SO THAT'S 60 POUNDS LIGHTER THAN A GERMAN SHEPHERD. SO IF YOU WANT EVERYTHING OF A GERMAN SHEPHERD, MINUS THE GERMAN SHEPHERD PART, SHE HAS IT ALL. I WILL SAY, THOUGH, SHE DOESN'T SHED, SHE JUST DECORATES. SO IF YOU'RE LOOKING FOR THAT, SHE IS HEARTWORM NEGATIVE. AND SHE HAD HER SURGERY ON THE 20TH, SO SHE'S FULLY VACCINATED, SPAYED, MICROCHIPPED AND EVERYTHING. SHE IS ABOUT $25. IF YOU WANT TO COME CHECK HER OUT AT THE SHELTER. AND THEN TODAY, WE'VE BEEN WITH THE CAPRA REVIEW TEAM, WHICH THEY ARE RIGHT HERE BEHIND ME. THEY COME FROM THEY'RE COMING FROM ALL OVER MARYLAND, PORTLAND AND OHIO. SO WE ARE SUPER THANKFUL THAT THEY ARE HERE. THEY BRING IDEAS, BUT THEY ALSO BRING A GREAT WEALTH OF KNOWLEDGE. THERE WERE OTHER VIOLATIONS RELATED TO CALLS RELATED BURGLARY, THINGS LIKE THAT, BUT NOTHING THAT WAS DIRECTLY RELATED TO ALCOHOL SALE IN THE LAST FIVE PLUS YEARS.

THERE WAS ONE VARIANCE ISSUED RELATED TO ALCOHOL DISTANCE IN CLOSE PROXIMITY ON YOUR SCREEN.

YOU SEE IN THE PURPLE CIRCLE, THE YELLOW POINT OR THE ORANGE POINT IS OUR 3301, THE SUBJECT CASE FOR TONIGHT. AND YOU SEE, JUST SOUTHEAST OF IT, WE HAVE 3405 BROADWAY BOULEVARD, WHICH ALSO HAS AN ALCOHOL DISTANCE VARIANCE THAT WAS APPROVED BACK IN. IT WAS ACTUALLY BROUGHT BACK TO CITY COUNCIL TWICE. IT WAS ORIGINALLY APPROVED IN 2019. BUT THEN THERE WAS A NEW CEO ISSUED, NEW LICENSE ISSUED. SO IT WAS BROUGHT BACK TO CITY COUNCIL AGAIN. BUT IT WAS THE SAME ADDRESS. GENERALLY, WE DO NOT CONTACT THE SCHOOL DISTRICT SEPARATELY OTHER THAN THE NOTIFICATION LETTERS FOR THESE TYPE OF CASES, BUT BECAUSE THERE WERE QUESTIONS ABOUT IT, WE DID REACH OUT TO THEM LAST WEEK AND THEY ACKNOWLEDGED THAT THEY THEY ASKED AUT WHEN THE HEARING IS.

SO THEY'RE AWARE OF THAT. I'M NOT REALLY SURE IF THERE'S ANYONE IN HERE, BUT THEY DIDN'T SAY ANYTHING FOR OR AGAINST ABOUT THIS CASE. THOSE WERE KIND OF THE THREE AREAS WHERE WE WANTED TO PROVIDE ADDITIONAL INFORMATION. IF THERE'S ANYTHING ELSE AND THERE'S THERE ARE NO UPDATED RESPONSES. THERE WERE ONE RESPONSE LETTER AND THAT WAS FROM THE PROPERTY OWNER THEMSELVES LAST TIME. AND THAT IS THE SAME THIS TIME AS WELL. WITH THAT, I'M AVAILABLE FOR QUESTIONS. VERY GOOD. HOWEVER, THE MAJORITY OF THE REZONING AREA IS ON THE EAST SIDE OF SOUTH GARLAND AVENUE.

APPROXIMATELY 50 ACRES OF THAT 317 ACRES OF CITY CONTROLLED PARCELS, MOSTLY CLOSE TO SOUTH GARLAND AVENUE. THIS IS IN DISTRICT FIVE. AND AS YOU MENTIONED, THERE ARE MULTIPLE ZONING DISTRICTS IN THIS AREA, PREDOMINANTLY COMMUNITY RETAIL. WE CALL IT CR AND IN WHICH IS INDUSTRIAL. AND THERE PD'S AS WELL THAT HAVE THOSE BASE ZONING AS WELL. THE CURRENT COMPREHENSIVE PLAN HAS DIFFERENT MULTIPLE LAND USE DESIGNATIONS IN THIS GENERAL AREA. AS YOU CAN SEE ON THE SLIDE TOGETHER. SO THERE ARE BUSINESS TRANSIT ORIENTED CENTERS, URBAN NEIGHBORHOOD AND NEIGHBORHOOD CENTERS. SO TOGETHER THEY DO FORMULATE A VISION FOR URBAN SCALE MIXED USE BUSINESSES, TRANSIT AND PEDESTRIAN ORIENTED DEVELOPMENT, WHICH WE CAN ALL AGREE. THAT'S NOT HOW THIS AREA IS DEVELOPED AS TODAY. OUR STRATEGIC PLAN ALSO RECOGNIZED THIS AS A CATALYST AREA. THEN, OUR ONGOING COMP PLAN EFFORT HAS ALREADY INFORMED US THAT THIS AREA WOULD BE MARKED AND RIPE FOR REDEVELOPMENT AND REVITALIZATION. THESE STUDIES DO CLEARLY RECOGNIZE THAT IT IS A GATEWAY TO THE CITY AND HAS NOT REALLY BEEN DEVELOPED AS SUCH, AND THE PROPOSED URBAN BUSINESS AND URBAN RESIDENTIAL ZONING DISTRICTS ARE CAPABLE OF CREATING THAT VIBRANT PLACE THAT MIXED USE, PEDESTRIAN ORIENTED DEVELOPMENT WITH APPROPRIATE URBAN DESIGN IN PLACE. TRUCKS. AND IT'S ALSO TALKING ABOUT WANTING MORE OPTIONS FOR RESIDENTIAL. SO AGAIN, WHAT WE ARE PROPOSING, IT'S ALL COMING FROM THESE SURVEYS, THESE ENGAGEMENTS AND THESE INITIATIVES THAT WE TAKEN ON FOR SEVERAL YEARS. THE CURRENT COMPREHENSIVE PLAN, WE HAD DONE SEVERAL SURVEYS ON THAT. I'M SURE MANY OF THE RESIDENTS PRESENT HERE TONIGHT MAY HAVE PARTICIPATED IN THOSE AS WELL. AND IN THE SLIDE, YOU CAN SEE 54.9797% RESPONDERS HAD SAID OVERALL APPEARANCE AND APPEAL OF REVITALIZATION. REDEVELOPMENT IS SOMETHING CITY OF GARLAND SHOULD FOCUS ON. AND THAT IS EXACTLY WHAT WE ARE DOING WITH THIS REZONING EFFORT.

I KIND OF WANT TO DRAW A LITTLE BIT OF ATTENTION ON THE TRANSPORTATION COMPOPONENT. AS U ALL ARE AWARE, THERE ARE IMPROVEMENTS GOING ON FOR I-66 35. SO ONCE THAT'S DONE, ACCESS THROUGH SHILOH AND GARLAND AVENUE IS ANTICIPATED TO IMPROVE SIGNIFICANTLY. AND THAT CAN CONTRIBUTE A LOT IN CREATING THIS DESTINATION THAT THE CITY HAS ENVISIONED FOR SO LONG.

THERE ARE ALSO ONGOING DISCUSSIONS WITH DART ABOUT RELOCATING THE TRANSIT STATION IN ANOTHER SITE. THE CITY AND DART HAS HAVE AN INTERLOCAL AGREEMENT IN PLACE FOR A LAND SWAP FOR THAT PURPOSE, SO WHY YOU ARE AND UB WE JUST WENT OVER WHAT THOSE DISTRICTS ARE, BUT WE ALSO WANTED TO BRING IT UP WITH THIS CASE BECAUSE THAT IS RELEVANT, THAT THAT IS WHAT WE ARE, WE ARE PROPOSING. WE THOUGHT OF INCLUDING THIS, THIS PHOTO BECAUSE TO SIMPLY ILLUSTRATE WHAT THIS DISTRICTS ARE FOR AND WHAT THEY CAN ACHIEVE, THESE ARE TRULY OUR BEST ZONING DISTRICTS AVAILABLE FOR PLACEMAKING PURPOSES. SO EVERYTHING KIND OF JUST REALLY REQUIRES A LOT OF QUALITY PROJECTS THROUGH THROUGH THIS ZONING DISTRICTS. I DO WANT TO BRING UP WHAT THE CURRENT ZONING DISTRICTS ALLOW. SO AS YOU CAN SEE ON THE MAP, WE HAVE HIGHLIGHTED THE AREA WITHIN THE REZONING AREA, REZONING THAT ARE CURRENTLY ZONED EITHER INDUSTRIAL OR HAS AN INDUSTRIAL BASED ZONING. AND SEXUALLY ORIENTED BUSINESSES ARE CURRENTLY PERMITTED BY RIGHT IN INDUSTRIAL ZONING, OUTSIDE STORAGE IS PERMITTED BY RIGHT TRUCK, SLASH BUS, BUS WASH, CONCRETE BATCH PLANT, AUTO REPAIR, AUTO SALES. THOSE THINGS ARE PERMITTED BY RIGHT. SO THEY CAN, IF THEY WANTED TO GO IN THOSE PURPLE AREAS TODAY, THEY CAN COME IN. THEY DON'T EVEN HAVE TO COME BEFORE PLANNING COMMISSION, CITY COUNCIL OR ANYTHING. THEY CAN GO STRAIGHT TO PERMIT AND OBTAIN A PERMIT FOR THOSE USES IN THOSE AREAS.

IT ALSO ALLOWS MOTELS WITH SUPS AND SMOKE SHOPS WITH SUPS. AND AGAIN, THIS IS NOT A FULL BLOWN, BLOWN ROBUST LIST OF THINGS THAT ARE ALLOWED IN INDUSTRIAL AND CR. BUT WE WANTED TO POINT IT OUT SOME OF THE POTENTIAL USES THAT ARE CURRENTLY PERMITTED BY RIGHT IN THE CURRENT ZONING. WE ALSO WANTED TO COMPARE HOW THE SINGLE FAMILY NEIGHBORHOODS ARE GOING TO BE PROTECTED FAR MORE THROUGH ADJACENCY BETWEEN THE CURRENT ZONING AND THE PROPOSED ZONING. SO WHAT YOU SEE ON THE SLIDE CURRENTLY, THAT IS WHAT THE CURRENT ZONING WOULD REQUIRE. SO GENERALLY THERE ARE COMMUNITY RETAIL ZONING THAT ARE ADJACENT TO THE SINGLE FAMILY HOMES. AND CR ZONING HAS A 20 FOOT REAR YARD SETBACK. BUILDINGS COULD BE UP TO 35FT. SO THIS COULD BE POTENTIALLY ANY SITUATION WITH THE CURRENT ZONING. WITH THE PROPOSED ZONING. THIS IS WHAT WE'RE ENVISIONING 100 FOOT SETBACK FROM THE SINGLE FAMILY NEIGHBORHOOD FOR FURTHER PROTECTION OF THOSE NEIGHBORHOODS. AND THEN ON TOP OF THAT, ANYTHING THAT GOES BEYOND 35 FOOT IN HEIGHT WILL HAVE TO COMPLY WITH THE 45 DEGREE RESIDENTIAL PROXIMITY SLOPE. AS YOU CAN SEE ON THE SLIDE, IT'S A 45 DEGREE ANGLE THAT IS DRAWN FROM THE PROPERTY LINE, AND THE HEIGHT WILL HAVE TO HAVE TO GO WITH THAT TO NOT ALLOW MASSIVE BUILDINGS ANYWHERE CLOSER TO SINGLE FAMILY NEIGHBORHOODS. ON THE RIGHT HAND SIDE, WE HAVE THE PROPOSED ZONING IN MAROON. WE ARE SHOWING URBAN BUSINESS ZONING DISTRICT, WHICH IS MAJORITY OF IT IN ORANGE. WE ARE SHOWING URBAN RESIDENTIAL AND URBAN RESIDENTIAL IS WHAT'S GOING TO BACK UP TO THE SINGLE FAMILY NEIGHBORHOODS. WE HEARD A LOT OF QUESTIONS ABOUT NONCONFORMITY. SO ANYTIME WE'RE BECAUSE IT'S A CITY INITIATED REZONING AND IT IS REZONING, IT IS PROPOSING TO REZONE A LARGE AREA. THERE ARE CONCERNS ABOUT EXISTING BUSINESSES THAT ARE GOING TO BECOME NONCONFORMING. SO WE HAVE A LIST ON THE SCREEN THAT SHOWS GENERALLY WHAT THOSE USES ARE. AGAIN, AUTO ORIENTED AUTO REPAIR, MAJOR MINOR AUTO SALES, BUS STORAGE, THINGS LIKE THAT. WE HAVE LOW IMPACT COMMERCIAL HOTEL, MOTEL, DRIVE THROUGH STORAGE FACILITIES, DISTRIBUTION CENTERS, THINGS LIKE THAT. SO WE GOT EVER SINCE WE HAD WE HAVE INITIATED THAT. WE HAVE GOTTEN A LOT OF QUESTIONS REGARDING NONCONFORMITY, AND I DID WANT TO GO AHEAD AND ADDRESS THOSE DURING THIS PRESENTATION. SO THE FIRST QUESTION THAT WE ALWAYS GET IS, OH, WHAT WHAT'S GOING TO HAPPEN TO MY BUSINESS IF I BECOME NON-CONFORMING? SO ANYTHING THAT'S OPERATING TODAY CAN CONTINUE OPERATING OPERATION AS IS, BUT THEY MAY NOT BE ABLE TO EXPAND THEIR BUILDING FOOTPRINT IN THE EVENT OF FIRE OR ANY OTHER ACTS OF NATURE. TORNADO. WE DID LOOK INTO SOME CASE STUDIES BECAUSE WE WANTED TO SHOW HOW SOME OTHER CITIES IN THE METROPLEX, WE'RE NOT THE ONLY ONES WHO HAVE TAKEN THIS KIND OF INITIATIVE FOR THE BETTERMENT OF OUR CITY. SO FORT WORTH, NEAR SOUTH SIDE, THEY IN 2008 WENT AHEAD AND REZONED 1400 ACRES. THEIR ENTIRE ZONING DISTRICTS NAME IS FORM BASED NS, WHICH STANDS FOR NEAR SOUTH SIDE. SO THEY HAVE THEIR OWN DISTINCT, DISTINCT ZONING DISTRICT FOR THAT 1400 ACRES. AND SINCE 2008 THAT HAS ATTRACTED OVER 1 BILLION IN PUBLIC AND PRIVATE INVESTMENT. AND ANG WITH HUNDREDS OF NEW BUSINESSES THAT ARE REALLY QUALITY, QUALITY PROJECTS. BUT PLANO LEGACY WEST, APPROXIMATELY 240 ACRES WERE REZONED IN 2010, AND THEY WERE REZONED TO A LEGACY WEST ZONING OVERLAY DISTRICT, AND THAT HAS ATTRACTED OVER $3 BILLION IN PRIVATE PRIVATE INVESTMENT SINCE 2010. RICHARDSON CITY LINE IS APPROXIMATELY 186 ACRES. THEY WERE REZONED TO SUPPORT MIXED USE DEVELOPMENT AND HAS ATTRACTED OVER $2.5 BILLION IN PRIVATE INVESTMENT SINCE 2013, AND 75 MILLION IN PUBLIC INVESTMENT. WE. THE LAST EXAMPLE I HAVE IS FOR ADDISON, THE VITRUVIAN AREA. IF YOU HAVE BEEN, IT'S REALLY PRETTY APPROXIMATELY 117 ACRES. THEY WERE REZONED TO MIXED USE ZONING WITH PUBLIC OPEN SPACE REQUIREMENTS AND PEDESTRIAN ORIENTED STREET AND BLOCK LAYOUT. THAT WAS ALSO DONE IN 2008, AND THEY HAVE ATTRACTED OVER 1 BILLION IN PRIVATE INVESTMENT SINCE 2008, WITH PUBLIC INVESTMENT BEING AROUND 40 MILLION. WE I WANTED TO HAVE THIS QUOTE FROM ONE OF OUR ONE OF OUR SMALL AREA PLANS IDENTIFYING THIS CATALYST AREA.
