Second Amendment to the Project Specific Agreement with Dallas County for Rowlett Road Cycle Track from Greenbelt Parkway to Lake Ray Hubbard Consider a Resolution authorizing the City Manager to enter into and execute a Second Amendment to the Project Specific Agreement (PSA) with Dallas County for increased participation in the design and construction of the Rowlett Road Cycle Track from Greenbelt Parkway to Lake Ray Hubbard. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the February 4, 2025 Regular Meeting.]

ON. HOMELAND SECURITY GRANT PROGRAM RESOLUTION, ITEM NUMBER TWO, SECOND AMENDMENT TO THE PROJECT SPECIFIC AGREEMENT WITH DALLAS COUNTY FOR ROWLETT ROAD CYCLE TRACK FROM GREENBELT PARKWAY TO LAKE RAY HUBBARD. AND I THINK THAT WE HAVE A FORMAL BRIEFING FOR THAT THIS EVENING.

THIS IS A REQUEST OF. COUNCILMAN BJ WILLIAMS. MR. COUNCILMAN, GOOD EVENING. MIKE. YES, SIR.

COUNCILMAN WILLIAMS HAD ASKED A QUESTION ABOUT THE FIRST AMENDMENT TO THIS CONTRACT AND THEN THE SUBSEQUENT SECOND AMENDMENT AND HAD A FOLLOW UP QUESTION AFTER THAT. SO THE FIRST AMENDMENT THAT WE SIGNED BACK, I BELIEVE IT WAS IN SEPTEMBER OF LAST YEAR, WAS RIGHT BEFORE THE BID. IT WAS FOR THE ACTUAL OPINION OF PROBABLE CAUSE. THE REVISED OPINION OF PROBABLE COST FROM THE CONSULTING ENGINEER WITH DALLAS COUNTY THAT WAS WORKING ON THE PROJECT WITH DALLAS COUNTY, AND BASED ON THAT, DALLAS COUNTY DECIDED THEY WANTED TO HAVE AN AMENDMENT TO THE CONTRACT FOR THE ADDITIONAL FUNDING FOR THE PROJECT. THE SECOND AMENDMENT THAT YOU'RE SEEING THIS EVENING AND THAT WE'RE ASKING THE COUNCIL TO APPROVE. I GUESS IN THE FIRST, FIRST WEEK OF FEBRUARY IS BASED ON ACTUAL BID COST OR BID PRICES THAT CAME IN AFTER THE COUNTY BID THE PROJECT. AND SO IF YOU SEE ON THE ON THE SUMMARY, IF YOU LOOK AT THE THIRD COLUMN, THE TOTAL PROJECT COST BASED ON THE SECOND AMENENT TO THE PSA SHOWS THE BREAKDOWN BETWEEN THE TXDOT TO SET ASIDE FUNDS, DALLAS COUNTY FUNDING, AS WELL AS THE CITY OF GARLAND PROPOSED FUNDING FOR THIS PROJECT. TO SET ASIDE FUNDING WOULD PAY FOR APPROXIMATELY 29% OF THE PROJECT. DALLAS COUNTY, 47% OF THE PROJECT. AND THE CITY OF GARLAND 24% OF THE PROJECT. BASED ON THIS, ON THE CALCULATIONS, THE TOTAL PROJECT COST CURRENTLY ALSO INCLUDES CONTINGENCY THAT THE COUNTY WORKED INTO THE BID SO THAT ANY COST OVERRUNS DURING CONSTRUCTION ARE SURPRISES DURING CONSTRUCTION COULD BE COVERED. SHOULD THERE BE. AND THIS IS SOMETHING THAT THE COUNCILMAN ASKED, SHOULD THERE BE A THIRD AMENDMENT THAT SAY THERE IS SOMETHING UNEXPECTED OUT IN THE FIELD DURING CONSTRUCTION? SHOULD THERE BE A THIRD AMENDMENT, IT WOULD BE EXPECTED THAT THE CITY AND COUNTY WOULD SHARE IN THAT COST ON THAT THIRD AMENDMENT AS WELL. WE'RE NOT EXPECTING THAT, SINCE MOST OF THE CONSTRUCTION IS IN THE MEDIAN, THERE'S FEWER UTILITIES, THERE'S FEWER THINGS TO GO WRONG IN THE MEDIAN, AS OPPOSED TO THE PARKWAY AREA WHERE YOU HAVE TYPICALLY UTILITIES IN IN DRIVEWAYS AND THAT TYPE OF THING. FOR THE BRIEFING, COUNCILMAN HEDRICK. THANK YOU. MAYOR PRO TEM, I HAVE A QUESTION ABOUT HOW WAS THE ORIGINAL ESTIMATE SO FAR OFF? I MEAN, THIS SECOND AMENDMENT, IT MORE THAN DOUBLES THE ORIGINAL COST ESTIMATE IN THE PROJECT. RIGHT. AND ONE THING THAT I MENTIONED, I BELIEVE IN MYATURDAY MORNING PRESENTATION A COUPLE OF WEEKS AGO, ONE THING THAT I HAVE SEEN OCCUR IN THE LAST 3 TO 4, MAYBE FIVE MONTHS NOW ON SOME OF OUR BIDS, IS THAT PAVEMENT COSTS ARE COMING IN A SIGNIFICANT AMOUNT HIGHER. SOME 15%. EVEN ONE BID WAS 20% CAME IN HIGHER THAN ESTIMATED. SO WE'RE SEEING A SPIKE IN PAVING COSTS RIGHT NOW. AND I AND I BELIEVE THAT'S WHAT HAPPENED ON THEIRS. I HAVE NOT STUDIED THEIR BIDS THAT THE COUNTY HAS PRESENTED BECAUSE THEY HAVEN'T AWARDED THIS YET. THEY DON'T WANT THAT OUT AS FAR AS THE PEOPLE'S BIDS. BUT WHAT I WANTED TO I'M SUSPECTING THAT'S WHAT THEY'RE SEEING AS WELL, IS THE SPIKE. MOST OF THIS IS ALL PAVING. WE'RE PAVING THE CENTER LANE, WE'RE PAVING THE LEFT TURN LANES AND THEN ALSO SOME SIDEWALKS ON THE SIDE. SO A LOT OF THIS IS PAVING COSTS. SO I'M ASSUMING THAT THEY'VE PROBABLY SEEN A SPIKE LIKE WE DID IN PAVING COSTS. I MEAN 15 TO 20% COST DOESN'T EXACTLY DOUBLE IT.

BUT RIGHT HOPEFULLY AT THIS POINT THEY'VE CAPTURED IT. I MEAN, I THINK IT'S A WORTHY PROJECT FOR SURE, BUT THE COSTS KEEP GOING UP AND TXDOT SHARE DOESN'T CHANGE OVER THAT. SO NO SIR. THAT ONE'S LOCKED IN. YEAH OKAY. YES, SIR. THANK YOU. THANK YOU, MAYOR PRO TEM. THANK YOU.

[5. Discussion of 2025 Proposed Capital Improvement Program (CIP) City Council will continue discussion of the 2025 Proposed Capital Improvement Program (CIP). ]

ON OUR AGENDA. ITEM NUMBER FIVE, DISCUSSION OF THE 2025 PROPOSED CAPITAL IMPROVEMENT PROGRAMS CIP. WE'LL BE LOOKING AT MATT WATSON AND LOOKS LIKE MATT WATSON. OKAY. UNFORTUNATELY JUST ME TODAY ALLISON IS ILL. SO Y'ALL ARE GOING TO HAVE TO SUFFER WITH ME. WE'LL PUT UP WITH THAT OKAY. SO QUICKLY, WE JUST WANTED TO GO THROUGH TWO CHANGES THAT WE HAD TO THE CIP.

ONE CAME FROM CITY COUNCIL AT THE SATURDAY WORK SESSION AND ONE WHICH IS STAFF INITIATED.

AND I'LL START WITH THE STAFF INITIATED. ONE. AND THIS IS A GRANT THAT WE RECEIVED FROM THE STATE ENERGY CONSERVATION OFFICE FOR ABOUT $250,000, AND WE ARE LOOKING TO APPLY THAT TO OUR EXISTING FACILITIES IMPROVEMENT PROGRAM. AND SPECIFICALLY, IT WILL BE APPLIED TO THE POLICE DEPARTMENT TO ENHANCE ENERGY EFFICIENT LIGHTING AS PART OF THEIR FCA PROGRAM, WHICH IS THE FACILITIES CONDITION ASSESSMENT. THERE'S NO CHANGE IN THE AMOUNT OF DEBT ISSUANCE ASSOCIATED WITH THIS. THIS IS JUST A GRANT TO DO SOME ENERGY EFFICIENT LIGHTING. THE SECOND PIECE IS THE GATEWOOD DRAINAGE PROJECT THAT WAS TALKED ABOUT JANUARY 11TH. WE HAD AN ESTIMATE OF $6.7 MILLION, WHICH WE ARE PROPOSING TO USE CERTIFICATES OF OBLIGATION TO FUND THAT WILL BE SERVICE. THE DEBT SERVICE WILL BE SERVICED FROM THE STORMWATER RATE. SO THIS WILL BE NO ADDITIONAL TAX SUPPORTED DEBT SERVICE, BUT WOULD BE UTILIZING THE STORMWATER RATE AS COUNCIL. AS YOU ALL REMEMBER, WE'VE BEEN INCREMENTALLY INCREASING THAT TO COVER DRAINAGE PROJECTS. SO THAT'S WHERE THIS WOULD COME FROM. AND I'LL LET KRYSTAL TALK ABOUT THE ACTUAL TIMING OF THIS PROJECT. GOOD EVENING. SO DURING OUR L LAST CIP MEETING, SEVERALF YOU EXPRESSED A DESIRE TO POSSIBLY MOVE THIS PROJECT FORWARD, AND WE MADE THE COMMITMENT AT THAT TIME THAT WE WOULD TAKE A LOOK AT IT. IF YOU RECALL, IT WAS ORIGINALLY PROGRAMED IN 2027. AFTER LOOKING AT THE RESOURCES THAT WE CURRENTLY HAVE AVAILABLE AND THE NUMBER OF PROJECTS THAT WE CURRENTLY HAVE ON DECK, I WOULD NOT BE COMFORTABLE IN PROPOSING THAT WE MOVE THIS PROJECT FORWARD AT THIS TIME. HOWEVER, I WOULD BE WILLING TO COMMIT TO LOOKING AT IT AGAIN IN 2026 AND DETERMINING IF WE IF IT WOULD BE POSSIBLE DURING THE 2026 CIP PROCESS TO MOVE IT FORWARD INTO 2026. I JUST I WANT TO BE SURE THAT WHAT WE DON'T END UP IN A SITUATION OF OVER AND UNDER-DELIVERING AND JUST IN IN MAINTAINING THAT INTEGRITY WITH MY TEAM, I DON'T THINK IT WOULD BE FAIR TO THEM TO TRY AND COMMIT TO MOVING THIS FORWARD PAST WHERE IT IS RIGHT NOW,

WITHOUT A FURTHER ASSESSMENT. LATER, AFTER WE HAVE HAD AN OPPORTUNITY TO COMPLETE SOME OF THE PROJECTS WE CURRENTLY HAVE ON DECK. COUNCILMAN WILLIAMS. THANK YOU, MICHAEL. AND CRYSTAL, THE I'M FINE WITH WITH WITH THAT RATIONALE. BUT ONE OF THE THINGS THAT I THINK WE CAN COMMIT TO IS THAT AND WE HAVE COMMITTED TO IT IS THAT WE WILL CONTINUE TO REVIEW THIS PROJECT FOR THE NEXT CIP. ABSOLUTELY. OKAY. THAT THIS PROJECT WILL BE WILL BE INCLUDED IN OUR PROJECTIONS AND OUR ESTIMATES. AND 2026 AND IF, IF WE CAN. WE HAVE THE BANDWIDTH TO INCLUDE THIS PROJECT. WE WILL AND WE WILL GO GO FROM THERE. BUT 2026 THIS PROJECT WILL BE REVIEWED FOR ADDITIONAL FUNDING IN 2026. I DO HAVE THAT COMMITMENT FROM CRYSTAL AND I THINK FROM THE CITY MANAGER.

RIGHT? YES. CORRECT. OKAY. OKAY. ALL RIGHT. OKAY. THAT'S ALL I'VE GOT. COUNCIL LADY DUTTON, CAN YOU JUST CLARIFY WHEN DID THIS FIRST THE GATEWAY DRAINAGE IMPROVEMENT SITUATION COME UP IS NEEDING TO BE TAKEN CARE OF. SO THIS WAS PART OF THE 2019 BOND PROGRAM. AND WE PRESSED PAUSE ON IT BECAUSE WE REALIZED THAT THE SCOPE THAT WAS IDENTIFIED IN THE 2019 BOND PROGRAM WAS NOT SUFFICIENT TO BE ABLE TO ADDRESS THIS ISSUE. IT NEEDED ADDITIONAL STUDIES DONE. WE COMPLETED THAT STUDY IN, OH MY GOSH, WE ARE 25. LAST YEAR WE COMPLETED THAT STUDY. LAST YEAR WE BROUGHT THAT FORWARD. AND THEN THAT'S WHERE THE RECOMMENDATION TO DO THE IMPROVEMENTS AT BROADWAY AND OATS CAME FROM AS PART OF THIS PROJECT. OKAY. SO. OBVIOUSLY 2019 IS BEFORE MY COUNCIL TIME, AND I UNDERSTAND THE FINANCIAL END OF IT. BUT I ALSO UNDERSTAND THAT WE'VE GOT HOUSES THAT ARE BEING AFFECTED IN A NEGATIVE WAY, AND I DON'T NECESSARILY KNOW THAT IT'S FAIR TO THOSE HOMEOWNERS THAT WE'RE WE'RE LIKE, WHAT'S ONE MORE YEAR WHEN WE'VE KNOWN THAT IT'S NOT THE FINANCIAL SIDE OF THINGS. THE FUNDING IS AVAILABLE. THE ISSUE IS THAT WE CURRENTLY HAVE, ON AVERAGE, OUR ENGINEERING TEAM, THEY'RE MANAGING ON AVERAGE RIGHT NOW, ABOUT 10 TO 12 PROJECTS EACH. AND SOME OF THESE ARE VERY, VERY LARGE PROJECTS. AND THEN WE'RE DOWN ONE STAFF MEMBER, WHICH MEANS THAT THOSE 10 OR 12 PROJECTS THAT WERE ALLOCATED TO THAT PARTICULAR STAFF MEMBER, WE'RE TRYING TO REALLOCATE THEM, WHICH MEANS THAT THAT 12 IS NOW GOING TO INCREASE BY SOME FACTOR. IT'S JUST IT'S RESOURCES. IT'S NOT ABOUT THE FUNDING. THE FUNDING IS AVAILABLE. SO BUT I COULD TELL YOU WE CAN START ON IT. BUT IT'S GOING TO SIT AND I JUST I DON'T WANT TO DO THAT BECAUSE THAT WOULD NOT BE TELLING YOU THE TRUTH. SO I BELIEVE DURING OUR CIP MEETING, DYLAN HAD ASKED ABOUT HIRING AN OUTSIDE. GROUP TO AT LEAST GET THE BALL ROLLING ON THIS. I WOULD IT. EITHER WAY, IT'S GOING TO SIT RIGHT? UNLESS WE HAVE SOMEONE ELSE TAKE THE REINS ON IT. SO IS THERE ANYTHING THAT IS STOPPING US FROM BEING ABLE TO DO THAT? JUST SO? I MEAN, THIS IS NOT MY WHEELHOUSE. SO I DON'T KNOW, LIKE I DON'T KNOW LIKE THE ABCS OF HOW IT ALL GOES DOWN. THROUGH OUTSIDE CONSULTANTS. BUT WHAT WE DON'T DO IS JUST TURN OUR PROJECTS OVER TO CONSULTANT, THROW THE MONEY AT THEM AND SAY, OKAY, WE'RE GOOD, YOU TAKE CARE OF IT AND BRING US BACK A FULL SET OF, YOU KNOW, CONSTRUCTION PLANS AND WE'RE GOOD TO GO. THERE IS A PROCESS THAT WE GO THROUGH. THERE'S RIGHT OF WAY ACQUISITION. SOMETIMES THERE'S DESIGN REVIEWS, THERE'S UTILITY RELOCATIONS. ALL OF THAT TAKES RESOURCES. THOSE ARE IN-HOUSE SERVICES T THAT WE AND THAT TAKES RESOURCES IN-HOUSE. SO WHEN I SAY WE HAVE 12 OR 13 PROJECTS, 11 OR 12, WHATEVER THAT NUMBER IS, THAT IS INCLUDING MOST OF THOSE ARE BEING DESIGNED BY OUTSIDE CONSULTANTS. WE DON'T DO WE DO VERY, VERY LITTLE IN-HOUSE DESIGN. THANK YOU. WE'RE NOT STAFFED THAT WAY. IF I COULD JUST ADD, I THINK WHAT WHAT STAFF IS SAYING AND CRYSTAL AND I HAVE HAD LONG CONVERSATION ABOUT THIS IS THAT WE'D LOVE TO I WOULD LOVE TO JUST SAY, YEAH, WE'LL WE'RE GOING TO MAKE THIS A PRIORITY AND MOVE FORWARD WITH IT THIS YEAR AS SOON AS POSSIBLE. AND THEN IT SITS AND WE DON'T KEEP THAT COMMITMENT. AND THAT'S NOT SOMETHING THAT WE WANT TO DO RIGHT NOW. WE'RE TRYING TO BE VERY REALISTIC ABOUT WHAT OUR CAPACITY IS TO MANAGE A LOT OF PROJECTS. WE HAVE A RECORD CIP. WE'VE HAD A RECORD CIP FOR SEVERAL YEARS AND THAT WE'RE WE'RE TRYING TO BE REALISTIC AND NOT OVERCOMMIT AND UNDER-DELIVER. AND I HATE THAT THIS IS LIKE THE FOCUS ON THIS PARTICULAR PROJECT. BUT IN REALITY, THERE'S A LOT OF PROJECTS OUT THERE. COUNCILMAN WILLIAMS, I THINK SOMEBODY ELSE IS IN. YOU MAY HAVE DYLAN, I SAW YOU IN AND THEN YOU CAME OUT. MY QUESTION WAS ANSWERED. THANK YOU. OKAY, GOOD. WELL.

UNDERSTANDING. CRYSTAL'S BECAUSE WE TALKED ABOUT IT BEFORE, AND I UNDERSTAND THAT. AND I THINK THE CONSTITUENTS DOWN THERE CAN UNDERSTAND THIS. BUT AND THAT'S WHY I. SOLICITED THE PROMISE AND GOT IT THAT THIS PROJECT IN 2026 IS GOING TO BE CLOSELY EXAMINED. AND IF THINGS IF THE STARS LINE UP. THIS PROJECT WOULD GO A YEAR EARLIER. WHAT MY CONCERN IS I DON'T WANT THIS. PROJECT. TO FADE INTO THE DARKNESS LIKE IT DID BEFORE. AND THAT'S NOT YOU HAVE NOTHING TO DO WITH THAT.

THAT'S A POLITICAL STATEMENT. BUT IT WAS INCLUDED IN BOND ISSUE BOND PROGRAM AND IT WAS STRICKEN. AND I DON'T DON'T EXPECT THAT TO HAPPEN AGAIN. BUT WORKING WITH CITY MANAGER AND STAFF, THAT'S WHY I SAID 2026. WE'LL BE LOOKING AT THIS PROJECT AGAIN. AND IF YOU DISCOVER SOME WAYS THAT WE CAN MOVE IT UP, THE FOLKS DOWN THERE WOULD LIKE TO HEAR THAT. BUT BUT I JUST WANT TO MAKE SURE THAT THIS PROJECT REMAINS ON THE RADAR. IT'S A PROJECT THAT'S BEEN LONG NEEDED AND THE PEOPLE HAVE BEEN VERY PATIENT. AND I EXPECT THERE TO BE SOME MOVEMENT ON THIS, ON THIS PROJECT. AND I'VE GOT THAT COMMITMENT FROM STAFF THAT THERE WILL BE SOME MOVEMENT ON THIS PROJECT. I KNOW WE'VE GOT A LOT OF PROJECTS GOING ALL OVER TOWN. I UNDERSTAND THAT, BUT THESE FOLKS HAVE BEEN VERY PATIENT. THEY'VE BEEN GOOD LISTENERS. THEY'VE NOT CAUSED WAVES. AND I THINK THAT'S TO THEIR CREDIT. SO MIKE AND MYSELF WORKED, ALONG WITH OTHER TEAM GARLAND MEMBERS ON A NEW SOLUTION THAT IS A COMPLETE REPLACEMENT OF ALL THE AUDIO VISUAL SOLUTIONS WITHIN THESE THREE ROOMS, AND PREPARES THESE THREE ROOMS FOR THE FUTURE AS WELL. NEXT, I'LL JUST DO A QUICK OVERVIEW OF THE THREE DIFFERENT ROOMS, AS WELL AS THE COUNCIL MEMBERS EXPERIENCE. SO WITHIN THE ACTUAL COUNCIL CHAMBERS ITSELF, WE'LL BE PUTTING IN NEW TOUCH SCREEN MONITORS AT THE MAYOR'S POSITION, CITY SECRETARY'S POSITION AND THE PODIUM AT EACH OF THE COUNCIL MEMBER SEATS. SO WHAT WE DID IS WE TOOK IT AND MADE IT A BIG PROJECT. WE HAD TIFFANY, WE KNOW WE'VE GOT DAN BOCK AND HIS TEAM INVOLVED. WE GOT IT INVOLVED, AND WE WENT THROUGH A PROCESS TO SELECT A VENDOR THAT COULD BRING US AN ENTIRE PACKAGE FOR THIS ROOM AND THAT ROOM, THE COUNCIL CHAMBERS AS WELL, THAT WILL TIE ALL THAT TECHNOLOGY TOGETHER.
