Hold public hearings on the following zoning cases: a. Consider the application of Stella Aluko, requesting approval of a Specific Use Permit for a Kindergarten, Preschool, or Child Care Center on property zoned Planned Development (PD) District 69-31 and in the IH 635 Overlay. The property is located at 1430 Northwest Highway. (Zoning File 13-24) The proposal is for approval of Specific Use Permit to operate a childcare center on property zoned Planned Development (PD) for General Business Uses. At the July 22, 2013 meeting, Plan Commission (by a 7 to 0) vote recommended approval with the provision that concrete pipe bollards be installed around the perimeter of the play area. b. Consider the application of Cosmo Foundation, requesting approval of a Specific Use Permit for a Charter School on property zoned Single Family (SF-7) District and in the SH 190 Overlay. (Zoning File 13-29) The proposal is for approval of a Specific Use Permit to expand the enrollment of a Charter School on property zoned Single Family (SF). At the July 22, 2013 meeting, the Plan Commission (by a 6 to 1) vote denied the request. The request before the Commission included building material Variances for the placement of portable buildings on the campus. The applicant has modified the request to accommodate the increased enrollment within the existing facility, eliminating the proposal to add portable buildings.
Hold a public hearing on the 2013-2014 Proposed Budget. Section 5, Article VII, of the City Charter requires that a public hearing be held on the Proposed Budget for the coming fiscal year. At the public hearing, all interested persons shall be given an opportunity to be heard for or against any item contained in the Proposed Budget. The Proposed Budget for 2013-14 has been available for public inspection in the City libraries, in the City Secretary’s Office, and on the City’s website since August 7, 2013. A second public hearing on the Proposed Budget is scheduled for Thursday, August 29, 2013. The 2013- 14 Budget is scheduled to be adopted on September 3, 2013.

Hold a public hearing on the Proposed 2013-14 Tax Rate The Texas Property Tax Code, Section 26.05 (d), provides that a governing body may not adopt a tax rate that exceeds the lower of the rollback tax rate or the effective rate until the governing body has held two public hearings on the proposed tax rate and has otherwise complied with Section 26.06 and Section 26.065. The 2013-2014 Proposed Budget is based on a tax rate of 70.46 cents per $100 of valuation, which does exceed the effective tax rate of 70.43 cents due to a 0.6% increase in the tax rate but does not exceed the rollback rate of 73.59 cents. A second public hearing is set for Thursday, August 29, 2013, at 7 p.m. 10. Consider an ordinance ordering and providing notice of a Special Home- Rule Election in the City of Garland, to be held November 5, 2013 for the purpose of submitting to the qualified voters, for the adoption or rejection, a proposition regarding an increase in the ad valorem tax rate the revenue from which will be dedicated to and use for street refurbishment and a proposition authorizing the sale or exchange of Bunker Hill Park. This item was considered at the August 5, 2013 Work Session.
Consider appointments to Boards and Commissions. Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.
12. Citizen comments. Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act. 13. Adjourn. All Regular Council meetings are broadcast live on CGTV, Time Warner Cable Channel 16, and Verizon FIOS TV 44. Meetings are rebroadcast at 9:00 a.m. and 7:00 p.m. on Wednesday-Sunday and at 7:30 p.m. on Thursday.
