The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.

LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the September 5, 2017 Regular Meeting.
 
2. Consider approval of the following bids:
 
a.  
Grounds and Landscape Maintenance   Bid No. 4413-14
     
Qualicare Landscape Services $16,867.00  

This request is to provide grounds and landscape maintenance at additional City facilities under the existing Term Contract with Qualicare Landscape Services.  The proposed Change Order increases the existing contract amount of $56,066.00 to approximately 30% for a new contract amount of $72,933.00
 
b.  
Replacement Toughbook Computers for Fire Department Fleet   Bid No. 1066-17
     
GTS Technology Solutions $190,231.41  

This request is to replace the aging computers that are installed in the Fire Department fleet.
 
c.  
Cleaning and Closed Circuit Television Inspection of Sewer Lines    Bid No. 0867-17
     
RKM Utility Services, Inc. $300,000.00  

This request is to provide cleaning and closed circuit television inspection of existing sewer lines of various sizes and locations throughout the city.  This is a term agreement with four optional renewals.

Duck Creek Wastewater Treatment Plant Raw Water Lift Pump Replacement   Bid No. 0974-17
     
Xylem Water Solutions $236,056.94  

This request is to purchase a raw water lift pump to be used by Duck Creek Wastewater Treatment for pumping raw water through the treatment system.

Ben Davis Substation Flood Study - Phase II   Bid No. 1085-17

This request is to obtain engineering services related to the study of the flooding and regulatory impact of proposed GP&L flood improvements at the Ben Davis Substation.

GP&L Naaman to Apollo Transmission Line Rebuild Engineering Services    Bid No. 1081-17
     
R-Delta Engineers $533,400.00  

This request is to obtain engineering services necessary to support voltage conversion from 69 kV to 138 kV for the GP&L Naaman to Apollo (NA-AP) transmission line.

This request is to begin Phase I demolition and concrete re-pavement of deteriorating asphalt parking lots in the Parks System.  Due to the complex nature of the project, an Optional Contingency is included for any additional work that may be required.

This request is to purchase property insurance to replace current coverage expiring September 30, 2017.

The purpose of this Change Order is to provide additional Life Safety Project upgrades for the Central Library.  Due to the complex nature of the project, an Optional Contingency is included for any additional design work that may be required.

GP&L/TMPA Construction Labor for Power Line Relocations    Bid No. 1029-17

This request is to provide for the construction labor associated with the Shelby to Nevada power line relocations.
 
3. A public hearing was previously conducted for the following zoning case. Council approved the request and instructed staff to bring forth the following ordinance for consideration.
 
a.   Zoning File No. Z 17-35, City of Garland (District 1)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving an amendment to Planned Development (PD) District 15-20 for Mixed Use to remove the Transition Zone located at the southwest corner of Campbell Road and Lookout Drive and re-zone to Mixed Use-Mixed Residential on an approximately 300-acre tract of land located northeast of PGBT/SH 190, west of Holford Road, and south of the city limits line; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date.
 
4.   Consider a resolution authorizing the submission of a grant application to the Office of the Governor of the State of Texas for certain public safety, law enforcement, and homeland security projects; and providing an effective date.

Council is requested to consider a resolution in support of the Homeland Security Grant Program application to gain access to grant funding.
 
5.   Consider a resolution of the City Council of the City of Garland, Texas adopting the Federal Emergency Management Agency (FEMA) approved revised Hazard Mitigation Action Plan.

Council is requested to consider adopting the Garland Hazard Mitigation Action Plan (HazMAP).
 
6.   Consider a resolution authorizing the City Manager to execute an amendment to a Project Specific Agreement with Dallas County for repairs of bridges over Type B Thoroughfares within the City of Garland, Dallas County District 1; and providing an effective date.

Council is requested to consider a resolution authorizing the City Manager to execute Amendment No. 1 to the Project Specific Agreement with Dallas County.
 
7.   Consider a resolution authorizing the City Manager to execute an interlocal agreement with Dallas County relating to the continued operation of a Household Hazardous Waste Disposal Program; and providing an effective date.

Council is requested to consider a resolution authorizing the City Manager to execute an interlocal agreement with the Dallas Area HHW Network to continue participation in the program.
 
8.   Consider by minute action authorizing the City Manager to execute an Interlocal Agreement with Dallas County Hospital District d/b/a Parkland Health and Hospital System that will extend the Inter-local agreement signed in October of 2016 between Garland and Parkland, by an additional two years, for Bio-Tel System Services in the amount of $180,068.72.

At the September 18, 2017 Work Session, Council considered executing the amendment delivered to the Garland Fire Department by the Dallas County Hospital District d/b/a Parkland Health & Hospital System.  The City of Garland uses Bio-Tel services to provide medical direction to EMS.  
 
9.   Consider by minute action approving the Wholesale Wastewater Contract with the Town of Sunnyvale.

At the April 17, 2017 Work Session, Council was presented a new wholesale wastewater contract with the Town of Sunnyvale. Garland’s prior wholesale wastewater contracts were not consistent in terms and conditions between wholesale customers, nor were they fully reflective of the numerous changes that have occurred in wastewater regulation in recent years. More specifically, these contracts contained conflicting provisions which complicated the administration of the contracts, particularly in the area of wastewater charges. The contract with the Town of Sunnyvale is the first of five renewals with neighboring wholesale wastewater customers that will be up for renewal in the next few years to ensure operational and financial consistency.
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
10.   Hold a public hearing regarding the 2017-18 Proposed Budget

Section 5, Article VII, of the City Charter requires that a Public Hearing be held on the Proposed Budget for the coming fiscal year.  At the Public Hearing, all interested persons shall be given an opportunity to be heard for or against any proposed item in the Budget.  The Proposed Budget for 2017-18 has been available for public inspection in the City libraries, in the City Secretary's Office, and on the City's website since August 2, 2017.  Previous Public Hearings were held on August 15 and August 24, 2017.

This budget will raise more total property taxes than last year's budget by $7,039,306 or 8.02%, and of that amount, $1,460,036 is tax revenue to be raised from new property added to the tax roll this year.  
 
11.   Hold a public hearing regarding the Proposed 2017-18 Tax Rate

The Texas Property Tax Code, Section 26.05 (d), provides that a governing body may not adopt a tax rate that exceeds the lower of the rollback tax rate or the effective rate until the governing body has held two public hearings on the proposed tax rate and has otherwise complied with Section 26.06 and Section 26.065.  The 2017-18 Proposed Budget is based on a tax rate of 70.46 cents per $100 of valuation, which does exceed the effective tax rate of 65.31 cents due to a 7.89% increase in taxable values.  This budget will raise more total property taxes than last year's budget by $7,039,306 or 8.02%, and of that amount, $1,460,036 is tax revenue to be raised from new property added to the tax roll this year.  Previous public hearings were held on August 15, August 24, and September 5, 2017.
 
12.   Adoption of the 2017-18 Budget

In accordance with the City Charter, the City Manager presented his recommended Budget for fiscal year 2017-18 to the City Council on August 1, 2017.  Copies were made available for public inspection at the City libraries, at the City Secretary's Office, and on the City's website.  Public hearings were held on August 15, August 24, and September 19, 2017.  An ordinance reflecting final decisions regarding the Budget for 2017-18 and revised budgets will be prepared for the Mayor's signature upon final direction from the City Council.
 
13.   Adoption of 2017-18 Property Tax Rate

The City Council has considered an Ad Valorem Tax Rate of 70.46 cents per $100 of valuation for the fiscal year beginning October 1, 2017.  All meetings, notices, and public hearing requirements related to the adoption of the Tax Rate have been met in accordance with State law.  Council is requested to consider approving an ordinance setting the Ad Valorem Tax Rate at 70.46 cents per $100 of valuation for 2017-18.
 
14.   Rate and Fee Changes for 2017-18

In considering the 2017-18 Proposed Budget, the City Council reviewed the adjustments to existing rates and fees.  Revenue estimates included in the 2017-18 Proposed Budget are based on these actions.  An ordinance will be prepared for the Mayor's signature once final direction has been given by the City Council.
 
15.   Consider an ordinance of the City of Garland, Texas, establishing civil service classifications within the Police and Fire Departments; prescribing the number of positions in each classification; prescribing the base salary and types of pay for those classifications; and providing an effective date.

Pursuant to Chapter 143 of the Local Government Code of Texas, the City Council must establish the civil service classifications in the Police and Fire Departments, the number of positions in each classification, the base salary, and the types of incentive pays for each classification.
 
16. Consider appointments to Boards and Commissions.

Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
 
18. Adjourn.
