FEBRUARY 23RD, 2022, DCA INDICATED A CHANGE IN OWNERSHIP TO THE CURRENT OWNERS.

AND IN JUNE AND SEPTEMBER OF 2022, THE CODE COMPLIANCE CONTRACTOR MOWED THE PROPERTY.

IN OCTOBER OF THE SAME YEAR, CODE COMPLIANCE CONTRACTOR BOARDED SEVERAL WINDOWS AND DOORS TO SECURE THE PROPERTY.

AND THEN IN FEBRUARY OF 2023, CODE COMPLIANCE CONDEMNED THE PROPERTY.

AT THAT TIME OF THE CONDEMNATION, THE, UH, ELECTRICAL SERVICE CONDUCTOR WAS ATTACHED TO THE POLE AND WAS LAYING ACROSS THE PARKING LOT FOR SAFETY REASONS.

CODE COMPLIANCE REQUESTED THAT IT BE REMOVED AND GPNL REMOVED THE ENTRANCE CONDUCTOR.

THESE PICTURES WERE TAKEN AT THE TIME OF THE CONDEMNATION ON FEBRUARY 24TH, 2023.

THE TIMELINE BEGINS AGAIN AT AUGUST OF 2023 WHEN OUR CONTRACTOR, AGAIN BOARDED THE WINDOWS AND DOORS TO SECURE THE PROPERTY.

THEN ON, ON OCTOBER 10TH, 2023, SCOTT INGER, WHO WAS A PART OF THE OWNERSHIP GROUP, PRESENTED A DETAILED PLAN TO THE GARLAND CITY COUNCIL.

THE PLAN INCLUDED DEMOLISHING THE EXISTING STRUCTURE AND CONSTRUCTION OF A SENIOR INDEPENDENT LIVING CENTER.

A WEEK LATER ON OCTOBER 17TH, 2023, THE GARLAND CITY COUNCIL APPROVED AN ORDINANCE TO AMEND THE GDC, CHANGING THE ZONING FOR THE PREMISES AND APPROVING THE DETAIL PLAN TO DEMOLISH THE EXISTING STRUCTURE AND BUILD AN ELDER CARE INDEPENDENT LIVING FACILITY.

IN JANUARY OF THIS YEAR, CODE COMPLIANCE SECURED THE PROPERTY AGAIN IN MAY OF 2024.

GPNL REMOVED ALL EXISTING ELECTRICAL FACILITIES FROM THE PREMISES TO PREPARE, PREPARE FOR DEMOLITION OF THE STRUCTURE.

JUNE 5TH, 2024, AND AGAIN, IN JULY OF 2024, THE CO COMPLIANCE CONTRACTOR REMOVED TRASH AND DEBRIS AND MOWED THE PROPERTY.

THEN ON JULY 9TH, 2024, CODE COMPLIANCE STAFF CONDUCTED A WARRANT INSPECTION OF THE PREMISES TO DETERMINE IF ANY REPAIRS HAD BEEN DONE SINCE THE TIME OF THE CONDEMNATION, AND TO ASSESS THE INTERIOR CONDITION OF THE PROPERTY.

THE FOLLOWING PICTURES ARE FROM THAT WARRANT INSPECTION.

THESE THREE SHOW THE UNSANITARY CONDITIONS OF THE INTERIOR.

THE, THE PICTURE ON THE LEFT IS TYPICAL OF MOST OF THE HALLWAYS.

UH, THE CEILING HAS EITHER BEEN PULLED DOWN OR HAS FALLEN DOWN, AND THE INSULATION IN THE CONTENTS OF THE ATTIC ARE WITHIN THE, UH, LIVING QUARTERS OF THE, OF THE PROPERTY.

THE PICTURE IN THE MIDDLE IS TYPICAL OF SOME OF THE ROOMS THERE.

THERE'S A LOT OF DEBRIS FROM THE PROPERTY ITSELF AND ALSO BROUGHT IN FROM OUTSIDE THE PROPERTY TO BE LEFT.

INSIDE THESE PICTURES SHOW SOME OF THE STRUCTURAL DAMAGE AT THE PROPERTY.

THE PICTURE ON THE FAR LEFT IS AT THE FRONT DRIVE OF THE PROPERTY.

A BEAM APPEARS TO HAVE BEEN STRUCK BY A VEHICLE AND IS KNOCKED ALMOST TO THE EDGE OF THE SUPPORTING COLUMNS.

BELOW IT, PICTURE IN THE MIDDLE IS SOME OF THE, UH, CEILING STRUCTURE THAT HAS FALLEN.

THE PHOTO ON THE RIGHT IS A CORNER OF A CINDER BLOCK WALL, AND AT THE TOP OF THIS WALL, THE CINDER BLOCKS ARE STARTING TO PULL APART.

THESE PICTURES ALSO TAKEN JULY 9TH, 2024, SHOW THE DAMAGE TO THE ELECTRICAL SYSTEM.

UH, THE, THE UNINSULATED PART OF THE CONDUCTOR IS READILY ACCESSIBLE.

AND THEN THE LIGHT FIXTURE THAT'S BEEN PULLED FROM ITS FIXTURE AND IS, UH, HANGING FROM THE WIRES, SEVERAL OF THOSE THROUGHOUT THE BUILDING.

THESE PICTURES WERE TAKEN OF THE PLUMBING SYSTEM AT THE EXTERIOR.

ON THE, ON THE LEFT PICTURE THERE, YOU'LL SEE AT THE EXTERIOR SOME OPEN, UH, SEWER CLEANOUTS.

AND THE OTHER TWO PICTURES ARE FROM THE INTERIOR WHERE SOME OF THE WASTE PLUMBING HAS BEEN PULLED OUT.

AND THE, UH, SEWER GASES ARE ESCAPING INTO THE INSIDE OF THE STRUCTURE.

THIS IS TYPICAL THROUGHOUT THE STRUCTURE WITH SEVERAL DOORS OPEN.

UH, SOME OF THEM HAD BEEN SECURED IN THE PAST AND ARE OPEN AGAIN.

AND THEN ALSO BROKEN WINDOWS WITH GLASS SHARDS AND JUST SOME WINDOWS THAT ARE, ARE JUST OPEN TO THE EXTERIOR.

THESE PICTURES SHOW INDICATIONS OF ILLEGAL OCCUPATION OF A CONDEMNED STRUCTURE.

THE PICTURE ON THE LEFT IS A PILLOW, SOME PERSONAL BELONGINGS AND BLANKETS FROM SOMEONE HAD BEEN, LOOKS LIKE SOMEONE HAD BEEN SLEEPING THERE.

THE PICTURE IN THE MIDDLE IS OF FOOD, UH, AND DRINKS THAT WERE SET OUT, THAT'S, THAT'S BREAD.

THERE WAS NO MILDEW OR MOLD ON THE BREAD.

IT LOOKS TO HAVE BEEN LEFT THERE, UH, RELATIVELY SHORTLY BEFORE WE DID OUR INSPECTION.

AND THE PHOTO ON THE RIGHT IS ANOTHER SPOT WHERE SOMEONE HAD BEEN EATING, UH, PIZZA AND TWINKIES AND SMOKING CIGARETTES AND HAD SOME OTHER PARAPHERNALIA LAYING AROUND.

THESE PICTURES SHOW SOME OF THE FAILING WEATHER PROTECTION.

THESE ARE TWO, TWO SEPARATE HOLES IN THE ROOF.

THE HOLES GO ALL THE WAY THROUGH TO THE INTERIOR AND CONTI CONTINUING THE TIMELINE.

AFTER THE INSPECTION IN AUGUST, AND THEN AGAIN IN SEPTEMBER OF THIS YEAR, CODE COMPLIANCE, REMOVE TRASH AND DEBRIS AND MOWED THE PROPERTY.

AND THEN ON DECEMBER 9TH, 2024, THE CITY OF GARLAND ECONOMIC DEVELOPMENT STAFF HAD A VIRTUAL MEETING WITH THE MEMBERS OF THE OWNERSHIP OF THE PREMISES.

THEY'RE STRUGGLING TO UC, STRUGGLING TO SECURE FUNDING TO DEMOLISH THE STRUCTURE AND INQUIRED ABOUT ASSISTANCE THE CITY COULD PROVIDE.

THE DEFICIENCY LIST FOR 5 0 5 WEST CENTERVILLE ROAD IS AN UNSECURED STRUCTURE.

IT'S OCCUPIED AND CONDEMNED AND DOES NOT HAVE UTILITY SERVICE.

IT'S UNSANITARY HAS STRUCTURAL DAMAGE, ROOF DAMAGE, DAMAGE TO THE ELECTRICAL SYSTEM, DAMAGE TO THE PLUMBING SYSTEM, BROKEN WINDOWS AND DOORS, AND DETERIORATED EXTERIOR SURFACES DUE TO LACK OF MAINTENANCE.

THE REQUIREMENTS TO COMPLY ARE THAT THE BUILDING MUST BE REPAIRED TO A HABITABLE CONDITION WITH REQUIRED PERMITS AND PASS FINAL INSPECTIONS BY THE BUILDING INSPECTIONS DEPARTMENT, OR BE DEMOLISHED WITH A PERMIT FROM THE

BUILDING INSPECTIONS DEPARTMENT.

IN THE MEANTIME, THE BUILDING MUST BE SECURED.

THE PREMISES MUST REMAIN FREE FROM TRASH AND DEBRIS, AND THE LANDSCAPING AND GRASS MUST BE MAINTAINED.

AND TO CLEAR UP CONFUSION, NOT THIS IS, THIS WOULD BE ACCEPTABLE IN THE SHORT TERM.

NO PERMITS HAVE BEEN OBTAINED TO DEMOLISH THE STRUCTURE, AND MANY VIOLATIONS OF THE CITY ORDINANCE REMAIN THESE ONGOING VIOLATIONS OF CAUSE OF THE SURROUNDING PROPERTIES TO SUFFER.

AND THE CODE COMPLIANCE DEPARTMENT HAS RECEIVED NUMEROUS COMPLAINTS.

CODE COMPLIANCE HAS HAD CONSTANT COMMUNICATION WITH THE OWNERS TO DIS DISCUSS REMEDY, HOWEVER, NO LONG TERM PROGRESS HAS BEEN MADE.

GARLAND CODE COMPLIANCE HAS ISSUED 18 MUNICIPAL COURT CITATIONS FOR FAILURE TO REPAIR A SUBSTANDARD BUILDING.

ON 11 OCCASIONS SINCE MAY OF 2020, THE CITY OF GARLAND CO COMPLIANCE DEPARTMENT HAS SECURED THE BUILDING MOWED AND REMOVED TRASH FROM THE PROPERTY.

THE STRUCTURE IS ALSO AN ATTRACTIVE NUISANCE TO HOMELESS IN THE AREA, EXCUSE ME.

AND WE BELIEVE THE, THE, UH, PREMISES TO BE OCCUPIED RANDOMLY BY VAGRANT WITHOUT UTILITY SERVICE.

THERE HAVE BEEN 92 CALLS FOR SERVICE TO THE GARLAND POLICE DEPARTMENT AT THE PROPERTY SINCE JANUARY, 2021.

MOST OF THESE CALLS WERE FOR SUSPICIOUS PERSONS RELATED TO HOMELESS ACTIVITY AND BURGLARY.

AND MR. CHAIRMAN, UH, OUR CI OUR ATTORNEY, WOULD LIKE TO SPEAK TO YOU ON BEHALF OF, UH, THE CITY ATTORNEY'S OFFICE AND SOME COMMUNICATION THAT THEY'VE HAD WITH REPRESENTATIVES OF THE PROPERTY RIGHT NOW.

THERE WAS A, A WAITING PERIOD FOR PEOPLE TO GET INTO IT.

AND, UH, IT WAS WELL MANAGED.

IT WAS, UH, THE EMPLOYEES WERE, UH, UH, VERY GOOD.

AND, UH, HOWEVER, I I WILL SAY THERE WERE A COUPLE OF OLD LADIES THAT, UH, LEFT THE FACILITY AND WOULD COME IN OUR YARD.

WE LIVED RIGHT NEXT TO THE FACILITY AND I LIKE THE GARDEN.

AND SO, UH, SEVERAL TIMES THEY PICKED MORE POTA, MORE POTATOES AND, AND, UH, UH, TOMATOES THAN I DID.

BUT, UH, UH, THAT, THAT'S HOW IT IS.

UM, HOWEVER, THE, AS THE OWNERSHIP CHANGED, THE FACILITY BEGAN TO DETERIORATE AND IT HAS BECOME TOTALLY DILAPIDATED.

UM, YOU KNOW, THERE ARE MAJOR, AS THE GENTLEMAN POINTED OUT, THERE ARE MAJOR PROBLEMS WITH THE ROOFING, WITH THE PLUMBING, WITH, WITH THE, UH, ELECTRICAL WORK.

AND THERE ARE RATS IN THERE BIGGER THAN CATS.

AS A MATTER OF FACT.

UM, THIS HAS BEEN ABOUT A COUPLE OF MONTHS AGO, A HUGE RAT WAS DEAD IN MY FRONT YARD AND, UH, I'M NOT A VETERINARIAN, BUT IT LOOKED LIKE IT DIED FROM OLD AGE.

SO, UH, THE, THE PLACE JUST REALLY, REALLY, REALLY NEED TO COME DOWN.

AND I, I POINT THIS OUT AND THIS, I KNOW SOMETHING ABOUT, UM, THE BUILDING WITH THE STRUCTURE OF IT.

AS, YOU KNOW, ANY LARGE BUSINESS THAT WOULD OCCUPY THAT BUILDING WOULD REQUIRE COMPUTERS TO BE USED

SO THAT BUILDING HAS OUTLIVED ITS TIME, THE TRUTH BE SAID.

'CAUSE A LOT OF WHERE THE CONCRETE IS, IS WHERE THE NEW STRUCTURES WOULD BE.

AND SO THEY WOULD HAVE TO PUT DOWN NEW FOUNDATIONS FOR THE NEW DEVELOPMENT.
