TO SPEAK ON THIS SIDE? I'M SORRY ABOUT THAT. WE WILL OPEN UP PUBLIC COMMENT. NO WE WILL CLOSE THE PUBLIC COMMENT AND WE WILL GO BACK, UH, TO THE MOTION THAT IS ON THE FLOOR FOR APPROVAL. UM AND COUNCIL. MM. AND DISPLAYS THE VOTE, PLEASE. AND THAT ITEM IS APPROVED UNANIMOUSLY. THANK YOU, MR ENGLAND. MOVING ON TO

[7.b. Consider a request by David Gibbons to construct twenty (20) senior assisted living units. The site is located at 1922 Castle Drive in District 2. ]

ITEM SEVEN. B CONSIDER A REQUEST BY DAVID GIBBONS TO CONSTRUCT 20 SENIOR ASSISTED LIVING UNITS.

THE SITE IS LOCATED AT 1922 CASTLE DRIVE IN DISTRICT TWO. HEY, THANK YOU, MAYOR. AS YOU STATED, THIS IS A PROPOSAL TO CONSTRUCT A SENIOR ASSISTED LIVING COMPLEX WITH 20 DWELLING UNITS LOCATION IS, UH, 1922 CASTLE DRIVE, AND THE APPLICANT IS DAVID GIBBONS WITH THE GARLAND HOUSING FINANCE CORPORATION. THE ACREAGE OF THE SITE IS ABOUT 2.3 ACRES IN SIZE, AND IT IS ZONED UH, WITHIN PLANNED DEVELOPMENT DISTRICT 17-25 THAT PD WAS CONTEMPLATED AT THE TIME OF PRESERVING THE PREVIOUS BUILDING THAT WAS ON THE SITE AND UM AND HAVING A SIMILAR USE ASSISTED SENIOR LIVING IN THAT BUILDING, BUT, UM, THAT PROPOSAL AS PRESENTED AND APPROVED AT THAT TIME DID NOT PROCEED. AND AS YOU KNOW, THE BUILDING HAS SINCE BEEN DEMOLISHED, SO THIS WOULD BE A PROPOSAL FOR A NEW CONSTRUCTION ON THE SITE. BUT A SIMILAR USE.

UM HERE'S A CITYWIDE LOCATION MAP OF THE PROPERTY. AND MORE SPECIFICALLY SHOWN HERE. UH, THAT IT DOES FRONT CASTLE DRIVE AND JUST SOME TO SHOW SOME OF THE SURROUNDING LAND USES AND ZONING. IT UH, IS, UM THERE IS, OF COURSE, SF SEVEN SINGLE FAMILY NEIGHBORHOODS TO THE NORTH ACROSS SOUTH, UH, ACROSS CASTLE DRIVE, UH, AND SOME SINGLE FAMILY NEIGHBORHOODS FURTHER SOUTH, UM, OF THE SUBJECT PROPERTY, OF COURSE, IMMEDIATELY SOUTH THIS AREA.

THERE'S A LITTLE CREEK THERE. IT'S PRETTY HEAVILY WOODEN, SO THE NEIGHBORHOOD COMES BACK A LITTLE FURTHER ON THE SUBJECT. PROPERTY UH, IMMEDIATELY TO THE WEST IS, UM, ACTUALLY ANOTHER SENIOR LIVING UH, APARTMENT COMPLEX, AND THEN, UH, A LITTLE BIT FURTHER EAST. THERE'S A SIMILAR ACTUALLY, THERE'S SOME TOWNHOUSES. AND THEN THERE'S ANOTHER, UM, ANOTHER MULTIFAMILY DEVELOPMENT AS I UNDERSTAND. BUT AGAIN AS YOU CAN SEE FOR THIS AERIAL, UH, THE PREVIOUS BUILDING THAT WAS THERE IS NO LONGER NO LONGER THERE SO THE SITE IS CURRENTLY VACANT. THE COMPREHENSIVE PLAN IDENTIFIES THIS, UH, TRACT AS COMPACT NEIGHBORHOODS. AND OPPOSING NET DENSITY FOR THIS PARTICULAR PROPOSAL IS 8.4 DWELLING UNITS PER ACRE, WHICH IS WITHIN THAT RANGE THAT THE COMPACT NEIGHBORHOODS DESIGNATION RECOMMENDS BETWEEN SIX AND 12 DWELLING UNITS PER ACRE SO COMPLIES WITH THE COMPREHENSIVE PLAN FROM THAT REGARD AND IN ADDITION, EXPANDS OPTIONS FOR SENIOR HOUSING. AND PER THE ECONOMIC DEVELOPMENT STRATEGIC PLAN ADDITIONAL DENSITY ALTHOUGH IT IS ONLY 20 UNITS, UM, BUT ADDITIONAL DENSITY, UH, HELPS INCREASE. UM UM SALES TAX IN THE AREA AND SUPPORTS EXISTING BUSINESSES AS WELL AND, OF COURSE, AS STATED THE SUBJECT PROPERTY WILL PROVIDE ADDITIONAL HOUSING TO THE AREA FOR SENIORS.

HERE'S SOME PHOTOS OF THE AREA, INCLUDING THE SUBJECT PROPERTY THERE ON THE LEFT HAND PHOTO.

AGAIN, IT IS VACANT AND JUST SOME ADDITIONAL PHOTOS, UM ALONG CASTLE DRIVE. AND HERE'S THE SITE PLAN. UM SO IT DOES INCLUDE FOUR BUILDINGS WITH FIVE UNITS, EACH WITH AGAIN. A TOTAL OF 20 DWELLING UNITS. UM THERE ARE TWO ACCESS POINTS OFF CASTLE DRIVE. UM I'LL JUMP TO THE NEXT UM ACTUALLY, I'LL I'LL READ FROM GHF. C'S UH, NARRATIVE. THE PER THE APPLICANT. THE MISSION IS TO PROVIDE AFFORDABLE HOUSING FOR SENIORS. THESE PLANNED 20 RESIDENTS WILL PROVIDE NEW, SAFE SANITARY AND SUSTAINABLE HOUSING TO SENIOR OR EXCUSE ME TO GARLAND SENIORS. AND I'LL JUMP TO THE LANDSCAPE PLAN HERE ON THE SITE IS LANDSCAPED, AND, UH, THEY'VE SHOWN SOMENTERIOR KIND OF COURTYARD AREAS FOR LACK OF BETTER WORDS, UM, SHOWN HERE AND HERE, SO THERE IS SOME OUTDOOR AMENITIES IN ADDITION TO THE PRIVATE LIVING ROOM SPACE THAT EACH RESIDENT WILL HAVE THERE'S SOME SHARED, UM KIND OF GREEN AND PLEASANT SPACES WITHIN THE DEVELOPMENT KIND OF PROVIDES A NEAT LITTLE KIND OF PRIVATE, SMALL SCALE PLACE MAKING OPPORTUNITY FOR THESE RESIDENTS AND INCLUDED SOME PHOTOGRAPHS ON THE RIGHT HAND SIDE THAT WERE PROVIDED FROM THE TO SHOW AN

[00:35:04]

EXAMPLE. IT'S KIND OF A PLANTER, LONG LINEAR PLANTER WITH SOME SEEDING AND, UM AGAIN. JUST SOME OPEN SPACE, UH, OPEN SPACES AROUND IT. AND HERE THE BUILDING ELEVATIONS. I'LL RUN THROUGH THESE, UH, VERY MUCH A RESIDENTIAL STYLE OF KIND OF A SINGLE FAMILY RESIDENTIAL STYLE OF DEVELOPMENT. UM VERY MUCH. IN CONTRAST TO THE PREVIOUS BUILDING. THAT WAS THERE THAT HAD MUCH MORE OF A, UM INSTITUTIONAL REALLY NON-RESIDENTIAL LOOK TO IT. SO UH, THE APPLICANT AND WORKING WITH STAFF, REALLY, UM, CRAFTED THIS PD LANGUAGE TO BE MORE CONDUCIVE TO RESIDENTIAL. UM, SO THE PD DOES INCLUDE, UH AGAIN THERE WAS A PREVIOUS PD ALREADY FOR THE SIMILAR USE, SO IT'S SUBMITTED A FEW THINGS, UM, INCLUDING SCREENING JUST THAT THERE WOULD STILL BE THE FENCING AS APPROVED ON THE PERIMETER, BUT JUST NO SHRUBS ALONG THE SOUTHERN PERIMETER, WHICH DUE TO THE SITE CONFIGURATION, SOME DRAINAGE MENTS, AND IT BACKS UP TO A WOODEN CREEK AREA AS WELL. THERE ARE SOME CHALLENGES WITH THAT, UM, AMENITIES. UH, JUST YOU KNOW, THIS IS A VERY SMALL SCALE OR SINGLE FAMILY STYLE, UM OF DEVELOPMENT, SO IT DOESN'T HAVE THE, UM ROBUST INDOOR AMENITIES THAT A LARGER SCALE THAT RESEMBLES MORE OF AN APARTMENT COMPLEX OR SOMETHING LIKE THAT WOULD, UM, BUT AGAIN, AND THIS IS FOR THE APPLICANT.

EACH DWELLING WILL HAVE A PORCH, WHICH WILL OVERLOOK AND PROVIDE ACCESS TO A PLANTED INTERIOR GARDEN ENVIRONMENT. THIS COMMON AREA IS MEANT TO CREATE OPPORTUNITY FOR CONNECTIONS WITHIN THE INDIVIDUAL STRUCTURE, ALLOWING FOR RESIDENTS, UH, RESIDENCE IS AN OPPORTUNITY TO SIT AND GATHER WITH NATURAL LIGHT AND AIR. IT IS MEANT TO ENCOURAGE CONNECTION TO THE INTERNAL GARDEN AREA. THE SPACE IS THEN INTERLOCKED TO ENCOURAGE CONNECTIONS TO OTHER STRUCTURES, THUS DEVELOPING A SENSE OF COMMUNITY AND A TOTAL OF APPROXIMATELY 2900 SQUARE FEET OF TOTAL COVERED COMMON AREAS PROVIDED BY THESE PORCHES AND THEN FINALLY, THE BUILDING DESIGN AND WORKING WITH THE APPLICANT AND, UM AND SHOULD SAY AS A SIDE NOTE, THERE WAS A AMOUNT OF PUBLIC INPUT, INCLUDING, UM UH GIST STUDENTS THAT PLAYED A ROLE IN THIS THE PUBLIC WORKSHOPS AND THEY HAD A DEFINITELY HAD HAD A HAND IN THE ARCHITECTURE. SO THIS IS ■A REALLY NEAT, NEAT PROCESS FROM BEGINNING UP UNTIL THIS POINT, UM, BUT AS FAR AS BUILDING DESIGN, TAILORING THE DESIGN STANDARDS TO MORE OF A SINGLE FAMILY ARCHITECTURAL STYLE VERSUS THE USING, UM MORE MULTIFAMILY AND NON RESIDENTS STANDARDS. SO IN SUMMARY. THE PROPOSAL REPRESENTS A REDEVELOPMENT OF A PRE PREVIOUS NURSING HOME SITE TO A SENIOR LIVING FACILITY WITH A RESIDENTIAL STYLE APPROPRIATE TO THE AREA. THE PROPOSAL ALIGNS WITH THE COMPREHENSIVE PLAN AND ECONOMIC DEVELOPMENT STRATEGIC PLAN. AND WITH THAT MAYOR STAFF RECOMMENDS APPROVAL OF THE REQUEST, AND THE PLANNING COMMISSION RECOMMENDED APPROVAL AS WELL WITH A 6 TO 0 VOTE. AND WE MAILED OUT 126 NOTIFICATION LETTERS ON THIS CASE, AND ALL THE RESPONSES WERE IN FAVOR. THERE WERE FIVE IN FAVOR ALL WITHIN THE NOTIFICATION AREA.

VERY GOOD. UH, ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE. NO, THANK YOU. SECRETARY OF YOU CALL OUR FIRST SPEAKER, PLEASE. YES, SIR. I HAD THE APPLICANT DAVID GIBBS. THE HONORABLE DAVID GIBBONS. GOOD TO SEE YOU, SIR. THANK YOU. EVEN WHEN WE. MR MAYOR, COUNCIL MEMBERS. I AM DAVID GIBBONS, REPRESENTING THE GARLAND HOUSING FINANCE CORPORATION. 1675 WEST CAMPBELL ROAD. GARLAND, TEXAS 75044. UH, MY JOURNEY ON THIS PROPERTY BEGAN BACK IN 2016. SO THIS IS GOING ON, UH, EIGHT YEARS NOW, IN FACT, UH, IN MAY OF 2016. WHEN I WAS FIRST ELECTED TO COUNCIL, MY PHONE BEGAN TO RING BECAUSE OF A NASTY UH, DILAPIDATED, UH, RUNDOWN, UH, NURSING HOME. UM AS YOU CAN SEE FROM THE PHOTOGRAPHS. THERE WAS A LOT OF VANDALISM. UH THE NEIGHBORS ARE VERY UNHAPPY ABOUT THIS BEING IN THE NEIGHBORHOOD. UH, I DON'T KNOW WHO THE VERSACE DISCIPLE WAS THAT, UH, CAME TO LIVE THERE FOR A WHILE, BUT, UH, WE FOUND THE PLACE QUITE IN DISARRAY. ALL OF THE MECHANICAL SYSTEMS HAVE BEEN CANNIBALIZED. THERE WAS NO COPPER. THERE WAS NO PLUMBING. THERE WERE NO AIR CONDITIONING. EVERYTHING HAD BEEN TAKEN OUT OF OUT OF THE ITS. AND SO, UM I HAD WORKED. WHEN I WAS ON COUNCIL. I WORKED VERY CLOSELY WITH MONA WOODARD AND JASON WILH WITH COMMUNITY SERVICES DEPARTMENT AND TRYING TO GET THE CITY TO ACQUIRE THIS PROPERTY, AND, UH, WE WORK FOR, UH, FIVE PLUS YEARS AND SIMPLY COULDN'T DO IT. THE OWNER HAD UNREALISTIC IDEAS ABOUT WHAT THE PRICE OF THE PROPERTY SHOULD BE. AND SO AFTER I JOINED GHF C IN 2020 IMMEDIATELY WENT TO WORK AND TRYING TO ACQUIRE THE PROPERTY AND WE WERE ABLE TO

[00:40:05]

ACQUIRE THE PROPERTY IN EARLY 2021. AT THAT TIME WE CAME TO THE CITY AND THE CITY. UH UH.

GAVE US AC DB G GRANT TO DO THE, UH, ASBESTOS ABATEMENT AND THE DEMOLITION OF THE PROPERTY AND THERE'S AN AERIAL VIEW OF THE DAY THE DEMOLITION STARTED. UH, THIS IS AT THE POINT WAS IN A DISTRICT ONE COUNCIL MEMBER BASS WAS THERE TO AND TO ENJOY SEEING THIS MONSTROSITY FINALLY COMING DOWN, AND SO, UM WE HAVE SPENT A LOT OF TIME SINCE SINCE THIS TIME BACK IN IN 2021 OF MOVING FORWARD. ONE OF THE THINGS THAT WE WANTED TO DO WAS TO HAVE THIS AS A COMMUNITY WIDE PROJECT. AND AS MR GARIN NOTED, IS, UH WE DID GO TO THE, UH ARCHITECTURAL AND DESIGN STUDENTS AT GILBERT REED.

UH, CAREER, UH, TECHNOLOGY CENTER, THE GRCTC AND, UM KURT ORT, WHO IS ARCHITECT FOR OUR PROJECT IS THE UH, ARCHITECT. UH, INSTRUCTOR THERE, AND SO WE WENT TO THE THOSE AND SAID, THIS IS NOT SOMETHING AIRY FAIRY. THIS IS NOT SOMETHING YOU'RE DREAMING OF. THIS IS A PIECE OF DIRT WE OWN, AND WE WANT YOU TO FIGURE OUT HOW THIS IS THE BEST USE OF THIS PROPERTY. AND SO THE KIDDOS SPENT AN ENTIRE SEMESTER WORKING ON THIS. THEY FIRST CAME BACK WITH 14 PLANS FOR THE FOR THE PROPERTY. WE MET WITH THEM AND WE SAID WE LIKE THIS. WE DON'T LIKE THAT. WE LIKE THIS.

WE DON'T LIKE THIS. AND SO THEY CAME BACK AND THEY CAME WITH TWO FINAL. UH, PROPOSALS AND SO IN JUNE OF 2022 YOU SAY THAT COUNCIL MEMBER BASS WAS THERE IN ATTENDANCE, AND THE KIDDOS DID A PRESENTATION THAT DAY. AND UM, THE MAYOR WAS THERE AND, UH, COUNCIL MEMBER MORRIS WAS THERE AND, UM, SUPERINTENDENT, UH DOCTOR LOPEZ WAS THERE AND OTHER SENIOR MEMBERS AND THESE KIDS REALLY, UH, PUT THEIR HEARTS IN THIS AND JUST DID A GREAT PRESENTATION FOR US AND REALLY, YOU KNOW, SET FORTH SOME GREAT IDEAS. THESE KIDS FIGURED OUT WHERE THE SUN WAS GONNA BE DURING THE DAY, SO THEY GET THE MOST LIGHT IN THE IN THE IN THE COMMUNITY. THEY THEY. THEY SPENT AN ENTIRE YEAR WORKING ON THIS AND DID A GREAT JOB. AND WE'RE VERY THANKFUL, UH, FOR THE PRESENTATION THAT THEY GAVE US THAT DAY. UH, WE WE'RE HOPEFUL THAT ONCE THIS GETS APPROVED AND GETS BUILT, THEY'LL ALL COME BACK AND SEE THE EFFORTS OF THEIR JOURNEY. UM FOR THE PAST COUPLE OF YEARS. WE'VE BEEN WORKING ON A SITE DESIGN OF ONE OF THE THINGS THAT CAME UP THAT WE DISCOVERED AFTER THE KID I WAS WORKED ON. IT WAS, UH, THERE WAS A SANITARY SEWER EASEMENT THAT TOOK OUT A BUILDING THAT WE COULDN'T PUT THERE. SO WE HAD TO DO SOME REDESIGN, BUT WE'VE WE'VE GOTTEN THAT DONE. AND TONIGHT WHAT YOU'RE SEEING IS A RESULT OF THREE YEARS OF EFFORTS, UM, BY PROBABLY MORE THAN 50 FOLKS WHO'VE HAD INPUT TO THIS DEVELOPMENT, AND SO, UM, WE'RE LOOKING TONIGHT TO ASK YOUR APPROVAL FOR UH, 20 NEW SINGLE, UH, SINGLE 20 NEW RESIDENCES, UH, THAT REALLY LOOK LIKE SINGLE FAMILY HOMES AND ARE GONNA YOU KNOW THEY'RE ONE STORY . THEY'VE GOT THE HUGE FRONT PORCHES. UH, THEY'RE DESIGNED SO YOU CAN SIT ON THE PORCH AND ROCK AND VISIT WITH YOUR NEIGHBORS AND ENJOY. AND UH, YOU KNOW, UH, PROVIDING SAFE, SUSTAINABLE. UH, SANITARY HOUSING. UH, THESE WILL BE INCOME LIMITED TO 60% AMI, UH, WHICH IS FOR A SINGLE PERSON THEY CANNOT EARN MORE THAN 36,000. DOLLARS A YEAR AND FOR A MARRIED COUPLE OR TWO PEOPLE, THEY CANNOT EARN MORE THAN $41,000 A YEAR, SO THESE ARE DESIGNED VERY MUCH FOR OUR SENIOR NEIGHBORS WHO HAVE LIMITED INCOMES WHO NEED NEW, AFFORDABLE. UH, AND SANITARY HOUSING. UH, I'M GONNA SHARE A VIDEO OR MR ORLEY IS GONNA HELP ME TRY TO SHARE A VIDEO. WE'VE HAD TROUBLE WITH THE VIDEO, BUT HOPEFULLY YOU'LL UNDERSTAND, UH WHAT THIS PROJECT HAS COME FOR ME AND FOR ALL OF US AT GHFC. OVER. WAS A. IS THERE A MILLENNIAL IN THE HOUSE? I KNOW. RIGHT F. FOUR EVERYTHING'S UP FOR IT'S LOCKED. IT'S FROZEN.

OH, THERE YOU GO. YEAH. OH, YEAH. YOU KILL THAT ONE. TRY AGAIN. OH, THAT'S FINE. IS IT THIS? NO, WE WANT THE VIDEO RIGHT HERE, OK? THAT'S TRUE. OH, HERE WE GO.

[00:46:10]

MM. AND THEN MR MAY, UH, I'LL BE HAPPY TO ENTERTAIN HER ATTEMPT TO ENTERTAIN TO ANSWER ANY QUESTIONS. ANYBODY VERY GOOD. UH, ANY QUESTIONS FOR THE APPLICANT? DEPUTY MAYOR PRO TIM MOORE. THANK YOU, MR MAYOR. JUST FOR UH CLARIFICATION, SO THESE ARE GONNA BE RENTAL PROPERTIES.

OWNED BY GHC. MAINTAIN BY GHFC. ALSO, THAT IS CORRECT. OK? IS THIS SOMETHING WE'VE DONE? BEFORE. DO WE HAVE ANYTHING LIKE THIS ALREADY IN PLACE? CERTAINLY NOT WITH GHFC, UH I JUST MIGHT MENTION, SIR, IS THAT WE ARE ALSO PARTNERS IN THE, UH UH IN COMMUNITY NEXT DOOR. AND PROBABLY, WHAT WE'RE LOOKING TO DO HOPE TO DO IS THAT WE WILL JOIN FORCES WITH THEM ONCE WE FINISH CONSTRUCTION, AND THAT USED THEM FOR THE MANAGEMENT SERVICES BECAUSE THEY'VE ALREADY GOT THE FULL TEAM THERE. AND ALSO, HOPEFULLY, YOU KNOW ONE OF THE THINGS THAT WE WANTED TO DO, UH, WITH THIS SMALLER SITE WAS TO MAKE THE PROPERTY AS DENSE AS POSSIBLE TO PROVIDE AS MANY UNITS AS POSSIBLE. SO ONE OF THE THINGS THAT WE HAVE NOT INCLUDED HAS BEEN, UH, A COMMUNITY CENTER THAT SORT OF THING, AND WE DESIGNED THE PORCHES IN THE COURTYARDS TO TRY TO AN OUTDOOR COMMUNITY CENTER. BUT IF WE HAD TO PUT THAT COMMUNITY CENTER AND WE WOULD LOSE ANOTHER 44 OR FIVE UNITS AND DOING THAT, SO WE WANTED TO GET THE UNITS THERE. SO WE'RE HOPEFUL THAT PART OF THAT RELATIONSHIP. UH DEPUTY MAYOR PRO TEM WILL BE TO INCLUDE NOT ONLY THEM HANDLING DAY TO DAY MANAGEMENT OPERATIONS FOR US, BUT ALSO USING THEIR AMENITY PACKAGES OF THEIR CLUBHOUSE AND THEIR POOL AND THAT SORT OF THING FOR OUR RESIDENTS. BUT UH AGAIN, WE'RE JUST TRYING TO DELIVER, UH, HOUSING THAT SENIORS NEED IN THIS CITY. WE KNOW THAT, UH OF THE MAJOR THE PALLADIUM SENIOR LEVAN SENIOR LIVING, UH, CSRA, UH, HOMETOWN AT GARLAND. ALL THOSE SENIOR COMMUNITIES THAT ARE AFFORDABLE STAY AT 100. OCCUPIED WITH A LONG WAITING LIST OF RESIDENTS WHO WANT TO GET IN THOSE. SO UH, WE ARE. WE ARE CONFIDENT THAT THIS WILL BE WELCOMED IN THE CITY TO BE ABLE TO GIVE MORE AFFORDABLE UNITS TO OUR SENIORS. KIND OF LIKE A GREAT CONCEPT.

AND JUST, UH, THINKING ABOUT WHAT HAPPENS OFTENTIMES TO THESE TYPES OF PROJECTS ARE NOT. IT'LL BE LONG LIVED. THERE'S GONNA BE SOMETHING THAT SOMEONE'S GONNA COME INTO AND LATER ON, IS GOING TO BEGIN TO GO DOWNHILL BECAUSE YOU GUYS ARE, UH, THE LANDLORDS OF IT. SO THANK YOU SO VERY MUCH, SIR. THANK YOU, MR MAYOR. VERY GOOD. THANK YOU, SIR. UH, MAYOR PRO TIM BATTS. THANK YOU, DAVID. THANK YOU SO MUCH. UM I DON'T HAVE ANY QUESTIONS. I JUST WANT TO SAY THANK YOU FOR YOUR YOUR PASSION. AND THANK YOU FOR YOUR DEDICATION TO THIS PROJECT. I KNOW YOU'VE BEEN WORKING ON THIS PROJECT PROBABLY LONGER THAN I'VE KNOWN YOU AND I FEEL LIKE I'VE KNOWN YOU FOR A WHILE, SO AND YOU KNOW, UM AND COMING ON TO COUNCIL, THIS IS ONE OF THE FIRST THINGS I WAS INTRODUCED TO, UH, WAS THIS PROJECT AND SO YOU KNOW, I'M HAPPY TO SEE IT COME TO FRUITION AND, UH, EVEN HAPPIER TO SEE IT, UH, YOU KNOW, REALIZED BY YOU AND YOUR TEAM, SO THANK YOU VERY MUCH TO OF G HSE. THANK YOU, SIR. VERY GOOD. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? MY SECRETARY. DO WE HAVE ANY ADDITIONAL SPEAKER CARDS ON THIS ITEM? I HAVE NO ADDITIONAL SPEAKERS. IS THERE ANYONE WHO WOULD LIKE TO SPEAK ON THIS ITEM? C. NO UH, WE HAVE CLEARED THE QUEUE. UM MR GIBBS. MR ORLEY , MR ADAMS. UH, THIS IS, UH, IN MY OPINION. PROBABLY ONE OF THE BEST PROJECTS THAT THAT WE PULLED TOGETHER, BRINGING THE STUDENTS IN BRINGING TAKING CARE OF THIS. DAVID I. I KNOW THIS PROPERTY. YOU AND THIS PROPERTY, UH, GO WAY BACK, AND THERE WERE

[00:50:03]

SOME HARSH WORDS SAID. UH, BUT THEY WERE ALL TRUTHFUL ABOUT THIS PROPERTY AND TO SEE WHAT IT WAS AND TO WHATT WILL BECOME. I AM. I AM MORE THAN HAPPY TO SUPPORT THIS PROJECT. UM WITH THAT, UH, COUNCILOR MORSE IS IN YOUR DISTRICT NOW. IT STARTED OUT IN ONE, AND IN THE MEANTIME, WE REDISTRICTED AND MOVED THE LINE A LITTLE BIT SO THAT IT'S IN DISTRICT TWO. YES AND WE'RE WE'RE THRILLED WITH THAT. AND MAYOR. YOU TOOK A LOT OF MY WORDS. THE PARTNERSHIP ON THIS PROJECT HAS BEEN AMAZING. WATCHING THE STUDENTS, UM, WAS AN AMAZING EXPERIENCE, UH, FOR ME AND FOR THEM, BUT WATCHING THIS FINALLY REACHED THIS POINT. I AM OVERJOYED. AND DAVID. I KNOW THIS HAD TO HAVE, UH, IF YOU HAD MORE HAIR WHEN WE STARTED, YOU PROBABLY WOULD HAVE PULLED IT OUT. BY THE TIME YOU GOT TO THIS POINT, SO WELL DONE, UH, WELL DONE TO ALL INVOLVED.

SO UM, JUST I LIVED IN THAT NEIGHBORHOOD RIGHT THERE BY THE CASTLE MANOR NURSING HOME. WHEN I FIRST MOVED TO GARLAND LIVED THERE FOR YEARS. I AM SO THRILLED TO SEE IT GONE. ON SO WITH ALL THAT, SAID, MAYOR I WOULD LIKE TO MOVE WITH GREAT JOY MOVED TO APPROVE AS PRESENTED VERY GOOD. I HAVE A MOTION BY COUNCILOR MORRIS AND SECOND BY MAYOR PRO TIM BASS TO APPROVE ITEM SEVEN B AS PRESENTED MADAM SECRETARY. YOU PRAY THE BOOK FOR US, PLEASE.

COUNCIL. AND DISPLAY THE VOTE. AND THE ITEM IS APPROVED UNANIMOUSLY. THANK YOU ALL VERY MUCH. NOT TO CUT YOU OFF. BUT, MR GARIN, UH, THEY'RE ALL HERE FOR. THEY'RE ALL HERE. OK SO WE ARE. I JUST NEEDED TO KNOW HOW WE WERE GONNA MOVE ON TO OUR NEXT CASE, BUT CERTAINLY AGAIN

[7.c. Consider a request by Kimley Horn to construct a restaurant with a drive-through [Swig]. The site is located at 2301 Arapaho Road in District 7. ]

THANK YOU ALL FOR THE FIRST ONE. ALRIGHT THAT BRINGS US TO ITEM SEVEN. C CONSIDER REQUEST BY KIM WE HORN TO CONSTRUCT A RESTAURANT WITH DRIVE THROUGH SWIG. THE SITE IS LOCATED AT 23 01 ARAPAHO ROAD IN DISTRICT SEVEN. MR GARIN. THANK YOU, MAYOR. UH, THIS IS A PROPOSAL FOR A RESTAURANT WITH A DRIVE-THROUGH SUP AS A REZONE IN AN SUP REQUEST. UH, SWIG SERVES, UM UH, DRINKS. YOU'VE PROBABLY SEEN A FEW AROUND THE METROPLEX. BUT THEY, UM THEY SELL VARIOUS TYPES OF, UH, DRINKS MADE BY MIXING, UM NAME BRAND SODAS SUCH AS COCA COLA AND DR PEPPER WITH ADDINS, SUCH AS FLAVORED SYRUPS AND CREAMS AND FRUIT PUREES AND, UM, SPARKLING WATERS AS WELL. SO JUST A LITTLE BIT ABOUT UH WHAT? THIS UH WHAT THIS USE IS THE LOCATION IS 23 01 ARAPAHO ROAD.

UM, THE ACREAGE OF THE SITE IS 1.15 ACRES AND IT IS ZONED WITHIN, UH, PD DISTRICT, 99-49, WHICH IS A PD RESTRICTED TO OFFICE USES AND SO PART OF THE REQUEST IS THE APPLICANT REQUEST TO REZONE TO COMMUNITY RETAIL AND REQUEST AN SUP, UH, FOR THE DRIVE THROUGH WHICH THE COMMUNITY RETAIL REQUIRES AN SUP FOR, UM, DRIVE THROUGH RESTAURANTS. HERE'S A GENERAL LOCATION OF THE SUBJECT PROPERTY. AND UH, MORE SPECIFICALLY SHOWN HERE, THIS KIND OF TRIANGLE SHAPED PROPERTY HERE ON THE HARD NORTH CORNER OF ARAPAHO AND HOLFORD ROAD. AND YOU CAN SEE SOME OF THE SURROUNDING USES. THERE IS A SINGLE FAMILY NEIGHBORHOOD TO THE NORTH. UH, THERE'S SOME VACANT AG, UH, ZONED LAND TO THE EAST. UM TO THE SOUTH. THERE'S SOME ADDITIONAL VACANT LAND, UM, AS WELL AS A CHURCH, AND, UM UH, CHILDCARE CENTER AND A LITTLE FURTHER NORTH IS SOME, UM, RETAIL COMMERCIAL SHOPPING CENTER TYPE USES. UM THERE'S A MURPHY GAS UH, DUTCH BROS. IN A RECENTLY APPROVED MCDONALD'S A LITTLE FURTHER WEST. THE CONFERENCE OF PLAN IDENTIFIES THIS TRACT AS NEIGHBORHOOD CENTERS, WHICH IN GENERAL LINES GENERALLY ALIGNS WITH COMMERCIAL . UH, DEVELOPMENT. THE PROPOSED USE COMPLIES WITH THE COMPREHENSIVE PLAN OR OFFERS A SUPPORTIVE USE TO THE AREA. THE RESIDENTS OF THE AREA AND PASSERSBY, AND THE PROPOSAL IS CONSIDERED STAND ALONE. COMMERCIAL PER THE ECONOMIC DEVELOPMENT STRATEGIC PLAN. THIS CATEGORY REPRESENTS A PROPERTY TAX REVENUE PER ACRE AT, UH $5380. AND IN ADDITION, THE PROPOSAL WILL ADD SALES TAX REVENUE TO THE CITY. AND HERE'S SOME PHOTOS OF THE AREA, INCLUDING THE SUBJECT PROPERTY AGAIN. IT IS VACANT. AND THAT'S JUST SHOWING YEAST TO THE SUBJECT PROPERTY. DOWN UM WILFORD ROAD AND, UH, NORTH OF THE SUBJECT PROPERTY IN AND WEST OF THE SUBJECT PROPERTY. LOOKING DOWN A RAPA HO THERE AND THAT'S LOOKING NORTH AT PULFORD ROAD. HERE'S THE PROPOSED SITE PLAN. UM HERE'S THE BUILDING HERE.

IT'S APPROXIMATELY 700 SQUARE FEET IN SIZE. UM THE REST OF THE SITE, YOU CAN SEE KIND OF THE DRIVE LANES AND QUEUING LANES. UH, THIS IS THE DRIVE THROUGH HERE. UM WHILE THERE WILL BE A MENU BOARD, UM WE HAVE CONDITIONED THE SP TO PROHIBIT A SPEAKER BOX ON THE SITE. THE

[00:55:03]

APPLICANT, UM HAS, UH, INDICATED THERE WILL BE. UM UH, I CAN'T REMEMBER THE WORD THEY'LL THEY'LL CLARIFY IT. BUT, UM, EMPLOYEES OUT THERE THAT TAKE YOUR ORDER. THEY AND THEN YOU BOARD THERE TO KIND OF SEE WHAT THEY OFFER. BUT UH, THERE WILL NOT BE THAT SPEAKER BOX, SO WE'VE LIMITED OR, UH ADDED INTO THE SUP CONDITIONS THAT THAT WOULD BE PROHIBITED ON THE SITES . THERE WERE SOME CONCERNS ABOUT NOISE AS IT RELATES TO THE RESIDENCES TO THE NORTH. UM, HERE'S THE LANDSCAPE. UH, PLAN. THE SITE IS LANDSCAPE. THE PLAN COMMISSION. THE COMMISSION DOES HAVE, UM, APPROVAL AUTHORITY FOR LANDSCAPE AND SCREENING VARIANCES DURING THE HEARING.

THEY DID APPROVE A LANDSCAPE AND SCREENING VARIANCE AS IT APPLIES OVER HERE THERE'LL BE THE APPLICANT IS PROVIDING SOME, UH, SHRUBS TO MITIGATE, BUT THERE'S AN ELECTRICAL EASEMENT OVER THERE AS WELL AS WELL AS SOME EXISTING POWER POLES THAT PROVIDED AN ISSUE OVER THERE, BUT OTHERWISE IT COMPLIES WITH ALL SITE AND LANDSCAPING REQUIREMENTS OF THE G DC, UH, HERE AT THE BUILDING ELEVATIONS. THE SMALL BUILDING, AS YOU CAN SEE ABOUT 700 SQUARE FEET IS FOR DRIVE THROUGH. UH UH. DRINKS UH, NO ALCOHOL WILL BE ON THE MENU. IT IS PURELY, UM, SODAS AND SPARKLING WATERS AND THE LIKE. UM SO THE REQUEST AND SUMMARY IS A CHANGE OF ZONING FROM PD 99-49 FOR NEIGHBORHOOD OFFICE USES TO COMMUNITY RETAIL RETAIL DISTRICT AS WELL AS AN APPROVAL OF THE SUP FOR THE DRIVE THROUGH THE APPLICANT IS PROPOSING REQUESTING A TIME PERIOD OF 25 YEARS, WHICH ALIGNS WITH THE S TIME PERIOD GUIDE AS APPROVED BY COUNSEL. AND STATS.

RECOMMENDATION IS APPROVAL OF THE REQUEST, AND THE PLAN COMMISSION RECOMMENDED APPROVAL AS WELL WITH THE 60 TO 0 VOTE AND AS I MENTIONED EARLIER THAT INCLUDED A VARIANCE REGARDING PERIMETER, UH, LANDSCAPE AND SCREENING. AND WITH THAT MAYOR WE HAVE MAILED OUT 78 NOTIFICATION LETTERS ON THIS CASE WE RECEIVED FOUR IN FAVOR WITHIN THE AREA WITHIN THE NOTIFICATION AREA, THREE AGAINST WITHIN THE NOTIFICATION AREA AND THREE AGAINST OUTSIDE THE NOTIFICATION AREA. VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? MAY PRO TIM BASS. THANK UH THANKS FOR THE PRESENTATION ON LOOKING THROUGH SOME OF THE RESPONSES. UM SOME OF THE CONCERNS ARE, UM, THE PROXIMITY FROM THE SWIG BUILDING TO THE, UH, THE HOUSES BEHIND IT. CAN YOU TELL US WHAT THAT DISTANCE IS? SURE. UM, LET'S LOOK AT THE CYCLING HERE. UM WHICH I DON'T BELIEVE I HAVE THE EXACT DISTANCE. I MAY HAVE TO EYEBALL IT HERE, UM IF I HAD, I WOULD SAY PROBABLY. I'D SAY PROBABLY ABOUT 50 FT OR SO FROM THE BUILDING TO THE PROPERTY LINE.

UM THERE, OF COURSE, WILL BE A MASONRY WALL. UM ALONG THE NORTHERN PERIMETER, UH, BOUNDARY AND, UM, SOME TREES AS WELL. A LARGE CANOPY TREES PLANTED ALONG HERE, UH, ADJACENT TO THE DRIVE THRU OR ADJACENT TO THE ESCAPE LANE. THAT'S AN 8 FT WALL. CORRECT UH, YES, SIR. I BELIEVE SO. YEAH AND THEN I I'M FAMILIAR WITH THAT CORNER, ALTHOUGH I HAVE NOT WALKED THROUGH THE PROPERTY, BUT JUST ABOUT ALL THE RESPONSES MENTIONED IN DITCH AS WELL. I'M GUESSING THERE'S A YES, SIR. IS THE DITCH GONNA BE FILLED? THERE WAS SOME CONCERN ABOUT THAT. AND THERE WERE SOME CONCERNS. I BELIEVE THAT HAD TO DO WITH THE REASON WHY THE TREES WERE SCOOTED UP. AND THEN THE AS THE DITCH COMES OVER HERE THAT YOU GET INTO ELECTRICAL EASEMENTS AND WHATNOT. SO THERE THERE WERE SOME CHALLENGES, BUT, UM, THE WALL WILL STILL BE BUILT ACCORDINGLY WHERE THEY CAN BUILD IT. UM, BUT THE TREES WERE SCOOTED UP AS THERE WAS ENOUGH SPACE FOR THE WALL AND THEN THE TREES BEING IMMEDIATELY NEXT TO IT. SO THOSE THOSE WERE SCREWED UP A LITTLE BIT, OK? AND IS THERE ANY OUTSIDE SEATING ANY PATIO SEATING? UM THERE ARE SOME BENCHES. THEY THEY DO NOT PLAN TO HAVE PATIOS, NO OR OR FORMAL TABLES AND SEATING, BUT THERE WILL BE SOME BENCHES IN THIS LANDSCAPE AREA. UM THE APPLICANT DOESN'T ANTICIPATE A LOT OF THAT TYPE OF, UM, CUSTOMER BASE THAT IS INTENDED TO BE REALLY A DRIVE THROUGH. COME AND GO. UM BUT IF SOMEONE WERE COMPELLED TO PARK AND KIND OF SIT AND ENJOY THEIR DRINK, THEY THEY CAN. OK, THANK YOU VERY MUCH. VERY GOOD. ANY ADDITIONAL QUESTIONS FOR STAFF. SEE NONE. WE HAVE THE APPLICANTS HERE. SECRETARY.

GLAD YOU MADE IT, SIR. I HEAR YOU'RE HAVING MULTIPLE HEARINGS THIS EVENING. AND UH, IF I COULD GET US GET YOU TO GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, YOU'LL HAVE 10 MINUTES TO, UH, MAKE YOUR PRESENTATION AND ANSWER ANY QUESTIONS. THANK YOU. MAYOR GARRETT JOHNSON, 6901 LA MANGA ROAD, DALLAS 75248. THANK YOU, COUNSEL. THANK YOU, MAYOR FOR THE TIME TODAY I REALLY APPRECIATE THIS. AND YOU YOU KNOW, I THINK THIS IS A GREAT USE ON THIS PROPERTY. THIS

[01:00:04]

PROPERTY HAS BEEN VACANT FOR A NUMBER OF YEARS WAITING FOR THE PERFECT TENANT AND I THINK I THINK I FOUND THE PERFECT TENANT. THE IT'S NOT OBNOXIOUS. THERE'S NO ODOR SMELL. THERE'S NO LOUD NOISES. THERE'S NO LOITERING. THERE'S NOTHING THAT COMES WITH A TYPICAL FAST FOOD.

DRIVE THROUGH CONCEPT. UH, SWIG DRINKS OUT OF, UH, UH, SALT LAKE CITY LIKE WILL SAID THEY DO.

DRINK CONCEPTS, SODAS, FRUITS, EVERY WHICH WAY. THERE'S NO COFFEE. IT'S NEW TO THE MARKET.

UH, THERE ARE ABOUT 55 ACROSS THE COUNTRY WITH ABOUT ANOTHER 50 IN DEVELOPMENT ACROSS THE COUNTRY, SO THEY'RE REALLY TRYING TO EXPAND. THIS IS GONNA BE A CORPORATE STORE. SO YOU WON'T HAVE A FRANCHISEE WITH ONE OR TWO LOCATIONS GOING OUT CORPORATES RUNNING IT. THEY THEY KNOW HOW TO RUN AN OPERATION. YOU'RE NOT GONNA HAVE A VACANT 5 700 FT. DRIVE THROUGH IN TWO YEARS. LET ME SEE IF I CAN. SO AS WELL, THERE'S A SITE PLAN. UM WHEN WE STARTED THIS PROJECT, I DEFINITELY WANTED TO GET IN FRONT OF ANY CONCERNS AS IT ABUTS THE NEIGHBORHOOD. I WANTED TO MAKE SURE THAT WE WERE ADDRESSING SOME CONCERNS WITH THE NEIGHBORHOOD AS WELL AS TALKING TO THE COUNCILMAN ABOUT HIS CONCERNS, AND IT'S IN HIS DISTRICT. I WANT TO MAKE SURE THAT WE WERE COVERING ANYTHING THAT THERE WAS SOME CONCERN, SO I SPENT A LOT OF TIME WITH WITH WITH THE COUNCILMAN AND ADDRESSING HIS CONCERNS. WE'VE ALSO SCHEDULED A MEETING WITH THE HO A AND THE BOARD AND WENT TO THEIR HOUSE AND DISCUSSED THEIR CONCERNS. SO A LOT OF THE CONCERNS I SAW IN IN THE CAR. THERE ARE THE SAME CONCERNS THAT WE HAVE ADDRESSED IN OUR SITE PLAN, WORKING WITH STAFF AS WELL AS THE COUNCILMAN AND ADDRESSING THOSE, UM, ONE OF THE CONCERNS WAS OBVIOUSLY LIGHTING. WE ARE MEETING GARLAND CITY CODE, MAKING SURE THAT THAT OUR LIGHTS DON'T FLOOD INTO THE BACKYARD OF THE HOUSES TO THE NORTH, MAKING SURE THAT WE'RE NOT IMPACTING THEM AT NIGHT. UM THEY ALSO AS WELL AS MENTIONED, THERE'S NO SQUAWK BOX OR OR YOU KNOW, LOUD NOISE COMING OUT OF A BOX. THEY ARE RUNNERS LIKE DUTCH BROTHERS, HAVE THEY COME UP? GET YOUR ORDER. TAKING IN THEIR LITTLE TABLET, AND IT POPS UP AND THEN THEY'RE OUT THE DOOR. THEY'RE TRYING TO GET PEOPLE IN AND OUT OF THIS DRIVE THROUGH AS FAST AS POSSIBLE. UH, THERE IS NO PATIO.

THE BENCHES THAT, UH, WE MENTIONED WERE ADDED BY STAFF. WE WOULD HAPPILY TAKE THEM AWAY.

IF THAT WAS THE COUNCIL'S DECISION. THERE WAS A REQUIREMENT FROM STAFF,O THAT'S WHY THEY ARE SHOWN ON OUR PLAN. UH, PER CITY OF GARLAND CODE, NOT JUST ON A WHALE. UM WE WORKED WITH STAFF ON SCREENING THE PROPERTY TO THE NORTH, MAKING SURE THAT WE WERE PROPERLY ADHERING TO THE SCREENING OR A SETBACK FROM THE NEIGHBORHOOD, MAKING SURE THAT WE GET THEM AS COMFORTABLE AS WE CAN HAVING A BUSINESS TO THE SOUTH. UH, AS WELL MENTIONED, THERE'S SOME EASEMENTS THAT RUN ALONG THE NORTH LINE, SO IT WAS A LITTLE BIT TRICKY, BUT I FEEL LIKE WE'VE COME UP WITH A GOOD SOLUTION THAT SHOULD SATISFY THE NEIGHBORS AS WELL AS MAKE OUR SITE PLAN MORE AND CIRCULATE AND ADHERE TO THE GARLAND BUILDING CODE. UH, THERE'S NO ON SITE COOKING, SO THERE'S NO FRYING. THERE'S NO COOKING. THERE'S NO DEEP FRYING. THERE'S NO OIL.

THERE'S NO THERE'S NOTHING. THEY HAND OUT COOKIES, PACKAGED COOKIES AND MUFFINS. SO THERE'S NO ON SITE COOKING AT ALL. SO THAT NOXIOUS SMELL OF FRIED FOOD AT 10 O'CLOCK AT NIGHT IS NOT GONNA BE PRESENT. UM ALSO, IT'S A SMALL BUILDING FOOTPRINT, SO I FEEL LIKE YOU KNOW IT. IT MESHES WELL WITH THE NEIGHBORHOOD. IT'S NOT A GIANT MCDONALD'S. IT'S FRYING FOOD AT 11 O'CLOCK AT NIGHT. UM IF YOU HAVE ANY QUESTIONS, UM, I'M HERE TO ANSWER THANK YOU FOR YOUR TIME.

VERY GOOD, SIR. THANK YOU, UH, ANY QUESTIONS FOR THE APPLICANT? REMORSE. THANK YOU, MAYOR. UM THIS ISN'T ACTUALLY A QUESTION, BUT THE MINUTE THAT IT HIT THE PUBLIC'S VIEW THAT THAT SWIG WAS POTENTIALLY COMING HERE TO GARLAND. I CAN TELL YOU THAT EVERYBODY I HEARD FROM WAS REJOICING. AND ABOUT EIGHT OR 10 OF THEM WERE RAVING ABOUT DIRTY SODAS AND THE FIRST TWO OR THREE I WAS GOING DIRTY. OH, YES. UM ANYWAY, SO EVENTUALLY THEY EDUCATED ME, BUT APPARENTLY THAT'S VERY POPULAR. APPARENTLY SWIG IS VERY POPULAR IN A LOT OF OUR RESIDENTS ARE ALL IN FOR THIS CONCEPT. SO UM SO THANK YOU. I THINK GARLAND WILL WELCOME YOU. THANKS. ANY ADDITIONAL QUESTIONS, UH, FOR THE APPLICANT. MADAM SECRETARY. DO WE HAVE ANY ADDITIONAL SPEAKERS ON THIS ITEM? I HAVE NO ADDITIONAL SPEAKERS. IS THERE ANYONE WHO WOULD LIKE TO SPEAK ON THIS SIDE? THAT. THANK YOU, SIR. I BELIEVE WE'VE CLEARED THE QUEUE. I WILL SAY, UH, AS A COUNCIL MEMBER FOR SIX YEARS FOR THE THAT FOR DISTRICT SEVEN. THAT PIECE OF PROPERTY HAS BEEN VERY CHALLENGING. UH, BECAUSE OF ITS SHE AND LOCA AND JUST LOTS OF LOTS OF ISSUES, AND I THINK THE CLOSEST WE EVER HAD TO A DEVELOPMENT ON THAT PROPERTY WAS A PROPOSED SOMEBODY WAS

[01:05:04]

PROPOSING AN OIL CHANGE LOCATION , WHICH I CAN TELL YOU WOULD HAVE DISRUPTED THE NEIGHBORS BEYOND SO I THINK THIS IS A GREAT USE. AND I THINK, UH, THE WAY THE SITE HAS BEEN LAID OUT.

UM I THINK IS VERY GOOD. SO WITH ALL THAT, UH, COUNCIL HERICK IN YOUR DISTRICT, SIR. THANK YOU, MAYOR AND I AGREE WITH YOU SAID THERE AND I APPRECIATE ALSO THE APPLICANT'S WILLINGNESS TO WORK WITH THE NEIGHBORHOOD AND CONDUCT MEETINGS AND I'VE BEEN A PART OF THOSE AND I. I REALLY APPRECIATE THEM, TAKING ALL THEIR CONCERNS INTO CONSIDERATION AND MAKING CHANGES TO THE SITE PLAN IS AS THEY SAW FIT. SO WITH THAT SAID, I'D LIKE TO MOVE TO APPROVE THE CHANGE IN ZONING FROM THE PD DISTRICT TO COMMUNITY RETAIL DISTRICT AND ALSO PROVE THE SPECIAL USE PROVISION FOR A RESTAURANT AND DRIVE-THROUGH USE. VERY GOOD. I HAVE A MOTION BY COUNCIL MEMBER HEDRICK AND A SECOND BY COUNCILOR DUTTON TO APPROVE THIS ITEM HAS BEEN PRESENTED. SEEING NO FURTHER COMMENT. MADAM SECRETARY, PREPARE THE VOTE, PLEASE. AND DISPLAY THE VOTE.

AND THAT ITEM IS APPROVED UNANIMOUSLY. LOOKING FORWARD TO HAVING YOU AND I WILL TELL YOU.

I JUST LIVE A COUPLE OF MINUTES FROM THIS LOCATION, SO I WILL MOST LIKELY BE SEEING YOU OFTEN.

THANK YOU. MOVING ON TO OUR LAST ZONING CASE. ITEM SEVEN. D CONSIDER REQUEST BY GOLDEN B

[7.d. Consider a request by Golden Bee Trove LLC for a Specific Use Provision for a thrift store use. The site is located at 5501 Broadway Boulevard, Suite 105 in District 4.]

TROVE LLC FOR A SPECIFIC USE PROVISION FOR A THRIFT STORE USE. THIS SITE IS LOCATED 55 01 BROADWAY BOULEVARD SUITE 105 IN DISTRICT FOUR, MR GARIN. THANK YOU, MAYOR. UH, IT IS AN SUP REQUEST FOR A THRIFT STORE WITHIN AN EXISTING RETAIL CENTER . TENANT SPACE. UH, THE LOCATION IS 55 01 BROADWAY BOULEVARD WITHIN SUITE 105, THE APPLICANT. GOLDEN BEACH TROVE AS I UNDERSTAND, IF THE USE IS APPROVED, I BELIEVE THAT'S THE BUSINESS NAME OR THE PROPOSED BUSINESS NAME. GOLDEN BEE. UM THE ACREAGE OF THE OVERALL RETAIL CENTER SHOPPING CENTER SITE IS ABOUT TWO ACRES. HOWEVER THE UM SPECIFIC TENANT SPACE WHERE THEY USE IS PROPOSED, AND WHERE THE SP WOULD BE LIMITED TO IS 530 SQUARE FEET. IT IS OWNED WITHIN PD 1840. THIS BUILDING WAS ALREADY IN PLACE BEFORE THAT PD. THAT PARTICULAR PD IN 2018 WAS AN AMENDMENT TO A PREVIOUS PD. AND AS IT RELATES TO THIS SITE, IT REALLY JUST DEFERS BACK TO COMMUNITY RETAIL ZONING, WHICH REQUIRES AN SUP FOR A USED GOODS, RETAIL USE. UM, HERE'S A GENERAL LOCATION MAP OF THE SUBJECT PROPERTY OR SHOWING WHERE THE SUBJECT PROPERTY GENERALLY IS. AND SOUTH CAROLINA AND, UH MORE SPECIFICALLY SHOWN HERE. HERE'S THE OVERALL SITE. UH, YOU CAN KIND OF SEE THE SORRY ABOUT THAT. TRY TO STOP MESSING WITH THAT YOU CAN SEE THE SHAPE OF THE BUILDING THERE AND IN BLUE COLOR THERE, WE TRIED TO HIGHLIGHT ABOUT WHERE THAT TENANT SPACE IS, UH, WITHIN THE, UM, RETAIL BUILDING. BUT AS YOU CAN SEE, UH TO THE WEST IS SOME SINGLE FAMILY RESIDENTIAL ZONING AND AN EXISTING NEIGHBORHOOD ZONED SF 10 BUT OTHERWISE TO THE NORTH, SOUTH AND EAST IS PRIMARILY OTHER COMMUNITY, RETAIL OR COMMUNITY. RETAIL BASED ZONING WITH EXISTING RETAIL COMMERCIAL RESTAURANT TYPE USES. THE COMPREHENSIVE PLAN IDENTIFIES THIS AREA AS A NEIGHBORHOOD CENTERS. WHICH, LIKE THE LAST CASE GENERALLY LINES WITH COMMERCIAL USES. FOR THE MOST PART, UM, THE USE, ADDS A RETAIL BUSINESS AND BUSINESS ACTIVITY TO THE AREA AND GENERALLY COMPATIBLE WITH THE COMPREHENSIVE PLAN AND PER THE ECONOMIC DEVELOPMENT STRATEGIC PLAN. THE PROPOSAL IS CONSIDERED PART OF A RETAIL STRIP BUILDING TYPE. OF COURSE, IT IS A TENANT MOVING INTO THAT BUILDING TYPE, AND WE WILL GENERATE SOME SALES TAX FOR THE CITY. BEING A RETAIL USE. UM HERE'S SOME PHOTOS OF THE AREA. THIS IS THE REALLY FACE OF THE SUBJECT PROPERTY HERE ON THE LEFT. THE TENANT SPACE, ACTUALLY, IS THERE RIGHT WHERE THIS HAND IS A HEALTHY PLACE? A HEALTHY PLA, UH, HAS MOVED OUT. SO THAT IS THE SPECIFIC TENANT SPACE THAT WE'RE TALKING ABOUT. AGAIN ABOUT 530 SQUARE FEET. BUT THE OTHER TENANT SPACES, UH, BUSINESSES WILL REMAIN SO IT WOULD JUST BE LIMITED TO THAT SPACE. VOTED TO THE RIGHT IS JUST SHOWING, UH, A VIEW ACROSS ROBBERY BOULEVARD. AND JUST SOME ADDITIONAL PHOTOS, HERE'S THE SITE PLAN THERE. UH, THE APPLICANT IS NOT PROPOSING ANY CHANGES TO THE SITE PLAN.

THIS IS REALLY JUST SHOWING THE EXISTING IMPROVEMENTS. BUT AS YOU CAN KIND OF SEE THERE WE'VE HIGHLIGHTED IN YELLOW ABOUT WHERE THE TENANT SPACE IS, UH, AND THOSE ARE THE OTHER TENANT SPACES AS YOU CAN SEE, AND, UH, ALSO SHOWN HERE. THOSE ARE THE THAT'S KIND OF THE SQUARE FOOTAGE. BREAKDOWN OF ALL THE TENANT SPACES WITHIN THE BUILDING. THIS IS ACTUALLY THE SMALLEST, UM, SQUARE FOOTAGE OF ALL TENANTS, UH, TENANT SPACES WITHIN THIS BUILDING. SO THE APPLICANT AND JUST TO READ A LITTLE BIT FROM THE APPLICANTS NARRATIVE. I BELIEVE WE PUT THIS

[01:10:05]

IN THE STAFF REPORT. BUT THE PROPOSED BUSINESS IS A THRIFT STORE THAT WILL SELL BOTH NEW AND USED ITEMS. UH THE STORE WILL LARGELY CONSIST OF CLOTHING , FURNITURE, FASHION ACCESSORIES , HOME DECOR, KITCHEN PRODUCTS, CHILDREN'S TOYS AND OTHER HOUSEHOLD ITEMS, ACCORDING TO THE APPLICANT.
