MOSTLY THE SUBSTANCE OF THIS ORDINANCE AMENDMENT IS RELATED TO SUBDIVISION REGULATIONS.
CHAPTER THREE. HOWEVER, THERE ARE SOME RELEVANT MATTERS THAT ARE THAT RESIDE IN CHAPTER ONE AND FIVE. SO WE'RE TACKLING ALL OF THEM TOGETHER COMPREHENSIVELY. THE THE SUBSTANCE OF THIS REQUEST IS RELATED TO ALLEY WAIVERS, SIDEWALK WAIVERS, AND WORKING PLANS. SO A LITTLE BIT OF BACKGROUND, AS YOU ALL ARE AWARE, IN SEPTEMBER 1ST, 2023, THE STATE ALLOWED CITIES TO MAKE THE PLANNING PROCESS ADMINISTRATIVE. PRIOR TO THAT, THE PLAT PROCESS WAS ADMINISTRATIVE ONLY. IF IT WAS A PLAT OF FOUR OR LESS LOTS, FOUR OR FEWER LOTS. BUT ANYTHING BIGGER THAN THAT, IT HAD TO BE A PLANNING COMMISSION DECISION MAKING PROCESS. HOWEVER, IT WAS MINISTERIAL. SO IF IT IF THEY MET EVERYTHING FROM THE ORDINANCE, THE PLANNING COMMISSION WAS OBLIGATED TO APPROVE THE APPROVE THE PLAT FOLLOWING THE UPDATED STATE LEGISLATURE STAFF BROUGHT FORWARD TO PLANNING COMMISSION AND CITY COUNCIL THE ORDINANCE AMENDMENT THAT WOULD ENABLE US TO ADMINISTER ALL PLATS BY STAFF AND ELIMINATED THE NEED TO GO TO PLANNING COMMISSION FOR THAT PURPOSE.

THOSE WERE NOT ADDRESSED AT THAT TIME, AND THOSE ARE ALLEY WAIVERS AND SIDEWALK WAIVERS. SO CURRENTLY, PER OUR GARLAND DEVELOPMENT CODE, ALL OUR SUBDIVISIONS REQUIRE AN ALLEY. SO ANYTHING THAT IS ANY DEVELOPMENT THAT IS NOT PROPOSING AN ALLEY, THEY ARE REQUIRED TO GO THROUGH AN ALLEY WAIVER PROCESS. WHAT WE HAVE CURRENTLY IN OUR GARLAND DEVELOPMENT CODE IS WHAT'S SHOWN ON ON THE SCREEN. SO IT IS KIND OF ALIGNED WITH HOW OUR PLAT APPROVAL PROCESS WAS BEFORE THE LEGISLATIVE UPDATE.
SO ANY ALLEY WAIVER FOR FOUR OR FEWER LOTS, THE DIRECTOR OF ENGINEERING WAS ABLE TO APPROVE

THAT, BUT ANYTHING BEYOND THAT HAD TO COME THROUGH PLAN COMMISSION. HOWEVER, NOW THAT ALL PLATS CAN BE ADMINISTRATIVELY APPROVED, WE DON'T SEE A NEED FOR HAVING THE ALLEY WAIVER PROCESS SEPARATED FROM THIS BECAUSE THEY ALMOST ALWAYS COME WITH THE PLAT. SO WE PROPOSE THAT WE TAKE OUT THAT FOUR OR FEWER LOTS OR FIVE PLUS FIVE PLUS LOTS, THOSE DIFFERENT DESIGNATIONS, AND WE MAKE THE WHOLE ALLEY WAIVER PROCESS. ADMINISTRATIVE.THEREFORE, THE DIRECTOR OF ENGINEERING WOULD BE ABLE TO APPROVE IT. HOWEVER, WE ALWAYS NEED TO HAVE AN APPEAL PROCESS. IF SOMEONE DISAGREES WITH THE WITH STAFF, THEY WILL HAVE THE OPTION TO GO TO PLAN COMMISSION, WHICH IS AGAIN ALIGNED WITH OUR CURRENT PLAT PROCESS WHERE THE PLANNING DIRECTOR CAN APPROVE THE PLAT, BUT ANYONE CAN APPEAL TO THE PLANNING COMMISSION.
SIMILAR THING FOR SIDEWALK WAIVERS AS WELL. CURRENTLY, THE DECISION MAKERS PLAN COMMISSION, AGAIN, IT'S ALIGNED WITH HOW THE PLAT PROCESS WAS BEFORE WE ADOPTED THE NEW NEW CHANGES. WE PROPOSED THAT WE MAKE THAT DIRECTOR OF ENGINEERING ENGINEERING'S APPROVAL WITH THE OPTION TO APPEAL TO PLAN COMMISSION. JUST A COUPLE ADDITIONAL THINGS THAT CAME UP DURING DISCUSSIONS THAT WE THINK WOULD BE USEFUL TO INCLUDE IN THE IN THE DDC RELATED TO SIDEWALK WAIVERS. SOMETIMES IF IT'S AN INFILL OR REDEVELOPMENT, IF IT'S AN EXISTING SUBDIVISION THAT DOESN'T EVEN HAVE SIDEWALKS, WE DON'T REALLY SEE THE NEED. WHY SOMEONE WOULD HAVE TO GO THROUGH A SIDEWALK WAIVER PROCESS, BECAUSE THE ENTIRE POINT OF SIDEWALKS IS THAT THEY NEED TO BE CONNECTED FOR THEM TO FUNCTION PROPERLY. IF THEY DON'T HAVE SIDEWALKS ON EITHER SIDE OF THEM, THAT'S CONNECTING THEM TO SOMEWHERE ELSE. THE CITY PROBABLY NEED TO COME UP WITH A DIFFERENT APPROACH FOR THAT ENTIRE SUBDIVISION OR FOR THAT ENTIRE AREA. SO THOSE ARE SOME OF THE EXCEPTIONS THAT WE WANTED TO INCLUDE IN DISCUSSION WITH OUR ENGINEERING COLLEAGUES. AND THAT EXCEPTION WOULD EXEMPTION WOULD ALSO BE DETERMINED BY THE DIRECTOTOR OF ENGINEERING. AS MENTIONED, THIS IS A HEAVILY ENGINEERING FOCUS TOPIC. WE ALSO SAY THAT IF A SIDEWALK WAIVER. WE ALSO PROPOSE THAT IF A SIDEWALK WAIVER PROCESS IS REQUIRED. CURRENTLY THERE IS A TWO YEAR WINDOW. SO SOMEONE PAYS THE SIDEWALK IMPROVEMENT FEE. BUT IF THE SIDEWALK ISN'T CONSTRUCTED WITHIN TWO YEARS, THE UDC, THE CITY IS SUPPOSED TO REIMBUR THAT AMOUNT TO TWO YEARS, IN OUR OPINION, IS PRETTY SHORT TO DETERMINE WHETHER OR NOT THAT MONEY COULD BE USED TOWARD CONSTRUCTING THAT SIDEWALK. SO WE PROPOSED THAT THE DIRECTOR OF ENGINEERING SHALL CONDUCT SIDEWALK IMPROVEMENT FORECAST EVALUATION TO DETERMINE IF THAT SIDEWALK IS PROJECTED TO BE DESIGNED AS PART OF THE CITY PROJECT WITHIN FIVE YEARS. IF IT IS, THEN YES, THE APPLICANT NEEDS TO PAY THE SIDEWALK IMPROVEMENT FEE. IF NO, THEN THEY SHOULD NOT HAVE TO PAY THE FEE FOR THE SIDEWALK IMPROVEMENT. AND THE REASON THE HOW WE CAME UP WITH FIVE YEARS.
THERE'S NO SCIENCE BEHIND IT, BUT MOST OF OUR PUBLIC WORKS DETERMINATIONS ARE 3 TO 5 YEARS.
SO THAT THAT AMOUNT OF YEARS SEEMED REASONABLE FOR US TO KNOW WHETHER OR NOT A PROJECT WILL BE DESIGNED WITHIN WITHIN THAT YEAR, WE WILL NEVER KNOW IF IT'S IF IT'S BEYOND FIVE YEARS, THAT'S NOT SOMETHING THAT WE'LL KNOW AT THAT POINT OF TIME. BASED ON ALL THAT CONSIDERATION WE THOUGHT FIVE YEARS COULD BE COULD BE A GOOD OPTION. ALONG WITH THAT, WE ALSO BRING IN ANOTHER KIND OF CLEANUP ITEM, WHICH IS OUR WORKING PLAN. YOU MAY BE AWARE PLATS ARE SUPPOSED TO BE APPROVED OR DENIED WITHIN 30 DAYS. AND SOMETIMES THAT THAT CAN CAUSE SOME UNNECESSARY BURDEN ON THE DEVELOPERS. BECAUSE IF THERE ARE CERTAIN THINGS THAT COULD BE WORKED ON, BUT STAFF IS IN A SHOT CLOCK PROCESS PER PER THE STATE, AND IF THEY'RE NOT MEETING THE STANDARDS, STAFF NEEDS TO DENY IT. THAT DOES CAUSE A LOT OF ISSUES FOR THE DEVELOPERS AND STAFF. BOTH ENDS. SO WE HAVE A WORKING PLAT PROCESS WHICH IS HIGHLY RECOMMENDED, WHICH 99% OF THE TIMES THEY COME IN WITH A SITE PERMIT. AND THAT IS NOT A FORMAL APPLICATION. AND CURRENTLY THE SMOKE SHOP DEFINITION DOES NOT INCLUDE THE VAPING COMPONENT, AND IT DOES NOT DISTINGUISH THAT USE FROM REGULAR TOBACCO CIGAR SHOP. SO TO ADDRESS THAT, THAT'S THE PRIMARY PURPOSE OF THIS AMENDMENT. WE'RE TRYING TO ADDRESS THOSE ISSUES. IN ORDER TO DO SO, WE ARE ADDING A NEW USE WHICH IS TOBACCO SLASH CIGAR SHOP, WHICH IS DEFINED AS A COMMERCIAL ESTABLISHMENT WHERE MORE THAN 75% OF THE STORE'S INVENTORY HAS TO BE TOBACCO PRODUCTS IN THEIR ORIGINAL MANUFACTURER'S PACKAGING. IN CONTRAST, THE SMOKE SHOP DEFINITION INCLUDES SMOKING, INHALING, VAPORIZING, OR CONSUMPTION OF ANY SUBSTANCE IN WHICH TOBACCO PRODUCTS MAKE UP LESS THAN 75% OF THE INVENTORY. SO A COUPLE CLARIFYING POINTS IN THE PAST, IT WAS BASED ON REVENUE. WE ARE PROPOSING TO CHANGE IT FROM INVENTORY TO THE 75% THRESHOLD.
