The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.


 

 
             
LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the August 6, 2019 Regular Meeting.
 
2. Consider approval of the following bids:
 
a.  
Central Park Playground   Bid No. 0961-19
     
Wall Enterprises, Inc.  $807,747.40  

This request is to develop a new inclusive playground in Central Park.
 
b.  
Certified Hydraulic System Rebuild    Bid No. 1240-19
     
Holt Cat $121,391.55  

This request is to rebuild the hydraulic system on the Caterpillar 973D Track Loader Unit # 160-0209 that is used by the Landfill.
 
c.  
Engineering Services for TMPA McCree Substation Upgrades   Bid No. 1203-19
     
Black & Veatch $213,840.00  

This request is to provide professional engineering design services for TMPA McCree Substation upgrades. 
 
d.  
TMPA McCree to Centerville Transmission Project Materials    Bid No. 0955-19
     
Techline, Inc. $218,394.60  

This request is for the purchase of conductor, insulators and associated hardware for four transmission structures that are being replaced on the TMPA McCree to Centerville transmission line. 
 
e.  
Professional Engineering Design Services for Water Improvements   Bid No. 1223-19
     
LAM Consulting Engineering $161,422.00  

This request is to provide professional engineering design services for the replacement of water and wastewater lines on Mayfield and Keele Drive.

TMPA McCree to Centerville TxDOT Project - Rebar and Casings    Bid No. 0063-19
     
Techline, Inc. $319,310.00  

This request is to approve Change Order #1 to provide structure foundation materials, rebar and casings required to support the installation of four transmission structures that are being replaced on the TMPA McCree to Centerville transmission line.

Single-Family New Home Construction - 810 West Avenue F   Bid No. 1127-19
     
Lyon Construction $209,000.00  

This request is for the construction of a new, single-family home using the HOME Infill Federal grant funding.
 
             
h.  
Carter Complex Parking Lot Repaving    Bid No. 1011-19
     
Wall Enterprises, Inc.  $2,021,879.98  

This request is to replace the deteriorating asphalt parking lot at Carter Softball Complex along Oates Road in Audubon Park with a new concrete parking lot.
 
3. A public hearing was previously conducted for the following zoning case. Council approved the request and instructed staff to bring forth the following ordinance for consideration.
 
a.   Zoning File No. Z 19-07, Provident Realty (District 1)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving 1) an amendment to Planned Development (PD) District 95-56 for Community Retail Uses, 2) a Concept Plan and 3) a Detail Plan for a Convenience Store Use and a Retail, Fuel Pumps Use on a 3.434-acre tract of land located at 5345 North President George Bush Turnpike; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Section 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Notice of Conditions of Compliance Clause; a Savings Clause, and a Severability Clause; and providing an effective date.
 
4.   Approve by minute action authorizing the City Manager to sign the funding agreement with the North Central Texas Council of Governments.

The City of Garland applied for funding through the Regional Transportation Counil (RTC) for the reconstruction and widening of Shiloh Road between Kingsley Road and Miller Road. The RTC has granted the City of Garland funding for construction of this project. In order to accept the funding, the City of Garland and the NCTCOG must enter into a funding agreement.
 
5.   Approve by minute action the reappointment of Dr. Timothy Lambert for a two-year term as the Garland Health Authority and authorize the City Manager to renew interlocal agreements with the City of Rowlett and the City of Sachse for the purpose of public health services.

At the August 5, 2019 Work Session, Council considered confirming Dr. Timothy Lambert for a two-year term as the City Health Authority and authorize the City Manager to renew interlocal agreements with the City of Rowlett and the City of Sachse for the purpose of public health services. 
 
6.   Consider a resolution approving the continued receipt of its statutorily allocated share of the amount collected as prize fees on bingo games conducted within the municipal boundaries of Garland, Texas; directing the City Manager to provide notice of the City Council's decision no later than November 1, 2019; directing the City Manager to notify each licensed authorized bingo organization within the City's jurisdiction of the continued imposition of the fee; and providing an effective date. 

At the August 5, 2019 Work Session, Council considered approving a resolution and authorizing staff to submit proof of a vote to the Texas Lottery Commission in order to continue to receive a share of bingo prize fees. 
 
7.   Consider an ordinance amending Chapter 30 of the Code of Ordinances, Chapter 34 of the Code of Ordinances, and the Garland Development Code of the City of Garland, Texas, regarding changes to the regulation of building materials, the development approval process, and Planning and Zoning fees in accordance with new laws passed by the Texas Legislature during the 2019 legislative session; providing a Savings Clause; providing a penalty under the provisions of Section 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Severability Clause; and setting an effective date. 

Council is requested to approve an ordinance amending Chapter 30 of the Code of Ordinances, Chapter 34 of the Code of Ordinances, and the Garland Development Code in response to recently passed State legislation. A public hearing for this item was conducted at the August 6, 2019 Regular City Council meeting. 
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
8.   Appointment of the Garland Housing Finance Corporation

At the August 19, 2019 Work Session, Council interviewed the candidates interested in being appointed as the City of Garland's representative to the Garland Housing Finance Corporation for a six-year term beginning September 1, 2019.
 
9.   Hold a Public Hearing Regarding the 2019-20 Proposed Budget

Section 5, Article VIII, of the City Charter requires that a Public Hearing be held on the Proposed Budget for the coming fiscal year.  At the Public Hearing, all interested persons shall be given an opportunity to be heard for or against any item contained in the Proposed Budget.  The Proposed Budget for 2019-20 has been available for public inspection in the City libraries, in the City Secretary's Office, and on the City's website since August 7, 2019.  A second Public Hearing on the Proposed Budget is scheduled for Tuesday, August 27, 2019.
 
10.   Hold a Public Hearing Regarding the Proposed 2019-20 Tax Rate

The Texas Property Tax Code, Section 26.05 (d), provides that a governing body may not adopt a tax rate that exceeds the lower of the rollback tax rate or the effective rate until the governing body has held two public hearings on the proposed tax rate and has otherwise complied with Section 26.06 and Section 26.065.  The 2019-20 Proposed Budget is based on a tax rate of 76.96 cents per $100 of valuation, which exceeds the effective tax rate of 66.82 cents by 15.17%.  A second public hearing is set for Tuesday, August 27, 2019, at 7:00 p.m.
 
11. Consider appointments to Boards and Commissions.

Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
