NOTICE: The City Council may recess from the open session and convene in a closed executive session if the discussion of any of the listed agenda items concerns one or more of the following matters:

(1) Pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct. Sec. 551.071, Tex. Gov't Code.

(2) The purchase, exchange, lease or value of real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.072, Tex. Gov't Code.

(3) A contract for a prospective gift or donation to the City, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.073, Tex. Gov't Code.

(4) Personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee or to hear a complaint against an officer or employee. Sec. 551.074, Tex. Gov't Code.

(5) The deployment, or specific occasions for implementation of security personnel or devices. Sec. 551.076, Tex. Gov't Code.

(6) Discussions or deliberations regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations; or to deliberate the offer of a financial or other incentive to a business prospect of the sort described in this provision. Sec. 551.087, Tex. Gov't Code.

(7) Discussions, deliberations, votes, or other final action on matters related to the City’s competitive activity, including information that would, if disclosed, give advantage to competitors or prospective competitors and is reasonably related to one or more of the following categories of information:

generation unit specific and portfolio fixed and variable costs, including forecasts of those costs, capital improvement plans for generation units, and generation unit operating characteristics and outage scheduling;
bidding and pricing information for purchased power, generation and fuel, and Electric Reliability Council of Texas bids, prices, offers, and related services and strategies;
effective fuel and purchased power agreements and fuel transportation arrangements and contracts;
risk management information, contracts, and strategies, including fuel hedging and storage;
plans, studies, proposals, and analyses for system improvements, additions, or sales, other than transmission and distribution system improvements inside the service area for which the public power utility is the sole certificated retail provider; and
customer billing, contract, and usage information, electric power pricing information, system load characteristics, and electric power marketing analyses and strategies. Sec. 551.086; Tex. Gov't Code; Sec. 552.133, Tex. Gov’t Code]


1.		Consider the Consent Agenda A member of the City Council may ask for discussion or further information on an item posted as a consent agenda item on the next Regular Meeting of the City Council. The Council Member may also ask that an item on the posted consent agenda be pulled from the consent agenda and considered for a vote separate from consent agenda items on the regular agenda. All discussions or deliberations on this portion of the work session agenda are limited to posted agenda items and may not include a new or unposted subject matter.

2.		Written Briefing:

	a.	Proposed Property Exchange - 400-500 Block of Avenue A The Council was briefed at the December 12, 2017 Work Session regarding a proposed property exchange with the Foundry Church in the 400-500 block of Avenue A. A property exchange contract has been developed for the Council's review and approval. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the April 17, 2018 Regular Meeting.

	b.	Oncor's Distribution Cost Recovery Factor Filing The City Council is requested to consider a resolution denying a rate request filed by Oncor to increase rates within the Oncor service area. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the May 1, 2018 Regular Meeting.

3.		Verbal Briefings:

	a.	Dallas Regional & Local Mobility Plan At the request of Mayor Douglas Athas, Michael Rogers, Director of Transportation, City of Dallas, will provide a presentation regarding the regional and local aspects of the Dallas Mobility Plan.

	b.	Transportation Update The Transportation Director will provide an update on the status of strategic transportation projects in Garland.

	c.	Image Initiative Advertising Campaign Proposal and Contract Council is requested to consider a proposed advertising campaign concept and change order for Pyro Agency to provide video, photography, design and support services to produce campaign materials, including but not limited to videos, digital advertising, print, and other media. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the April 17, 2018 Regular Meeting.

	d.	Revised Site Selection for the Dog Park and Skate Park within Central Park At the request of Council Member Robert John Smith and Council Member Anita Goebel, Council is requested to consider revising the proposed locations of the dog park and skate park within Central Park.

4.		Regular Items:

	a.	2018-2019 CDBG, HOME and ESG Budget Allocation Council was provided the 2018-2019 CDBG, HOME Infill Partnership and ESG program information at the March 19, 2018 Work Session. City Council conducted a public hearing on March 20, 2018 to allow interested parties seeking federal grant funding an opportunity to present information on proposed programs. During City Council's April 2, 2018 Work Session, Council discussed allocation of funding and final budgets for the grant programs. Council is requested to make final allocations of grant funding for public services and give final approval for City projects to be implemented for the 2018-2019 fiscal year. City Council is requested to adopt a final budget for federal funding during the Regular City Council Meeting that will be held on April, 17, 2018.

5.		Announce Future Agenda Items A member of the City Council, with a second by another member, or the Mayor alone, may ask that an item be placed on a future agenda of the City Council or a committee of the City Council. No substantive discussion of that item will take place at this time.

		The City Council will adjourn into executive session under Sec. 551.071, TEX. GOV'T CODE and Sec. 551.087, TEX. GOV'T CODE regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations or to deliberate the offer of a financial or other incentive to a business prospect relating to: A commercial project located generally northeast of the intersection of West Miller Road and South Jupiter Road A commercial project located generally southeast of the intersection of South Garland Road and West Kingsley A commercial project located generally northwest of the intersection of South Shiloh Road and Marquis Drive A residential project located generally southwest of the intersection of East Kingsley Road and East Centerville Road

		The City Council will convene in executive session pursuant to Sections 551.806 and 552.133 of the Texas Government Code to discuss, deliberate, vote on or take final action with regard to a competitive matter, that being a utility-related matter that is related to the City’s competitive activity involving the City’s preparations for delivery of electric power during the upcoming summer and issues relating to electric rates.

Item Title:	Oncor's Distribution Cost Recovery Factor Filing

Summary of Request/Problem
The City Council is requested to consider a resolution denying a rate request filed by Oncor to increase rates within the Oncor service area. On April 5, 2018, Oncor filed an Application for Approval of a Distribution Cost Recover Factor (“DCRF”) to Increase Distribution Rates with each of the cities in their service area. The filing included Garland because approximately 15% of Garland is served by Oncor. In the filing, the Company asserts that it is seeking an increase in distribution revenues of $19,002,177 systemwide. We do not know at this point what the impact would be on Garland ratepayers within the Garland service area served by Oncor. The immediate problem is that the type of rate filing employed by Oncor in this case triggers a very short response time on the City’s part. We have only 60 days in which to review and approve or disapprove the filing. Given the short amount of time allowed, the prudent course of action is to deny the request, which then moves the matter to the PUC for ultimate resolution. Generally, once the cities affected by the increase have had a chance to fully review and analyze the filing, a negotiated rate can be agreed on, which will then be submitted to the PUC for approval. Garland is a member of a large group of cities known as the Steering Committee of Cities Served by Oncor (“OCSC”). It is through the OCSC that the rate filing will be evaluated and the group will determine what further strategy, including settlement, to pursue.
Recommendation/Action Requested and Justification
The purpose of the proposed resolution is to deny the DCRF application filed by Oncor. The resolution will futher: Authorize the City to participate with OCSC as a party in the Company’s DCRF filing, PUC Docket No. 48231. Authorize the hiring of legal counsel and consultants to review the filing, negotiate with Oncor, and make recommendations to the City (through the OCSC) regarding reasonable rates. Authorize the OCSC to direct any necessary administrative proceedings or court litigation associated with an appeal of this application filed with the PUC. Preserve Oncor’s current rates pending further action. Provide that Oncor will reimburse the cities that comprise the OCSC for their reasonable rate case expenses. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the May 1, 2018 Regular Meeting.

Item Title:	Revised Site Selection for the Dog Park and Skate Park within Central Park

ISSUE
At the request of Council Member Robert John Smith and Council Member Anita Goebel, Council is requested to consider revising the proposed locations of the dog park and skate park within Central Park. The locations presented were developed through a series of public engagement meetings with the Embree Neighborhood Association, and the attached proposal is believed to address the major concerns of the neighborhood from the previous staff presentation related to site selection on September 5, 2017.
BACKGROUND
City staff presented a recommendation on September 5, 2017 for the selected sites for the dog park and skate park projects within Central Park. Central Ballfield #1 was selected to be repurposed for the proposed dog park, and the northern portion of the former armory complex was selected to be repurposed for the proposed skate park. On October 2, 2017 a project consultant, Pacheco Koch, was approved to assist staff in engaging the public and developing concepts for the proposed projects. Pacheco Koch is also contracted to create construction documents for the dog park project. A separate company has been selected by staff through approved purchasing and procurement methods to serve as the design/build company for the skate park project. That company, SPA Skateparks, is yet to be brought forth to the Parks and Recreation Board for recommendation and to City Council for approval until the parameters of the skate park project are more clearly defined. City staff proceeded with four public meetings from October to December 2017. The citizens who attended those meetings brought forth concerns with siting the projects in Central Park as well as specific concerns with proximity to the proposed layout to the adjacent homes. Subsequently, Councilman Robert John Smith engaged the citizens further, and through several meetings throughout February and March of 2018, was successful in reaching a consensus for keeping the projects in Central Park, provided that the projects are located on the specific sites as presented and that certain design and operational conditions are taken into consideration. On April 4, 2018 Councilman Smith presented the attached proposal to the Parks and Recreation Board, and the Board unanimously voted in favor to recommend the proposal as presented. The items for consideration are outlined in the following section.
CONSIDERATION
consider revising locations of the dog and skate park within Central Park consider revising project budget and scope to add additional demolition projects and costs, required design elements (fencing) and costs consider establishing operating policies and procedures for the skate/dog park.

ISSUE
Final discussion of applications, funding history, and available funds for the Community Development Block Grant (CDBG), HOME Infill Partnership Grant (HOME) and Emergency Solutions Grant (ESG) budgets are provided for Council's information and review.
RECOMMENDATION

BACKGROUND
The City expects to receive the following funding for 2018-2019: CDBG: $1,872,146 HOME: $ 515,574 ESG: $ 168,777 The proposed budget for fiscal year 2018/2019 must be submitted to the Department of Housing and Urban Development (HUD) by August 15, 2018 for CDBG, HOME, and ESG. H&CS conducted two public input meetings and one public hearing to solicit feedback on the proposed use of funds.
CONSIDERATION
Staff received CDBG applications requesting a total of $451,200 for public services, $3,313,946 for City sponsored projects, and $374,429 for administrative use for next fiscal year. CDBG reprogrammed funds total $7,159 available for other eligible projects. For grant planning and administration HUD regulations limit expenditures to 20% ($374,429) of the City's annual HUD Entitlement Funding. Public Services expenditures are limited to 15% ($280,822) of the City's annual HUD Entitlement Funding. Including reprogrammed CDBG funds, $1,224,054 is available for City Council to program for FY 18/19. HOME Funds available for FY 18/19 total $515,574. H&CS proposes $515,574 in HOME expenditures for City sponsored housing programs. HUD regulations allow up to 10% of HOME funds to be used for administration and 15% of HOME grant funds must be allocated to Community Housing Development Organizations (CHDO). funds available for the FY 18/19 ESG program funds total $168,777. H&CS proposes to use use $12,658 of ESG funds for ESG program administration and $9,283 for data collection, as allowed by HUD. Remaining ESG funds are proposed for use as follows: Shelter Operations $54,009, Homeless Prevention $50,633 and Rapid-Re-housing $42,194. Requests for ESG funding exceeded the amount ESG funds available by $48,416.
