DEFINITIONS:

Written Briefing: Items that generally do not require a presentation or discussion by the staff or Council. On these items the staff is seeking direction from the Council or providing information in a written format.

Verbal Briefing: These items do not require written background information or are an update on items previously discussed by the Council.

NOTICE: The City Council may recess from the open session and convene in a closed executive session if the discussion of any of the listed agenda items concerns one or more of the following matters:

(1) Pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct. Sec. 551.071, Tex. Gov't Code.

(2) The purchase, exchange, lease or value of real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.072, Tex. Gov't Code.

(3) A contract for a prospective gift or donation to the City, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.073, Tex. Gov't Code.

(4) Personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee or to hear a complaint against an officer or employee. Sec. 551.074, Tex. Gov't Code.

(5) The deployment, or specific occasions for implementation of security personnel or devices. Sec. 551.076, Tex. Gov't Code.

(6) Discussions or deliberations regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations; or to deliberate the offer of a financial or other incentive to a business prospect of the sort described in this provision. Sec. 551.087, Tex. Gov't Code.

(7) Discussions, deliberations, votes, or other final action on matters related to the City’s competitive activity, including information that would, if disclosed, give advantage to competitors or prospective competitors and is reasonably related to one or more of the following categories of information:

generation unit specific and portfolio fixed and variable costs, including forecasts of those costs, capital improvement plans for generation units, and generation unit operating characteristics and outage scheduling;
bidding and pricing information for purchased power, generation and fuel, and Electric Reliability Council of Texas bids, prices, offers, and related services and strategies;
effective fuel and purchased power agreements and fuel transportation arrangements and contracts;
risk management information, contracts, and strategies, including fuel hedging and storage;
plans, studies, proposals, and analyses for system improvements, additions, or sales, other than transmission and distribution system improvements inside the service area for which the public power utility is the sole certificated retail provider; and
customer billing, contract, and usage information, electric power pricing information, system load characteristics, and electric power marketing analyses and strategies. Sec. 551.086; Tex. Gov't Code; Sec. 552.133, Tex. Gov’t Code]


1.		Public Comments on Work Session Items Persons who desire to address the City Council on any item on the Work Session agenda are allowed three minutes to speak. Speakers are taken only at the beginning of the meeting, other than invited testimony. Speakers are grouped by Work Session item and will be taken in the order of the Work Session agenda. Speakers must submit to the City Secretary a completed speaker’s card before the beginning of the meeting. Speaker cards will not be accepted after the Mayor calls the meeting to order. Speaker cards are available in the lobby, at the visitor’s side of the Work Session Room, and from members of staff. Speakers are limited to addressing items on the Work Session agenda – any item relating to a Regular Session agenda item should be addressed at the Regular Session and any item not on an agenda may be addressed during the open microphone at the end of the Regular Session.

2.		Consider the Consent Agenda A member of the City Council may ask for discussion or further information on an item posted as a consent agenda item on the next Regular Meeting of the City Council. The Council Member may also ask that an item on the posted consent agenda be pulled from the consent agenda and considered for a vote separate from consent agenda items on the regular agenda. All discussions or deliberations on this portion of the work session agenda are limited to posted agenda items and may not include a new or unposted subject matter.

3.		Written Briefings:

	a.	Investment Portfolio Summary Staff presents the Portfolio Summary report to Council each quarter. The report is in compliance with the requirements of the Public Funds Investment Act. Management of the City's portfolios is conducted in accordance with the City Council Financial Policy, Statement of Investment Strategy and Investment Policy. Staff has submitted an updated Statement of Investment Strategy and Investment Policy for Council review and approval. The December 31, 2019, Portfolio Summary presented does not take into account any of the suggested changes to these Statements.

	b.	2020-2021 Federal Grants Calendar Council is requested to approve the 2020-2021 Federal Grants Calendar for the Community Development Block Grant (CDBG), HOME Partnership Grant (HOME) and Emergency Solutions Grant (ESG).

	c.	Annual Adoption of Council Policies Council is requested to approve the proposed changes to the 2020 Council Policies. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the February 18, 2020 Regular Meeting.

	d.	North Texas (Dallas) Internet Crimes Against Children (ICAC) Task Force Interlocal Agreement Council is requested to consider whether to enter into an interlocal agreement with the City of Dallas regarding the North Texas (Dallas) Internet Crimes Against Children (ICAC) Task Force and accept grant funding in the amount of $16,000.

	e.	Proposed Changes to City Council Investment Policy and Strategy The Texas Public Funds Investment Act (PFIA)requires governmental entities, including cities, to review the entities' investment policies and strategies annually and to provide a record of such review. In Garland, we do so through the yearly adoption of the Council Policies, of which the City's investment policy and strategy are a part. (See Article II, Division 3 of the Council Policies). Council is requested to approve the changes to the Council Investment Policy and Strategy.

4.		Verbal Briefings:

	a.	Consider Adoption of a "Party House" Ordinance At the request of Council Member David Gibbons, seconded by Council Member Jim Bookhout, Council is requested to address the issue of "party houses."

	b.	Transportation Quarterly Update The Director of Transportation will present the quarterly update to Council on strategic transportation projects in Garland.

	c.	May 2 General Election Ordinance - Use of Hollabaugh Park for a Library Facility Council is requested to discuss and deliberate a draft ordinance ordering a general election for the City of Garland to be held on May 2, 2020 for the purpose of electing one Council Member each to respectively represent Districts 1, 2, 4 and 5; ordering a general election for the purpose of submitting to the qualified voters of the City, for adoption or rejection, a proposition authorizing the construction and use of a library facility within a portion of public property designated as parkland, commonly known as Hollabaugh Park; providing for a run-off election if needed; and providing for other matters relating to the conduct of the election. While Council will deliberate the election ordinance, the briefing will focus on Staff's recommendation to relocate the West Creek Branch Library at Hollabaugh Park.

	d.	Preview of 2020 Proposed CIP Staff will provide an overview of the 2020 Proposed Capital Improvement Program (CIP), which will be formally presented by the City Manager at the February 4, 2020 Regular City Council Meeting.

5.		Announce Future Agenda Items A member of the City Council, with a second by another member, or the Mayor alone, may ask that an item be placed on a future agenda of the City Council or a committee of the City Council. No substantive discussion of that item will take place at this time.

6.		Council will move into Executive Session

Item Title:	Annual Adoption of Council Policies

Summary of Request/Problem
Council policies, operating procedures, and the rules of order that govern how meetings are conducted by the Council are contained in a document entitled “Council Rules of Order and Procedure and Council Policies”. The document is commonly referred to as just the “Council Policies” for convenience. The City Charter requires the City Council to adopt the Council Policies annually. Although an evergreen provision contained in the policies keeps the previous year’s policies in effect until revised or readopted, nonetheless, annual adoption must be done at some point each year. Typically, the previous year’s policies are readopted by ratification along with such new changes as have been approved by Council during the course of the preceding year. At the January 13, 2020 Work Session, Council recently indicated its approval of additional amendments to the 2019 version of the Council Policies as proposed by the Administrative Services Committee to Article II, Division 1, Section 11 of the Council Policies relating to minimum meeting schedules, election of officers, and other matters governing the operations of the City’s boards and commissions. Those amendments have been incorporated into the attached draft. In addition to the Charter’s requirement of annual adoption of policies, State law requires an annual review of the City’s financial and investment policies and strategies. The Texas Public Funds Investment Act requires governmental entities, including cities, to review the entities’ investment policies and strategies annually and to provide a record of such review. In Garland, we do so through the yearly adoption of the Council Policies, of which the City’s financial and investment policies are a part. (See Article II, Division 3 of the Council Policies). This year, there are several changes to the City’s financial and investment policies being proposed by staff. A separate Council briefing will be provided in connection with those changes.
Recommendation/Action Requested and Justification
If Council concurs with the proposed changes to the City’s financial and investment policies, those changes will be incorporated into the 2020 Council Policies document and then the entirety will be offered for formal approval at the February 18, 2020 Regular Meeting as the “2020 Council Rules of Order and Procedure and Council Policies”. A draft of the proposed 2020 Council Policies (with the current version of the City’s financial and investment policies) is attached for review.

RECOMMENDATION

Unless otherwise directed by Council, this item will be scheduled for formal consideration at the February 18, 2020 Regular Meeting.
BACKGROUND
The Internet Crimes Against Children (ICAC) Task Force is a grant program funded under an award by the United States Department of Justice through their Office of Juvenile Justice and Delinquency Prevention, under the Federal Missing and Exploited Children’s Program. The Garland Police Department has been a member of the North Texas (Dallas) Internet Crimes Against Children Task Force for several years. The City of Dallas, has applied for and received grant funding from the Department of Justice on behalf of the Garland Police Department. The purpose of the grant is to target child solicitation and child pornography over the internet.
CONSIDERATION
Pending approval of the interlocal agreement, the Internet Crimes Against Children grant should provide $16,000 in funding. The grant will be for a 12-month period. At the conclusion of that time period, any unallocated funds must be returned to the City of Dallas. Funds must be used to supplement existing funds for program activities and cannot replace or supplant nonfederal funds that have been appropriated for the same purpose.

Item Title:	Proposed Changes to City Council Investment Policy and Strategy

ISSUE

In Garland, we do so through the yearly adoption of the Council Policies, of which the City's investment policy and strategy are a part. (See Article II, Division 3 of the Council Policies). This year, there are several changes and updates to the Council Investment Policy and Strategy that staff and the City's Investment Advisor, Hilltop Securities Asset Management, would like for Council to consider approving.

RECOMMENDATION

BACKGROUND
On October 8, 2019, Council approved a resolution authorizing the City Manager to execute an Investment Advisory Agreement with Hilltop Securities Asset Management. After approval of this agreement, the Financial Services Department staff and Hilltop began reviewing the Council Investment Policy and Strategy with the intent of updating the policy based on recent changes in law, as well as to include the roles and responsibilities of Hilltop Securities Asset Management. A full redline copy of the proposed changes is attached for City Council review and a summary of all the major changes being proposed is below: Investment Strategy Benchmarks for Operating, Reserve, and Debt Funds - Currently, the Investment Strategy states that a rolling average yield of the two-year Treasury Note for the Operating Fund, six-month Treasury Bill for Debt Service Funds, and 3-year Treasury Note for Reserve Funds are used for benchmarking purposes. In order to provide a more accurate reflection of the performance of our investment portfolio, it is proposed to use the trailing average of the Constant Maturity Treasury (CMT) index published by the Federal Reserve. This Fed index is based on the average yield of various treasury securities maturing at different periods and is a widely used benchmark for municipal government investment portfolios. In addition, it is proposed to change the benchmark's maturity length to more closely match the weighted average maturity of the City's portfolio. For example, this proposed change will move our Operating Funds benchmark from a 2-year treasury note benchmark to the 6-month CMT. Add Roles and Responsibilities of the City's Investment Advisor to the Investment Policy - The City began using an Investment Advisor in October of 2019. Therefore, staff is proposing that Council incorporate the investment advisors roles and responsibilities into the Investment Policy.The proposed language suggested include the following: Investment Advisor will be required to adhere to the spirit, philosophy and specific term of the Investment Policy/Strategy and shall invest within the same “Standard of Prudence”. In addition, the investment advisor must be registered with the Securities and Exchange Commission (SEC) under the Investment Advisors Act of 1940 as well as with the Texas State Securities Board. The Investment Advisor responsibilities may include assisting the City in management of its funds, review of investment policy, development of appropriate investment strategies, security analysis, trade execution, security clearance, broker dealer compliance, investment reporting and security documentation. Investment Advisor will be responsible for soliciting competitive quotations from at least three securities dealers and ensure that a fair market price is obtained. In addition, the advisor shall be responsible for performing due diligence on and maintain a list of broker/dealers with which it shall transact business on behalf of the City. The advisor shall annually present a list of its authorized broker/dealers to the City for review and likewise shall execute the aforementioned written instrument stating that the advisor has review the City’s investment policy and has implemented reasonable procedures and controls in an effort to preclude imprudent investment activities with the City. The advisor shall obtain and document competitive bids and offers on all transactions and present these to the City as part of its standard trade documentation. Updates Due to Change in Law or Practice - Several items in the policy needed to be updated based on changes in law or practice including the following: The Public Funds Investment Act requires the City's investment officers attend ten hours of training related to investment responsibilities during the first year of employment and not less than 8 hours of instruction every two years thereafter. Titles of the City's Investment Officers have changed due to staff turnover or promotion and have been updated to include the Finance Director, Cash and Debt Manager and Controller. The list of PFIA authorized investment instruments was updated to include all US governmental agencies and government sponsored enterprises backed by the full faith and credit of the US government. SEC registered no-load money market funds and state investment pools must have a weighted average of 60 days now rather than 90 days. Commercial Paper continues to be rated at no less than A1 or P1. However, it is proposed to increase the stated maturity of these investments to 270 days rather than 180 days, as well as change the provision of no more than 2% of any one issuer to be held to no more than 5% of any one issuer held. This proposed change is in compliance with the PFIA and will allow staff the flexibility to purchase high quality commercial paper, if and when it is in the best interest of the City. In order to be consistent with the requirements of state law, rather than listing out the securities approved for collateral with the City, the policy is proposed to be changed to require the City's depository bank to be in full compliance with the Government Code 2257, Collateral for Public Funds.
CONSIDERATION
All proposed changes to the Council Investment Policy and Investment Strategy are in compliance with the Public Funds Investment Act.

Item Title:	Consider Adoption of a “Party House” Ordinance

Summary of Request/Problem
At the January 6, 2020 Work Session, Council Member David Gibbons, seconded by Council Member Jim Bookhout, requested a briefing and recommendations addressing the phenomenon of what is colloquially known as “party houses." The party house problem is often associated with short-term rentals: Visitors rent a property for a few days (or nights) and sponsor what becomes a major event involving large numbers of guests, loud music or even live bands, liberal use of alcohol and associated problems of traffic, parking and justifiably upset neighbors. Anecdotal evidence suggests that some of the parties are actually moneymaking ventures where guests pay a cover charge to attend or at which alcoholic beverages are sold illegally. Party house ordinances are in place in cities throughout the nation, especially in college towns and other locations with younger populations. For the most part these ordinances have three common components: (1) A definition section that attempts to identify in words what constitutes “loud or unruly gatherings” (which is the usual legal term applied to “party houses”); (2) a prohibition section that makes loud or unruly gatherings a criminal offense or civil infraction (if so allowed under the law of the state in which the city is located); and (3) a penalty or enforcement provision. From a brief review of news articles and other coverage of party house ordinances, the most common enforcement tool provided in party house ordinances is some sort of administrative penalty. Other cities assess response cost fees that ostensibly make the owner of the property or the sponsor of the party liable for the costs associated with sending police officers to break up the party. The technique used to impose a penalty or response cost fee differs from city to city, but often involves a tiered system of notices and placards (indeed, party house ordinances are often referred to as “orange sticker ordinances”). Other ordinances employ more direct methods of enforcement. Litigation challenging the validity of party house ordinances has been sparse and mostly unsuccessful. Nonetheless, apparently due to litigation threats or other challenges, some party house ordinances carve out exceptions for expressive activities that may fall within the protections of the First Amendment. Other ordinances have been modified to add or bolster due process provisions under which a property owner or other affected person may challenge the designation or placarding of the property as a party house or the imposition of a fine, fee or other penalty. In 2018 the City of Los Angeles adopted a party house ordinance that is typical of those found in other cities around the country. A copy of the Los Angeles ordinance is attached as a sample (but not necessarily as an example) of a common version of party house ordinance.
