Verbal Briefing: These items do not require written background information or are an update on items previously discussed by the Council.

Regular Item: These items generally require discussion between the Council and staff, boards, commissions, or consultants. These items are often accompanied by a formal presentation followed by discussion.

NOTICE: The City Council may recess from the open session and convene in a closed executive session if the discussion of any of the listed agenda items concerns one or more of the following matters:

(1) Pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct. Sec. 551.071, Tex. Gov't Code.

(2) The purchase, exchange, lease or value of real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.072, Tex. Gov't Code.

(3) A contract for a prospective gift or donation to the City, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.073, Tex. Gov't Code.

(4) Personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee or to hear a complaint against an officer or employee. Sec. 551.074, Tex. Gov't Code.

(5) The deployment, or specific occasions for implementation of security personnel or devices. Sec. 551.076, Tex. Gov't Code.

(6) Discussions or deliberations regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations; or to deliberate the offer of a financial or other incentive to a business prospect of the sort described in this provision. Sec. 551.087, Tex. Gov't Code.

(7) Discussions, deliberations, votes, or other final action on matters related to the City’s competitive activity, including information that would, if disclosed, give advantage to competitors or prospective competitors and is reasonably related to one or more of the following categories of information:

generation unit specific and portfolio fixed and variable costs, including forecasts of those costs, capital improvement plans for generation units, and generation unit operating characteristics and outage scheduling;
bidding and pricing information for purchased power, generation and fuel, and Electric Reliability Council of Texas bids, prices, offers, and related services and strategies;
effective fuel and purchased power agreements and fuel transportation arrangements and contracts;
risk management information, contracts, and strategies, including fuel hedging and storage;
plans, studies, proposals, and analyses for system improvements, additions, or sales, other than transmission and distribution system improvements inside the service area for which the public power utility is the sole certificated retail provider; and
customer billing, contract, and usage information, electric power pricing information, system load characteristics, and electric power marketing analyses and strategies. Sec. 551.086; Tex. Gov't Code; Sec. 552.133, Tex. Gov’t Code]


1.		Consider the Consent Agenda A member of the City Council may ask for discussion or further information on an item posted as a consent agenda item on the next Regular Meeting of the City Council. The Council Member may also ask that an item on the posted consent agenda be pulled from the consent agenda and considered for a vote separate from consent agenda items on the regular agenda. All discussions or deliberations on this portion of the work session agenda are limited to posted agenda items and may not include a new or unposted subject matter.

2.		Written Briefings:

	a.	Wastewater New Wholesale Customer Contract Council is requested to authorize a new contract with the Kaufman County Fresh Water Supply District #1A (FWSD).

	b.	Annual Performance Update on the City of Garland Housing Agency 2015-2019 Five-Year Plan and Administrative Plan Approval Council is requested to consider approval of the Garland Housing Agency's Annual Performance Update and the Administrative Plan revisions in order for the City of Garland to continue to receive funding from the Department of Housing and Urban Development to provide rental assistance to low income families. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the July 17, 2018 Regular Meeting.

3.		Verbal Briefings:

	a.	Fire Department Presentation of Mechanical CPR Devices The Fire Department will provide a brief presentation and demonstration of the mechanical CPR devices that were authorized by City Council following the closing of Baylor Garland. These devices are performing a high level of CPR and allowing the firefighters to be safer during the longer transports to hospitals outside of Garland. The device provides compressions that are the right depth, the right rate, and without tiring . These devices have not only helped our firefighters but have also increased the effectiveness and efficiencies on scenes where CPR is called for.

	b.	Consideration and discussion regarding a 2019 Bond Program Staff will provide a presentation outlining the tax rate impacts of a bond program based on different funding levels and implementation schedules. In addition, a community engagement strategy, appointment of a citizen bond committee, and development of a schedule of events based on either a May 2019 or November 2019 election date will be discussed.

	c.	Amendments to the Garland Development Code (GDC) Regarding Institutionalized Care of Alcoholic, Drug Dependent or Psychiatric Patients The Garland Development Code (GDC) does not currently define or recognize the institutionalized care of psychiatric, alcoholic or drug dependent patients in the applicable list of land uses. The former development code [Comprehensive Zoning Ordinance, No. 4647] defined these uses but it did not carry over into the adoption of the GDC in 2015. In order to address these types of uses consistently in the future, the proposed amendments formally define them, based on the previous code’s definition, and establish in which zoning districts to allow them--by Specific Use Provision (SUP).

	d.	Heritage Tourism Program Staff will provide a briefing to the City Council on proposed projects for the Heritage Tourism Program. In the FY18 Operating Budget, Council approved funding for the program with the goal of promoting Downtown as a tourist destination.

Item Title:	Wastewater New Wholesale Customer Contract

ISSUE
This is to inform the council of a potential new wholesale wastewater customer agreement with the City of Garland and the Kaufman County Fresh Water Supply District #1A. (KCFWSD)

RECOMMENDATION
Unless otherwise directed by Council, it is recommended that staff be authorized to develop a new contract with the Kaufman County Fresh Water Supply District #1A. (KCFWSD). A final negotiated contract will be brought back to Council at a later date.
BACKGROUND
The City of Garland owns and operates two wastewater treatment plants: Rowlett Creek located in Garland with a total treatment capacity of 24 Million Gallons per Day (MGD), and Duck Creek located in Sunnyvale with a total treatment capacity of 40 MGD. In addition to treating its own wastewater, the treatment plants are considered a regional system as they treat all wastewater from the cities of Rowlett, and Sachse, including portions of Dallas, Richardson and Sunnyvale. (See Attached Map) These treatment costs are administered by individual wholesale contracts with each city. The City of Garland was approached in late 2017 by representatives of KCFWSD, which provide water and wastewater utility services to the Windmill Farms subdivision located in Forney, about the possibility of Garland providing wholesale wastewater treatment service to the KCFWSD. This service would be provided by the Duck Creek Wastewater Treatment Plant located in Sunnyvale. Currently, the KCFWSD wastewater needs are met by a limited wastewater treatment package plant which has reached capacity and has historically represented an unreliable way to treat wastewater. To ensure regulatory compliance and the integrity of the environment, as well as to ensure development can continue in the area, a more reliable method of wastewater treatment is needed. The attached map indicates the proposed sewer line and KCFWSD service area. The City of Garland has sufficient capacity in its Duck Creek Wastewater Treatment Plant to provide the requested service. Providing the requested service will also be of financial benefit to the City’s retail customers, as any additional wholesale costs will provide a cost off-set to the retail rates. City staff recommends that the City Council authorize continued discussions between the parties and authorize the development and execution of a wholesale wastewater treatment contract between the City and KCFWSD.
CONSIDERATION
If authorized, it is anticipated that a contract will be developed and submitted to the council for approval by the end of 2018. KCFWSD will construct all piping and metering necessary in order for the City to treat their wastewater at the Duck Creek WWTP. There will be minimal costs incurred by the City.

Item Title:	Annual Performance Update on the City of Garland Housing Agency 2015-2019 Five-Year Plan and Administrative Plan Approval

ISSUE
To consider approval of the Garland Housing Agency's Annual Performance Update and the Administrative Plan revisions in order for the City of Garland to continue to receive funding from the Department of Housing and Urban Development to provide rental assistance to low income families.
OPTIONS
(1) At the July 17, 2018 regular City Council meeting, the City Council can approve a resolution adopting the GHA's Annual Performance Update on the Five-Year Plan for submission to HUD and a resolution to approve the Administrative Plan. (2) The City Council could take no action. Funding for the fiscal year 2018-2019 housing assistance payments for 1,526 families and approximately $11 million could be withheld by HUD.
RECOMMENDATION
For the City Council to adopt the accomplishments presented in the FY 2018 Annual Plan and approve the Garland Housing Agency's Administrative Plan. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the July 17, 2018 Regular Meeting.
BACKGROUND
The U.S. Department of Housing and Urban Development (HUD) signed into law on October 4, 1988, the Quality Housing and Work Responsiblity Act of 1998 (QHWRA). The QHWRA merges the Section 8 Voucher and Certificate programs, and it requires all housing authorities and agencies to develop a 5 year plan and an annual strategic plan prior to receiving funds from HUD. The development of the Garland Housing Agency Plans requires the City to engage in a process that examines the needs of those being served in public housing, consults with interested and affected parties, and designs strategies for addressing those needs. The City Council approved the Garland Housing Agency's 5-Year Plan on August 18, 2015. The attached electronic document is a summary of the City of Garland Housing Agency's (GHA) annual performance under its third year of the 2015-2019 Five-Year Plan, as required by HUD. No changes were made to the plan since approval in 2015. HUD requires each agency to submit an annual performance progress report on their five-year plan. The progress report must be made available to the public for comments, prior to submitting to HUD for annual certification. The Annual and Administrative Plans were made available for public viewing by interested parties at the Garland Housing Agency on April 18, 2018, for the required 45-day comment period. All this information was made available to the public through advertisement in the Dallas Morning News. A public hearing was held at the Garland Housing Agency's office for public comments on June 12, 2018. There were no comments from the public hearing. HUD requires that each Housing Agency develop and adopt an Administrative Plan that identitifes the policies the agency will follow to administer the Housing Choice Voucher Program Funds. Each year the administrative plan is reviewed and changes are made as HUD regulations and policies are updated or changed and as internal policies need to be changed or updated to improve the administration of the program. Additionally, the GHA requested members of its advisory board to meet and discuss the update of the Annual Plan and the Administrative Plan on May 9, 2018. To increase participation in the process, the families that must attend an annual recertification briefing each May were utilized. There were 19 participants in attendance. Comments from the advisory board are attached.
CONSIDERATION
The approval of the annual performance report and any changes to the administrative plan are required in order for the City of Garland to continue to receive Housing Choice Voucher funds to provide housing assistance to low income families.
