WELL, GOOD EVENING AND WELCOME TO THE JANUARY 18, 2022 REGULAR MEETING OF THE GARLAND CITY

[00:00:06]

COUNCIL. IT IS THE TRADITION OF THIS COUNCIL TO HAVE A INVOCATION AND RECITAL OF THE PLEDGE OF ALLEGIANCE PRIOR TO THE BEGINNING OF OUR MEETING, LED BY ONE OF OUR COUNCIL MEMBERS. AND YOU ARE INVITED TO PARTICIPATE.

IT IS NOT REQUIRED AND YOUR DECISIONS WILL NOT IMPACT THE DECISIONS THAT WE MAKE HERE THIS EVENING. AND I WAS ABOUT TO THROW IT TO COUNCIL MEMBER BASS, WHO IS JOINING US REMOTELY. THERE HE IS.

TONIGHT, WE WILL BE LED BY COUNCIL MEMBER JEFF BASS FROM DISTRICT ONE.

GO AHEAD, SIR. THANK YOU, MAYOR.

IF YOU'D LIKE TO JOIN PLEASE BOW YOUR HEAD.

HEAVENLY FATHER, WE COME TO YOU BEFORE-- WE COME BEFORE YOU TONIGHT TO THANK YOU FOR YOUR MANY BLESSINGS AND TO ASK YOU FOR YOUR WISDOM AND GUIDANCE AS WE SERVE THE CITIZENS OF THE FINE CITY OF GARLAND, TEXAS.

WE ALSO ASK THAT YOU WATCH OVER THOSE WHO WATCH OVER US, OUR MILITARY, POLICE, FIRE TEACHERS AND MEDICAL PERSONNEL.

IN JESUS NAME, WE PRAY.

AMEN. IF YOU PLEASE FACE THE FLAG.

WELL, AS YOU CAN SEE, COUNCIL MEMBER BASS IS JOINING US REMOTELY THIS EVENING, AND I

[ Mayoral Proclamations, Recognitions and Announcements]

THINK HE HAS THE DISTINCTION OF BEING THE FIRST COUNCIL MEMBER TO LEAD US IN THE BEGINNING [INAUDIBLE] REMOTELY AND ATTEND REMOTELY.

AND I CAN TELL YOU THAT WE'RE ALL JUST HAPPY THAT THE SYSTEM IS WORKING AND ALLOWING THE FEED TO COME THROUGH. WE'VE-- WE'RE JUST HAPPY TO SEE HIS FACE AND BE ABLE TO HEAR HIS VOICE. SO. [LAUGHTER] BUT WE DO HAVE A COUPLE OF PRESENTATIONS HERE THIS EVENING.

OUR FIRST IS FOR PATTY GRANVILLE.

PATTY, IF YOU COULD COME.

IT'S VERY GOOD TO SEE YOU THIS EVENING.

AND FOR THOSE OF YOU DON'T KNOW, PATTY RECENTLY RETIRED FROM THE CITY AFTER HOW MANY YEARS? ALMOST 40 YEARS.

ALMOST 40 YEARS.

BUT SHE IS STILL VERY ACTIVE IN THE LOCAL ARTS COMMUNITY, AND SO RECENTLY SHE RECEIVED THE 2021 OBELISK AWARD.

AND SO I HAVE A LITTLE INFORMATION HERE.

FORMER CULTURAL ARTS DIRECTOR PATTY GRANVILLE WAS HONORED THE JUROR'S AWARD AT THE 33RD ANNUAL OBELISK AWARDS, PRESENTED BY BUSINESS COUNCIL FOR THE ARTS ON NOVEMBER 17TH IN DALLAS. THE AWARD HONORS BUSINESSES, NONPROFITS AND INDIVIDUALS FOR THEIR EXTRAORDINARY SUPPORT OF ARTS AND CULTURE IN NORTH TEXAS.

PATTY GRANVILLE WAS NOMINATED BY MICHELLE NORRIS, CULTURAL ARTS SUPERVISOR AT THE CITY OF GARLAND.

IN HER NOMINATION, NORRIS NOTED THAT PATTY IS THE EMBODIMENT OF CULTURAL ARTS IN GARLAND.

I ABSOLUTELY-- INDISPUTABLE.

SHOULD BE UNDERLINED, BOLDED THAT STATEMENT.

SHE HAS SERVED AS THE CULTURAL ARTS DIRECTOR SINCE 1982 AND HAS CERTAINLY LEFT BEHIND AN INDELIBLE LEGACY.

PATTY OPENED THE GRANVILLE ARTS CENTER IN 1982, WHICH WAS RENAMED FOR HER IN 2003, AND SHE HAS CONTINUED TO PURSUE THE CULTURAL ARTS FOR GARLAND AND ITS RESIDENTS THROUGHOUT NEARLY 40 YEARS OF SERVICE.

SO, PATTY, AGAIN, IT'S GREAT TO SEE YOU.

THANK YOU. AND WOULD YOU LIKE TO TELL US A LITTLE BIT MORE ABOUT THE AWARD? WELL, I'D JUST LIKE TO THANK THE CITY OF GARLAND AND THE CITY COUNCIL AND THE CITY STAFF FOR ALL THESE YEARS AND CITY MANAGERS AND MY AMAZING STAFFS OVER THE YEARS FOR HELPING US COME ALONG THIS MAGNIFICENT JOURNEY THAT WE HELPED CREATE ONE OF THE FINEST ARTS PROGRAMS IN NORTH TEXAS.

IN ADDITION TO HAVING SOME OF THE FINEST FACILITIES, ARTS FACILITIES IN NORTH TEXAS TOO, AND I JUST FEEL PRIVILEGED AND HONORED THAT I HAVE BEEN ABLE TO BE PART OF THIS MAGNIFICENT PLAN AND THANK YOU SO MUCH.

AND THE AWARD WAS THE GREAT HONOR.

IT WAS AT THE FAIRMONT HOTEL AND I HAD PICTURES.

I DIDN'T REALIZE THAT'S WHAT WE WERE DOING TONIGHT.

I COULD HAVE BROUGHT IT, BUT IT'S BEAUTIFUL.

I'LL SEND PICTURES, BUT THANK YOU AGAIN.

THANK YOU, MAYOR, AND THANK THE COUNCIL AND EVERYONE FOR THEIR SUPPORT AND THEIR FINANCIAL SUPPORT OF BUILDING ALL THE ARTS PROGRAMS AND KEEPING OUR FACILITIES SO THEIR TOP RATED AND JUST AMAZING OVER THE YEARS.

I JUST APPRECIATE EVERYTHING THAT'S BEEN DONE AND THE WHOLE COMMUNITY HAS BEEN BEHIND US FOR ALMOST 40 YEARS.

THANK YOU AGAIN. VERY GOOD.

[00:05:01]

THANK YOU, MA'AM. THANK YOU. [APPLAUSE] VERY GOOD, AND NEXT I HAVE STAFF COMING UP, WE HAVE A CHECK PRESENTATION FOR OUR R-I-N, RIN ROYALTIES AND CHRIS HOOFNAGLE, YOU ARE GOING TO EXPLAIN TO US WHAT ALL THAT MEANS. I'M SURE. I'M GONNA TRY.

INTRODUCE YOURSELF AND TELL ME WHAT THAT MEANS.

MY NAME IS CHRIS HOOFNAGLE.

I'M THE LANDFILLED DIRECTOR.

AND, YOU KNOW, FOR YEARS, THE CITY OF GARLAND WOULD SPEND IN EXCESS OF ONE HUNDRED THOUSAND DOLLARS EACH YEAR TO CAPTURE AND COLLECT AND CONTROL THE GAS CREATED AT THE LANDFILL. IT'S A NATURAL GAS CREATED FROM THE DECOMPOSITION OF THE WASTE BURIED THERE.

AND NOW, THROUGH A PARTNERSHIP WITH MORROW RENEWABLES, WE'VE TURNED THE TABLES AND THAT GAS IS NOW REFINED AND SENT TO THE ATMOS ENERGY COMPANY, AND THE CITY NOW RECEIVES A REVENUE SOURCE FROM THAT, A RELIABLE REVENUE STREAM THAT WE'LL BE ABLE TO ENJOY FOR DECADES TO COME.

SO, THE PRESENTATION TONIGHT LUKE MORROW, THE PRESIDENT OF MORROW RENEWABLES IS HERE TO MAKE, REPRESENTS THE FIRST TWO AND A HALF MONTHS OF THAT NEW PARTNERSHIP.

BECAUSE WE JUST HAD THE RIBBON CUTTING NOT TO AT THE END OF OCTOBER, WE OPENED THE PLANT FOR BUSINESS, AND THE DOLLAR AMOUNT IN THE FIRST TWO AND A HALF MONTHS REPRESENTS ABOUT WHAT WE SPENT IN TWO YEARS.

SO, WE'VE EARNED THAT BACK IN A VERY SHORT TIME.

SO, I WANT TO THANK LUKE FOR BRINGING THIS PARTNERSHIP TO THE CITY AND THANK THE MAYOR FOR HIS SUPPORT AND THE CITY COUNCIL IN MAKING THIS PROJECT A SUCCESS.

LUKE? ABSOLUTELY. SO, THIS CHECK IS FOR-- THIS IS A BIG CHECK, RIGHT? $342,379.40 AND-- [APPLAUSE].

IT IS ACTUALLY MADE OUT [INAUDIBLE].

[LAUGHTER] THAT'S RIGHT.

I MAY NEED A FEW EXTRA PAGES FOR [INAUDIBLE].

YEAH, THAT'S RIGHT. THAT'S RIGHT.

BUT ANYWAY, WE ARE VERY THANKFUL TO GET TO WORK WITH THE CITY OF GARLAND.

THIS IS A GREAT CITY WITH GREAT PEOPLE AND GETTING TO WORK WITH JASON AND CHRIS HAS BEEN ABSOLUTELY WONDERFUL FOR US.

JUST WANT TO THANK THE CITY COUNCIL AND THANK EVERYONE INVOLVED IN-- WE'RE HAPPY TO BE A PART OF THE CITY OF GARLAND.

THANK YOU. GOOD. THANK YOU.

ALL RIGHT. THANK YOU, SIR.

THANK YOU. AND I LOOK FORWARD TO MORE OF THESE CHECKS COMING-- [LAUGHTER].

THAT BIG. THIS BIG.

YES. JUST A CEREMONY.

[LAUGHTER] FINALLY THOUGHT THIS JOB WAS GOING TO HAVE A PERK TO IT.

THANK YOU BOTH VERY MUCH.

[INAUDIBLE]. YEAH.

MY CAMPAIGN TREASURER IS IN FOR A SHOCK.

ALL RIGHT. GET SERIOUS HERE FOR A MOMENT.

WE'LL GO AHEAD AND GET STARTED ON OUR AGENDA.

THE FIRST ITEM ON OUR AGENDA IS THE CONSENT AGENDA.

[ Consent Agenda]

EXCUSE ME, ALL ITEMS UNDER THIS SECTION ARE RECOMMENDED FOR APPROVAL BY A SINGLE A MOTION OF COUNCIL. COUNCIL HAS HAD THE OPPORTUNITY TO REVIEW EACH OF THESE ITEMS AT A PREVIOUS WORK SESSION, AND APPROVAL OF THE CONSENT AGENDA AUTHORIZES THE CITY MANAGER TO IMPLEMENT EACH ITEM. I WILL ANNOUNCE THE AGENDA AND PROVIDE SUPPORT TO THE COUNCIL TO REQUEST THAT AN ITEM BE REMOVED AND CONSIDERED SEPARATELY.

I DON'T HAVE ANY REQUEST AT THE MOMENT.

WE'LL GO AHEAD AND READ THROUGH THE AGENDA.

[INAUDIBLE] COUNCILMAN BASS.

SIR CAN YOU HEAR ME? YES, AND I WILL ASK THAT WHEN WE VOTE, I'M ASSUMING YOU HAVE YOUR VOTING PANEL WITH YOU STILL.

EXCELLENT. I DON'T HAVE THEM ANYMORE.

EXCELLENT. SO, WHEN I CALL FOR THE VOTE, IF YOU COULD DISPLAY YOURS, PLEASE.

MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US.

YOU KNOW WHAT? YOU KNOW, FOR THE LAST SEVERAL MEETINGS, I'VE BEEN SKIPPING THAT VERY KEY PORTION OF-- YES, GO AHEAD, SIR.

BEFORE MAKING MOTION TO APPROVE, I WOULD LIKE TO JUST--.

WE HAVE ON HERE THE EMPLOYMENT AGREEMENTS FOR CITY MANAGER BRYAN BRADFORD, CITY AUDITOR JED JOHNSON AND CITY ATTORNEY BRYAN ENGLAND.

AND I WOULD JUST LIKE TO THANK THOSE GENTLEMEN FOR THEIR YEARS OF DEDICATION AND SERVICE TO THE CITIZENS OF GARLAND.

VERY GOOD. NOTED.

ALL RIGHT, WE HAVE A MOTION BY COUNCILMAN--.

I'D LIKE TO MAKE A MOTION TO APPROVE.

[LAUGHTER] OK.

WHAT ARE YOU GOING TO DO [INAUDIBLE]? ALL RIGHT.

WE NOW HAVE A MOTION BY COUNCIL MEMBER BASS TO APPROVE THE CONSENT AGENDA AS PRESENTED AND A SECOND BY COUNCIL MEMBER AUBIN.

ANY FURTHER DISCUSSION? MADAM SECRETARY, PLEASE PREPARE THE VOTE FOR US.

GET ME OUT OF THIS.

AND COUNCIL, IF YOU COULD, PLEASE VOTE.

COUNCIL MEMBER MOORE. ALL RIGHT.

AND COUNCIL MEMBER BASS JUST--.

AND MADAM SECRETARY, IF YOU COULD DISPLAY THE VOTE FOR US, PLEASE.

COUNCIL MEMBER MOORE IS VOTING IN THE AFFIRMATIVE, AS IS COUNCIL MEMBER BASS, SO THAT ITEM IS APPROVED UNANIMOUSLY.

I'M NOT SURE WHY I KEEP SKIPPING THE MOTION PART, JUST TRYING TO SHAVE A FEW MINUTES OFF EACH MEETING. YEAH. [LAUGHTER] ALL RIGHT.

NEXT, WE WILL MOVE ON TO ITEMS FOR INDIVIDUAL CONSIDERATION.

MADAM SECRETARY, CAN YOU GIVE US THE SPEAKER GUIDELINES, PLEASE? YES, SIR. THE OPPORTUNITY TO SPEAK IS GIVEN TO PROVIDE TESTIMONY RATHER THAN TO QUESTION THE CITY COUNCIL OR STAFF.

ALL RIGHT. MOVING ON TO OUR FIRST ITEM FOR INDIVIDUAL CONSIDERATION, IT IS ITEM 9,

I BELIEVE COUNCIL MEMBER SMITH YOU'VE GOT THE MOTION ON THIS ITEM AND JUST [INAUDIBLE].

THIS ITEM REQUIRES SOME VERY SPECIFIC LANGUAGE TO BE IN THE MOTION.

GO AHEAD, SIR. SORRY.

THANK YOU, MAYOR. AND IF YOU WANTED TO SKIP THE MOTION LANGUAGE ON THIS ONE, THAT WOULD BE AWESOME. IT'S ABOUT A TWO PAGE MOTION, FOLKS.

[10. Presentation of 2022 Proposed CIP]

BEFORE WE GET STARTED COUNCIL AND, I THINK I HAD A CHANCE TO SPEAK TO MOST OF YOU DURING THE BREAK, BUT I DON'T KNOW IF I GOT TO EVERYBODY AND TO THE AUDIENCE.

WE DO HAVE ONE CHANGE.

THE WORK SESSION THAT WE ARE PLANNING FOR THIS COMING SATURDAY IS GOING TO BE HELD HERE IN THE COUNCIL CHAMBERS, NOT AT THE COUNTY ROAD AND BRIDGE BUILDING DUE TO A SCHEDULING ISSUE. SO, THAT MEETING WILL GET POSTED TONIGHT, BUT WE WILL BE MEETING HERE SATURDAY

[00:20:01]

MORNING AT 8:30.

VERY GOOD. GO AHEAD. GOOD EVENING, MAYOR AND COUNCIL MEMBERS-- OOP.

HANG ON. HANG ON. NOPE.

GO AHEAD. THANK YOU.

GOOD EVENING, MAYOR AND COUNCIL MEMBERS.

ON BEHALF OF OUR CITY MANAGER, BRYAN BRADFORD, I'M PLEASED TO PRESENT THE PROPOSED 2022 CAPITAL IMPROVEMENT PROGRAM AND AT $521 MILLION DOLLARS, THIS IS THE LARGEST CAPITAL PLAN IN GARLAND'S HISTORY, A COMMENT THAT OUR CITY MANAGER MADE LAST YEAR AS WELL.

SO, WE'RE GOING TO CONTINUE THE STREAK AND CONTINUE THE PROGRESS THAT WE'RE SEEING HERE IN GARLAND CITY.

OUR CITY MANAGER WOULD ALSO KNOW THAT THIS HAS BEEN A PARTICULARLY CHALLENGING CIP PROCESS THUS FAR, WITH A LOT OF THE ECONOMIC IMPACTS COMING OUT OF THE COVID 19 PANDEMIC.

BUT WE'RE PLEASED WITH WHERE WE'RE AT SO FAR AND LOOK FORWARD TO ENGAGING WITH THE COUNCIL ON SOME ADDITIONAL DISCUSSIONS AS WE MOVE THROUGH THE PROCESS.

I DO WANT TO THANK SOME OF THE STAFF THAT'S BEEN INVOLVED IN THE PROCESS.

YOU HEARD FROM A COUPLE OF THEM EARLIER TONIGHT.

OUR CFO MATT WATSON AND BUDGET DIRECTOR ALLYSON STEADMAN BELL AND ALL THE DEPARTMENT DIRECTORS THAT HAVE HELPED TO PUT THE PLAN TOGETHER.

I WANT TO THANK THEM FOR THEIR EFFORTS THUS FAR.

WE ALWAYS LIKE TO BEGIN WITH THE END IN MIND, AND THE THREE GOALS THAT WERE MENTIONED PREVIOUSLY FOR THE CIP THIS YEAR INCLUDE CONTINUED IMPLEMENTATION OF THE 2019 BOND PROGRAM, INCLUDING THE ESCALATION IN COSTS THAT WE'VE SEEN ON SOME OF THOSE PROJECTS.

SO, THAT'S A TOP PRIORITY IN GOAL FOR US.

THE SECOND IS TO IMPLEMENT THE ARPA PLAN THAT COUNCIL APPROVED EARLIER THIS YEAR AND OF COURSE, COMPLY WITH ALL THE RED TAPE AND GUIDELINES THAT COME ALONG WITH THAT FUNDING, THAT IMPORTANT FUNDING.

AND THEN FINALLY, CONSIDER OPPORTUNITIES TO FUND ADDITIONAL OPPORTUNITIES WITH THE 2019 BOND PROJECTS AND EXPAND ON THOSE IMPROVEMENTS IN SOME WAYS AND THEN ALSO TO ADDRESS NEW FUNDING NEEDS THAT COME UP.

SO, WITH THAT IN MIND, I'LL JUST GIVE SOME HIGHLIGHTS OF THE CIP, HE PROPOSED CIP, WHICH YOU HAVE IN A VERY LARGE BINDER NOW AND WE'LL BE TESTING YOU ON THAT VERY SOON.

BY SATURDAY, ACTUALLY.

SO, ON THE TAX SUPPORTED SIDE, AS IT WAS MENTIONED EARLIER, $227 MILLION IN TAX SUPPORTED PROJECTS. $68 MILLION OF THAT IS GOING TO GO TOWARDS PARK PROGRAMS AND FACILITIES, INCLUDING IMPROVEMENTS TO THE SENIOR CITIZEN CENTER.

MANY OF OUR RECREATION CENTERS PARKS, NEW PARKS, SPORTS FIELDS, PLAYGROUNDS AND THE LIKE AND OF COURSE, TRAIL IMPROVEMENTS, WHICH KIND OF WEAVE THROUGH ALL OF OUR COUNCIL DISTRICTS. $55 MILLION TOWARDS STREET AND TRANSPORTATION IMPROVEMENTS, MOST OF THAT MONEY IS GOING TOWARDS IMPROVEMENTS THAT WILL EXPAND OUR TRANSPORTATION CAPACITY AND FIX CRITICAL BOTTLENECK AREAS AS WELL.

SOME PROJECTS INCLUDE SHILOH, BOBTOWN, NAAMAN SCHOOL, LYONS, HOLFORD AND OTHER ROAD AND INTERSECTION IMPROVEMENTS.

THERE'S MANY PUBLIC SAFETY IMPROVEMENTS IN THE PROPOSED CIP, INCLUDING NEW FIRE STATIONS AND FIRE ADMINISTRATION AND TRAINING FACILITY IMPROVEMENTS, IMPROVEMENTS OF THE GARLAND POLICE STATION, RANGE AND TRAINING FACILITIES.

MANY OF OUR LIBRARIES WILL BE IMPROVED AS PART OF THE CIP AS WELL, INCLUDING IMPROVEMENTS TO CENTRAL AND NORTH BRANCHES AND, OF COURSE, A NEW BRANCH TO SERVE WEST GARLAND.

THE PROPOSED CIP CONTINUES THE PROGRESS THAT WE'VE MADE ON ECONOMIC DEVELOPMENT AND REDEVELOPMENT FRONTS AS WELL FUNDING LAND ACQUISITION AND STREETSCAPE IMPROVEMENTS IN KEY CATALYST AREAS INCLUDING DOWNTOWN AND THE MEDICAL DISTRICT.

AND OF COURSE, WE'RE EXCITED TO SHARE THAT THE CIP INCLUDES AN ARPA FUNDING ALLOCATION TO BEGIN DESIGN OF A NEW PUBLIC HEALTH CLINIC.

SO, THAT'S JUST A HIGH LEVEL OVERVIEW ON THE TAX SUPPORTED SIDE.

ON THE UTILITY SUPPORTED SIDE, WHICH TOTALS $290 MILLION, MAJOR SANITATION EQUIPMENT PURCHASES, WATER AND WASTEWATER LINE IMPROVEMENTS, WATER METERS, WASTEWATER UPGRADES AT THE TREATMENT PLANTS AND THOSE PROCESSES.

AND MOST OF THAT UTILITY SUPPORTED MONEY GOING TO GARLAND POWER AND LIGHT FOR IMPORTANT INFRASTRUCTURE IMPROVEMENTS TO TRANSMISSION LINES, SUBSTATIONS, RELIABILITY UPGRADES AND ONE-- AND INITIATION OF THE AUTOMATED METER INFRASTRUCTURE PROGRAM AS WELL.

AND ONE THING I'LL NOTE THROUGH THIS PROCESS IN THE CIP IS THAT YOU'LL SEE MANY OF OUR BOND PROJECTS SORT OF WEAVE THROUGH THE CIP IN DIFFERENT WAYS THAT IT STARTS WITH A STREET PROJECT INTERTWINED WITH WATER AND WASTEWATER IMPROVEMENTS THAT ARE ASSOCIATED WITH THAT PROJECT AND ALSO ELECTRICAL DISTRIBUTION AND TRANSMISSION IMPROVEMENTS AS WELL.

AND SO YOU SEE A LOT OF COLLABORATION AND COORDINATION BETWEEN PROJECTS IN THE CIP.

AS FAR AS INTERNAL SERVICES GO, $3 MILLION IN IMPROVEMENTS AND PROJECTS THROUGH THAT ALLOCATION ON THE DEBT ISSUANCE SIDE, $99 MILLION DOLLARS IN TAX SUPPORTED FOR 2022

[00:25:07]

THROUGH GOS AND COS AND ON THE UTILITY SIDE, $118 MILLION IN UTILITY SUPPORTED DEBT ISSUANCE AS WELL.

ALL THAT TO SAY THAT NO ADDITIONAL PROPERTY TAX INCREASE IS, OF COURSE, PROPOSED.

THE ONLY RATE IMPACT, AS NOTED IN PREVIOUS PRESENTATION, IS TO THE WASTEWATER AND SANITATION INCREASES IN FISCAL 2023.

SO, IN CONCLUSION, WE'RE PLEASED TO PRESENT THE PROPOSED 22 CIP.

IT'S A SIGNIFICANT STEP TOWARD COMPLETION OF THE 2019 BOND PROGRAM.

WE'RE CONFIDENT THAT THIS WILL HELP MOVE US FORWARD AND CONTINUE TO IMPLEMENT THE PROGRESSIVE VISION THAT THE CITY COUNCIL HAS PUT FORWARD.

YOU HAVE COPIES OF THE DOCUMENTS.

IT'LL BE POSTED ON THE WEBSITE TOMORROW AND ALSO MADE AVAILABLE IN OUR LIBRARIES IN THE CITY SECRETARY'S OFFICE.

AND WHILE AN INCREDIBLE AMOUNT OF WORK HAS BEEN DONE TO DATE TO GET US TO THIS POINT, WE ARE AT THE BEGINNING AND NOT THE END, AND SO WE LOOK FORWARD TO ENGAGING WITH THE CITY COUNCIL, SATURDAY, TO START AND THEN FOLLOWING MEETINGS AFTER THAT.

SO AGAIN, HAPPY TO PRESENT THIS ON BEHALF OF OUR CITY MANAGER BRYAN BRADFORD, AND HAPPY TO ANSWER ANY QUESTIONS YOU MAY HAVE.

VERY GOOD, SIR. THANK YOU.

I THINK WE WILL PROBABLY HOLD ALL OF OUR QUESTIONS UNTIL SATURDAY WHEN WE SEE ALL THE PRESENTATIONS. BUT THANK YOU.

ALL RIGHT. MOVING ON TO ITEM 11, 2021-22 BUDGET AMENDMENT NUMBER ONE, COUNCIL MEMBER

[Items 11 &12]

AUBIN GO AHEAD. THANK YOU, MAYOR.

I GUESS FIRST OFF, I'D LIKE TO ASK IF WE COULD COMBINE ITEMS 11 AND 12 AS THEY ARE CONNECTED. ANY OBJECTION ON THAT? I DON'T SEE ANY OBJECTION TO THAT.

OK. MAYOR, I WOULD-- I APPRECIATE VERY MUCH STAFF BRINGING THIS FORWARD IN THE PRESENTATIONS WE GOT TWO WEEKS AGO FROM CHIEF BRYAN.

I WOULD LIKE TO PROPOSE THAT WE PASS SOME-- A REVISED VERSION OF THIS TONIGHT THAT WOULD ADD IN ADDITION TO THE TWO OFFICERS THE CHIEF BRYAN ASKED FOR, I WOULD LIKE TO ADD AN ADDITIONAL TWO OFFICERS AND A LIEUTENANT ABOVE WHAT THE CHIEF HAS ASKED FOR.

IT'S NOT SOMETHING THE CHIEF MENTIONED.

I KNOW HE CAME TO US WITH KIND OF THE MINIMUM, BUT IN THE INTERVENING TWO WEEKS SINCE WE LAST MET, WE'VE HAD SEVERAL INCIDENTS, INCLUDING, THAT I THINK MOST OF THE COUNCIL ARE AWARE OF INCLUDING ONE THAT WAS IN MY DISTRICT, THAT INVOLVED, A FOR LACK OF A BETTER DESCRIPTION, A DAYTIME SHOOT OUT AT A PARK.

AND I THINK THAT, YOU KNOW, IN THE PAST, THE GANG UNITS HAVE MOSTLY WORKED NIGHTS AND WEEKENDS, BUT OUR GANGS ARE NOW WORKING FULL TIME DURING THE DAY AND AT NIGHT, AND BY INCREASING THE UNIT STRENGTH TO 10 OFFICERS AND TWO LIEUTENANTS, THAT WOULD GIVE US THE OPPORTUNITY TO RUN, I DON'T WANT TO CALL IT A FULL SERVICE OPERATION, BUT TO DO BETTER AT KEEPING UP WITH THEM. AND WITH THE CITY OF OUR SIZE AND WITH THESE ONGOING ISSUES, I'D LIKE TO SEE US DO THAT.

I THINK, YOU KNOW, I COMMEND THE CHIEF AND STAFF FOR THE WORK THEY'VE DONE.

I KNOW THAT THEY'VE TRIED TO-- THAT THEY'RE WORKING ON SURGING RESPONSE TO THE GANG ISSUE. BUT IN THE LONG TERM, I THINK WE'RE JUST GOING TO NEED A BIGGER GANG UNIT AND WE NEED OFFICERS THAT ARE-- EVENTUALLY WE NEED THOSE OFFICERS, WHETHER THEY BE NPOS OR OTHERWISE, TO RETURN BACK TO THEIR REGULAR ASSIGNMENTS.

SO, THAT'S WHERE I'M PREPARED TO MAKE THAT MOTION.

BUT I DON'T KNOW IF FOLKS WANT TO DISCUSS IT AND IF WE'D LIKE TO HEAR FROM STAFF AND FROM CHIEF ABOUT THEIR TAKE ON THAT.

IT WOULD-- I'M NOT SURE OF WHAT THE DETAILS OF-- I KNOW SOME OF THE DETAILS ARE WHAT THE AMENDMENT OR WHAT THE REVISED ORDINANCES WOULD NEED TO LOOK LIKE, BUT I DON'T KNOW SOME OF THE SPECIFIC NUMBERS IF WE NEED TO GET THAT.

OK. I HAVE A FEW FOLKS IN THE QUEUE, AND WE'LL BRING THE SPEAKERS UP AS WELL.

OK, THANK YOU, MAYOR.

COUNCIL MEMBER SMITH. THANK YOU, MAYOR.

YEAH, I APPRECIATE THE AMENDMENT.

ONE OF THE COMMON COMPLAINTS I GET WHEN WE HAVE TO ACTIVATE OUR GANG UNIT IS THAT WE ALWAYS DRAW FROM OUR NPO FORCE AND THAT TAKES THOSE OFFICERS OUT OF THEIR NORMAL ROLE AS NPOS AND PUTS THEM INTO THAT VERY NECESSARY GANG UNIT.

BUT YOU KNOW, IT'S-- WE LOSE SOME OF OUR NPO CAPABILITY, AND MANY OF THE CONCERNS HAVE GOTTEN FROM THE COMMUNITY REVOLVE AROUND THAT.

SO, MORE BODIES IS PROBABLY A GOOD THING.

[00:30:02]

CHIEF HAS COME UP, SO I'LL DEFER TO YOU, SIR.

BOY, YOU SUMMED IT UP WELL THERE.

[LAUGHTER] WHEN WE NEED SUPPORT FOR THE GANG UNIT AND THAT IS BECOMING MORE FREQUENT, WE PULL FROM THE NPOS AND THE FIRST QUESTION I GET IS WHERE'S MY NPO? AND SO BEEFING UP THE GANG UNIT IS CERTAINLY ONE OF MY GOALS.

THE TWO THAT WE TALKED ABOUT AND MORE IS GOOD.

FOR THE RECORD, ANY TIME YOU ASK ME, DO I NEED MORE POLICE OFFICERS, THE ANSWER IS YES.

[LAUGHTER] I NEED TO-- DO YOU KNOW WHAT OUR CURRENT RATIO IS FOR OFFICERS TO ONE PER 1000 PEOPLE.

I CAN GET A CALCULATOR AND FIGURE THAT OUT.

WE HAVE 354 OFFICERS AND AROUND A QUARTER MILLION PEOPLE.

SO, WHATEVER THAT COMES OUT TO.

I KNOW THAT SOME OF THE SURROUNDING CITIES HAVE A 2 TO 1000 RATIO AND OBVIOUSLY WE'RE WELL BELOW THAT. SO, ONCE AGAIN, WE DO A LOT WITH A LITTLE AND WE CERTAINLY APPRECIATE THAT.

AND WE KNOW THAT, YOU KNOW, AS GANG ACTIVITY FALLS OFF, WE CAN USE THESE OFFICERS IN OTHER ROLES, WHETHER IT'S TO HELP PULL DOWN SOME OF THE OVERTIME NUMBERS OR ON ANY ONE OF THE MANY TASK FORCE THAT WE SEEM TO ALWAYS HAVE TO DEPLOY TO HANDLE VERY SPECIFIC ISSUES.

SO, COUNCILMAN I'M GOING TO SUPPORT YOUR AMENDMENT ON THIS AND AS LONG AS THE NUMBERS WORK OUT FROM THE BUDGET SIDE, I HAVE NO OBJECTIONS AT ALL.

SO, THANK YOU, CHIEF.

THANK YOU, COUNCILMAN AUBIN AND THANK YOU, MAYOR.

THANK YOU, SIR. DEPUTY MAYOR PRO TEM WILLIAM.

THANK YOU, MAYOR.

MAYOR, TO SUPPORT COUNCILMAN AUBIN PROPOSED AMENDMENT, I JUST HAVE A QUESTION FOR CHIEF.

CHIEF, COUNCILMAN AUBIN'S MOTION INCLUDES TWO OFFICES AND I THINK HE SAID ONE LIEUTENANT.

CAN YOU COMMENT ON DOES THAT AS FAR AS YOUR NEEDS, HOW IS THAT-- [INAUDIBLE] THAT LIEUTENANT, WHICH IS PART OF THE MANAGEMENT TEAM? IS THERE A NEED OR WOULD YOU ENVISION USING THAT SLOT FOR WHAT I WOULD CALL LIKE A BETTER TERM BOOTS ON THE GROUND? CAN YOU COMMENT ON THAT? WELL, OUR LIEUTENANTS ARE BOOTS ON THE GROUND.

OUR LIEUTENANTS ARE OUR FIRST LINE SUPERVISORS.

RIGHT? USUALLY, ONCE WE HAVE FIVE TO SEVEN OFFICERS, THAT'S WHEN WE PUT A LIEUTENANT OVER A FIVE TO SEVEN OFFICER GROUP.

SO, THAT RATIO WOULD BE WHAT WE NEED TO SUPPORT THE INCREASE IN STAFF.

OK. ALL RIGHT.

AND LAST DISCUSSION ON THIS, THE CHIEF YOU TALKED ABOUT-- WE TALKED-- WE HAD SOME DISCUSSION ON THE MENTAL HEALTH ASPECTS.

SO, ARE YOU COMFORTABLE AT THIS POINT AS FAR AS YOUR PRIORITY OF NEEDS? YES. AND THAT IS ON THIS, AS WELL AS A SECOND MENTAL HEALTH PERSON, AND I DO FORESEE THAT GROWING AS WELL.

WE NEED TO GET IT ESTABLISHED.

WE'RE FOLLOWING A COUPLE OF LEADS IN THIS OF AGENCIES THAT ARE ALREADY DOING THIS.

SO, I NEED TO GET PEOPLE IN AND GET THEM ESTABLISHED.

WE'RE DOING INTERVIEWS THIS WEEK ON THIS AS A MATTER OF FACT.

I DON'T WANT TO OVERWHELM THAT THOUGHT AT THIS POINT, BUT I DO SEE THAT GROWING IN THE FUTURE. BUT THE TWO WE'RE HIRING RIGHT NOW IS IT WOULD MEET OUR NEEDS RIGHT NOW.

OK. ALL RIGHT.

WELL, IF YOU-- AND CHIEF WHEN I USE THE TERM BOOTS, THE GROUND, YOU KNOW WHAT I'M TALKING ABOUT. I'M KIND OF CLOSE TO THE NPOS.

YOU KNOW, THE GUYS THAT I SEE, I SEE MORE OF THEM THAN I DO YOUR LIEUTENANT.

SO, IT'S NO NEGATIVE TOWARDS YOUR [INAUDIBLE] STAFF.

BUT THE OTHER THING IS BECAUSE LIKE COUNCILMAN AUBIN, I HAD A DRIVE BY MY DISTRICT, COUNCILMAN AUBIN, ABOUT TWO WEEKS AGO IN A RESIDENTIAL ABOUT FOUR O'CLOCK IN THE MORNING, FOLKS WERE ASLEEP. SO, I TOTALLY SUPPORT COUNCILMAN AUBIN [INAUDIBLE] INITIATIVE.

I WISH WE COULD DO MORE.

AND I'M LIKE, COUNCILMAN SMITH, YOU KNOW, BUDGET WITHSTANDING.

I TOTALLY SUPPORT THIS AMENDMENT AS OPPOSED BY COUNCILMAN AUBIN.

THANKS, CHIEF. THANK YOU, MAYOR.

[INAUDIBLE] AND COUNCIL MEMBER BASS, YOU'RE IN THE QUEUE, I SEE.

GO AHEAD, SIR. YES, SIR. THANK YOU, MAYOR.

OK. CHIEF BRYAN, I DEFINITELY SUPPORT OUR OFFICERS AND OUR NPOS, AND I'M NOT A FAN OF PULLING THE NPOS OFF FROM THEIR DUTIES FOR THE GANG UNIT.

SO, JUST LOOKING AT SOME STATISTICS HERE IN THE STATE OF TEXAS, AVERAGE IS 2.2 OFFICERS PER 1000 RESIDENTS.

SO, IF GARLAND WERE TO EQUAL THAT AVERAGE FIGURE FOR OUR STATE, THAT WOULD MEAN 550 OFFICERS, WHICH IS 200 MORE THAN WE CURRENTLY HAVE.

SO, I THINK THAT WE CAN DEFINITELY HAVE SUPPORT BEHIND A FEW MORE OFFICERS TO HELP OUT WITH THE BOOTS ON THE GROUND.

SO, I JUST WANTED TO LET YOU KNOW THOSE ARE THE NUMBERS I FOUND, AND I DEFINITELY SUPPORT ANY INITIATIVE WE CAN TO KEEP OUR CITY SAFE.

THANK YOU, MAYOR. THANK YOU, SIR.

I APPRECIATE IT. LET ME SAY TOO.

CAUTION YOU A LITTLE BIT ON THOSE NUMBERS.

WHEN YOU LOOK AT LARGE CITIES SUCH AS DALLAS AND FORT WORTH, I THINK IT'S MORE BENEFICIAL

[00:35:06]

TO COMPARE US TO CITIES OUR SIZE.

AND I HAVEN'T LOOKED AT THAT IN A WHILE, BUT I THINK WE'RE CLOSER TO CITIES IN OUR SIZE.

BUT I DON'T WANT YOU TO GET CONFUSED WHEN YOU SEE A CITY LIKE DALLAS OR LIKE FORT WORTH BECAUSE THEY'RE GOING TO BE MUCH HIGHER IN THOSE NUMBERS.

OK. COUNCIL MEMBER AUBIN.

[INAUDIBLE] IN UNLESS I DON'T WANT TO-- WAS NOBODY ELSE IN THE QUEUE? THANK YOU, MAYOR.

I GUESS IF WE COULD HEAR FROM-- AND FIRST THING I'D LIKE TO SAY, CHIEF IS, AS YOU KNOW, I THINK WE-- THIS CITY FROM THE COUNCIL DOWN TO EVERY RESIDENT VERY STRONG, ALMOST EVERY RESIDENT, STRONGLY SUPPORTS THE POLICE DEPARTMENT AND I BELIEVE THAT OUR DEPARTMENT DOES MORE WITH LESS AND HAS FOR YEARS.

AND SO, VERY PROUD OF THE WORK THAT THEY DO.

BUT THERE ARE TIMES THAT WE JUST NEED MORE OF THEM.

AND I THINK THIS IS ONE OF THOSE TIMES AND IT'S NO REFLECTION IN ANY NEGATIVE WAY ON ANYONE AT OUR DEPARTMENT OR ON THE STAFFING DECISIONS OR NUMBERS THAT Y'ALL HAVE MADE.

SO, I JUST WANT TO BE CLEAR ABOUT THAT.

WE APPRECIATE THE SUPPORT, MORE OFFICERS AS GOOD.

THANK YOU VERY MUCH. ABSOLUTELY.

AND IF I GUESS IF WE COULD HEAR FROM STAFF ON THE, WHETHER IT'S FROM THE ASSISTANT CITY MANAGER OR FROM MR. WATSON, IF HE'S HERE, IF WE COULD JUST HEAR FROM SOMEBODY FROM A BUDGETING PERSPECTIVE, ARE WE GOOD ON THIS? I THINK WE ARE IF WE HAVE ENOUGH MONEY IN THE [INAUDIBLE] AS WE ARE, SO, I DON'T WANT TO HAMSTRING ANYBODY. WE'RE RUNNING ON THE FLY HERE, SO WE'VE GOT BALLPARK NUMBERS.

BUT IT LOOKS LIKE FOR ONE LIEUTENANT AND TWO ADDITIONAL POLICE OFFICERS, IT'S ABOUT $480,000. AND WE'VE PRORATED THAT FOR THIS YEAR FOR THE REMAINING PORTION OF THIS YEAR, AND WE WOULD UTILIZE ONE TIME FUNDS TO DO THAT.

I WOULD CAUTION COUNCIL THAT OBVIOUSLY THAT MEANS NEXT YEAR THERE-- THAT NUMBER WILL BE ROUGHLY DOUBLE.

SO, CLOSE TO A MILLION DOLLARS AND WE WOULD GO AHEAD AND BASICALLY FACTOR THAT IN AS WE MOVE THROUGH THE BUDGET PROCESS TO HAVE THOSE THREE ADDITIONAL OFFICERS IN THE BUDGET.

RIGHT. SO, WE'RE BASICALLY BAKING IT INTO THE BUDGET GOING FORWARD, CORRECT? NEXT YEAR'S BUDGET. BUT WE HAVE ENOUGH MONEY-- AS A ONE TIME CHARGE, WE'RE GOOD ON ONE TIME CHARGES FOR THIS? INTO THE OPERATING BUDGET FOR NEXT YEAR.

OK. AND WE JUST HAVE TO FIND SOMEWHERE TO FIND THE VEHICLES BECAUSE NOBODY HAS NEW VEHICLES ANYMORE? RIGHT.

ANYBODY AT HOME WANTS TO SELL A, YOU KNOW, TAHOE TO THE CITY.

LIGHTLY USED. YEAH, LIGHTLY.

[LAUGHTER] YEAH, EXACTLY.

I'M JUST KIDDING. SO, WE'RE GOOD AT-- SO, YOU'RE GOOD FROM A FINANCIAL PERSPECTIVE ON THIS? FINANCIAL PERSPECTIVE, WE CAN MAKE THIS WORK IF COUNCIL DESIRES.

YES. YOU'RE THE GOOD ON THE REAL NUMBERS AND MS. BELL WAS GOOD ON THE PRETEND NUMBERS.

JUST KIDDING. SORRY, I CAN'T HELP IT.

OK, THANK YOU. SURE.

VERY GOOD. I DON'T HAVE ANYONE ELSE IN THE QUEUE.

IS THERE ANY FURTHER DISCUSSION ON THIS ITEM? OK, THEN AND I JUST HAVE A QUICK QUESTION FOR THE CITY ATTORNEY REAL QUICK.

SHOULD WE-- THE COUNCILMAN HAS ASKED TO COMBINE ITEMS 11 AND 12, SHOULD WE DEAL WITH THEM INDIVIDUALLY AND JUST-- OR BOTH AS AMENDED? IS THAT THE APPROACH? AS REVISED. OR AS REVISED? SORRY, YOU HAVE TO DO THAT.

HERE YOU GO. I WOULD SAY YOU CAN DO THEM TOGETHER IF YOU DESIRE AND JUST SAY AS REVISED OR AS AMENDED.

THANK YOU. MR. ENGLAND, DO I NEED THE SPECIFIC NUMBERS IN THERE IN TERMS OF DOLLARS OR CAN I JUST DO IT ON THE FLY WITH THE--? I THINK IF THEY CAN GIVE YOU SOME NUMBERS THAT ARE RELATIVELY CLOSE, THAT WOULD BE HELPFUL. YEAH, AND I THINK THEY PROBABLY HAVE THOSE AT HAND.

IF NOT, THEN WE CAN DO IT ON THE FLY, BUT I'M PRETTY SURE THEY HAVE THOSE NUMBERS FOR YOU . MR. WATSON. SO, IF WE TAKE THE-- SO NOW, THE WHOLE ENCHILADA.

THE TOTAL FOR THE WHOLE BUDGET AMENDMENT IS $972,042 DOLLARS.

AND THAT'S IN-- TO AMEND THE--.

FY 22 BUDGET.

FY 22 BUDGET.

OK, THANK YOU.

THANK YOU, SIR. WELL, HANG ON, I THINK.

DO YOU HAVE SOMETHING ELSE? YOU HAVE THE CIVIL SERVICE COUNTS TOO, BECAUSE WE'LL NEED TO--. WE'LL HAVE TO AMEND THOSE TOO, AND THAT'S GOING TO HAVE TO BE TO ADD ONE, I THINK IT'S ACTUALLY CALLED POLICE SUPERVISOR, WHICH WOULD GIVE US 40 AND IN ABOVE WHAT YOU'VE GOT, WHAT WE HAVE ON PAPER, TWO MORE OFFICERS, WHICH WOULD BRING US TO 305 OFFICERS, 359 TOTAL BUDGETED POSITIONS.

AND THEN I NOTICE THAT THE EFFECTIVE DATE ON THE ORDINANCE WAS WAS ACTUALLY SET OFF, BUT TO BE EFFECTIVE, BOTH OF THESE ORDINANCES TO BE EFFECTIVE ON PASSAGE.

YES. AM I IN THE RIGHT BALLPARK.

OK, LET'S SEE IF I CAN MAKE THIS MOTION.

[00:40:01]

[LAUGHTER] OK.

I HAVE FAITH IN YOU. THERE ARE A FEW-- THIS MIGHT BE MORE COMPLICATED THEN THE MOTION TO FOR THE CONDEMNATIONS.

SO COUNCIL, WITH THAT, I MOVE THAT WE APPROVE BUDGET AMENDMENT NUMBER ONE WITH THE REVISIONS TO BE AN ADDITION TO ADD ONE ADDITIONAL POLICE SUPERVISOR AND TWO NEW ADDITIONAL POLICE OFFICERS FOR A TOTAL OF FOUR.

IN ADDITION TO THE OTHER POSITIONS THAT ARE LISTED THERE WITH A TOTAL BUDGET IMPACT TO FISCAL YEAR 2022 OF $972,042 DOLLARS IN THAT, WE ALSO AMEND THE CIVIL SERVICE ORDINANCE REFERENCE IN ITEM 12 THAT WE PASSED THAT WITH THE REVISION TO THE TOTAL POLICE BUDGETED POSITIONS TO BE 359.

NUMBER OF POLICE OFFICERS POSITIONS TO 305.

AND POLICE SUPERVISOR POSITIONS TO 40 AND ALSO ENSURE THAT THE EFFECTIVE DATE OF BOTH OF THE ORDINANCES IS JANUARY 18TH, 2022.

AND THAT INCLUDES UPDATING THE EFFECTIVE DATES ON THE ATTACHED EXHIBITS AS NECESSARY.

VERY GOOD AND I HAVE CONFIRMATION FROM THE CITY ATTORNEY'S OFFICE THAT THOSE ITEMS WORK AND I HAVE A SECOND BY COUNCIL MEMBER VERA.

ANY FURTHER DISCUSSION? SEEING NONE. MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE.

AND AS YOU SAID, THIS IS STILL COMBINING ITEMS 11 AND 12 AS AMENDED.

COUNCIL, IF YOU COULD PLEASE VOTE.

AND DISPLAY THE VOTE FOR ME, PLEASE, AND COUNCIL MEMBER MOORE AND COUNCIL MEMBER BASS ARE VOTING IN THE AFFIRMATIVE, AND THAT MAKES IT UNANIMOUS.

THANK YOU. THANK YOU.

ALL RIGHT, NEXT, WE ARE MOVING ON TO HOLD PUBLIC HEARINGS, ITEM 13.

[Items 13A & 13B]

WE HAVE ZONING CASE THAT ACTUALLY IS IN TWO PARTS.

ITEM 13 A IS CONSIDERED A ZONING REQUEST BY LARS ANDERSON AND ASSOCIATES INC.

TO EXPAND THE EXISTING HOME DEPOT FOR TOOL AND RENTAL CENTER AND STORAGE ROOM, AND PROPOSED OUTDOOR RENTALS FOR EQUIPMENT AND TRUCKS.

THIS PROPERTY IS LOCATED AT 3261 NORTH PRESIDENT GEORGE BUSH TURNPIKE IN DISTRICT ONE.

THE SECOND PART OF THIS ITEM 13 B, IS TO CONSIDER A DETAILED PLAN.

SAME APPLICANT. SAME ADDRESS.

MR. GUERIN.

MAYOR, COUNCIL, GOOD EVENING.

AS YOU STATED, MAYOR, THIS IS A PROPOSAL TO EXPAND THE EXISTING HOME DEPOT IN NORTH GARLAND FOR A TOOL RENTAL CENTER AND STORAGE ROOM, AND FOR OUTDOOR RENTALS FOR EQUIPMENT AND TRUCKS. THE LOCATION IS 3261 NORTH PRESIDENT GEORGE BUSH TURNPIKE.

THE ACREAGE OF THE EXISTING SITE IS APPROXIMATELY 11.66 ACRES AND THE ZONING IT IS WITHIN A PD, PD DISTRICT 97-23.

HERE'S THE GENERAL LOCATION OF THE SUBJECT SITE INDICATED BY THE RED STAR HERE NEAR SH 190 AND CRIST ROAD, AND ZOOMED IN HERE ON THE ZONING MAP AND THE SUBJECT SITE IS OUTLINED IN THIS TEAL COLOR HERE.

THIS IS THE EXISTING HOME DEPOT BUILDING AND THE EXISTING PARKING LOT OUT FRONT BETWEEN THE BUILDING AND SH 190.

CRIST ROAD ABUTS THE SUBJECT PROPERTY TO THE EAST AND TO PARTIALLY TO THE SOUTH AS WELL.

THE SITE IS MOSTLY SURROUNDED BY OTHER RETAIL DEVELOPMENTS ZONED IN PDS FOR COMMUNITY RETAIL. THERE'S A BEST BUY TO THE EAST ACROSS CRIST ROAD.

THERE'S A KOHL'S JUST TO THE WEST AND THEN FURTHER TO THE SOUTH AS SOME ADDITIONAL RETAIL AND COMMERCIAL DEVELOPMENT AND FURTHER TO THE SOUTH AND SOUTHEAST IS A RESIDENTIAL DEVELOPMENT AND ACROSS SH 190 IS THE WILL TOWN CENTER AREA.

THE COMPREHENSIVE PLAN IDENTIFIES THIS SITE IN GENERAL AREAS COMMUNITY CENTERS.

THE EXISTING SITE AND ZONING AND DEVELOPMENT IS IN CONFORMANCE WITH THE COMMUNITY CENTER'S DESIGNATION. IT IS A RETAIL AND KIND OF ANCHOR RETAIL STORE THAT SERVES THE NEARBY NEIGHBORHOODS. HERE'S SOME PHOTOS OF THE AREA.

THE ONE ON THE LEFT IS THE SUBJECT PROPERTY LOOKING AT THE FRONT OF THE HOME DEPOT AND THE, OF COURSE, THE PARKING LOT IN THE FOREGROUND THERE, AND THEN SOME SURROUNDING PHOTOS TO THE RIGHT AS THE VIEW OF THE PROPERTY LOOKING ACROSS AT SH 190, YOU CAN SEE THE AMC

[00:45:04]

MOVIE THEATER TO THE NORTH AND THEN THE KOHL'S TO THE WEST AND BESTBUY TO THE EAST ACROSS CRIST ROAD, AS I MENTIONED EARLIER.

HERE'S THE PROPOSED SITE PLAN.

THE APPLICANT PROPOSES TO EXPAND THE BUILDING JUST TO THE EAST, KIND OF INDICATING HERE FOR THE TOOL RENTAL CENTER AND STORAGE ROOM.

AND THEN THE APPLICANT ALSO PROPOSES TO HAVE OUTDOOR TRUCK RENTALS IN THESE DESIGNATED SPACES HERE.

SHOWN HERE ON THE SITE PLAN, IF YOU CAN SEE THAT.

THERE ARE EIGHT STANDARD PARKING SPACES THAT THEY WOULD BE TAKING UP, HOWEVER, THE TRUCKS WOULD KIND OF PULL IN TO THESE SPACES WHERE YOU HAVE KIND OF TWO IN A ROW.

SO, IN OTHER WORDS, THERE WOULD REALLY JUST BE FOUR, A MAXIMUM OF FOUR TRUCKS IN THOSE SPACES. SO, THAT WOULD BE THE LOCATION OF THE TRUCK RENTALS.

THESE WOULD BE HOME DEPOT TRUCK RENTALS.

THESE WOULD NOT BE THIRD PARTIES SUCH AS PENSKE TRUCKS THAT YOU SOMETIMES HAVE SEEN AT OTHER HOME DEPOT SITES.

SO, THESE WOULD BE THEIR OWN FLEET OF TRUCK RENTALS.

AND THAT'S AN EXAMPLE OF SOME OF THE TRUCKS OF WHAT THEY LOOK LIKE RIGHT THERE.

I BELIEVE THAT'S TAKEN FROM THE HOME DEPOT IN ROWLETT.

SO, THAT'S AN EXAMPLE OF WHAT THEY LOOK LIKE.

AND THEN THE APPLICANT ALSO PROPOSES TO HAVE SOME DISPLAYS OF THE EQUIPMENT FOR RENT JUST TO THE EAST OF THE BUILDING EXPANSION.

SO, LOCATING IT HERE, THAT WOULD BE 10 PARKING SPACES THAT WOULD BE RESERVED FOR THE EQUIPMENT. THE OVERALL SITE WOULD STILL BE IN PARKING COMPLIANCE WITH THE GDC, AND THAT'S SOME OF THE EXAMPLES OF THE RENTALS.

I BELIEVE I PUT IN YOUR PACKET SOME OTHER PHOTOGRAPHIC EXAMPLES AS WELL, BUT SOME OF THE EQUIPMENT TO GIVE SOME EXAMPLES INCLUDE OF TRENCHERS, TRACTOR LOADER, BACKHOES, SKID STEERS AND MANY EXCAVATORS.

AND THIS WAS ACTUALLY AN EXHIBIT THE APPLICANT PROVIDED EARLIER.

JUST TO KIND OF HONE IN ON THE POINT THAT THESE ARE NOT PENSKE TRUCKS THAT WE'VE SEEN AT SOME OTHER HOME DEPOT LOCATIONS.

THESE AGAIN, WOULD BE HOME DEPOT'S OWN FLEET.

SO, HERE HERE ARE SOME EXAMPLES THAT THE APPLICANT HAS PROVIDED, AND THEY JUST MADE A POINT HERE THAT. I'LL KIND OF GO THROUGH THIS A LITTLE BIT MORE, GIVE A HISTORY OF HOW THE SITE PLAN HAS EVOLVED, BUT THEY HAVE MOVED THE TRUCKS FURTHER TO THE WEST INTO THE PARKING LOT. I'LL KIND OF GO THROUGH THAT A LITTLE BIT MORE HERE.

BUT THE APPLICANT DOES STATE THAT THE PROPOSALS GO HAND IN HAND.

THEY ARE CONJUNCTION WITH ONE ANOTHER, THE TOOL RENTAL CENTER AND THE EQUIPMENT RENTALS THEY WISH TO HAVE IN CONJUNCTION WITH ONE ANOTHER.

THIS IS JUST A ZOOM IN OF THE SITE PLAN OF THE BUILDING EXPANSION OVER HERE AND THEN THE LOCATION OF THE EQUIPMENT RENTALS.

THE APPLICANT WOULD BE PROVIDING A SCREENING, LANDSCAPE SCREENING, TO HELP SCREEN THE EQUIPMENT RENTAL AREA.

I HAVE A PHOTOGRAPH I'LL SHOW HERE IN A LITTLE BIT OF THAT, BUT JUST TO GIVE A LITTLE HISTORY OF KIND OF WHERE THE CASE WAS AND KIND OF HOW WE GOT TO TODAY, THE APPLICANT HAS MADE A FEW CHANGES ALONG THE WAY FROM THE INITIAL SUBMITTAL AND WHAT WAS PRESENTED TO PLAN COMMISSION AND THEN WHERE IT IS TODAY.

SO, WHEN IT WAS BROUGHT FORWARD TO THE PLANNING COMMISSION, THE ORIGINAL REQUEST WAS TO HAVE THE EQUIPMENT RENTALS HERE STILL ALONG CRIST ROAD, BUT A LITTLE BIT FURTHER TO THE NORTH, KIND OF IN THE GENERAL PARKING LOT AREA.

THE APPLICANT DID NOT PROPOSE ANY ADDITIONAL SCREENING AT THAT TIME AND THEN THE TRUCK RENTALS WERE SHOWN HERE.

SO, JUST KIND OF ONE PARKING AISLE INTO THE SITE FROM CRIST ROAD AND THEN THE PLAN COMMISSION FOLLOWING THAT MEETING BETWEEN THEN AND THE COUNCIL MEETING ON JANUARY 4TH, WHICH OF COURSE, THE COUNCIL HAD POSTPONED IT TO THIS EVENING.

BUT WHAT WAS AT LEAST GOING TO BE PRESENTED THAT NIGHT WAS THE APPLICANT-- THE ONLY CHANGE THE APPLICANT HAD MADE BETWEEN THE PLANNING COMMISSION MEETING AND JANUARY 4TH WAS ADDING LANDSCAPE SCREENING HERE ALONG CRIST ROAD TO HELP SHIELD THE EQUIPMENT.

SO, WHAT THE APPLICANT HAS CHANGED BETWEEN JANUARY 4TH AND NOW, AND THIS IS THE SAME SITE PLAN ESSENTIALLY THAT I JUST SHOWED YOU ALL BUT.

BUT THE APPLICANT HAS MOVED THE EQUIPMENT, AS I SHOWED EARLIER TO THE DOWN HERE TO THE EASTERN SIDE OF THE BUILDING, A LITTLE BIT CLOSER TO THE ACTUAL TOOL RENTAL CENTER LOCATION. AND THEY HAVE MOVED THE TRUCKS TO ADDITIONAL PARKING AISLES FURTHER WEST INTO THE PARKING SITE HERE, AND THE APPLICANT STILL DOES PROPOSE THE LANDSCAPE SCREENING TO HELP SCREEN THE EQUIPMENT.

AND THIS JUST KIND OF SHOWS A LITTLE ZOOM IN OF THE LANDSCAPING, BUT ON THE RIGHT HAND SIDE, THERE'S JUST A LITTLE PHOTOSHOP OF THE PROPOSED LANDSCAPING THERE.

BE SOME EVERGREEN SHRUBS THAT WOULD HELP SCREEN THE EQUIPMENT.

[00:50:05]

[INAUDIBLE] THE BUILDING ELEVATIONS.

THE APPLICANT INTENDS TO ESSENTIALLY MATCH THE EXISTING BUILDING.

THIS COMPLIES WITH THE GDC, SO EXPANDING IT FOR THE TOOL RENTAL CENTER.

STAFF'S RECOMMENDATION IS APPROVAL OF THE REQUEST.

WE'VE ADDED A SUGGESTION, HOWEVER, TO FURTHER MINIMIZE VISUAL IMPACT FROM THE STREET VIEW, THE COUNCIL MAY CONSIDER REQUIRING THE RENTAL TRUCKS AT THE REAR OF THE BUILDING, WHERE THERE IS SCREENING ALREADY IN PLACE.

THERE'S A MASONRY WALL AND LANDSCAPE SCREENING TOWARDS THE REAR OF THE BUILDING ALONG CRIST ROAD, SO JUST ONE SUGGESTION WE WANTED TO INCLUDE THERE.

AS FOR THE PLAN COMMISSION'S RECOMMENDATION ON DECEMBER 15TH, THE COMMISSION VOTED SIX TO ONE APPROVAL OF THE REQUEST.

HOWEVER, THEY APPROVED A RECOMMENDED APPROVAL OF THE BUILDING EXPANSION, BUT NOT FOR THE OUTDOOR TRUCK RENTALS AND EQUIPMENT RENTALS.

SO, IN RESPONSE, AS I MENTIONED EARLIER, THE APPLICANT PROPOSED ADDITIONAL LANDSCAPING MINIMUM SIX FEET IN HEIGHT ALONG CRIST ROAD TO SCREEN THE EQUIPMENT.

AND THEN, AFTER THE COUNCIL POSTPONED FROM THE JANUARY 4TH MEETING, THE APPLICANT HAS RELOCATED THE EQUIPMENT TO THE EASTERN SIDE OF THE BUILDING AND ADDED THE LANDSCAPING MINIMUM SIX FEET IN HEIGHT ALONG CRIST ROAD TO HELP SCREEN THAT EQUIPMENT.

AND THE APPLICANT HAS ALSO RELOCATED THE TRUCK RENTAL LOCATION FURTHER WEST IN THE PARKING LOT TO MAKE IT LESS VISIBLE FROM CRIST ROAD.

SO, WITH THAT MAYOR, WE MAILED OUT TWENTY SIX NOTIFICATION LETTERS FOR THIS CASE AND WE DID NOT RECEIVE ANY RESPONSES.

VERY GOOD. ANY QUESTIONS FOR STAFF ON THIS ITEM? COUNCIL MEMBER VERA.

WELL, IS ALL THIS EQUIPMENT, IS THAT GOING TO BE FENCED IN? I DON'T BELIEVE IT WOULD BE FENCED IN.

THERE WOULD BE RESERVED KIND OF SIGNAGE FOR IT IN THOSE PARKING SPACES.

IT WOULD BE OPEN? IT WOULD BE OPEN.

THAT'S MY UNDERSTANDING. YES, SIR.

EXCEPT WAS [INAUDIBLE] PLANTING [INAUDIBLE] IN FRONT OF IT? YES, SIR. EXACTLY.

THE PLANTING WOULD BE, YEAH, KIND OF BETWEEN THE EQUIPMENT AND CRIST ROAD.

YES. THAT'S IT. THAT'S ALL.

THANK YOU, MAYOR. THANK YOU, SIR.

DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MAYOR. GOOD EVENING, MR. GUERIN. WOULD YOU GO BACK TO THAT SLOT WHERE YOU HAD RECOMMENDATIONS FOR THE PLANNING COMMISSION OR STAFF? YEAH, RIGHT THERE.

OK. YES SIR.

WOULD YOU CLARIFY FOR ME SCREENING OPTIONS IN YOUR LAST PARAGRAPH THAT YOU TALK ABOUT? CAN YOU ELABORATE A LITTLE BIT ON THAT FOR ME? SURE. WELL, THE-- AND ACTUALLY, I HAVE A PHOTO THAT MAYBE HELP ILLUSTRATE THAT A LITTLE BIT BETTER KIND OF AS A BACKUP HERE.

THIS JUST SHOWS THE STREET VIEW FROM CRIST ROAD.

THIS IS THE REAR OF THE HOME DEPOT BUILDING, SO LOOKING KIND OF NORTH TOWARDS THE BACK OF THE BUILDING. AS YOU CAN SEE HERE, THERE'S AN EXISTING MASONRY SCREENING WALL.

THERE'S THE DRIVEWAY WHERE I THINK SOME OF THE LOADING TRUCKS AND WHATNOT GO IN AND OUT.

AND THEN THERE'S A PRETTY DENSE ROW OF VEGETATION OVER HERE, KIND OF ON THE SOUTHWESTERN SIDE OF THE SITE. SO, THAT WAS THE SUGGESTION, YOU KNOW, THAT THE TRUCKS PERHAPS COULD GO BACK THERE. I DON'T KNOW HOW MUCH THE APPLICANT HAS VETTED THAT OR CONSIDERED THAT.

I DO KNOW, OR AT LEAST MY UNDERSTANDING FROM THEM, IS THEY DO WISH TO HAVE THE TRUCK RENTALS AND EQUIPMENT RENTALS VISIBLE TO THE PUBLIC SO THAT THEY [INAUDIBLE] THE CUSTOMERS AT LEAST. SO, THAT THE CUSTOMERS ARE AWARE THAT THOSE ARE ITEMS THAT CAN BE RENTED, AND SO THEY-- I BELIEVE IT IS THEIR INTENT AND DESIRE TO HAVE THOSE VISIBLE TO THE PUBLIC. BUT THAT WAS JUST A KIND OF A SUGGESTION.

WE'RE KIND OF LOOKING AT THE SITE PLAN.

THERE MIGHT BE SOME SPACE BACK THERE AGAIN THAT HASN'T BEEN FULLY VETTED OR REVIEWED, TO MY KNOWLEDGE, BUT JUST KIND OF SOMETHING TO CONSIDER.

USING THAT PHOTO AND YOUR ARROW POINT AGAIN-- WE'VE LOOKED AT THE SITE PLAN.

POINT AGAIN, WHERE THE LOCATION, PER THEIR REQUEST, WILL BE.

SURE. USING THAT SAME PHOTO.

NO, GO BACK TO YOUR PHOTO.

YES, SIR. USING YOUR POINTER, POINT TO ME-- TO US EXACTLY AS PROPOSED.

I DON'T BELIEVE IT'S VISIBLE FROM THIS PHOTO.

NO, IT'S AROUND THE CORNER.

IT'S AROUND THE CORNER FROM THAT RIGHT? CORRECT. YES, SIR. OK, BUT AS PROPOSED IT WILL BE VISIBLE FROM CRIST? THE-- I'LL KIND OF GO BACK TO THE SITE PLAN.

THE EQUIPMENT RENTALS SHOULDN'T BE VERY VISIBLE, GIVEN THAT THEY WOULD HAVE, AND THERE'S

[00:55:01]

KIND OF A ZOOM IN THE EVERGREEN SHRUBS.

AND AGAIN, THERE'S THE-- THERE'S KIND OF A PHOTOSHOP OF WHAT THOSE WOULD LOOK LIKE, THE EQUIPMENT RENTALS WOULD BE BEHIND THAT.

SO, THAT THE VISIBILITY SHOULD BE FAIRLY MINIMAL FOR THE EQUIPMENT RENTALS, THE TRUCK RENTALS WOULD BE A BIT MORE VISIBLE.

THE APPLICANT IS NOT PROPOSING ANY PARTICULAR SCREENING OTHER THAN JUST KIND OF THAT THEY RELOCATED THEM A LITTLE BIT.

MY QUESTION IS NOT FOR THE TRUCK RENTAL [INAUDIBLE].

OK. THE FIRST AREA HERE WHERE THE SHRUBBERIES ARE, THAT'S WHAT'S BEING PROPOSED AS THE SCREENING TOOL, RIGHT? YES SIR. CORRECT. OF CRIST ROAD? YES, SIR. AND AS YOU KNOW, THAT'S-- OF COURSE I'M GOING TO DEFER TO COUNCILMAN, THE HONORABLE COUNCILMAN FROM DISTRICT ONE ON THIS.

BUT AS YOU KNOW, THAT'S MY CONCERN.

I DON'T-- I'M TRYING TO UNDERSTAND TRUCK RENTALS-- THE KIND OF VEHICLES THAT THEY'RE DESCRIBING. I CAN'T SEE WHERE-- HOW-- WHAT'S THE HEIGHT OF THOSE SHRUBS AS [INAUDIBLE]-- . SIX FEET MINIMUM.

BUT I CAN'T SEE-- AND CRIST ROAD IS A MAJOR THOROUGHFARE IN OUR CITY.

AND I'M JUST UNDECIDED.

BUT I'M TELLING-- I CAN'T SEE HOW THOSE SHRUBBERIES ARE GOING TO SCREEN THAT FROM A MAJOR THOROUGHFARE. AND THAT'S MY CONCERN.

SO, I'M GUESS I'LL WAIT AND HEAR FROM THE APPLICANT AN EXPLANATION ON THAT.

BUT YOU KNOW, IT'S ON-- IF IT WERE LOCATED AT ANOTHER SPOT HERE, IT WOULDN'T CONCERN ME.

BUT I AM CONCERNED THE [INAUDIBLE] SIX FOOT SHRUBS ARE NOT GOING TO SHIELD THOSE VEHICLES FROM FROM CRIST ROAD.

AND THERE'S BEEN A LOT OF WORK DONE ON CRIST.

MUCH IMPROVEMENT.

SO, I'LL WAIT TO HEAR FROM THE APPLICANT ON THAT.

THAT'S MY CONCERN.

ALL RIGHT. THANK YOU. OK, THANK YOU, SIR.

COUNCIL MEMBER BASS. GO AHEAD.

THANK YOU, MAYOR. DO WE HAVE A REPRESENTATIVE FOR THE APPLICANT? WE DO. AND THEY ARE--.

WE DO. OK, [INAUDIBLE].

I KNOW THAT THEY WERE HAVING SOME ISSUES AS WELL.

OK, I'LL ABSTAIN FOR NOW.

I'LL WAIT UNTIL THE APPLICANT SPEAKS AND THEN I'LL TALK.

THANK YOU. THANK YOU, MAYOR. THANK YOU, SIR.

ANY FURTHER QUESTIONS FOR STAFF BEFORE WE MOVE TO THE APPLICANT? MADAM SECRETARY, I BELIEVE YOU SAID WE HAD AN ONLINE SPEAKER.

IS THAT WITH THE APPLICANT? YES. OK.

BUT I HAVE A SPEAKER IN PERSON.

SO, IS ONE OR THE OTHER OR BOTH GOING TO BE MAKING THE PRESENTATION? THAT'S WHAT I'M TRYING TO-- DO WE KNOW THAT INFORMATION? I'M WITH MAYNARD CONSULTING [INAUDIBLE] REPRESENTATIVE OF--.

OK. ALL RIGHT.

WE'LL BRING OUR IN PERSON SPEAKER, JASON PYKA.

JASON, IF YOU COULD COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND THEN YOU WILL HAVE 10 MINUTES TO MAKE YOUR PRESENTATION OR JUST ANSWER QUESTIONS.

MAYOR COUNCIL MEMBER, THANK YOU FOR YOUR CONSIDERATION TONIGHT.

MY NAME IS JASON PYKA WITH MAYNARD CONSULTING.

WE'RE AN AGENT OF LARS ANDERSON WHO'S THE APPLICANT.

MY ADDRESS IS 12225 GREENVILLE AVENUE IN DALLAS, TEXAS.

TO ANSWER A LITTLE BIT OF YOUR QUESTIONS, MR. VERA. THE INTENT OF THE RENTAL EQUIPMENT THAT IS BEING SCREENED OVER THERE WILL BE ON TRAILERS READY FOR CUSTOMER PICKUP DAY.

SO, IT'S SMALL DIY HOME EQUIPMENT.

IT'S SMALL TRENCHERS THAT-- AND LANDSCAPING EQUIPMENT, SMALL BACKHOES AND SKID SKIERS THAT YOU'RE GOING TO GO AND DO SOME SMALL LANDSCAPING STUFF.

NOTHING THAT'S GOING TO BE LARGE CONSTRUCTION EQUIPMENT, OF COURSE, THE DIVERS TO THOSE LARGER RENTAL EQUIPMENTS.

THIS IS FOR THE HOMEBUILDER.

THIS IS FOR THE-- OR THE DIY HOME BUILDER.

SOMEBODY LIKE ME WHO LIVES UP SEVENTY EIGHT A LITTLE BIT THAT NEEDS TO DO A LITTLE BIT MORE THAN JUST WITH A SHOVEL, BUT STILL WANTS TO KEEP IT IN HOUSE.

TO ANSWER YOUR QUESTION, DEPUTY MAYOR PRO TEM, IT IS GOING TO BE ON TRAILERS, BUT IT IS THOSE SMALL LITTLE TRENCHERS.

MOST OF THE EQUIPMENT IS UNDER SIX FEET IN HEIGHT.

THE SKID STEER WILL GET TO THAT POINT, BUT I BELIEVE IN THE PACKET.

THERE IS SOME EXAMPLES OF THAT EQUIPMENT.

YOU CAN CLEARLY SEE THAT MOST OF THEM ARE LOWER IN HEIGHT, SO THEY'RE SMALLER IN HEIGHTS.

SO, I MEAN, I CAN'T CONFIRM OR DENY THAT THE NATURE OF THE SHRUBBING.

BUT THE INTENT IS TO FULLY SCREEN IN A SOLID SCREENING WALL OF EVERGREEN SHRUBBERY FROM CRIST ROAD. SO, IF A CAR IS DRIVING BY AT FOUR FEET HIGH, THE SHRUBS ARE SIX FEET IN HEIGHT. THE VIEW ANGLE SHOULD SHOULD TAKE CARE OF MOST OF THAT SCREENING AS BEST AS WE COULD ALLOW IN THAT LANDSCAPING AREA.

AND THEN OTHER THAN THAT, IT'S THE-- JUST WANTED TO MAKE NOTE OF THE TRUCKS.

[01:00:02]

LIKE THE STAFF MENTIONED, THERE'S EIGHT PARKING SPOTS PROPOSED TO BE RE STRIPED AS PULL THROUGH SITES, BUT THERE'S ONLY GOING TO BE FOUR VEHICLES OUT THERE.

JUST WANTED TO MAKE NOTE THAT THIS IS A BIG MARKETING INITIATIVE FOR HOME DEPOT TO HAVE THIS IN THE FRONT OF THE STORE.

CUSTOMERS DON'T KNOW THAT THERE'S TRUCKS FOR RENTALS, THEY DON'T KNOW THAT THERE'S THIS EQUIPMENT FOR RENTAL IF THERE TUCKED IN THE BACK.

THIS IS ONE OF THOSE POINT OF SALE ITEMS THAT THEY CAN COME IN AND SEE, AND THEY NEED SOME LUMBER AND THEY'RE DRIVING A COROLLA IN THERE AND REALIZE, OH, I CAN RENT THIS TRUCK FOR $20 AN HOUR AND I CAN JUST LOAD IT INTO THE TRUCK DRIVING HOME AND BRING IT BACK.

NOW I CAN GET MY EQUIPMENT HOME.

UNFORTUNATELY, IF IT'S IN THE BACK OF THE STORE IT IS A HUGE LOSS OF REVENUE FOR [INAUDIBLE] AND IT IS A BIG INITIATIVE FOR [INAUDIBLE] TO HAVE IT.

WITH THAT, IT IS THE HOME DEPOT VEHICLES, IT IS THE MAINTAINED AND OWNED-- THEY DO HAVE THEIR OWN RENTAL FLEET NOT RENTING TO A THIRD PARTY LIKE PENSKE TRUCKS OR ANYTHING LIKE THAT. SO, IT IS THEIR OWN VEHICLES, THEIR SMALLER VEHICLES IT'S F250S.

IT'S A SMALLER BOX TRUCK, IT'S A 12 FOOT BOX TRUCK, A VAN AND ANOTHER FLATBED TRUCK THAT'S ALLOWABLE FOR RENTAL USE.

ONE OF THE NOTES WITH THIS IS IT IS A SALES PLOY TO DO THIS.

THEY DO NOT RUN-- THE RENTALS FOR THESE VEHICLES IS NOT TO MAKE MONEY FOR HOME DEPOT, IT IS TO INCREASE THE SALES FROM THEIR STORE.

SO, PART OF THEIR INITIATIVE IS TO PROVIDE THE CUSTOMER A SOURCE TO GET THE LARGER AMOUNTS OF EQUIPMENT HOME SO THEY'RE NOT WALKING OUT OF THE STORE AND HAVING TO COME BACK OR GO TO LOWE'S OR SOMEWHERE ELSE TO GET THE LARGE PALLETS OF LUMBER OR ANYTHING LIKE THAT, THAT THEY CAN'T GET HOME IN THEIR NORMAL DAY TO DAY VEHICLE.

OTHER THAN THAT, AGAIN, WE APPRECIATE YOUR CONSIDERATION TONIGHT.

I'M HERE TO ANSWER ANY QUESTIONS.

ALSO, JANAY WITH LARS ANDERSON IS ON THE LINE.

SHE'S ON THE ZOOM CALL AS WELL.

SHE CAN ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE AS WELL.

BUT AGAIN. OK.

APPRECIATE YOUR CONSIDERATION TONIGHT.

COUNCIL MEMBER VERA. THANK YOU.

THANK YOU, MAYOR. IS THIS GOING TO LOOK LIKE THE ONE IN NORTHWEST HIGHWAY AND SKILLMAN? I CAN'T. IT'S BEEN A WHILE SINCE I'VE BEEN DOWN TO THAT [INAUDIBLE].

I CAN'T ANSWER TO THAT.

BECAUSE THEY HAVE THE SAME THING.

A ROW, BUT IN THE BACKSIDE OF THE PARKING LOT, THEY HAVE THOSE BIG BOX TRUCKS FOR RENT, YOU KNOW, U-HAUL OR WHATEVER IT IS.

I CAN CONFIRM THEY WILL NOT-- THIS WILL BE THE HOME DEPOT [INAUDIBLE].

OK.

WILL NOT BE A THIRD PARTY VEHICLE.

OK, THANK YOU.

THANK YOU, MAYOR. THANK YOU, SIR.

MAYOR PRO TEM HEDRICK.

THANK YOU, MR. MAYOR. CAN YOU GO TO THE REASONING WHY YOU MOVED THE TRUCK AREA FROM THE PLANNING COMMISSION OVER BY CRIST ROAD TO THE ENTRANCE NEAR GEORGE BUSH? THE INTENT WAS THERE TO, I BELIEVE, WITH THE DISCUSSIONS WITH STAFF AND THE COUNCIL MEMBER FROM DISTRICT ONE WAS TO GET THAT FURTHER INTO THE SITE AWAY FROM CRIST ROAD.

I THINK SOME OF THE CONCERN WITH THE DISCUSSION AT THAT TIME WAS THE VISIBILITY FROM THAT HARD CORNER OF CRIST ROAD AND THE ACCESS ROAD OF GEORGE BUSH THERE WAS CONCERNING.

FOR BOTH THE OUTDOOR RENTAL EQUIPMENT AND THE TRUCKS.

SO, MOVING THEM INTERIOR TO THE SITE, IT STILL GETS THEM IN A VISIBILITY FOR CUSTOMERS, BUT IT'S FURTHER AWAY FROM THE PATRONS THAT ARE DRIVING DOWN CRIST ROAD.

THANK YOU. THANK YOU, MR. MAYOR. THANKS, SIR.

DEPUTY MAYOR PRO TEM WILLIAMS. THANK YOU, MAYOR. THANK YOU, SIR, AND THANK YOU FOR YOUR EXPLANATION.

JUST A COUPLE OF POINTS.

AGAIN, GOING BACK TO THE SCREENING.

NOW, ON CRIST ROAD, YOU SAID, TELL ME AGAIN THE HEIGHT THAT YOU--.

I BELIEVE THE PROPOSED DISCUSSED WITH STAFF IS SIX FOOT SOLID EVERGREEN SCREENING ALONG CRIST ROAD.

IS THAT GOING TO BE INITIALLY DONE? ARE WE GOING TO NEED GROWTH TIME? I BELIEVE IN THAT COULD BE A QUESTION FOR JANAY TO ANSWER, BUT I BELIEVE IT'S PLANTED AT SIX FEET, CORRECT? IT'S GOT TO ORIGINALLY BE SIX FEET.

IT'S GOING TO BE SO IT WON'T NEED GROWTH TIME TO GET TO SIX FEET? I WOULD HAVE TO CONFIRM WITH STAFF ON THAT.

BUT--.

[INAUDIBLE] CAN SOMEBODY CONFIRM THAT FOR ME? WELL, MR. GUERIN.

YES, SIR.

WE COULD CERTAINLY MAKE THAT MORE SPECIFIC IN THE ORDINANCE, BUT I THINK THE EXPECTATION WOULD BE THAT IT WOULD BE PLANTED AT SIX FEET.

YES, SIR. AND THE LANGUAGE THEY PROVIDE US WITH MINIMUM SIX FEET.

SO, I BELIEVE IT SHOULD BE PLANTED AT SIX FEET AND KIND OF GROW FROM THERE.

OK, OK. WELL, I CAN LIVE WITH THAT IF THE INITIAL PLANTING IS SIX, BUT IT WAS GOING TO TAKE SIX YEARS TO GET THERE.

AND AGAIN, I'M REFERRING BACK TO MY COUNCILMAN BASS ON THIS.

BUT THAT'S MY CONCERN.

AND IF WE'RE NOT LOCATED WHERE IT IS, [INAUDIBLE] CRIST ROAD, YOU UNDERSTAND.

[01:05:02]

THAT'S MY CONCERN.

IT'S A MAJOR THOROUGHFARE THAT THE CITY HAS INVESTED A LOT IN AND IT SIGNIFICANT.

AND ONE OF THE OTHER OBSERVATIONS ON KNOWING THE COMPANY THAT YOU REPRESENT, YOU KNOW, THE GARDEN AREA, LAWN MOWERS ARE SCREENED OFF WITH CYCLONE FENCES AND WHATEVER YOU CALL THE GREEN MASH.

SO, SCREENING IS NOT SOMETHING NEW.

SO, CAN YOU, I MEAN, THERE'S A LOT OF STUFF THAT SCREENED.

I'VE BEEN IN THIS STORE A NUMBER OF TIMES.

AND SO, DID YOU EVER CONSIDER ANY ALTERNATIVE THAT WOULD NOT, I'M NOT TALKING ABOUT NECESSARILY A MASONRY-- HAVING TO BUILD A MASONRY WALL.

BUT IF [INAUDIBLE] TO CONSIDER ANY OTHER OPTIONS BECAUSE OF WHERE IT'S LOCATED WITH THE VISIBILITY, I UNDERSTAND THAT THE, YOU KNOW, THE SALES INITIATIVE AND ALL THAT.

BUT BECAUSE OF THE LOCATION, BECAUSE OF THE TRAFFIC VOLUME AND THE TRAFFIC PATTERNS AT THIS LOCATION, WHICH IS VERY CRITICAL.

HAVE YOU ALL EVEN DISCUSSED OR CONSIDERED OR WOULD YOU CONSIDER ANY OTHER OPTIONS? ABSENT, AGAIN, I'M NOT TALKING ABOUT A MASONRY-- BUILDING AND MASONRY WALL, BUT I'M TALKING ABOUT USING SOME OF THE CURRENT PRACTICES THAT THIS COMPANY USED TO [INAUDIBLE] SCREEN ITSELF. CUSTOMERS STILL KNOW-- YOU KNOW, THEY KNOW WHAT'S IN THE GARDEN CENTER.

THEY KNOW WHAT THE LAWNMOWERS ARE.

SO, THIS DOES NOT TAKE AWAY FROM THE THINGS THAT YOU TALKED ABOUT.

SO, ARE THERE ANY OPTIONS-- ANY OTHER OPTIONS OTHER THAN THE SIX FOOT EVERGREEN SHRUBS THAT YOU ALL PERHAPS COULD CONSIDER THAT WOULD NOT IMPACT YOUR PROJECT? AND MR. WILLIAMS, THANK YOU FOR CONSIDERATION ON THAT.

I'LL HAVE JANEY, WHO'S ON THE ZOOM CALL, WHO'S DEALT [INAUDIBLE] WITH STAFF AND THEN THOSE DISCUSSIONS. SHE CAN ANSWER THAT A LITTLE BIT MORE ARTICULATELY THAN I CAN, AND I THINK SHE'S SLATED NEXT TO SPEAK AND SHE CAN ANSWER QUESTIONS.

OK, I'LL WAIT. I WOULD ASK THE TABLE THAT QUESTION FOR HER.

I WAIT. OKAY.

I'LL WAIT. ALL RIGHT.

THANKS, SIR. THANK YOU, MAYOR.

DO WE HAVE ANY ADDITIONAL QUESTIONS BEFORE WE CAN BRING OUR ONLINE APPLICANT IN? OK, LET'S GO AHEAD AND DO THAT.

MADAM SECRETARY, IF WE CAN CUE UP OUR ONLINE APPLICANT.

HELLO, THIS IS JANAY MOMMER, CAN YOU HEAR ME? YES, MA'AM. IF YOU CAN GIVE US YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE.

MY NAME IS JANAY MOMMER.

ADDRESS IS 4694 WEST, JACQUELYN AVENUE, FRESNO, CALIFORNIA.

AND JUST TO CONFIRM THE LANDSCAPE SCREENING, WE ARE GOING TO INSTALL IT AT SIX FOOT FULL HEIGHT SO THERE WON'T BE A WAITING PERIOD FOR THE GROWTH.

OK, AND HAVE YOU-- I BELIEVE YOU MAY HAVE HEARD THE QUESTION, WERE ANY OTHER SCREENING MATERIALS OR DEVICES PROPOSED OR DISCUSSED? WE CAN REVIEW ANY OTHER SCREENING MATERIALS.

OK. THIS WAS JUST THE-- WE FELT MOST ESTHETICALLY PLEASING OPTION.

OK. AND SO-- MR. GUERIN. SO, WERE ANY OTHER ALTERNATIVE SCREENING METHODS DISCUSSED OR PROPOSED BY STAFF OR SUGGESTED? NO, SIR. I DON'T BELIEVE FOR THE EQUIPMENT [INAUDIBLE].

YES. CORRECT. OK, THANK YOU.

OK, THANK YOU, MA'AM.

ANY FURTHER QUESTIONS FOR THIS ONLINE APPLICANT? I SEE NONE. THANK YOU, MS. MOMMER. MAYOR LEMAY? YES, MA'AM. COUNCIL MEMBER BASS HAS A QUESTION FOR MS. MOMMER. OK, COUNCIL MEMBER BASS.

GO AHEAD. THANK YOU, MAYOR.

THERE HE IS. THANK YOU FOR THE PRESENTATION, GUYS.

AND I DO WANT TO SAY I APPRECIATE THAT YOU GUYS HAVE TAKEN INTO CONSIDERATION THE STAFF AND PLANNING COMMISSIONERS AND MY ADVISEMENT ON MAKING CHANGES TO MAKE THIS MORE PRESENTABLE FOR OUR COMMUNITY AND PRESERVING THE QUALITY OF THE AREA.

SO, I DO WANT TO SAY THANK YOU FOR MAKING AN EFFORT, AND I REALLY APPRECIATE THAT.

AND I THINK THAT THE CONCERNS THAT HAVE BEEN RAISED HAVE BEEN ADDRESSED AND I APPRECIATE YOU GUYS TAKING IT SERIOUSLY AND ADDRESSING OUR CONCERNS.

THAT'S ALL I HAVE. THANK YOU. THANK YOU, SIR.

ANY FURTHER QUESTIONS FOR THE APPLICANT? I GUESS JUST MY OBSERVATION.

AS FAR AS, YOU KNOW, THIS IS THE SUGGESTION OF MOVING THE EQUIPMENT RENTAL PIECES AROUND BACK, I WOULD ALSO IMAGINE, DOES THAT NOT POSE A LOSS PREVENTION VANDALISM ISSUE? CAN YOU-- I MEAN, I WOULD SAY PUTTING THOSE-- I UNDERSTAND THE DESIRE TO WANT TO HAVE

[01:10:04]

THOSE THINGS AWAY FROM THE SIGHTLINES.

BUT I WOULD THINK THAT, THAT ALSO-- NOT ONLY DOES IT IMPACT YOUR SALES PROMOTION OF IT.

MY FEAR IS IT WOULD ALSO INVITE PEOPLE TO MAYBE TAKE THOSE WITHOUT A RENTAL AGREEMENT.

AND YES, MY UNDERSTANDING IS THAT THE SITE IS VIDEO SECURED, BUT THAT'S NOT GOING TO STOP A LOT OF PEOPLE FROM DOING THAT.

SO. RIGHT. BEING MORE VISIBLE TO THE FRONT OF THE STORE, ESPECIALLY DURING DAYTIME AND EVENING HOURS, THAT [INAUDIBLE] TEND TO THAT AS WELL.

I MEAN, THEY ARE SECURED AND THEY ARE [INAUDIBLE] TRAILERS AND THEY'RE LOCKED RIGHT.

BUT I MEAN, PART OF THAT IS THAT ASPECT OF IT.

THE OTHER ASPECT IS THE CUSTOMER CIRCULATION THROUGH THERE THAT, THAT BACK PARKING LOT IS STRICTLY FOR EMPLOYEE PARKING AND LOADING AND UNLOADING OF DISTRIBUTION VEHICLES.

SO, THERE'S REALLY NOT A GOOD CIRCULATION PATH FOR CUSTOMERS TO GET TO THOSE VEHICLES TO LOAD UP THEIR TRUCKS AND TAKE THAT EQUIPMENT AS WELL.

ALL RIGHT, THANK YOU. I HAVE NO ONE ELSE IN THE QUEUE AND I WILL TELL YOU I AM IN SUPPORT OF THE PLAN AS IT'S BEEN PRESENTED AND AMENDED, AND I THANK YOU FOR WORKING THROUGH THE VARIOUS ALTERNATIVES.

AND I'M JUST IMAGINING ALL OF THE TROUBLE I CAN GET INTO OR FUN I CAN HAVE WITH A MINI EXCAVATOR IN MY YARD.

SO.

THAT IS-- I'LL LEAVE MY THOUGHTS AT THAT.

COUNCIL MEMBER BASS, THIS IS IN YOUR DISTRICT, SIR.

YES, SIR. THANK YOU, MAYOR.

I MAKE A MOTION ITEMS 13 A AND B.

THE ZONING REQUEST AND THE DETAILED PLAN MAKE A MOTION TO APPROVE AS PRESENTED.

ANY FURTHER DISCUSSION? MADAM SECRETARY, IF YOU COULD PREPARE THE VOTE FOR US, PLEASE.

COUNCIL. AND DISPLAY THE VOTE FOR US, PLEASE.

AND CASPAR BASS IS A VOTING IN THE AFFIRMATIVE AS WELL AS THE OTHER COUNCIL MEMBERS, SO THIS ITEM IS APPROVED OR THOSE ITEMS 13A AND 13B ARE APPROVED AS MOTION.

THANK YOU. THE NEXT ITEM IS, ITEM 14.

CONSIDER APPOINTMENTS TO BOARDS AND COMMISSIONS.

[14. Consider appointments to Boards and Commissions]

COUNCIL MEMBER AUBIN.
