The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.

LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the April 17, 2018 Regular Meeting.
 
2. Consider approval of the following bids:
 
a.  
Backhoe/Loader Tractor for Water Department    Bid No. 0600-18

This request is to purchase one Backhoe/Loader Tractor to be used by the Water Department in their daily operations.

 This request is to purchase one Front Loader Truck to be used by the EWS Department in their daily operations.

This request is to conduct an alignment study of approximately 4,200 linear feet for Naaman School Road between Brand Road (North) and State Highway 78 as well as approximately 6,700 linear feet for Brand Road (South) between Beltline Road and Naaman School Road.

This request is to finalize the alignment study for Holford Road between Arapaho and Creekwood Drive.

This request is to provide needed renovations to the Granger Recreation Center.  Due to the complex nature of the project, an Optional Contingency is included for any unforeseen additional repairs that may be required.
 
3. A public hearing was previously conducted for the following zoning case. Council approved the request and instructed staff to bring forth the following ordinance for consideration.
 
a.   Zoning File No. Z 18-15, Star Plus, Inc. (District 6)

Consider an ordinance amending the Garland Development Code of Garland, Texas; by approving a Specific Use Provision for a Food Processing and Storage Use on a 2.23-acre tract of land zoned Industrial (IN) District and located at 3925 Miller Park Drive; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date.
 
4.   Consider a resolution authorizing the acceptance of a Texas Department of Transportation (TxDOT) Selective Traffic Enforcement Program (STEP) - Click It or Ticket (CIOT) Grant in the amount of $11,374.58; and providing an effective date.

Council is requested to approve a resolution authorizing the City Manager to accept the State of Texas Department of Transportation (TxDOT) Selective Traffic Enforcement Program (STEP) Grant "Click It or Ticket" for May 22, 2018 - June 4, 2018 in the amount of $11,374.58.
 
5.   Consider a resolution approving and funding the 2017-2018 Cycle 2 Neighborhood Vitality Matching Grant Projects.

Council is requested to consider a resolution approving and funding the 2017-18 Cycle 2 Neighborhood Vitality Matching Grant Projects. 
 
6.   Consider a resolution of the City of Garland finding that Oncor Electric Delivery Company, LLC's application for approval of a distribution cost recovery factor pursuant to 16 Tex. Admin. Code 25.243 to increase distribution rates within the City should be denied; finding that the City's reasonable rate case expenses shall be reimbursed by the company; requiring notice of this resolution to the company and legal counsel; and setting an effective date.  

Council is requested to adopt the proposed resolution to suspend the rate increase application and preserve current rates pending further action. 
 
7.  
Consider a resolution agreeing to the sale of certain property located within the City of Garland and owned by taxing authorities including the City of Garland as the result of a tax sale; authorizing the Mayor to execute a Deed Without Warranty;and providing an effective date.

Council is requested to accept the offer and sell the property to the Garland Housing Finance Corporation.
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
8.   Hold a public hearing to amend the project plan and financing plan for Tax Increment Financing (TIF) Reinvestment Zone #1 (Downtown/Forest-Jupiter)

At the April 30, 2018 Work Session, Council was provided information related to the Downtown/Forest-Jupiter Tax Increment Financing (TIF) Reinvestment Zone #1 Project Plan and Financing Plan. The TIF board provided an overview of projects they recommend be added to The Project Plan and Financing Plan (projects are required by state law to be listed in these plans before TIF Funds can be used).       
 
9.   Consider an ordinance of the City of Garland adopting the revised Project and Financing Plan for the Downtown/Forest-Jupiter Tax Increment Financing Reinvestment Zone (TIF #1); and providing an effective date.  

Council is requested to approve, amend, or reject the ordinance revising The Project and Financing Plan for TIF #1. 
 
10. Hold public hearings on:
 
a.   Consider the application of Masterplan Consultants, requesting approval of 1) a Change in Zoning from Agricultural (AG) District to Planned Development (PD) District for Multi-Family Uses and 2) a Detail Plan for Multi-Family Uses.  The property is located at 4701 Bunker Hill Road. (File No. Z 17-43, District 1)

BEING an approximate 41.79-acre tract of land situated in the Daniel Crist Survey, Abstract No. 226, Dallas County, Texas, and being property described as two tracts of land in deed to Norberto Guillen as recorded in Volume 2002058 at Page 7057 of the official public records of Dallas County, Texas.  Approval of the request would allow a Planned Development (PD) District and Detail Plan for an approximately 291-unit multi-family development. 
 
b.   Consider the application of AMCAL Multi-Housing, Inc., requesting approval of 1) a Zoning Change from Planned Development (PD) 95-20 District for Light Commercial Uses and Community Retail (CR) District to a Planned Development (PD) District for Multi-Family Uses and 2) a Detail Plan for Elder Care-Independent Living. The property is located at 902 Lavon Drive, 1014 Lavon Drive and 314 Castle Drive. (File No. Z 18-08, District 2)

BEING an approximate 11.299-acre tract of land situated in the William Turner Survey, Abstract Number 1483, in the City of Garland, Dallas County, Texas, and being all of Tract C, Block 1 of Shorehaven Village, Second Installment, an addition to the City of Garland as recorded in Volume 382, Page 1145, Map Records, Dallas County, Texas, and said tract being all of a tract of land described to Harvest Church of God in a Special Warranty Deed With Vendor's Lien as recorded in Instrument Number 201500221528, Official Public Records, Dallas County, Texas.   Approval of the request would allow the construction of a senior living facility (independent living).
 
c.   Consider the application of IDI Logistics, requesting approval of amendments to Planned Development (PD) District 16-07 for Industrial Uses. The property is located at 3800 Leon Road. (File No. Z 18-16, District 5)

BEING a 29.053-acre tract of land situated in the John Casey Survey, Abstract No. 351, the John Casey Survey, Abstract No. 350, and the John T. Corcoran Survey, Abstract No. 348, City of Garland, Dallas County, Texas, being all of Lot 1, Block 1 and Lot 2, Block 1 Garland Logistics Center, an addition to the City of Garland, Dallas County, Texas according to the plat thereof recorded in County Clerk's Instrument # 201600351809  of the Official Public Records of Dallas County, Texas.  Approval of the request would allow a Planned Development District 16-07 to allow screened outside storage, and clarify and reduce the list of permitted uses with Planned Development District 16-07.
 
d.   Consider the application of Kimley-Horn & Associates, requesting approval of 1) Amendments to Planned Development (PD) 16-10 District for Industrial Uses including Retail Store, 2) Amendments to a Detail Plan for Convenience Store; Fuel Pumps, Retail; Retail Store; Restaurant, Drive-Through and Car Wash, Automated/Rollover, 3) Amendments to a Specific Use Provision for Restaurant, Drive-Through and 4) a Zoning Change from Planned Development (PD) 16-10 District to Industrial (IN) District. The property is located on the northeast corner of West Miller Road and South Jupiter Road. (File No. Z 18-18, District 6)

BEING one tract of land with approximately 8.232 acres and identified as Lot 1 on Block 1 of the Bluestone Garland Addition, an addition to the City of Garland, as recorded in Instrument No. 201600364479, M.R.D.C.T., City of Garland, Dallas County, Texas.  Approval of the request would allow the applicant to acquire a portion of the subject property (a rectangular area located on the northeast corner of the subject property) and rezone it to Industrial (IN) District. Such portion of the subject property would be removed from the existing Planned Development (PD) 16-10 District, out of the Detail Plan and out of Specific Use Provision; subsequently, it would be combined with the property immediately to the north for the development of a distribution center.
 
e.   Consider the application of the City of Garland, requesting approval of 1) a Change in Zoning from Urban Business (UB), Community Retail (CR), and Community Office (CO) to a Planned Development (PD) District for Mixed Uses. The property is generally bound by Bobtown Road on the north, Overglen Drive on the south, and extending approximately 1,500 feet east and 1,700 feet west of Rosehill Road. (File No. Z 18-20, Districts 3 and 4)

BEING approximately 138.6 acres of land with portions situated in the McKinney & Williams Survey, Abstracts No. 1036 and 1037, the W S Pegues Survey, Abstract No. 1158, and the Andrew J Robinson Survey, Abstract No. 1260, in the City of Garland, Dallas County, Texas. Approval of the request would allow for future mixed-use development, including but not limited to, Single-Family Detached, Single-Family Attached (Townhouse), Multi-Family, Office, Retail, Service, and Commercial Uses.
 
11. Citizen comments.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
 
12. Adjourn.
