AND IT'S A TOPIC THAT BEGAN WITH THE JULY 15TH, 2024, UH, CITY COUNCIL WORK SESSION.
A MOTION BY COUNCIL MEMBER HEDRICK AND A SECOND BY MAYOR PRO, TIM LUCK TO ASSIGN THE TOPIC TO EXPANDING THE CITY'S STORM WATER PROGRAM TO THE TRANSPORTATION INFRASTRUCTURE AND MOBILITY COMMITTEE.
DISCUSSION STEM FROM A PRESENTATION ON STORM STORMWATER QUALITY, AND INCLUDED A PROPOSAL TO EXPLORE EXPANSION OF THE PROGRAM.
UM, IF YOU MAY RECALL, WE DID MEET IN AUGUST.
I, I PRESENTED SOME INFORMATION, UM, AT THAT TIME ON OUR STORM WATER FEE, WHAT WE, WHAT OUR CURRENT RATES WERE, WHAT, UM, AND THEN WE ALSO DID SOME RESEARCH AT THAT TIME WHERE WE LOOKED AT A COUP A FEW CITIES.
AND I'M GONNA REHASH SOME OF THAT REAL QUICK SO THAT IT REMINDS, 'CAUSE IT'S BEEN A FEW MONTHS.
SO WE'LL GO BACK THROUGH IT AGAIN.
THESE ARE THE, UM, CITIES BECAUSE WHAT CAME UP IS, UH, I BELIEVE COUNCILMAN HENDRICK, YOU WERE LOOKING AT A POSSIBLE STORMWATER FEE CREDIT, UM, AND HOW WE CAN IMPLEMENT THAT IN THE CITY OF GARLAND.
WE, WE DID, UH, SOME CALLING AROUND BACK IN JULY INTO AUGUST, AND, AND, UH, BASICALLY POLLED THE CITIES THAT YOU SEE THERE.
ARLINGTON, DALLAS-FORT WORTH, IRVING, MESQUITE, PLANO, FRISCO, GRAND PRAIRIE, RICHARDSON, LEWISVILLE, AND MCKINNEY TO DIS ASKING THEM, DO THEY HAVE A STORM WATER FEE CREDIT? AND, UM, IF THEY DID, WHAT'S THEIR POLICY? THEY SENT US THEIR POLICIES, THEY SENT US THEIR ORDINANCES, THINGS TO LIKE THAT.
AND AS YOU CAN SEE HERE, FROM THOSE THAT WE POLLED, THERE ARE FIVE CITIES.
I'VE KIND OF CONDENSED IT DOWN TO MAKE IT A LITTLE MORE LEGIBLE AND NOT SO BUSY.
BUT ARLINGTON, FORT WORTH, PLANO, FRISCO AND LEWISVILLE ALL HAVE, UM, STORMWATER FEE CREDITS.
AND AS YOU CAN SEE ON THE FAR RIGHT, THERE'S A DATE OF WHEN THEIR ORDINANCES AND THEIR PO AND OR POLICIES HAD WERE IMPLEMENTED EVERYWHERE.
ANYTHING FROM 2008 TO 2017 AND IN BETWEEN.
AND SO I, I WANTED TO REHASH A LITTLE BIT OF THIS.
ARLINGTON, BASICALLY, UH, IN THEIR ORDINANCE, IT WAS ADOPTED IN 2010.
THEY CURRENTLY HAVE ONE PROPERTY THAT IS, UH, PARTICIPATING IN THE VOLUNTARY FEE CREDIT.
AND THERE IS NO SELF-REPORTING REQUIRED AND THERE'S NO FORMAL INSPECTION PROCESS.
FORT WORTH, I, WE HAD MENTIONED THIS ONE BACK IN AUGUST, AND THEY DO HAVE, UM, SELF-REPORTING THAT'S REQUIRED.
AND CITY INSPECTORS ARE REQUIRED ON CERTAIN, IN INSPECTIONS ARE REQUIRED ON CERTAIN BMPS.
THEY CURRENTLY HAVE 90 PARTICIPATING, BUT IT'S EDUCATIONAL CREDIT ONLY.
THIS IS THEIR, UM, THEY ACTUALLY ASSESS THEIR SCHOOL DISTRICT FOR THE, THE STORMWATER FEE IN GARLAND.
WE DO NOT ASSESS OUR SCHOOL DISTRICT.
WE DON'T ASSESS GISD FOR THE STORMWATER FEE, BUT THERE ARE CURRENTLY NO OTHER WATER QUALITY CREDITS BEING PROVIDED BY THE CITY OF FORT WORTH.
THEY DO NOT HAVE ANY SELF-REPORTING OR INSPECTION REQUIREMENTS.
UM, WHEN WE CONTACTED THEM OF THE 92, THEY, THEY MENTIONED THAT, UM, THERE HAVE BEEN NO INSPECTIONS SINCE THEIR IMPLEMENTATION.
AND SO WE ASKED HIM, I SAID, SO HOW DO YOU KNOW IF THEY'RE STILL, YOU KNOW, WORKING OR IF THEY'RE, IF THEY'RE STILL ACCEPTABLE, THEY DON'T HAVE ANY CLUE 'CAUSE THEY'RE, THEY DON'T INSPECT AND THEY DON'T REQUIRE SELF, UM, REPORTING.
UM, FRISCO ADOPTED THEIRS IN 2009.
THEY DON'T, THEY CURRENTLY DON'T HAVE ANY.
THEY, THEY DO HAVE SELF-REPORTING REQUIRED IN THEIR ORDINANCE OR THEIR POLICY AND CITY INSPECTIONS ON CERTAIN BMPS.
AND THEN OF COURSE, LEWISVILLE, ONE OF THE MOST RECENT, UM, SINCE 2017.

HAVE TWO THAT ARE, THAT ARE PARTICIPATING.THEY DO HAVE SELF-REPORTING THAT'S REQUIRED, AND THEIR INSPECTIONS ARE NOT CONDUCTED AT THIS TIME BY THE CITY STAFF.
SO OUR LOCAL DRAINAGE FEES, I WENT OVER THIS, THESE WERE AS OF AUGUST, UM, GARLANDS HAS GONE UP.
I, WE, WE HAVE A NOTE THERE AT THE BOTTOM THAT GARLAND IN THIS CURRENT STUDY, GARLAND WAS 29% THE BLOW, THE MEAN AVERAGE OF THE RESIDENTIAL FEE.
AND THEY WERE ABOUT 17% BELOW THE MEAN AVERAGE OF THE COMMERCIAL FEE RATE THAT WAS ASSESSED OF ALL THE CITIES THAT WE, WE POLLED.
UM, THE CITY'S FEE WENT UP FROM 0.107 TO 0.122 AS OF OCTOBER 1ST, UH, JUST GIVE YOU A BRIEFING ON THAT.
AND WE HAVE NOT GONE BACK TO REASSESS IF ANY OF THE OTHER CITIES HAD GONE UP AT THIS TIME.
IF YOU'LL LOOK AT YOUR HANDOUT, I'VE, I'VE GIVEN YOU A TWO PAGE, A COUPLE PAGES HERE.
IT'S, IT'S TWO PAGES, BUT IT'S ACTUALLY THREE, FOUR PAGES ON, UM, THE ADMINISTRATIVE DIRECTIVE.

SO THE DIRECTIVE, BASICALLY AN OVERVIEW OF IT, YOU KNOW, GIVING THE HISTORY OF THE MUNICIPAL DRAINAGE, UTILITY FEE BRIEF, UH, DESCRIPTION OF THE BASIS OF HOW IT'S, UH, THE UTILITY FEE IS CALCULATED.
UM, STATEMENT TO AMEND THE ORDINANCE, TO GRANT THE FEE CREDITS, YOU KNOW, AND THE PURPOSE OF IT.
AND THEN THE SECOND, THE SECOND, UM, SECTION WOULD BE ALL YOUR DEFINITIONS, YOU KNOW, YOUR BEST MANAGEMENT PRACTICE, DEFINITION OF IMPERVIOUS AREA, THINGS LIKE THAT.
TYPICAL DEFINITIONS THAT WOULD, THAT WOULD SUPPORT THE, THE POLICY.
THEN, UM, ON THE NEXT ONE, ITEM THREE WOULD BE THE ELIGIBILITY.
THIS WOULD BE FOR NON-RESIDENTIAL PROPERTIES ONLY.
SINCE THE RESIDENTIAL PROPERTIES ARE REALLY, THERE'S NOT ANYTHING THAT THEY CAN REALLY IMPLEMENT ON A GRAND BASIS TO ACTUALLY GET A CREDIT.
AND, UM, AND, AND SINCE THEIR FEES ARE AROUND FIVE, ON AN AVERAGE OF $5, IT'S, IT WOULD TAKE A SUBSTANTIAL AMOUNT OF MONEY PROBABLY TO PUT SOME, TO IMPLEMENT SOMETHING ON THEIR OWN PROPERTY.
BUT, UM, ADMINISTRATION OF THE PROGRAM, UH, THE RESPONSIBILITY KNOW, ENGINEERING OVERSEEING THE PROGRAM AND THE APP, APPLICATION OF REVIEWS, CERTIFICATIONS AND INSPECTIONS, ANNUAL REVIEWS, UM, THEY WOULD'VE TO SUBMIT FOR ANY, UM, THEY WOULD HAVE TO, WE WOULD REQUIRE, LIKE FRISCO DOES AND SOME OF THE OTHERS, THE APPLICANTS TO REAPPLY EVERY YEAR FOR THE CREDIT.
UM, THAT IT WOULDN'T JUST BE A GIVEN AND THAT ANY SELF-REPORTING WOULD HAVE TO BE DONE AT THAT TIME.
AS WELL AS, UM, IF THEY REAPPLIED, IF THERE WAS A CITY INSPECTION REQUIRED, THEN THE CITY WOULD GO OUT AND PROVIDE THE INSPECTION AT THAT TIME AS WELL.
BUT THEY WOULD, IT WOULD BE UPON THE, THE APPLICANT TO REAPPLY.
THE CITY WOULDN'T SEND OUT A NOTICE TO REMIND THEM, HEY, IT'S, IT'S ABOUT TIME.
IT WOULD, THEY WOULD HAVE TO, ON THEIR OWN ACCORD, SUBMIT TO THE CITY FOR, FOR, UM, REAPPLICATION.
AND THEN THE APPLICATION PROCESS.
APPLICANTS WOULD SUBMIT FORMS FOR CREDITS AT NO COST.
CITY BEARS THE ADMINISTRATIVE COSTS, CITY TIME TO DO THIS, YOU KNOW, A COUPLE HOURS TO JUST INTAKE AND REVIEW THE FORMS AND MAKE SURE THAT EVERYTHING'S COMPLETED.
THEN, UH, MODIFICATIONS, UM, PROGRAM CAN BE MODIFIED BY THE CITY AT ANY TIME.
WE GIVE OURSELVES THE RIGHT TO DO THAT.
THE REVIEW TIMELINE REVIEWS COMPLETED WITHIN 60 DAYS.
A LOT OF TIMES THESE WOULD BE ALONG WITH A SUBMITTAL OF YOUR TYPICAL, UM, PROP, YOUR PROJECT DEVELOPMENT PLANS.
THAT'S MOST OF THE TIME WHEN PEOPLE WOULD PUT THIS IN AS A VOLUNTARY, THEY MIGHT COME BACK AND WANNA DO SOMETHING LIKE THIS IF THEY WERE ADDING ANOTHER ADDITION TO A BUILDING OR SOMETHING.
BUT MOST LIKELY IT WOULD BE AT THE VERY BEGINNING, UH, OF THE DEVELOPMENT AND, UM, TO MAKE SURE THAT EVERYTHING COMPLIES AND, AND WORKS WITH THE SITE AND THE GRADING.
UH, TYPICALLY THE REVIEW WOULD TAKE WITH 60 DAYS TYPICALLY.
AND THEN, UM, ANY DEFICIENCIES NOTICE SENT IF NECESSARY.
SO TIME TO REVIEW THIS, IF IT'S A DETENTION POND AND SIZING THE DETENTION POND AND THAT TYPE OF THING.
AND MAKING SURE THAT IT'S SIZED APPROPRIATELY.
UH, ABOUT 10 TO 18 HOURS TO GO THROUGH THIS REVIEW PROCESS.
GO OUT TO THE SITE, LOOK AT THE SITE, MAKE SURE THAT WE

AGREE WITH WHAT THEY'RE, WHAT THEY'RE, WHAT THEY'RE PROPOSING, AND THEN ALSO REVIEWING THE CALCULATIONS OF THE DETENTION POND.UH, IF IT'S A STORM SCEPTER OR ANY OTHER BMP, THESE MAY NOT TAKE AS LONG TO REVIEW, UM, BUT WE'D STILL HAVE TO HAVE CALCULATIONS PROVIDED FOR BY THE, BY THE ENGINEER AND THE MANUFACTURER OF THE, OF THE BMP.
IF IT'S A STORM SCEPTER OR ANY OTHER DEVICE, UM, ENGINEERING DOCUMENTATION, PROFESSIONAL ENGINEERS, YOU KNOW, MAY BE REQUIRED TO DOCUMENT THE BMP COMPLIANCE IN IMPERVIOUS AREAS SERVED BY THE BMPS.
UH, IF, IF IT'S A LARGE SITE AND ONLY PART OF IT'S GOING TO THE BMP AND THE OTHER SITES BEING DISCHARGED OUT, THE DRIVE APPROACHES AS THEY USUALLY DO, THEN THAT WOULD HAVE TO BE ALL ACCOUNTED FOR.

GOING TO THE BMP, UM, INSPECTIONS, RIGHT OF ENTRY CITY WOULD HAVE THE RIGHT TO INSPECT THE PROPERTIES, APPLYING FOR CREDITS TO VERIFY COMPLIANCE.
UH, TYPICALLY THAT TAKES ABOUT A COUPLE, TWO TO THREE HOURS TO GO OUT, VISIT THE SITE, INSPECT IT, AND THEN COME BACK, WRITE UP THE REPORTS, UH, NOTICES THE NON-COMPLIANCE ISSUED.
IF BMPS ARE NOT IN ACCORDANCE WITH THE PROGRAM, UH, USUALLY AN HOUR TO CRAFT AN EMAIL AND, AND NOTE, NOTE ALL THE NON-COMPLIANCE REQUIREMENTS AND, AND SUBMIT IT TO THE, TO THE APPLICANT.
ITEM NINE, RENEWAL OF THE APPLICA APPLICATION.
AGAIN, THIS IS GONNA BE UP TO THE APPLICANT TO RENEW AND, AND SUBMIT THEIR, THEIR REQUEST TO RENEW CREDITS MUST BE RENEWED ANNUALLY.
CITY WILL NOT SEND A REMINDER NOTICE.

UH, IF IT'S, IF IT'S A DETENTION POND THAT THE CITY'S REQUIRED TO GO OUT AND INSPECT OR, OR WE GO AND INSPECT, UH, WE'LL, WE'LL WRITE UP THE ANY, I GUESS, UH, NON-COMPLIANCE ISSUES IF THEY'RE, IF THEY HAVEN'T MAINTAINED IT.

AND THEN, UH, TYPES OF CREDIT, UH, GETTING DOWN TO THE, TO THE, THE NUTS AND BOLTS OF IT.
NON SINGLE FAMILY RESIDENTIAL PROPERTIES.
MAXIMUM TOTAL CREDIT PER PROPERTY WOULD BE 50%.
THIS WOULD BE, I HAVE A CHART, A, YOU KNOW, TABLE ONE SHOWS, UM, PARKING LOT SWEEPING CREDIT DETENTION POND, ZERO DISCHARGE CREDIT, PERMANENT STRUCTURAL CON CONTROLS CREDIT.

I MEAN, THERE HAVE BEEN A FEW THAT WE'VE HEARD THROUGH OTHER CITIES THAT, UM, SOME PEOPLE HAVE ESTABLISHED GREEN ROOFS ON THEIR, ON THEIR BUSINESSES.
I DON'T KNOW HOW THAT TRULY WORKS.
WE'VE NEVER HAD A REQUEST FOR THAT IN GARLAND AND IT'S NOT PART OF OUR TYPICAL BMPS IN GARLAND.

SINCE WE'D HAVE TO GO OUT TO THE SITE AND VISIT THE SITE, YOU HAD A FEW MORE HOURS IN THERE, TWO TO FOUR HOURS.
UM, NOTICE OF NON-COMPLIANCE, THIS WOULD BE A VISUAL INSPECTION OF NON-COMPLIANCE AS WELL AS, AS IF THEY DIDN'T PROVIDE THE CORRECT DOCUMENTATION, WE WOULD'VE TO GET BACK IN TOUCH WITH THEM FIGURING BACK AND FORTH.

OKAY, SO, SO AS WE, AS WE MENTIONED THAT THIS ORDINANCE WOULD BE A VOLUNTARY, SO IF THEY'RE, IF THEY'RE PROPOSING A DETENTION POND BECAUSE THEY VOLUNTARILY PROPOSE IT, UM, THAT DOES TAKE SOME TIME.
'CAUSE WE GOTTA MAKE, WE, WE, WE GOT TO, WE HAVE TO MAKE SURE THAT THEY ARE DESIGNED APPROPRIATELY FOR THE AREA THAT THEY'RE DRAINING TO.
SO WE DOUBLE CHECK ALL THEIR CALCULATIONS MM-HMM
SO WE DO GO THROUGH THAT AND WE HAVE A PROCESS TO DO THAT.

AND THE DETENTION POND IS BUILT ACCORDINGLY OR SIZED ACCORDINGLY.

AND THEN ANY KIND OF WATER QUALITY FEATURES THAT ARE AT THE END OF THAT, UM, DETENTION POND.
THERE'S, THERE'S A SAND EMBEDMENT, THERE'S THE FILTERING SYSTEM AND, AND THE, AND THE CATCH FOR THE TRASH AND EVERYTHING ELSE.
ALL THAT WOULD HAVE TO BE IN, IN, IN AND REVIEWED AND MAKE SURE THAT IT'S ALL IN COMPLIANCE AS WELL.
SO YES, IF IT'S ALL BY BEING PART OF THE SAME PLAN, IT'S, IT'S ALL ENVELOPED INTO THAT.

IT, IT FORCES THE WATER DOWN INTO A CONTAINMENT AREA UNDERNEATH.
SO IT'S A REALLY DEEP MANHOLE FORCES THE WATER DOWN AND YOUR SILT AND IT, AND IT SPINS, YOUR SILT SETTLES OUT, YOUR OILS RISE.
AND THEN THERE'S A, THERE'S ANOTHER PIPE BELOW THAT THAT FORCES THE WATER BACK UP AND OUT THE PIPE.
SO IT FILTERS ALL THAT OUT AND FORCES IT OUT.
SO IT'S ACTUALLY A GREAT FILTRATION DEVICE.
SO FOR SMALL STORMS, LIKE WE HAD THIS LAST WEEKEND, THESE LITTLE SLOW SOAKING RAINS, THEY WORK WONDERFULLY.
IF YOU HAVE A FOUR INCH RAIN IN AN HOUR, IT DOES HAVE A BYPASS WHERE SOME OF IT WILL STILL FLOW OUT.
BUT THEY ARE A, A VERY GOOD MECHANISM FOR SEPARATING OUT SILT AND OILS OUT OFF OF PARKING LOTS.
BUT, BUT THEY'RE VERY, THEY COULD BE TO INSTALL ONE OF THOSE CAN BE, I WAS LOOKING UP PRICING JUST ONLINE ANYWHERE FROM 10 TO 30, 40,000 DEPENDING ON HOW BIG OF AN AREA YOU'RE DRAINING TO IT.
AND SO THERE, THERE'S THE INITIAL COST, WHICH I THINK IS SOMETIMES PROHIBITIVE IF PEOPLE ARE LOOKING AT IT FROM A VOLUNTARY STANDPOINT.
AND THEN PROBABLY ONCE A YEAR YOU WOULD AT LEAST HAVE TO PUMP IT OUT ONCE A YEAR TO REMOVE THE SEDIMENT AND OIL OUT OF IT, OUT OF THE CONTAINMENT VESSEL.
UM, IF IT, IF YOU GET AN AIR, YOU KNOW, A YEAR THAT YOU DON'T HAVE A LOT OF RAIN, YOU MAY NOT HAVE TO CLEAN IT OUT IN THAT ONE YEAR.
BUT TO SELF-REPORT SOMETHING LIKE THAT BACK TO THE CITY, 'CAUSE THAT'S NOT SOMETHING THAT WE CAN GO PULL THE LID AND LOOK DOWN INTO ONE.

AND, AND SO UNLESS YOU, THEY HAD SOME KIND OF A ROD TO STICK DOWN IN THERE THROUGH ALL THE SILT TO FIGURE OUT HOW DEEP IT IS ALL GAS STATIONS AND, AND THEY COULD BE 20, 30 FEET DEEP IN SOME CASES DEPENDING ON HOW BIG THEY ARE.
SO THAT WOULD HAVE TO BE SELF-REPORTED INTO SELF-REPORT.
YOU WOULD HAVE TO LEAST CLEAN IT OUT ONCE A YEAR.
AND YOU WOULD HIRE A COMPANY TO COME WITH A VAC TRUCK, VACUUM IT ALL OUT AND GET ALL THE SILT AND EVERYTHING OUT OF THEM.
BUT, BUT PEOPLE PUT THOSE IN BECAUSE THEY'RE A MUCH MORE CONFINED SPACE THAN A LARGE DETENTION POND.

SO A A A LOT OF DEVELOPERS ARE, ARE MOVING WHEN, WHEN THEY'RE REQUIRED TO HAVE TO, YOU KNOW, IT DOESN'T TAKE THE PLACE OF DETENTION.
BUT IF PEOPLE ARE LOOKING FOR WATER QUALITY FEATURES, THEY'LL PUT THOSE ON THERE.
ALRIGHT, SO THIS WOULD BE ALL THESE THINGS THAT WE WERE TALKING ABOUT.
IDEALLY IT WOULD BE FOR MAJOR PROJECTS, NEW PROJECTS, REMODELS, THINGS OF THAT NATURE.
UH, SOMETHING LIKE IF CRAFT WANTED TO BUY THE PROPERTY NEXT DOOR AND BUILD A BRAND NEW BUILDING OVER THERE, THEY WOULD ADD THESE TYPES OF THINGS.
BUT I AGREE THAT IF, THAT, IT SOUNDS GREAT BUT, UH, DOESN'T SOUND VERY PRACTICAL TO IMPLEMENT AT THE MOMENT AS FAR AS HAVING A STORM WATER CREDIT.
