AND WITH THAT, WE WILL BE LED THIS EVENING BY COUNCIL MEMBER HEDRICK FROM DISTRICT SEVEN, SIR. THANK YOU MAYOR. YOU CAN JOIN ME IN PRAYER. GOD OF ALL NATIONS, FATHER OF THE HUMAN FAMILY. WE GIVE YOU THANKS FOR THE FREEDOM WE EXERCISE AND THE MANY BLESSINGS OF DEMOCRACY WE ENJOY IN THESE UNITED STATES OF AMERICA. [ MAYORAL PROCLAMATIONS, RECOGNITIONS AND ANNOUNCEMENTS The Mayor may present proclamations, recognize attendees or accomplishments, and make announcements regarding City events or other matters of interest to citizens including but not limited to listed items. There will be no Council discussion or votes on these matters. The State Fire Marshal's Office will present the City of Garland with an ISO Class 1 Property Protection Classification Red Kettle Mayor's Challenge Proclamation]
WELL, GOOD EVENING EVERYONE. EXCUSE ME. AND WE'VE GOT A COUPLE OF PRESENTATIONS TO START OFF THE EVENING. AND SO I'LL INVITE CHIEF LEE. IF YOU COME FORWARD WITH STATE FIRE MARSHAL'S OFFICE. THIS IS. THIS HAS BEEN A GOOD WEEK FOR THE GARLAND FIRE DEPARTMENT. WE OPENED NEW STATION SIX A FEW DAYS AGO, AND THEN TONIGHT WE HAVE A PRESENTATION FROM THE STATE FIRE MARSHAL'S OFFICE ON OUR ISO RATING. IF YOU WOULD LIKE TO GIVE US SOME INFORMATIO, THIS IS A TEXAS STATE FIRE MARSHAL, DEBORAH KNIGHT. SHE IS JOINING US TONIGHT. THE CITY OF GARLAND IN 2015 EARNED A PROPERTY PROTECTION CLASSIFICATION OF A CLASS ONE, WHICH IS KIND OF THE HIGHEST RATING THAT YOU CAN GET FROM THE INSURANCE SERVICES OFFICE. IT'S QUITE A TASK TO ACHIEVE IT, AND IT TAKES THE COMMITMENT OF COUNCIL. THE FIRE DEPARTMENT, THE FIRE MARSHAL'S OFFICE, THE STATE FIRE MARSHAL'S OFFICE, DISPATCH AND OUR WATER DEPARTMENT. AND SO THROUGH THAT COMBINATION OF FOLKS AND TEAM WORK, WE'VE ACHIEVED IT. AND I'M GOING TO LET CHIEF KNIGHT TAKE OVER FROM HERE. WELL, THANK, THANK YOU. ANTHAT'S KIND OF MY SPIEL, BUT SO. WELL, I DON'T KNOW HOW MUCH BETTER, BUT BUT SO I'M DEBORAH KNIGHT AND I'M THE STATE FIRE MARSHAL. AND THANK YOU FOR ALLOWING ME TO COME AND RECOGNIZE THE COMMUNITY'S CONTINUATION AND MAINTENANCE OF ITS CLASS ONE. IT'S GOING TO GIVE YOU A LITTLE BIT OF BACKGROUND SO YOU CAN SEE WHAT KIND OF ACHIEVEMENT THIS IS. THE SO THE STATE FIRE MARSHAL'S OFFICE, WE ARE PART OF THE DEPARTMENT OF INSURANCE. WE'RE DIVISION OF DEPARTMENT OF INSURANCE. WE HAVE AN ORGANIZATION CALLED ISO. IT'S NOT IT'S THEY DON'T REPORT TO M.THEY DON'T REPORT TO THE COMMISSIONER OF INSURANCE. BUBUT WHAT THEY DO IS THEY GO OUT TO COMMUNITIES ACROSS THE NATION AND THEY ASSESS THE COMMUNITY'S ABILITY TO RESPOND TO AND SUPPRESS FIRES IN THAT COMMUNITY. AND THEY USE THAT. THEY DO THAT BY DOING APPLYING BEST PRACTICES, NATIONALLY RECOGNIZED BEST PRACTICES AND CODES TO SAY, YES, THIS COMMUNITY CAN RESPOND TO THESE FIRES AND SUPPRESS THESE FIRES. THEY DO IT ALL OVER THE COUNTRY.
AND THAT ALL OVER. THERE'S ONLY ABOUT 500 CLASSES LIKE 503 NOW OF CLASS ONES IN THE NATION. SO IN TEXAS WE HAVE MORE THAN OUR FAIR SHARE. WE HAVE 102. SO TEXAS IS SUPPORTIVE OF ITS FIRE SERVICE AND RECOGNIZES THE IMPORTANCE OF, YOU KNOW, OF THE COMMUNITY AND PROTECTING THE COMMUNITY FROM THAT, FROM THAT RISK. SO IT'S GREAT TO BE PART OF THE FIRE SERVICE IN TEXAS.
BUT STILL, EVEN THOUGH WE HAVE MORE THAN OUR FAIR SHARE HERE 100. GETTING A CLASS ONE IS A TRUE ACHIEVEMENT. SO THEY SCORE IT FROM FROM CLASS ONE, WHICH IS THE BEST, TO CLASS TEN WHICH IS NOT SO GOOD. Y'ALL ARE CLASS ONE AND YOU MAINTAINED YOUR CLASS ONE, WHI IS IT'S A COMMITMENT RIGHT? IT'S A COMMITMENT IN RESOURCES. AND IT'S A COMMITMENT IN TIME. AND SOME COMMUNITIES
[00:05:06]
ARE KIND OF ONE. AND DONE. BUT THOSE THAT THAT DECIDE, YOU KNOW, THAT RECOGNIZE AND CONTINUE TO IMPLEMENT AND HAVE THE PROCESSES IN PLACE AND THE RESOURCES, THE MONEY IS IT'S TRULY AN ACHIEVEMENT. SO ON BEHALF OF MYSELF AND COMMISSIONER BROWN FOR THE TEXAS DEPARTMENT OF INSURANCE, I WANT TO RECOGNIZE THAT ACHIEVEMENT AND JOB WELL DONE. AND REALLY THANK YOU. GREAT. THANK YOU VERY MUCH. I GOT IT OVER THERE. I GOT IT. THERE YOU GO. THERE WE GO.VERY GOOD. SO. WELL, CONGRATULATIONS ON THAT, SIR. YOU KNOW, I THINK THAT'D BE GOOD IN YOUR HALLWAYS. YOU GOT IT. WE GOT IT. THANK YOU FOR JOINING US THIS EVENING. COMING ALL THE WAY UP HERE FROM AUSTIN. WE CERTAINLY APPRECIATE IT. AND THANK YOU. I SAID I FOR ISO ONES COMMUNITIES. IT'S A TRUE, YOU KNOW, TRUE PLEASURE TO, TO BE ABLE TO GIVE TO RECOGNIZE IT.
VERY GOOD. WELL THANK YOU. THANK YOU. THANK YOU. THANK YOU. THANK YOU. CHIEF. . AND NEXT UP, YOU KNOW, IF YOU HAVEN'T NOTICED, IF YOU HAVEN'T LOOKED AT A CALENDAR IN THE LAST, SAY, COUPLE WEEKS, THE HOLIDAYS ARE UPON US. AND THAT IS A TIME OF A LOT OF TRADITIONS THAT THAT WE ALL THAT WE ALL SHARE IN. AND ONE OF THOSE TRADITIONS IS THE SALVATION ARMY'S RED KETTLE CAMPAIGN. WE'VE GOT LOOK AT THEIR. OH THAT'S RIGHT. OH MY. BUT YOU KNOW, THE RED KETTLE CAMPAIGN IS, IS ONE OF THOSE, ONE OF THOSE THINGS THAT WE ALL YOU KNOW, WE ALL KNOW THE, THE RINGING, THE RINGING OF THE BELLS AND WE, WE HAVE CERTAINLY PARTICIPATED IN THAT OVER THE YEARS. AND SO WE'LL TALK A LITTLE BIT MORE OF THAT. I DO HAVE A PRESENTATION, BUT THEN I'LL TURN IT OVER TO YOU. THANK YOU. ALRIGHT. SALVATION ARMY'S RED KETTLE CAMPAIGN. WHEREAS THE OPERATIONS OF THE SALVATION ARMY ARE SUPERVISED BY TRAINED, COMMISSIONED OFFICERS, THEY PROCLAIM THE GOSPEL AND SERVE AS ADMINISTRATORS, TEACHERS, SOCIAL WORKERS, COUNSELORS, YOUTH LEADERS AND MUSICIANS. THESE MEN AND WOMEN HAVE DEDICATED THEIR LIVES COMPLETELY TO SERVICE. AND WHEREAS THE PEOPLE IN GARLAND OF ALL AGES VOLUNTEER THEIR TIME, TALENTS AND RESOURCES WITH THE SALVATION ARMY TO ASSIST WITH THE WORK NEEDED TO MEET HUMAN NEEDS WITHOUT DISCRIMINATION.
THE VOLUNTEERS ARE CRITICAL PARTNERS IN HELPING FULFILL THEIR PROMISE TO AMERICA OF DOING THE BEST. AND WHEREAS IN GARLAND, THE SALVATION ARMY PROVIDES IMPORTANT SERVICES TO THE COMMUNITY, INCLUDING MEALS, SHELTER FOR MEN AND WOMEN AND CHILDREN DURING TIMES OF EXTREME WEATHER, SUBSTANCE ABUSE TRAINING, TREATMENT. EXCUSE ME, JOB TRAINING AND FINANCIAL ASSISTANCE TO HELP FAMILIES PAY RENT AND UTILITY BILLS. AND WHEREAS THESE SERVICES ARE PROVIDED FREE OF CHARGE TO THE PEOPLE WHO ARE SERVED THE ONLY WAY THIS IS POSSIBLE IS THROUGH THE FINANCIAL SUPPORT OF LOCAL CITIZENS WHO GIVE THROUGH THE VARIOUS CHANNELS, NOT THE LEAST OF WHICH IS THE SALVATION ARMY'S ANNUAL RED KETTLE CAMPAIGN. AND SO TO REACH THEIR RED CAMP, THEIR RED KETTLE GOAL OF $100,000 FOR THIS YEAR'S HOLIDAY CAMPAIGN, THE SALVATION ARMY IS SEEKING VOLUNTEERS TO FILL MORE THAN 1003 HOUR SHIFTS AS BELL RINGERS. THE AVERAGE BELL RINGER BRINGS IN OVER $50 AN HOUR FOR THE CAUSE. NOW, THEREFORE, I, SCOTT LEMAY, MAYOR OF THE CITY OF GARLAND, ALONG WITH OUR CITY COUNCIL, DO HEREBY DECLARE AND PROCLAIM THE 2024 HOLIDAY SEASON IN GARLAND AS THE SALVATION ARMY RINGS. HOPE MARCHES ON AND WE URGE ALL CITIZENS TO GO REGISTER TO RING, GO TO REGISTER TO RING.COM, PICK A DAY TIME AND LOCATION TO VOLUNTEER AS A BELL RINGER FOR THE SALVATION ARMY. BETWEEN THANKSGIVING AND CHRISTMAS. AND WE HAVE DONE THAT. AND YOU'RE GOING TO TELL US A LITTLE BIT MORE ABOUT IT. I'M GOING TO TRY. YOU'RE GOING TO TRY. VERY GOOD. THANK YOU. THANK YOU VERY MUCH. WE ARE GRATEFUL FOR THE SUPPORT THAT THE CITY THAT YOU, THE CITY COUNCIL AND OF COURSE, THE COMMUNITY GIVES TO THE SALVATION ARMY. WE COULDN'T DO IT WITHOUT YOU. AND SO WE'RE REALLY GRATEFUL FOR THAT. THIS YEAR, WE'LL BE DOING 3000 ANGELS OUT OF OUR GYM, WHICH IS PRETTY IMPRESSIVE. I THINK. YOU KNOW, THAT'S 300 KIDS THAT WILL RECEIVE CHRISTMAS. AND IT'S AMAZING TO SEE IT GROW. IT'S EVEN BETTER TO SEE THE GYM EMPTY OUT BECAUSE WE KNOW THE LIVES OF FAMILIES HAVE BEEN SERVED. IT'S GREAT TO SEE IT'S FULL, BUT IT'S GREAT TO SEE IT EMPTY. YEAH, THAT'S EXACTLY RIGHT. BUT WE'RE GRATEFUL FOR YOU. WE'RE GRATEFUL FOR ALL OF YOU THAT GO OUT AND RING THE BELL AND HELP US TO HAVE FUN AND BE GENEROUS WITH ALL THE THINGS THAT WE'RE DOING. OF COURSE, WE'RE TALKING ABOUT THE DECEMBER 14TH. MAYOR SCOTT LEMAY IS GOING TO GO UP AGAINST THE ROWLETT MAYOR AND WE ARE GOING TO, IF YOU WILL, COME OUT AND SUPPORT HIM, HE'S GOING TO BE OUT THERE RINGING THE BELL.
[00:10:06]
LAST YEAR, HE WAS OUT THERE THE WHOLE TIME, YOU KNOW, AND SO WE ENCOURAGE YOU TO COME OUT ON THAT DAY AND SUPPORT HIM TO SUPPORT THE CITY AND OF COURSE, SUPPORT THE SALVATION ARMY. I DIDN'T BRING ANYTHING AS COOL AS THE BILL, BUT I BROUGHT THIS LITTLE KEEPSAKE FOR YOU, AND IT'S JUST SOMETHING YOU CAN PUT ON YOUR TREE JUST AS A REMINDER. IT'S A SELFLESS. IT'S ONE OF THOSE REMINDERS OF A SELFLESS ACT THAT YOU GAVE, AND YOU PUT IT ON THE TREE, A REMINDER THAT YOU DID SOMETHING THAT WAS SELFLESS, THAT MADE A DIFFERENCE, AND IMPACT THE LIVES OF PEOPLE. WELL, THANK YOU VERY MUCH. THANK YOU. AND I WILL GIVE YOU THIS, SIR. AND I WILL TELL YOU IF THE EMAIL HASN'T GONE OUT FOR OTHER VOLUNTEERS, IT WILL SOON. SO ON DECEMBER 14TH WE WILL BE AT THE WALMART IN NORTH ON NORTH GARLAND. AND LAST YEAR I CAN'T REMEMBER WHAT WE BROUGHT IN, BUT IT WAS SIGNIFICANT. I DIDN'T BRING IT WITH ME EITHER. I COULDN'T REMEMBER THE TOTAL OFF THE TOP OF MY HEAD, AND I SHOULD HAVE BROUGHT IT. BUT AGAIN, HE'S THE REIGNING. HE'S THE REIGNING MAYOR. SO PLEASE COME AND SUPPORT HIM. AND SO WE WILL BE OUT THERE AND WE LOOK FORWARD TO SEEING YOU AND THANK YOU AND THANK YOU FOR WHAT YOU DO. GOD BLESS YOU. THANKS. THANK YOU. IF YOU SEE THIS QR CODE RIGHT HERE ON SOCIAL MEDIA OR ON THE SIGN, IT'S ACTIVE RIGHT NOW.SO YOU CAN GIVE GARLAND A LEG UP AND WE CAN GET A JUMP START ON DECEMBER 14TH RIGHT NOW. AND I SHOULD PROBABLY START WORKING OUT, YOU KNOW, GETTING THE GETTING THE ELBOW READY, YOU KNOW. WELL THANK YOU BOTH VERY MUCH.
ALL RIGHT. AND I BELIEVE AT LAST YEAR'S EVENT COUNCIL MEMBER BASS WAS IN A DINOSAUR OUTFIT. SO NOT ONLY IS IT A GOOD CAUSE TO NOT ONLY IS IT A GOOD CAUSE TO SUPPORT, IT IS ALSO SOMEWHAT ENTERTAINING AS WELL. SO ENCOURAGE ALL OF YOU TO COME OUT AND SUPPORT US NEXT THING WE'LL

GET STARTED WITH OUR AGENDA. FIRST ITEM ON OUR AGENDA IS OUR CONSENT AGENDA. ALL ITEMS UNDER THIS SECTION ARE RECOMMENDED FOR APPROVAL BY A SINGLE MOTION OF COUNCIL, WITHOUT DISCUSSION.COUNCIL HAS HAD THE OPPORTUNITY TO REVIEW EACH OF THESE ITEMS AT A PREVIOUS WORK SESSION, AND APPROVAL OF THE CONSENT AGENDA AUTHORIZES THE CITY MANAGER, OR HIS DESIGNEE TO EXECUTE EACH ITEM. [00:15:03]
COUNCIL OR STAFF. THE CHAIR MAY CALL A SPEAKER OUT OF ORDER IF THE SPEAKER PRESENTS QUESTIONS OR REQUEST FOR INFORMATION THAT WILL UNDULY DELAY THE TRANSACTION OF BUSINESS AT THE MEETING. SPEAKERS SHALL BE ALLOWED TO SPEAK ON A FIRST COME, FIRST TO SPEAK BASIS, AS DETERMINED BY THE ORDER IN WHICH THE CITY SECRETARY RECEIVES THE SPEAKER'S INFORMATION.APPLICANTS ARE ALLOWED TEN MINUTES FOR PRESENTATIONS AND ALL OTHER SPEAKERS WILL BE ALLOWED THREE MINUTES TO SPEAK. WHEN THE PODIUM BUZZER SOUNDS, THE SPEAKER MUST END THEIR COMMENTS. VERY GOOD. AND DO WE HAVE SPEAKER CARDS FOR ANY OF OUR ITEMS THIS EVENING? NO, SIR, WE DO NOT. OKAY. IF YOU ARE HERE TO SPEAK ON ANY PARTICULAR ITEM, I WILL ASK THAT YOU SEE THE CITY SECRETARY AND SHE YOU CAN FILL OUT A SPEAKER CARD AND WE CAN GET YOU QUEUED UP FOR THE AGENDA ITEM. THE FIRST ITEM UNDER THIS SECTION, ITEM SIX A CONSIDER REQUEST BY OLSON PROPOSING A SPECIFIC USE PERMIT PROVISION FOR THE EXPANSION OF AN EXISTING RESTAURANT DRIVE THRU MCDONALD'S. THIS SITE IS LOCATED AT 3285 BROADWAY BOULEVARD IN DISTRICT FOUR.
ALL RIGHT. THANK YOU, MR. MAYOR. THIS IS A REQUEST FOR AN SUP FOR AN EXISTING DRIVE THRU RESTAURANT. MCDONALD'S. AS THE MAYOR MENTIONED, THEY ARE PROPOSING AN ADDITION TO THE EXISTING BUILDING.HE ADDITION IS THE ONE THAT'S TRIGGERING THE REQUIREMENT FOR THEM TO COMPLY WITH THE GDC. AND THAT NECESSITATES AN SUP FOR THE DRIVE THRU SERVICE. SO HERE WE HAVE THE CASE INFORMATION. THIS IS LOCATED IN 3285 BROADWAY BOULEVARD. IT'S A LITTLE LESS THAN AN ACRE AND IS ZONED COMMUNITY RETAIL. WE HAVE THE LOCATION MAP HERE. IT IS LOCATED IN DISTRICT FOUR. ON THIS SLIDE YOU CAN SEE THE ZONING ON THE PROPERTY AS WELL AS THE SURROUNDING ZONING, MOSTLY SURROUNDED BY CR ZONING TO THE NORTHEAST AND NORTHWEST. YOU COULD SEE A LITTLE BIT OF NEIGHBORHOOD OFFICE AND COMMUNITY OFFICE DISTRICT TO THE WEST AND SOUTH BEYOND. KINGSLEY. KINGSLEY ROAD YOU CAN SEE SOME SINGLE FAMILY NEIGHBORHOODS.
IT'S NOT FULLY VISIBLE ON THE MAP, BUT THERE ARE A WHOLE BUNCH OF SINGLE FAMILY NEIGHBORHOODS.
THERE. WE LOOKED AT THE COMPREHENSIVE PLAN, THE EXISTING FUTURE LAND USE MAP FROM ENVISION GARLAND, AND THIS AREA IS DESIGNATED AS NEIGHBORHOOD CENTER AND IT CALLS OUT FOR A MIX OF RETAIL SERVICES AND COMMUNITY GATHERING PLACES, APPROPRIATELY SCALED TO ADJACENT RESIDENTIAL AREAS. WE DO THINK THE PROPOSAL WILL CONTINUE TO PROVIDE A SUPPORTING RESTAURANT USE TO THE NEARBY RESIDENTIAL NEIGHBORHOODS. HERE WE HAVE SOME SITE PHOTOS ON THE FIRST PHOTO, YOU WE COULD SEE THE EXISTING BUILDING. THEN WE ARE LOOKING ACROSS BROADWAY BOULEVARD. ON THE SECOND PHOTO. ON THIS SLIDE, YOU COULD SEE THE SURROUNDING AREAS AND THE STREET JUST TO GET A LOOK AND FEEL OF THE GENERAL SURROUNDING OF THIS PROPOSED SITE. THE APPLICANT HAS PROPOSED A CONCEPT PLAN WITH THIS APPLICATION. AS YOU KNOW, THE CONCEPT PLAN IS A BROAD BRUSH OF THE SITE, BUT IN THIS CASE, THIS IS AN ALREADY DEVELOPED SITE. THE YELLOW ON THE CONCEPT PLAN IS THE EXISTING BUILDING AND THE RED THAT YOU SEE TO THE WEST. TO THE EAST, THAT LITTLE PORTION, THE RED IS THE ADDITION THAT THEY'RE PROPOSING. THE EXISTING BUILDING IS APPROXIMATELY 5958FT■S, AND THE PROPOSED ADDITION IS 194FT■S, WHICH IS ABOUT 3% OF THE EXISTING BUILDING. SO IT IS A PRETTY, PRETTY MINOR ADDITION. AND THAT IS WHY THE SITE DEVELOPMENT STANDARDS SUCH AS LANDSCAPING WILL NOT KICK IN FOR FULL COMPLIANCE. THOSE KICK IN WHEN AN ADDITION OF 30% OR MORE IS BEING PROPOSED. WHEN THEY DO SUBMIT FOR A SITE PERMIT OR A BUILDING PERMIT, THOSE THINGS WILL BE REEVALUATED AGAIN TO MAKE SURE THE APPLICANT IS ASKING FOR A 25 YEAR SUP. THE WE HAVE A TIME PERIOD GUIDE THAT RECOMMENDS A RANGE OF 20 TO 25 THAT. SO THAT IS WELL WITHIN THE RECOMMENDATION. SO WITH THIS SUP A NONCONFORMING USE IS BEING BROUGHT INTO COMPLIANCE, AT LEAST FROM THE SUP PERSPECTIVE, BECAUSE RIGHT NOW THEY DON'T HAVE ONE. AND IT IS CONSISTENT WITH THE GENERAL IDEA OF WHAT SHOULD BE IN THAT AREA FROM THE
[00:20:02]
COMPREHENSIVE PLAN. IT DOES GEL WELL WITH THE SURROUNDING BUSINESSES AS WELL. SO WE ARE RECOMMENDING APPROVAL OF THE SUP FOR 25 YEARS AND RECOMMENDING APPROVAL OF THE CONCEPT PLAN PLANNING AND PLAN COMMISSION HAS ALSO RECOMMENDED APPROVAL OF THE SAME. WE DID NOT RECEIVE ANY RESPONSES TO RESPONSES TO THE NOTIFICATION LETTER FOR THIS CASE. AND WITH THAT, I'M AVAILABLE FOR QUESTIONS. VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE. THANK YOU. ALL RIGHT. IS THE APPLICANT PRESENT THIS EVENING? OKAY. I WILL SAY THIS. IF YOU WOULD LIKE TO MAKE A PRESENTATION OR JUST BE AVAILABLE FOR QUESTIONS, WE CAN DO THAT. IF, IF I WILL ASK COUNSEL, DO WE HAVE ANY QUESTIONS FOR THE APPLICANT? I SEE NONE. YOU'RE DOING A GREAT JOB MAN. OR IS THERE ANYONE ELSE WHO WOULD LIKE TO SPEAK ON THIS ITEM? SEEING NONE, COUNCIL MEMBER WILLIAMS. THANK YOU, MAYOR. I I'D LIKE TO MAKE A MOTION FOR THIS THIS PROJECT.THE APPROVAL OF A RESTAURANT. SPECIFIC. SPECIFIC USE PERMIT FOR A PERIOD OF 20 YEAR AND A PLAN FOR RESTAURANT DRIVE. DRIVE THROUGH USE OF PROPERTY LOCATED AT 3285 BROADWAY BOULEVARD.
OKAY, I HAVE A MOTIO BY COUNCILMEMBER WILLIAMS. EXCUSE ME TO APPROVE THE SPECIAL USE PROVISION FOR A 20 YEAR TIME PERIOD. DO I HAVE A SECOND? MAYOR PRO TEM MOORE IS OUR SECOND. ANY ADDITIONAL QUESTION? MADAM SECRETARY, YOU PREPARE THE VOTE FOR US. PLEASE. COUNCIL.
AND DISPLAY THE VOTE. AND THAT ITEM IS APPROVED UNANIMOUSLY. MOVING ON TO ITEM. EXCUSE ME.
ITEM SIX. BE. CONSIDER REQUEST BY OLSON PROPOSING A SPECIFIC USE PROVISION FOR THE EXPANSION OF AN EXISTING RESTAURANT DRIVE THROUGH MCDONALD'S. THIS SITE IS LOCATED AT 1110 WEST CENTERVILLE ROAD IN DISTRICT FIVE. THANK YOU. MAYOR. SO THIS CASE AND THE ONE THAT WE JUST PRESENTED ARE PRETTY SIMILAR. SO SOME OF THE PRESENTATION MAY SEEM A LITTLE REDUNDANT, BUT WE'LL GO OVER THE CASE AS WE HAVE ON THE OTHER ONE AS WELL. SO HERE HERE ARE THE CASE INFORMATION 1110 WEST CENTERVILLE ROAD. THIS IS TWO THIRD OF AN ACRE. AND THE ZONING IS A PD 0248. SO IT'S AN OLD PD FROM 2002. BUT THE PD REFERS TO COMMUNITY RETAIL USES. AND ON THE M MAP YOU CAN SEE THE DISTRT IT IS LOCATED IN DISTRICT FIVE. ON THIS SLIDE YOU CAN LOOK INTO THE ZONING OF THE PROPERTY AS WELL AS ITS SURROUNDING ZONING. MOSTLY SURROUNDED BY OTHER PDS, BUT MOST OF THOSE PDS ARE FOR COMMERCIAL USES, ALTHOUGH YOU CAN S ON THIS LOCATION MAP BECAUSE OF HOW ZOOMED IN IT IS TO THE EAST AND TO THE SOUTH, WE HAVE SINGLE FAMILY RESIDENTIAL NEIGHBORHOODS, MOSTLY ZONED SF SEVEN. ON THIS, THE COMPREHENSIVE PLAN CALLS CALLS IT CALL THIS AREA CALLS THIS AREA OUT AS COMMUNITY CENTERS AND COMMUNITY CENTERS ARE COMPACT DEVELOPMENT, PRIMARILY NONRESIDENTIAL, SERVING A COLLECTION OF NEIGHBORHOODS. WE DO THINK THIS THIS BUSINESS AND THIS PROPOSAL IS CONSISTENT WITH THAT. AGAIN, THIS IS AN EXISTING MCDONALD'S SIMILAR THING.
THEY'RE OPERATING. THEY DIDN'T HAVE AN SCP BEFORE. GDC NOW REQUIRES AN SP. SO THEY'RE COMING IN BECAUSE THEY WANT TO DO AN ADDITION. THEY'RE COMING IN REQUESTING THE SCP TO BE IN COMPLIANCE WITH THE GDC HERE. HERE ARE THE PHOTOS. YOU CAN SEE THE SUBJECT SITE FROM WEST CENTERVILLE ROAD LOOKING SOUTH DOWN WEST CENTERVILLE, AND HERE ARE SOME OF THE PHOTOS TO HAVE A LOOK AND FEEL OF THE STREET AND THE SURROUNDING AREAS. HERE'S THE CONCEPT PLAN FOR THIS SITE.
AGAIN, SIMILAR TO THE YELLOW SHOWING THE EXISTING AND THE RED TO THE SOUTH. EAST SIDE IS SHOWING THE ADDITION. THE EXISTING BUILDINGS 4085FT■S AND THE ADDITION IS 81FT■S, WHICH IS LESS THAN 2%. SO AGAIN, PRETTY MINOR. AGAIN, THEY'RE ASKING FOR 25 YEAR. THE SP TIME PERIOD
[00:25:08]
GUIDELINE RECOMMENDS 20 TO 25. WE ARE RECOMMENDING APPROVAL. KIND OF SIMILAR THOUGHTS. THIS DOES SERVE THE SURROUNDING NEIGHBORHOODS CONSISTENT WITH THE COMP PLAN. AND ALSO COMPLEMENTARY TO THE SURROUNDING USES. PLANNING COMMISSION ALSO RECOMMENDED APPROVAL OF THE SAME. WE DID RECEIVE TWO RESPONSES ON THIS, ONE IN FAVOR, AND THAT ONE IS FROM THE REQUIRED NOTIFICATION AREA AND ONE IN OPPOSITION, AND THAT ONE IS OUTSIDE OF THE NOTIFICATION AREA. A AND THE COMMENT LETTER. YOU WILL SEE THEY MENTIONED TRAFFIC AS THEIR REASON FOR OPPOSITION. AND WITH THAT, I'M AVAILABLE FOR QUESTIONS. VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? I SEE NONE. THANK YOU. AND I'M GOING TO GO OUT ON A LIMB HERE AND ASSUME IT'S THE SAME APPLICANT. AND DO WE HAVE ANY QUESTIONS FOR THE APPLICANT ON THIS ITEM. I SEE NONE. DEPUTY MAYOR PRO TEM WELL, IN ORDER TO MAINTAIN CONSISTENCY, I WOULD LIKE TO MOTION TO APPROVE THIS SFP FOR 20 YEARS AS WELL. VERY GOOD. I HAVE A MOTION BY DEPUTY MAYOR PRO TEM LUCK TO APPROVE THIS ITEM WITH A WITH AN SP OF 20 YEARS. DO I HAVE A SECOND? I HAVE A SECOND BY COUNCIL MEMBER DUTTON. SEEING NO FURTHER QUESTIONS, COUNCIL. AND DISPLAY THE VOTE. AND THAT ITEM IS APPROVED UNANIMOUSLY. THANK YOU. OUR LAST ZONING ITEM, ITEM SIX Z, IS SIX C IS. CONSIDER A REQUEST BY MANNIX SMITH GROUP INCORPORATED PROPOSING A SPECIFIC USE PROVISION FOR A NEW RESTAURANT DRIVE T THROUGH SLL SLIDERS. THIS SITE IS LOCATED AT 6010 NORTH GARLAND AVENUE IN DISTRICT ONE. THANK YOU, MR. MAYOR. SO THIS IS A REQUEST FOR AN SP FOR A NEW DRIVE THROUGH RESTAURANT NAMED SMALL SLIDERS. PROPERTY IS LOCATED NEAR 6010 NORTH NORTH GARLAND AVENUE. WE SAY NEAR BECAUSE 6010 NORTH GARLAND AVENUE TAKES YOU TO THE STARBUCKS TO THE TO THE NORTH.AND NOT THIS PARTICULAR SITE. SO WE'RE SAYING NEAR AND NOT AT. THIS IS A 1.15 ACRES AND ZONED COMMUNITY RETAIL. HERE YOU CAN SEE THE DISTRICT MAP. THIS IS LOCATED IN DISTRICT ONE. ON THE SLIDE YOU CAN SEE THE ZONING ON THIS PROPERTY AS WELL AS THE SURROUNDING. IT IS ZONED KR. THE SURROUNDING PROPERTIES ON THE EAST SIDE OF NORTH GARLAND AVENUE. THEY'RE ALL ZONED KR. A LITTLE FURTHER TO THE EAST YOU COULD SEE SINGLE FAMILY NEIGHBORHOODS ON THE COMPREHENSIVE PLAN. THIS AREA IS CALLED OUT FOR COMMUNITY CENTERS. AGAIN, COMPACT DEVELOPMENT PRIMARILY NONRESIDENTIAL, SERVING A COLLECTION OF NEIGHBORHOOD, WHICH WE BELIEVE THIS RESTAURANT WILL DO. PHOTOS OF THE SITE. THE FIRST PHOTO IS THE VIEW OF THE SUBJECT SITE. YOU CAN SEE THE MUTUAL ACCESS DRIVE AND NORTH GARLAND AVENUE FROM THE EAST.
THE SECOND PHOTO IS LOOKING SOUTH DOWN NORTH GARLAND AVENUE FROM THE SUBJECT SITE. AND AGAIN, SOME OTHER PICTURES THAT GIVES YOU A LITTLE FEEL ABOUT THE GENERAL AREA. HERE WE HAVE THE CONCEPT PLAN. THE ORANGE AREA HERE IS THE EIGHT PROPOSED APPROXIMATELY 800 SQUARE FOOT BUILDING. THEY'RE GENERALLY SHOWN WHERE THE DRIVE THROUGH AREA WILL BE, WHICH IS SHOWN IN PURPLE. THEY'RE GENERALLY SHOWING WHERE LANDSCAPE AREA WOULD BE THAT IS SHOWN IN GREEN.
PARKING IS SHOWN IN BLUE ON THE CONCEPT PLAN WHEN THE SITE PERMIT PROCESS HAPPENS. WHEN THEY SUBMIT FOR A SITE PERMIT, WE'LL GET INTO ALL THE DETAILS OF LANDSCAPING, PARKING, THE DRIVE THROUGH SO EVERYTHING THAT THE GDC CONTROLS WILL COME INTO PLAY FOR THIS. THIS APPLICANT IS ALSO REQUESTING AN APPROVAL OF A 25 YEAR. AND IT'S PRETTY CONSISTENT WITH THE GUIDELINE OF 20 TO 25. WE DO THINK THIS IS A NEW RESTAURANT, NEW UNIQUE RESTAURANT THAT CAN SERVE THE SURROUNDING NEIGHBORHOODS. BRING IN, BRING IN SOMETHING NEW FOR THE CITY. AND SO WE ARE RECOMMENDING APPROVAL. IT'S CONSISTENT WITH THE COMPREHENSIVE PLAN, AND IT'S COMPLEMENTARY TO THE SURROUNDING USES. PLANNING COMMISSION ALSO RECOMMENDED APPROVAL OF THE SAME. WE RECEIVED ONE RESPONSE LETTER FOR THIS. AND THAT ONE WAS IN OPPOSITION. AND ON THE RESPONSE LETTER YOU'LL SEE THEY MADE SOME COMMENTS ABOUT TRAFFIC NOISE, CRIME AND TRASH TO BE THEIR CONCERN. OKAY, WITH THAT, I'M AVAILABLE FOR QUESTIONS. ANY QUESTIONS FOR STAFF ON THIS ITE?
[00:30:08]
I SEE NONE, THANK YOU. AND DO WE HAVE THE APPLICANT PRESENT? AND I THINK I'M GOING TO SAY THIS AGAIN IF YOU WOULD LIKE TO MAKE A PRESENTATION OR SIMPLY BE AVAILABLE FOR QUESTIONS, WE CAN DO THAT. COUNSEL. DO WE HAVE ANY QUESTIONS FOR THE APPLICANT. LOOKS LIKE WE'RE GOING TO GO THREE FOR THREE ON NO. SO THANK YOU FOR OH OH HELLO. SORRY. ALL RIGHT. THE STREAK HAS BEEN BROKEN. AND BEFORE YOU LEAVE I'LL NEED YOU TO GET NEED TO GET YOU TO FILL OUT A SPEAKER CARD.COUNCILMEMBER WILLIAMS. GOOD EVENING SIR. GOOD EVENING. I THINK YOU HEARD THE STAFF REPORT AND YOU GOT THAT ONE RESPONSE. SOME ISSUES. CAN YOU RESPOND TO THAT CONCERN? THE I COULD SPEAK TO THE TRAFFIC. WE DO A DOUBLE STACK DRIVE THROUGH. IT'S ALL THE TRAFFIC WILL BE CONTAINED INSIDE THE SITE. THERE'LL BE VERY LITTLE TRAFFIC COMING OUT. JUST ONE CAR AT A TIME. SO THERE'S NOT GOING TO BE ANY TRAFFIC BACKED UP INTO THE, YOU KNOW, THE MAIN HIGHWAY OR ANYTHING LIKE THAT. WE CONTAIN ALL THAT ON SITE AS FAR AS TRASH OR ANYTHING LIKE THAT. WE'RE EXTREMELY CLEAN SITE. WE HAVE WE HAVE NO INDOOR DINING. WE JUST HAVE AN OUTDOOR PATIO AREA TO WALK UP WINDOW OR EITHER A DRIVE THROUGH. SO THERE'S REALLY TRASH IS NOT REALLY AN ISSUE CRIME.
SAME THERE. WE HAVE SECURITY CAMERAS. WE HAVE LIGHTS. IT'S ON 24 HOURS A DAY. WE'RE RIGHT NEXT TO STARBUCKS BETWEEN THE BANK RIGHT THERE. I CAN'T IMAGINE THAT BEING TOO MUCH OF A PROBLEM. I CAN'T THINK OF ANY OF THE OTHER COMMENTS, BUT THOSE ITEMS, I FEEL LIKE WE CAN EASILY ACCOMMODATE ANY OF THOSE ITEMS, YOU KNOW? THANK YOU VERY MUCH, SIR. THANK YOU. YOU'RE WELCOME.
THANK YOU. AND SPEAKER CARD. SPEAKER CARD. ANY ADDITIONS SINCE WE'VE GOT HIM HERE. ANY ADDITIONAL QUESTIONS FOR THE APPLICANT? DID I GO OVER THERE? I SEE NONE, THANK YOU SIR.
APPRECIATE IT. IS THERE ANYONE ELSE WHO WOULD LIKE TO SPEAK ON THIS ITEM? SEEING NONE, COUNCILMEMBER BASS. THANK YOU. MAYOR, I'D LIKE TO MAKE A MOTION TO APPROVE ZONING CASE 2433, AS PRESENTED WITH THE SCP. 25 YEARS SECOND. VERY GOOD. I HAVA MOTION BY COUNCILMEMBER BASS AND A SECOND BY MAYOR PRO TEM. MORE TO APPROVE THIS ITEM AS PRESENTED WITH A 25 YEAR SUP. I SEE NO ADDITIONAL QUESTIONS. MADAM SECRETARY, PREPARE THE VOTE FOR US, PLEASE. COUNCIL.
AND DISPLAY THE VOTE. AND THAT ITEM IS APPROVED UNANIMOUSLY. AND THAT WAS OUR LAST ZONING ITEM FOR THIS EVENING. NEXT ITEM IS CITIZEN COMMENTS. MEMBERS OF THE AUDIENCE WISHING TO ADDRESS ISSUES NOT ON THE MEETING AGENDA MAY HAVE THREE MINUTES TO SPEAK. HOWEVER, ACCORDING TO THE TEXAS OPEN MEETINGS ACT, COUNSEL IS PROHIBITED FROM DISCUSSING ANY ITEM NOT ON THE POSTED AGENDA. I DON'T BELIEVE WE HAVE ANY SPEAKER CARDS THIS EVENING, BUT IS THERE ANYONE WHO WOULD LIKE TO SPEAK? SEEING NONE AT 733, WE
