The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.

LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the February 20, 2018 Regular Meeting.
 
2. Consider approval of the following bids:
 
a.  
Ridgedale and Glenbrook Drives Water and Sewer Replacement    Bid No. 0129-18

This request is to provide for the replacement of existing water and wastewater lines along Ridgedale Drive from Kingsley Road to Woodbury Drive and Glenbrook Drive from Kingsley Road to Carroll Drive, as shown in the attached location map.

This request is to obtain professional engineering services associated with reconductoring the TMPA Ben Davis to McCree 138kV Transmission Line.

XIT Paving and Construction, Inc.  $360,000.00  

This request is to approve Change Order No. 2 for Centerville Road Street and Sidewalk Repairs that were not included in the original plans developed in 2016.
 
3. Public hearings were previously conducted for the following zoning cases. Council approved the requests and instructed staff to bring forth the following ordinances for consideration.
 
a.   Zoning File No. Z 17-48, Nissi Development Group (District 6)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving a Specific Use Provision to allow Food Processing & Storage on a property zoned Industrial (IN) District and located at 3350 Marquis Drive; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date.
 
b.   Zoning File No. DD 18-01, GFF Architects (District 2)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving a Specific Use Provision for Drive-Through Service and an Automated Teller Machine (ATM) - Drive-Up on a 0.797-acre tract of land zoned Downtown (DT) District and located at 1001 Main Street; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date.
 
c.   Zoning File No. Z 17-47, Cates-Clark & Associates, LLP (District 1)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving 1) an amendment to Planned Development (PD) 94-06 District and 2) a Detail Plan for a Retail Store on an 11.1082-acre tract of land zoned Planned Development (PD) 94-06 District for Community Retail Uses and located at 3501 Mars Drive; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date. 
 
d.   Zoning File No. Z 17-41, Akram alzoubi and Masterplan Consultants (District 4)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving 1) an amendment to Planned Development District 13-32 for Mixed-Uses, and 2) a Detail Plan for a Car Wash (Automated/Rollover) and Automobile Repair (Minor) Uses on a 1.12-acre tract of land Zoned Planned Development (PD) District 13-32; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date.  
 
4.   Consider an ordinance of the City Council of the City of Garland, Texas, approving a tariff authorizing an annual Rate Review Mechanism ("RRM") as a substitution for the annual interim rate adjustment process defined by Section 104.301 of the Texas Utilities Code, and as negotiated between Atmos Energy Corp., Mid-Tex Division ("Atmos Mid-Tex" or "Company") and the Steering Committee of cities served by Atmos; requiring the company to reimburse cities' reasonable ratemaking expenses; adopting a Savings Clause; determining that this ordinance was passed in accordance with the requirements of the open meetings act; declaring an effective date; providing that the terms of any franchise between Atmos Mid-Tex control over any conflicting term contained in any tariff; and requiring delivery of this ordinance to the company and legal counsel for the Steering Committee.  

Council is requested to consider approval of the Settlement Agreement with Atmos Energy Mid-Tex Division ("Atmos Mid-Tex") and a revised Rate Review Mechanism (RRM) tariff.
 
5.   Consider a resolution agreeing to the sale of certain property located within the City of Garland and owned by taxing authorities including the City of Garland as the result of a tax sale; authorizing the Mayor to execute a Deed Without Warranty; and providing an effective date.

Council is requested to consider accepting the offer and sell the property to Mr. Jose Lopez.
 
6.   Consider an ordinance authorizing an amendment to the 2017-18 Operating Budget (Budget Amendment No. 1), providing for supplemental appropriation of funds in the General Fund, the Infrastructure Repair & Replacement Fund, the Information Technology Replacement Fund, the Public Safety Grant Fund, the Economic Development Fund, the Hotel/Motel Tax Fund, the Environmental Waste Services Fund, the Wastewater Utility Fund, and various funds associated with Purchase Order Encumbrances; and providing an effective date. 

Council is requested to consider approval of the ordinance amending the 2017-18 Adopted Budget.  
 
7.   Consider an ordinance cancelling the election to be held May 5, 2018 for unopposed candidates for Council Members for Districts 1, 4, and 5; declaring each of the unopposed candidates for Council Members within those respective districts elected to office subject to certain conditions precedent; ordering the City Secretary to post a copy of this ordinance at each polling place that would have been used in the election for such districts; continuing as unaffected by this ordinance the election for Council Members for District 2; and providing an effective date. 

Council is requested to accept the Certification and approve the ordinance to cancel the election for Council Districts 1, 4, and 5.
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
8. Hold public hearings on:
 
a.   Consider the application of Monk Consulting, requesting approval of a 1) an Amendment to Planned Development (PD) 97-39 District for Community Retail Uses, 2) a Concept Plan, and 3) a Detail Plan for Church or Place of Worship.  This property is located at 4440 Waterhouse Boulevard.  (File No. Z 18-05, District 3)

BEING an approximate 18.04-acre tract of land situated in the Thomas Stone Survey, Abstract No. 1330, City of Garland, Dallas County, Texas, being that same tract of land conveyed to Oasis Church at Lakeview Assembly of God, described as Tract One, by Special Warranty Deed with Vendor's Lien recorded in Instrument No. 201600128433, Official Public Records, Dallas County, Texas.  The site is located at 4440 Waterhouse Boulevard.  Approval of the proposal would allow for the construction of a church.
 
b.   Consider the application of RGA Architects, requesting approval of a Specific Use Provision for a High Risk Use on property zoned Industrial (IN) District.  The property is located at 3502 Regency Crest Drive. (File No. Z 18-03, District 5) 

BEING a certain 12.808-acre tract of land situated in the A.G. Collins Survey, Abstract No. 329, City of Garland, Dallas County, Texas, and being all of that certain tract of land to Stag Garland 2, L.P., by deed recorded in Instrument Number 201500332288, Official Public Records, Dallas County, Texas, and being all of Lot 1, Block 1, Gateway Business Park No. 4, an addition to the City of Garland, Dallas County, Texas, according to the plat thereof recorded in Volume 97119, Page 251, Deed Records, Dallas County, Texas. The property is located at 3502 Regency Crest Drive.  Approval of the proposal would allow for the indoor storage of a perfume additive used in the production of fabric softener/scent booster beads. The proposed quantity of raw goods storage is considered High Hazard Storage by the Garland Fire Marshall’s Office and requires Specific Use Provision approval. The additive will be stored inside an existing industrial building.
 
c.   Consider the application of Hidden Oaks Lot Venture, Ltd., requesting approval of 1) an Amendment to Planned Development (PD) 17-04 District for Single-Family Attached (Townhouse) Uses and 2) an Amended Detail Plan for Dwelling, Single-Family Attached (Townhouse) Use.  This property is located at to the east of Lavon Drive, between Foster Road and Crist.  (File No. Z 18-07, District 1)

BEING an approximate 13.3868-acre tract of land situated in the T.V. Griffin Survey, Abstract Number 528, in Dallas County, Texas, being part of a called 15.501 acre tract of land described in a deed recorded in Volume 2001229, Page 10037, in the Deed Records of Dallas County, Texas.  The site is located to the east of Lavon Drive, between Foster Road and Crist.  Approval of the proposal would allow an amendment to the existing Detail Plan of a previously approved townhome development by establishing a phasing plan for construction, and to expand the overall project boundaries, thus increasing certain lot depths.
 
d.   Consider the application of Winkelmann & Associates, Inc., requesting approval of 1) an amended Concept Plan and 2) a Detail Plan for Dwelling, Multi-Family Use on property zoned Planned Development (PD) 11-32 District for Multi-Family Uses and Retail Uses. This site is located at 4689 Saturn Road and 1651, 1551 and 1451 Marketplace Drive.  (File No. Z 18-13, District 5)

BEING an approximate 11.915-acre tract of land situated in the Soloman Dixon Survey, Abstract No. 408, being a portion of Lots 1R2, 4, and 5, Block 1, and all of Lot 6 Block 1, Eastgate No. 1 Fourth Replat, an addition to the City of Garland, Dallas County, Texas, according to the Plat thereof recorded in County Clerk's Instrument No. 20080057168, Official Public Records, Dallas County, Texas.  The site is located at 4689 Saturn Road and 1651, 1551 and 1451 Marketplace Drive.  (District 5).  Approval of the proposal would allow for the development of an approximately 300-unit multi-family residential complex comprised of five buildings, parking, and amenities.
 
9. Consider appointments to Boards and Commissions.

Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
