THERE'S SIGNIFICANT SANITATION VIOLATIONS CAUSED BY ANIMALS KEPT INSIDE THE HOUSE BY PREVIOUS OWNERS, HIGH GRASS AND DAMAGE TO THE ROOF AND EXTERIOR CLADDING CAUSED BY LACK OF MAINTENANCE REQUIREMENTS TO COMPLY ARE THAT THE HOUSE BE REPAIRED TO A HABITABLE CONDITION WITH REQUIRED PERMITS AND PASS FILE INSPECTIONS BY THE BUILDING INSPECTIONS DEPARTMENT.

THE HOUSE MUST BE SECURED.

THE PROPERTY MUST REMAIN FREE FROM TRACTION, DEBRIS, AND LANDSCAPING AND GRASS MUST BE MAINTAINED.

SO IN SUMMARY, THE ANIMAL SERVICES DEPARTMENT SERVED A WARRANT TO SEIZE ANIMALS FROM THIS PROPERTY IN JANUARY OF 2024, DUE THE DUE TO THE DEPLORABLE UNSANITARY CONDITIONS NOTED DURING SERVICE OF THAT WARRANT.

CODE COMPLIANCE WAS CONTACTED.

CO COMPLIANCE CONDEMNED THE PROPERTY DUE TO THE UNSANITARY CONDITIONS AS WELL AS ADDITIONAL HOUSING STANDARDS VIOLATIONS.

THE OWNER AT THE TIME SOLD THE PROPERTY TO AL ED OF MATRIX PROPERTY SOLUTIONS.

LLC, WHO'S THE CURRENT OWNER.

COMPLIANCE STAFF, HAS BEEN IN CONTACT WITH MR. ONED SEVERAL

HE ORIGINALLY PLANNED TO HAVE THE PROPERTY COMPLETED, THE PROJECT COMPLETED IN FOUR MONTHS.

HOWEVER, HE NOW BELIEVES IT WILL TAKE CLOSER TO EIGHT MONTHS TO COMPLETE.

MR. AHMED HAS ALSO INDICATED THAT HE MAY SELL THE PROPERTY INSTEAD OF REPAIRING IT.

NO PERMITS HAVE BEEN OBTAINED FROM THE BILLING INSPECTIONS DEPARTMENT AND ON MONDAY, STAFF SPOKE TO MIGUEL AT, AT TINA, A POTENTIAL BUYER FOR THE PROPERTY.

HE INDICATED THAT HE THINKS HE CAN COMPLETE REPAIRS IN EIGHT TO 10 WEEKS, AND HE IS SCHEDULED TO CLOSE ON THE PROPERTY TOMORROW APRIL 12TH.

STAFF'S RECOMMENDATION IS THAT THE BOARD FIND AND CONCLUDE ONE, THAT THE NOTICE OF PROCEEDINGS HAS BEEN GIVEN MAIL PUBLISHED AND POSTED IN ACCORDANCE WITH CITY ORDINANCE, STATE LAW AND DUE PROCESS.

TWO, THAT THERE EXISTS ON THE PREMISES, A SUBSTANDARD STRUCTURE, SPECIFICALLY THE MAIN RESIDENCE LOCATED AT 1501 HERITAGE DRIVE IN GARLAND, TEXAS.

THREE, THAT THE CONDITION OF THE STRUCTURE IS SUBSTANDARD DUE TO STRUCTURAL HAZARDS, MINIMUM HOUSING STANDARDS, VIOLATIONS, AND HEALTH AND SANITATION VIOLATIONS, SPECIFICALLY ROTTEN MATERIALS DUE TO LACK OF MAINTENANCE AND FILTH AND RUBBISH.

THAT, AND FOUR, THAT THE SUBSTANDARD STRUCTURE IS CURRENTLY NOT OCCUPIED.

FURTHER, STAFF RECOMMENDS THAT THE BOARD ORDER ONE, THAT NO PERSON MAY OCCUPY THE SUBSTANDARD STRUCTURE UNTIL SUCH TIME AS A FINAL INSPECTION IS CONDUCTED BY CODE COMPLIANCE TWO, THAT THE SUBSTANDARD STRUCTURE BE SECURED AGAINST UNAUTHORIZED ENTRY BY APRIL 15TH, 2024.

THREE, THAT IF THE SUBSTANDARD STRUCTURE IS NOT SECURED AGAINST UNAUTHORIZED ENTRY BY APRIL 15TH, 2024, THE CITY BE AUTHORIZED TO OBTAIN A WARRANT DIRECTING ANY PEACE OFFICER OF THE STATE, INCLUDING A SHERIFF OR CONSTABLE OR CHIEF OF POLICE OF THE CITY, TO ENFORCE AND CARRY OUT THE LAWFUL ORDERS OR DIRECTIVES OF THE PROPERTY STANDARDS BOARD TO ENTER THE PROPERTY AND SECURE THE PROPERTY AGAINST UNAUTHORIZED ENTRY AND PLACE A LIEN ON THE PROPERTY FOR THE COST OF SECURING THE SUBSTANDARD STRUCTURE.

HOWEVER, SHE DID NOT HAVE A PLAN OR A TIMEFRAME FOR COMPLETION.

STAFF RECOMMENDS THAT THE BOARD FIND AND CONCLUDE THAT THE NOTICE OF THESE PROCEEDINGS HAS BEEN GIVEN, MAILED, PUBLISHED, AND POSTED IN ACCORDANCE WITH CITY ORDINANCE, STATE LAW AND DUE PROCESS THAT THERE EXISTS ON THE PREMISES.
