The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible. Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall. Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.

LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting. Members of the audience are invited to participate. However, members of the audience are not required to participate. The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting.

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.

CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.

Consider approval of the minutes of the August 20 Regular Meeting and August 27 Special Session.

Consider approval of the following bids:

Design Services for Downtown - Infrastructure, Plaza and Surrounding Streetscapes		Bid No. 0937 - 19

Studio Outside, LLC		$2,442,142.00

This request is to provide professional design services for conceptual plan design, design development plans and detailed construction documents for multiple projects in Downtown including infrastructure around the Square, the public plaza and up to 15 blocks of surrounding streetscapes. Due to the complexity of this project, an Optional Contingency is included for additional services that may be required.

Rowlett Creek Wastewater Treatment Plant Administration Building Renovations		Bid No. 0550-19

This request is to provide needed renovations to the 25-year-old Rowlett Creek Wastewater Treatment Plant Administration Building.

Trails and Bikeways Master Plan Scope Expansion		Bid No. 0735-19

This request is to expand upon the previously approved Bicycle and Pedestrian Master Plan currently being performed by Halff Associates to include additional Scope of Work in order to generate a comprehensive Trails and Bikeways Master Plan for the City of Garland.

This request is to provide water and wastewater improvements in the alley between First Street and Fremont Drive. An Optional Contingency is included for any additional work that may be required.

This request is to provide Professional Engineering Design Services for the replacement of water and wastewater lines on Noble Lane, Victoria Drive and Lakeshore Drive.

This request is for the purchase of two replacement Pumper Trucks and one replacement Aerial Ladder Truck for Garland Fire Department.

This request is to obtain labor services for the installation of street light poles and LED street lights throughout the city as part of the GP&L Street Light Conversion CIP project. This is a term agreement that has three optional renewals.

This request is to provide architectural design and construction administration services for the new Animal Shelter.

Consider a resolution authorizing the submission and acceptance of an application to the Bureau of Justice Assistance Grant under the 2019 Edward Byrne Memorial Justice Assistance Grant program; and providing an effective date.

At the August 19, 2019 Work Session, Council was scheduled to consider a request from the Police Department to apply for the 2019 Edward Byrne Memorial Justice Assistance Grant (JAG) program for reducing crime and improving public safety.

Consider an ordinance amending the Tax Roll of the City of Garland, Texas and providing an effective date.

At the August 19, 2019 Council Work Session, Council was requested to consider the apporoval of an ordinance to amend the Tax Roll by $96,077.80.

Consider an ordinance amending Chapter 33, "Transportation", of the Code of Ordinances of the City of Garland Texas relating to the use and possession of shopping carts; providing a penality under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a savings clause and a severability clause; and providing an effective date.

At the August 19, 2019, Council Work Session, Council discussed an ordinance to resolve issues related to the use and possession of shopping carts.

Consider an ordinance authorizing the issuance of "CITY OF GARLAND, TEXAS, TAX NOTES, SERIES 2019B"; specifying the terms and features of said notes; levying a continuing direct annual ad valorem tax for the payment of said notes; and resolving other matters incident and related to the issuance, sale, payment, and delivery of said notes, including the approval and execution of a Paying Agent/Registrar Agreement and a Purchase Letter; and providing an effective date.

On May 15, 2019 Council authorized staff to issue Tax Notes, Series 2019A in the anount of $9,530.000, which is equivalent to a 6.5 cent increase in the debt service tax rate. At this time, it was anticipated that second tax note issuance would occur in September due to savings realized from the General Obligation Commercial Paper Program and growth in the tax base. The City has the capacity in the FY 2019-20 Proposed Budget to issue additional tax notes totaling $12,750,000 with no additional tax rate increase required. Proceeds from tax notes are an important funding source for the City's annual Street Reconstruction and Improvement Program and allow for the City to fund capital improvements without increasing the City's long-term debt burden.

Consider by minute action authorizing the City Manager to execute the second amendment to the Interlocal Agreement between City of Garland and Parkland Health and Hospital System for Medical Direction Services.

At the August 19, 2019 City Council Work Session the City Council considered the approval of the second amendment to an existing Interlocal Agreement between City of Garland and Parkland Health and Hospital System extending the current agreement for a two-year period effective October 1, 2019 and expiring September 30, 2021.

Consider by minute action approving an amendment to Article II, Division 1, Section 3 (M) (relating to posting of notices of potential quorums) and approve a policy to be included as Section 14 of Article II, Division 1 of the Council's policies (relating to the integrity of information).

At the August 19, 2019 Work Session, Council considered a report from the Administrative Services Committee regarding two proposed policy changes.

ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.

Hold a public hearing regarding the 2019-20 Proposed Budget

Section 5, Article VIII, of the City Charter requires that a Public Hearing be held on the Proposed Budget for the coming fiscal year. At the Public Hearing, all interested persons shall be given an opportunity to be heard for or against any item contained in the Proposed Budget. The Proposed Budget for 2019-20 has been available for public inspection in the City libraries, in the City Secretary's Office and on the City's webiste since August 7, 2019.

This budget will raise more total property taxes than last year’s budget by $16,584,574 or 15.47%, and of that amount, $2,131,145 is tax revenue to be raised from new property added to the tax roll this year.

Hold a public hearing regarding the Proposed 2019-20 Tax Rate

The Texas Property Tax Code, Section 26.05 (d), provides that a governing body may not adopt a tax rate that exceeds the lower of the rollback tax rate or the effective rate until the governing body has held two public hearings on the proposed tax rate and has otherwise complied with Section 26.06 and Section 26.065. The 2019-20 Proposed Budget is based on a tax rate of 76.96 cents per $100 of valuation, which exceeds the effective tax rate of 66.82 cents by 15.17%. Previous public hearings were held on August 20 and August 27, 2019.

Adoption of the 2019-20 Budget

In accordance with the City Charter, the City Manager presented his recommended Budget for fiscal year 2019-20 to City Council on August 6, 2019. Copies were made available for public inspection at the City libraries, at the City Secretary's Office, and on the City's website. Public hearings were held on August 20, August 27 and September 3, 2019. An ordinance reflecting final decisions regarding the Budget for 2019-20 and revised budgets will be prepared for the Mayor's signature upon final direction from City Council.

Adoption of 2019-20 Property Tax Rate

The City Council has considered an Ad Valorem Tax Rate of 76.96 cents per $100 of valuation for the fiscal year beginning October 1, 2019. All meetings, notices and public hearing requirements related to the adoption of the Tax Rate have been met in accordance with State law. Council is requested to consider approving an ordinance setting the Ad Valorem Tax Rate at 76.96 cents per $100 of valuation for 2019-20.

Rate and Fee Changes for 2019-20

In considering the 2019-20 Proposed Budget, the City Council reviewed the adjustments to existing rates and fees. Revenue estimates included in the 2019-20 Proposed Budget are based on these actions. An ordinance will be prepared for the Mayor's signature once final direction has been given by the City Council.

Consider and ordinance of the City of Garland, Texas, establishing civil service classifications within the Police and Fire Departments; prescribing the number of positions in each classification; prescribing the base salary and types of pay for those classifications; and providing an effective date.

Pursuant to Chapter 143 of the Local Government Code of Texas, the City Council must establish the civil service classifications in the Police and Fire Departments, the number of positions in each classification, the base salary and the types of incentive pays for each classification.

Hold a public hearing on:

Consider the application of K1 Concept, LLC, requesting approval of a Specific Use Provision for Used Goods, Retail Sales (Indoors) on a property zoned Community Retail (CR) District. This property is located at 1725 South First Street. (File No. Z 19-08, District 2)

BEING an approximate 1.234-acre tract of land identified as Lot 1, Block 7, of the CRESTHAVEN RESERVED PHASE II, a Replat of Lot 1, Block 7, CHRESTHAVEN FIRST INSTALLMENT, an addition to the City of Garland, Dallas County, Texas, and according to the map recorded under Instrument No: 201300037022, Map Records Dallas County, Texas. The applicant proposes to open a thrift store on a developed property.

16.

Consider appointments to Boards and Commissions.

Board members are selected for two-year terms by the City Council in August. Terms are usually staggered whereby at least half of the membership has board experience. Board members are appointed based on qualifications.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
