SO LET'S GET STARTED WITH OUR FIRST ITEM, WHICH IS APPROVAL OF THE MINUTES FROM, UH, LET'S SEE, WHICH, WHEN WAS THAT MEETING? FEBRUARY 19TH, 2025.

THIS IS A SCOPING DISCUSSION.

THIS WAS REFERRED BY COUNCIL MEMBER DUTTON AND A SECOND BY COUNCILMEMBER WILLIAMS AT THE AUGUST 18TH WORK SESSION.

UM, WE JUST WANNA KIND OF KICK THINGS OFF WITH HAVING A REALLY GOOD UNDERSTANDING OF THE ITEM.

SO WE'LL LEAD WITH, UM, BOTH ON THIS ITEM IN THE NEXT WITH WHAT PROBLEM ARE WE TRYING TO SOLVE, AND THEN IF YOU CAN SHARE EXAMPLES OF IF YOU'VE SEEN ANYTHING OUT IN THE COMMUNITY, UM, TO SHARE.

AND OF COURSE WE'VE GOT FOLKS LINED UP TO HELP SCOPE THIS OUT, BUT IF YOU COULD LAY THAT FOUNDATION FOR THIS DISCUSSION, THAT'D BE REALLY HELPFUL.

SO THIS, UM, IS ACTUALLY WAS BROUGHT ON BY AN OVERABUNDANCE OF TRAFFIC CONTROL DEVICES ALSO, UM, AKA, THE ORANGE CONES OF DEATH, UM, THAT YOU WILL SEE LITTERING THE CITY.

UM, THERE'S CURRENTLY ON SOUTHBOUND SHILOH AT BUCKINGHAM FOUR BARRELS THAT HAVE BEEN SHOVED OVER INTO THE GRASSY AREA FOR PROBABLY FOUR OR FIVE MONTHS NOW.

UM, AND THAT IS A WIDESPREAD PROBLEM THROUGH THE CITY.

UM, TONY AND I HAVE HAD THIS CONVERSATION BEFORE AND SOMETIMES I KNOW THE ISSUE IS NOT EVEN THAT IT'S OUR, UM, OUR CONES IT, FROM WHAT I HAVE SEEN, IT TYPICALLY IS NOT THE CITY THAT'S LEAVING THEM.

IT IS CONTRACTORS AND ATMOS THAT WILL GO AND DO WORK AND THEN THEY JUST LEAVE ALL OF THEIR ORANGE GOODNESS ALL OVER THE CITY.

SO, UM, THAT, THAT WAS WHAT SPARKED THIS, UM, BETWEEN LEAVING THEM AT POST-CONSTRUCTION AND THEN PUTTING THEM OUT LONG BEFORE CONSTRUCTION BEGINS.

UM, I THINK WE'VE ALL SEEN AREAS THROUGH TOWN WHERE YOU'LL SEE SIGNS THAT ARE LIKE RIGHT LANE CLOSED, THE RIGHT LANE'S NOT CLOSED.

IT'S NOT, IT HASN'T BEEN FOR MONTHS AND IT'S NOT GOING TO FOR MORE MONTHS.

SO IT, IT MAKES IT LOOK LIKE WE ARE ALWAYS UNDER CONSTRUCTION IN THE ENTIRE CITY WHEN WE'RE NOT.

AND SO I WOULD REALLY LOVE TO SEE THAT GET CLEANED UP AND IN A TIMELY MANNER.

AND, AND I KNOW THAT IT'S, IT'S NOT OUR CRUISE 'CAUSE I WATCH LIKE A HAWK.

IT'S MY HYPER FOCUS, UH, FOR THE LAST SIX MONTHS.

UM, BUT I, I THINK IF WE HAD SOME SORT OF, PROBABLY NOT AN ORDINANCE, BUT SOMETHING IN OUR CONTRACTS WITH PEOPLE THAT ARE LIKE YOUR CONES HAVE TO BE LABELED WITH WHO THEY BELONG TO, UM, THEY HAVE TO BE PICKED UP WITHIN A CERTAIN AMOUNT OF TIME.

YOU CAN'T PUT THEM OUT MORE THAN A WEEK PRIOR TO CONSTRUCTION.

UM, WE, I,

MARGARET CAN ATTEST TO THE CONE FIASCO THAT WE HAD OR THE TRAFFIC CONTROL DEVICE FIASCO THAT WE HAD.

UM, GOING DOWN MILLER AT GARLAND ROAD AND SATURN WHERE IT WAS THE SAME COMPANY BUT ON THIS SIDE OF THE ROAD, WHOEVER WAS IN CHARGE OF THE CONES WENT ABOVE AND BEYOND TO THE POINT WHERE IT WAS CONFUSING, YOU DIDN'T KNOW WHERE YOU WERE GOING, THEN YOU CROSSED OVER GARLAND ROAD AND THERE'S, THEY, I DON'T THINK THAT THEY KNEW WHAT THEY WERE DOING WITH CONES, SO PEOPLE WERE DRIVING OFF INTO A REBAR.

SO THAT'S KIND OF THE BASIS OF THIS REQUEST.

WITH THAT, UM, CAN ANYONE COME UP AND HELP SCOPE OUT WHERE WE MIGHT LOOK TO REVIEW POLICIES IN PLACE AND TALK ABOUT NEXT STEPS? AND I, I'M JUST GONNA, UH, SAY YOU'RE WELCOME IN ADVANCE TO EVERYONE.

UM, THERE ARE DEFINITELY SOME VALID POINTS THAT YOU MADE TODAY SPECIFICALLY ABOUT, UM, WHEN TRAFFIC CONTROL DEVICES ARE PUT OUT, HOW THEY'RE BEING MANAGED.

UM, AND THAT IS AN ONGOING DISCUSSION THAT WE ARE HAVING WITHIN THE DEPARTMENTS.

I LIKE TO BRING Y'ALL ALL THE, THE RANDOM WEIRD STUFF.

THIS ONE, THIS ONE.

I, I'VE BEEN LOOKING FORWARD TO THIS.

ALRIGHT, SO THE, THE PORTA POTTY, UM, THERE WERE TWO INSTANCES, INSTANCES THAT, UM, BROUGHT THE PORTA POTTY SITUATION TO LIGHT.

THE FIRST ONE WAS AGAIN OFF OF MILLER AND GARLAND SATURN AREA.

UM, THE CRUISE HAD FINISHED CONSTRUCTION COMPLETELY AND JUST MOVED THEIR PORTA-POTTY DOWN MILLER ON THE SIDEWALK.

AND THERE'S ZERO CONSTRUCTION HAPPENING.

THERE'S JUST A RANDOM PORTA-POTTY ON THE SIDEWALK.

SO THAT WAS THE FIRST, FIRST, UM, THE FIRST INSTANCE WHERE IT WAS JUST LIKE, WHAT? LIKE YOU PICKED UP ALL OF YOUR TRAFFIC CONTROL DEVICES AND NOW WE HAVE A PORTA-POTTY.

IT WAS VERY WEIRD.

IT WAS, UH, YEAH, IF MY CAR CAN'T BLOCK A SIDEWALK, YOUR PORTA-POTTY ALSO CANNOT BLOCK THE SIDEWALK.

IN MY OPINION.

IT, IT WAS A LITTLE ODD.

THE SECOND WAS OFF OF BUCKINGHAM BETWEEN JUPITER AND SHILOH, UM, OVER, I GUESS BY THE ENTRANCE OF THAT OAK RIDGE SUBDIVISION.

THERE'S A LIGHT RIGHT THERE, I CAN'T REMEMBER WHAT IT IS, BUT KIND OF LIKE POTOMAC, BUT CLOSER WEST.

UM, THEY HAD TWO PORTA-POTTIES FOR VERY MINOR.

IT WAS A VERY MINOR CONSTRUCTION ZONE, UM, WHERE THEY WERE CUTTING OUT A PANEL OF CEMENT, UM, IN THE ROAD.

AND THERE WERE TWO PORTA-POTTIES WITHIN LIKE 200 FEET OF EACH OTHER AND

WAY OUTSIDE OF WHERE THEY WERE EVEN DOING CONSTRUCTION BOTH ALSO ON THE SIDEWALK.

SO IT, IT WAS JUST KIND OF, WE'VE MADE SO MANY EFFORTS AND IN, OR WE'RE IN THE PROCESS OF SO MANY DIFFERENT EFFORTS IN CLEANING UP OUR CITY AND GIVING A BETTER LOOK ABOUT US THAT HAVING, I, I DON'T UNDERSTAND WHY FOUR MEN NEEDED TWO PORTA-POTTIES WITHIN A HUNDRED FEET OF EACH OTHER AND NOT EVEN REMOTELY CLOSE TO THE CONSTRUCTION ZONE.

AND SO WE, WE DON'T NEED ANY HELP MAKING OUR CITY LOOK LIKE A PORTA-POTTY.

SO THAT'S WHAT, UM, THOSE WERE THE TWO INCIDENCES THAT BROUGHT THE PORTA-POTTY TOPIC UP.

RIGHT.

AND THOUGH, UM, AND SO THEN AGAIN, KEEPING IT AT THE SCOPING LEVEL AND KIND OF UNDERSTANDING WHAT WE MIGHT EVEN LOOK INTO, I DO KNOW WE'VE GOT THE TEAM READY WITH JUST A CURRENT STATUS OF REGULATIONS.

ARE YOU COMFORTABLE WITH SHARING THAT OR I GUESS I DO.

I DO HAVE A QUESTION ON THAT.

YOU SAID AT MILLER, I BELIEVE IN SATURN.

UM, SO IT WAS IN THAT AREA WHEN THEY WERE DOING THAT WHOLE STRETCH AND, AND THEN WHEN THEY PULLED OFF, THEY LEFT THE PORTA-POTTY, THEY MOVED THE ENTIRE PORTA-POTTY.

IT DIDN'T MAKE ANY SENSE.

SO IT WASN'T EVEN LIKE THEY JUST, THE PORTA POTTY HADN'T BEEN PICKED UP YET.

IT WAS, IT WAS FULLY MOVED TO A WHOLE NOTHER AREA, LIKE ON THE OPPOSITE SIDE OF OKAY.

LIKE IF YOU'RE GOING SATURN 16TH AREA? NO, IT WAS FURTHER.

OH WOW.

IT WAS ON, IN LIKE BY WILLIAMS ESTATES.

OH, OKAY.

IT WAS ON LIKE PAST WALMART.

IT WAS THE ODDEST THING.

LIKE CLOSE TO HILLTOP, I THINK IN, IN, IN A, IN A LOT OF CASES THE, THE PORTA-POTTIES ARE ACTUALLY A SEPARATE COMPANY THAT IS HIRED BY THE CONTRACTOR.

ONCE CONSTRUCTION'S FINISHED, THE CONTRACTOR PICKS UP, THEY MOVE OFF THE SITE, THEY'RE RESPONSIBLE FOR CONTACTING THE, THE CON THE, UH, COMPANY THAT THEY'VE LEASED THOSE FROM.

OBVIOUSLY THEY DON'T WANT TO KEEP PAYING FOR 'EM, BUT THEY'RE SUPPOSED TO CONTACT THEM AND THEN THE COMPANY COMES AND PICKS 'EM UP.

HOW IT GOT MOVED, I CAN'T QUITE ANSWER THAT UNLESS THERE'S A PROPERTY OWNER THAT JUST GOT DISGUSTED WITH US AND I'M GONNA MOVE IT DOWN THE STREET.

BUT, UM, AS FAR AS PORTA-POTTIES THAT TODAY'S POLICY AS FAR AS CIP PROJECTS THAT WE WORK ON THAT ACTUALLY HAVE A STORMWATER POLLUTION PREVENTION PLAN WITH THEM, WE, WE ACTUALLY LOCATE ON THE PLAN.

THE, THE ENGINEER OF RECORD LOCATES 'EM ON THE PLAN OF WHERE THE STRATEGICALLY PLACE 'EM THROUGHOUT THE SITE AND WE PUT 'EM THERE DURING THE CONSTRUCTION.

THE CONTRACTOR WILL PUT 'EM THERE OR HAVE 'EM PLACED THERE.

SOMETIMES WE WORK WITH PROPERTY OWNERS.

THE PROPERTY OWNER MAY NOT WANT IT EXACTLY THAT LOCATION.

WE TRY TO MOVE IT AND, AND TRY TO APPEASE EVERYBODY THE BEST WE CAN.

UM, SOMETIMES IT'S, YOU JUST CAN'T MAKE EVERYONE HAPPY.

BUT WE'VE NEED, THEY'RE, THEY'RE REQUIRED ON SITE, ESPECIALLY FOR LONG-TERM PROJECTS BECAUSE THERE'S THE ALTERNATIVE, WHICH WE'VE HAD COMPLAINTS ON WHEN YOU DIDN'T HAVE ENOUGH OF THEM, THEY FIND SOMEWHERE ELSE TO GO.

AND A LOT OF TIMES IT'S ON PEOPLE'S PRIVATE PROPERTY.

AND UNFORTUNATELY THAT TURNS OUT TO BE BAD.

SO, UM, IT, IT'S A NECESSARY EVIL FOR LACK OF A BETTER EXPRESSION.

AND I DID GIVE YOU A PIECE OF PAPER TODAY.

THIS, THIS COMES FROM OUR STORM WATER POLLUTION PREVENTION PLAN.

UM, STANDARD DETAILS.

AND IT TALKS ABOUT THE SANITARY FACILITIES.

AND I KNOW ANOTHER COMPLAINT THAT WE OFTEN GET IS, YOU KNOW, HOW OFTEN ARE THEY SERVICED? AND IT'S TYPICALLY UP TO THE COMPANY THAT, THAT, UH, COMES OUT AND PLACES THEM THAT THEY'LL, THEY, THEY HAVE A SCHEDULE OF HEALTH AND THEY, THEY'LL BE SERVICED.

I DON'T KNOW IF THAT'S ONE OR TWO WEEKS.

UH, WE DON'T REQUIRE A CERTAIN ON OUR, ON OUR LIST, IT'S USUALLY REQUIRED BY THE COMPANY.

NOW I DO KNOW SOME CONTRACTORS PURCHASE THEIR OWN AND HAVE THEM ON SITE AND SOMETIMES THOSE DON'T GET SERVICED AS OFTEN.

AND THERE'S THE SMELL COMPLAINTS.

AND THEN ONCE WE GET THOSE, WE TALK TO THE CONTRACTOR TO SERVICE 'EM.

SO, UM, WITH THAT, THIS IS ALL GOVERNED BY OUR STORM WATER POLLUTION PREVENTION PLAN.

NOW, WHEN IT COMES TO, UM, WATER DEPARTMENT PROJECTS, UM, WHERE THEIR CREWS ARE OUT THERE AND STREET DEPARTMENT, I, I, I CAN'T ANSWER THOSE QUESTIONS.

UH, THEY MAY BE ABLE TO COME UP HERE AND ANSWER HOW, WHAT THEIR CURRENT POLICY IS.

BUT, UM, ON CIP PROJECTS, WHICH ARE YOUR LONGER TERM PROJECTS, THIS IS HOW WE USUALLY TYPICALLY WORK WITH THEM.

AND IF THERE'S ONE LEFT OUT THERE, UH, IF SOMEBODY CAN HOLLER AT US, WE'LL MAKE SURE THAT IT GETS REMOVED.

THE FIRST LINE ITEM SAYS SANITARY FACILITIES MUST BE PROVIDED ON THE SITE IN CLOSE PROXIMITY OF AREAS WHERE PEOPLE ARE WORKING.

WHAT DO WE CONSIDER CLOSE PROXIMITY? WELL, AND I WAS LOOKING AT A PLAN BEFORE I CAME OVER HERE AND I DIDN'T HAVE A CHANCE TO PRINT OUT 11 BY 17 SHEETS FOR YOU, BUT ON ONE OF OUR RECENT PROJECTS

ON KHO, UM, WHICH IS UP NEAR YOUR DISTRICT, UH, WE HAD 'EM AT EVERY OTHER ALLEY ENTRANCE.

UH, 'CAUSE WHAT WE'VE, WHAT WE FOUND OUT, YOU GOT A GUY ON A BACKHOE OR SOMETHING, HE'S GOT A, ALL OF A SUDDEN I GOTTA GO AND , THEY NEED TO BE CLOSE ENOUGH BY THAT.

IT'S, THAT'S NOT GONNA SLOW 'EM DOWN ON THEIR WORK THAT THEY CAN GO GET BACK TO THEIR JOB AND COMPLETE THE WORK.

SO THOSE WERE, THOSE WERE SHOWN AT EVERY OTHER ALLEY.

AND WE TRY TO KEEP 'EM MORE TOWARDS THE BACK OF THE PROPERTIES WHERE YOU MAY HAVE AN ALLEY APPROACH OR SOMETHING WHERE THEY'RE, THEY'RE NOT IN SOMEBODY'S FRONT YARD.

RIGHT.

AND BEING MORE UNSIGHTLY.

RIGHT.

SO, UM, AGAIN, EVEN SOMETIMES AT THE BACK ALLEY, SOMEBODY MAY SAY, I DON'T WANT THAT THERE.

AND WE TRY TO GET'EM MOVED AND TRY TO PLACE 'EM THE BEST WE CAN, BUT THEY NEED TO BE STRATEGICALLY PLACED OUT TO WHERE PEOPLE HAVE AN OPPORTUNITY THAT THEY DON'T HAVE TO WALK SIX BLOCKS ONE WAY TO JUST TO GO TO THE RESTROOM.

RIGHT.

SO, AND THE THE REASON I ASK IS BECAUSE THE ONES THAT WERE ON BUCKINGHAM WERE BOTH A GOOD DISTANCE AWAY FROM WHERE THEY WERE WORKING ON THE STREETS.

SO THAT WAS LIKE, OKAY, LIKE IF YOU HAVE TO WALK THAT WHOLE DISTANCE TO GO TO THE BATHROOM, LIKE THAT'S A LITTLE SILLY.

RIGHT.

BUT THAT'S WHAT, THAT'S WHY I WAS ASKING, BUT I APPRECIATE IT.

IT ALSO SAYS PORTABLE TOILETS SHOULD BE REGULARLY SERVICED.

IS THERE, CAN WE PUT A TIMEFRAME ON THAT OR DO YOU NOT RECOMMEND DOING THAT? IT, IF A PROJECT IS REALLY LONG, UM, AND THERE ARE MULTIPLE, JUST LIKE THAT INSTANCE WHERE YOU HAVE ONE EVERY ALLEY, MAYBE IT'S NOT NECESSARY TO EMPTY THEM ONCE A WEEK, MAYBE EVERY TWO WEEKS.

BUT IF YOU HAVE, ESPECIALLY SINCE THEY'RE LOCATED IN YOUR HOMES, UM, BUT IF YOU HAVE A, A SHORTER, SMALLER PROJECT WHERE THERE'S JUST ONE PORTA-POTTY FOR THE WHOLE SITE, MAYBE THAT NEEDS TO BE EMPTIED EVERY WEEK KIND OF THING.

I DON'T KNOW.

AND WHAT WE CAN DO IS WE CAN, WE CAN CONTACT A FEW OF THESE COMPANIES AND FIND OUT WHAT THEIR TYPICAL CYCLE IS FOR MOST PROJECTS, ESPECIALLY LARGER PROJECTS, UM, LIKE THE CIP MAYBE IT IS ONCE A WEEK, MAYBE IT'S ONCE EVERY TWO WEEKS.

SINCE THERE'S SO MANY OF THEM.

AND, AND MAYBE WE CAN PROBABLY TRY TO PUT SOMETHING IN THERE, YOU KNOW, BASED ON THE GUIDELINES PROVIDED BY, WE CAN PUT SOMETHING IN HERE.

I IMAGINE IT, IT'S KIND OF BASED ON HOW MANY PEOPLE ARE USING IT.

WELL, UH, USUALLY WHAT I'VE SEEN IN, IN, IN THE PAST IS ONCE A CONTRACTOR GOES OUT THERE AND THEY'RE FINISHED WITH ALL THEIR CLEANUP, THAT'S WHEN, YOU KNOW, AS THEY CLEAN UP, THEY'RE PICKING UP THEIR, YOU KNOW, ONCE THEY'RE FINISHED IN THAT PARTICULAR ZONE, THEY'LL GET ALL THEIR STUFF REMOVED AND, AND MOVED OFF THE SITE.

IF THEY STILL HAVE TO COME BACK AND SOD OR SOMETHING, THEY MAY LEAVE IT UP TILL THEY GET THE SOD PUT DOWN, BUT FOR THE MOST PART, THEY USUALLY PICK IT UP AS THEY GO RIGHT.

WHEN THEY CLEAN UP.

I, I MEAN, I'M SURE THAT IN SOME CASES THAT'S, I MEAN THE GLENBROOK OR UH, THE GLENBROOK PROJECT IS REALLY MORE OF A, A ONE-OFF THING.
