I'LL ACTUALLY COME DOWN HERE FOR A BIT.

UM, I, I DON'T KNOW THE EXTENT TO WHICH YOU ALL MAY BE AWARE.

UH, WE HAD A RECENT CHANGE TO THE GARLAND CODE OF ORDINANCES, AND THEY HAVE, UH, THE ORDINANCE DESIGNATES THE PROPERTY STANDARDS BOARD AS THE, AS THE APPEAL BOARD, UH, FOR REVOCATION AND FOOD PERMITS OR FAMILY PERMITS.

UH, WE'RE GONNA GO THROUGH, KIND OF TELL YOU WHAT THAT'S ABOUT.

UH, WE'VE, WE'VE GOT TO GIVE YOU, YOU KNOW, WE'VE GOT SOME PEOPLE THAT ARE GONNA GIVE YOU A LITTLE INFORMATION.

I'LL GIVE YOU A LITTLE OF INFORMATION ABOUT WHAT, WHAT YOUR DUTIES WILL BE AS AN APPELLATE BOARD, UH, WHICH ARE A LITTLE BIT DIFFERENT, UH, THAN YOUR DUTIES, UH, IN REVIEW PROPERTY STANDARDS CASES.

SO WE WANT TO LET YOU KNOW WHAT YOU'RE GONNA BE LOOKING AT HERE REAL QUICKLY, AND THEN I'LL COME BACK UP AND I'LL GIVE YOU WHAT YOUR, WHAT YOUR LEGAL STANDARDS AND THAT KIND OF THING WILL BE ON THAT.

MY NAME IS MANDY PIPPEN AND I'M THE DIRECTOR OF THE ENVIRONMENTAL HEALTH DEPARTMENT.

AND I'M HERE TONIGHT TO KIND OF CLUE YOU INTO WHY, UM, HEALTH IS HERE NOW, AND TO, UH, GIVE YOU A LITTLE CONTEXT.

UH, AS TO OUR FOOD INSPECTION PROGRAM, IN SEPTEMBER OF 25, UH, THE CITY COUNCIL PASSED AN ORDINANCE THAT CHANGED, UH, THE APPEAL PROCESS FOR A FOOD ESTABLISHMENT THAT'S FACING PERMIT REVOCATION.

IT USED TO GO TO THE CITY COUNCIL, AND WE NEVER ACTUALLY HAD A CASE DO THAT.

SO, UH, YOU GUYS ARE THE FIRST.

SO THEY CHANGED THAT PROCESS FROM CITY COUNCIL TO PROPERTY STANDARDS REPORT.

UM, THERE'S ALSO, UH, A PART IN THERE THAT TALKS ABOUT THAT YOU HAVE TO HEAR THE CASE WITHIN 30 DAYS OF A REQUEST.

UM, THIS ORDINANCE BECAME, UM, EFFECTIVE IN NOVEMBER.

OKAY.

SO JUST A LITTLE, UM, INFORMATION ABOUT OUR INSPECTION PROGRAM.

UM, OUR MISSION OF THE HEALTH DEPARTMENT IS TO PROTECT PUBLIC HEALTH.

AND THE BIGGEST WAY WE DO THAT IS THROUGH INSPECTIONS.

SO OUR INSPECTIONS ENSURE PUBLIC SAFETY BY ENFORCING THE FOOD SAFETY REGULATIONS TO PREVENT FOOD, CORN ILLNESS.

AND WE EDUCATE THE STAFF ON PROPER FOOD HANDLING PROCEDURES.

UM, GARLAND HAS 1,157 FOOD ESTABLISHMENTS, AND WE INSPECT THEM ALL ONCE A YEAR.

UM, IF THEY HAVE, UH, HIGHER RISK, UH, OPERATIONS, OR THEY SERVE LIKE A, A HIGHLY SUSCEPTIBLE POPULATION LIKE THE ELDERLY OR THE CHILDREN, THEN WE WILL GO MORE OFTEN.

UM, ADDITIONALLY, PLACES THAT SCORE BELOW 69 WILL BE INSPECTED AGAIN IN 90 DAYS, AS LONG AS WE HAVE THE, UH, BANDWIDTH FOR THAT.

UM, INSPECTIONS USUALLY REQUIRE A RECHECK TO MAKE SURE THE VIOLATIONS WERE CORRECTED.

AND THEN WE ALSO, IN INFOR, UH, WE REALLY PUT A LOT OF EMPHASIS ON PROACTIVE SUPPORT.

YOU KNOW, WE, WE WANNA WORK HAND IN HAND WITH THE, UH, RESTAURANTS AND WE, WE DO EDUCATION FIRST.

UM, AND WE ALSO HAVE SOME NEW INITIATIVES.

ONE IS CALLED THE WELCOME WAGON, WHERE NEW ESTABLISHMENTS THAT HAVE NEVER HAD INSPECTION CAN KIND OF GET LIKE A, A MOCK INSPECTION WHERE WE'RE EDUCATING ALONG THE WAY.

UM, SO WE'RE JUST PUTTING ALL THESE THINGS IN PLACE TO, TO PREVENT THIS KIND OF SITUATION.

UM, ALSO, THEY ALWAYS HAVE ACCESS TO THE INSPECTOR, SO THEY CAN CALL ANYTIME, EMAIL, ANYTIME.

UM, OUR INSPECTIONS ARE DONE ON THE TEXAS DEPARTMENT OF STATE HEALTH SERVICES 47 ITEM FORM.

IT'S MUCH LIKE SCHOOL WHERE THE MAXIMUM SCORE IS A HUNDRED AND FAILING IS BELOW 70.

UM, ON THE NEXT SCREEN, AND I CAN'T REALLY SEE IT THAT WELL, BUT, UM, YOU'LL SEE THE, ON THE ONE ON THE LEFT, IT'S KIND OF BROKEN IN THREE SECTIONS.

THE TOP SECTION IS THE PRIORITY VIOLATIONS.

THOSE ARE THE ONES THAT ARE RESPONSIBLE FOR MAKING PEOPLE SICK.

THERE WERE THREE POINTS EACH.

THE TOTAL FOR THAT SECTION IS 60 POINTS, AND THOSE ARE ITEMS THAT HAVE TO BE CORRECTED IMMEDIATELY.

THE SECOND SECTION IS THE PRIORITY FOUNDATION ITEMS. THOSE ARE OFTEN LIKE CLUES THAT YOU MIGHT FIND PRIORITY ITEMS. FOR EXAMPLE, A PRIORITY FOUNDATION ITEM WOULD BE LIKE, THEY DON'T HAVE A THERMOMETER.

WELL, IF THEY DON'T

HAVE A THERMOMETER, IT'S PROBABLY REASONABLE TO ASSUME THAT LET'S GO CHECK TIPPER.

'CAUSE IF THEY AREN'T EVEN CHECKING, YOU KNOW, THEY'RE PROBABLY GONNA HAVE SOME VIOLATIONS.

SO THOSE ARE WORTH TWO POINTS EACH FOR A TOTAL OF 26 IN THAT SECTION.

AND THOSE HAVE A CORRECTION TIME OF 10 DAYS.

AND THEN THE LAST SECTION IS, UH, CORE ITEMS. AND THOSE ARE WORTH ONLY ONE POINT.

THEY'RE THINGS LIKE CLEANING, MAINTENANCE, BROKEN FLOOR, FLOOR TILES, THINGS LIKE THAT.

UM, AND THOSE SOMETIMES CAN JUST WAIT TILL THE NEXT INSPECTION TO BE CORRECTED.

THE DOCUMENT ON THE RIGHT IS THE WAY OUR FORM LOOKS, UH, COMPUTERIZED.

SO IT'S THE FORM FORM ON THE LEFT PUT INTO OUR COMPUTER SYSTEM.

OKAY.

SO FAILING INSPECTION SUPPORT, THAT'S ANYTHING 69 OR BELOW.

ONCE THEY SCORE 69 OR BELOW, THEY ARE STRIKE ONE.

OKAY.

PER ORDINANCE, ANY ESTABLISHMENT SWORN 69 OR BELOW THREE TIMES IN 24 MONTH PERIOD IS SUBJECT TO A PERMIT.

REVOCATION.

PREVIOUSLY THAT WAS THREE INSPECTIONS IN 18 MONTHS, AND THEY HAD, THEY COULD GO AS LOW AS 59.

SO IT'S A LITTLE BIT OF A SHIFT.

UM, BUT WE, WE INTENTIONALLY DID THAT 'CAUSE WE, WE SAW PEOPLE JUST HANGING OUT IN THOSE, THAT MIDDLE RANGE, 50 TO 60, AND THEY EITHER NEED TO DO BETTER OR, YOU KNOW, MOVE ON .

BUT WE, WE INTENTIONALLY WANTED TO MAKE IT, UH, MORE, UH, STRICT BECAUSE THAT'S, THAT'S OUR MISSION.

UM, ON THE THIRD STRIKE, UM, LIKE I SAID, THAT, THAT THEIR PERMIT IS REVOKED.

UM, THEN THEY HAVE FIVE DAYS TO REQUEST AN APPEAL, AND THAT WOULD BE TO YOU GUYS.

UM, AND LIKE I SAID, YOU HAVE TO, UH, WE HAVE TO HEAR THAT WITHIN 30 DAYS OF THEIR REQUEST, UM, WHEN THEY DO HAVE A STRIKE ONE, IT'S A CLOSURE FOR 24 HOURS, THEY GET A WRITTEN NOTICE.

THEY HAVE THE OPTION OF A MEETING WITH ME AND THE OPTION TO DEVELOP WHAT'S CALLED RISK CONTROL PLANS.

AND THAT'S WHERE WE TAKE EACH PRIORITY ITEM THAT THEY GOT AND BREAK IT DOWN LIKE, WHAT HAPPENED? WHY IS THIS IMPORTANT TO PUBLIC HEALTH? HOW CAN WE FIX IT? WHO'S GOING TO BE CHECKING ON THIS? SO IT KIND OF REALLY JUST BREAKS IT UP TO, TO ENSURE THAT HOPEFULLY WE DON'T SEE THIS VIOLATION AGAIN.

THERE'S ALSO A NEW RECHECK FEE AS PART OF THE ORDINANCE, $200.

AND THEN OF COURSE, THEY HAVE TO REACH, UH, CORRECT ALL THE VIOLATIONS BEFORE WE REOPEN THEM.

STRIKE TWO HAS SIMILAR, UH, STEPS, BUT IT IS A CLOSURE FOR SEVEN DAYS.

AND THEN THE MEETING WITH ME AND THE RISK CONTROL PLAN IS, UH, MANDATORY.

UM, BOTH SITUATIONS, CITATIONS ARE POSSIBLE.

AND THEN THE LAST STEP IS WHERE WE ARE PERMANENT RELOCATION.

SO WHERE DO WE STAND RIGHT NOW? WE HAVE ABOUT 35 PLACES OUT OF 1157, UM, IN STRIKE ONE, AND THEN EIGHT IN STRIKE TWO AND TWO IN STRIKE THREE, WHICH YOU'LL HEAR TONIGHT.

OKAY.

THE WAY THAT THESE WILL GO IS WE WILL PRESENT OUR CASE WITH PHOTOS.

YOU HAVE PACKETS THAT HAVE THE INSPECTION HISTORY, UM, AND THE PHOTOS AND CITATIONS IN, IN YOUR PACKET THERE.

THE CHOICES OF THE DECISION ARE TO AFFIRM OUR DECISION TO REVOKE THE PERMIT, OR YOU REVERSE THE DECISION TO REVOKE THE PERMIT.

THE CITY COUNCIL, UH, VERY RARELY IF EVER HAD APPEALS, AND THEN THEY CHANGED IT UP AND SUDDENLY WE, WE'VE GOT APPEALS, UH, WHICH MAY NOT BE SURPRISING, AND THAT'S JUST THE WAY THINGS GO SOMETIMES.

UH, THIS IS THE STATUTE THAT, OR THE ORDINANCE THAT REFERENCES, UH, THE REVOCATION GOES THROUGH PRETTY MUCH, UH, WHAT MANDY JUST WENT THROUGH AS FAR AS WHAT IT TAKES IN ORDER TO GET, UH, REVOKED.

UH, AND IT'S BASICALLY COMES DOWN TO THREE, UH, 69 OR BELOW SCORES WITHIN THE 24 MONTH PERIOD.

UH, AND IT PROVIDES FOR THE APPEAL TO YOU, UH, OF THAT REVOCATION.

UH, EXCEPT SHELBY HEARD ABOUT THE PROPERTY STANDARDS REPORT.

UH, SHE REFERENCED A COUPLE TIMES.

THERE'S A, THERE'S A 30 DAY APPEAL WINDOW OR FIVE DAY APPEAL WINDOW, AND THEN HAS TO BE HEARD WITHIN 30 DAYS.

UH, WE ARE, UH, GOING TO ATTEMPT TO MAKE SURE TO OUR GENERAL HEARING DATES FOR THE PROPERTY STANDARDS BOARD, WE TRY TO HEAR CASES QUARTERLY.

UH, SOME MONTHS WE DON'T HAVE ENOUGH CASES, BUT THEY'RE GOING TO, UH, TRY TO TIME, UH, THE REVOCATIONS, UH, TO THESE, TO THESE RESTAURANTS, UH, SO THAT THE 30 DAY APPEAL WILL, WILL MATCH UP WITH THE CALENDAR THAT'S, THAT'S ALREADY BEEN ESTABLISHED FOR PROPER STANDARD STORE.

SO, UH, THE HOPE IS IT'S NOT GONNA CREATE MORE HEARINGS, UH, BUT AS THIS IS A NEW PROCESS, UH, THINGS COULD CHANGE.

UH, YEAH, I FEEL REALLY SORRY FOR THESE PEOPLE BECAUSE, UH, I THINK THEY WERE TRYING TO KEEP THE GARAGE CAT WARM ON A COLD NIGHT AND HAD A, UH, HEAT LAMP THAT BASICALLY CAUGHT THE HOUSE ON FIRE.

AND, AND THEY LITERALLY GOT OUT IN THEIR UNDERWEAR AND WITH THEIR DOG.

AND THAT WAS, THEY'D BEEN IN THE HOUSE A FEW MORE MINUTES, THEY WOULDN'T COME OUT.

UH, AND THEY HAD REALLY NO RESOURCES AFTER THAT.

THEY LIVED IN THEIR TRUCK IN THE DRIVEWAY FOR A YEAR AND A HALF, ALMOST TWO YEARS OFF AND ON.

THEY'D HAVE ENOUGH MONEY TO GO STAY AT A HOTEL FOR A WEEK AND THEY'D BE BACK FOR THREE WEEKS LIVING IN THE TRUCK.

UH, I TRIED MY BEST TO HELP 'EM, I OFFERED ALL KINDS OF HELP.

UH, I HELPED THEM HELP MIKE PROCURE A ROLL OFF DUMPSTER FROM THE CITY.

I TOLD HIM, I SAID, ALL YOU'RE GONNA HAVE TO DO IS PAY THE TIPPING FEE WHEN THEY TAKE, TAKE THE DEBRIS AWAY.

THE LIVING ROOM, THE UTILITY ROOM, AND THE BACK BEDROOM, THE, THE ROOF OVER THE GARAGE HAS CAVED IN TO THE POINT AS FAR DOWN AS IT CAN GO.

UM, SHE WAS RUSHED TO THE HOSPITAL AND THEY SAID THAT IT'S A GOOD THING I GOT HER IN THERE BECAUSE SHE PROBABLY WOULD'VE DIED BECAUSE SHE HAD SMOKE IN HER LUNGS TOO.

UM, AFTER THAT SHE WAS IN THE HOSPITAL.

SOMEHOW SHE CALLED COVID IN THE HOSPITAL.

SO WE HAD TO STAY IN THE HOSPITAL FOR A MONTH AND THEN THEY FOUND OUT SHE COULDN'T WALK.

SO WE HAD TO GO THROUGH REHAB.

WE TO REHAB FOR ABOUT THREE WEEKS.

SHE WALKED GOOD ENOUGH TO GET HOME.
