The City Council extends to each visitor a sincere welcome. We value your interest in your community and your participation in the meetings of this governing body. Regular meetings of the City Council are held the 1st and 3rd Tuesdays of each month, beginning at 7:00 p.m.; the City Council meets regularly in work sessions at 6:00 p.m. the Monday preceding each regular meeting.

Garland City Hall and Council Chambers is wheelchair accessible.  Special parking is available on the east side of City Hall and on Austin & State Street west of City Hall.  Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services must contact the City Secretary’s Office at (972) 205-2404 at least two working days prior to the meeting so that appropriate arrangements can be made. BRAILLE IS NOT AVAILABLE.


 

 
             
LEGISLATIVE PRAYER AND PLEDGE OF ALLEGIANCE

It is the custom and tradition of the members of the City Council to have an invocation and recital of the Pledge of Allegiance prior to the beginning of the meeting.  Members of the audience are invited to participate.  However, members of the audience are not required to participate.  The decision to participate is strictly a matter of personal choice and has no bearing on matters to be considered by the City Council and will not affect the decisions to be made during the meeting. 
 
MAYORAL PROCLAMATIONS,
RECOGNITIONS AND ANNOUNCEMENTS

The Mayor may present proclamations and recognize attendees or award winners, and may make announcements regarding upcoming City events and matters of interest to citizens. There will be no Council deliberations or votes on these matters.
 
 
CONSENT AGENDA

All items under this section are recommended for approval by a single motion of Council, without discussion. Council has had the opportunity to review each of these items at a previous work session and approval of the consent agenda authorizes the City Manager to implement each item. The Mayor will announce the agenda and provide an opportunity for members of the audience and the City Council to request that an item be removed and considered separately.
 
 
1.   Consider approval of the minutes of the October 22, 2019 Regular Meeting.
 
2. Consider approval of the following bids:
 
a.  
Wet Weather Management and Resiliency Master Plan    Bid No. 0023-20
     
CP&Y, Inc.  $342,300.00  
Optional Contingency 18,600.00  
TOTAL:  $360,900.00  

This request is to provide Professional Engineering Services to develop peak wet weather flow management alternatives to treat and/or store wet weather flows received from the collection systems for the Rowlett and Duck Creek Wastewater Treatment Plants.
 
b.  
Duck Creek Wastewater Treatment Plant Submersible Raw Water Lift Pump Replacement   Bid No. 1307-19
     
Xylem Water Solutions $197,404.54  

This request is to purchase a raw water lift pump to be used for pumping wastewater through the Duck Creek Wastewater Treatment Plant.

Traffic Signal Cabinets   Bid No. 0081-20
     
Consolidated Traffic Controls, Inc.  $700,000.00  

This request is for the purchase of traffic signal cabinets for Warehouse inventory.
 
3. Public hearings were previously conducted for the following zoning cases. Council approved the requests and instructed staff to bring forth the following ordinances for consideration.
 
a.   Zoning File No. Z 19-28, CDS Development Services (District 4)

Consider an ordinance amending the Garland Development Code of the City of Garland, Texas, by approving a Specific Use Provision for a Restaurant, Drive-Through on a 0.6579-acre tract of land zoned Community Retail (CR) District and located at 5724 Broadway Boulevard; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Section 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Notice of Conditions of Compliance Clause; a Savings Clause, and a Severability Clause; and providing an effective date.
 
b.   Consider amendments to Chapter 2, Sections 2.51 and 2.52; and Chapter 6, Section 6.03 of the Garland Development Code creating a definition and regulations for “Makerspace (Hackerspace)” uses.

Consideration an ordinance amending the Garland Development Code creating a definition and regulations for Makerspace uses; providing for conditions, restrictions, and regulations; providing a penalty under the provisions of Section 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Notice of Conditions of Compliance Clause; a Savings Clause, and a Severability Clause; and providing an effective date.
 
4.   Approve by minute action the transfer of $63,179 in Community Development Block Grant (CDBG) funding from the Carver Senior Community Center Project to the Vietnamese Community Center Project.

 At the October 21, 2019 Work Session, Council considered approving the transfer of Community Development Block Grant (CDBG) funding of $63,179 left over from the Carver Senior Community Center Program to the Vietnamese Community Center Phase II Program.
 
5.   Consider a resolution of the City Council of the City of Garland, Texas, requesting that the Dallas County Central Appraisal District reappraise properties in the City of Garland affected by the recent tornadoes, as authorized by Section 23.02 of the Texas Tax Code, and providing an effective date.

At the November 4, 2019 Work Session, Council considered the reappraisal of the property in the disaster area.  If approved, affected property owners may receive a prorated reappraisal of the storm damaged property for the 2019 tax year.  
 
6.   Consider a resolution accepting a Texas Department of Transportation (TxDOT) Selective Traffic Enforcement Program (STEP) - Impaired Driving Mobilization (IDM) Grant in the amount of $9,930.68; and providing an effective date.

At the November 4, 2019 Work Session, Council considered adopting a resolution authorizing the City Manager to accept a State of Texas Department of Transportation (TxDOT) Selective Traffic Enforcement Program (STEP) - Impaired Driving Mobilization (IDM) Grant related to Driving While Intoxicated (DWI) enforcement in the amount of $9,930.67 for FY 2019-2020.
 
7.   Consider an ordinance authorizing the issuance of "City of Garland, Texas, General Obligation Refunding Bonds, Series 2019;" specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; providing for the redemption of certain outstanding obligations of the City; and resolving other matters incident and related to the issuance, sale, payment and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement and an Escrow Agreement and the approval and distribution of a Preliminary Official Statement and an Official Statement; and providing an effective date. 

At the September 16, 2019 Work Session, Council considered refunding approximately $23.5 million of General Obligation Commercial Paper Notes, Series 2015 and approximately $1.3 million Combination Tax & Revenue Certificates of Obligation, Series 2010 with General Obligation Refunding Bonds, Series 2019. The purpose of this transaction is to refund a portion of variable rate commercial paper notes and to generate debt service savings.
 
8.   Consider an ordinance authorizing the issuance of "City of Garland, Texas, Water and Sewer System Revenue Refunding Bonds, New Series 2019A," pledging net revenues of the City’s Water and Sewer System to the security of and the payment of the principal of and interest on said bonds; specifying the terms and conditions of such bonds; resolving other matters incident and related to the issuance, payment, security, sale and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement and an Escrow Agreement; and the approval and distribution of a Preliminary Official Statement and an Official Statement; and providing an effective date. 

At the September 16, 2019 Work Session, Council considered refunding approximately $30 million of Water and Sewer System Commercial Paper Notes, Series 2015, approximately $13 million Water and Sewer System Revenue Bonds, Series 2010 and approximately $11.1 million Water and Sewer System Revenue Refunding Bonds, Series 2011A with Water and Sewer System Revenue Refunding Bonds, Series 2019A. The purpose of this transaction is to refund a portion of variable rate commercial paper notes with fixed rate long-term debt and to generate debt service savings.
 
9.   Consider an ordinance authorizing the issuance of "City of Garland, Texas, Electric Utility System Revenue Refunding Bonds, New Series 2019A," pledging the net revenues of the City’s electric utility system to the payment of the principal of and interest on said bonds; specifying the terms and conditions of such bonds; resolving other matters incident and related to the issuance, payment, security, sale and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement, an Escrow Agreement and a Purchase Agreement; and the approval and distribution of a Preliminary Official Statement and an Official Statement; and providing an effective date. 

At the September 16, 2019 Work Session, the City Council considered authorizing the refunding of approximately $41 million of Electric Utility System Commercial Paper Notes, Series 2018, approximately $8 million of Electric Utility System Revenue Refunding Bonds, Series 2011A, and approximately $114 million of Combination Tax and Electric Utility System Revenue Refunding Bonds, Series 2010 with Electric System Revenue Refunding Bonds, Series 2019A.  The purpose of this transaction is to refund a portion of variable rate commercial paper notes with fixed rate long-term debt and to generate savings in debt service.
 
10.   Consider an ordinance of the City of Garland, Texas, granting to Atmos Energy Corporation, Mid-Tex Division, a Texas and Virginia corporation, its successors and authorized assigns, a franchise to furnish, transport and supply natural gas to the general public in the City of Garland, Dallas County, Texas, to construct, maintain and operate pipelines and equipment in the City of Garland, Dallas County, Texas, for the transportation, delivery, sale, and distribution of natural gas in, out of and through the city for all purposes; providing for the payment of a fee or charge for the use of the public rights-of-ways; providing that such fee shall be in lieu of other fees and charges, generally excepting certain general and other taxes; repealing all previous Atmos Energy Gas franchise ordinances; prescribing the terms, conditions, obligations and limitations under which such franchise shall be exercised; providing a most favored nations clause and a severability clause; and providing an effective date.

At the October 21, 2019 Work Session, Council considered approving a franchise agreement with Atmos Energy Corporation, Mid-Tex Division. 
 
11.   Consider an ordinance amending Chapter 33, "Transportation," of the Code of Ordinances of the City of Garland, Texas; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date. 

At the October 21, 2019 Work Session, Council considered parking restrictions on Charleston Drive in front of Southgate Elementary.
 
ITEMS FOR INDIVIDUAL CONSIDERATION

Speaker Regulations:

Anyone wishing to speak for, against, or on agenda items must fill out a speaker card and give it to the City Secretary before speaking (cards are located at the entrance to the Council Chambers). The Mayor will recognize speakers; he may impose a time limit and may provide for rebuttal. All comments and testimony are to be presented from the podium.
 
 
12.   Consider an ordinance amending Chapter 24, "Municipal Court and Administrative Adjudication," Chapter 32, "Property Sanitation and Housing Services," and Chapter 33, "Transportation" of the Code of Ordinances of the City of Garland, Texas; providing a penalty under the provisions of Sec. 10.05 of the Code of Ordinances of the City of Garland, Texas; providing a Savings Clause and a Severability Clause; and providing an effective date. 

At the October 21, 2019 Work Session, Council considered implementing a neighborhood parking enforcement program to be administered by the City Marshal's office.  
 
13. Hold public hearings on:
 
a.   Consider the application of Hidden Oaks Lot Venture, Ltd., requesting approval of a Change in Zoning from Planned Development (PD) District 18-07 for Single-Family Attached (Townhouse) Use to a Planned Development (PD) District for Single-Family-5 (SF-5) Use.  This property is located at 2845 Crist Road.  (File No. Z 19-29, District 1)

The applicant proposes to build a subdivision consisting of detached single-family homes.  The previous development proposed was for townhouses. This item is the applicant’s Planned Development amendment (zoning) request. 
 
b.   Consider the application of Hidden Oaks Lot Venture, Ltd., requesting approval of a Detail Plan for Single-Family-5 (SF-5) Use.  This property is located at 2845 Crist Road.  (File No. Z 19-29, District 1)

The applicant proposes to build a subdivision consisting of detached single-family homes.  The previous development proposed was for townhouses. This item is the applicant’s Detail Plan request. 
 
c.   Consider an amended Development Agreement regarding Zoning File No. Z 19-29.

Consider an amended Development Agreement between Skorburg Retail Corporation and the City of Garland. This Development Agreement relates to Zoning Case Z 19-29 for a proposed single-family detached residential subdivision located at 2845 Crist Road. During the October 14, 2019 Plan Commission meeting, the Commission recommended that a development agreement accompany Zoning Case Z 19-29 regarding specific standards to the building elevations and materials of the homes as presented by the applicant. There is a previously approved development agreement for the previously approved development for townhouses. 
 
14. Citizen comments.

Persons wishing to address issues not on the agenda may have three minutes to address Council at this time. Council is prohibited from discussing any item not posted according to the Texas Open Meetings Act.
